Excitement mounts as construction industry gets ready for the 2017 National Site Awards Top performing construction sites to receive national recognition by Considerate Constructors Scheme The Considerate Constructors Scheme will be honouring the very best performing registered construction sites at the 2017 National Site Awards. These prestigious awards recognise those registered sites that have shown the highest level of considerate construction towards the public, the workforce and the environment. Over 3000 guests from construction sites of all different sizes will be attending award ceremonies taking place between 20 March - 7 April in Edinburgh, London and Manchester. Out of some 8000 eligible sites, over 800 have been selected to win either Bronze, Silver or Gold Awards, within each of the following project value bands: Band 1: Under £500k; Band 2: £500k to <£1m; Band 3: £1m to <£5m; Band 4: £5m to <£10m; Band 5: £10m to <£50m; and Band 6: £50m and over. One Gold Award winner per value band will also be given the prestigious title of ‘Most Considerate Site 2017’, with all shortlisted sites for this accolade receiving Runner-up Awards. Costain secures multi-million pound Project Controls Framework Agreement from EDF Energy Costain has won a new multi-million pound framework agreement from EDF Energy Nuclear Generation to provide a project controls managed service to portfolios and programmes of work across all of EDF Energy’s eight UK nuclear power stations for an initial three year term. The Nuclear Generation division of EDF Energy is a new client for Costain. As part of this work Costain will develop people capability in core project control skills and provide specialist support to EDF Energy’s Central Technical Organisation to improve project performance and deliver cost efficiencies. Nigel Curry, Consulting and Advisory Services Director at Costain, said: “Nuclear power is a significant part of the UK’s energy mix. It provides consumers across the country with power that is affordable, low carbon and secure. Meeting national needs is the cornerstone of Costain’s strategy and we have broadened our services to ensure we can best support our customers. Sally Cave becomes the UK’s first female Gas Membrane Installer and Trainer in a male dominated construction industry Following the completion of a NVQ Level II in Gas Membrane Installation, Sally Cave, a 28-year-old Project Manager at Doncaster Membrane Installation Ltd (DMI), has become the first qualified female gas membrane installer and Training Assessor in the UK; and has received high praise from three leading trade organisations in the process. Sally’s achievement is even more remarkable given the way men dominate the construction industry. According to UCATT, the trade union for the construction industry, women make up only 11 per cent of the construction workforce and just 1 per cent of workers on site. The Office for National Statistics says that the number of women working as roofers, bricklayers and glaziers is so low that it is unmeasurable. Sally, who lives in Sheffield, has worked at the family owned business since 2013 and began studying for her qualification in 2014. It

News Work starts on £20m industrial development in the heart of Birmingham Infrastructure and remediation work has started on site at Kingpin, Tyseley, a £20m development of industrial and warehouse units on a 13-acre canal-side site in Birmingham. When complete the project will see the delivery of over 200,000ft2 of B1, B2 and B8 warehouse and manufacturing units. The transformation of the previously rundown site is being delivered by H2O Urban, a joint venture company owned 50% by Canal & River Trust and 50% by private developer bloc. Tyseley is just one of several regeneration and redevelopment projects that H2O is working on in conjunction with Canal & River Trust adjacent to its waterways. Funding for the site has been provided by Ropemaker, the property arm of the BP Pension fund. H2O has appointed A & H Construction to build out the scheme; the firm has a long history of building commercial and industrial buildings both in the Midlands and throughout the UK. The development will provide high specification build-to-suit warehouse and manufacturing units ranging in size from 40,000 ft2 up to a maximum of 110,000 ft2, available on a leasehold basis. The first unit will be completed in June 2017. Other units will then be progressively completed through the year with the final structure ready in March 2018. In addition to delivery, H2O’s role has comprised obtaining outline planning approval, obtaining reserved matters approval and identifying and securing Ropemaker Properties as its funding partner for the scheme. It has also been announced that SIG Trading has agreed a 15-year lease on a 15,000ft2 unit, trade counter and large builders yard at the site, relocating from premises nearby. As the first tenant, SIG’s premises will be completed by summer 2017.

