Affordable housing planning measure gains council’s nod

Special zoning designations intended to allow affordable housing projects were attached to six city-owned properties Tuesday night by the City Council. Councilmembers said they weren’t crazy about having to approve the so-called “overlays” but that not doing so could result in the state taking over the city’s planning functions. The application of the overlays will be accomplished through amendments to the city’s General Plan and zoning ordinances. Once the work is completed on city-owned lots, a second phase, involving privately owned properties, will begin, according to city planner Rich Whipple. The state requires that every city in California participate in a “fair share” housing program so that homes are available to those on a wide economic scale. How each city intends to comply with its “fair share” allocation is written in to the housing element of its General Plan. SEE COUNCIL, Page 8

A Poway woman learned Monday that a state agency’s plan to seize birds she cares for in her wildlife center will be put on hold, after the 4th District Court of Appeal for the State of California approved an emergency request granting a two-week stay. Lindy O’Leary can keep the birds, pending the results of a vote on April 17 by a state Senate committee on agriculture that could ultimately change the agency responsible for overseeing O’Leary’s wildlife center, located on her property in Poway, from the California Department of Fish and Game to the California De-
partment of Food and Agriculture. Senator Mimi Walters, R-Laguna Hills, authored the proposed bill and will present it to the committee. In a statement directed to Senate members, Walters said, “In my opinion, there has been a great deal of time and state resources wasted by the Department of Fish and Game to destroy a few disabled birds and the heart of a woman who has devoted herself unconditionally to the welfare of these birds.” If the committee passes the measure, it would still need to be heard by the entire Senate, then the state SEE BIRDS, Page 15
