Supporting mental health and positive wellbeing FROM THE PRESIDENT

When I took on the role of President this year, I did so with the comfort that I was taking over from a highly regarded and respected person who had made great achievements for our members and also set up systems going forward to help look after them. The LVML board were more than aware of the knock-on effects that the Covid-19 pandemic had played within our industry and community and decided that we needed to do more to support them.

As you are all aware the past few years have been a rollercoaster ride for everyone. With demanding growth for landscaping services, so too came the restriction on materials and supplies, struggles to find staff and retain them and frustrating delays with planning and permits.

Additionally, we experienced a true ‘Annus Horribilis’ with the extreme wet weather 2022 brought to Victoria. All this lead to blowouts to deadlines and renegotiations to contracts, putting more and more pressure on our members, especially the small business owners.

Packed with evidence-based resources the LVML Wellbeing Hub is guided by the PERMAH theory, which suggests wellbeing is cultivated by the presence in our lives of positive emotion, engagement, relationships, meaning, accomplishment, and good health.

LVML members and their teams can register and access the resources within the LVML Wellbeing Hub free of charge. Individuals who are especially passionate are also encouraged to become Wellbeing Champions, which will provide them with the skills to guide discussions around wellbeing within the workplace.

This initiative is a first step in ensuring members have access to the right resources to look after themselves and check in on the wellbeing of their team.

With this in mind, we invite everyone to get on board and look out not only for yourself, but also for those around you at work and home.

This year we have again had to deal with the added pressure of constant interest rate rises, putting further pressure on clients, staff and businesses everywhere.

As stated last year ”Upholding professionalism and integrity in the face of adversity is what sets our members apart”.

However, LVML felt there was more work to be done to support its members during these challenging times. Not only to survive this wave of change, but also to make sure there were able to thrive and flourish in the long term.

Thanks to a grant from the Business Victoria Mental Wellbeing of Business Communities Grant Program, LVML were very proud to be able to launch the LVML Wellbeing Hub. This is an online resource designed to support and engage landscaping professionals on their journey to improved self-care.

FROM THE CEO

With a cracking Golf Day to open our year in terms of Member activity, the seasons seem to have passed more quickly than ever and we are about to open the doors to The Landscape Show for another year! It is hard to believe!

In between we’ve been busy with the Melbourne International Flower & Garden Show, the Trades Fit Career Expo, an appearance at the Bunnings Trade day and in amongst that the Executive Team have been working with the Board to develop the Strategic Plan for the coming financial year and carrying out ‘business as usual’ activities needed to support our growing member base.

As you will see from our Golf Day wrap up on page 33, this Member event continues to grow and this year we needed to run two sessions back-to-back to accommodate everyone who wanted to join in the fun and support our charity partner This Is A Conversation Starter.

The amazing efforts by several of our members, alongside other industry players, dominates this edition as we celebrate and applaud the efforts of everyone involved at MIFGS who bring the Carlton Gardens to life over a magical five days.

Taking out a Gold award as well as the Mark Bence Construction Award and the Peugeot Innovative Design Award, MINT Landscape Design deserve a special mention. Check out their stunning garden AURUM on page 13.

Despite some gloomy weather, show crowds were up this year and a big shout out has to go to the many volunteer members who helped us at the LVML Advisory Centre either answering questions for the visiting public or distributing our famous buckets and copies of The Best. Your help is vital to educate the public as to why we exist and the necessity that they only engage professionals when considering landscaping services.

The Industry Function was also a big hit, and the resulting fun photos are on pages 26 - 27.

Public education is just one aspect of our advocacy & promotion efforts and leveraging our valued relationships with other industry groups and government contacts to effect change and support the growth of our industry is another. It is disappointing that at the time of writing we are having to engage these relationships to try to save the Swinburne Horticulture Department.

We can only hope that when Earthstyle Spring/ Summer comes out we will have some good news to report.

