DECISION TO OVERTURN PROP. 8 RIGHT STEP IN DIRECTION OF EQUAL RIGHTS FOR ALL

Last week, US District Chief Judge Vaughn R. Walker ruled that Proposition 8, a voter initiative constitutional amendment that eliminated the right of same sex couples to marry, was unconstitutional “under both the Due Process and Equal Protection Clauses.” While lawyers on both sides of the issue continue to battle it out in court, black people will once more find themselves engaged in this heated debate with the black church split down the middle. We know discrimination first hand. From thee days of slavery, through the Jim Crow era, and the Civil Rights Movement, we have been fighting since the firstt Africans arrived off the coast of South Carolina. Today the fight continues for equal rights forr all ng compeople, and that includes the same-gender loving ghts munity. While we do not believe that the gay rights movement is the same as the black Civil Rights Movement, there are similarities and when we discriminate against gays, we are discriminating against our own. As long as there have been black people on Earth, there have been black gays. They are not only our sons and daughters, but they are community leaders, teachers, business owners, politicians, authors, entertain-

ers, doctors, and more. Black people in America today owe their civil rights to Bayard Rustin, one of the main architects of the Civil Rights Movement and the chief organizer of the 1963 March on Washington for Jobs and Freedom. It’s important to note that while white gays adopted the language of the civil rights movement, it’s been black gays who put into practice its core principles for their white counterparts to help them gain an understanding of the people and history behind it—many times while fighting issues of racism against blacks from within the gay community. Black people have a come a long ways from the days when the Massuh arranged our marriages, we were jumping over brooms, to being allowed to interracially fight marry. But the fi ght continues.

Gay and lesbian couples work, pay taxes, and contribute to society like every other couple and deserve the same rights and protections afforded to married couples. Gay couples who want to get married should have the right to under today’s laws. Anything less is a form of social injustice and as the conscious of America, it is not for us to aid in the oppression of others, especially our own. The black civil rights movement was essentially born out of and driven by the black church. While it is a fact that social justice and religion are inextricably intertwined in the black community, as is Christianity, allowing gays to marry is not going to change that. Black churches will not be forced to marry gay couples. Besides, it’s highly unlikely that a couple—whether gay or het heterosexual—would choose to get married somewhere they are not welcome. Th The black church will be as it has always been. Gays being allowed to get married will not change that. Wh While we still have a lot of battles to fight to win equali equality for all people, allowing same-gender loving couple couples to marry is a step in the right direction of guarantee anteeing equal liberties for all people. directly regarding the skeletal remains of a woman found Aug. 9 in Malibu Canyon. This took place after unconfirmed reports started surfacing in the media and on blogs that the women’s clothing also found near the scene matched the clothing Mitrice was last seen wearing before she disappeared.

Funding for Black Farmers, Indians Stalls Again BY BEN EVANS AP WRITER WASHINGTON (AP) — Despite broad support, legislation to finalize $4.6 billion in settlements with black farmers and American Indians stalled in the Senate again Aug. 5 amid partisan bickering. Lawmakers from both parties say they support resolving the long-standing claims of discrimination and mistreatment by federal agencies. But the funding has been caught up for months in a fight over spending and deficits, with Republicans and Democrats arguing over how to pay for them. Republicans have repeatedly blocked Democratic proposals and did so again Thursday. This time, Sen. John Barrasso, RWyo., argued that the settlement in the Indian case needs work and made a counter offer that would change parts of it. An exasperated Sen. Byron Dorgan, DN.D., responded that it's not Congress’ role to renegotiate the case, which has been in court for 14 years and which the Obama administration is under a court-ordered deadline to resolve. “My colleague from Wyoming, I think, wishes he were one of the negotiators,” Dorgan said. “Nobody in Congress was a negotiator ... the question is whether we will meet our responsibility.” In the Indian case, at least 300,000 Native Americans claim they were swindled out of royalties overseen by the Interior Department since 1887 for things like oil, gas, grazing and timber.

