President's Message

President of Master Builders Association of the ACT, John Haskins AM I write this article as the new President. As we know, outgoing President, Simon Butt, is heading off to New Zealand to oversee Manteena’s operations out of Christchurch. I would like to take this opportunity to thank the members of the executive committee and the Peak Council who have endorsed me to take over as President as the organisation manages the change and succession planning needed in responding to Simon’s sudden departure.

One thing I do want members to know is that despite not being directly involved with Master Builders ACT for a considerable period of time, I have retained very strong links with the industry since I last occupied this position. I chaired the LDA ACT for several years, and currently serve as a director of CBUS. I am more than ready to assist the industry in fighting for the things that are important. A more stable industrial environment, government and a bureaucracy really listening to industry rather than pretending to consult and

the health of a nation. For the industry to help in the country’s recovery post GFC and from weakened confidence levels, the next government must be a willing collaborator with the industry. Half-hearted measures and platitudinal rhetoric is just not going to cut it. It is very important to recognise the outstanding work of Simon. He has been a member of the Master Builders ACT executive committee and a director of MBA Group Training for around six years. Simon’s commitment and contribution to the broader industry through his involvement with Master Builders ACT should not be understated. The respect he has garnered in the ACT and across the country through his work with MBA Australia is immense. For the time being, the local industry has lost an inspirational and thoughtful leader and we certainly hope it is not for long before we see Simon back in Canberra. Having said that, it is also important to wish Simon and Sue all the best in their new life and we trust that is a successful and happy time for them.

Now that the Federal election has been called for September 7, we need to work hard to get the strongest messages possible to all political aspirants. Later in this publication you will see how local candidates have responded to a series of questions put to them on how they will support our industry. If there is one thing that everyone wants to see following this contest, it is far greater confidence. A new government must engender a lot more certainty about our short, medium and long term future. The Master Builders movement is building its election lobbying around the theme Strong Building – Strong Economy. The country needs our industry as activity from the mining sector declines from the peaks reached over the past few years. Building and construction remains the most reliable barometer of

just how important this industry is to the city and the region. There are just a couple of weeks to go before we know where we might be headed. We need to use every moment of that time trying to influence those who can make a difference. I conclude by again acknowledging those who have entrusted me with this role and I look forward to doing all within my power to make sure the industry and our members get the best deal out of those who make the decisions that impact on the way in which we do our business.

Executive Director of Master Builders Association of the ACT, John Miller As the debate over Light Rail, or Capital Metro in project sales parlance, heats up, surely now is precisely the right time to shine a light on that other big transport elephant in the room? For so long, untouchable and sacrosanct by virtue of alliances preventing reasonable discourse or disclosure about the operation, the future of ACTION buses has been merely an old chestnut rolled out when a distraction is needed or other topics have become ho hum. Not for one minute longer should ACTION be off the table as we debate our future transport arrangements. In considering cost savings and delivery options for our new toy, especially when the ACT Government and the Greens are adamant that we are going to have Light Rail or

the unions have such a foothold. They are not going to allow it. If we really want Light Rail, and we seem to be told we do (just like we wanted self-government), an option of divesting ourselves of some of the ACTION costs has to be explored. What government, especially one with a small cloth trying to cut a deal on big ideas, wouldn’t entertain some consideration of offsetting its future losses with some countervailing gains elsewhere in its budget? Claw back a good wad of the $100m of annual losses, a quick boost into the coffers from a deal with well negotiated and community minded conditions, and perhaps Light Rail becomes less difficult to sell and a damned sight easier to deliver.

on just one project. When is the right time to deliver this project? Surely that question needs to be answered by the ACT Government in a full and frank disclosure to the whole community and in a way that everyone understands what they’re being told. This is a critical period of time for the taxpayers of the ACT. We are witnessing the incredible escalation of costs in health care and education, both eating substantially into a very small ACT budget. We want (or are told we want) Light Rail and we want buses. We want a big public service, lots of police, good roads, nature parks, theatres, sporting facilities and bike paths, and the very best of everything else. The one thing we want more of to deal with all of this is money. And for that reason,

It doesn’t take a lot of imagination to guess how the local unions might respond, and no doubt the posturing to prevent any real debate will be swift. Capital Metro, the broader community must confront reality. The current cost (deficit) of the “community social benefit” delivered by our public transport system is around $100 million per annum. That’s about $700 per household in the Territory. The early figure floated for the first stage of a Light Rail system in the Territory was in the quantum of $660m and three quarters of a billion wouldn’t be out of the question when you throw in a few changes. Whatever the delivery method, be it fully ACT taxpayer financed or a Public Private Partnership (PPP), there will be a further decent hit on the ACT purse strings over and above the losses already incurred by ACTION. And there is no way that those Light Rail losses will be mitigated by any substantial reductions in costs associated with ACTION’s future delivery. Naturally, some will try and sell the reduced costs line. It just doesn’t happen in delivery of government services and especially where 8

The bottom line however is that other jurisdictions have had longstanding, efficient and effective private sector delivery of commuter bus services. There will be some in the community who will oppose a private delivery model purely on ideological grounds. The real debate belongs with tens of thousands of taxpayers who will get sidelined or drowned out of the discussions. In an ideal world, Light Rail would seem a most appropriate project. Is the ideal world a population of around 375,000, a very limited capital works budget and some potential on major corridors? We can’t find enough in the current budget to repair existing infrastructure and we find ourselves faced with huge costs

the whole debate around ACTION must now get the full airing it needs if we want the transport infrastructure of tomorrow. I close this column by welcoming our new President, John Haskins and acknowledging the wonderful contribution made by Simon Butt. Simon has moved to New Zealand where he will be overseeing Manteena’s operations in that country. It was most unfortunate that we lost Simon so early in his role of President of MBA-ACT after serving on the Executive Committee for a number of years. We hope to see him back at some stage but in the meantime wish him and Sue all the best across the ditch. In stepping into the role of President, John Haskins brings lots of industry experience as a previous President of MBA-ACT and Master Builders Australia. We are very fortunate to have someone of John’s experience and industry knowledge to help us transition through Simon’s departure.

‘Job security’ clauses in enterprise agreements and their enforceability under the Fair Work Act. The Construction, Forestry, Mining and Energy Union (CFMEU) often attempts to ‘cascade’ the terms and conditions of its template enterprise bargaining agreement (EBA) onto subcontractors, via the use of so-called ‘job-security’ or ‘subcontractor’ clauses in builder’s EBAs, in effect using them as ‘site rates’ provisions. It is crucial that members which are signatory to an EBA, considering entering into EBA, or working on sites controlled by principals with an EBA, thoroughly understand that subcontractor provisions often have limited enforceability under the Fair Work Act 2009 (Cth) (Fair Work Act).

9.1 The Company recognises that in certain circumstances the use of contractors and labour hire may affect the job security of Employees covered by this agreement.