Work continues on our Workplace Innovation and Training Fund project to deliver a new Advanced Landscape Design and Construction course-in with Pilot Programs being prepared to launch in July. Our Landscape Designer members are encouraged to sign up to participate in this pilot course to assist us as we push towards completion and the all-important course accreditation we ultimately need to secure a future registration class for this group of professionals. More about this next development phase can be found on page 29.

Connection and networking are critical to support the success of our Members’ businesses, and I hope to see many members and their staff at The Landscape Show on May 24th taking advantage of the exhibits by more than 80 industry suppliers. Support from businesses such as Arborgreen, who jumped at the chance to become our presenting partner this year alongside major sponsors Coolabah Turf and Milwaukee Tools, illustrates a depth of commitment to, and belief in, our Association’s ability to support the sector. I urge members to reciprocate that support wherever possible, be that through direct relationships with these valued partnerships, or by attending the events they help us deliver.

With few opportunities for public accolades, I would like to acknowledge my wonderful team; Bianca, Darren, Nicole, Colleen, and our newest member of staff, Ella, who joins us as Admin Officer. The effort, dedication and enthusiasm shown by this small team to accomplish all that they do to support you, our members, is nothing short of astonishing. My sincere thanks to you all.

It was on these pages a few years ago the current Warner’s Chair, Michael Warner published an article on the value of relationships and the importance of trust in business.

The recent Melbourne International Flower and Garden Show (MIFGS) highlighted again just how important these two factors are today. As written then, “The very best landscapes arise from a place of sharing and collaboration. They evolve and grow through the alignment of ideas and values of the people who work together to passionately bring them to life. When others can see what you can see…. that’s where the magic happens.”

The theme running through various conversations at MIFGS this year was that of relationships and working together.

The very nature of lending a hand has been recognised this year with the inaugural ‘Spirit of The Show’ award presented to Martin Semken of Semken Landscaping. Martin and his team have been recognised for contributing significantly to the success of MIFGS through their enormous effort & support over many years.

That this award has been initiated by The Show organisers speaks of the importance of working together as an industry - collaborations between designers, contractors and suppliers are what contribute to creating something special.

Whilst completing a Show Garden or indeed a real-life project is important, it is the satisfaction of working together to ‘realize the vision’ that is often the most rewarding.

“This is where community plays an important role in the success of the project. Major industry events, such as the Australian Landscape Conference, MIFGS and LV Awards contribute to the advancement of landscape and design

practices – not by spruiking products and prices, but by allowing the opportunity for individuals to network, to connect and build relationships and seek out others who care enough to see what they can see.”

MIFGS reflects the relationships that exist in the day-to-day world of our industry. The five-day show presents an opportunity to collaborate with others, have some fun and allow us all to grow together, not just as individuals, but as collective businesses and Industry bodies. Working together builds trust, and that foundation allows us all to share and prosper.

'The Container Garden'

'The Container Garden' is the ultimate garden oasis, designed with every aspect of outdoor living in mind. This space has been created for entertaining, relaxation, cooking, and spending quality time with friends and loved ones. As we’ve all learned in recent times, our outdoor spaces are more important than ever, and this garden truly celebrates the joy of being together.

A standout feature of the garden is the use of two recycled shipping containers. By repurposing these containers, they are given a new lease on life, while also being cost-effective and adding a striking element to the overall design. These containers have even allowed for the creation of a rooftop terrace, perfect for taking in beautiful views.

The garden incorporates a water feature, an open lawn, and a wood-fired cooking station. The plant selection blends harmoniously with the containers and surrounding elements, with a mix of textures and colours that bring a sense of warmth and comfort to the space.

For those looking to host a gathering or simply enjoy a peaceful moment in nature, the garden provides a breathtaking outdoor oasis where one can discover the true beauty of outdoor living.

'Aurum'

'Aurum' (latin for gold) is an exploration of form, materials, texture, pattern and colour in the landscape.

