County turns down short-term wireless project

After exiting a nearly two-hourlong closed session, the Culpeper County Board of Supervisors recently opted against pursuing a $3.2 million project that would have delivered wireless internet to 3,800 homes without connections.

The decision was made by a 6-0 vote, as Supervisor Bill Chase attends meetings virtually and does not participate in closed sessions.

The decision comes after the county's public works committee - consisting of supervisors Jack Frazier, Tom Underwood and Paul Bates - unanimously recommended the deal be approved.

The project, proposed by the All Points Broadband company, was meant to be a three to five year solution as the county pursues delivering more reliable fiber connections to the 4,000-plus county homes Licensed & Insured without internet.

While the fiber-to-home project may hopefully start in 18 months, it remains unknown when connections will be delivered to every un-

served location.

The wireless project would have been funded with about $2 million worth of Coronavirus Aid, Relief and Economic Security money while the rest would have come out of county coffers. Supervisor Jack Frazier explained that the current plan is using that CARES to pursue a more permanent solution.

Noting that the wireless connections would have been available for a maximum of five years, Frazier said he found difficulties in spending so much money for a temporary solution.

"The money would be better spent, even though we have to wait a little longer, if we subsidized a permanent fix," he said.

Exact costs of the fiber-to-home project remain unknown, as the county is undergoing negotiations with multiple companies. The county will eventually apply for grants and work to gain project approval from the State Corporation Commission.

"There's a lot of work that's actually in play right now. There's just so many moving parts to this. You almost get a different update every week," Frazier said.

Regal Cinemas sues the Town of Culpeper over lease termination

Regal Cinemas, Inc. has filed a lawsuit claiming that the Town of Culpeper illegitimately attempted to prematurely terminate the theater’s lease for the building at 210 S. Main St. The town disagrees with this notion and has filed a motion for the lawsuit’s dismissal.

On Feb. 9, the Culpeper Town Council voted to terminate the lease because Regal had not operated a movie theater business for at least 120 days. The town also directed staff to pursue the collection of past due rent totaling $56,428.

The lease was officially terminated on Feb. 13. The lease was terminated because the theater had not operated for 120 days, not because of the delinquent payments.

Filed in the federal U.S. District Court in Charlottesville, Regal’s lawsuit says the town’s attempt “to seize this valuable property” was conducted “in an underhanded and rushed effort.”

Town Manager Chris Hively told the Culpeper Times that the town "believes there is no merit in Regal's lawsuit."

The theater, which opened in 2000, closed at the onset of the coronavi-

rus pandemic due to state-imposed restrictions. Those restrictions were later lifted and the theater reopened on Aug. 28. Due to low attendance, a lack of new movies and safety concerns, the theater closed again on Oct. 9. It has remained closed since.

An issue at the crux of the lawsuit is whether the town provided proper notice in terminating the lease.

The lease states that “In the event that Tenant vacates, abandons or deserts the Property, or ceases operating its movie theatre business at the Property for a period of one hundred twenty days... or more....except for the making of necessary renovations or repairs following a fire or other casualty, Landlord may, at its sole option, declare the Tenant in default and terminate this Lease by giving written notice of such termination and of the effective date thereof to Tenant…[and] this Lease shall cease and come to an end as of the date set forth.”

The lawsuit notes that “Regal’s theatre remains temporarily closed to the public as of the date of this filing, but Regal intends to re-open the theatre shortly” and claims “at no point has Regal ever abandoned or vacated the Property, nor has

Regal fully or permanently ceased operations on the Property.” It adds that the theater “has only temporarily closed its doors to the public in an effort to protect public safety in the midst of a global pandemic.”

The lawsuit claims the town failed to comply with a contractual provision requiring 30 days’ notice of the termination “and the opportunity to cure before any such termination.” The lawsuit says the town acknowledged that the theater had 30 days to pay its delinquent rent, and the theater did so on Feb. 12. Shortly after that payment was received, Hively said Regal "filed suit in Federal court...to attack the Town’s termination of the lease rather than return possession of the Town owned property."

Regarding the alleged improper notice of termination, the town filed a motion saying a 30 day notice was not necessary since the theater’s operations ceased for 120 days. The town’s reply adds that “plain reading of the Lease and basic rules of contractual construction permitted the Town to terminate the lease upon written notice at an effective

date selected by the Town." The filing adds that Regal does not need 30 days’ notice to “cure” its failure to operate a theater.

"As required by the lease, the Town provided Regal Cinemas thirty days to pay the back rent, but was not required to give Regal Cinemas an additional thirty days to reopen," Hively said.

During the closure, the lawsuit says “Regal has performed necessary maintenance and repairs to protect the building from water intrusion, service the HVAC system, and otherwise engaged in activity to prevent the deterioration of the premise.” Hively noted that "the lease requires Regal Cinemas to maintain operations of the Culpeper movie theater and not close for 120 days or more, except if repairing damage from fire or similar cause."

Amongst Regal’s request in the lawsuit is a judicial ruling that the theater’s “temporary suspension of its full operations to protect public safety during the COVID-19 pandemic does not constitute a cessation” as defined in the lease. The town’s response states that “Regal attempts to sidestep” a “clear breach of contract by asking the Court to add additional terms not found in the Lease.”

Regal also asks for a ruling that any period during which the theater was “conducting necessary modifications or repairs at the theater” to not count towards the 120day period outlined in the lease.

The town replies that Regal’s “contractual maintenance obligation of the Property” does not qualify as “movie theater operations.”

If those requests are denied, Regal asks that its temporary closure be excused.”because the cessation was the direct result of unexpected and/or unforeseeable circumstance.”

Regal also seeks damages of at least $75,000 because the town allegedly breached the lease.

New CTE facility nears completion

It will not be long before the Culpeper Technical Education Center is bustling with students gaining hands-on learning experiences and credentials that will be handy in the workforce. Construction is moving along and the 50,000-square-foot facility is near substantial completion.