9.4 Where there is need for supplementary labour to meet temporary/peak work requirements, such labour may be accessed from bona fide labour hire companies following consultation with the Company Consultative Committee and/ or workplace delegate. If labour hire is to be used the company shall ensure that any workers engaged through a supplementary/labour hire arrangement and who are under the direction and control of the company performing work that, had it been done by direct employees of the Company would have been covered by this Agreement, shall receive wages, allowances and conditions not less than those contained in this Agreement.

‘Permitted matters’ under the Fair Work Act

.2 If the Company wishes to engage 9 independent contractors to perform work that might be performed by current or future Employees under this agreement, the Company must first consult in good faith with potentially affected Employees and their Union.

Clause 9.3 is the essential part of the provision extracted above. It appears to state that subcontractors (and their employees) must receive the same wages and conditions as those set out in the EBA. Such clauses are broadly lawful, being about ‘permitted matters’ under section 172 of the Fair Work Act. The Fair Work Act requires that clauses in an EBA must generally relate to the ‘employment relationship’ (or the employerunion relationship) in order to be ‘permitted’ and therefore enforceable under the Fair Work Act. 1

they were engaged as Employees under this agreement performing the same work. The use of sham sub-contracting arrangements would constitute a breach of this agreement. [emphasis added]

by shielding them from the threat of cheap contract labour 4. Some decisions on contractor clauses While job-security provisions may be broadly lawful, their scope is often much more limited that the CFMEU would have members believe. There have been recent stoushes in the Fair Work Commission (FWC) about whether the broad scope of some job security clauses could take them beyond the ambit of permitted matters, which would mean that they were unenforceable, see: •

CFMEU v Brookfield Multiplex Constructions Pty Ltd 5: in this case it was held that a subcontractor clause linked to award classifications was so broad that it was unrelated to the ‘job security’ of the employees to whom the enterprise agreement would apply, and so was held not to be about permitted matters (note that an appeal by the CFMEU was withdrawn);

CFMEU v Lend Lease Project Management and Construction (Australia) Pty Limited 6 : this is a contrasting decision in which it was held that a subcontractor clause linked to award classifications could be about permitted matters on a ‘just-in-case’ basis, i.e. to anticipate expansions in the new roles that might offered by the employer.

Application at law Despite the apparently conflicting decisions summarised above, it is arguable that implicit in both is the following principle: a subcontractor clause will only be enforceable against an EBA-signatory principal/employer in relation to third parties such as subcontractors, where the subcontracted work could conceivably be performed by current or future employees of that employer/principal. In other words, the job security of the employees to whom the EBA applies must actually be threatened, which is impossible if the subcontracted labour performs tasks wholly different from those undertaken (or


likely to be undertaken) by the EBA-signatory employer’s/principal’s employees. If job-security is not an issue, then provisions such a clause 9 cannot be said to ‘pertain’ to the employer/employee relationship as required the Fair Work Act, which would render it of no effect, as noted above 7. Accordingly, a consideration of the particular business’ employment structure is required to determine the scope of any subcontractor clause. By way of example, if a painting firm signs an EBA with a provision such as clause 9 and then engages painting subcontractors, clearly clause 9 would operate to protect the job security of the employer’s/principal’s employees, by mandating pay and conditions parity for the subcontractor’s workers. As the EBA is only enforceable against the parties to the EBA (i.e. the employer, its employees and the union) but not directly against subcontractors, the employer/principal would be required to extract a guarantee from the subcontractor that it would meet the terms and conditions of the EBA prior to the subcontractor’s engagement, which is likely to affect the subcontractor’s quote 8. Consultation with the union would also be required. 9 However, if a builder were to agree to a subcontractor clause (such as clause 9) because most principals often have a limited workforce (generally skilled labourers, with little realistic view of expansion of the workforce into other roles) the subcontractor clause would have almost no effect. Because the job security clause would only apply to subcontractors that did the same or similar work to that performed by the principal’s direct employees, it would generally only apply to subcontracted labourers (which would generally raise issues of ‘sham contracting’ 10 unless provided on a labour hire basis). The subcontractor clause certainly would not apply to all work subcontracted by the builder, i.e. it would not operate as a kind of ‘site rates’ clause. Of course, the kind of work performed by a builder will have to be examined on a case-by-case basis, to determine whether subcontractors perform the same kind of work as the builder’s employees.

Application in practice However, even if the scope of job-security provision may be limited at law, such legal niceties are often lost on subcontractors when confronted by a union official on-site, who often misrepresent that provisions such as clause 9 apply much more broadly (as indeed they often read). Typically, the union will argue that such provisions require all subcontractors that fall within the classification structure of the EBA to pay their employees at EBA rates. The CFMEU has been very effective at signing up subcontractors to union EBA’s (or at least enforcing ‘site rates’) by reliance on provisions such as clause 9, which will usually push-up charge-out rates to principals.

Building Code 2013 and adverse action under the Fair Work Act As members tendering for Commonwealth-funded work would know, the Building Code 2013 (Code) prohibits contractors from requiring or unduly influencing a subcontractor to have a union EBA in place, and otherwise exhorts members to respect freedom of association (including the freedom not to associate). Strictly speaking, job-security clauses do not require principals to ensure that subcontractors have union EBAs, only that the subcontractor pay EBA rates to its employees (where job-security is in fact an issue) which can be done under a common law contract or an individual flexibility arrangement. Any EBA approved by the FWC will also be automatically deemed to be Code compliant (unless it does not provide for arbitration by the FWC). Members should of course always be aware that it is unlawful to award contracts on the basis of whether a subcontractor does or does not have not have a union EBA, as this would be ‘adverse action’ under sections 340 and 354 of the Fair Work Act and punishable by fines of up to $51,000 per breach. Members should feel free to call Master Builders on 02 6247 2099 if they have any particular questions about job-security clauses or seek assistance in negotiating an EBA.

Sham contracting can be punishable by fines of up to $51,000 per breach, and leave employers exposed to back-pay for entitlements such as annual leave and superannuation. Generally speaking, the distinction between a contractor and an employee at law is as follows. An employee works under a contract of personal service and so must perform [PTO] any lawful and reasonable task requested by the employer (within their broad ‘job description). Crucially, they are able to be subject to the employer’s control in how they carry out those tasks. By contrast, a subcontractor works under a contract for services, usually for a set of specific tasks, which they may perform themselves or subcontract to others and complete in any way they please, as long as the result meets the standards required by the contract. A subcontractor must in effect be running their own business. The Government is to be commended for its support to date and encouraged to increase its direct support to these Institutions and inter-alia the wellbeing of the Economy.

