Generally speaking, we believe that the prices that are being sought by our current vendors represent fair value, although there is still the opportunity to negotiate. We have found that there is a general optimism about the economy, encouraged by City Bonus payouts which inevitably flow into the property market. Vendors are sometimes keener to secure their purchase rather than wait for the last penny on their own property. As at the moment demand still outstrips supply, you will see from the following pages that we have the 'lion share' of the best properties on the market at the present time. So it really is a good time to make a move and fix that mortgage.

Excellent news was received in the last week from the developers responsible for Theydon Towers at Epping. Having acquired the property through Lawlors at the end of last year the developers have worked feverishly to supply plans to the local planning authority to convert this impressive Victorian residence into duplex and single level apartments. Planning permission was granted in August and work has started in readiness for early release. We are now taking details from prospective purchasers for priority when the properties are released. Autumn tends to be a fairly busy few months for the housing market. With summer holidays out of the way and the Christmas festivities still some way off, it can be the perfect opportunity to consider upping sticks and moving to a new property. The challenge over the next couple of months won’t just be finding the property of your dreams but getting the right financing. With interest rates rising in August and the possibility of a further Base Rate rise later this year, borrowers may need to consider carefully whether they opt for a variable or a fixed rate. Below, I run through the factors you may wish to consider to help you get the most suitable mortgage.

wrong – i.e. if rates move up rather than down they can still afford their mortgage – may find a tracker mortgage to be more suitable. This tracks the base rate so any cut made by the Bank of England is passed onto borrowers in full soon afterwards. So if rates move downwards over the next few months, these borrowers will benefit from lower monthly repayments. Finding the most competitive deal is a time-consuming task therefore you should consider using an independent mortgage broker. Some of your financial questions answered… DAVID KIRKWOOD OF LOCAL ACCOUNTANTS, TAX AND BUSINESS ADVISERS VANTIS, COMMENTS ON SOME OF OUR READERS FINANCIAL QUERIES. Here at Vantis, we’ve been pleased at the response received following publication of our articles over the last few months. Financial issues come in a wide variety of shapes and sizes. However, for most people the single largest investment they will make in their life is their home. So for this issue we’ve mainly focused on readers questions relating to this.

Capital gains tax on second properties? QUESTION ONE

ANSWER:

“My husband and I bought a property in Scotland in November 2001 and for just over 3 years it was used as a holiday self catering unit until February 2005. I moved into the property in March 2005 and my husband followed in November 2005. It is now our main residence. If we sell the property will we be liable for Capital Gains Tax on the profit? Our original main residence was in Essex which we have owned for 18 years. We lived there for 17 years and have let it out since November 2005. If we sell the property in Scotland we would return to Essex. If this became our main residence again would we be liable for Capital Gains Tax when we sell it?”

• On the basis that your house in Essex was your and your husband’s principal place of residence up to February 2005, that property should be exempt from Capital Gains Tax for that period.

• From February 2005 to November 2005 you and your husband had two residences available to you. You can elect before February 2007 for whichever of those two residences you wish to be regarded as your main (tax exempt) residence for that period. As husband and wife, you must elect jointly. Clearly the property which is likely to provide the most favourable financial position will determine your choice of election.

QUESTION ONE ANSWER CONTINUED...

• From November 2005 the Scottish property should be exempt as your main residence.

Inheritance tax on gifts to children? QUESTION:

• When you sell the Scottish property the proportion of the gain, from November 2001 to February 2005 (or possibly November 2005), will be potentially liable to Capital Gains Tax. However, if the sale were to take place before February 2008 (November 2008), depending on residences election, exemption could also apply for part of the holiday lettings period, because the last 36 months of ownership is exempt irrespective of whether the property was occupied as your residence.

“I am 77 & my son is nearly 50. He has been offered a property for £100,000. I am ready to lend him this sum, but not gift it to him as I have two other children who will share in my Estate and all subsequent income derived from my invested funds. Am I obliged to charge my son interest on this loan at market rates or otherwise could he be accused of having a pecuniary interest and hit by inheritance tax problems.”

• If the disposal is at a later date, the last 36 months of ownership will continue to attract its exemption, but the resultant period of letting, which will show a potential gain may also be sheltered from a tax charge.

ANSWER:

• Where a property which qualifies for exemption as one's main residence is let, the proportion of the gain attributable to the period(s) of letting is exempt to the extent that gain does not exceed the amount of the "main residence exemption" or £40,000 per owner (ie £80,000 for husband and wife) whichever is the lower. • If after selling the Scottish property you returned to the Essex property as your main residence, the exemption for that property should resume. Your absence from the Essex property is intended to be a period of letting as well. Therefore the gain attributable to that period could also be exempt, subject to the same points set out above for the letting exemption.

• You are able to make a loan to your son on interest free terms that should not have any tax consequences for you or your son. • The absence of interest on the loan should not give you or your son any inheritance tax problems unless you were to occupy the property and not pay a full rent for the use of it. • It is recommended that the loan is made, say, repayable on demand or on after a notice period of, perhaps, six-months, in order to protect your other children's position if the loan is still outstanding at your death.

• The proportion of the gain relating to a period of ownership is usually calculated on a straight-line basis of period over total ownership.

Do you have a financial query for our experts? QUESTION TWO “I am moving back to my property that was rented out for 4 years as my husband and I are separating. I need to sell as I am re-locating abroad. Will I be eligible to pay Capital Gains Tax if I sell within 3 months?”

ANSWER: • You suggest the property was occupied as your main residence for a period prior to its being let. If this is the case your period of re-occupation should be exempt, as should that earlier period of occupation. The last 36 months of ownership should be exempt but there is a period, during which the property was rented out, which is not covered by the exemptions for main residence. It should still be exempt however because of the letting exemption available, as detailed in the answer to question 1 above (although in theory the gain could exceed the maximum amount). • If this were to happen and the liability is significant you may wish to consider deferring the sale of the property until you have left the UK to settle aboard because non-UK residents, who do not become resident again in the UK within five years, are not normally liable to Capital Gains Tax on sales of UK property. • The exemption from Capital Gains Tax for a main residence applies to one property at any one time. A husband and wife living together can only have one such property. Until you separate from your husband, you will have to take account of the property he occupies. If your husband still has an interest in the property he may continue to be entitled to the main residence exemption on his share of the property if, under the financial settlement between you, he disposes of his interest to you, and up to that time he has not elected for another property to be his main residence.

YOU MAY NOT HAVE HEARD OF APHASIA BUT YOU PROBABLY KNOW SOMEONE WHO HAS IT APHASIA is a long-term neurological condition that disables more than 20,000 adults annually in the UK. Aphasia can be caused by head injury or tumour, but it is most often caused by stroke. Aphasia affects people of all ages from all walks of life, populations and backgrounds. ‘How can I tell you what it’s like?’ says Sue Guy. ‘I couldn’t write, or read, I couldn’t ask the time. I couldn’t remember or say the children’s names. I couldn’t work, I couldn’t read the newspapers. I couldn’t convey that I was sad, tired, angry, ill… I wasn’t deaf or blind but I couldn’t communicate. I thought I was mad. Coming to Connect. For me it was the day when I began to get better.’
