Milk & honey for the GTM’s lawyers R48 000 per day!
A number of lawyers seem to have enjoyed a rather profitable time doing legal work for the GTM in the past few years, and senior members of the law profession say a forensic investigation should be done to determine the acceptability of fees that have been paid by the GTM. One lawyer charged the GTM an astonishing R100 per minute for telephone “consulta-
tions”. This amounts to R100 x 60 minutes = R6 000 per hour x 8 hours = R48 000 per day! The same lawyer charged R500 “to receive an answering affidavit per fax from correspondent attorneys” and then added R10 000 “for perusal of the affidavit”. To travel to Pretoria the lawyer charged R12 000 for time spent travelling, R2 000 for
petrol inclusive of Toll-gate (which is extremely reasonable) and R3 184 for “travelling to and from Tzaneen to Pretoria”, for a total of R17 184 for a trip to Pretoria and back to Tzaneen. • On page 3 you can read more about the seemingly exorbitant costs charged by attorneys, plus a few other matters relating to the GTM’s legal expenses.

Stuart Lunt, a Stanford Lake College Grade 12 pupil, achieved the almost impossible, when he scored 100% for the Talent Search Computer Olympiad 2015. The Talent Search Olympiad is open to all and tests computational thinking. The names of the top pupils are forwarded to the department of science and technology and to the Allan Gray Orbis Foundation. Last year Josh Selfe of SLC (he was then also in Grade 12) was listed in the top results of the 2014 Talent Search Olympiad.

Ogies toe!
beoefen of uitleef.

Milk & honey for the lawyers Bulletin managed to obtain documents to support claims that the Greater Tzaneen Municipality might have spent far too much money on legal matters and attorney fees over the past few years. We have been advised to rather withhold the names of the relevant lawyers at this stage, despite the fact that the details are contained in documents in our possession. We will consider publishing names at a later stage. We are also busy preparing some questions for the GTM, to allow them the opportunity to comment on certain issues pertaining to the alleged wasteful expenditure.
A road issue
The construction of a road in the district became an issue when a contractor objected against the allocation of the tender to another contractor, and it resulted in an arbitration case. The lawyer for the GTM’s cost represents: R78 000 for “consultation and perusal of documents”, R47 220,46 for “travelling and time spent on reserved days”, R5 300 for “letters and copies prepared”, R19 532,20 for “drawing fee” and R85 010,67 for “disbursement council” (an advocate).
‘Taxi money’
In the cases between the GTM on the one side and the Letaba Taxi Association and a Mr Van Vuuren on the orher side, the lawyer who represented the GTM charged R531 172,44.
Accident by employee
A lawyer charged the GTM R44 650,00 for “consultation and perusal of documents”, R36 000,00 for “attending court” for the trial and R8 715,00 for “patties and sundry” (total: R100 658,25) in a court case regarding an accident by a municipal employee.
To adjust salaries
A few years ago the senior municipal officials of the GTM insisted that the salary disparities should be rectified. The situation resulted in a court interdict. The payment to the relevant lawyer amounted to R365 253,38. Of this amount R29 000,00 was for the services of an advocate. Another lawyer also got paid for “handling the salaries
disparities issues” for the GTM. His costs were: R55 000,00 for “consultation”, R80 000,00 for “perusal and studying of documents”, R95 000,00 for “travelling, patties and sundry”, R160 000,00 for “research and compilation of the report” and R210 000,00 for “attending work session and revising the report”.
Presiding officer
The presiding officer in the disciplinary hearing of the suspended municipal manager, Mr Elias Mankabidi, has tendered an account for R219 000: R210 000 for “twelve days booking and perusal of documents”, R9 000 for “travelling and time spent on reserved days” and R17 500 for “full day booking rate”.
Plus lawyer
To be added to the R219 000 for the presiding officer in the hearing of the suspended municipal manager, the GTM has to fork out R1 528 830,08 for the lawyer “who are currently handling” the hearing for and on behalf of the council. The total cost for the presiding officer and the lawyer thus amounts to a handsome R1 747 830,08! The amount of more than R1,5 million is made up as follows: R1 025 185,01 for “consultation, representation and perusal” (daily rate charged R16 500), R138 345,32 was VAT, R28 146,00 was charged for “letters and copies made”, R176 557,50 for “expert witness fees” and R 127 694,25 for “legal opinions”.
‘Pay back the money’
A lawyer who had to do debt collection for the GTM was paid R446 184,21. This means, in normal circumstances, that the debtors could not be traced or couldn’t pay their debt. In the normal run of debt collection the debtors are held responsible for all costs incurred in the legal process and thus the debtors would have paid for the lawyer’s expenses, had they paid the GTM.
Another shocker coming The GTM has lost their case against the previous chief financial officer, Mr André la Grange, in the Appeal Court. The story of how La Grange’s contract was not renewed and what
followed is a story for another day (we will get to it). In the meantime, however, the GTM will have to face another sizeable legal bill; especially since the court ruled that the GTM must pay La Grange’s legal costs. This means that the total cost for the GTM’s clumsy handling of the situation could well be in the order of R2,5 million!
How big is it? Legal costs for the GTM for 2013/2014 amounted to R11,9 million and for 2014/2015 (for nine months) amounts to R10,2 million. To be added to the 2014/2015 amount of R10,2 million is the cost for the La Grange case (more or less R2,5 million) plus other costs incurred up to the end of the financial year. This means that about R25 million, which in the end could be close to R30 million of taxpayers’ money have been spent on legal costs since 1 July 2013. A number of questions could be asked about this expenditure: • Was the money well spent? • Could some of the legal action/court cases have been avoided? • Did the GTM agree to pay lawyers on a lawyer-client scale or did they enter into agreements regarding the fees to be charged? • Does somebody with a bit of knowledge check the lawyers’ accounts, and has any sort of forensic perusal of the legal fees been executed? • What part does the GTM’s legal department — with an advocate and an assistant being employed full-time — play in guiding the municipality in its legal matters? More questions will be asked in the weeks to follow.
Research and reports compiled by Francois Aucamp. If you have any information about wasteful expenditure by the GTM, kindly communicate with him on 015 307 7248 or 083 266 6906 or write an e-mail to editor@bulletin.us.com.

