Legal Processes Covered By Case Management and Support
Case management and support is used to manage civil cases in all aspects of civil law, orchestrating a variety of different processes including: •
Supporting negotiations between the parties, including pre-trial resolution; ongoing negotiations; pre-trial settlement of disputes; and preparing and reviewing legal expert opinions and civil lawsuit materials
•
Preparing and filing procedural documents, including lawsuits; objections or statements of defense; complaints against action or inaction of a judge; various statements and motions with regard to the lawsuit; amicable settlement; and appeals against rulings, decisions or sentences
The overarching aim of case management and civil practice and procedure rules is to ensure the just resolution of disputes in ac-
cordance with the law – as expeditiously, efficiently and inexpensively as possible – by ensuring that there are: •
Fewer issues in contest
•
Any issues raised receive no greater investigation than justice requires
•
Minimal interlocutory applications, including only those that are absolutely necessary for the efficient and just disposition of lawsuits
Case management is a system where the court imposes strict timeframes for each procedural step, providing opportunities for settlement and consolidation of issues to streamline proceedings and ensuring trial resources are only used where needed most.