Construction subcontractors forced to accept contract terms Over half of UK subcontractors believe they must accept the terms of contracts with large construction firms, or face the risk of losing future business, according to new research from specialist funder, Bibby Financial Services (BFS). Findings of the Subcontracting Growth survey show that the majority of firms (55%) do not believe they can influence the terms of agreements with main contractors. The research highlights the power imbalance between the sector’s large and small businesses. Helen Wheeler, Managing Director of Construction Finance at Bibby Financial Services said: “All too often we see the battle of David versus Goliath in the construction industry, with larger contractors wielding the power and smaller firms reluctant to negotiate terms through fear of losing future work or gaining a reputation for being difficult. “However, understanding and negotiating suitable contract terms is critical in ensuring that projects are priced accordingly and profitable for subcontractors.” Findings of the research reveal that late payment from prime contractors is the most significant challenge subcontractors face over the year ahead (27%), followed by skills shortages (21%). One in five (20%) said the health of the UK economy is the biggest threat to their business in the next 12 months. The majority of subcontractors (51%) do not believe the UK’s decision to leave the EU will affect their businesses. Almost one in five (19%) said that Brexit will have a negative impact and 17 per cent said it will be bad for their businesses. Helen continued: “On the subject of Brexit, subcontractors are divided. For some it

will help the UK to secure infrastructure investment from wallets further afield than Europe. Others see it posing a threat to labour pools and a cause of significant inflationary pressures.” “One thing that is clear is the impact poor payment practices are having on the industry. It is unsurprising but discouraging that late payment from main contractors is still an issue for smaller construction firms across the country.” The report also revealed the enormity of the task for subcontractors having to negotiate contracts with businesses taking on an average of 40 contracts per year. The average value of these contracts was £205,076, highlighting the significance of the work undertaken by the UK’s army of subcontractors. One in five firms (20%) believes that unfair penalty clauses from prime contractors have negatively impacted their businesses. Peter Vinden, Managing Director of construction specialists, the Vinden Partnership, said: “The power imbalance of the construction sector is well known but it is critical that subcontractors recognise that there is support available to help them check and negotiate terms with larger firms. “Ensuring that they are not signing contracts with unfavourable terms or clauses could be the difference between taking on a profitable project and insolvency. “The impacts of signing contracts with onerous terms or clauses can be anything from a lack of cashflow preventing salary payments through to insolvency, so it really is important that firms ensure they’re negotiating the best terms for their business and seeking help where they need.”

Achieving the NVQ is just one step along the career development path that Sally has set out for herself, as she explains; “When I started work here in 2013, I was doing one day a week on admin tasks helping out my dad who started the company in 1993, when I was only four. I quickly realised that I could hardly tell the lads what to do unless I fully understood all the processes involved, so I enrolled to study through the Construction Industry Training Board (CITB) approved British Geomembrane Association (BGA) course. It meant being out on site a lot, which I found I loved doing; even though I never really envisaged myself being out managing projects. Yes, this is a very male dominated industry, but I get total respect from everyone in the team because they know I can do exactly what they can irrespective of my gender,” said Sally. “Gaining the qualification is important for my long-term plans,” says Sally “I really enjoy the training side of things and hope to develop a training school that becomes a beacon of excellence for the industry. DMI already runs upskilling courses for general construction workers that want to be able to lay membranes and move on to become qualified technicians. Unfortunately, we are still seeing unqualified people laying membranes - which is a really dangerous practice as inadequately laid membranes can be killers.”

Pulse Modular Homes appoints chief financial officer as modular housing sector expects growth Pulse Modular Homes Ltd, a specialist modular housing developer has appointed Elaine New to the management team as chief financial officer. Starting with a Cambridge education and Price Waterhouse ACA training, Elaine has since had a wealth of experience in finance and business operations, including as a director of several public limited companies. She successfully co-launched Harrods’ airport operations, relaunched the film production company Seven Arts Pictures Plc onto the NASDAQ global market and helped to create a new brand for Sears Plc. Elaine commented: “I have an entrepreneurial spirit wrapped up in an accountant’s body which has helped me manage top level finance and operational issues across a range of successful corporates. Leading developer and manager, MEPC, has commenced construction work at its speculative Park Drive East development at Milton Park in Oxfordshire. Park Drive East will be comprised of three separate buildings (141, 142 and 143 Park Drive), totalling 110,000 sq ft, including a 42,000 sq ft Grade-A office building, as well as two hi-tech laboratory facilities totalling 68,000 sq ft. The Grade A office building is expected to complete by the end of the year, which will quickly accommodate the ongoing demand for high-quality office and laboratory space in Oxfordshire. The two remaining buildings are expected to complete in spring 2018. The development is situated on a 7.6-acre site located towards the eastern end of the leading science and business park. It also falls within the Science Value UK Enterprise Zone, which offers businesses taking space in the new scheme to apply for business rates discounts of up to £275,000.

