WHAT’S NEW FOR 2022
EACH YEAR, Landscape Trades dedicates an issue to
showcase new equipment and products for landscape and horticulture professionals. It’s one of my favourites to work on because it’s exciting to learn about the latest innovations, technological advancements and upgrades hitting the market. Every time we survey readers to learn what they enjoy most about the magazine, new products top the list. It’s no surprise. Great equipment and products can save time and money on the jobsite. They can also drive sales. Flip through pages 6-31 and you’ll see a whole lot of new mowers, blowers, trimmers, chain saws, pavers, stones, excavators, trucks, loaders, mulchers, loppers, dumpers, and just about everything else you need to do what you do best. There is a lot to get excited about, but one trend stands out above the rest: Battery power has entered the pickup truck and mid-size equipment space. Both Ford and GM are set to launch their first electric pickup trucks this year, with the F-150 Lightning coming in mid-2022 and the Hummer EV pickup slated for the fall. Rivian is poised to be the first company to launch an all-electric pickup truck in Canada, with its R1T scheduled to roll out in July. Chevrolet will join the group in 2023 with the Silverado EV. On the equipment side, Bobcat recently unveiled its
first all-electric compact track loader, the T7X. Yanmar announced an electric mini excavator prototype, Merlo has a pair of electric telehandler models and Greenworks offers a battery powered UTV. John Deere also just fianlized an agreement to purchase Kreisel Electric, an Austrian battery technology provider. These pickup trucks and mid-sized machines join the many mowers, blowers, trimers, chainsaws and tools that make up an ever growing, and improving battery powered equipment segment. Will all our trucks and machines go electric? There are certainly some big benefits. In Canada, our electricity is mostly clean. Clean Energy Canada estimates our grid is 83 per cent emissions free, so moving away from fossil fuels can make a significant impact on greenhouse gas emissions. Add in the fuel cost savings, as well as the decrease in fumes, noise and vibrations, and the case for battery power is compelling. On the other hand, it remains to be seen if the latest advancements in battery technology will address the areas where electric equipment has fallen short in the past. Will the trucks and machines provide enough power to do the job? How long will their charge last? How will the upfront costs compare to traditional options? Landscape Trades interviews Canada’s Ag Minister on the government’s response
I
n November 2021, heavy rains caused catastrophic flooding across British Columbia’s lower mainland. The damage was staggering: mudslides shutdown major highways, disconnecting road and rail routes in and out of the province; over 640,000 livestock were killed; more than 15,000 people were forced from their homes; and experts estimated $450 million in insurance damage. Landscape Trades recently connected with Marie-Claude Bibeau, Minister of Agriculture and Agri-Food, to find out how the federal government is supporting nursery growers impacted by the floods.

You recently toured the flood zone. What was the experience like? What did you hear from farmers on the ground? Marie-Claude Bibeau
Landscape Trades: What impact has the British Columbia flooding had on the agriculture sector in the region? Minister Bibeau: The governments of Canada and B.C. continue to stand with farmers and communities who are feeling the impacts of extreme weather conditions. The governments continue to work together – and engage with the sector and Indigenous leaders to understand the full impact of the floods and landslides – in order to

Minister Bibeau: Minister Popham and I visited some of the affected farms, including dairy and poultry farms and a winery. We spoke with local farmers and saw and heard how these events devastated many B.C. farms. We also heard stories of courage and resilience and how farm families worked together in the face of adversity. To see the impacts of the floods and landslides in person truly demonstrates how fragile the environment is, but also how resilient and courageous communities and people can be when faced with adversity. The Government of Canada will continue to work closely with the province of B.C. to provide support to help deal with the challenges it faces today, and to better adapt and prepare for future climate change events.
How is the federal government supporting farmers in the impacted areas? Minister Bibeau: The federal and provincial governments held an industry roundtable with B.C. agriculture representatives to discuss both immediate and long-term support for the agriculture and agri-food industry, including a recent provincial request to launch a joint assessment under the AgriRecovery Framework. Federal and provincial officials are working to complete the joint assessment and help producers with their extraordinary costs. Outreach is already underway to specific provincial commodity groups to determine these costs. Programming under AgriRecovery will roll
out as soon as those assessments and the program design are completed. Prime Minister Justin Trudeau and Premier John Horgan also announced a committee of federal and provincial ministers who will work together, and with Indigenous leadership, to guide immediate and ongoing support to British Columbia families, businesses, farmers and communities affected by the extreme weather events. There has also been the assistance from Canadian Armed Forces personnel, who have been on the ground since mid-November to help farmers rescue livestock, resupply food to isolated communities, help repair critical infrastructure and assist continued > with supply chain movement.