Master Builders ACT to lead the way in creating Drug-Safe Workplaces! With the recent changes to the IR landscape and the current rewriting of the OH&S legislation (well overdue) by the current Federal Government, business leaders need to be alarmed by, and alerted to issues such as “ derivative liability”. Namely, responsibility for the actions of staff at all levels. And when it comes to “drug related“ incidents or fatalities we bring a whole new world of death defying acts into the circus tent. Actually, using the circus is a good analogy. Can you imagine any performer in a circus being under the influence of performance inhibiting drugs? Not a chance! The balance of the high wire and the split second timing of the high flying trapeze artist are paramount to their performance and more importantly, their safety, not forgetting the audience either. Interestingly, performers within many Australian construction sites face similar “death defying” moments on a regular basis, yet think nothing of working with ”clowns” who have been binge drinking, “partying” all weekend, smoking dope or possibly all three. HOW BAD IS THE ALCOHOL AND OTHER DRUG PROBLEM?

WHAT DO WE NEED TO DO FIRST AS AN INDUSTRY GROUP?

It’s bad! There’s no denying it! Particularly with the rise of synthetic drugs and “ICE” which has come as a natural extension of the “ecstasy party” era.

Educate ourselves! Too few of us actually understand what drugs are, their relationship to each other and how they affect our workers. On 14 October, Master Builders ACT will be conducting an alcohol and drug workshop in their training rooms in Canberra. We intend to give all attendees a complete understanding of the drugs in the work environment and ways to manage them through a simple but comprehensive Drug-Safe Workplace programme.

Approximately 70% of illicit drug users are employed. That’s not suggesting that 70% of your workers are using drugs. In fact it’s only a minority of workers who fall into this category and they are generally within the 18 – 35 year old male demographic. This of course is the generation referred to as “X” and “Y” and are overly represented throughout our industry. They culturally feel they have a right to party hard, have a drug of choice (no matter if it’s illicit) and weekend binges. The incidence of these employees showing drug affected behaviour at work is on the increase. “Eccie Mondays” (where the individual has been awake and partying throughout the weekend) have become the norm in some workplaces. As this group represents a large percentage

Infringement notices for workplace safety breaches New on-the-spot fines for workplace safety breaches came into force from 1 July 2013 New on-the-spot fines for workplace safety breaches came into force from 1 July 2013, greatly broadening the number of offences which will earn on-the-spot fines of $720 for an individual and $3600 for a company. The Master Builders Association of the ACT has been presenting information sessions that provide you with the information of specific breaches that will attract an onthe-spot fine. These information sessions were presented by the ACT Work Safety Commissioner, Mark McCabe. The Master Builders’ objective is that you do not incur these fines, and that you are aware of your obligations under the Work Health & Safety Act.

ACT Building and Construction Activity Forecast to Ease Back Master Builders’ forecasts for Australian Capital Territory building and construction show the industry is set to continue to fall back over the three year period to 2015-16, following the boom-like conditions that peaked last year. The forecasts are derived from a sophisticated national model purposely designed for the building and construction industry by Master Builders in collaboration with Independent Economics. The forecasts need to be seen against the backdrop of a building boom in the ACT in the recent past. Even with the forecast decline, activity will remain at relatively healthy levels.

Master Builders ACT Executive Director John Miller wrote to candidates in the ACT and in Eden Monaro inviting them to answer a questionnaire on these key issues: “We plan to inform our membership of the views of candidates at the forthcoming Federal election on issues of importance to them and our industry.” Commenting on the response of candidates to the 2013 Federal election questionnaire John Miller said, “The message is clear from the building and construction industry to all candidates and parties contesting Election2013 - it’s time to get back to business of rebuilding the economy by building the infrastructure that this country so desperately needs. In short, it is Strong Building – Strong Economy. “As other countries and regions wake from the economic slumber brought on by the Global Financial Crisis, the Australian economy will have to readjust to remain competitive. Mining, whilst it will continue to contribute to the economy, will not carry us as it has in the past decade. A lot of the responsibility will fall to the building and construction industry to drive the economy.

“Master Builders ACT asked candidates and ultimately those who will represent us in the next Australian parliament to ensure that the building and construction industry is given every opportunity to fulfil its potential in delivering maximum benefit to the well-being of the nation. Through the responses to our prepared questions you will hopefully get some insight of where candidates see our industry in terms of its importance to the economy and as the employer of almost one million people across the country,” Mr Miller said. “The industry has endured volatility and uncertainty for too long. Like many other industries, we want to see a huge reduction in some of the burdensome and complex compliance obligations imposed, often without a hint of regulatory assessment to justify imposition of laws or regulation. AWARD MODERNISATION

Q

While the ‘award modernisation’ process undertaken under Labor’s Fair Work Act 2009 (Cth) (FW Act) provided the appearance of diminished red tape, the modern awards system falls far short of its legislated aim of being ‘simple’ and ‘easy to understand’. What will you do to simplify the safety net and lift the regulatory burden on employers? LIBERAL PARTY The Coalition’s Policy to Boost Productivity and Reduce Regulation will lower business costs, generate more jobs and strengthen the economy. For too long, the red and green tape burden on Australian businesses has been increasing. Under the Rudd/Gillard Government, 21,000 additional regulations have been added despite having promised to cap the growth of regulation with a ‘one-in, one-out’ policy. Small business in particular has carried the burden of increasing demands by government. Small businesses don’t have compliance departments – and nor should they. We need common sense to prevail again. We will also lower company tax, give businesses the option of remitting superannuation payments to the ATO, have the Family Assistance Office administer paid parental leave, require regulatory impact statements for new policies and devote days in parliament to abolishing unnecessary regulations. LABOR PARTY Federal Labor has ensured that 3000 state and federal awards were reduced to just 122 simple, modern awards which protect important key conditions such as penalty rates and overtime. Simplifying Australia’s award system is something the Liberals promised to do, but failed to deliver. The Fair Work Act has delivered for working

Australians and the Australian economy. •

Productivity is up – three times higher under Fair Work than Work Choices.

Employment is up – more Australians in work than ever before.

Industrial disputes are down – on average around one third the rate of the Howard Government.

Wages growth is steady and reasonable – there is no wages breakout.

By keeping disputes to a minimum the ABCC has helped to increase productivity and lower construction costs around Australia. The Australian Building and Construction Commission has helped the building and construction industry to increase productivity by 10 per cent, provide an annual economic welfare gain of $5.5 billion dollars per year; reduce inflation by 1.2 per cent, increase GDP by 1.5 per cent and cause a significant reduction in days lost through industrial action. LABOR PARTY

Labor’s Fair Work Ombudsman is always available to provide information about modern awards and Australia’s employment laws to employers and employees.

Labor does not condone illegal or unlawful conduct in any workplace.

Labor will continue to make responsible decisions which support growth, jobs and increased productivity.

Labor’s Fair Work Building and Construction has a full suite of investigation and prosecution powers to deal with unlawful behaviour in the building and construction industry – whether by employers, employees, unions or contractors.

GREENS The Greens support the maintenance and extension of the modern award and the National Employment Standards coverage.

