Devonshire Homes received the green light this month from the Department of Local Government and Communities for a £4m slice of the £525m Builders Finance Fund, which will allow it to kick-start building in Tiverton, Cullompton and Axminster. An additional £1bn is being spent through the Large Sites Infrastructure Programme for large-scale developments.

IF you’re buying a property you want to alter or extend and this is dependent on getting permission, you could be in for a nasty surprise. Last year, the Department for Communities and Local Government changed the law (for three years) to make it easier to build extensions. Permitted development rights (where planning permission isn’t required) for single-storey rear extensions have increased from 3m to 6m for attached houses and from 4m to 8m for detached ones (some houses are exempt). Sounds good? Well, yes and no. Because unlike normal permitted development, the neighbour on either side, and at the back, is given the chance to object. If they do, the local council will decide if work can go ahead, but, it seems, councils aren’t necessarily as keen on new extensions as the Government. We recently applied to do a 4.5m extension under these rules. A few weeks ago, our local authority wrote to confirm that no one had objected so we could proceed. But then the next week they decided that our adjoining neighbour had, in fact, objected and they were upholding his objection, so permission was suddenly refused. As our adjoining neighbour has a road on the other side of him, his unextended house can’t be trapped in a dark ‘tunnel’ between two extensions. We bought this house after being forced out of our previous home by neighbours from hell doesn’t have an extension, with perhaps 4m on the other side, where that neighbour has extended by 4m. A decision like this can throw your plans into disarray and saddle you with a compromised layout. We bought this house after being forced out of our previous home, a flat, by neighbours from hell. One of the reasons we bought the flat was to convert the large cellar, as others in the street have done. After we’d secured planning permission (second time around) and were several months into the project, the owners of the other flat in the building, Janice and Ken (not their real names), decided to stop us. Their party wall surveyor – who we had to pay for – claimed that Janice and Ken, who own the freehold to the house jointly with us, also own half the soil under it and wouldn’t allow us to dig down to increase the cellar’s height. Janice and Ken later told us that they wouldn’t accept any sum of money for their 30cm or so of soil – they only wanted to stop us adding value to our home in case we sold it. Not wanting a court battle, we abandoned the cellar conversion in favour of just rejigging the flat’s layout, but Janice and Ken have been fighting us over this for almost a year. Although the law is firmly on our side, these poisonous people and
their slippery solicitor – who, again, we have to pay for – have got away with flouting it. Ownership of the soil under the house was a grey area, although it usually belongs to the freeholder/s. Often you can get space you don’t own valued by a surveyor and then pay the freeholder/s for it. This commonly happens with lofts – the owner of the (leasehold) top-floor flat may want to convert the loft but finds that it’s owned by the freeholder. Altering our flat’s layout is different, as we’re not increasing the size of it. Because our flat is
leasehold, we need the permission of the freeholder – us, Janice and Ken – to alter it, because this is what the lease says. The lease also says, as most do, that permission can’t be unreasonably withheld. The issue of what’s reasonable is crucial. Normally, agreeing a licence to alter (a legal document granting permission) would take a month or two – the courts view more than about five months as unreasonable. However, Janice and Ken took months just to get a solicitor, who then played stalling games for them. I’ve heard of freeholders refusing
leaseholders permission to make alterations, or asking money to grant permission, but not cofreeholders. I’ve also made offers on flats for sale on condition that the freeholder approves my planned alterations. When the freeholder proved difficult, I had to pull out. If you’re buying a leasehold property, you’re unlikely to come across people as unreasonable and spiteful as Janice and Ken, but if there are two flats in the building and the freehold is split jointly between them, I’d avoid it like the plague!

Cathedral bells chimed as runners assembled for Wave 2 and with the Lord Mayor now well into his race, the starter’s flag was waved by Cllr Simon Cook accompanied by the Lady Mayoress and veteran local Olympian Nick Rose. Sarah Piercy the only elite wheelchair athlete to take part, finished in 1.15.30 and the Lord Mayor clocked 2.01.11. The money Robin is raising is on behalf of The Pituitary Foundation, Bradley’s official charity for 2014. Many people may not have heard of this devastating condition or the impact it can have on everyday life. Robin will be setting his sights on his final challenge by running in his final half marathon, Exeter’s Great West Run, on Sunday October 19. Chronicles of a Devon barn conversion FIFTEEN months ago Peter and Christine Stafford sold their converted barn in Lancashire and set off on an exciting journey to start a new life in Devon. In convoy behind the removal truck, Peter, towing the caravan which was to be their home for the next ten months, had Solstice and Tara, their two border terriers as travel companions while Chris followed in the horsebox with their two horses and 15 chickens. In the three years it had taken to find a buyer for the barn they had converted in the recession-hit cotton mill town of Bacup, high in the Pennine Hills of East Lancashire, Peter and Chris had not been idle. Some years ago the two chartered surveyors (now retired from RICS), Peter a building surveyor with a Masters in building and heritage conservation and Chris a general practice surveyor, had decided to swap their mainly office-based life for one less ordinary. The South West was an easy choice, but pinpointing an ideal location in this beautiful corner of the country was rather more difficult. Newspapers and magazines gave clues as to suitable locations, and a few fact-finding trips narrowed the search to the east of the moors. Many hours spent on property websites led to a chance encounter. Not what they had originally had in mind, Peter, Chris, and Peter’s son Robin arranged to view the barns at Aller Cross in 2009, lot three of three in a dispersal sale comprising house, cottage and dilapidated medieval listed barns that once formed part of a farm holding of more than 600 acres. A bid was accepted and the long conveyancing process began. Twelve months later and many complications resolved, the barns were bought. Friends thought this was a risky venture as the barns did not have planning permission for any other use, but Peter and Chris were undaunted. An application was eventually successful with the help and tenacity of their planning consultant. Mid Devon District Council granted planning permission and listed building consent for the conversion of the Grade II listed barns into two dwellings. This happily coincided with the sale of their barn in Lancashire, and Peter and Chris moved into their caravan, and picked up the tools. “The conversion of the Linhay was to be a hands-on, self-build project” Chris explains. “We always had a schedule of works from drains to roof and during the planning stages worked with the conservation officer to bring out the best features of the buildings, but each stage has been rewarding, seeing the transformation of a dilapidated, neglected, agricultural building to stunning and unique accommodation has been immensely satisfying. There were some things which seemed a little odd at the time, like when we had to install the Hunter fire so the flue could be fitted in the roof, even though we didn’t have doors,
windows or even the first floor in, but the fire was very welcome during the winter, and we even had mulled wine and mice pies with the contractors before the Christmas holiday. While caravan life with two dogs, working on the barn by day and into the evening sourcing and ordering materials was tough, the rewards of living in such a beautiful county, surrounded by superb countryside and so close to the coast, beaches and walks has made it all worthwhile. We love living in Devon, and have loved making such a wonderful place out of a redundant shell. Will we be sad to sell? Yes, but keen to do it all again”.