agricultural production that continues to ensure the growth of the sector. That’s why our Government announced over $550 million in new programs last year to achieve a vision of environmental sustainability in the agriculture sector. In December 2020, as part of our strengthened climate plan, A Healthy Environment and a Healthy Economy, the Government of Canada committed to develop Canada’s first National Adaptation Strategy with provincial, territorial and municipal governments, Indigenous Peoples, and other key partners. Development of the strategy offers the opportunity to unite actors across Canada, including in the agriculture sector, through shared priorities, cohesive action, and a wholeof-Canada approach to reducing climate change risks. I continue to work with my colleague, Minister of Environment and Climate Change Steven Guilbeault, on our shared mandate commitment to establish a Canada Water Agency to work together with the provinces, territories, Indigenous communities, local authorities, scientists and others to find the best ways to keep our water safe, clean and well-managed. In addition, the Canadian Agricultural Partnership, a five-year, $3-billion investment by federal, provincial and territorial governments, is supporting on-farm actions including $2 billion through cost-shared programs that are delivered by the provinces and territories. This includes programs designed to raise producer awareness of environmental risks and support the adoption of on-farm technologies and practices to reduce these risks, such as protecting water quality, reducing emissions and conserving biodiversity. Producers also have access to a suite of Business Risk Management programs to help them manage significant risks that threaten the viability of their farms, and are beyond their capacity to manage. These measures can also help increase the sustainability of their business. LT

CCDC updates Stipulated Price Contract BY ROB KENNALEY THE CANADIAN CONSTRUCTION DOCUMENTS COMMITTEE (CCDC), made up of representatives
from all levels of the construction sector, prepares standard form construction contracts for use in Canada. Last year, it introduced the new CCDC 2-2020 fixed price standard form, in large part to bring it in line with prompt payment and adjudication legislation which has been introduced, is being rolled out or is being considered in most jurisdictions in Canada. It is the first CCDC 2 to be updated in this regard. The CCDC forms are intended for national use, and the legislation will vary from jurisdiction to jurisdiction. It’s accordingly not possible for the Committee to dovetail its forms to the legislation in any detailed, surgical way. The most the Committee can do is make the forms conform with the aspects of prompt payment and adjudication which it believes will be common across jurisdictions and, then, make the forms subject to any applicable “Payment Legislation” in any event. The new form follows the basic approach to payment set out in Ontario’s Construction Act, R.S.O. 1990, c.C30. In this regard, both the new form and the Ontario Act require that a payment application (or “proper invoice” under the Act) be given
to the owner and paid within 28 days unless a written notice giving reasons for the revision or rejection (which is a “notice of non-payment” under the Act) is given to the contractor within 14 (calendar) days. As regards to adjudication, the new form merely provides that nothing in the Contract affects the parties’ rights to resolve a dispute by way of such legislation. In addition to bringing the CCDC form(s) into conformity with prompt payment and adjudication legislation, there is much that can be done, contractually, to address gaps, confusion and inconsistencies in the legislation and better manage risks associated with the same. In what follows, we will review some contractual mechanisms that might be used, in the context of Ontario’s Construction Act. Those in Ontario might consider addressing these issues, regardless of the form of contract being used. Parties in other jurisdictions should consider whether similar issues arise under the form in place, or being considered, in their jurisdiction. First, the provisions of the prior Construction Lien Act apply under contracts procured or entered into before July 1, 2018, and the prompt payment and adjudication provisions apply under contracts procured or entered into on or after Oct. 1, 2019.

Toward avoiding confusion, the contract can expressly confirm when it was procured (if at all) for the purposes of these provisions. We suggest payment obligations be altered by Supplementary Condition to expressly bring them in line with the Act, where prompt payment and adjudication apply. For example, while the Act requires (unless a notice of non-payment is given) that the holdback be paid upon the expiry of the lien period, the updated CCDC 2 requires payment within 10 days of that expiry. In addition, final payment is to be made under the Act within 28 days of the contractor’s proper invoice for the same, while the updated CCDC 2 requires payment within five days of the consultant’s certificate in that regard. In addition, where a notice of termination of the contract is published, the party publishing might be required to provide a copy of the Notice to the other party as this is not actually required by the Act. This, because lien rights under the Act will commence ticking at the time of the termination set out in the notice. Also, under both the old and new versions of the Ontario Act, many documents must be “given.” Although determining how this occurs is not simple, the parties can agree to do so by email communication, and this agreement can be set out in the contract. In addition, the Act requires various documents to be published in a “daily construction newspaper” (including certificates of substantial performance, notices of non-payment of holdback, notices under the Condominium Act and notices of

