COSTLY, UNPLEASANT AND AVOIDABLE A surprising number of cases arising out of contested wills come before the courts each year and the large majority of these are avoidable. Such cases can arise for a variety of reasons, one of which is that a will is known to have been made, but cannot be found. One such ‘lost will’ case was heard in which the original of the will was said to be lost and a photocopy of the alleged will was put before the court for verification. Behind the case was a not uncommon story. A father died and the copy of his will favoured one of his sons, with whom he had lived for several years. The main asset of the estate was the family home and this was left to the son, with the residue of the estate divided between the other children. If the will was ruled to be invalid, they stood to inherit far more, under the intestacy rules, and they contested the validity of the will. They argued that the will was forged and that if it was not, then the deceased must have revoked and intentionally destroyed the original. They argued that their father hoarded documents and that he would have kept the original of the will if it still represented his wishes. The evidence of a handwriting expert, concerning the authenticity of the will, was inconclusive. However, the court heard a great deal of independent evidence that confirmed that the deceased had indeed intended to give the family home to his son on his death. Furthermore, witnesses were produced who recognised the photocopy as being that of the original will which they had been asked to witness.

The judge ruled that the photocopied will be accepted as valid. The necessity of taking this case to court resulted in unnecessary costs and no doubt a considerable amount of ill-feeling in the family. The legal proceedings also delayed the administration of the estate for a very considerable period. This circumstance could easily have been avoided had the original of the will been prepared with the benefit of professional advice and retained in a safe place which was known to the family. Making a will at Attwater & Liell and storing it with us is not expensive and can avoid a great deal of unnecessary cost, delay and, possibly, acrimony between surviving members of the family. It also gives you the re-assurance that, at what will be a difficult and distressing time for your family, there will be someone immediately on hand to help them navigate the probate procedures and to ensure that your intentions as to the disposal of your estate are realised as you would wish.

The Perfect Suburb Regular readers of our Inhouse magazine will know that for many years I have been championing the benefits of living in our leafy suburbs, and now it seems the London property media are starting to see our part of Essex in a much better light. Gone are the old ‘birds of a feather’ clichés. The hot topic of the day, according to the Evening Standard, is the rise of the Super Suburb. Driven by research that has highlighted the number of £1m plus properties in areas surrounding London. It is apparent that all the areas covered by our Lawlors offices feature way up the list. The North East London cluster of high value properties are included in the areas of Chigwell, High Beech, Loughton and Woodford Green, and are all recognised as top locations. As you will see many of the properties featured throughout the pages of this magazine comfortably fit into this criteria. The forthcoming development of Chigwell Grange by Byrne Estates will certainly push our local profile even higher, with over 30 luxury homes to be built in the near future. In nearby Theydon Road, Epping Lawlors have successfully launched four fantastic converted apartments onto the market with prices ranging from £950,000 to £1.5m. Demand is high with staff inundated with enquiries from serious buyers looking to down-size to these apartments.

The desire to retain a fantastic standard of accommodation but shed the top floor is a top priority in the area for many people, but the desire to stay in the area is what supports these values. A development of luxury homes expected to achieve in excess of £2m will shortly be available in the Loughton area. I have seen probably my first £10m property recently and at least two other properties that can touch the £4m mark. If these properties are anything to go by then we can certainly anticipate high demand throughout the area and a competitive position at the top of most ‘desirable suburb list’.

