Fast and efficient procurement Once LHC Appointed Companies are established for a framework, the process of calling off projects and commissioning work is very efficient. Terms and rates have been agreed and even when a mini competition is required, the majority of contractual arrangements have already been finalised. Project work can start quickly. Financial gains Working with LHC frameworks gives suppliers access to construction, refurbishment and maintenance projects of over £200m each financial year. Clients who spend more than £200,000 on two or more frameworks in a year will benefit from a share in the LHC operating surplus we return to Members. About this framework agreement The LHC Framework Agreement for schools and community buildings is available to all local authorities, housing associations and other public sector bodies in England, Wales and Scotland. Fully OJEU compliant, it is divided into two workstreams providing a full range of design and build and general refurbishment works.

This framework agreement has been established in strict compliance with UK Public Sector procurement rules for use by public sector bodies in the UK as detailed in the LHC buyer profile (www.lhc.gov.uk/buyerprofile) and as specified in the Contract Notice: -- 2012/S 95-156442 Published in OJEU in May 2012 with 13 successful tenderers appointed in November 2013.

About a tender Interested companies were invited to complete a Pre-Qualification Questionnaire (PQQ), which sought detailed information on several criteria, prepared and formatted in accordance with PAS 91:2013 ‘Construction pre-qualification questionnaires’, before inviting selected companies to complete an ITT and Offer Document. PAS 91:2013 was published by the British Standards Institution and sponsored by the Department for Business, Innovation and Skills (BIS) to provide a consistent set of pre-qualification questions to be used throughout construction procurement.

The companies that scored sufficient marks in the PQQ were invited to complete an offer document (invitation to tender).

-- Compliance with EU/UK legislation -- Applicant’s organisation -- Quality management -- Sustainability and social inclusion -- Equal opportunities and diversity -- Health and safety -- Financial status and insurances -- Responses to questions using case studies to demonstrate capability, skills, experience and resources to deliver and maintain the high level of quality required by LHC for the delivery of works and installations

The offer document provided detailed service and product specifications and sought a response from companies on their conformity to these requirements.

From pre-qualification to call-off contract The diagram below shows the process a supplier completes to become an LHC Appointed Company and to be awarded a contract (or “call-off”). It also highlights the support LHC provides once a project is live. Suppliers complete a pre-qualification questionnaire accessing: -- Company standing

-- Financial standing, employment practices, environmental awareness, capacity and geographical range -- Installation capability -- Technical capability -- Quality systems management capability -- Experience of supply to the public sector -- Sustainability and social value Selected suppliers submit offer documents covering: -- Specification for products and services -- Testing and certification -- Service capability

-- Pricing Scores are then awarded to each supplier in respect of each evaluation criteria. A detailed evaluation report is prepared which shows for each tenderer a: -- Weighted score under each heading -- Value for money index -- Company or companies recommended for appointment

Appointing companies

Our aim is giving LHC clients and Members a choice of Appointed Companies to work with. Numbers vary per framework in line with anticipated demand and subject to the number of qualifying suppliers. -- All suppliers are notified of the results and the unsuccessful tenderers can choose to have a debriefing to help improve future offers -- Contract Award Notices are published in the Official Journal of the European Union (QJEU) and on the LHC website

Awarding contracts “Call-offs”

When buyers are ready to choose a supplier for an individual project they should start the process by talking to LHC. LHC will coordinate either a direct award, if there is a single supplier on a framework, or a mini-competition if there are several. -- A mini-competition involves all capable LHC Appointed Companies -- A direct award is made to a single company, with justifiable reasoning, without reopening competition

Award weighting criteria Award weighting criteria are established on each individual framework and can be flexed to a buyer’s individual needs. Public sector officers can obtain a copy of the full LHC evaluation report on request.

Workstream 1 New build extensions and associated works

40% Structured interview session Evaluation of tenderers’ responses to questions covering: -- R isk management, including the effectiveness and use of risk registers and responses to specific health and safety and financial hazards

40% Tenderer’s written responses to the technical quality questions

-- D esign and management expertise, including specific responses to CDM co-ordinator, health and safety file and programming issues -- C arrying out the works under a design and build contract, including supply chain, statutory requirements and development control issues

Evaluation of responses to questions and of declarations of compliance, covering: -- T he provision of a comprehensive service for the execution of works, regarding delivery issues, call-off processes, health and safety, quality management assurance and control procedures across the lot appointed to -- T he satisfactory evaluation of experience, skills and competency of the design team and their management -- F ull details of approach to delivering a scenario project and sustainability

20% Pricing (price models) Prices were tendered on the basis of indicative elemental costs, covering: -- Preliminaries -- Site establishment and management costs These were fed into six price models covering various different project types and values for each workstream.

Workstream 2 General refurbishment

Details of each workstream Workstream 1 addresses works relating to new build extensions and workstream 2 covers general refurbishment projects and the supporting design service.

Workstream 1: New build extensions and associated works

Workstream 2: General refurbishment

-- Full scope design service, including but not limited to architectural services, mechanical and electrical services design, and structural and civil engineering design

External refurbishment works, including:

-- Design services can be provided by the LHC Appointed Company’s in-house design team, a consultant employed by the Appointed Company or a client nominated consultant

-- External cladding and insulation works

-- Replacement of flat and pitched roof coverings -- Replacement windows and doors -- External landscaping works including resurfacing of car parks and playgrounds

-- Traditional design and build call-off projects set by the member or nominated consultant

-- Multi-use games areas and other types of sports facilities including groundworks, drainage, fencing and associated electrical works

-- Bespoke modified design and build call-off projects inclusive of design to cost methodology

-- D edicated design service available from all Appointed Companies, if required Internal refurbishment works, including: -- Refurbishment of science labs and home economics and other education learning environments -- Refurbishment of sanitary facilities, sports changing facilities with associated electrical and mechanical works with a supported design service -- Internal refurbishment and remodelling of community buildings with all associated works and electrical and mechanical services works -- D edicated design service available from all Appointed Companies, if required Additional services provided by LHC Appointed Companies across both workstreams include: -- The provision of a dedicated project manager at each LHC Appointed Company to maintain high quality communication and service at all times -- The provision of insurance warranties, collateral warranties, bond or parent company guarantee and guarantees for workmanship and materials -- The provision of detailed monthly reports of actual costs and forecasts for out-turn costs for all contracts, broken down to various parts of the works in accordance with customer’s requirements -- The availability of other LHC EU compliant framework agreements, including for flat roofing and PVC-U, aluminium and timber windows and doors.