AHMM’s New Scotland Yard refurbishment

Allford Hall Monaghan Morris has delivered a new home for the Metropolitan Police which combines openness and securityhas delivered a new home for the Metropolitan Police which combines openness and security. Staff have been moving into the Allford Hall Monaghan Morris (AHMM)designed New Scotland Yard since last November. When it reaches full capacity, more than 2,300 people will pass through its doors each day. It’s a fitting time for London’s Metropolitan Police Service to move to its new home, just as the Met’s first female police commissioner, Cressida Dick, takes the reins. It is also a return to the William Curtis Green-designed building on Victoria Embankment, part of a strategy to rationalise the force’s estate and shake up its working culture. Its former base for 49 years at 10 The Broadway has

been sold and the funds used to refurbish and extend the 1937 building and improve technology across the Met’s estate. The building, which sits next to the original police HQ designed by Richard Norman Shaw in the 1800s, was originally built as an annexe to the latter to house the force’s technology departments. But it had stood empty since 2011. AHMM won the job to bring it back into police use in October 2013 when it was selected ahead of Foster + Partners, Allies and Morrison, Keith Williams Architects and Lifschutz Davidson Sandilands in a RIBA-run contest. The scheme consists of four main elements: a new glass-fronted pavilion; another pavilion at the top of the building with views over London; a new wing at the side of the building to add symmetry; and an extension to the rear elevation to increase the floor space. ‘One of the most important ambitions was to give a sense of transparency and openness,’ says AHMM co-founder Paul Monaghan. But at a time when the need for security is so high, this was never going to be easy. ‘The types of attack we had to design for have changed significantly since we began the project,’ Monaghan adds. ‘The glazed pavilion at the front was certainly difficult.’ Bomb-proof glazing is par for the course in designing a building like this. But many of the security measures that have been put in place are barely noticeable, or just become a discreet part of the landscape surrounding the ground floor: bollards and a walled ramp leading up to the glass pavilion, for instance, are designed to prevent the building being rammed by a vehicle. You are hardly aware that you are crossing a security line, which is embedded in public realm features, rather than being an obvious afterthought.

To the rear, the building is clad in fins bearing colours sampled from surrounding buildings. Orange-red tones of brickwork combine with yellowish stone colours of the nearby parliament buildings to create a privacy veil along the back of the building where the façade sits just a few metres away from the adjacent block. The Eternal Flame, which honours police officers who have died on duty, has been moved to the front of the building where it can be seen by the public. It had previously been housed within the hallway of 10 The Broadway, away from the public eye. Continuing the series of military and civic memorials along the Victoria Embankment, the flame now sits within a contemplation pool to the south of the entrance pavilion. In the pavilion itself, a case overlooking the flame holds the Roll of Honour listing all those members of the Met who have died in service.

To the other side of the pavilion, the building’s previous entrance has been turned into a glazed vitrine, which will display historical items of interest. Eventually a museum will open in the building’s basement, reinforcing the message of openness and accessibility between police and public.

Just as important as the building’s transparent entrance was the need for spaces which could be used for media broadcasts. Views have been carefully considered for different purposes. At the front of the building, TV news