Much like the modern Hollywood style, 'Aurum' is unashamedly hedonistic and glamorous yet grounded in nature. The design weaves elements of modernist and art deco philosophy together and reinterprets them using contemporary design principles.

The fresh colour palette brings aesthetics to the fore in a design that is climateconscious and people-centric.

Like all art, 'Aurum' is an exploration of balance within the landscape; bold versus delicate, man-made and natural. The result is an elegant resolution, a garden that flows in a cohesive narrative.

GOLD SHOW GARDENS

'The Bamstone Garden'

'The Bamstone Garden' is an exquisite representation of a love story that transcends time and distance.

This contemporary garden portrays the tale of two hearts separated by a small island off the coast of Galway to the mainland. The design aims to take visitors on a journey through a rocky, maritime landscape, reminiscent of the journey made across the Atlantic from the Connemara coast.

The garden features a series of natural steppingstones that elegantly weave through the landscape, leading visitors to an island of tranquillity. Here, a single large, bright Gleditsia triacanthos ‘Sunburst’ tree stands tall, providing a beacon of hope to those who wish to return to their loved ones.

The key elements of 'The Bamstone Garden' include water, natural stone paving, boulders, and lush planting. To further enhance the garden’s appeal, a portal dolmen-esque stone structure with a stone table and seating has been incorporated, allowing visitors to relax and appreciate the natural beauty of the surroundings.

'Consciousness'

An elegant contemporary garden, 'Enscape' was designed with both aesthetics and environmental impact in mind. The use of locally and sustainably sourced materials, such as recycled brick, reclaimed timber, and rammed earth, reduces the carbon footprint of construction.

The garden features a variety of Australian plants, including Indigenous species from Melbourne, used in innovative ways to challenge traditional native garden design.

One notable feature is a low hedge of Common Correa. The garden also prioritises biodiversity, with local plant species selected to provide food and habitat for a range of living things, from birds and reptiles to insects and amphibians.

This outdoor space contributes to the local ecosystem while creating a unique sense of place.

SILVER GILT SHOW GARDEN SILVER SHOW GARDENS

'Villa Di Lusso'

Named 'Villa di lusso' (a.k.a ‘Luxurious Villa’), this garden draws inspiration from the Mediterranean and presents a contemporary and elegant style. Stepping up through a curved archway into a luxurious sleek structure, visitors take in the views of the pool and unique landscaped garden.

As guests walk through the garden, separate zones are connected seamlessly together to immerse them in each entertaining space. Rustic and modern materials work together adding layers of luxury to this harmonic outdoor space. Split face limestone adds texture and tone while sandblasted limestone feels earthy underfoot. Hand-cut clay tiles with pops of earthy tones are an opulent feature with brass features to the finishes.

A backyard oasis that will leave visitors feeling like they’ve stepped into their own private hideaway.

'Mindset'

Designed by InStyle Gardens

Titled 'Mindset', this garden aims to inspire people to focus on positivity and appreciate the little things in life. This beautiful oasis is complete with a dining/fireplace zone, a lawn area with bean bags and a projector screen, and a bench seat under a stunning cloud-pruned Olive tree. To promote the importance of spending time outside in nature, there is also an outdoor shower/concrete bath combo.

'Mindset' follows the trend of natural-looking designs, with perennials as the most popular style. The use of architectural concrete and natural stone for walling and paving has also significantly increased in construction over the past 25 years. The push towards reducing waste and recycling products is another improvement that deserves more recognition.

'Lunaria Pods'

Designed by Inge Jabara

'Lunaria Pods', designed and constructed by Inge Jabara Landscapes, draws inspiration from the biennial plant, Lunaria biennis. The garden takes its name and shape from the translucent pods of the Lunaria plant, which typically flower in the spring. Jabara was struck by the shape of the pods, individually and as branches, and the way they let light into where the seed is held, similar to how light enters a home.

This theatrical and futuristic Show Garden mimics the branch and pod structures of the Lunaria plant. The concept of the garden is to motivate people to create living spaces that are inspired by their living environment. The result is a futuristic green living space that integrates seamlessly with its surroundings.