Rhino poachers nabbed Five suspected rhino poachers were arrested in the Gravelotte area in two separate incidents over the weekend, bringing the total of suspected poachers arrested in the province since the beginning of March to 21. The first arrest took place when members of a special rhino poaching investigating task team followed up information on poachers who were planning to shoot a rhino in a nature reserve in the Harmony Block, Gravelotte. The vehicle was observed and stopped on a gravel road. Three suspects were arrested after the investigating task team searched the vehicle and found a 303 rifle and silencer, twelve rounds of live ammo, two axes and knives. While busy on the scene, members received information about another group of suspected poachers travelling in a vehicle in the same area. The information was followed up and the task team arrested two suspects after searching their vehicle and confiscating a 375 hunting rifle, two silencers, live ammunition, an axe, a panga and a knife. In both cases the serial numbers of the rifles were filed and the origins of the weapons

It’s that time of the year again when you can kick off your high heels, school shoes or boots and swap them for your comfy pair of tekkies (we all know you want to). The best part – it is all for a good cause. All you have to do is: Choose the sector you want to support and YES, you may choose more than one. Animals • Basic Family Care • Children • Disability or Education. Get your R10 sticker (that is the tax you pay) and wear your tekkies. are being investigated. The provincial commissioner of the Police in Limpopo, Lt Gen Fannie Masemola, congratulated the team which consists of members of Crime Intelligence, Stock Theft and Crime Prevention on their latest success. The team is responsible for the arrest of 21 suspected poachers over the province since the beginning on March. With the exception of only once incident in the Bela Bela area, members managed to arrest the suspected poachers before they were able to shoot and dehorn any animals. Three poachers also received hefty sentences during March for an incident in the Cumberland area in February. Members of the same task team arrested the three suspects on a farm in the Cumberland area on their way to shoot and dehorn a rhino. They pleaded guilty during their last appearance in the Thabazimbi Magistrates’ Court on charges of illegally possessing a fire-arm and the conspiracy to commit rhino poaching. Mishack Chauke was sentenced to eleven years imprisonment, Tsakane Shihlanhu to six years imprisonment and Thomas Moholole to four years imprisonment. The five suspects who were arrested over the weekend appeared in the Phalaborwa Magistrates’ Court on Monday and their cases were remanded to 20 April for further investigation. They remain in custody.

