Lower property and share prices could reduce your Inheritance Tax

Many people planning to leave an inheritance are concerned about the recent dramatic falls in the value of their shares and houses, but at Attwaters Solicitors we believe the recession could actually save them money in the long term through paying less Inheritance Tax. HM Revenue and Customs has issued statistics showing that a large number of people who die each year leave shares or property other than the house they live in. In the 05/06 tax year, 47% of estates where Inheritance Tax had to be paid contained such assets, which were valued at nearly £9bn. After deduction of mortgages and debts, this amounted to an Inheritance Tax bill of approximately £2.8bn being paid by these estates. Here at Attwaters Solicitors we believe people could reduce the amount of Inheritance Tax payable when they die by taking advantage of falling asset prices now before values start to increase again in the years to come. Inheritance Tax is currently payable on estates worth more than £325,000, but the amount of Inheritance Tax payable can be mitigated by making lifetime gifts of assets. Generally, any gifts over £3,000 are liable for Inheritance Tax if the person making the gift dies within seven years. The current low values of second homes, buy-to-let properties and shares provide a good opportunity to save Inheritance Tax on death. Lifetime gifts are valued at the date of the transfer, so if you can afford to give away assets now currently worth say £200,000 and die within seven years when the value has increased to say £300,000, it will be the £200,000 figure that is subject to Inheritance Tax - a potential £40,000 saving to your estate.

If you die after seven years, the tax saving is a massive £120,000! As long as you're not giving away a house you need to live in, or assets that provide an income to live on, this is the ideal moment to consider lifetime gifts. The only downside is that on making a gift of an investment property or shares it might give rise to a Capital Gains Tax liability. Even so that expense will almost certainly be far outweighed by the potential Inheritance Tax saving.

Pre-Nuptial and Cohabitation Agreements

Be Prepared As more and more couples choose to live together before marriage, they are leaving themselves open to financial complications if the relationship breaks down. By this time there may be a merging of financial assets and liabilities and the myth of “common law marriage” will not protect the couple’s interests.

It is becoming commonplace for couples to enter into Cohabitation Agreements to set out their financial intentions. Whilst Cohabitation Agreements are currently not legally binding in English law, the Law Courts will give them some weight and validity if the following principals have been adhered to when the document is drawn up: • • • •

Both Parties have received independent legal advice on the terms of the agreement and provided full financial disclosure The Agreement is in writing and is clear and open in its intention The Agreement is in the form of a Deed The Agreement has been entered into once the couple begin living together

Correctly drawn up Agreements which do not restrict any right to apply to a court for a financial order if necessary can, therefore, allow couples to determine important financial issues which can effect the time they live together and also on the breakdown of their relationship. Recent cases of Sutton v Mishcon De Reya and Gawor & Co (2003) EWHC 3166 demonstrate courts recognising the validity of Cohabitation Agreements. Agreements can cover a wide range of issues such as ownership of property, child maintenance and children’s surnames (Any Agreement made in connection to children will be limited by the Children Act 1989). Agreements can also cover practical issues such as how to divide household bills and determine ownership of joint accounts.

Unmarried couples do not have the same rights under the Matrimonial Causes Act 1973 and couples can only seek legal recourse with regards to property and children matters on the breakdown of a relationship under general property law or under the Children’s Act 1989. The relaxed attitudes of the courts is also demonstrated by the recent decision in Radmacher v Granatinio 2009 EWCA Civ 649 whereby the terms of a pre-nuptial agreement were up-held and it was stated that the “rights of autonomous adults to govern their future financial relations” by such agreements should be given great weight. So, whilst it may not seem the most romantic topic of discussions when you are moving in with your partner you do not want it to be one of the more important discussions you should have had!