'Lunaria Pods' is a thought-provoking garden that challenges our notions of how we live and interact with our surroundings.

SILVER SHOW GARDENS

A wellness garden, 'Composition' is a place to explore one’s inner consciousness.

'Composition'

Transporting visitors to a place of serenity, the garden’s grand entrance features a forest of traditional Japanese trees and shrubs that bathe the senses as two bodies of water bring calmness. A natural stone cobble pathway leads visitors through the garden.

A negative space of raked river sand and charcoal pebbles creates a sense of emptiness that is critical for one’s mind. The focal point of the garden is a large waterfall with a traditional Japanese rice paper wall as a backdrop. The outdoor room creates a place for contemplation and a chance to immerse oneself in nature. A small decking area nestled into the corner of the front lagoon creates an idyllic spot to just ‘be’.

BRONZE SHOW GARDEN

'Alone. Together'

'Alone. Together' is a collaboration with Beyond Blue to shed light on the increasing health concerns stemming from social isolation and loneliness. The garden serves as an educational platform, utilising parks and gardens to promote belonging, foster dialogue about loneliness, and inspire further research in designing for wellness.

The garden showcases a contrast of landscapes in its design, presenting a Hydrangea against the backdrop of a Messmate forest, protected by a large Dicksonia frond. The garden’s scale and magnitude celebrate social isolation and offer ample opportunity for visitors to connect with others. The show garden encourages people to revisit national parks and highlights the benefits of such visits to health and wellness.

Victoria Master Landscapers Boutique Gardens Competition at the Melbourne International Flower and Garden Show! A big congratulations to their build crew Better Landscapes for bringing their vision to life.

As a past finalist in the Boutique Garden competition Alistair has returned this year alongside Elliot with another innovative boundary-pushing design, Karrikin Garden. Their concept explores the regeneration and rejuvenation that fire can bring to the Australian landscape and celebrates a garden that derives its form from the rhythms and systems of our dynamic landscape.

'Slant'

'Slant' by Riley Cooper Landscape Design & Horticulture was awarded second place in the Boutique Garden Competition for 2023.

Inspired by the undulating hills of where the Otways meets the western stony rises, 'Slant' looks at how we live within a sloping site without an overuse of traditional hardscape intervention.

The vibrant planting palette offers a variety of texture, foliage and flower, and creates a dynamic wilderness that gives year-long interest to the garden. Often gardens are designed to control and tame, however this garden is designed to complement itself in its wild, untamed structure.

Congratulations Riley and the team at Bays Edge Landscapes for executing the build on Riley's vision.

BOUTIQUE GARDENS

'Techtonic Fluidity'

'Tectonic Fluidity' by Paul Pritchard Landscapes took out third place in the Boutique Gardens Competition and was constructed by the team at Adam Hompas Landscapes who executed Paul's vision with exceptional detail.

'Tectonic Fluidity' represents an exercise in tectonic fluidity and meditation, an opportunity to expand a small area through the use of varying levels, textures & movement. Sharp angles are displayed yet one is able to move seamlessly throughout the dynamic garden.

The design employs line, shadow and form as tools to expand the perception of space, whilst using the flora and water to bind a sense of tranquility and freedom.

'The Duality Garden'

Bronni's design captured alot of interest from well-established industry professionals and we have no doubt Bronni's career will be stellar as a result.

'The Duality Garden' explores the nature of duality and of opposing elements that create beauty and balance. From the soft sway of the grasses against an architectural arid aesthetic, to a dark expanse of water capturing the reflection of light, this is a minimal and modern interpretation of an old world aesthetic, offering reconnection to an inner world within a refuge from the outer world.

A special mention to her build crew KlayCon Landscape Construction for bringing Bronni's vision to life.

'Garden Reflections'

It was wonderful to see Lachlan's 'Garden Reflections' come to life, and we congratulate Lachlan on being a finalist in the Boutique Garden competition at this year's Melbourne International Flower and Garden Show.