termination of a contract), which can now be an online publication which meets prescribed requirements. As there are now three online options in that regard, the newspaper in which the documents should be published might be clarified in the contract (although publication in a publication which complies with the Act will nonetheless be effective). Contractors should be careful to review the terms of a tender package or contract to understand how the owner might have altered payment provisions to better meet its payment obligations under the Act. These might include contractually varying the requirement that proper invoices be given monthly, requiring payment applications to be provided initially in draft form and/or with additional information or documentation, protocols for precisely when and where invoices and backup are to be sent and site meetings or walk-throughs for the purposes of review. Ontario’s Act allows for the early release of holdback, either annually or on a phased basis, in certain circumstances where the contract calls for it. Contractors may wish to negotiate for the annual or phased release of the holdback, where possible. As regards adjudication, Ontario’s Construction Act allows parties to agree on aspects of the process, so long as the Act’s requirements are complied with. In this regard, there are innumerable things that parties can do, in their contracts and subcontracts, to more effectively manage the risks associated with the process. The following options might, for example,

be considered by way of Supplementary Condition: (i) Developing a process to name agreeable adjudicator(s), to avoid an adjudicator with little experience with the legal or factual issues being appointed in the relatively short four calendar day time-frame the parties are otherwise given to agree on one (using a process for selecting a project mediator which is already called for under the CCDC 2). (ii) Allowing a notice of adjudication to be given after the contract or subcontract has been completed, as disputes often don’t arise or become heightened until after that date; allowing more than one matter to proceed to adjudication at a time (subject to the adjudicator’s agreement); agreeing (subject to the adjudicator’s agreement) on timelines and processes for the adjudication, including those relating to the exchange of documents, the introduction of evidence, rights of reply and oral submissions; and altering the rules for and timelines for mediation and arbitration, to make them more palatable to the parties than an adjudication under the Construction Act, if the parties wish to avoid adjudication all together. Pepper Dragonfly Dragonfly pepper plants produce beautiful fruit that have thick, sweet walls, unlike the thin papery walls of other purples on the market. This is as delicious at the green stage of maturity as it is when transitioned to fully purple and mature with a robust pepper flavour. Fruits are held high on the plant, keeping them from the soil. CONGRESS CANCELS 2022 TRADE SHOW
John Deere has signed a definitive agreement to acquire majority ownership in Kreisel Electric, a battery technology provider based in Austria. Kreisel develops high-density, highdurability electric battery modules and packs. Kreisel also developed a charging infrastructure platform that utilizes its patented battery technology. Since 2014, Kreisel has been focused on the development of immersion-cooled electric battery modules and packs for highperformance and off-highway applications. The company has a differentiated battery technology and battery-buffered charging infrastructure offering. They currently serve a global customer base across multiple end markets, including commercial vehicles, off-highway vehicles, marine, e-motorsports, and other highperformance applications. “John Deere sees demand growing for batteries as a sole- or hybrid-propulsion system for off-highway vehicles,” a media release from the company says. “Products in Deere’s portfolio such as turf equipment, compact utility tractors, small tractors, compact construction, and some road building equipment could rely solely on batteries as a primary power source. Deere intends to continue to invest in and develop technologies to innovate, deliver value to customers, and work towards a future with zero emissions propulsion systems.”
Landscape Ontario Horticultural Trades Association cancelled its trade show due to COVID-19. The show had been scheduled for January 1113, 2022 at the Toronto Congress Centre. “We are saddened and disappointed that we have had to cancel the Congress 2022 in-person trade show,” the association said in a news release. “The COVID-19 situation has made it impossible to proceed. Everyone who purchased trade show passes will receive a full refund. Planning will also begin for the 2023 Congress Trade Show, which will mark the show’s 50th anniversary. We hope you will be there with us.” Landscape Ontario Congress is Canada’s largest green industry event. The trade show and conference hosts 15,000 people annually, for a show floor with over 400 landscape and horticulture exhibitors. The 2023 event is scheduled for January 10-12 at the Toronto Congress Centre.
SB&D ACQUIRES MTD AND EXCEL Stanley Black & Decker completed the acquisition of MTD Holdings and Excel Industries. The purchase price for the two transactions totaled $1.9 billion USD. Headquartered in Valley City, Ohio, the MTD family of brands includes Cub Cadet, Troy-Bilt, Robomow, Rover, and WOLF-Garten. Based in Hesston, Kan., Excel is a designer and manufacturer of commercial and residential turf equipment under the distinct brands of Hustler Turf Equipment (Hustler) and BigDog Mower Co. (BigDog). Based in New Britain, Conn., Stanley Black & Decker operates the world’s largest tools and storage business featuring brands such as Dewalt, Stanley, Black+Decker and Craftsman.