They would share a $3.4 billion settlement in a class-action lawsuit originally filed in 1996 by Elouise Cobell, a member of the Blackfeet Tribe from Browning, Mont. For the black farmers, it is the second round of funding from a class-action lawsuit originally settled in 1999 over allegations of widespread discrimination by local Agriculture Department offices in awarding loans and other aid. It is known as the Pigford case, named after Timothy Pigford, a black farmer from North Carolina who was an original plaintiff. The government already has paid out more than $1 billion to about 16,000 farmers, with most getting payments of about $50,000. The new money is intended for people — some estimates say 70,000 or 80,000 — who were denied earlier payments because they missed deadlines for filing. The amount of money each would get depends on how many claims are successfully filed. Passing the funding for the two cases would fulfill a campaign promise by President Barack Obama to resolve long-festering complaints. John Boyd, head of the National Black Farmers Association, said both parties share the blame of leaving the work undone before the Senate adjourned for it’s month-long August recess. “It’s just partisan division, one party against another,” he said. “It’s an embarrassment for the American people that they can’t get a bill passed that everybody supports.”

Bob Johnson Argues that Wealth Gap Threatens African American Families In an address to members of Congress and participants attending a Congressional Black Caucus meeting, Robert L. Johnson, founder and chairman of The RLJ Companies, called for a national discussion about the growing wealth

gap which he referred to as a “wealth gap tsunami threatening African American families.” He cited the recent Institute on Assets and Social Policy at Brandeis University study, among other studies, which conclude “the wealth gap

between white and African American families has more than quadrupled over the course of a generation; the racial wealth gap increased by $75,000, from $20,000 to $95,000; and, at least 25 percent of African Americans have no assets.” According to the U.S. Census data, “white household median net worth is 10 times that of Black households. The median net worth for African Americans was $11,800 compared to $118,000 for whites.” In response to addressing this compelling national crisis, Johnson stated that, “We must admit the harsh reality of a history of institutionalized racism and economic discrimination against African Americans is the primary cause of wealth disparity between Black and white Americans” and “we must be willing to talk about race recognition remedies at the highest levels of government as well as between Black and white Americans.” Johnson suggests that the wealth disparity between African Americans and whites compares to the “compelling national interest test” cited in the Supreme Court’s Adarand decision where the Court ruled ‘a racial or ethnic classification must serve a compelling interest and must be narrowly tailored to serve that interest.’ In his remarks to the Caucus, Johnson listed several race recognition policy initiatives

For example, allow African American families earning less than $250,000 annually to defer all federal income taxes, without interest, provided tax savings are placed into a 401(k) type savings account which can only be drawn out at retirement or upon death at which time the government would be reimbursed for the deferred taxes. He pointed out that this would allow the gain on the 401(k) investment to be available to the families at retirement or passed on to future generations. “I wish the answers to close the wealth gap were as politically palatable and acceptable as proposals to make our public schools better for

minorities, to retrain minority workers for the new jobs market, and aggressively enforce laws against racial and economic discrimination. Over the years, this Nation has been committed to all of these objectives, but this effort will not close the Black wealth gap. I recognize that public policy based on race is extremely provocative and controversial but controversy should not prevent a reasonable dialogue about a societal dilemma that is real and economically devastating in its potential to millions of African Americans,” he concluded. BRIEFS Lawyer Agrees to Work ‘Grim Sleeper’ Case for Free (AP) — A Los Angeles man suspected of the “Grim Sleeper” slayings of 10 women has a new attorney who says she will work for free. Lonnie Franklin Jr. appeared in court Aug. 9 with his new attorney and had his arraignment rescheduled for Aug. 23. His lawyer, Louisa Pensanti, says she will work pro bono and has experience handling multiple murder cases. Franklin is charged with 10 counts of murder and one count of attempted murder. He was arrested in July after authorities said DNA evidence linked the mechanic to the series of killings. The slayings occurred from 1985 to 1988, and again from 2002 to 2007. The 14-year pause led to the killer’s nickname of the “Grim Sleeper.”

Rep. Waters Denies Ethics Violations in Bailout (AP) — Los Angeles-area congresswoman Maxine Waters denies improperly favoring a bank her husband held stock in during the federal bank bailout. In a speech at First A.M.E. Church in South Los Angeles on

Aug. 7, Waters repeated calls to have ethics charges against her made public as soon as possible. Waters says she did nothing improper when she arranged a meeting between the Treasury Department and an association of minority-owned banks in September 2008. OneUnited Bank, where her husband was a stockholder, attended the meeting and received $12 million from the $700 billion federal bank bailout three months later. The Congressional Ethics Committee has charged the 10-term Democrat with violations.