Carpets are installed, the floors are shining and equipment such as commercial cooking appliances is resting beneath plastic wrap.

The state-of-the-art $17 million facility - CTEC for short - features a sleek design with modern amenities. The entrance gives way to a 428-foot long hallway illuminated by skylights. tour of the facility.

Stepping into the culinary arts classroom, Lutz said "imagine what it's going to be like when we have eager students and that knowledgeable staff.”

“And they're going to leave here with an industry credential. So they're going to graduate with a diploma, a credential and then they can go straight into the workforce or they can continue on with their education," she said. "But how amazing is that, that they can graduate with all that."

There is also an awning outside where students can work in an environment mirroring job sites and Krawchuck noted “the real-world experience is something to treasure.”

Lutz agreed, saying “this will be hands-on instruction with authentic workplace experience.”

The courses were determined based upon student input and regional market needs. For example, Lutz explained students have longed expressed desires for cosmetology classes while health science is America’s “largest growing career cluster.”

The schools are also partnering with Germanna Community College, which will relocate its automotive equipment from their Stafford location to the school.

While daytime classes are only available to students at Culpeper County and Eastern View high

schools, Germanna Community College will offer evening courses at the facility for adults.

Planners recommend denial of Maroon Solar’s revised application

Although Maroon Solar revised its conditional use permit application that seeks permission to construct a 970-acre solar farm with over 400,000 panels off Raccoon Ford Road, the Culpeper County Planning Commission remains unsatisfied with the company’s proposal.

During a March 10 meeting that lasted over three hours, the commission recommended that the application be denied. The vote came after over 15 individuals spoke during a public hearing. Well over half of the speakers opposed the project.

The recommendation will go before the Culpeper County Board of Supervisors, which will make the ultimate decision regarding the permit. In November, the commission also recommended denial of Maroon Solar's original application.

That initial request never went before the supervisors as the company pulled its application shortly after the planners recommended denial.

In January, the company submitted a revised application.

PROJECT SIZE

Maroon Solar’s proposal more than quintuples the county’s solar farm guidelines stipulating that

solar farms should not exceed 300 acres. The county is currently in the process of reviewing its land-use policies regarding solar projects. The revised application does not modify the project's size, which has been a major concern of planning staff.

The company addresses concerns over the project's size in its application, saying: "While the staff report criticizes the application for exceeding 300 acres as being principally a “financial” decision, as if that were a negative consideration, the County must also consider that it is simply not cost-effective to construct such facilities on 300 acres, and at the same time penalize private landowners and the County itself, both of which could benefit greatly from participation in valuable clean energy projects." David Stoner, a development consultant for Maroon’s North Carolina-based parent company Strata Solar, noted during the meeting that the county's 300-acre policy is a guideline, not a requirement.

APPLICATION REVISIONS

Changes in the revised application include construction spanning three phases compared to the former timeline in which the project would have been completed in one phase over a single construction

season. Each phase may take up to one year compared to the previously envisioned 18-month timeline.

Since construction would occur in about 300-acre increments, Stoner said the company believes this revision closely aligns with the intent of the county's land-use policy. He added that one large, non-visible project would be better for the county than several solar farms scattered about in perhaps more visible locations.

Commissioner Cindy Thornhill said she is not comfortable with construction lasting three years, as that is three years worth of noise.

"This is not any better than it was....there's just a lot of what-ifs," she said, noting that many questions would remain unanswered until a site plan is submitted.

County Planning Director Sam McLearen said planning staff is indeed concerned with noise during construction. He also noted the project would not present a great visual impact to neighbors as it is isolated and surrounded by timber.

The revised application also relocated the substation from about 1,800 feet off Raccoon Ford Road to an internal location within the project’s site.

Company representatives said this should eliminate a majority of

construction traffic on Racoon Ford Road as just about a half-mile of the road will be used.

SIZE REMAINS A CONCERN

When it came time to vote, Commissioner Raymond Zegley noted Maroon Solar has submitted many changes. Some of those amendments came at the last minute and he expressed a desire for a final application. He added that the commission is bound by the policies on the county's books and the project is too big.

Planning Commission Chairman Sanford Reaves Jr. agreed, saying "the size of it just doesn't comply with the policy." Noting that the planning commission is an advisory board, Reaves said the size is the only reason for his opposition.

He noted that renewable energy is the way of the future and he does support solar power.

Reaves added that he is a big proponent of land rights. Noting that the county is working on a new land ordinance, he said hopefully it will soon be easier for landowners to do as they please with their property.

Planning Commissioner Laura Rogers noted the project's location and character does not align with the county's comprehensive plan.

Culpeper County Circuit Court clerk candidates forum canceled

➤ The Chamber of Commerce hopes to hold an altered version

The Culpeper County Circuit Court candidates forum was canceled the morning it was supposed to occur. It was set to feature Marshall Keene and Carson Beard, the two candidates in the March 30 special election for retired clerk Jancie Corbin’s seat.

The forum was supposed to be hosted by the Culpeper Chamber of Commerce with its President/CEO Jeff Say serving as the moderator. Plans called for it to be live streamed online.

Six hours before the forum was scheduled, however, Say sent an emailed notification stating that the event was canceled due to "unforeseen circumstances beyond our control.” Say said that he could not reveal details of the circumstances necessitating the cancellation.

"It will not be rescheduled. We apologize as we looked forward to educating the community and remind the public that there is a special election for Culpeper County Clerk of the Court March 30," Say wrote.

Say added that “the Culpeper Chamber of Commerce has served as a vehicle for voter education through candidate forums for many years. We serve as the moderator. We look forward to continuing to educate our community.”

Beard told the Culpeper Times that he does not know why the forum was canceled but that he "was greatly looking forward to it." He added that he was "very disappointed" that the community could not hear from the two candidates in the forum.

"I'm trying as best as I can, through my Facebook page and my website, to get what I do out there and what the clerk's office does," he said. "But I think it is a loss for the community to not hear both sides from the two candidates running for office. You look at every other office, and they often hear from the candidates in a forum of some type."