What kind of justice? Plasies contribute to blood drive The National Blood Service had their quarterly visit at Merensky High School on Tuesday 14 April. This national blood drive is supported by several learners and teachers at Plasieland. Except for the fact that you can save a life by donating blood, there is also a four times a year campaign gift in the form of a sports bag for regular donors. According to the nurses the 37 unit target for the day was reached.
Provincial department in contempt of rights A serious obstruction of the public’s constitutional right to know could be in effect, as the provincial department of education proves to be in contempt of its need to account to the public. Bulletin has recently come across some serious difficulties in sending though enquiries to the department’s spokesperson, Mr Paena Galane (from what we are told), as all roads leading to Galane seem to be blocked. Mr Galane, whose office should be situated in Polokwane, has not been answering his phone, nor has his office, for almost two weeks now. Without Galane, no one in the department can relate matters to the public, as we have been told other government officials are not allowed to independently speak on behalf of the government. Moreover, the state pays a lot of money to have qualified communication representatives/ spokespeople in place. For its manager of communications, the
Greater Tzaneen Municipality last year advertised a vacancy worth R389 336,41 per annum. For a relative beginner in its department of communications, the Greater Letaba Municipality, in the same year, advertised a vacancy worth R203 401,72 per annum. If these are to go by, the spokesperson for the provincial department of education could be earning something along these lines, and maybe more. Mr Galane, or the department thereof, as well as all government institutions, should therefore be in no position to ignore public enquiries. Furthermore, by denying us access to information, government institutions are in contempt of our right to a transparent government. Bulletin will continue probing for an explanation on why the department’s spokesperson and his office have been unreachable. — Joy Mojela joy@bulletin.us.com
Despite being the main institution in the area to implement the law, it looks like the Tzaneen Magistrates’ Court is stepping on a few strings of the law itself through its operation. Magistrates arriving thirty minutes before formal court recesses for two hour court proceedings, absence of court rolls on notice boards, seemingly dysfunctional microphones, interpreters who stutter in English and poor toilet facilities form part of the court experience justice seekers witness at the local Magistrates’ Court. Bulletin was recently shocked by what seems to be a willy-nilly operation of the Magistrates’ Court. We have since sent an enquiry on the court’s operation to the Department of Justice, as the court manager explained that she is not in a position to address the media. The enquiry, amongst other things, includes whether magistrates are permitted to arrive in court independently (at anytime), the criteria used to employ interpreters, maintenance of court facilities and the proper administration of the court. In relationship to interpreters, our enquiry includes whether it is necessary for court proceedings to be interpreted in English if the magistrate residing understands the local vernaculars. Furthermore, it is our concern whether proceedings are properly related by the stuttering interpreter between the magistrate and the accused in cases where the magistrate does not understand the vernaculars. What we do know is that all South African Magistrates’ Courts are to be held in open court. The Magistrates’ Court Act of 1944 states: “Except where otherwise provided by the law, the proceedings in every court in all criminal cases and the trial of all defended civil actions shall be carried on in open court...” What this means is that the pub-
lic has rights to attend Magistrates’ Court proceedings, and justice should be witnessed in the courts (K Stuart et al, 1986. The Newspaperman’s Guide to the Law). In this case, perhaps for proceedings to be interpreted in English might be necessary to accommodate spectators of various language backgrounds, including the media and local students who attend court proceedings for educational purposes. At the same time, the functionality of microphones in courtrooms (their use thereof) and the availability of court rolls should be necessary for the public’s ability, and right thereof, to witness open court proceedings. In addition, poor toilet facilities are a major concern for accused persons who spend almost the entire working day waiting for their cases to be heard. The department has since sent the matter to the regional offices in the province and promised that investigations will commence. Matters relating to magistrates will be referred to the Magistrates’ Commission. We have so far been unable to contact the regional department to enquire about the matter. — Joy Mojela joy@bulletin.us.com