reporters can stand before the relocated revolving New Scotland Yard sign, while terraces on the upper storeys at the rear provide a backdrop of the Palace of Westminster and central London. Internally, the Met’s new home features large, open plan office spaces reminiscent of AHMM’s 2011 Stirling Prizeshortlisted Angel Building in Islington. (Monaghan toured the building with the client while they were designing this project.) The new New Scotland Yard lacks the large top-lit atrium space of the Angel, and instead a new lift core occupies the centre, its glazed sides offering glimpses into each of the office floors. For the Met, just moving to open plan spaces and adopting hot-desking has been a huge change in culture, and AHMM has provided a variety of spaces to help ease this transition. In some there are high desks with stools, in others a more formal regular layout, while café and breakout spaces have been designed to accommodate meetings in a more informal environment. In the bathrooms AHMM has had some fun playing with the graphic heritage of the Met with each floor designed using the colours of police service cars through the ages. It’s fun and playful without being obvious. In its completed state the building differs little from the practice’s competition-winning proposal. The architecture offers a subdued Modernism and a gravitas befitting a respected institution. The building will become an icon not just for its architecture but because it is inevitable – it will be on our television screens every week, a calm backdrop to the drama of policing London’s streets. For AHMM this has been a chance to put their stamp on a building of major significance in London.

Architect’s view Our design for New Scotland Yard is a radical remodelling and extension of the Curtis Green Building, erected on the Thames Embankment in the 1930s, which was an earlier home of the Metropolitan Police Service. The core of the brief was to deliver a landmark development and to create

Curtis Green Building; create a highly visible entrance and reception area; create an enhanced connection with the public and enliven the external realm; use good-quality, durable materials from sustainable sources; and employ a holistic, layered security strategy to protect the building’s users and visitors. The design has transformed the building with the addition of a curved glass entrance pavilion, rooftop pavilions and a reworking of the existing accommodation. The scheme has expanded the building’s floor area from 8,691m2 to about 12,000m2 through extensions to the rear, roof and front concourse. The contemporary design of these complements and enhances the architectural features of the original building and the materials, colours and proportions of neighbouring Whitehall buildings. Inside the original building we have created a flexible fle office environment to facilitate collaboration and interaction. The ro ooftop extension provides multi-use conference space and terraces and is illuminated to give presence at night, symbolising the 24/7 nature of the building along with its civic purpose. A brick ‘carpet’ in the landscape outside the entrance references the distinctive striped brickwork of the neighbouring Norman Shaw North building, while the Eternal Flame has been set within a contemplation pool south of the entrance pavilion. We knew this would be an extremely complex project from the start. Our proposals had to address the history and traditions of the Met while delivering a headquarters fit for the present and future organisation. The brief demanded a building that reflects both the prominence of the location and the importance of the Met as an institution, and it has been a privilege to be able to deliver that. Priority’ Richmond School is transformed, thanks to £4.2m Scheme PUPILS and teachers in the London Borough of Richmond are benefiting from a £4.2m transformation of their school after it was deemed to be in poor condition. Leading independent management, design and construction consultancy Pick Everard, along with contractor Bowmer and Kirkland, have completed the design, structural and civil engineering works at The Queen’s Church of England Primary School - after it was prioritised for a brand new school. Work at the school, based in Cumberland Road, Kew, has been completed as part of the Government’s £4.4 billion Priority School Building Programme which is rebuilding or refurbishing those school buildings in the very worst condition across the country. Paul Rothera, director at Pick Everard, said: “The previous building was no longer fit for purpose with poor lighting, insulation and the costs of ongoing maintenance and repair were significant. Therefore, demolition was required and a new stateof-art building was created which is more conducive to high quality learning. “The new school provides a solution where not only do the children and staff benefit from a greatly improved teaching and learning environment, considerable savings have also been made to reduce the ongoing costs of running the school.” The new school has been designed with a

Reception classrooms are located on the ground floor with direct free-flow access to outdoor play areas and learning zones designed specifically for respective key stages. The completed building is designed to reduce heat loss with improved thermal

properties throughout the construction of the building. Water efficient fittings have also been installed to reduce hot and cold water consumption, while daylight is maximised with the use of “daylight dimming” which reduces the need for artificial light. Further environmentally friendly measures include utilising mixed mode ventilation with heat recovery to improve efficiency and eliminate the need to use excessive energy for cooling. The controls are designed on a room by room basis to minimise wasted energy within each space. Ed Sutton, Bowmer & Kirkland associate director, said: “The Queen’s Church of England Primary is one of many schools we have completed, or are currently constructing across the country, for the Education Funding Agency. It is really pleasing to think that Bowmer & Kirkland has been part of the team which has helped to improve the learning environment and future prospects of many young children in the borough of Richmond.” The Education Funding Agency (EFA) manages £54 billion of funding a year to support all state-provided education for 8 million children aged 3 to 16, and 1.6 million young people aged 16 to 19. There are two phases of the Priority School Building Programme, covering a total of 537 schools. Under the first phase of the programme, PSBP1, the first school opened in April 2014, five months earlier than originally programmed. More than 160 schools have opened through the initiative and the majority of the 260 schools in the first phase of the programme will open new or refurbished buildings by the end of 2017, two years earlier than originally planned. Under the second phase of the programme, PSBP2, the EFA plans to have all schools open in their new/refurbished buildings by the end of 2021. The new school is a 2-form entry primary school for 4 -11-year-olds and accommodates 420 children.