Beard added that the clerk's office is "very important to the community" and it is disappointing citizens "couldn't get to hear us answer questions and make an informed decision."

Keene did not reply to a phone message seeking comment.

Beard added that he would happily participate in a rescheduled forum.

Later in the day, the chamber announced

that it developed an alternate plan in which each candidate would separately participate in a pre-recorded format.

“In the original forum, candidates were given pre-written questions that they received ahead of time,” Say said. “The Chamber will pre-record each candidate individually, if willing, with this same format and air it prior to the election.”

Beard said he did indeed receive topics before the canceled forum but did not receive the questions that would have been asked until after the cancellation.

SPECIAL ELECTION APPROACHES

Keene and Beard are seeking to serve the four years remaining on Corbin’s eight-year term.

Beard, who is running as an independent, began working in the circuit court clerk’s office after graduating from James Madison University in 2014 with a justice studies degree. He began as a deputy clerk and was later promoted to chief deputy. He has served as interim clerk since Corbin’s retirement.

Keene, who is running as a Republican, enlisted in the Marine Corps at the age of 17 and six years later began employment at the Richmond City Sheriff ’s Office. He later worked for the Spotsylvania County Sheriff ’s Office and has been employed as a Culpeper County Sheriff ’s Office detective for a decade. He was elected to the Culpeper County School Board in 2017 and chosen as its chair on Jan. 11. He also chairs the local Republican committee and is a business owner.

Early votes can be cast at the registrar’s 151 N. Main St. office weekdays from 8:30 a.m. - 4:30 p.m., except for holidays. The office will also be open Saturday, March 27 from 8:30 a.m. - 4:30 p.m. On March 30, votes will be cast at regular polling locations.

The deadline to request absentee ballots by mail is 5 p.m. March 19. The easiest way to apply is at voteinculpeper.info. Registrar James Clements encouraged people to apply as soon as possible. All mailed-in ballots must be received at the office by 7 p.m.

March 30 and signed by a witness, who can be any adult in the house.

To vote on March 30, the deadline to register or update addresses was March 16.

Clements noted that anyone who is already registered did not have to do so again.

Clements said COVID-19 safety protocols such as social distancing will be implemented at polling locations and face coverings are highly encouraged.

Should you be wearing two masks? ➤ Yes, because new strains of COVID-19 raise questions about protection

Submitted by Novant Health Wearing an additional face covering — or a mask with multiple layers — is recommended as extra protection against new variants of the COVID-19 virus emerging in the United States.

“Either way, more layers means additional safety,” said Nael Hasan, MD, interim medical director, Novant Health UVA Health System Culpeper Medical Center.

But, he said, the single most important thing you can do is to make sure that whatever mask you use — even if it’s just one — you wear it correctly. The mask must cover your nose and mouth at all times. Don’t lower your mask to hang under your chin or dangle it off your ear.

“It's not a bad idea to wear multiple layers,” Hasan said. “Many masks already have multiple layers, but some don't. We’ve seen people recently wearing

a surgical mask with a cloth mask over it. That's certainly not a bad idea.”

Public health experts have said that double masking may make sense for people who are in high-risk situations or have medical conditions that put them at high risk. The new variations of COVID-19 are more contagious, Nael Hasan which has sparked the trend of double masking.

Adding another mask layer “makes common sense that it likely would be more effective,” said Anthony Fauci, MD, the director of the National Institute of Allergy and Infectious Diseases.

The Centers for Disease Control and Prevention (CDC) has these mask recommendations: • Wear two or more layers of washable, breathable fabric.

• Completely cover your nose and mouth.

• Make sure masking fits snugly against the sides of your face and doesn’t have gaps where air particles can easily enter.

• Don’t use masks made of fabric that makes it hard to breathe, for example, vinyl.

• Don’t use masks that have exhalation valves or vents that allow virus particles to escape.

• Don’t use masks that are intended for healthcare workers, including N95 respirators or surgical masks.

That could threaten supplies that healthcare workers need in hospitals.

The CDC also recommends that if you wear a neck gaiter, choose one that has two layers, or fold the one you have to make it two layers.

Hasan said scientific research is ongoing about the effectiveness of which masks work best, but adding additional layers and making sure they’re worn

correctly is a good safety measure.

As more Americans receive the COVID-19 vaccination, it’s still as important as ever to: • Continue wearing masks • Maintain social distancing of at last 6 feet from those outside your household • Avoid crowds and poorly ventilated places • Wash your hands often and thoroughly Even after you receive both doses of the vaccine, it will be necessary to continue to mask and follow safety protocols until public health experts say we can stop.

“Over time, we'll see how the science evolves on the best type of mask and how the technology improves,” Hasan said. “Hopefully, a lot of people will get vaccinated and at some point, we won't have to do this as much.”

irector Elections for REC’s Board of Directors take place at the Annual Meeting during the month of August. REC’s Bylaws govern the election processes and director qualifications are further defi ned in Board Policy.

The nomination period for the 2021 Director Elections opened March 1. or Sanford Reaves Jr., everything revolves around family.

He and his wife of 44 years, Lorraine, have three adult children and six grandchildren who range in age from 5 months to 20.

He gushes with pride as he talks about taking his grandkids to Shenandoah National Park “to show them Mother Nature.” A smile breaks out across his face as he recalls stops near the creeks along Graves’ Mountain Lodge, where the youngest ones like to play.

His voice fills with nostalgia as he talks about his dad, 87-year-old Sanford Sr., with whom Reaves has enjoyed fishing in Culpeper ponds over the years.

A member of REC’s Board of Directors, Reaves also runs Sanford and Sons Construction and Janitorial Services in Culpeper, where he was born, raised and chose to start his own family after college.

“The thing about Culpeper is, no matter where you might come from, you are going to be made to feel like you are part of this community,” Reaves said. “It doesn’t take people long to feel like they can call Culpeper home.”

That’s what he likes about REC, too.

