% % . and I felt the need to somehow link it to Your Legal Lesson. From a legal viewpoint, the incidents described above are re % . ( 6 ÂŁ / 3 % % % exercising their ‘rights of ownership.’ What? Yes, that’s correct, they are exercising their rights of ownership. These rights include and are otherwise known as USUS, FRUCTUS and ABUSUS. And, no, these are not the names of any Greek Gods, they are the terms for the required criteria any person must establish in order for that person to demonstrate their ‘ownership’ of a ‘thing.’ USUS is the right to ‘use’ the thing, FRUCTUS is the right to acE { # {( D # /

/ ! ABUSUS is the right to ‘sell,’ ‘give,’ ‘dispose,’ or ‘destroy’ the thing and if a person does have all three of these rights in, or to, the thing then that person does not legally ‘own’ the thing. In accordance with Quebec law, the rights of ownership are le! . M]• M]M G ( (CCQ) wherein the legislator, using typical legalese language, establishes the same three legal principles to which I have referred ( " / 3 %. % % ( (

3 %. # ( " When I teach this topic to my students, I ask them to imagine that they own an apple tree or an apple orchard. During the spring / ( ‹ ‹

% / % . ! / tours of the apple blossoms (not unlike how Washington, DC uses their famous May cherry blossom season) and in the summer the trees can be ‘used’ for the cooling shade they provide while one reads their favourite book under them. In the autumn, well, this is the season of FRUCTUS, when one can eat the apples, sell the apples and the seeds they provide, make apple sauce, pies, cider, juice (i.e. reap the ‘fruits’ of ‘owning’ the orchard). And in the cold months of winter, the owner can ABUSUS the trees (if so required)

Gordon Hulley 1921-2018

It is with great sadness that the family of Gordon Hulley announce his passing on August 8, 2018 in his 97th year. Gordon will be lovingly remembered by his wife of 70 years, Helen, daughters Linda (the late Ken), Debra and Brenda (Mark), grandsons David (Hanie), Colin (Claire) and his great grandchildren. Special thanks go to Dr Bouhairie and the extraordinary care given by the nurses at Ste. Anne’s Veterans Hospital. A private service will be held by the family.
