BELGIUM – CCTV NEW: From now on, your surveillance cameras must be reported to the police services. As of today, surveillance cameras must be reported via a specific website. What does this mean? Good news! The declarations from your surveillance cameras will be free from now on. IMPACT: •

Do you want to install a new camera surveillance system? No problem! You must indicate your system on the new application no later than the day before the system is operated. Have you already indicated your surveillance cameras at the electronic desk of the Belgian Privacy Commission? To update your data, you also need to indicate your cameras on this new application. o A two-year transition period was provided to give you the time to do so; you therefore have until May 25, 2020 to be in order for this declaration. LUPPO’s advice: don’t wait! If cctv is not reported correctly, there is the chance that a court will not accept them as evidence! o You must ensure that your declaration is up-to-date, by validating it at least annually.

PRIVACY •

As provided by the European Data Protection Regulation (GDPR), the Camera Act also imposes the obligation to keep a register of your image processing activities. This register must, on request, be made available to the Data Protection Authority to enable it to carry out its audit engagement. This register will take a written form or electronically and must be updated.

What do you need? The declarations of surveillance cameras must be submitted electronically (as in the previous system) via the following NEW link. Access is by means of an electronic identity card, a citizens' token, or a unique security code via a mobile application (such as when you wish to file your tax return via tax-on-web). ATTENTION: If you want to submit a declaration for a legal entity, it is therefore necessary to be able to represent it.