THE BUILDING AND CONSTRUCTION INDUSTRY

The abolition of the Australian Building & Construction Commission and its replacement by Fair Work Building & Construction was strongly opposed by the building industry and has caused the industry damage. If your party wins Government what would you do to maintain law and order on construction sites?

FWBC has been more effective than the ABCC. FWBC is undertaking more investigations, concluding investigations and getting matters to court faster and recovering more money for workers in the industry. ABS data shows these arrangements are working well - industrial disputation in the building and construction industry is less than one fifth the rate seen under the Howard Government. GREENS The Greens believe general industrial relations law and criminal law are adequate to regulate all workplaces including the building and construction industry.

LIBERAL PARTY We will re-instate the ABCC, in order to ensure law and order is returned to building sites. The Howard Government established the Australian Building and Construction Commission in 2005, in response to the findings of the Cole Royal Commission, and has been instrumental in curbing thuggery, illegal industrial action and lawlessness in the construction industry. 25

ACT AND REGION ECONOMY

Q

A reduction in the number of Commonwealth public servants and cuts to public expenditure announced and foreshadowed by both Labor and the Coalition have already had an adverse impact on business and consumer confidence in the ACT and surrounding region. Are you concerned by these cuts? Do you think this will have an impact on the local economy? What is your party’s policy on public service cuts and what will you do to reignite confidence and safeguard the ACT and region? LIBERAL PARTY The Labor Greens Government has put our country in to huge deficit. Unfortunately, that means that savings do have to be made. The Coalition has been honest about what we will do in regard to the public service. Labor has created uncertainty and instability by misleading Canberrans about the cuts they are making to public service jobs. Labor is cutting or will cut at least 10,000 jobs in the Public Service. The Coalition has a plan to grow the economy. When Australia’s economy grows, so does Canberra’s. The only way that we are going to support the local community is with sound economic management and stable government. The Howard Government inherited 8% unemployment in Canberra and lowered this to 2.5%. Once the budget was under control, we also built things like the National Museum, ASIO headquarters, Defence Joint Operations Centre and National Portrait Gallery amongst other things. By responsibly managing the budget, stimulating growth through our policy to cut red tape and lower taxes, we will grow the economy nationally and here in the ACT. PETER HENDY LIBERAL CANDIDATE FOR EDEN-MONARO I remain absolutely committed to backing our small businesses in Eden-Monaro. They are the lifeblood of our towns. The building industry in particular underpins so much business activity and opportunities in our communities. I welcome 26

our promise to cut company tax by 1.5%, our policy to get rid of Labor’s carbon tax and our commitment to cutting red tape and regulation as these policies will help many of our small businesses in Eden-Monaro. I am a passionate supporter of local agriculture and small business. I was a director of the Australia Made, Australian Grown Campaign. The campaign supports the purchase of Australian agricultural produce by Australian consumers – putting Australians first. For six years I served as the Chief Executive of the Australian Chamber of Commerce and Industry. During this time I was the principal advocate for the Australian small business community. For his services he was awarded an Australian Centenary Medal. Peter has also run his own small business as an economic consultant. LABOR PARTY Despite the tight economic circumstances, Labor is committed to jobs and growth. That is the difference between us and the Liberal Party, who have already identified public sector job cuts of up to 20,000. Labor’s target has always been inefficiency, not public service jobs. Labor has a strong record of finding non-staffing efficiencies in the public service and we plan to continue this. We do want to make the public service more efficient, but we won’t be cutting jobs for their own sake. The Coalition has only one answer to public service efficiency – cut jobs. In 1996, the Howard Government cut 15,000 public service jobs in Canberra, and this devastated the economy of the whole region, with high unemployment, falling house prices, and both personal and business bankruptcies increasing. Labor does not want to see this happen to Canberra again, and will be fighting to protect Canberra jobs, and to protect Canberra. GREENS The Greens are deeply concerned by the attitude of the old parties to the Commonwealth public service. Slashing the public service should not been seen as an easy way to raise revenue. We

understand the value of the public service to all Australians, and particularly the economic benefit of the APS to Canberra and its surrounds. In particular, small business will be affected adversely as people leave town and clients and customers become fewer. We believe the Liberal policy of sacking at least 12 000 commonwealth public servants will have an enormously detrimental effect on the economy of the ACT and will do what we can in Parliament to stand up for the public service and for the ACT.

HIGH SPEED RAIL

Do you support proposals for the east coast High Speed Rail project? What will you do support it proceeding? What would you do to ensure that the route includes the ACT and Canberra? ZED SESELJA LIBERAL SENATE CANDIDATE FOR THE ACT The east coast High Speed Rail project would be significant piece of national infrastructure which would have an effect on a large portion of the population. My personal position is that I would love to see the VFT happen. Unfortunately, due to the fiscal position that the Labor/Greens government have put this country in to, it is not possible for the Coalition to commit to this project at this time. LABOR PARTY An east coast High Speed Rail project would provide Canberra with incredible opportunities. Labor’s study is the most detailed ever undertaken in Australia into high speed rail and it draws on overseas experience — especially from Japan — including manufacturers and suppliers. The study identifies, in detail, a route between Brisbane, Sydney and Melbourne, with spur lines to Canberra and the Gold Coast. We now have a solid basis for an informed public debate about how high speed rail could help meet our transport challenges.

GREENS The Greens have worked hard to put High Speed Rail on the national agenda. As part of the agreement to support the minority Labor Government, the Australian Greens secured a $20 million feasibility study into high speed rail. The Greens commissioned and released the High Speed Rail: Benefits That Add Up report to make the case for a HSR along the East Coast, including Canberra, and has called on the Government to make a financial commitment to HSR. The report laid down a plan for rolling out the High Speed Rail Project in several stages. The Greens will implement the accelerated timetable envisaged in the report. We believe High Speed Rail will be a great ‘stimulus package’ for the south-east states and the manufacturing sector as the economy slows. High speed rail will boost the economies of regional centres along the route. ADAM BANDT MP has said to begin this nationtransforming project, the Greens are committing to fast track high speed rail, and would: •

Fast-track intergovernmental agreements and legislation to get high speed rail moving.

Establish a dedicated High Speed Rail Authority (HSRA) to develop and manage the project. The Authority would be responsible for:

Preparing a detailed financing and investment plan for the project.

Surveying the best rail corridors with the relevant state and local governments

Secure ownership of those routes and confirm the development and operation plan of the project through an inter-governmental agreement.

Commence a comprehensive environmental impact assessment.