That’s what makes me so proud to be on the Board of Directors,” Reaves said. “What I like about REC’s staff and leadership is that they are always willing to do whatever it takes to bend over backwards for members — especially when their power goes out.”

He has visited REC’s offices in Bowling Green, Culpeper, Fredericksburg and Front Royal, and sees the same thing wherever he goes.

“Every employee at REC is ready to do what it takes to support the members. It’s just an innovative group, an intelligent group running the co-op.

They are dedicated, and they really do care.”

He thinks the reason is simple.

“Just like in Culpeper, REC employees see each other and members as a family, and we all know we take care of our families.”

Culpeper Student Spotlight Avery Ward It’s a question to which every senior needs an answer. When countless people walk up or type a message and asks - “So, what are your plans after high school?”

- we need an answer. For the longest time, my responses were filled with ‘I hope’ and ‘maybe.’ I would respond with “I hope to go to this college” or “I might study this.” After what feels like years of searching for and working towards an answer to this frequently asked question, I finally have a response that I am proud of!

My name is Avery Ward! I am a Class of 2021 senior, and I will be graduating this May. I will be going to James Madison University in the fall. I will be majoring in health sciences on a pre-physician assistant track. I will graduate in three years. I will continue to make the most out of every situation.

Even with all the “I hopes” that I have turned into “I will,” I am steadily making an even longer list of things I hope to do. I hope to be able to study abroad. I hope to make more amazing, life-long friends.

There are so many new dreams and ideas that have come from deciding where I will spend the next few years of my life, and I hope to accomplish them all.

Hopeful GOP gubernatorial nominee stops by Culpeper

Pete Snyder, who seeks the Republican nomination in the November governor’s race, has been traveling to localities throughout Virginia and recently visited Culpeper.

Snyder, 48, founded the social media marketing company New Media Strategies and is a self-described “constitutional conservative” whose only previous foray into politics was an unsuccessful 2013 lieutenant governor bid.

Although Virginia has steadily voted blue for several years, Synder told the Culpeper Times that he can win with the help of independents and those who “lean” Democrat, demographics he believes are upset over school shutdowns and high tax rates.

“They’re furious and they want change and that’s why I’m gonna win,” he said.

Any entrepreneur such as himself, Snyder said, has “to be an opti-

mist at heart.”

“That said, I am not a fool. I would not be running if I didn’t fundamentally believe that we’re gonna win this nomination and be able to win in November,” he said.

The two primary issues of his campaign are fully reopening both schools and the economy. The third issue, he said, is restoring civil liberties and constitutional rights that “have absolutely been shredded by government under the guise of a pandemic.” He said the 2nd Amendment, 1st Amendment and religious freedoms are “under attack these days.”

Snyder added that the General Assembly has focused on the wrong issues - marijuana legalization, styrofoam container bans and “gun grabbing” bills - during the middle of a pandemic. Meanwhile, he is befuddled that schools are not fully reopened and churches face state-mandated restrictions while 200 people can go into a Walmart. He says all

schools would have offered a five-day in-person learning option on Aug. 15 if he were governor. Now, he said, schools need to fully re-open “immediately.” He noted that it “can be done” as some private schools have resumed full operations with “nary an incident.”

“Five days a week, every week, with a teacher in every classroom.

Not some of these babysitting services that folks are offering up,” he said, adding that school closures have had a “devastating impact” on children.

In addition to schools, Snyder said “we need to open our economy now” to save small businesses, which he described as “the backbone of our economy and the heartbeat of our community.”

Snyder described Gov. Ralph Northam’s coronavirus-related executive orders as “unconstitutional” actions that “destroyed and obliterated our economy.”

“This was an unforced and unnecessary wound to ourselves,” he said.

He noted that Florida reopened its economy early and the only discernible difference between Virginia and Florida right now “is our economy is in shatters and theirs is thriving.” As of March 15, Virginia reported 6,981 COVID-19 cases and 118 deaths per 100,000 residents compared to 9,217 cases and 151 deaths per 100,000 residents in Florida.

Snyder noted that he and his wife jumped to the aid of small businesses early on in the pandemic by launching the Virginia 30 Day Fund nonprofit organization. He explained the organization provides small businesses lifelines in the form of $3,000 grants.

“We thought that we would only have to do that for 30 or 45 days. It ended up being a whole year and we have funded nearly 1,000 small businesses all around Virginia - about a dozen in Culpeper alone,” Snyder said.

CCHS basketball overcomes challenges for a successful season

Looking back on his final year with the Culpeper County High School basketball team, senior JoJo Crewnshaw said “it was definitely an interesting season.” What he will remember most is how they fought through adversity and ended up as a competitive team with a winning record.

Challenges were presented right off the bat. After just one game, Crenshaw explained the team received notification they could not play for two weeks due to a coronavirus exposure.

“At that point, I just kind of lost it.

I didn’t really know if we would finish our season or how bad it would affect our season...it took about half our season,” Crenshaw said.

Other challenges, Coach James Thompson explained, came when five “impact players” opted out of playing and resulted in the team

being “basement dwellers” in preseason standings. But he said the less experienced players “took advantage of the opportunity presented to them.” The Blue Devils finished as the runner up to Handley in the regular season and district tournament. In the regional semifinals, CCHS fell short to Loudon.

Beyond having key players not on the roster, Thompson said “it was a tough season to coach because you woke up everyday hoping none of your players or staff had contracted COVID.” “Even the bus rides to opposing teams were very stressful,” Thompson said.

The most palatable difference this season to Crenshaw was not having the usual lively crowd at home games.

“We have a pretty good fanbase...

But this year it was insanely different with only having 10 people in

the stands or only having parents in the stands. It’s kind of almost like a dressed up practice,” he said.

Despite the challenges, four CCHS players made the all-district team including Nathan Amos, who averaged 13 points per game; Chase Smith, who averaged 14 points per game; Quentin Butler, who averaged 10 points per game; and Crenshaw, who rounded up 14 rebounds per game.