A critical, independent and investigative press is the lifeblood of any democracy. The press must be free from state interference. It must have the economic strength to stand up to the blandishments of government officials. It must have sufficient independence from vested interests to be bold and inquiring without fear or favor. Kontak haar by 084 414 6166 of 015 307 5029 vir navrae.
As jy weer in dieselfde situasie kom, hoe gaan jy dit hanteer? Wat het jy vandag geleer? Meer inligting by: http://www.angriesout.com/resilience.htm
What should we do with diversity in the human race? I recently learned that there are people who are not sexual at all. It is called a-sexuality. They have no sexual feelings, although some may masturbate. As I understand it, they cannot sense (or they sense negligibly) communal sex. I found this amazing, especially because I initially thought sexuality was a given for all human beings. Perhaps, what is even more amazing is that the concept of sexuality was not even discussed when I was at school, and I went to school when Life Orientation was already a subject. I have since come to understand that the education system is not so much inclusive. Besides debates that the system almost everywhere in the world respectively often carries a political agenda, it undoubtedly also carries an elitist — we should all be alike and aspire to this — tone. Hence, amongst other things, only certain aspects of society (science, history, maths, you name it) are considered educational.
Min dinge word juis so waardeer in mense soos opregte nederigheid. Die gesindheid is slegs moontlik as ‘n mens opsien na ’n groter persoon as jyself. (Gal.2:19,20).

STI: Mopani’s people do not protect themselves The provincial department of health’s spokesperson, Mr Macks Lesufi, says Mopani residents are just not taking necessary precautions against sexually transmitted infections. Bulletin spoke to Lesufi after a recent press statement by the department noted Mopani as the district with the second highest reported STI’s in the province during the 2013/2014 financial year. According to the statement, the district with the highest reported infections is Vhembe. Limpopo reported a total of 62 926 STI patients altogether. Limpopo department of health’s spokesperson says the department is constantly educating people about protecting oneself against sexually transmitted infections. “We do everything in our

Sexuality is of course a big example in this case. Patriarchal (glorifying the male, encouraging a male lead) heterosexual relations were the epitome of sexual relations when we were taught biology, called life sciences at the time, at school. I recently learnt that something as basic (seemingly) as sex — male or female — is also not always a given. Hermaphrodites (as they are apparently called) also exist in the human race. They contain features exclusive to either males or females. This is perhaps not ideal for a society that breeds — at least practically (that is, what my closed/un-opened mind thinks) — but so what if some people are created to be different?
capacity to help people understand the risks of unprotected sex. “Condoms are also available for free at state clinics and hospitals,” he said. According to Lesufi, the only reason people still get infected is that they choose not to protect themselves. During the recent national STI Condom Week, the provincial MEC for health, Mr Ishmael Kgetjepe, urged everyone to join the fight against STI’s by using protection during sexual activities, regularly testing for STI and taking treatment, amongst other things. According to the department, over four million people received treatment for STI’s in the country in 2013/2014. — Joy Mojela joy@bulletin.us.com
So what if the human race is more diverse than we can find words to classify the diversity? Does it give us rights to kill, hate or fear what we deem different? In some parts of the world, people are being killed because of their religious beliefs and their perceived ability, or fear thereof, to ‘influence’ others. In some of these areas, not so long ago, laws were set to imprison un-elitist sexual groups for pretty much the same reasons — they are different and can possibly influence others. A couple of years ago, the censorship of the apparent other was done in the name of land. The history of human kind and the planet is riddled by wars on land ownership and identity, the right to belong. Where do we stop, if one may ask? When will we be identical enough to accept and allow for uniqueness, or are we to never be unique, if possible? It is amazing how when God created a companion for Adam, He created a woman instead of an identical man. Who knows, maybe Eve had a different skin colour from Adam’s. They gave birth to children of another skin colour — that is, coloured children — and none of us are in effect original.

