Emerald City shines on Dallas music scene By David Mullen david@katytrailweekly.com Have you ever heard of the group The Four Grand? Probably not. Have you ever heard of the group the Emerald City Band? If you have spent any time in Dallas, you almost assuredly have since they are the area’s premier jazz, soul, funk and pop band. Emerald City was started by Deno Taglioli 35 years ago. A first generation Italian born in Detroit, Taglioli started college at Wayne State University. “I studied music there – classical, actually – under this guy that was part of the Detroit Symphony,” Taglioli said. He became a percussionist in the Detroit Youth Symphony. “I was being mentored into classical music by my mom,” Taglioli said. “She wanted me to be able to read, she wanted me to write, she wanted me to play the right way and be able to get a job in a symphony. She thought that was a sense of security. She wasn’t the type that wanted me to play drums in a rock band. That wouldn’t sit well with her.”

The Emerald City Band. After two years at Wayne State “a couple of my buddies were getting scholarships at University of Texas, Arlington (UTA),” Taglioli said. “The band leader there was a friend of (Big Band leader) Stan Kenton. It sounded like a great opportunity to play jazz.” Taglioli came to Dallas in 1977. He got a scholarship, graduated from

UTA and then headed to North Texas State (now University of North Texas) to work on his master’s degree in music. He started Emerald City in 1983. The band currently consists of 12 members featuring three horns and five singers including front man Taglioli, who is an accomplished songwriter as well.

“I loved playing pop music,” Taglioli said. “I loved the Motown stuff and I loved playing the three-minute pop song. Should it be the other way around? … It was very strange, on Feb. 5, to flip on HBO before I was about to watch the State of the Union address and see Liam Neesom considering in a recent interview that “he reacted to the rape of someone to whom he was close by loitering outside a pub for a week wanting to murder a black person.” Neeson has declined to name the victim and withholds details to protect their anonymity. The hero inside all of us

My last article introduced the idea that we can be transformed by the power of love. The idea of transformation is nothing new, but our world is often so controlled and predictable that we forget just how powerful raw, natural love can be. The following story shows how we seek goodness and respond to courage and kindness. It might also just be a reminder to us that we have the desire for good inside us. Last summer I heard a story of a beach trip gone awry. If you’re like me, you definitely expect a day at the beach to be fun and relaxing. I imagine a light breeze on my face, the cool water and definitely a cold drink in my hand. But for Roberta Ursrey, a trip to Panama City Beach took a bad turn quickly. Roberta and her husband, mother, nephews and sons were enjoying the sun and sand. Roberta had just left the water, expecting her sons to be right behind her, but when she turned around to look for them, she noticed they were much farther from shore than she remembered. Concerned, she started walking down the beach. And then she heard their screams. They were screaming that they were stuck and being pulled under the water — they had gotten trapped in a powerful rip current. Roberta knew she had to help them, even though people were telling her not to go back out into the water. She jumped in and swam out to them and the rest of her family followed behind her. When they reached the boys, the rip current was much stronger than they realized and despite their best efforts to escape, they were trapped as well — nine people stuck in about 15 feet of water. Back on the beach, Jessica Simmons and her husband had finished lunch and were strolling along the beach. A crowd of people were on the beach watching and pointing and yelling helplessly at Roberta’s family, and that caught Jessica’s attention. Jessica wasn’t the type of person to stand by and simply watch someone who needed help, so when she saw Roberta’s family in trouble, she immediately grabbed a boogie board from the beach, jumped into the water, and started toward them while her husband and a few other men started to form a human chain to bring the swimmers back to shore. As Jessica paddled, the human chain grew, with more than 80 people stretching

