Zillow Says it’s Acquiring Transaction Tool dotloop SEATTLE and CINCINNATI – July 23, 2015 – Zillow Group announced it entered into a definitive agreement to buy dotloop, a Cincinnati-based company that operates a paperless, online transaction management tool. In a release announcing the acquisition, Zillow said it would make the technology "more readily available" to its "broker partners and the agents they represent, as well as our approximately 100,000 real estate agent advertisers." "One of the primary reasons we're acquiring dotloop is we think the value dotloop provides to brokers is significant," Zillow CEO Spencer Rascoff told Inman News. He said Zillow will be "looking for ways to use dotloop to further improve the value proposition that Zillow Group can provide." DotLoop was founded in 2009 and has 124 employees at its Cincinnati headquarters and office in San Francisco. The company previously raised $14 million in funding from Trinity Ventures and angel investors. Dotloop says almost 500,000 users signed real estate docs through the transaction platform each month. No‐money‐down Green Upgrades Paid Via Property Taxes TALLAHASSEE, Fla. – July 23, 2015 – Under the Florida Property Assessed Clean Energy (PACE) program, homeowners can pay for energy-efficient upgrades with no money down and relatively low interest rates, currently 6.5 to 7.5 percent. Homeowners then pay off the loan in installments as part of their personal property tax bill. The Florida Legislature created the program in 2010 to help owners make the move to energy efficient products, such as solar energy, windows, doors, air-conditioning units or wind mitigation improvements, such as new roofs. The product must be attached to the house, so appliances don't qualify. To date, 13 counties have signed onto the program along with a number of cities. In general, an energy-efficient upgrade can be paid off over its expected life, but the owner could opt for a shorter timeframe if preferred. Since the loan is paid through a homeowner's property tax bill, any remaining payments for the energy upgrade can be passed off to the next homebuyer, though a seller has the option to pay it off at the time of sale. Under the Florida PACE law, a seller must disclose the existence of any remaining debt, though a record of it will also appear in county tax records. The program works for both residential homeowners and commercial projects, but some of the details, such as interest rates, vary. "The program comes at no cost to local governments," says Jonathan Schaefer, program manager for the Florida PACE Funding Agency. He says it can be adopted by either county or city governments. While authorized by the Florida Legislature, the PACE program doesn't rely on tax money. It's funded and operated privately by agencies, such as the Orlando-based Florida PACE Funding Agency. Florida PACE Funding Agency Contractor Kirk Francis told The Orlando Sentinel that he sees one big benefit to the program: "A lot of folks don't have the money laying around to make these (energy upgrades). If it's secured by the property, even people who don't have strong credit can possibly qualify." Highlights from July’s Military Tribute CPAR’S July General Membership Meeting was a tribute to America and its veterans. CPAR members brought in artifacts from their own or their relative’s time in the military and shared their stories. It was educational, emotional and a great way to celebrate our history. Keller Williams agent Gregory Dodson spoke about his two deployments with the US Marine Corps and urged those present to thank not him, but those who made the ultimate sacrifice and didn’t return home.

Existing‐Home Sales Rise in June as Home Prices Surpass July 2006 Peak WASHINGTON (July 22, 2015) — Existing-home sales increased in June to their highest pace in over eight years, while the cumulative effect of rising demand and limited supply helped push the national median sales price to an all-time high, according to the National Association of Realtors®. All major regions experienced sales gains in June and have now risen above year-over-year levels for six consecutive months. Total existing-home sales1, which are completed transactions that include single-family homes, townhomes, condominiums and co-ops, increased 3.2 percent to a seasonally adjusted annual rate of 5.49 million in June from a downwardly revised 5.32 million in May. Sales are now at their highest pace since February 2007 (5.79 million), have increased year-over-year for nine consecutive months and are 9.6 percent above a year ago (5.01 million). Lawrence Yun, NAR chief economist, says backed by June's solid gain in closings, this year's spring buying season has been the strongest since the downturn. "Buyers have come back in force, leading to the strongest past two months in sales since early 2007," he said. "This wave of demand is being fueled by a year-plus of steady job growth and an improving economy that's giving more households the financial wherewithal and incentive to buy." Adds Yun, "June sales were also likely propelled by the spring's initial phase of rising mortgage rates, which usually prods some prospective buyers to buy now rather than wait until later when borrowing costs could be higher." The median existing-home price2 for all housing types in June was $236,400, which is 6.5 percent above June 2014 and surpasses the peak median sales price set in July 2006 ($230,400). June's price increase also marks the 40th consecutive month of year-over-year gains. Total housing inventory3 at the end of June inched 0.9 percent to 2.30 million existing homes available for sale, and is 0.4 percent higher than a year ago (2.29 million). Unsold inventory is at a 5.0-month supply at the current sales pace, down from 5.1 months in May. "Limited inventory amidst strong demand