again. If you enjoyed a cigarette at social events, avoid these while your cravings are still strong. If you used to have a cigarette with your meals, have your meals where you are not allowed to smoke. Many smokers make a grab for cigarettes when their stress levels climb. Be aware of this. Know your weaknesses. Find a replacement stress reliever. Have a game plan for the inevitable stressful or trigger situations. Creative artist decided to settle in Tzaneen
Mr Eduard Liebenberg (50), born in Pretoria, studied Theatre Crafts at the Pretoria Technikon (called the Tshwane University of Technology these days). He came to live in Tzaneen a few months ago and hopes to lend his talent and expertise to creating employment. His tertiary studies fuelled his desire to enter into the world of fashion design. He ran a CMT factory (Cut Make and Trim)
for a decade and then found a market for his hobby, stained glass, abroad. He was asked to restore a stained glass window at the Church of England’s cathedral in Kilmarnock in Scotland. The window had a huge hole and it took Liebenberg almost three years to restore it. Liebenberg was then approached by the Canadian Museum Services. He based himself in Calgary and lived in Canada for five years. He restored stained glass in old house Liebenberg. museums, cathedrals and churches and undertook private commissions. Every weekend Liebenberg flew to another American state and he proudly states that he’s been to every single state in the USA. With authority he claims that the best place in the country is New Orleans. He returned to South Africa and moved to Cape Town where he designed clothes for
private exclusive clients. His sense of adventure then led him to Holland. He stayed in the small town of Zeist while teaching fashion design and pattern cutting at the Gooise Skool Federatie in Hilversum for a year. He returned to SA, found the right house in Graskop in Mpumalanga and worked in retail for nine years. During this time he also did event planning, ran small art groups for adults and gave stained glass lessons and pottery classes. He also bakes special occasion cakes and cupcakes. Besides designing and making clothes, Liebenberg has a wide range of teddy bears made from traditional seshweshwe African cloth. Quilting is another of Liebenberg’s passions and his quilt won best of show in Johannesburg in 2011. The quilt went to France and was exhibited at the annual European national patchwork meeting. From there it went to Australia for a nationwide tour with a couple of other international quilts.

Two customers, Mss Ms Nicola Brits (right) and Christine Coston, take an ice cream break.
The revival of the Oasis Mall in Aqua Park, Tzaneen, seems to have taken off. Mr Sydney Webb (29) has opened his dual business at the newly named Oasis Entertainment Centre. Originally from a financial background in Pretoria, Webb began Sandeg in Tzaneen a year ago. Sandeg provides for corporate functions. Frozen Spoon, his new venture, is the frozen yoghurt ice cream side. Primary school children are the main customers in the fortnight that he’s been open. Ms Nicola Brits was there when we visited the shop to buy ice cream on her 12-year-old
daughter’s recommendation. Webb changes the flavours regularly and amongst the day’s flavours were cheese cake, litchi, condensed milk and English toffee. The business is open daily until 19:00 (week days) and 20:00.on weekends. Above one door of the shop is written “Big Things Have Small Beginnings”. Webb says that there are moves afoot with more children-related shops coming and a few elite stores. This will spell the revival of the centre. — Sue Ettmayr

SLC had a good rugby tour
The pupils who went on a rugby tour are, in front: David Morris, Cules Kloppers, Pieter de Wit (capt), Mr Steve Willson (coach), Conrad Schmidt (vice-capt), Keegan van Jaarsveld, Michael van Zyl and Aidan Du Preez. In the middle row are Pierre Smalle, Istifah Kalla, Retabiele Matebatha, Rhanda Mongwe, Junior Mashele, Adam McGaffin and Jason Wright. At the back are Edgar Silimela, Thabo Rachidi, Josh de Goede, Dewald Ludick, Austin Johnson, Tristan Baptista, Vusi Muhlari and Bradley Penrose. Unfortunately Ryan Davidson was absent when the team photo was taken.
During the Easter Holidays, Stanford Lake College’s first rugby team had its most successful rugby tour to date. The team travelled to the annual Treverton Easter Sports Festival and faced some tough competition from various schools around the country. The boys got off to a great start by playing
some exciting running rugby, beating Woodhill College 47-3 in their first game. The following day was much of the same, with SLC beating Southcity Schools 2510. The final game was against tour rivals, Maragon College, and the game was a much closer and hard fought affair, with both teams giving everything.
The Stanford boys never gave up and despite being behind the entire game, managed to be awarded a penalty in their half after time was up. Flyhalf Josh de Goede slotted a fantastic kick under pressure and Stanford won the game 6-5 to end off an excellent tour results-wise. The team is now looking forward to a hard season ahead.

Merensky se hokkie byt by Puk
“When people are taken out of their depths they lose their heads, no matter how charming a bluff they may put up.”