more than 100 yards out to the distressed swimmers. Even though some of the people who joined the human chain later admitted they couldn’t swim, they followed Jessica’s Rev. Dr. Girata lead and wanted to do what they could to help. Some stood in the shallows, others stood in water up to their necks, all waiting for Jessica and her husband to cover the last few feet so they could pass the family to shore. What Jessica found at the end of the human chain, she said, was shocking. Roberta’s family was exhausted — her mother’s eyes were rolling back into her head and she was swallowing water. Everyone was exhausted, the waves continuing to drag them under. But one by one, starting with the children, Jessica and her husband, along with the other rescuers, towed the swimmers to the human chain, who then pulled them all to shore. Later, Roberta spoke with a reporter and said, “I am so grateful. These people were God’s angels that were in the right place at the right time. I owe my life and my family’s life to them. Without them, we wouldn’t be here.” Jessica told a reporter that “It was the most remarkable thing to see. These people who don’t even know each other trusted each other that much to get them to safety. We have our own lives and we’re constantly at a fast pace, but when somebody needs help, everybody drops everything and helps. With everything going on in the world, I’m glad to know that people are still good.” We aren’t perfect, and we aren’t as good as we want to be, but the desire to be good is inside each one of us. When we witness moments of true generosity, I am reminded that we will never look into the eyes of someone God does not love. Remember that you are loved and look for all the ways you can show love to every person you meet. The Rev. Dr. Chris Girata was called to be the eighth Rector of Saint Michael and All Angels in Dallas and started his ministry at Saint Michael on Aug. 15, 2016. With UX 200, Lexus hatches plan

djboldt@sbcglobal.net Affordability. Of course, not everyone’s talking affordability — as most know, Commerce Secretary Wilbur Ross isn’t. But enough are talking to suggest there’s real concern when new $30K cars typically require $500/month — over five years — to pay for. With that, even the luxury brands are looking for ways to draw younger and/or less affluent buyers into their fold or grab the empty nesters who might have 60 months before the kids take the keys away. Either way, the new Lexus UX 200 attempts to speak to that price anxiety, in combination with the wants our pampered society now views as needs. And since we’re being frank here, let’s be frank. While marketed as a crossover, if the new UX (Urban eXplorer, get it?) is a crossover, I’m Wilbur Ross. Crossovers are car-based SUVs capable, in this viewer’s view, of at least some capability on a gravel road or fire trail. And with what I see as mandatory all-wheel drive within this footprint, a genuine crossover can navigate most roads throughout the whole year. The Lexus UX 200 is front-wheel drive only; the hybrid variant comes with all-wheel drive — we’re driving the non-hybrid. And with little more ground clearance than a Prius, Lexus should be calling it a hatchback. But if marketed as a hatch, it wouldn’t sell without incentives, while as a ‘crossover’ it can sell or lease for a premium. Regardless of what you call it, Lexus has crafted a neat, subcompact

The Lexus UX 200. package with a surprising amount of interior room within its urban-appropriate footprint. And while few would objectively call the UX sheet metal attractive, neither would we hide it under a car cover. For a crossover, the hip point is relatively low, but the glass area is good and, with the available sunroof, the interior is open, even airy. That interior, with available F SPORT trim, includes some of the nicest seating we’ve experienced on this side of $40K. The buckets, covered in what the marketing team dubs ‘NuLuxe’ seats, are perforated and do a fine job securing your contact points without confining those contact points. And despite the relatively low hip point, getting in and getting out is not only possible by the mobility challenged, it’s probably probable. In short, the utility of this smallish Lexus is far better than its exterior size would suggest. Under the hood, you have two liters of normally aspirated four, which means no turbo or supercharger. Driving through a 10-speed CVT, the result is shifting far more direct than what is typical of a continuously variable transmission. And if avoiding the ‘Eco’ mode

and going for ‘Sport,’ you’ll enjoy an acceptable level of performance, without any chance of confusing this with a hot hatch. Given its $40K price tag, it’s not even a warm hatch. Finally, there’s my disconnect with the Urban eXplorer premise. In my experience, those into urban exploration are doing it on a bike, by foot or by one of those electric scooters Uber investors are so high on, and intentionally leaving the car — if they have a car — in the garage. If you’re inclined to explore the suburbs (making a Walmart run?), go for it. With more than a few options, our UX 200 hit $40K, but you could equip one comfortably for about $5K south of that. Were it our money while hanging out in a Lexus showroom, we’d opt for the capable NX and — perhaps — buy fewer options. Or purchase a well-equipped Corolla for about $25K, which shares much of the same basic platform as this new, smaller Lexus. The Corolla, of course, is a hatch. Deep Ellum gets new taste of Mexico Tacos fresh from the street

