However, Easter has certainly been the turning point for this year. Tax Investments
It will be interesting to see how popular a form of investment REIT’s will be, but given the UK populations fascination with property and its’ history of steady growth they are likely to be very successful. They are bound to be seen by many as an easy way to get onto the residential property bandwagon without the very large commitment needed to acquire a ‘buy to let’ property.
TAX EFFICIENT INVESTMENTS
REAL ESTATE INVESTMENT TRUSTS We touched on REIT’s in a previous issue and the details of how these new entities will operate in the future was in the 2006 Finance Bill published on 7th April 2003.
However for many investors it will still be more beneficial to acquire commercial properties within either a pension fund to ensure total exemption, or personally to attract Capital Gains Tax 75% business taper relief if the investment is to be reasonably short term.
The property sector is likely to welcome these new rules as they include improvements over the original draft rules. Unfortunately UK REIT’s will not be able to operate until 1st January 2007.

The Present Rules A Quoted Property Investment Company will pay corporation tax on its rental income and capital gains at a rate of 30%. Any dividends paid to investors is received net of a tax credit. Investors who are standard rate taxpayers pay no additional tax on their dividends.
Venture Capital Trust VCT’s are collective investments that invest the majority of their funds in smaller companies not quoted on the main UK Stock Exchange. These investments can be more risky than normal but the Government are committed to help the ‘small’ business sector. For the year ended 5th April 2006 an investment up to £200,000 attracted income tax relief at an individual’s highest rate, normally 40%. These investments are also free of Capital Gains Tax on sale.
However higher rate taxpayers end up paying a further 25% (see example I)
New rules for UK REIT’s From 1st January 2007 property income and capital gains will be free of corporation tax. Distributions to investors will cease to have a tax credit but be paid under deduction of Standard rate tax, currently 22%. Investors subject to tax at the higher rate will have to pay an extra 18% (see example II)
For 2006/07 the tax relief has been reduced to 30% but even at this level VCT’s should remain popular. VCT’s, by their very nature, are really a medium to long term investment but, because of the tax relief, will need to drop 30% in value before they show a real loss. Many VCT’s have recently shown reasonable growth. Also for 2006/07 the minimum period ownership of VCT’s to achieve the tax breaks is up from 3 to 5 years.
It can be seen that both standard rate taxpayers and higher rate taxpayers are between 11% and 14% better off with a REIT over present property investment companies. What this effectively does is to place an investment into a REIT more or less on a par with an individual investing in property in their own personal limited company, but without the hassle and without the same level of risk.
Summary
Capital Gains made on the sale of REIT investments are subject to Capital Gains Tax in the normal way.

splitting . . . the costs
Whilst we are usually instructed by clients about property matters at the outset of a relationship, the rise in separation and divorce rates over the last few years means that we are frequently consulted about our clients rights when relationships do end. .I was pleased to read this month that marriages are now lasting longer and that their may be a downturn in the divorce rate, nevertheless it is a sad fact that perilously close to fifty per cent of all relationships do come to a premature end. Consequently we must consider and advise clients about the likely impact of such an event happening. Unlike much of Europe, marriage does not automatically change a persons property rights.
Divorce proceedings simply bring the marriage to an end, they do not disentangle a couples finances. There are two routes to achieving a financial settlement. Some couples are able to agree the terms of a settlement in which case a Consent Order is drawn up. For others this is not possible and a separate application (known as the Ancillary Proceedings )must be made to the court. The court has wide powers in those Ancillary Proceedings to assess the assets of each party, consider their present and future needs and to transfer ownership of those assets - including the matrimonial home and other properties. The reason why the marriage failed is irrelevant to

how the assets are split. In Matrimonial Proceedings courts now recognise that there is an equal contribution to the marriage from both the party that goes to work and earns money and the party that stays at home and cares for the children. Their starting is an equal division of a couples assets and there have to be good reasons why the court should depart from that. Various Acts of Parliament dictate what criteria a court must take into account when dividing assets but the welfare of any children is their paramount consideration. This means that if there are insufficient assets to provide each with a home, the party with care of children will have priority in respect of housing. This being said provision can be made for the other person to obtain a charge against the former matrimonial home to secure a share in the house. That share will be released, for example, when children of the family reach 18 or earlier if the party in residence re-marries.
A court order is essential... It is important to us that clients are aware of the fact that a Decree Absolute does not itself prevent a spouse making a claim on their former spouse’s assets and income. In England Pre-nuptial agreements are still frowned on by the courts but they are now beginning to take more notice of such arrangements even though the court is not bound by them. This is especially relevant if there is a very short marriage and both parties have had legal advice. Many couples now chose to live together rather
than get married. When such a relationship breaks down the couple do not enjoy the protection given to married couples by the court. The term “common law wife” is often used but in reality there is no such thing. Unfortunately, if a couple are unmarried then in general terms neither party has any claim against the assets of the other party.
A Trust Deed to be drawn up Therefore it is vital that some thought is given at the time of purchase as to how the property should be owned. It is advisable that a Trust Deed be drawn up which will make it clear what share each party should take from the property in the event of them separating. If both are contributing equally they may agree that in the event of separation they will split the proceeds equally. However, it is often the case that one party will contribute more than the other. In these circumstances it may be considered fairer that the person that contributed more should receive more. While such discussions may be difficult and seem unromantic they will save a lot of upset if the couple eventually separate. Whilst little protection is offered to unmarried couples the powers of the court have been substantially extended by recent enactment of The Civil Partnership Act. This gives same sex couples who have entered into a Civil Partnership the same rights as married couples.