“I’m proud of the team and what we ended up doing this season with all of the adversity we faced. Not having gym time in the summer and not being able to get in the weight room like we should have, we still ended up with a winning record and still competed for our district championship and still competed for our regional championship” Crenshaw said. “We still did all those things that we’ve always done at Culpeper.

SUMMER CAMPS Summer camps given the greenlight to resume After being cooped up for a year of reduced in-person learning, both parents and children have cause for celebration as Gov. Ralph Northam recently announced that summer camps will be allowed to resume operations after being shut down last year.

During a February news conference, Northam said one the most frequent questions he receives regards the status of overnight summer camps.

“Will children be able to go to overnight summer camps? Yes they will this summer,” Northam said.

In the most recently amended version of Executive Order 72, which outlines guidelines for events and gatherings, overnight summer camps must adhere to the following guidelines: • Employ the use of cohorts for the first 14 days of any camp session. Cohort size may not exceed 25 campers, not including camp personnel.

• Post signage to provide public health reminders regarding physical distancing, hand hygiene, respiratory etiquette, and reporting symptoms if sick. Signs must use age-appropriate language to be understandable by campers.

Regarding the argument to immediately reduce personal property taxes, Rimeikis said “I don’t know where your math is coming from but I think it’s missing some elements of reality.”

Russell responded that Hively’s plan is “what the government would like to do” while “I’m making the argument for what the taxpayers would like to do.”

Town Councilwoman Jamie Clancey noted that personal property taxes go into the general fund.

“So eliminating them, whenever that happens - as long as we have the money that we need in the general fund - that doesn’t necessarily take away anything,” she said.

Hively said that is correct but “the question is sustainability.”

"We've had a very good run - we had a very good economy until this pandemic hit. It’s hard to look in the crystal ball. Are we gonna come out of this pandemic and have just as strong of an economy as we had in 2019? Or is it gonna be a more drawn out, poor economy where we won’t see as much revenue?” Hively asked.

Councilman Billy Yowell said cutting personal property taxes “is a very worthy topic to talk about.” Cutting revenue, he added, could present problems if an issue arises with the economy, which “puts the pressure back on the council to have to increase real estate taxes, which I think we all don’t want to do."

If the town cuts personal property taxes, Rimeikis said the town should have a plan instead of it being a “symbolic effort.” He asked if anybody recalled former Virginia Gov. Jim Gilmore’s “no car tax” campaign promise.

As an alternative to cutting personal property taxes across the board, Councilman Keith Price suggested instead perhaps cutting them for certain items primarily used in business operations such as heavy trucks and tractor-trailers.

Russell suggested that the town cut personal property taxes for heavy trucks, campers, tractor-trailers, boats, RVs and outside signs. This would eliminate about $47,600 in town revenue. Clancey responded that it doesn’t hurt to have the conversation, even if it is just part of a long-term goal.

If the council opts to cut personal property taxes, Hively suggested removing $50,000 from either reserve funds or the town’s road paving budget.

The town council will continue discussing personal property taxes at future meetings.

As the Culpeper Town Council was reviewing budgetary plans for the upcoming fiscal year during a March 11 meeting, Councilman Keith Brown broached the notion of reducing personal property taxes.

This suggestion comes as the town’s revenue is $1.2 million less than expected revenue projections made before the coronavirus pandemic.

An approximate breakdown of current annual personal property tax collections include: $1,081 for vehicles, $381,000 for computer equipment, $198,000 for business equipment, $19,000 for heavy trucks and tractor-trailers, $10,000 for campers, $10,000 for trailers, $5,000 for recreational vehicles, $3,550 for boats and $50 for outside signs.

Councilman Jon Russell asked: “Can anyone make a justification for taxing people over and over on the things that they own.” He described personal property taxes as “unjust,” “anti-business,” “very antiquated,” and “asinine.”

Personal property taxes, Russell said, should be removed or phased out.

Councilman Pranas Rimeikis noted that the town has a longterm approach to reducing personal property taxes.

Town Manager Chris Hively said the town is currently on pace to pay off its debt service by 2030. This, he said, could open the door for a property tax reduction. Finance Director Howard Kartel explained a covenant debt agreement prohibits the town from paying off its debt before 2026.

Hively added that the town will hopefully become debt free before 2030.

With that said, Mayor Michael Olinger suggested that the town “follow the plan.” Rimeikis agreed, saying that “sounds like a plan to me.”

Instead of waiting, Brown said it would be a “good faith effort” if the town cut personal property taxes by 10% this year. The town would lose about $137,000 of tax revenue in that scenario, which Brown said is “very doable.”

Councilwoman Meghan Taylor said that Hively already presented a plan demonstrating “a good faith effort.” She added that the coronavirus pandemic remains ongoing. While Coronavirus Aid, Relief and Economic Security Act funding helped the town last year, she said “we don’t know what’s coming this year.”

While many employers have not provided salary increases, Brown noted that town employees are due a 2% raise. While Brown said he believes in taking care of employees, his main priority is “taking care of everybody.”

Trinity Senior Village opens assisted living facility

Trinity Senior Village, located just over the Culpeper County line in Orange, recently cut the ribbon on its new assisted living facility.

The property includes the assisted living facility and a memory care facility that is expected to open sometime in April. Owners Ken and Barb Tomayko purchased the land and constructed the two buildings to fill a much-needed service gap in the area.

Denice Caswell, Trinity Senior Village’s director of sales and marketing, explained the facilities were “designed and built to be very homelike opposed to the

big communities that can be too much for some people.” Each facility has 19 private suites and four shared suites while the land has room for one or two more buildings if a certain occupancy percentage is reached.

The assisted living facility is for those who need a little bit of help with daily activities such as bathing or dressing. The memory care facility has more built-in security measures and is designed for those with conditions such as dementia or alzheimers.

In addition to common amenities such as a gym and salon, Caswell explained that Trinity Senior Village has unique state-of-the-art

technology such as a Care Predict wristband. This versatile device serves as a roomkey and has a button to call staff. Over time, the wristband also monitors the wearer’s eating habits, gait and bathroom patterns.