Obama Marks 45th Anniversary of Voting Rights Act WASHINGTON (AP) — President Barack Obama is urging Americans on the 45th anniversary of the Voting Rights Act to honor the legacy of those who helped make the law possible by exercising the rights they fought hard to guarantee. The 1965 law guaranteed blacks the right to vote. Its passage was spurred by the unprovoked and bloody attack by Alabama state troopers on peaceful marchers crossing the Edmund Pettus Bridge from Selma to Montgomery on March 7, 1965.

Obama says the law marked the culmination of decades of work by such civil rights activists as Martin Luther King Jr. and Rosa Parks to fulfill America’s promise of equality. He says all Americans should exercise their right to vote and continue working to promote equality.

SC Man Indicted in Shooting, Dragging Case NEWBERRY, S.C. (AP) — A grand jury has indicted a white South Carolina man on charges he killed his black friend and dragged his body behind a truck. Prosecutor Jerry Peace said 19year-old Gregory Collins was indicted Aug. 6 for murder, desecrating a body and possessing a weapon during a violent crime. Peace said it becomes a case on the active docket. Collins was arrested in June and accused of killing 30-year-old Anthony Hill. Authorities say Collins shot Hill, then dragged his body 11 miles behind a truck. The New Black Panther Party has held protests and rallies in Newberry, asking federal authorities to charge Collins with a hate crime. About two weeks ago, a judge decided not to issue a gag order in the case.

African Diaspora CONAKRY, Guinea (AP) — A government spokesman announced that the second round of Guinea’s presidential election will be held on Sept. 19. The presidential decree read out on state TV by presidential spokesman Mohamed Kasse ends weeks of speculation and political wrangling following the June 27 first round of the presidential vote. The top candidate, Cellou Dalein Diallo, got 44 percent of the vote, shy of the majority needed to avoid a runoff. The election results needed to be confirmed by the courts, but once they were confirmed in July, candidates accused the transitional government of dragging its feet and not announcing the date of the second round in a vain attempt to hold onto power. Guinea has survived decades of dictatorship, including most recently the one-year rule of an eccentric army captain whose forces led a massacre of hundreds of people.

French Police Captured on Video Assaulting African Women (GIN) — Videos of a police assault on a protest by African women and children have been widely circulating on the Internet. The footage shows the officers

trying to move African squatters from the north-east Parisian suburb of La Courneuve. The group of about 60 women had been living in the street since being evicted from their tenement homes on July 8 to make way for a new housing project. At one point, a woman is shown being pulled by her legs across the ground, her baby — who she had been carrying on her back — dragged along the concrete after her. Most of the protesters were legal migrants from the Ivory Coast and had been in France for more than a decade, according to Michael Hoare, a spokesman for Droit au Logement (Right to Housing). The footage, shot on July 21, comes as President Nicolas Sarkozy targets gypsies and immigrants who he threatened to strip of their passports if they attack police. BY DOUG FERGUSON AP WRITER SHEBOYGAN, Wis. â&#x20AC;&#x201D; Tiger Woods played a practice round Aug. 10 at the PGA Championship with a swing coach at his side. Sean Foley is not Woodsâ&#x20AC;&#x2122; coach â&#x20AC;&#x201D; at least not yet. The Canadian-born coach who lives in Orlando, Fla., confirmed that Woods asked him to take a look at his swing. Asked if he was working with Woods, Foley paused and said, â&#x20AC;&#x153;I wouldnâ&#x20AC;&#x2122;t say that.â&#x20AC;? â&#x20AC;&#x153;But the possibility is there,â&#x20AC;? Foley said. â&#x20AC;&#x153;Iâ&#x20AC;&#x2122;m just taking a look at him. The advice I would give any player is to have at least two people look at your swing.â&#x20AC;? It was the second time in three months that Foley has been part of Woodsâ&#x20AC;&#x2122; group in a practice round. Neither time was unusual because Woods was playing with two of Foleyâ&#x20AC;&#x2122;s clients, Hunter Mahan and Sean Oâ&#x20AC;&#x2122;Hair. The difference at Whistling Straits came on the par-5 fifth hole, when Foley took out his video camera to tape Woodsâ&#x20AC;&#x2122; swing. Foley later stood below the eighth tee on a cart path to capture his swing from in front of him. â&#x20AC;&#x153;I did ask him to film a couple I would like to take a look at â&#x20AC;&#x201D; which I did look â&#x20AC;&#x201D; so Iâ&#x20AC;&#x2122;m heading in the right direction,â&#x20AC;? Woods said. Woods didnâ&#x20AC;&#x2122;t look at the videotape on the golf course. On the 10th tee, Foley and Woods had a brief conversation before the coach dropped back to work with Stephen Ames, another client. Woods has been without a coach since he parted ways with Hank Haney in May. They had worked together for six years. The only other coach the worldâ&#x20AC;&#x2122;s No. 1 player employed as a professional was Butch Harmon, which lasted until 2003. Woods has said he would not have a coach, instead relying on a friend at