continues to push home prices higher, leading to declining affordability for prospective buyers," said Yun. "Local officials in recent years have rightly authorized permits for new apartment construction, but more needs to be done for condominiums and single-family homes." The percent share of first-time buyers fell to 30 percent in June from 32 percent in May, but remained at or above 30 percent for the fourth consecutive month. A year ago, first-time buyers represented 28 percent of all buyers. According to Freddie Mac, the average commitment rate for a 30-year, conventional, fixed-rate mortgage rose in June to 3.98 from 3.84 percent in May, but remained just below 4.00 percent for the seventh straight month. Properties typically stayed on the market for 34 days in June, down from May (40 days) and the shortest time since NAR began tracking in May 2011. Short sales were on the market the longest at a median of 129 days in June, while foreclosures sold in 39 days and non-distressed homes took 33 days. Forty-seven percent of homes sold in June were on the market for less than a month — the highest percentage since June 2013 (also 47 percent). NAR President Chris Polychron, executive broker with 1st Choice Realty in Hot Springs, Ark., says Realtors® are reporting drastic imbalances of supply in relation to demand in many metro areas — especially in the West. "The demand for buying has really heated up this summer, leading to multiple bidders and homes selling at or above asking price4," he said. "Furthermore, tight inventory conditions are being exacerbated by the fact that some homeowners are hesitant to sell because they're not optimistic they'll have adequate time to find an affordable property to move into." Matching the lowest share since December 2009, all-cash sales were 22 percent of transactions in June, down from 24 percent in May and 32 percent a year ago. Individual investors, who account for many cash sales, purchased 12 percent of homes in June (14 percent in May) — the lowest since August 2014 (also 12 percent) and down from 16 percent in June 2014. NAR and Move Win Patent Case on Appeal Read the court's decision: Move, Inc. v. Real Estate Alliance Ltd., No. 2014-1657, 2015 WL 4257797 (Fed. Cir. July 15, 2015) In a long running legal battle over patent infringement allegations, the Federal Circuit Court of Appeals affirmed a California federal court’s decision that Move, Inc.’s (“Move”) websites, including REALTOR®.com, do not infringe Real Estate Alliance, Ltd.’s (REAL) patent. Move operates a number of real estate websites, including REALTOR®.com (owned by the National Association of REALTORS®). In 2007, Move brought a lawsuit against REAL seeking a declaratory judgment that its websites do not infringe REAL’s patents, which allegedly cover a process for locating properties on a map via a computer. REAL filed a countersuit and named a wide variety of defendants across the real estate industry. The trial court entered judgment that Move did not infringe REAL’s patents. REAL appealed the ruling, however, and the United States Court of Appeals for the Federal Circuit vacated the trial court’s decision based on improper claim construction for one of the patents. The case was remanded to the trial court, and both parties filed for summary judgment. Using the claim construction ordered by the Federal Circuit, the trial court again found that Move’s websites did not infringe REAL’s patent. REAL appealed, and the Federal Circuit affirmed the trial court’s decision, upholding the finding that Move’s websites did not infringe REAL’s patent. Claim construction is the term of art describing the process courts use to construe the claims of a patent in order to give them meaning. The claim construction is compared to the allegedly infringing device or method to determine infringement or to prior art to determine validity. The trial court originally construed REAL’s patent to require a website user to choose “a geographic area of interest by causing a boundary to be superimposed over the displayed map using [a] selection curser [sic].” In its review of the trial court’s claim construction, the Federal Circuit instead interpreted REAL’s patent to require “selecting an area” and not “defining an area.” In other words, the boundaries of the selected area do not have to be created in any specific manner. Furthermore, the Federal Circuit found that either a human user or a computer could perform the “selecting.” Using the Federal Circuit’s claim construction, Move argued on summary judgment that its websites do not infringe REAL’s patent. Move submitted its websites do not select an area because only the user may do so via clicking on an area of a map, a point in a map, a zoom bar, or a name in a drop-down menu. In sum, the user does the selecting and Move’s websites merely respond by gathering information. As a result, Move’s websites do not perform the steps set forth in REAL’s patent. The trial court agreed with Move’s position. REAL argued in its summary judgment motion that a user of Move’s websites only inputs information but the websites ended up selecting the geographic boundaries. The trial court rejected this position. Instead, the trial court found that there are specific geographic boundaries for zip codes and towns/cities, so the boundaries were not selected by Move’s websites. Similarly, zooming in or out was a user function. Thus, the websites did not select the geographic area as described by REAL’s patent, and the trial court found in favor of Move on summary judgment. REAL appealed in March 2012. The Federal Circuit Court of Appeals affirmed the trial court’s decision on July 15, 2015. An affirmed decision by a Court of Appeals means the Court finds the trial court’s decision is correct and will therefore stand as rendered by the trial court. Move, Inc. v.