'Garden Reflections' exudes a cool tonal palette that oozes a soft and textural style. It wasn't designed to be showy, but to conjure peaceful and comforting sentiments when you're experiencing its existence.

The natural bluestone adds a cool warmth to the base of the garden whilst the Betula pendula and dual pencil pines, frame the “room” with its elegant bark, draping foliage and slender height.

External walls with a darkened tonal base allow for the collection of plantings to illuminate and showcase individually, and in unison.

MIFGS Industry Night

Over 350 industry people from LVML, NGIV and Flowers VIC enjoyed an evening in the gardens during MIFGS, networking, catching up with old friends and making new aquaintances.

The Industry Night is also a way to thank the volunteers who spent countless hours in the Advisory Centre, handing out magazines, buckets and chatting to attendees. When Megan Flower, CEO of Landscaping Victoria Master Landscapers, first conceived The Landscape Show in 2018, she identified a gap in the Australian market for a trade-only expo for the landscaping industry. What an amazing day on the green! Our annual charity golf day was a huge success, and we're thrilled to announce that it was our most successful golf day turn out to date! Your business name is a valuable asset

What is a Business Name? Do I need to register my Business Name?

A business name simply means the name that you use in relation to your business.

Under the Business Names Registration Act

2011 (Cth) (“the Act”), you need to register your business name if you are carrying a business under that name unless:

You are an individual and you are carrying the business under your personal name;

• You are a corporation and you are carrying the business under the corporation’s name; or

• You are a partnership and you are carrying the business under the names of all of the partners.

While you are required to register your business name, please note that the registration of the business name alone does not grant you any intellectual property rights over the business name. If you would like to own exclusive rights over the business name in relation to the goods or services you sell, you need to apply to register a trade mark with IP Australia.

Accordingly, having a registered business name might not necessarily give you the rights to carry on a business under that name.

If your registered business name could cause confusion due to its similarity to any registered trademarks, you might still be in breach of trade mark law and/or the Australian Consumer Law for misleading and deceptive conduct.

Once you have registered your business name, your business name will be recorded in the National Business Names Register.

Transferring Your Business Name

If you sell your business, you can transfer your registered business name online via the ASIC website as follows:

• You need to have an account with “ASIC Connect” and obtain a password, which you can use for all future dealing of the business name.

• To transfer the business name, you need to first request to cancel the business name.

• By requesting to cancel the business name, ASIC will offer you the option to request to transfer the business name. If you choose this option, ASIC will send you a letter with a unique number.

• Simultaneously or after the settlement of your sale of business, you can provide the unique number to the purchaser. This will enable them to register the business name exclusively within a three month period.

WTIF Project proceeds to Pilot Phase

After four years of planning and applications, and another 16 months of development work, the Workplace Training and Innovation Fund project “Towards Accreditation and Registration: Landscape Design & Construction Course-In” is preparing to enter the Pilot Phase.

A small army of people have been working with LVML to reach this point including many of our own members acting as Subject Matter Experts. They have been guiding, checking and critiquing the work of professional course writers and adult-learning developers as they work up the course content into formal documentation, toolbox resources, videos and AR content.

The next critical step is to pilot that content to make sure it is relevant and can be delivered in a logical and understandable way to achieve the highest outcomes for learners.

We are now calling for all interested professionals to apply to join one of two pilot courses. Feedback provided by the pilot learners will shape our final submission for accreditation early in 2024.

Timing: Pilot One will run between July to September, and Pilot Two will run between September to November. Specific dates and details will be provided to successful applicants.

Call for teaching staff: We are also keen to hear from anyone interested in delivering the course content as a facilitator. It is not necessary that you hold your TAE certification as we will be operating the delivery of this course under Pilot conditions, so if you’ve ever wanted to dabble in teaching, now is your time!