R&B guitarist Phelps “Catfish” Collins dead at 66 BY GARY GRAFF DETROIT (Billboard) — R&B guitarist Phelps “Catfish” Collins, a veteran of James Brown’s J.B.’s, ParliamentFunkadelic and his younger brother William “Bootsy” Collins’ Rubber Band, died of cancer last Friday at his home in Cincinnati. He as 66. Bootsy Collins said in a statement that “my world will never be the same ... Be happy for him, he certainly is now and always has been the happiest young fellow I ever met on this planet.” Bootsy’s wife, Patti Collins, told the Cincinnati Enquirer that Catfish “was a father figure to my husband. He’s the reason why Bootsy is who he is.” Catfish, eight years Bootsy’s senior, suggested his brother put bass strings on an old guitar. After being recruited by James Brown, they played on such classics as “Get Up (I Feel Like Being a) Sex Machine,” “Give It Up or Turnit a Loose,” “Super Bad” and “Soul Power.” By 1971 they had left Brown’s employ, going on to form the House Guests and then joining Funkadelic in 1972 for albums such as “America Eats Its Young” and “Cosmic Slop.” Catfish remained with the group — which also lost guitarist Garry Shider to cancer in June — until the mid-'80s. “(Catfish) was a hell of a musician,” keyboardist Bernie Worrell, who played with the guitarist in Funkadelic, told the Enquirer. “People seem to forget that the rhythm guitar behind James Brown was Catfish’s creative genius, and that was the rhythm besides Bootsy’s bass.”

to be appealed,” says Perkins, who is African American and a member of the Church of Jesus Christ of Latter-day Saints. But the issue of gay marriage itself is something he still has feelings about. Perkins says he believes marriage should be between a man and woman, and that children should have a mother and father. Legalizing same-sex marriage allows gay couples to “push their agenda” on everyone else, he says, later adding: “If we are going to redefine marriage, where does it stop? ... What about the man who wants to marry his sister? What about the man who wants to marry more than one person? ... Where does it end?” In 2008, Perkins advocated for passing Proposition 8, even speaking on television, but he doesn’t plan to participate in any activism this time around. “Now that that is out of our hands, I’ll leave it to those who can decide what to do from” here, he says. Some are anticipating the case will go to the Supreme Court. The case will be heard before the Ninth Circuit U.S. Court of Appeals. Also at issue is whether Walker will allow gay marriages to take place in California. Daria Roithmayr, a University of Southern California law professor, says she expects the Supreme Court to take the case. Walker’s decision was so “meticulously written” that it would be very hard to overturn, says Roithmayr, who teaches critical race theory and is an expert on race and gender. Part of Walker’s decision, which is more than 130 pages, states: “California has eliminated all legally-mandated gender roles except the requirement that a marriage consist of one man and one woman … Proposition 8 thus enshrines in the California Constitution a gender restriction that the evidence shows to be nothing more than an artifact of a foregone notion that men and women fulfill different roles in civic life.” Jim Campbell, an attorney with the Alliance Defense Fund who participated in the defense in the San Francisco case, tells the L.A. Watts Times that the Supreme Court doesn’t hear a case unless it decides to do so, but “one thing’s for sure: Whoever loses before the Ninth Circuit (court) will ask the Supreme Court to hear this case.” “This case is much bigger than one activists court in San Francisco,” Campbell says. “This case has just begun.” “In our country, we should respect and uphold the right of the people to make policy choices through the democratic process,” he says. “Unfortunately the court’s decision ignored that.” Geoff Kors, executive director for Equality California, said in a press release that: “We are thrilled with today’s ruling, which affirms that the protections enshrined in our U.S. Constitution apply to all Americans and that our dream of equality and freedom deserves protection. Judge Walker has preserved our democracy by ruling that a majority cannot deny a minority group of fundamental freedoms.” A SHIFT IN VIEWS Polling data suggest opinions about gay marriage have changed. According to the nonprofit Public Religion Research Institute in Washington, D.C., its recent survey suggests that a majority of Californians (51 percent) would vote for supporting gay marriage if a similar vote to Proposition 8 took place tomorrow. “Among black Protestants, twice as many report becoming more supportive as report becoming more opposed (27 (percent) vs. 13 (percent)),” the institute’s report, titled “Religion and Same-sex Marriage in California: A New Look at Attitudes and Values Two Years after Proposition 8,” states. When it comes to Hosea Collins’ opinion, the question he asks is, “What does my King (God) say about it?”