Although the weather has been so nice the last few days, that you’ve got no excuses. If you’re making a list of brunches to try, consider Vidorra, a new “cocina de Mexico” in Deep Ellum. The menu ranges from authentic to hangover fodder to indulgent. Chilaquiles, tortilla pieces in red chile sauce, topped with refried black beans and fried eggs leans toward authentic. The gut-busting Hangover Vidorr-ito, a big ol’ burrito stuffed with chorizo and scrambled eggs plus sides of breakfast potatoes and queso lives up to its name. Churro (aka French) Toast, with fried bananas, fresh strawberries and blueberries beckons when a special breakfast treat is what you crave. Before we got to the food on our hosted tasting visit, we started with the brunch cocktail La Paloma Mimosa, a grapefruit juice adaptation of the classic with orange juice. Served in big margarita glasses, grapefruit juice and tequila effervesced and lightly sweetened with sparkling wine, was a nice change. If you are a fan of Salty Dog or Greyhound cocktails, La Paloma Mimosa rates. It rocks with the chilaquiles plate. The red

chile sauce was earthy with depth of dried chile flavor, nuance of heat and bare knuckles essence of guajillo chilies. Black beans and a couple of fried eggs with lovely, runny yolks made this a breakfast dish worth getting up for. If you’re dragging and need something “to soak up the alcohol,” the Hangover Vidorr-ito could be the sponge you’re seeking. Lots of mild chorizo and scrambled eggs fill a large flour tortilla to make this big burrito good for the morning after. The side of queso to drizzle over the burrito and/or the potatoes just adds to the curative nature of the dish. Sometimes a big plate of French toast with fruit is what the morning calls for. At Vidorra, this breakfast staple gets some sophistication with fried bananas. Coated with cinnamon and sugar that forms a crisp crust when fried, these hunks of bananas add texture contrast. Vidorra’s Churro Toast rises above yeoman level. The chef likes to play with chilies. If you order a basket of sopapillas for the table, it comes with chipotle and lime-flavored honey. It’s sweet, but not too, with just a hint of chile and lime. Drizzle it on cinnamon sugar-coated squares of fry bread and you’ll be happy. Good news for those who fret about parking in Deep Ellum. There’s an affordable lot next to Vidorra. Vidorra is a big space with a second story patio that will be awesome for spring and fall al fresco dining. The interior evokes an elegant Mexican style reflecting modernist architecture. There’s also a yearround rooftop bar overlooking the Dallas skyline. Vidorra is the second Deep Ellum restaurant created by hospitality group, Milkshake Concepts. In addition to STIRR, also on Main Street, Milkshake operates Citizen in Uptown.

What to do in Israel during Sabbath

By Michael Wald wald.world@yahoo.com Staying in Israel over a Friday night? Unlike any other place, around 3 p.m. on Friday, the streets start to look a lot less crowded. People are beginning to get ready for the Jewish Sabbath that begins at sunset Friday night and lasts until sunset Saturday. In most Christian nations, everything used to close down for Sunday. In Israel, the Sabbath is the day of rest, and things haven’t changed much since ancient times. Everything closes on the Sabbath. Most restaurants are closed. Most grocery stores are closed. In order to receive certification as kosher (a requirement for most of the people in Israel to shop in your store), you have to be closed. When I was recently in Israel, I noticed that the McDonald’s restaurants were still open on the Sabbath, as are some convenience stores run by Arabs. But if you think you need milk, for example, don’t wait until the Sabbath. In Tel Aviv, the super-modern city on the Mediterranean, things are a little less religious. There you will find some restaurants that can survive without being kosher. So, they are open on Sabbath and may even serve non-kosher food as well. So, if you are touring Israel and don’t want to sit out the day of rest, what should you plan to do? Well, surprisingly, you can visit some of the many kibbutzim. The