Recognising its importance, in 2010 the Labor Government commissioned Dr Allan Hawke AC to examine the working relationship between the Commonwealth and the ACT through the National Capital Authority. As a result, we proposed and passed legislation to give the ACT Assembly the power to determine the number of members its legislative assembly needs to effectively perform its functions without reference to the Commonwealth. 28

We have also provided funding to support the Centenary of Canberra, the development of the National Arboretum Canberra and the upgrade of Constitution Avenue. The Federal Labor Government is investing a record $505.8 million in ACT infrastructure through the Nation Building Program. Under Labor, Federal infrastructure spending in the Territory has nearly doubled from $80 to $120 per person. This financial year (2013-14) we will be injecting $74 million into the ACT. The Rudd Labor Government understands the importance of investing for the future and will continue to invest in the ACT. GREENS We agree that the old parties have taken Canberra for granted for far too long. In particular, Canberra’s public service is used as a political football by politicians and further harsh job cuts will have flow on effects in particular for small business. The last time the Liberals were elected they cut so many jobs that Canberra went into recession. The Greens will oppose these harsh job cuts. We also have plans for supporting small business. There are over 26,000 small businesses in Canberra, and our plan to cut the company tax rate for small business by 2% will have huge benefits for Canberra. The Senate race in Canberra is the most marginal in the country. If we can elect a Green here, rather than a Liberal, we can show them this is no longer such a ‘safe’ seat and it will mean the old parties no longer take us for granted. CATHERINE MOORE – GREENS CANDIDATE FOR EDEN-MONARO Yes, as someone who has lived and studied and worked in Canberra and still uses its many excellent health and cultural facilities, I agree that Canberra is too often used as a political football, and that the term “Canberra” is often applied in an over-arching and derogatory way when people are referring to federal politicians and/or the government.

We will: While there is room for promotion and support in all sorts of areas, my answer here relates to building. The National Capital is the appropriate and obvious place for national institutions, and some years ago I had some discussions with a then employee of the National Capital Authority about the creation of a national centre for sustainability on the shores of Lake Burley Griffin. Other activities precluded me from developing the idea further, but I still see some potential in a centre like this, where information about and examples of cutting edge building technology could be on display for people to see and be inspired by, enabling an increasing number of people, including young people and students, to think about what sort of building they inhabit, how it could be improved and how they live, as we move into an uncertain future. Even if such a centre never comes to fruition, I see huge potential for Canberra to become a national showcase for improving and in some cases rebuilding existing homes and other buildings, reusing and reforming Australian Greens.

In recent years there has been an avalanche of new government regulations mainly effecting the viability of small to medium sized businesses. Our feedback is that most of these new regulations are actually pointless and of no benefit to industry or consumers. If you gain government what would you do to reduce the regulatory burden that is currently crippling small and medium sized businesses? LIBERAL PARTY A Coalition government will undertake a number of measures to deregulate the economy including setting aside two Parliamentary sitting days for the repeal of legislation each year, reporting to Parliament annually on red and green tape reduction, relocating the responsibility for deregulation from the Department of Finance to a new unit within the Department of Prime Minister and Cabinet – taking a whole of government approach to deregulation and creating a dedicated unit within each department and agency that is charged with driving red tape reduction;

LABOR PARTY The Rudd Labor Government understands how important it is to support small business people. That is why we were the first party to appoint a Small Business Minister (Barry Jones 1988), a National Small Business Commissioner (Mark Brennan, 2012), to restore the small business minister to Cabinet (Brendan O’Connor 2012) and to keep the small business in Cabinet (Gary Gray 2013). Federal Labor’s seamless national economy agenda is about reducing costs for business in complying with unnecessary and inconsistent regulation across jurisdictions. The deregulation reforms are now largely completed - 18 of the 27 reforms are now fully operational and the benefits from these reforms are significant. As an indication, the Productivity Commission reported that just 17 Seamless National Economy reforms are estimated to lower business costs by $4 billion each year when fully implemented and improvements to productivity could increase GDP by about 0.4% or $6 billion. These are worthwhile reforms. For example: •

Standard Business Reporting is up and running - providing business with a quicker and simpler way to complete and lodge forms - saving business both time and money. Business can now meet many of their reporting requirement through standard business reporting - BAS statements, Tax File Number declarations, PAYG payment summaries, Company Financial Statements, and Payroll Tax returns. Once fully implemented, it is expected that more than one million businesses will be able to report through Standard Business Reporting. 29

Canberra Students Learn On-the-Job at Majura Parkway. A productive partnership between Fulton Hogan, the Master Builders Association and Beaconhill Consulting has given four University of Canberra (UC) students a fantastic opportunity to put their theoretical learning into practice. A productive partnership between Fulton Hogan, the MBA and Beaconhill Consulting has given four University of Canberra (UC) students a fantastic opportunity to put their theoretical learning into practice. Fulton Hogan is a major civil contractor with 80 years’ experience delivering infrastructure projects to communities throughout Australia and New Zealand. This work includes light rail, major road and bridge construction, as well as airports, ports and water infrastructure. In February, Fulton Hogan commenced work on their first ACT project, the $288 million Majura Parkway construction, which is due for completion in mid-2016. Fulton Hogan has a strong track record of employing graduates to foster engineering within the communities they operate. The Master Builders Association suggested that Fulton Hogan offer cadetships to mid-level construction students at the University of Canberra, and Beaconhill Consulting set about making this a reality for students in Canberra. The university’s three year construction degree requires each student to complete three Industry Based Learning (IBL) placements. The first one is usually completed with the MBA and the students are introduced to the basics of real life in the construction industry. During this placement they study Construction Induction and earn a White Card. The second and third IBL placements involve a long project on construction site, and that’s where Fulton Hogan comes in. 32

The cadetships were advertised within the university and attracted a lot of interest from the students. The successful applicants were Allan Ouma, Mitchell Guy, Genevieve Kenyon-Slade and Aaron Ackland. They started their ten-week cadetship in mid-June. Each student was assigned to one senior manager in Fulton Hogan, and had to intensively learn a specific job which they had been allocated. They then prepared a report for their supervisor in whatever form was appropriate, and the supervisor prepared a candid assessment of the student. The first ten-week placement was so successful that all four cadets were offered, and accepted, additional 13-week placements with Fulton Hogan for their final IBL placement.

“The innovative scheme benefits the university, the students and the employer” Aaron worked mainly in the contracts area. This was his first time on a construction site and he found the experience invaluable. Genevieve worked in quality assurance, mainly to do with drainage. She was extremely impressed with how approachable everyone was. Fulton Hogan staff and contractors were always willing to answer questions and were very patient. One aspect of construction work that was a surprise to her was the sheer volume of paperwork required. She now understands why this is necessary and important. Mitchell was assigned to work with a site engineer on a special project involving the airport. He was very

interested to learn about the potential career paths open to a Building Construction graduate, such as the UC cadets. Allan worked in several areas during his time at Fulton Hogan, including quantity surveying and structures. He found the experience at Fulton Hogan invaluable and is sure that this relevant, paid internship will greatly improve his chances of finding permanent employment after he graduates. The Project Director of Majura Parkway, Malcolm Thomson, was very supportive of the cadetship scheme and is looking forward to working with UC cadets in the future. He said that he was impressed with the dedication, commitment and enthusiasm of the cadets and their ability to ask pertinent questions. UC Course Convenor Paul Watson was delighted with the placing of the cadets with Fulton Hogan and is hoping to continue the scheme in the future. The innovative scheme benefits the university, the students and the employer. The University of Canberra enhances its reputation as providing top-quality industry-focussed education with real-world practical instruction. The students have a rare opportunity to put their theoretical learning into practice and possibly make connection with future employers. ABOUT LIAM KELLY Liam Kelly is the Founder and Managing Director of Banyan Constructions, with over 14 years’ experience in the construction industry, he directly employs 12 people and dozens of subcontractors across his business.