Please email mflower@landscapingvictoria. com.au to express your interest in teaching, outlining your experience. All teaching materials will be provided, and guidance from experienced teaching staff will be available.

Eligibility: To participate in the Pilot program learners can enter from one of two streams. You can either:

ƒ hold a Landscape Design or Architecture qualification (min Cert IV) AND have at least 2 years industry experience in a design role.

OR

ƒ have worked in the Landscape Industry but do not have the minimum qualification, however can demonstrate the acquisition of significant industry experience in providing landscape consultations, designs, and drawings for the domestic, commercial or industrial sectors, including:

ƒ Sole Traders, Studio Owners, Employees (working for a Design Studio or a Landscaper)

ƒ Landscaping and Horticultural service providers who offer non-structural services such as soft landscaping and garden maintenance

(Note: for piloting purposes only, this course is not suitable for a person who has graduated from a design course within the last 2 years.)

There is no cost to complete the course under the Pilot Program and once the course is accredited, learners who have participated in the Pilot will be eligible to apply for their certification.

LVML has long been campaigning for the introduction of a recognised advanced skill set for landscape designers as there are currently no courses that offer a combination of extensive design and construction skills in the one qualification. As a result, skilled Landscape Designers are limited in the services they can provide.

We anticipate this qualification will become the minimum requirement for the development of a new registration category for Landscape Designers within the Victorian Building Authority (VBA) registration framework. It is designed to scaffold as an additional level of accreditation to existing Certificate IV and Diploma Landscape Design courses.

Course content development, including the production of video interviews with industry experts, is underway to support the Pilot.

What are your obligations to protect employee data??

Data protection is crucial to any business, and the construction industry is no exception. Unfortunately, while employers are typically well-versed in their obligations to employee health and safety, many are unaware of their obligations to protect employees’ data. As a result, employee data breaches cause distress and financial loss for employees and significant costs to the employer in legal liabilities. Robust data protection policies and procedures are therefore essential to protect all parties.

One of the most significant risks associated with protecting employees’ data is cyber security threats. Cybercriminals can target employers to steal employee data. They will exploit this information for personal gain by impersonating the employee, gaining access to their bank accounts, or selling the data to someone who will.

In Australia, employers must comply with the Privacy Act 1988 and Fairwork Act 2009, which set out specific requirements for handling personal information. The recent spate of cyber-attacks and data breaches has the federal government focused on a review of privacy laws.

The primary emphasis of this reform is expected to be on consumer personal data rights. However, it’s also anticipated that there will be a significant shift in how employers can collect, use, and disclose employee information. In addition, a recent Forbes article estimates that 43% of all cyber-attacks are aimed at small to medium businesses and that cybercriminals see these businesses as easy targets because of their lack of security expertise.

Establishing strict data protection policies and procedures is the first step in protecting employees' data. You can start by implementing secure storage and transmission methods, firewalls, and antivirus software.

Training employees on data protection is critical. Regular training sessions on malicious email identification and proper handling of sensitive data are essential to creating a data protection culture.

Limiting data collection from employees is also essential in protecting their privacy. Only relevant, necessary and reasonable information should be collected and stored. Additionally, employers must destroy or de-identify personal data collected on unsuccessful job applicants.

Another risk associated with protecting employees' data is unauthorised access. Data access should be limited to those with a legitimate reason to access the information. It should include strong passwords, multi-factor authentication, permission-based access and dedicated locked areas for any physical records.

Regular evaluation of third-party access, such as payroll contractors and financial advisors, is another vital task. Employers must understand who can access their data, whether jobs are being outsourced to others, where geographically those jobs are carried out, and whether secure individual login credentials are utilised.

In conclusion, today's businesses of all sizes are vulnerable to cyberattacks and data breaches. Therefore, employers must proactively safeguard their employees' personal information. Neglecting to do so may result in severe financial loss, regulatory penalties, reputation damage, and legal liabilities. By prioritising employee data protection, employers can safeguard their employees' personal information and protect their legal standing.