kibbutz movement was begun by mostly non-religious settlers, so many of them do not close down for Sabbath. Some may allow you to poke around, but most want you to make an appointment. We stayed in a huge hotel that was run by, and was on, a kibbutz near Tiberias. Obviously, if you are in the hotel business, you have to stay open. Museums, closed. Retail, closed. You can, of course, visit a mosque or church. But one of the best things to do is visit a national park. For some unexplained reason, all of Israel’s national parks are open during the Sabbath. Many Israelis use the Sabbath to get away to the parks. I had the opportunity to visit two of the national parks on the Sabbath. One is south of Tel Aviv, between the Gaza Strip and the Judean Hills, called Beit Guvrin-Maresha. The park is in an area rich in archeological finds, as the area was occupied at different times by Jews, Christians, Byzantines and Egyptians. In 2014, the park was designated as a UNESCO World Heritage Site for its caves where ancient humans lived from the eighth century before Christ to the 10th century after Christ, one of the longest cave dwelling periods known to man in the world. The park brochure lists nine different cave sites and a number of ancient sites, such as a church, amphitheater and bathhouse to visit. But the park has a lot of natural beauty as well. Take care to avoid the areas

designated as “firing zone” as these areas may be dangerous, given the park’s proximity to politically charged areas. The second national park I visited on the Sabbath is Bet She’an, located south of the Sea of Galilee. Again, Bet She’an was under control of a number of different groups at various times but was a major Roman city. Excavations here have unearthed fantastic ruins including a large theater and colonnade. There are so many ruins here that it is easy to imagine the grandeur of this city in Roman times. Of particular interest to tourists are the public lavatories and the bathhouse, both of which are especially well preserved. It’s getting harder and harder to find a historic home in Dallas that has avoided the bulldozer. People are so quick to tear down without thinking through why a house is still standing almost a century later. It takes a sophisticated buyer to understand what provenance brings to the party and to realize you can no longer afford to build homes like 4209 Lorraine Ave. This beautiful Georgian mansion is not only a masterpiece of original design, but it has also had a series of owners that have kept it up-to-date over the years. One of the wonderful things about historic homes is their provenance. If someone could afford an architect-designed, two-story Georgian mansion in the 1920s, they were generally one of the movers and shakers of the city. The Dallas Morning News archives are full of wonderful tidbits of information on teas and engagement parties that took place in these homes. As I was digging through the archives, I came across possibly the first owner of this Georgian mansion, as the records date back to 1931. Henry Grady Goggans was a partner in the law firm of Goggans and Ritchie, and chairman of the board of Texas Bitulithic Company. He married Margaret Ferris in 1931, and the teas and parties in this home began! They were a very social family, and their daughter, Peggy, became the Dallas Mardi Gras Duchess for the annual Galveston event. Reading through these social notices, you begin to get a sense that this Georgian mansion has always been the center of family, fun and festivities. Fast forward to 2019, and we