Liam’s grandparents were his mentors, and their solid, reliable approach and old fashioned values set an example that has helped him get to where he is today. When you meet Liam, this really shines through.

From an early age, Liam knew he wanted to be a builder. “I was always nailing bits of timber together and building tree houses. I got a sense of fulfilment from doing these things and fell in love with it” he says.

Banyan Constructions is aware of the need to keep up-to-date with changes in technology and are committed to finding smarter, faster and better ways to build.

All the way through high school Liam helped his uncles build their houses and in the school holidays he worked for a local builder. This cemented his determination to have a career in the building and construction industry. When Liam was about eight years old he realised that what he wanted most was to build skyscrapers and buildings with architectural character. “It’s not surprising that I embarked on a building apprenticeship as soon as I could leave school, completing it in the shortest possible time….while keeping up with part time jobs on the side.”

“Life is increasingly fast paced and this is being projected into the building industry, putting pressure on deadlines and people. I believe this creates a lot of the issues that need to be addressed.

For me, safety is always the number one issue! Every trade within the construction industry needs to find better ways to train apprentices and staff on safety practices ad procedures, and we can’t stress enough how important it is.

Banyan Constructions is keen to encourage more concern about quality work. “Over the last 10 years I’ve really noticed that each trade seems to pass the buck if a problem arises. They either just leave the problem, or work around it, instead of working out a solution and finishing things off properly. “Builders should take real pride in what they are building! There seems to be a lot of badly built, low quality projects being brought to the market place and unfortunately it is being accepted. The prevailing ‘she’ll be right’ attitude, where trades pass the blame down the line, compounds the problem. It’s just not good enough!” A refreshingly honest approach to the industry. Liam’s determination to actively address the issues outlined above was a key motivator for establishing Banyan Constructions.

The Master Builders and Cbus Excellence in Building Awards was an amazing success, exceeding all expectations. 2013 has already seen many awe inspiring projects from the building and construction industry with 28 of the ACT entries successfully selected to represent the Territory at the National MBA Awards in November. This huge achievement is a combined acknowledgement to everyone involved in the industry. Master Builders ACT and Cbus were thrilled with the feedback received from the Awards night held at the National Convention Centre on 28 June 2013. The crowd roaring laughs provided by our comical emcee Peter Helliar and the fantastic performance from Shannon Noll who had guests dancing up a storm; truly amplified the night. The divine décor, delicious cuisine and utter glamour of the room and guests sincerely astonishing with one of our longstanding guests stated the 2013 Excellence in Building Awards as ‘the best ever’. PROJECT OF THE YEAR / CONSTRUCTION CONTROL Canberra International Airport The redevelopment of the Multi-user Terminal at Canberra Airport is the largest privately funded piece of public infrastructure ever built in Canberra. Construction Control have successfully and proudly delivered a facility that makes a statement about Canberra experienced by all passing visitors. The Capital Airport Group had a vision to create the best small airport in the world. What has been delivered is innovative, visionary and an iconic gateway to the Nation’s Capital.

Construction Control have done the Nation’s Capital proud, delivering this visually incredible project that most would deem practicably unfathomable. The new Multi-user Terminal is truly world class and will put the team at Construction Control on the national and international stage.

As a second generation participant in the Canberra building and construction industry, from a young age, John never envisioned a career in the industry. After almost two years in the banking industry John decided to join his father in the family trade. Attributing a vast majority of his skills and workmanship to knowledge passed on from his father John has a strong focus on imparting his knowledge to future generations. “The best way of imparting skills, craftsmanship and knowledge to future generations is by encouraging them not to be afraid to ask questions no matter how silly they may believe they are and to ask them as often as needed. By doing this and demonstrating patience in answering and always being receptive to questions, knowledge is easier to pass on and is usually sought more often than not. In a single word, communicate” he recently said.

One of the major difficulties Construction Control experience with the Canberra Airport project was the maintenance of public amenity during the construction phase. Working in and around a fully operational Airport and ensuring operational standards and safety was one of the greatest challenges and considerations of the team. Like any industry there are highs and lows experienced, the building and construction industry is no stranger to this. 2014 may deliver a slower industry environment than the past 12-24 months but this is the lifecycle all too familiar. “I can only hope it does not get to such a level as to force genuinely talented people from the industry” he concluded. A piece of advice that will remain with John for the entirety of his career is ‘don’t come to me with a problem unless you have explored potential solutions’.

HOUSE OF THE YEAR / BELLEVARDE CONSTRUCTIONS A beautifully realised home nestled in the picturesque Jamberoo Valley. Bellevarde Constructions have absolutely out done themselves with this immaculate work of art. Located on the New South Wales south coast, this site possesses picturesque views to the sea. Founder John Fielding entered his career as a bricklayer with a passion for architecture, starting Bellevarde Constructions in 1980.

Bellevarde Constructions operates and maintains such a high standard by living and breathing ‘the Bellevarde way’, which is a documented uniform approach adopted by all employees and sub contractors. The high standard of the organisation is also derived from the careful selection of good workers who like doing things to the highest standard and won’t settle for anything less. The new house is the principal building sitting on the north-west corner of the complex. Existing farm buildings including an old diary, barns, sheds and cottages have been retained around an ancient Morton Bay Fig tree. The new additions comprise of three pavilions connected through a breezeway creating a series of views through the building. Carefully designed to add a contemporary layer of history to the place,

the new building responds in shape, scale and proportion to its immediate surroundings. The judging panel from the MBA ACT Awards were amazed by the craftsmanship, attention to detail, use of materials and the overall caliber of excellence displayed. All judges expressed the honour and privilege it was to experience the magnificent work of Bellevarde Constructions.