“If there’s changes in that, a report is generated and staff will be aware of some differences to possibly prevent something down the road,” Caswell said. “So and so may have a urinary tract infection or they may exhibit some weight loss down the road if we’re not proactive in their diet.”

The facility also features a large touch screen monitor loaded with over 4,000 activities including

games, puzzles, art, literature, Bible study and more.

“Each person can pick out activities that they enjoy. We create a page for them so they can easily access those activities,” Caswell said, adding that the device also can gear activities towards those with memory issues.

The facility accepts residents from anywhere as Caswell noted that many adult children have expressed interest in moving their parents who currently live out of state to the facility. Depending on which building a resident is in and whether they are in a shared sweet, monthly fees range from $5,995 -$6,995

New location, new services at Elements Wellness Spa

Elements Wellness Spa is offering expanded services at a new, larger location. Customers will not have to travel far as the spa has moved from one location to another in the Cannon Office Park, where it has operated since opening in 2019.

Now at 763 Madison Road, suite 206, Elements Wellness Spa has doubled its size with four treatment rooms, two full bathrooms and a fitness room.

Services range from relaxing spa packages including facials and massages to beauty treatments and medical massages for chronic pain management or injury rehabilitation. The spa also offers sports massages to improve athletic performance and small group fitness and yoga classes.

Spa owner Becki Curtis added that clients can enjoy the many health benefits of an infrared sauna and Himalayan salt walls. An

oxygen bar will also be available in April.

Noting that the spa was voted the best massage and spa services in Culpeper for several years, she said “Elements Wellness Spa is the only spa of its kind in Culpeper County.”

Heather Boggess, a personal trainer at Powell Wellness Center, said she used Curtis before Elements Wellness Spa opened and remains a loyal customer. Boggess also sends her clients to Curtis, saying that "together, the two of us have helped people get back to their daily lives free of the pain that was bothering them."

"She's extremely knowledgeable with her services....because of the knowledge that she has, she knows exactly what muscles may potentially need strengthening," she said.

Boggess added that Curtis is very personable and truly cares about her job, which is "just apparent in what she does."

Viewing history objectively

How interesting it is that so much emotional energy is being spent over an issue that was settled more than 160 years ago. When slavery was abolished by the 13th amendment, it was universally accepted, and no one in his right mind any longer wished to reinstitute it. Americans, North and South, rolled up their sleeves and went back to work to heal and rebuild what the war had destroyed, and the nation became, not perfect, but better and strong and more prosperous than ever before. The monument on the courthouse lawn, as well as those that sprung up over the rest of the South, were not altars to slavery, but memorials to the bravery and sacrifical services of sons and brothers and loved ones in defense of their homeland from what they perceived to be oppression and invasion by a

tyrannical government. That they were wrong in their perception is indisputable, but that they were wrong in their endurance of the pains and privations and sufferings of war for their sincere beliefs is honorable and commendable in every place and in every age.

Today, not a single former slave nor a single former slaveholder remains, yet there are those who are attempting to instigate division among us. The effort to erase everything that has any connection with the Confederacy is reminiscent of Orwellian practice, so adeptly utilized by the Soviets for the past century, of continually revising the historical record by expunging everything not in alignment with current political correctness. If there is a “cancer that needs to be excised” from our midst, it is, ironically, the

same spirit of resentment, bitterness, vindictiveness, and division that sparked the Civil War in the first place.

History is what it is. That we may not like what happened doesn’t change what happened. What matters is that we either learn from what happened, or we are destined to repeat it until we do. No generation in any place or at any time inherited a perfect world, nor left a perfect world behind when it passed. Imperfect people with imperfect knowledge did the best they could with what they had at the time, and the result was imperfect progress, but progress nonetheless. May God grant us the wisdom God grant us the wisdom and the humility to do no less.

No. 1 on the checklist for all generations I brought boxes, packing tape, and coffee. Bonding is supposed to occur over that venti, honey almond milk, flat white, right? I did not want this exercise to be part of our bonding. Our bond was unfaltering. Certainly, we could just leave this day out of the calendar! An adjustment of schedule was not going to occur, and my role was to pack up the kitchen and her closet.

Packing each mug reminded Katherine Charapich me of the facets of humor embodied in this beautiful, now-adult daughter - each garment that I folded, an example of her fashion flair, be it behind the badge, in the gym, or a casual Saturday morning.

This precious child had not even departed for the nine-hour drive that would now separate us – a far cry from the five-minute luxury to which we had been accustomed, and through the tears that I tried to hide, I kept wanting to say, “1, 2, 3 . . . ok – you can come back now.”

In addition to what one might consider normal, parental concerns – that of safety and provision, I worried about my daughter’s estate planning, specifically her power of attorney. I would be handing such an important matter into the hands of another estate planning attorney – one in “that new state.”

Perhaps a “normal checklist” when moving to a new jurisdiction – a new

state, would be: find a church, contact the DMV, establish new bank accounts, find a physician, and purchase a gym membership. It has been my experience that for the person who is “twenty-something,” placing the action of “finding an estate planning attorney” just does not make the list unless there are minor children to consider.

Actually, it is not just those who are “twenty-something” who may need a little encouragement to affect estate planning, the prompting is applicable across all age groups.

Thus, step one - place affecting an estate plan on your checklist. Step two – put in place a general durable power of attorney.

A power of attorney is a legal document that provides you, the principal, the opportunity while you have capacity, to set forth the parameters that are acceptable to you for decisions that are part of your every-day life practices. The fact that your power of attorney will be a “general” one means that broad authority is being given to the agent to do almost anything for the principal for matters such as quality of life decisions, financial, legal, contractual, and communications.

A power of attorney affords the principal the opportunity to name an individual as an agent – someone who has the authority to act on behalf of the principal. Successor agents may also be named, so that in the event the primary agent is unable or unwilling to act, or fails to serve, there is a trusted individual who can take her place. § 64.2-1607 of the Code of Virginia

states, “A power of attorney is effective when executed unless the principal provides in the power of attorney that it becomes effective at a future date or upon the occurrence of a future event or contingency.”