. . . n i a p S o t o s d an enter the Notary You have finished your property transactions in England and decide, for whatever reason, that it is time to embark on the adventure of buying a property abroad. All is going swimmingly well – you have found your property, you have arranged finance in the foreign country and you have instructed a local lawyer. Out of the blue arrives a bundle of papers with the instruction that they are to be notarised and returned to the foreign lawyer as a matter of urgency. The papers are partly in a foreign language, which you cannot understand, although it appears that some of them have been translated by the lawyer, but what do you do next? The answer is simple, if perhaps not too helpful. Find a Notary Public. So what is a Notary Public He is one of only 800 persons in England who can notarise documents for use abroad. Many solicitors think they have this qualification also, but they are wrong. The majority of notaries are solicitors, but their notarial practice is carried on completely separately and independently from their practice as a solicitor, although usually within the same office of their firm. Most towns or business centres have a notary in the locality. A notary’s authority stems from his permission to practice, which is still granted by the Archbishop of Canterbury and is one of the last vestiges of the old ecclesiastical law. Having found your notary he will ask you to attend before him, together with any other persons who have to sign, with evidence of identity, [usually your passport], the documents that you have received from abroad and his fees. Charges are on an hourly basis and will vary between £250 and £300. Since it will take at least 15 minutes to deal with your notarial requirements you will find that there will often be a minimum charge in the region of £70.00. After your visit to the notary you will leave with your documents, boasting an impressive display of seals and stamps, but you may not yet be finished. Your instructions from the foreign lawyer might also have asked you to have the documents “legalised”. This next step [which can be organised for you by the notary for an additional charge] involves taking or sending the documents to the Foreign & Commonwealth Office in London where an “apostille” will be affixed. Rarely

some countries may still not be satisfied and you may need to attend the Embassy or Consulate of the foreign country in London to have further authentication attached. One way or another you have now met all the requirements of your foreign lawyer and are able to return the documents to him, so what has this done? The whole purpose of the exercise is to authenticate the documents so that they can be relied upon in the foreign country. Of course all of this could have been avoided had you signed the documents abroad and the procedure is only necessary when you are signing documents in this country for use out of the English jurisdiction. Most countries have different requirements from others, American documents being a particular example, and in America requirements even vary from state to state, but the notary will know this and be able to advise if things are unclear from the instructions you have received from abroad. Another example of when notarial services will be required, is if you are involved in a company that is establishing itself in business abroad. The company may be opening a bank account, appointing a local agent, assigning the benefit of a patent or trade mark, etc and all the documentation necessary, if being signed on behalf of the company in England, will invariably need to be notarised. You can usually find a notary within a reasonable distance, although as you approach London they tend to be light on the ground since until recently members of the Scriveners’ Company based in the City of London had the sole right to notarise documents there and within 3 miles. Scriveners still exist and are almost exclusively still based within the City and practise purely as such, not also as solicitors. They are the smallest profession in the country and in addition to providing the notarial service will also be able to interpret and translate documents since their members within each firm will be familiar with most of the common languages of the world.

Despite all the recent media speculation I believe we have now reached a period of stability within the marketplace. Albeit prices are not rising at the moment, but neither are they collapsing. The recent interest rate reduction combined with the Spring market has seen a burst of activity, particularly in our Woodford Green office. It is vital to price correctly to encourage sufficient interest to attract an offer. If the price is too high the buyer will simply do a quick search on comparable properties via the net and move on.

THE BIDDING ZONE The key is to price within the ‘bidding zone’. This is the price range between your asking price and the price the buyer thinks the property is worth. Obviously the smaller this gap is the greater your chance of selling quickly. It is vital to price accurately to encourage viewing even though your asking price may still be above your buyer’s expectation, it needs to be close enough to tantalise. I believe it is common knowledge that most people stretch for a property if it is what they want and often, what we desire, is beyond our reach. As a general rule we recommend an asking price no higher than 5% over your realistic expectation. This is, of course, not a precise science, but with some proper research and good marketing with Lawlors Property Services we will help you set your price and achieve a sale. Another consideration for vendors to take into account is not just the price you are selling at, but also the price you may be purchasing at. At the end of the day it is all about differentials and thus although you maybe taking a price less than you were expecting, if you were buying your future property at a lower price then you should be no worse off. Buyers are more informed than ever and with so much information regarding house prices available on the net, the sensible vendor looks to attract a buyer, rather than hope for a buyer.