Funding boost of £6.2 million for refurbishment of Scotland’s historic towns and cities The latest round of Conservative Area Regeneration Scheme (CARS) funding has been announced and the benefits of it will be going to seven communities across Scotland. The funds of £6.2 million will be split between Rothesay, Cockenzie, Penicuik, Jedburgh, Dunoon, Maybole and Union Street in Aberdeen and will be used to renovate the historic areas and help to attract further investment in the future. The investment was outlined by Alex Paterson, Chief Executive of Historic Environment Scotland (HES), as he visited Falkirk CARS, which is scheduled to be completed in 2018. This is the seventh round of CARS funding, with £42.2 million having been invested by HES (and formerly Historic Scotland) on behalf of the Scottish Government since the first grants were awarded in 2007. When he spoke in Falkirk, HE’s biggest CARS funding award to date at £1.6m, Mr Paterson announced that the progress of the joint Falkirk Townscape Heritage Initiative/CARS has been transformative for the town. He said: “In Scotland’s year of History, Heritage and Archaeology we’re celebrating all the different elements which make up our rich and diverse historic environment. Preserving

the built heritage of our town centres is a hugely important part of this, because investment in our historic environment is key to supporting improved quality of life for many people across Scotland, and it has been great to see this in action today in Falkirk. The council’s aim has been to create a high quality urban environment where people will want to spend their time and money, and the progress they’ve made to date is fantastic. “It’s my pleasure to announce Round 7 today, as this funding will enable seven more communities up and down the country to breathe new life into their historic town and city centres, encouraging further investment, creating new employment opportunities, and boosting the local tourism industry.” Councillor Dennis Goldie, the spokesperson for Economic Development at Falkirk Council commented: “The funding received from Historic Environment Scotland has been a critical component of the joint CARS-THI initiative which is currently running in Falkirk Town Centre. “The restoration of the Steeple, a real local treasure for many people, is nearing completion thanks to nearly £500k spent to conserve this iconic local landmark for the future. “A great many property owners have also benefited from upgrades, improvements and restoration

works to their homes and businesses, with more works still to be carried out.” The overall aim of the Falkirk CARS has been to enhance the physical appearance of the Town Centre and to showcase the things that make it special and unique. This will include the restoration of traditional shop fronts, roof repairs to historic buildings and rehabilitation work to the exterior of the Falkirk Steeple including stone and joinery repairs, repairs to the clock face and timber preservation. The project has also included traditional skills workshops and heritage engagement exhibitions. The CARS funding programme targets conservation areas that are at a social and economic disadvantage which makes it difficult for them to attract investment in sustainable regeneration. The scheme assists these areas by providing funding for opportunities to enhance sustainable economic growth and helps support projects that develop an area’s sense of place. The scheme is open to Local and National Park Authorities, community groups and other third sector organisations experienced in delivering multi-funded projects. Funding can be utilised for a number of purposes from the repair of priority properties and small grants to homeowners and retailers, to providing traditional craft training opportunities.

SimpsonHaugh and ShedKM to revamp Manchester warehouses SimpsonHaugh and Partners and ShedKM are set to transform three Grade II-listed warehouses in Manchester city centre under two multi-million redevelopment schemes Trilogy Property and Peterson Group have appointed Manchester-based SimpsonHaugh to work on their £300 million plans to transform the Great Northern Warehouse - a scheme first masterplanned for the developer by Will Alsop. The building, which currently houses restaurants, shops and leisure facilities including a cinema, will become a residential, commercial and leisure quarter. Interior architecture and design firm Johnson Naylor will work on the interiors, with Altrincham landscape architecture firm Planit IE responsible for the reconfiguration of Great Northern Square. Manchester City Council approved the strategic regeneration framework for the area in February. Alsop’s aLL Design will continue to work on the

More than 80 new homes delivered in Regeneration Project The much anticipated £13 million scheme to transform Leamington Spa’s social housing offering is now complete, thanks to Pick Everard, BM3 Architecture, Willmott Partnership Homes and Scape Group. As the need for more high quality, sustainable homes for the over 55s increases, given an ageing population, the project was important in meeting the requirements of local residents in Lemington Spa.