Hypogonadism and testosterone replacement therapy By Dr. Jeff R. Hischke With today’s array of anti-aging remedies, it is no secret that maintaining one’s youth is a common goal. Unfortunately, there is no cure for low testosterone, thus symptoms may reoccur if the TRT is stopped. However, there are natural methods of increasing testosterone production including exercise and a healthy diet to promote weight loss and increased muscle. Testosterone replacement therapy is not currently advised for men simply seeking a burst of “youth.” The misconception of TRT stems from the overlap of symptoms associated with both low testosterone and increased age. For example, both are known to cause fatigue, loss of muscle mass and increased body fat. It’s important to consider that many of these symptoms can have underlying causes, therefore a blood test is required to diagnose low testosterone that warrants TRT. Possible side effects of TRT include increased risk of blood clots and heart disease, as well as acne, reduced sperm production, baldness and swelling of breast tissue. For this reason, doctors do not recommend TRT as an anti-aging remedy. That being said, the benefits are believed to outweigh the risk for men suffering from hypogonadism. HBO features two writing heavyweights

unclebarky@verizon.net The lead is inspired — and also duly depressing given the latest rounds of gut-punching layoffs in the newspaper industry. HBO’s newly released “Breslin and Hamill: Deadline Artists” begins with visuals of New York subway passengers transfixed by their cellphones. Then cut to an earlier era, when rail riders were immersed in the Manhattan tabloids that once housed the punchy prose of columnists Jimmy Breslin and Pete Hamill. “This was the last expression of great, 20th century muscular American journalism,” an unidentified admirer says near the end of this nearly two-hour documentary film. It’s really not too grand a statement about two guys who lived, breathed and emboldened the printed word. Although “Deadline Artists” profiles both of them, the late Breslin (who died in 2017 at the age of 87) is the swaggering star of this time capsule. Hamill, living on at the age of 83, is far less bombastic but “got the pretty girls” in the vernacular of those times. He most famously dated Jackie O, and also squired Linda Ronstadt and Shirley MacLaine. But if Hamill had the looks, the unrepentant Breslin had the guts. By the year 2015, both men looked frail and spent while seated next to one another for the purposes of this evocative film. Breslin remained pretty grouchy while the cheerier Hamill arrived in a wheelchair. It’s still something to see. Breslin once described himself as “the John Gotti of journalism,” a reference to the cutthroat mobster he had both covered and knew personally. “I like bad boys,” he said. “Legitimate people are boring. They’re terrible.” Breslin had the temerity to take on “subway vigilante” Bernhard Goetz, who in 1984 was lionized by many New Yorkers after shooting four young black men who had taunted him. “Criminals Think Twice Or We Will Goetz You!” a

Jimmy Breslin. sign of the times read. Writing extensively about the incident, Breslin said that Goetz in fact was more a cold-blooded killer than hero. What if his victims had been white? Would he also have fired away? On a famous episode of his once immensely popular talk show, Phil Donahue opined, “Mr. Breslin, sir, you do appear to be whistling a very lonely tune … Your speeches are not playing in New York City.” Breslin didn’t care, and kept saying so. And in a subsequent police tape, the eventually indicted Goetz came off as a remorseless, cold-blooded killer who said in part, “If I had more bullets, I would have shot ‘em all again and again. My problem was I ran out of bullets.” The film also recounts Breslin’s up close and personal role in the Son of Sam serial murders, and his incredibly inventive and distinctive writing about the assassination of John F. Kennedy, when he alone had the foresight to seek out the late president’s AfricanAmerican gravedigger while thousands of rival reporters

basically parroted the same stories. He also wrote two big bestsellers, Can’t Anyone Here Play This Game? and The Gang That Couldn’t Shoot Straight. But Breslin’s outsized mouth bit him hard when at age 61, he lamented that his wife no longer was around to do the household chores now that she had been elected to the City Council. A Korean-American colleague of his at New York’s Newsday took umbrage and accused Breslin of “spewing sexism” in a personal message to him. He responded with a newsroom tirade that branded the woman “slant-eyed” and a “yellow cur.” It became big news. A two-week suspension ensued after Breslin issued an apology that really wasn’t one: “Once again I am wrong. JB No. 1.” Gail Collins, longtime columnist and reporter for The New York Times, says in a fresh interview that Breslin was “terrible in many ways, but his sense of sympathy was just amazing.” Others interviewed for “Deadline Artists” include the