A power of attorney that is durable means that the power of attorney is effective even in the event the principal become incapacitated.

In the event you do not have a power of attorney in place, there is no one who has been given the legal authority to make decisions on your behalf. If you become incapacitated and do not have a power of attorney in place, then an individual – perhaps a family member, friend, or someone you do not know, can petition the court for guardianship of your person, conservatorship of your estate. Please control your care, the management of your assets, and the parameters that affect your quality of life while you have the ability to do so.

The following is a power of attorney checklist that I would like to give to all adult children and those young at heart: Self-care . . . Decide to protect your interests while you are on this earth.

Contact an estate planning attorney.

Discuss the value of a general durable power of attorney that is effective upon signing.

Identify at least three people you can trust to be your agent and name them in succession.

Once this important document is in place, then you and your loved ones can focus on the rest of the “checklist” – with coffee in hand - up close or over the miles.

It appears that it is now part of the agenda of the Culpeper Town Council to remove from local place names any reference to any historical individual who supported the practice of slavery during that period when it was legal in the areas where it was practiced. That being so, I propose another name for their consideration.

Thomas, Lord Culpeper, to whom was originally granted by Charles II a large tract of land including all that is now occupied by Culpeper County, is my candidate. Thomas was a principal in the Royal African Company, which was vigorously engaged in shipping African slaves to Virginia. Of course, that will require changing the names of Culpeper County, the Town of Culpeper, and, as well, the Culpeper Town Council, but these are minor difficulties and expenses when compared to the glorious feeling of political correctness that will result. The Council has set the agenda -- full speed ahead.

Mr. Joe Daniel, leading the effort to remove Confederate symbols from Culpeper, said in the February 18 – March 3 issue of the Culpeper Times that the confederate monument on the courthouse lawn was erected by the Daughters of the American Revolution in 1911.

The Culpeper Minutemen Chapter of the DAR would like to correct the record.

The bronze plaque on the south face of the monument’s pedestal says: “Culpeper’s Memorial to her Confederate soldiers 1861 – 1865 by A. P. Hill Camp NO. 2 C.V. and the citizens of this county, 1911.”

A bronze medallion on the east face of the pedestal displays a mounted soldier surrounded by the words: "The Confederate States of America: 22 February, 1862 DEO VINDICE." Another medallion on the west face is Virginia's motto, SIC SEMPER TYRANNIS, beneath a version of the Virginia state seal. The north face is blank.

Boosalis said developing the site plan will take anywhere from three to five years with construction starting after that. The development will still have to go through the process of getting permits from the county.

The owners want to work with the cur-

rent tenants to see if they want to lease space in the new development or another shopping center the company owns, Boosalis said.

Grace Street Properties plans to build 2 million square feet for a mixed-used development, which will include retail space for lease. The developer wants to work with the county to consider a pedestrian bridge from the development to the VRE and Amtrak station across U.S. 1.

The county’s plan for North Woodbridge calls for increased density in the area near the VRE. Dr. Colin Greene recently began as director of the Rappahannock-Rapidan Health District. He is stepping in to replace former director Dr. Wade Kartchner, who left at the beginning of March after serving the district for nearly five years.

Greene transitioned seamlessly into the role, having served as the health director of the neighboring Lord Fairfax Health District for the past three years. He said he is pleased with the vaccination efforts in his new district, which he affectionately calls “Rap-Rap.” Greene said new daily cases of COVID-19

are finally dropping into the 20s after peaking at about 100 cases per day in January.

He said RapRap has been receiving regular shipments of about 2,400 first doses of COVID-19 vaccine per week from various manufacturers, Dr. Colin and several hunGreene dred second doses as well. “There are occasional opportunities when there are extra shots available and whenever I hear about that, I reach out and grab them.”

Asked why there are extra vaccines lying around, Greene said he

doesn’t know all the details but he guessed that “maybe too much is ordered, or more than likely we just get more than we expected from the federal government.”

As of Tuesday, about 18.5 percent of residents in the Rappahannock-Rapidan Health District have received at least one shot and close to 10 percent are fully vaccinated.

“We’ve been trying to favor the older members of the population so if you look at the over-65 folks, that number should be much higher,” he added. “Considering it has a relatively small population and it’s a rural spread-out area — which makes it a little hard to get to people sometimes — I’d say we’re doing very well.”

Statewide, 1.6 million Virginians have received at least one dose,

placing Virginia 11th in the country in terms of doses administered and sixth in percentage of allocated doses used.

Greene, who served as the interim commander of the Walter Reed Army Institute of Research during the Zika virus epidemic, encourages residents of Rap-Rap to get whichever vaccine becomes available to them when they become eligible.

Greene served as a doctor in the U.S. Army for 30 years and received his master’s in public health from the University of Washington in Seattle. He has served as the chief medical officer of a large medical center in Fort Bragg, North Carolina and was also in charge of a small field hospital in Iraq for almost a year.

Culpeper churches must continue following COVID-19 guidelines

Local churchgoers must continue following coronavirus-related safety guidelines outlined in Gov. Ralph Northam’s Executive Order 72, as Culpeper County Circuit Court Judge Dale B. Durrer recently denied a request to provide a temporary injunction easing restrictions during church services.

Attorney J. Michael Sharman filed the lawsuit against Northam on the behalf of Ron Young, Alum Spring Baptist Church’s pastor, Charles Sheads Sr. and Jocie Stallings, who are both members of Novum Baptist Church in Madison County. He also filed a nearly identical lawsuit in Rappahannock and Madison counties.

Sharman explained via email that “this was only a denial of the request for Temporary Injunction” and “the case is not over.”

“We still have the Permanent Injunction and the Declaratory Judgement trials to do. The judge’s letter opinion and order denying our request for the Temporary Injunction lets us see what concerns he has regarding the merits of the case so that we now see what is needed to overcome those concerns,” he wrote.