Buckingham Palace repairs funding approved by MPs Funding for a multimillion-pound refurbishment of Buckingham Palace has been approved by MPs. They backed changes to the Sovereign Grant - the funding formula for the monarchy’s official duties - by 464 votes to 56. The grant will increase by 66% to pay for the £369m refurbishment. Officials say the essential work - set to take 10 years - is needed to avoid the risk of “catastrophic building failure”. Ageing cables, lead pipes, wiring and boilers will be replaced, many for the first time in 60 years, amid fears about potential fire and water damage. Two Labour MPs - Rushanara Ali and Dennis Skinnerwere among those who opposed the move, along with 46 from the SNP. At a time of austerity, this significant increase in the money given to the royals has attracted little public criticism and minimal parliamentary scrutiny. It was very different in the 1990s when the government suggested spending taxpayers’ money on repairs to Windsor Castle after it was damaged by fire. Two decades on, the Sovereign Grant increase has been approved after a committee of MPs considered the matter briefly, and after an overwhelming Commons vote in favour. Next month, the Queen’s funding will rise from £43m to £76m. And it will rise each year, for the next 10 years. The focus now is on appointing consultants and finalising the refurbishment plans. With the builders in for at least a decade, the Queen may be tempted, at times, to replace her crown with a hard hat.

Pick Everard project managed the scheme, delivering 81 quality new homes at the new Sayer Court, which replaced the previous 1960’s building. Work began onsite in May 2015 as Warwick District Council prepared to give its tenants energy efficient ‘Lifetime Homes’ – marking its first housing scheme in more than 30 years. “The modern complex – comprising 76 apartments and five bungalows - has been designed to complement the town, being located on one of the primary routes into and out of Leamington Spa. “There was a collaborative approach to working which became particularly important when faced with issues on-site,” said Adrian. Pick Everard provided project management services, BM3 Architecture completed the designs for the scheme, with construction work completed by Willmott Partnership Homes, which was procured through the Scape Major Works framework.

ABP appoints Britcon for £2.1m project at Kings Lynn Associated British Ports (ABP) has appointed building and civil engineering company Britcon to build a new £2.1 million ‘bulk store’ at its busy port in King’s Lynn. The contract includes the delivery of an 85m by 40m, steel-framed, reinforced concrete building to store dry bulk in four separate bays. Britcon will install internal features such as LED lighting, SPV panels to the roof as well as external yard surfacing. ABP is the UK’s leading ports operator with a network of 21 ports across the UK. In 2015 ABP handled 92 million tonnes of cargo, support 84,000 jobs and contributes £5.6 billion to the UK economy every year. The 97-acre Port of King’s Lynn handles around 500,000 tonnes of good each year comprising dry bulks, forest products, steel and other metals. Britcon will start construction this month and expects to complete the project in July, The contract follows Britcon’s successful bid as main contractor to build a £5 million Marine Control Tower for ABP in Grimsby. The new four storey facility is to replace the existing Vessel Traffic Services centre at Spurn Point, which has become increasingly difficult to access by land because of the progressive deterioration of the peninsula. The project, due to complete in May this year,

Construction Contracts and NonPayment - Suspend or Terminate? Late, partial and non-payment continues to cause serious problems within the construction industry. The Euler Hermes Quarterly Overdue Payments Report, published in March 2016, reported that in 2015 the construction industry suffered a 26% year-on-year rise in the number of payments which were overdue. Johnathan Hyndman, Partner at solicitors Rosling King, looks at the issues to be considered before an unpaid party suspends performance or seeks to terminate following non-payment.