aforementioned MacLaine, the late Tom Wolfe, Gloria Steinem, Garry Trudeau, Gay Talese, Spike Lee, Robert De Niro and Tom Brokaw, who calls Hamill “so authentically male” — whatever that means. Hamill otherwise can’t help but pale in comparison to the bombastic Breslin. He initially was hired by The New York Post as their answer to Breslin. But they later ended up being colleagues, for a relatively short while, as columnists for the Daily News. Imagine what a one-two punch that was. Hamill remains proud of making Richard Nixon’s “Enemies List” and of being singled out by Vice President Spiro Agnew in the aftermath of his “nattering nabobs of negativism” speech aimed at the administration’s media detractors. He also became close with Robert F. Kennedy, at one point writing a letter to him that encouraged a run for the presidency. In retrospect, he “made a terrible mistake as a journalist,” Hamill says. “I had become friends with Robert Kennedy … I never was friends with a

politician again.” Both Hamill and Breslin were on the scene when Kennedy was assassinated in a Los Angeles hotel after Ed Bark winning the 1968 California presidential primary. In Breslin’s view, which he held to the end, “You’re not put on this earth to be happy. You’re really not.” Hamill, last seen drawing on an artist’s pad while sitting in his wheelchair outside Prospect Park, in contrast seems to be a study in reasonably happy contentment. The Daily News couldn’t afford either of them now. Back in 1988, the paper employed 400 reporters and editors, according to “Deadline Artists.” Thirty years later, it was down to 45. ‘What Men Want’ is choppy with a side of schmaltz

If someone has been counting towards that exact figure, your work here is done, my friend. On the surface, f lipping the gender from “What Women Want” to “What Men Want” is pretty clever. There is

comedy gold to be mined in watching a woman have her mind blown by the bizarre random thoughts from guys that she simply passes on the street. Of course, it all could fall f lat on its face if the star and execution don’t mesh. It’s not quite pancake-f lat, but “What Men Want” is extremely choppy with loads of filler, annoying characters, and for a raunchy R-rated movie, an overabundance of emotional schmaltz. is game and she is not phoning this one in, but as is usually the case with talented actors, the material lets her down. Henson portrays an Atlanta sports agent, Ali Davis. She’s hellbent on becoming a partner in her firm, but feels like she’s being held back due to gender and racial politics. While that’s part of the reason, it’s mostly due to the fact that Ali is so power-hungry that she alienates her co-workers and peers, even those that support her, such as

her assistant, Brandon (Josh Brener). It’s annoying and silly until Ali and her buddies have a sit down with a psychic named Sister (an absolute scene stealing Erykah Badu). Whether it’s the tea, pot or knock on the head, Ali wakes up after the night out and has been blessed with the “hear men’s thoughts” superpower. Initially, it’s slightly funny. It doesn’t last. Ali’s shock builds to nervous breakdown levels, but once she realizes

she can use these powers to her advantage, she quickly embraces the skill. Once Tracy Morgan shows up as the father of a future NBA superstar, “What Men Want” becomes grating. It gets even worse when Ali’s love interest, Will (Aldis Hodge), and his son are used as props to further her career. For every clever scene, such as Ali crashing an all boys night poker game, there’s a dozen terrible ones. There are entire subplots involving Ali’s friends and one of her co-workers (played by Pete Davidson) that crush any building momentum and do nothing to advance the film. Oddly enough, Henson is at her best when she’s awkwardly

stuttering or faking her way to the top of the corporate ladder. As soon as she has to act tough or get all lovey dovey, the entire movie suffers. Henson has some unexpected comedic chops and she elevates “What Men Want” to a much higher level than it deserves. At almost two hours long, “What Men Want” runs out of steam around the 90 minute mark. The last 30 minutes are painfully cheesy and written like a lame PG-13 crowd pleaser. It’s as if the script was rewritten to be a raunchfest, but this team of writers didn’t get to the last 30 pages. Henson definitely has what it takes to be a major movie star, but she’s surrounded by mediocrity this time out.

