PROBATE: TWO TYPES OF SALES

An Executor should understand that there are two types of probate sales.
Why Choose Us?
A Court-Confirmed Probate Sale. This is more time-consuming and complicated because the sale requires a court appraisal and court approval.
We conduct an interior inspection of the property and complete a Broker Price Opinion report (appraisal) which documents the property’s deferred maintenance that may affect value. This report, along with photos, is provided to the attorney to assist the probate referee in determining an accurate value for the property. This can save 2-3 weeks of adjusting a value that is inconsistent with the condition of the property.
An Independent Administration Probate Sale. This is less complicated and closer to a traditional real estate transaction because the sale does not require court confirmation.

The Estate is not responsible for complying with California’s Real Property Transfer Disclosure laws. However, Executors, Administrators and REALTORS® have an obligation to disclose known defects to buyers.
With a traditional sale, sellers represent to the best of their knowledge that the electrical, plumbing, heating, sewer system, built-in appliances, roof and all other fixtures and equipment are in working order. Furthermore, the seller is liable to maintain the property until possession is delivered to the buyer. In accordance with California law, probate property is offered “As-Is,” without representation, warranty or covenant of any kind, implied or expressed.
We offer you a full range of referral services including: • Painters, plumbers, electricians, etc. • Contractors • Clean up and hauling services • Appraisers
• Estate Liquidation Services • Eviction services • Pest inspectors • Movers

Inspectors The Estate is not obligated to inspect the property or to provide reports such as structural, pest control, contractors, or roof reports. Buyers make an offer based on their own physical inspection and not on any representation of the seller or seller’s agent.
“As-Is” Sale An “As-Is” sale assumes that the Executor or Administrator has not investigated the condition of the property. Buyers may choose, at their expense, to conduct their own investigation of the property’s condition.
No Franchise Tax Non-resident beneficiaries of California real property can avoid paying the Franchise Tax (3⅓% of sales price) provided they do not take direct distribution of funds and the deceased had a California Homeowners Property Tax Exemption. Consult your attorney.
