Unlike some parts of the UK, evidence suggests that the trend in this exclusive area is only going one way – up. At Lawlors Property Services we have seen substantial price increase sometimes by as much as 10% year-on-year and even reaching 15 – 20% in some cases. In fact, according to our records at Lawlors properties that we had sold five years ago in this area have sometimes increased by as much as 100% Generally Essex has long been considered less desirable than some other comparable suburbs due partly to unflattering TV programmes and bad taste jokes, which in their own innocuous way have a damaging effect on the perception of where we live. However, since the announcement that the Olympics are to be held in East London, it’s worth noting that there has been far less negative comment about the County. In fact, it is impossible to ignore the ripple effect of billions of pounds being spent on infrastructure and regeneration on our doorstep. The effect of this windfall will bring even more demand to our already sought after area and for its properties. With easy comutability Stratford is set to become an inter-continental hub of all this activity the benefit to the areas along the Central Line should be immense. With the natural boundary of Epping Forest protecting us from overdevelopment and with the Central Line weaving through the area providing an easy commute

One can already see the huge amount of development that has taken place from Wanstead to Epping with block after block of quality apartments and new build homes being snapped up by eager buyers. Of course, prices are rising throughout the South East but I believe that our area has a greater chance of maintaining its value and in fact, increasing over coming years because its growth was subdued for many years by poor access to and from London. The top end of the market is also flourishing with Millionaires flocking to our popular streets and tranquil country lanes.

When it comes to mortgages, many homeowners want flexibility as well as a competitive rate of interest. Offset mortgages are growing in popularity for this reason. As rates fall, they are becoming more attractive to homeowners hoping to save money and reduce their mortgage term, while still retaining access to their savings.

How they work

Added benefits

Offset mortgages enable you to set your savings and current account against your mortgage debt, reducing the interest you pay. For example, if you have a £400,000 mortgage and £100,000 in savings, you only pay interest on £300,000 – the difference between the two. The more savings you have to offset, the lower the effective rate of interest on your mortgage.

Offsets have added benefits for the self-employed and higher-rate taxpayers. If you are selfemployed, you can use the cash you put aside to pay your tax bill at the end of the year to reduce your mortgage interest in the meantime. These savings can be withdrawn without interest when required; there is no notice period. Higher-rate taxpayers can benefit because with an offset you avoid paying tax on the interest your savings would otherwise have earned.

For example, if you take out a £400,000 mortgage on an offset basis at 0.40 percentage points under bank base rate (5.25 %) for two years, you get a pay rate of 4.85 % (the overall cost for comparison is 6.5% APR) (if you have no savings to offset). If you offset this against savings of £50,000, the net effective pay-rate rate would fall to a 4.24% (the overall cost for comparison is 6.6% APR). If you have significant savings, you could pay less than the headline mortgage rate. But a homeowner with little in the way of savings wouldn’t see their mortgage rate significantly improve. This can be a problem as some offsets still have higher rates of interest than standard residential deals. So if you don’t offset much money you may be worse off than you would have been with a standard residential deal.

Boundary Issues?

A new client storms into the reception of your office and demands to see a solicitor immediately. Your receptionist warns you that the man (it usually is a man) is so agitated it looks as if he is about to have a heart attack. You immediately drop the urgent divorce file you are working on as you know this must be more important. As you enter the reception you can identify the new client instantly. He is the one whose eyes are bulging and who has started frothing at the mouth (perhaps I exaggerate slightly here). Then he says those few words that, with experience, you learn to fear and dread: “My neighbour has moved his fence onto my land, and I want you to sue him”. Everything falls into place. You suddenly realise why you, a relatively newly qualified solicitor, have been summoned by the receptionist rather than the Senior Partner. The SP, as he is fondly referred to, (although he prefers to be known as “God”) is much wiser and more experienced. He recognised the signs. Indeed if you asked him the Senior Partner will tell you he has seen the film, got the video and worn the t-shirt. That is why he had already taken shelter under his desk. He knew what was coming.

This applies even if you successfully persuade the District Judge that you are right and your neighbour has wrongly trespassed on your land and must move his fence back. In such cases rarely do you recover all your legal costs from the other side, you have suffered the stress of a full court hearing and ended up with neighbours who have become sworn enemies. As a solicitor it is almost impossible to finish such a case with a satisfied client. If you lose then your client believes it’s the lawyers fault entirely, even though it was the client who was found by the court to have acted unreasonably. And if you win then it was only what the client believed he was entitled to anyway, and he cannot understand why it cost him so much to prove his point. If you are ever unfortunate enough to be involved in a boundary dispute here are a few things worth considering: • Is the land you are arguing over worth the emotional strain and the potential cost of taking the matter any further? You may think, “It’s a matter of principle” but remember principles can be very expensive.

Yes all solicitors hate boundary disputes with a passion, and if they tell you anything different they are lying. A leading textbook in this area of the law by David Powell concludes with just three words of advice about boundary disputes, and they are quite simple but to the point: “Don’t have them”.

• Even though your neighbour may seem an arrogant fool with all the attractive qualities of Hannibal Lector do see if you can resist the temptation to inflict actual bodily harm upon him and try and settle the matter amicably. You may feel like a hypocrite but it could save you thousands of pounds.

Most disputes are over a few inches of land. Unfortunately the smaller the size of the land in dispute the more vitriolic people can be. Often this is because a person who worries over a few inches is likely to be a person who gets obsessive. There are few winners in boundary disputes, only losers.

• Before consulting your solicitor take advice from a chartered surveyor. I have heard of cases where clients have racked up many thousands of pounds of legal costs before instructing a surveyor, only to be told that the fence was in the right place all along.

• Do not rely upon the Land Registry title plans to determine exactly where your boundary line is, because the plans are not sufficiently accurate nor are they designed for this purpose. Even the width of a line on an OS map at a scale of 1/1250 represents about 0.3 metre so do not expect it to show your boundary with any degree of precision. Indeed clients are often shocked when Judges start their cases by casually dismissing the evidential value of such plans • Do not believe the fence on your left hand boundary always belongs to you. This is an old wives’ tale and has no basis in law. • If you cut the branches off a neighbours tree which overhangs your land be careful. Whilst you are normally entitled to do so, provided you offer the wood back, make sure you check the tree is not in a conservation area or protected by a tree preservation order. • Be aware there that is no general duty to repair boundaries, so if your neighbour refuses to replace his fence that was blown down in a gale you have very few legal remedies. It may be easier simply to erect your own fence instead. Many years ago, when I was a trainee solicitor, my old mentor used to tell me that there was only one sensible solution to a boundary dispute, and that was to move. Not usually the suggestion that the client wants to hear but nevertheless probably the sagest advice on the subject. And remember, if you need someone to do the conveyancing...