What will Loop look like in action? Häagen-Dazs will sell ice cream in steel containers and PepsiCo’s Tropicana orange juice brand will come in glass bottles. Consumers will receive products from a TerraCycle shopping platform in a reusable tote bag and then schedule a pick up for the empty containers to be cleaned and reused. The product cost will be in line with familiar single use packaging, but there will be a deposit of $1 to $10 per container. “From a philosophical point of view, we have got to lean in and learn about this stuff,” Simon Lowden, marketing leader for PepsiCo’s snacks division told the Wall Street Journal. “People talk about recyclability and reuse and say they’d like to be involved in helping the environment, so let’s see if it’s true.” Reducing plastics is the goal. If the Loop pilot program is successful and becomes more widespread, the reusable packaging movement could make a dent in the plastics issue. Nine billion tons of plastic have been produced since the material was introduced in the 1950s, and the

amount produced each year is about equivalent to the entire weight of humanity. Almost every piece of plastic ever produced still exists in some form aside from the small amount that has been incinerated. Ninety-one percent of plastic waste isn’t recycled, and if plastic production isn’t reduced, plastic pollution will outweigh fish pound-forpound by 2050. Single-use plastics in packaging is clearly an environmental issue, and Loop is a step in the right direction, but changing consumer behavior won’t be easy. “We don't want another big public press announcement that says we're going to be doing this then find that people say, ‘Oh well it didn't work.’ Nothing works in business the first time you're out there,” Shireman explained. He added, “We haven't had refillable containers as a common product in more than a generation. It's gonna take some effort. The one thing that we will be watching for is that companies have staying power on this. They say, ‘We're going to try this. We're going to adapt it. Types of IRS audits: the correspondence audit

If the information furnished by the taxpayer is not satisfactory to the IRS, then a 30-day letter will be issued, advising the taxpayer of the proposed tax changes and appeal rights. If the IRS needs additional information, then the Campus will request such by letter from the taxpayer. If the second explanation is not a sufficient basis to resolve the matter, then the return may be transferred to a local office for further review. If the IRS does not receive an agreement or receives no response from the taxpayer within 30 days of the issuance of its initial contact letter, then the IRS will issue a 30-day letter. If the taxpayer fails to respond to the 30-day letter, then a notice of deficiency will be issued, and the taxpayer will have 90 days to file suit in the United States Tax Court to contest the determination made by the IRS. The IRS also has an Unallowable Items Program, where the computer identifies items which appear to be unallowable by law. any table provided by the IRS with respect to any return if such incorrect use is apparent from the existence of other information on the return. • An entry on a return of an item which is inconsistent with another entry of the same or another item on such return. • An omission of information which is required to be supplied on the return to substantiate an entry on the return. • An entry on a return of a deduction or credit in an amount which exceeds the statutory limit imposed by subtitle A or B, or Chapter 41, 42, 43, 44 or 45. The correction of mathematical and clerical errors is not considered to be an examination. Therefore, the assessment can be made without giving the taxpayer any notice of deficiency and the taxpayer has no right to appeal to the United States Tax Court. Thus, the IRS is permitted to summarily assess the additional tax resulting from these errors. However, the statute provides that a taxpayer who receives a math/clerical notice of an assessment

for additional tax has the right to appeal. The appeal must be made by the taxpayer within 60 days by filing a request for an abatement of the assessment. The taxpayer sets forth any disagreement with the amount of the assessment. Under Section 62l3(b)(2)(A) of the Code, upon receiving a request for abatement from the taxpayer, the assessment shall be abated, and during the 60-day period the IRS may not proceed to collect the tax (Section 62l3(b) (2)(B)). If the taxpayer's appeal is denied by the Service Center, it will be referred to the examination branch in the Service Center for examination. If the Service Center is unable to resolve the matter, then the taxpayer will be sent a statutory notice of deficiency. Never, never send original documents to the IRS.