Termination

A statutory right to suspend all or part of an unpaid party’s obligations under a construction contract will arise where payment is late, partially paid or missed completely, without the correct notice procedures being adhered to. In order to suspend performance, the unpaid party must first serve the defaulting payer with written notice of its intention to suspend. This notice must confirm the intention to suspend performance and the grounds for doing so and should also provide at least seven days’ notice before suspension takes place.

The vast majority of construction contracts will contain express provisions allowing the parties to terminate following the occurrence of specific events. These invariably include non-payment and/or where the unpaid party has validly suspended performance following non-payment for a continuous specified period.

Once this procedure has been complied with the unpaid party can treat performance under the construction contract as suspended and will be released from its obligations under the contract until the amount due is paid in full. In addition, the paying party will be liable for the reasonable costs of the unpaid party demobilising and remobilising. The unpaid party will also be entitled to an extension of time under its construction contract equal to the period of suspension. It is fundamental that the unpaid party closely examines the terms of its construction contract before suspending performance to ensure that in exercising its right to suspend, it does not itself repudiate the construction contract. The unpaid party should review any express terms within the contract as to suspension and closely examine the payment provisions within the contract to ensure that the final date for payment has in fact passed. Correspondence received from the paying party must also be reviewed to establish whether an effective payment less notice has been served. The suspending party must also adhere to the notice provisions within the construction contract and pay particular attention as to whether weekends and/or bank holidays are included within the reckoning of days both in relation to determining whether the final date for payment has passed and the notice period required before performance can be suspended.

The issues to be considered by the unpaid party before terminating a construction contract are similar to those which must be considered before any right to suspend performance is exercised – the contractual termination mechanics and notice provisions must be examined and strictly observed and the final date for payment must have passed without a valid pay less notice having been served by the paying party. Most construction contracts provide for a two-stage termination notice procedure with the non-paying party servicing an initial notice specifying the default and, where the default specified in the initial notice is not remedied within the contractual timeframe, a second notice effecting termination. The contractual provisions as to the effects of termination should also be considered before an unpaid party seeks to terminate its employment under a construction contract. The terms of the contract may attempt to exclude compensation for loss of profit and it may therefore be more attractive to the unpaid party to treat the contract as being repudiated at common law and sue for damages for breach of contract. Unpaid parties should, however, bear in mind that the courts will not generally consider failure to pay on time as a repudiatory breach but will instead consider the aggregated effect of a party’s failures to pay at all or on time in assessing whether that party is in repudiatory breach of contract.

Both suspending performance and termination are serious steps to take following non-payment. The most significant risk to the unpaid party in suspending or terminating is a claim from the non-paying party that the unpaid party has, by its actions, itself repudiated the contract by breach. It is therefore imperative that the relevant circumstances giving rise to the unpaid party’s right to suspend or terminate exist and the contractual procedures both closely examined and strictly adhered to before performance is suspended or a construction contract terminated – failure to do so could have severe consequences to the unpaid party.

Work starts on £6m concert hall revamp Construction work is starting on a £6 million project to transform St George’s Bristol into a world-class concert venue. St George’s will re-launch in spring 2018 after a tight one-year build schedule, with a stunning new pavilion-style extension. The registered charity has received funding from Arts Council England, Heritage Lottery Fund (HLF), Bristol City Council, charitable trusts, corporates, major donors and crowdfund supporters. St George’s has just £240,000 still to raise. The extension, designed by award-winning architects Patel Taylor, will feature a multi-purpose spaces for performances, education workshops and venue hire; a café bar, which will be open during the day and evening, and improved access for people with disabilities. There will also be interpretation displays in the Crypt, the extension and gardens, telling long-forgotten stories of St George’s and Georgian Bristol, as well as activities for schools, families and coach groups. Admission to the Crypt will be free of charge and open to visitors, as well as audience members. Befitting a concert hall with some of the best acoustics in the world, the foyer will feature a dramatic glass sculpture designed by Bristolbased artist Luke Jerram. Named ‘Apollo’ after the Ancient Greek God of music, the exquisite structure is made of 100 sponsored roundels. St George’s ‘Building a Sound Future’ project will create exciting new spaces for audience members, artists, families and schoolchildren including its Cosmos Children’s Community Choir. It will also help give the charity a financially sustainable future – especially important at a time when medium-sized music venues are increasingly under threat of closure. The venue is famed for its acoustic, which attracts leading classical, jazz, folk, soul and world music artists. These include the Orchestra of the Age of Enlightenment, percussionist Dame Evelyn Glennie, pianist Paul Lewis, virtuoso violinist Kyung Wha Chung, and contemporary artists Bjork, Cerys Matthews, The Unthanks, Courtney Pine and Omar. Midas moves onto site, following extensive archaeological activity and preparatory ground works. St George’s Bristol will hold concerts from now until the end of May, and from the end of September to Christmas, before the re-launch in spring 2018. The average British worker spends as many as 120 hours per year using their smartphones in the workplace, and those working in construction are among the worst culprits, according to research. Research of 2,012 UK adults has revealed more than three quarters (78%) of construction workers admit to using their smartphones during working hours. 78% regularly respond to personal text messages during working hours, and 59% regularly take personal phone calls whilst working. 52% admit to answering instant messages via platforms such as Whatsapp and Facebook, whilst 9% have sent a Snapchat from their workplace. 44% of respondents said their workplace permitted reasonable use of smartphones. More than a third (38%) regularly check their social media accounts while in the workplace.