Abode Constructions and Developments Named the Young Residential Builder of the ACT, 2013 was an enormous surprise to Scott Simpson. Scott’s business Abode Constructions and Developments has been operational for a little over two years and is continually producing brilliant residential homes for Canberra families. Scott was previously employed by Kell and Rigby and states his most memorable project with the company was the award winning Botswana High Commission. As a young site manager Scott quickly developed highly tuned managerial skills needed for a jobsite that could have 50-100 workers operational at any one time. After a highly intensive, result-focussed first six months of 2013, GEOCON appreciated the ability to relax and celebrate with industry colleagues at the Excellence in Building Awards. GEOCON’s award winning entry, Abode Woden was a refurbishment of the historic Juliana House in Woden’s Town Centre. With an existing building, there are always hurdles that will emerge once the project has commenced. Add to this a goal to make the project Australia’s first Green Star hotel and the list of challenges starts to grow. One of the main challenges was the discovery of asbestos but the speedy response from the team to have all people on site undergo asbestos awareness training before resuming work meant this situation was rectified quickly. This held up the project slightly but was a good learning experience for the project team and business as a whole. Being the first Green-star hotel project in Australia was an additional challenge as the administrative and system infrastructure did not exist; GEOCON has taken on the additional role as pioneers for the industry. Managing director of GEOCON Nick Georgalis states “I am a big believer in teaching people and allowing them to learn and build their own knowledge. With everyone in my team, I guide them but also allow them to make their own decisions and sometimes their own mistakes. We have a very young and enthusiastic team who are all very keen to make their mark on Canberra and I am proud to be leading them on this journey”. Providing a supportive learning environment and positive business ethos has enabled GEOCON to achieve great feats. Jordan has embraced vocational education and training and is currently enrolled in the Certificate IV in Building and Construction (Building).

National Update Recovery in Housing Finance Begins to Strengthen A sixth consecutive rise in housing finance figures released recently by the Australian Bureau of Statistics provides hope of a strengthening recovery in the residential housing market. The total number of dwelling commitments rose 2.7 per cent in June, seasonally adjusted. The number of commitments for the construction of new dwellings rose 0.9 per cent and commitments for the purchase of new dwellings rose 0.2 per cent, seasonally adjusted. Nationally, loans for the construction of dwellings and for the purchase of new dwellings combined rose 0.6 per cent in the month, to be up 13.3 per cent from June 2012. Encouragingly, housing finance commitments for owner occupiers in Queensland increased by a strong 4.4 per cent seasonally adjusted for the month of June. Peter Jones, Master Builders Australia’s Chief Economist said “The figures confirm the impact of lower interest rates is starting to be felt in the housing market. “The figures are encouraging although any increase in new building activity or work done tends to lag finance commitments by a few months as existing stock is soaked up,” Mr Jones said. “With an upswing in housing finance starting to strengthen, residential builders will welcome a flow through into new building activity where the recovery to date has been unusually tepid,” he said. “Home builders are banking on further improvements with yesterday’s further rate cut expected to help drive a long-awaited improvement in building activity,” Mr Jones added.

Builders Welcomes More Funding For Asbestos Safety Agency Master Builders Australia (Master Builders) commends the announcement made recently by the Minister for Workplace Relations, Hon Bill Shorten, of additional funding of $6.4 million for the Asbestos Safety and Eradication Agency. Master Builders supports the introduction of best practice for asbestos management, control and removal. Currently, 600 Australians are diagnosed with mesothelioma every year. The number of people diagnosed with mesothelioma and other asbestos-related conditions is rising with the number of people diagnosed with asbestos related diseases expected to peak in 2020. By then it is estimated that there will be up to 40,000 cases of asbestos-related disease. Wilhelm Harnisch, Master Builders Chief Executive said that asbestos-related diseases are moving away from heavy exposures during the mining, milling and manufacture of asbestos to diseases resulting from exposures during the abatement of 54

loose asbestos and the use and removal of asbestos containing materials. “The occupations that account for the greatest number of mesothelioma cases have changed over the years from miners/ millers, product manufacturers and insulation workers to other end-users of asbestos-containing materials, in particular workers in the building and construction industry and in shipyards,” Mr Harnisch said. “Although the level of individual risk is lower for such end-users, the higher number of workers in building and construction means that these workers contribute greater absolute numbers to the national mesothelioma toll. However, Master Builders has some concerns about Government’s National Strategic Plan for Asbestos Awareness and Management 2013-2018 that was also released today. “One of the strategies is for the development and implementation of a Prioritised Removal Program of asbestos in commercial and government buildings. Such a plan would create unnecessary risks to workers involved in the removal, transport and disposal of the asbestos and to the public,” Mr Harnisch said. “The risks posed by asbestos depend on the nature and condition of the materials and the potential for exposure. Left undisturbed, bonded asbestos material in good condition does not pose a risk to health,” he said. “Master Builders’ preferred approach is that, wherever possible, asbestos should not be disturbed. Where there is a risk of deterioration of the asbestos material, such as with the weathering of asbestos roofing, Master Builders recommends that the asbestos containing material only be removed by a licensed removalist.” Master Builders also has concerns over the disposal of asbestos materials if a Prioritised Removal Program was given the green light. For example, there are currently no disposal facilities in the Northern Territory that accept commercial quantities of asbestos. This results in asbestos products needing to be transported interstate to facilities such as in Dublin, South Australia. “Master Builders recommends that the additional funding given to the Asbestos Safety and Eradication Agency be spent on education programs that encourage home owners who plan to renovate a pre-1990 home to engage a licensed asbestos removalist to identify and, if required, remove asbestos from the home.”

MBA Supports Corruption Crackdown Master Builders supports a crackdown on corruption as an appropriate step in reform of Australia’s industrially registered organisations. Master Builders Chief Executive Wilhelm Harnisch said, “No party in the workplace should receive special treatment. “The Coalition’s proposal, released today in its policy Better Transparency and Accountability of Registered Organisations,


to impose personal fines and jail terms for officials of registered organisations who break the rules is one facet of reform of registered organisations which should be given careful consideration,” Mr Harnisch said. “In August 2013, Master Builders will release a detailed submission to provide the Government and Opposition with the building and construction industry’s first priority and first step for reform of the industrially registered organisations legislation,” he said. “People with management and control of registered organisations would need to prove before being appointed that they have not been convicted of certain criminal offences. This test would be the first hurdle that would need to be passed,” Mr Harnisch said. “Master Builders will also recommend that the current fit and proper person test, which regulates whether or not a union right of entry permit is granted under the Fair Work Act, should be strengthened,” he said. Master Builders’ second priority is that people with management and control of registered organisations would need to prove they are of good character.

Gosatti National Chief Executive Officer of the CCF said. “Whilst we will await more detail what is pleasing about the policy is that the Shadow Minister Bruce Billson has well and truly heard and understood the problems besetting the sector and has responded with a range of initiatives. “In particular we welcome comments in relation to the ability of smaller business to contract for government work and protecting the rights of independent contractors and the self-employed.” Mr Gosatti also said This commitment to protecting the rights of independent contractors aligned with the guarantee of the return of a strong building and construction regulator is particularly important in unlocking productivity in the sector. “It is a good start although our members would like to see more done on the workplace relations front with reform to the Unfair Dismissal provisions and abolition of adverse action claims.

Master Builders will provide a detailed case for these reforms in its August 2013 submission.

“These provisions have seen the return of “go away money” and are a substantial burden on employers particularly because of the reverse onus of proof in adverse action claims.” Mr. Trevor Gosatti also said.

Government cap on self-education expenses deferred!

Apprentice Pay Decision Will Lock Young People Out Of Work.