FLUORIDATION OF YOUR WATER SUPPLY The purpose of this notice is to inform you that Park Water Company (Park), your water provider, will soon put into operation groundwater well fluoridation facilities. One way to address this issue is through fluoridation of the public water supply systems. Fluoride is nature's cavity fighter. Drinking optimally fluoridated water has reduced tooth decay by about 60% in the United States since World War II. Fluoride helps fight cavities by strengthening tooth enamel so teeth become more resistant to decay, particularly in children prenatal stage through age five. Also, according to the American Dental Association, "Of the thousands of credible scientific studies on fluoridation, none has shown health problems associated with the consumption of optimally fluoridated water." After careful consideration of all reputable sources, Park believes that optimally fluoridating their water supply will provide their consumers with a valuable health benefit at minimal cost. Now this is a parable that I suspect that we are all familiar with. We all, or most of us, know the story of the “prodigal son.” Young man, son of a powerful father, wants his inheritance early, and after he gets it leaves home, goes to a far off land, gets involved with a bad crowd and lifestyle and soon loses everything. He soon ends up having to work in the fields feeding pigs and contemplates eating the food that is to be given to the pigs. Before he does that, though, he remembers his fathers’ house and then goes home and is restored. If we take an honest look at ourselves and our lives we can see ourselves in the life and actions of this young man who sought to live life fully on his terms without wisdom or maturity. Not in the sense that we have gone to our fathers and asked for our inheritances early, but in the fact that I believe that this man had what we would call today an identity crisis in his young life. Let’s just look at the setting for a minute: Here we have a young man who had grown up in the lap of luxury. His father had to be rich because poor folk don’t leave an inheritance for their children; they only leave their children with bills. So we know that this man had to be a man of means. This son had to look over his life and he had to wonder if everything that made up who he was was a result of who his father was, or a result of what his father had done. So our text has him doing something that was completely out of the realm of who he really was, a Hebrew feeding slop to pigs until he … came … to … himself. Now contrary to what you all might think, my father is not a rich man, but you can say that he has been richly blessed of Lord. And although I myself did not grow up in the lap of luxury, as I have grown into a man, I have had to admit that the majority of the blessings that I have enjoyed in my life have come as a result of the blessings that the Lord worked in the life of my family. And before I knew who I was in God, I found myself just going through the motions, living far below my God-given potential,

eating the spiritual slop of this world trying to find out who I was. I found myself in all kinds of situations until I came … to … myself. You see I figured out that, all that time, I was looking in the wrong place to find out who I was. I was asking myself, my earthly father, and the world who I was when I should have been asking my Creator. A very good friend of mine once told me a long time ago that if you want to find out the purpose of a thing, you can’t ask the thing; you’ve got to ask its maker. My Maker let me know that I’m a child of The Almighty. I’m more than a conqueror. If you want to know who you are, you got to ask your Maker, your Creator. If you look at our community today or just outside the walls of our churches, you would think that we Black folk have completely lost our minds and our identity. We are at the lowest end of every achievement list on the planet, but we have the highest blood pressure, unemployment rate, highest prison population, highest high school dropout rate, poverty rate and the list goes on. It seems that the more the Lord has blessed us with, the more

we have lost who we are and now we are more afraid of our own children than we are of anything else. When we were slaves in the fields, we knew who to call on, we knew how to believe in God because God was all we had. We may have picked cotton but at least we picked it together. But now we done moved on up to the East Side, got a little money in our pockets, and don’t know who we are anymore. I believe that we are so blessed today because those who were slaves prayed too hard that their children would not have to endure what they went through, and in the middle of all these blessings, we have forgotten who they are. But we have to come to ourselves. 2 Chronicles 7:14 says that, “If My people who are called by My name will humble themselves and pray and seek My face, and turn from their wicked ways, then I will hear from heaven, and will forgive their sin and heal their land.” Ask yourself these questions: If I had to be who I am today for the rest of my life, would I be happy with that? Or do I know that there is more inside of myself, inside of us? We must come to ourselves, Beloved. Blessings.