YEAR OF THE GARDEN 2022 BEGINS MARCH 20 The Canadian Garden Council’s (CGC) Year of the Garden 2022 officially launches on the first day of spring, March 20, 2022. The initiative celebrates the Canadian Nursery Landscape Association’s (CNLA) 100th anniversary. Numerous garden clubs, horticultural societies and public gardens across Canada are planning special activities to celebrate. Municipalities such as Toronto, Winnipeg, Red Deer, Halifax, Saint Andrews, and Brantford have proclaimed 2022 as their Year of the Garden. Throughout the Year of the Garden 2022, there will be many ways to “live the garden life” and make a difference. Canadians can get involved in one of the many Year of the Garden 2022 programs, including: plant red and show your Canadian garden pride; sign up your garden as a 2022 Celebration Garden; celebrate your municipal proclamation; and celebrate your garden heroes. The Year of the Garden 2022 will also be an exciting time to experience and celebrate why Canada is known as a nation of gardeners and gardens. For the past 18 months, CNLA’s 100th Anniversary Committee and staff have been planning a celebration of our industry. We are excited to announce the celebration is set for Aug. 11, 2022, in Ottawa. The day will include a bus tour of local member companies and some of Ottawa’s great attractions. The evening will be capped with the 100th Gala at the Fairmont Chateau Laurier. A commemorative yearbook is also in the works with Rita Weerdenburg at the helm. Building on “The Rock” LANDSCAPE TRADES recently had the opportunity to talk landscaping with builder Randy Spracklin, of HGTV’s Rock Solid Builds fame. A third-generation builder with an artistic flair and deep roots in his community, Spracklin lives with his young family in postcard-perfect Brigus, N.L. The co-owner of Newfound Builders, Spracklin is a funloving, hands-on boss who oversees crews working all over the island. Landscape Trades: How important is a high-quality landscaping solution to your typical renovation/building project? Randy Spracklin: That all depends on the property and the client. Overall, a house needs to fit into its environment. Landscaping doesn’t need to cost a fortune, but a few strategic expenses can go a long way. Being able to enjoy your property increases joy — and there’s no price tag on that.
What can landscapers do to help homeowners understand the value and necessity of their work in a typical renovation/ building project?
Building and landscaping go hand in hand. So, if you’re committed to your home, you’re committed to your property. You have to look at it as one beautiful package. And, when you do, you can’t separate one from the other. Of course, you can always tackle the outdoors later, once you’ve got a solid roof over your head… and the dust has settled!
What are some of the measures landscapers can take to build a stronger relationship with professionals like you?
Any long-term relationship has to be win-win so that everyone walks away happy. Flexibility is key since every building project is bound to come off the rails at some point.

What portion of the total renovation budget should landscapers expect to be devoted to their work?
Tough to say. The sky’s the limit when it comes to landscaping. For some people, outdoor spaces are more important than their interiors so they’re prepared to spend an arm and a leg. But, on average, I usually earmark around five to 10 per cent. And, I always expect spectacular results — no matter the size of the budget!
What are some of the most memorable landscape projects you’ve been associated with and why?
Hard to pick a favourite. Working in Newfoundland means we’re constantly surrounded by some of the most incredible natural landscaping on the planet. I’m a nut for that kind of beauty. The dramatic rocks, the history, the ocean — whenever we make the most of all these elements — that’s my favourite project.
What are some of the most disappointing landscape projects you’ve witnessed and why?
A landscape project has to fit with the property. And, when that scale isn’t respected, you get a result that’s wonky. Plus, I’ve seen some expensive and sketchy lawn art that’ll raise eyebrows and would have been better invested somewhere else.
What are some of the special features landscapers can add to a property to make a significant impact?
A great landscaper will showcase the natural beauty of a property and will focus on the longer term, like gardens that have something to look at in every season and trees and shrubs that mature alongside your family. Personally, I love a great water feature and a yard that has something special for the kids. LT