In his objection to the ruling, Sharman wrote that both the state and federal constitution impose “limits on a government’s exercise of its police powers” and the court

erred “when it inverted that rule and elevated the government’s exercise of its police powers over the Plaintiffs’ inherent rights.”

In another objection, he says churches now enter a second year facing restriction on their abilities to “freely gather together and worship with their full congregation during this Holy Season of Lent, Passover, Good Friday, and Easter, despite no evidence...that even a single person within their congregations had died, been hospitalized, treated for, or even diagnosed with COVID-19.”

The plaintiffs are asking that the least possible restrictive guidelines be placed upon churches in what Sharman previously said are attempts to obtain equality and religious freedom as churchgoers should not be subject to harsher guidelines than anyone else.

STATE: BUSINESSES FACE MORE RESTRICTIONS

The state argues that businesses face more restrictive measures than churches and that religious services have continued uninterrupted throughout the pandemic. The state added that capacity limits have not been enforced at churches since July and the only requirements for religious services are social distancing and masks. Sharman countered that the executive order does not outline exactly what distancing

protocols are required, and this vagueness imposes capacity restrictions upon churches.

Northam’s order has been amended several times, with current guidelines for religious services with over 10 participants including:

Keeping students fed over 365 days of a pandemic

The process of feeding students at school is usually easy - they go to the cafeteria, stand in line and then eat. That all changed last March when schools closed and virtual classes began. Despite all of the unknowns at that time, Food Services Director Greg Beamer explained one thing his department knew was “we still had to feed kids.”

Since students could not be fed through computer screens, his staff launched into action and initiated a “grab-and-go” meals distribution system a couple of days after the shutdown. From 10:30 a.m.-noon at six schools, a food services worker mans the grab-and-go station rain or shine.

Parents pull up, grab the bagged meals and are on their way.

Krystal Howell, the child nutrition food service employee who distributes meals at Culpeper County Middle School, has enjoyed getting to know parents and chatting with kids who tag along for the pick-up.

In testing whether the order violated the Virginia Statute for Religious Freedom, Judge Durrer noted that the statute does not prevent the government “from maintaining health, safety, security or discipline.”

Durrer notes that the statute adds that the government cannot “substantially burden” free religious practices unless it is demonstrated that the burden is “essential to further a compelling governmental interest” and implements “the least restrictive means

While less students actually need meals, Beamer said distributing the food is more challenging than ever as “we’re serving meals inside the building, we’re serving meals outside the building and we also have a Wednesday delivery for families that can’t get to us.”

Lunch for in-person learners has also altered, with changes depending on the schools’ capabilities. Students eat in classrooms at the middle school, which Principal Jesse Blackburn joked is a welcomed change in the administrative office neighboring the cafeteria, as the decibel levels are off the charts during lunch hours.

In denying injunctive relief, Durrer wrote that Executive Order 72 does not limit church capacity or prevent assembly, communion, singing or praying.

Addressing whether the least restrictive means have been implemented, Durrer notes the order “exempts religious services from the otherwise-universal temporary gathering restrictions” and “indicates that individuals may be seated wherever and with whomever they want with appropriate physical distancing.”

Durrer noted that the court recognizes the distinction between a political debate reflecting rational disagreement with the order and a judicial ruling that the order is unconstitutional.

“Therefore, the court holds that the Petitioners are not entitled to

injunctive relief under the statute,” he wrote.

In his objection, Sharman claims Durrer was not in fact quoting the Statute of Religious Freedom.

CONSIDERING AN INJUNCTION

After determining that the Executive Order does not violate the Virginia Statute for Religious Freedom, Durrer examined whether the request for a temporary injunction passed a four-pronged test. While the lawsuit did not meet all of the requirements, it met some, such as proving the plaintiffs will suffer irreparable harm without preliminary relief.

“The ability to worship as one chooses is sacrosanct in the United States of America. Any restriction on that right causes irreparable harm,” Durrer writes.

Additionally, Durrer conceded that the plaintiffs “demonstrated that the requested temporary injunction is in the public interest and balance of equities tips in their favor” as “the court holds that the protection of constitutional rights is always in the public interest.”

“Conversely, the protection of the public health and safety is also of great concern,” he wrote. “However, the court heard no evidence

Having to bag up meals presents limitations on the amount of hot entrees offered, an obstacle that was also conquered by keeping a food warmer outside two days a week at certain schools.

He added that it does not matter how next school year unfolds because “we will feed the kids one way or the other no matter what is put in front of us.”

“That is our job, to make sure they get a nutritious meal,” Beamer said.

For the school division’s efforts, the No Kid Hungry organization recently recognized Beamer as a Schools Meals Hero. In presenting the award, Superintendent Dr. Anthony Brads noted that Beamer “doesn’t seek attention, doesn’t seek the credit but my golly this guy does a great job and we really appreciate him.”

Beamer said his entire staff, principals and administration should all be labeled heroes because “it takes all of us to get it done.”

“Whatever it took to get it done, that’s what we did. And the only way it got done is with the dedicated staff that I’ve got,” he said. that any activity at these specific churches, including, without limitation, physical distancing and gathering has or would result in an increase of the spread of Covid-19.”

Durrer also expressed concern over the potential of police officers asking pastors how they plan to host services or whether they have marked seating and common areas. He added that “the thought of police officers “pestering" religious leaders is “disconcerting.”

In denying a temporary injunction, Durrer noted that the plaintiffs failed to prove that they are likely to succeed on the presented merits. He wrote that the legislature has empowered the health commissioner to “meet any emergency or to prevent a potential emergency caused by a disease dangerous to the public health.”

Additionally, he noted that the U.S. Supreme Court has stated that “it is no part of the function of a court to determine which measures are likely to be the most effective for the protection of the public against disease.”

“In this case, the purpose of the order is not to infringe or prohibit religious worship, but to ensure that it occur safely during a worldwide pandemic,” Durrer wrote.
