Belgium : Security guards on public roads and their duties
Recently, the powers of private security guards have been expanded with regard to their power of action in places open to the public (more about this new law in our Newsletter #37). A surveillance activity by private security giards on public roads is possible in several situations. Thus, the surveillance and control of persons in the context of the maintenance of security can take place: ✓ On the perimeter of the parts of the public road adjacent to buildings of international institutions or embassies, determined by the Minister of the Interior and whose access to the public is temporarily limited ✓ In industrial areas where there are no inhabited homes. This restriction is not applicable on the homes that are connected to the companies located in that industrial area. ✓ Public places that belong to the infrastructure of public transport companies or airports ✓ The following two possibilities have the following restriction: the perimeter must be clearly delineated with the following icons. These are laid down by the Royal Decree of 10 November 2017.
1. Under certain conditions within a perimeter determined by a municipality Municipalities can indicate a perimeter through a police regulation where private security is allowed. The conditions for this are that the zone is not mainly residential and cannot extend over the entire municipality area. Moreover, this perimeter may only be introduced temporarily and in exceptional circumstances. 2. Within a safety perimeter and in case of emergency determined by a municipality It is about a safety perimeter that has been introduced because of an emergency situation. It is temporary and only in exceptional circumstances (catastrophe, fire, flood, gas leak, etc.). The monitoring and control of persons is permitted within the perimeter laid down by the municipal council and on condition that the municipal authorities do not have evidence to show that public order will be disturbed.
In such circumstances, the security officers may guard at the edge of this perimeter to prevent unauthorized persons entering the perimeter. In this way they can monitor the demarcated perimeter and the emergency services can concentrate on their main tasks