Construction figures on the increase across February Spearheaded by strong performances from the housing and hotel, leisure & sport sectors, overall contract value for the construction industry in February reached £6.4 billion based on a three month rolling average, a 15.4 per cent increase on the same month last year. According to the latest edition of the Economic & Construction Market Review from industry analysts Barbour ABI, contracts for housing projects reached £2.7 billion in February, the same figure as January 2017, which are the best performing months for residential building since the economic downturn. Coinciding with the strong housing figures, the hotel, leisure & sport sector construction contracts reached £736 million (see figure 1.1) on the month, a substantial 105.3 per cent increase compared to February 2016. Looking across the other sectors within construction; Infrastructure accounted for £1.48 billion worth of construction contracts on the month, a 20.8 per cent increase on January. Commercial & retail projects also increased month on month by 17.5 per cent – the highest since September 2016, although values in the sector remain lower than previously when viewed over the longer term. More than 80 New Homes delivered in Regeneration Project The much anticipated £13 million scheme to transform Leamington Spa’s social housing offering is now complete, thanks to Pick Everard, BM3 Architecture, Willmott Partnership Homes and Scape Group. As the need for more high quality, sustainable homes for the over 55s increases, given an ageing population, the project was important in meeting the requirements of local residents in Lemington Spa. Pick Everard project managed the scheme, delivering 81 quality new homes at the new Sayer Court, which replaced the previous 1960’s building. Work began onsite in May 2015 as Warwick District Council prepared to give its tenants energy efficient ‘Lifetime Homes’ – marking its first housing scheme in more than 30 years. Adrian Ceney, national director at property, construction and infrastructure consultancy Pick Everard, said: “The previous development only had provision for 29 homes so the new Sayer Court has completely transformed the site and is already at full capacity. “The modern complex – comprising 76 apartments and five bungalows - has been designed to complement the town, being located on one of the primary routes into and out of Leamington Spa. “There was a collaborative approach to working which became particularly important when faced with issues on-site,” said Adrian. Pick Everard provided project management services, BM3 Architecture completed the designs for the scheme, with construction work completed by Willmott Partnership Homes, which was procured through the Scape Major Works framework. CA Roofing Services, along with CA Group’s specialist cladding division SCS, has announced completion of work on phase one of the £140m Rushden Lakes development in the Nene Valley, Northamptonshire. The retail, leisure and tourism destination, when complete, will include a 14-screen cinema, cycle hire, indoor trampoline and climbing facility as well as restaurants and access to some of the UK’s biggest high street shopping brands. The construction sector saw a 4%1 increase in the number of SMEs from 2010 according to the latest study from specialist challenger bank Hampshire Trust Bank. The research conducted in partnership with the Centre for Economics and Business Research (CEBR), reveals the three sectors which demonstrated the highest growth were technical and professional (39%), information and communication (33%) and business services (25%). Looking at the UK as a whole, there has been a 17% rise in the number of SMEs from 2010. From its experience of working with SME housebuilders, Hampshire Trust Bank attributes the lower levels of SME growth to the high number

However these two sectors attributed financial concerns as barriers to growth in their industries which may deter start-ups in the sectors.