On Friday 2 August, the Rudd government put on ice Wayne Swan’s proposal to put a taxable cap of $2,000 on self-education expenses until July 2015.

Master Builders Australia says the hopes of thousands of young people seeking jobs in the building and construction industry were dashed today by the Fair Work Commission’s decision to effectively raise the pay of first and second year trade apprentices by 20%.

This proposed cap could have affected nearly two million workers, cost the nation $1.6 billion in lost tax revenue and cut national productivity by up to $6 billion – while delivering only $520 million in revenue. Treasurer Chris Bowen announced the cap deferral as part of the Government’s Economic Statement. The Scrap the Cap Alliance, has been lobbying against the proposed cap since former Treasurer, Wayne Swan, released the policy back in April and is pleased with this government announcement. AMA President, Dr Steve Hambleton, said the decision by the Government to defer the introduction of the proposed $2,000 cap on work-related self-education expenses until July 2015 would allow proper informed discussion that should lead to the removal of the proposed cap by the next Government.

“The Fair Work Commission’s decision today will lock thousands of young Australians out of rewarding careers in an industry crying out for more skilled workers over the next decade,” Master Builders Chief Executive Officer Wilhelm Harnisch said. “It must be remembered that apprentices are being paid to attain a qualification,” he said. “The Commission’s decision will simply price many apprentices out of what is already a tight job market and at a time when the building and construction is struggling and less able to afford to take them on.” The Commission’s decision could not come at worse time as the numbers of trade apprentices has slightly increased for the first time in two years on the back of falls of 32% over the previous two years.

A Sound Foundation But More Needed On Workplace Relations to Support Small Business.

The Commission’s decision follows a campaign by the ACTU and a range of unions, including building unions. The CFMEU’s wage claim wilfully ignored the job losses which will follow this decision and the disincentive for employers to take on adult apprentices when their wages increase without productivity measures.

The Civil Contractors Federation (CCF) recently welcomed the Coalition’s plan for improving the business environment for small business.

“Unions such as the CFMEU have lost touch with reality when they denigrate 457 visa workers because they want more employment for Australian workers but pursue a wage claim that will lock thousands of young Australians out of vocational training and a rewarding career,” Mr Harnisch said.

“Red-tape, unfair trading terms and the constant erosion of the ability of small business to employ skilled labour on the terms that suit that business are serious concerns of our members.” Mr Trevor

Silver Lining in the Cloud

Two Canberra businessmen have teamed up to create a new software program that may be the simple answer to what’s troubling subcontractors in the Australian construction industry. It’s fair to say that many involved in the Australian construction industry are currently doing it tough. The last few years have witnessed the collapse of a record number of construction businesses. The slowdown has clearly shown that some companies nationwide are struggling under the burden of an increasing administrative workload, difficulties in estimating project budgets/construction programs, and complexities in resolving contractual disputes. Commercial subcontractors need a product to better manage their businesses and construction sites. Trade-Up is a unique software program developed in the ACT which allows subcontractors to manage the key factor that makes or breaks a business - track the productivity of groups of workers on construction sites.

Utilising the rapid advances in mobile and cloud technology, Trade-Up will allow on-site foremen and tradespeople to access and enter information on each of their construction sites using the phone in their pocket. The program takes information directly from the ‘coal face’ of a project. The amount of work completed in a day and the manhours spent produces an innovative productivity score to track whether a project will be delivered on-time and within budget.

Jesse Ahern sums up Trade-Up using a cricket analogy. ‘Similar to cricket where you can estimate a team’s total and how quickly they might reach it by looking at the runrate, Trade-Up allows users to predict how many men will be needed at the current pace to finish on time and on budget.’ ‘Trade-Up is next generation business software that has been developed from within the industry in response to an actual need, which means it is what subcontractors actually want.’ Trade-Up uses the productivity score taken on site to make tendering, variations, and labour costing faster and more accurate. Trade-Up can also be used as a tool in dispute resolution and regulation compliance all while reducing the administrative burden.

All work, on each section of the site, has key performance indicators so the workers on site know what they need to achieve each day and receive instant feedback’. Trade-Up is designed to be simple and intuitive even for those who don’t regularly use technology. The program generates easy to read graphs and statistics. These statistics allow the user to track productivity and trends in workflows on a daily basis, making it easier to identify issues before they turn into a dispute.

This next generation business software has been developed from within the industry in response to an actual need, which means it is what subcontractors actually want. Trade-Up has also been developed in close consultation with peak industry bodies. It has been endorsed by us at the Master Builders Association of the ACT, as well as the Masonry Contractors Association, and the Australian Brick and Block Training Foundation. The first release of Trade-Up is tailored for brick and blockwork subcontractors. Development is well underway to extend the product to other trades. The Masonry version is undergoing Beta Testing and is anticipated for release in early November 2013.

VILLAGE CELEBRATES 25 YEARS AS AFFORDABLE HOUSING FRONTRUNNER. Village Building Co.’s new Chairman Mr John McCarthy AO paid tribute to the tireless commitment of Village’s retiring Chairman and Board member, John Thame. Previous Chairman Brian Pettit, the founder of Pettit & Sevitt, paid tribute to foundation Director and original Company shareholder, Bert Roberts, who with his wife Dorothy, owns Millers of Manuka. Both John Thame and Bert Roberts retired on Village’s milestone anniversary.

The company’s success led to it expanding outside MBA builders to the ACT market at large. In 1990 Village Building also expanded outside the ACT with a project in Orange in New South Wales, before embarking on projects in Wollongong in 1992, Brisbane in 1993, Coffs Harbour in 2002 and Sydney in 2011.

In each community it develops, Village implements a public art program which began in 1993 with the installation of a goanna and Indigenous art wall in the Golf Course Estate in Gungahlin. Over the past decade, the Company has spent over $800,000 on public art, as an investment in the local community, to soften and enliven the character of the areas it develops.

“Our focus over the years has been to provide affordable homes to meet the needs of Canberrans,” Mr Winnel said. “We have achieved a great deal during our first 25 years of business, not only building homes, but also contributing to the communities in which we work. “We have completed six joint ventures totalling 1,981 lots with the ACT Government. Working together with Government we have been able to deliver affordable housing to over 30,000 Canberrans.” Village began its business life in the nation’s capital as a land developer originally named MBA Land, to provide serviced sites to members of the Master Builders Association.

Since its launch, Village has developed over 14,265 lots including 3753 dwellings, with a sales revenue in excess of $1.7billion or $3.7billion in current values. Village Building reiterated its commitment to creating affordable homes in 2007 by working with the ACT Government to redesign and plan the affordable and sustainable community at Macgregor West 1. An increase in yield from an original 570 blocks to 813 blocks enabled a reduction in overall house and land costs to the end purchaser and helped fill an unmet need in 3 bedroom family homes under $400,000. In 2010, Village once again worked with the ACT Government to transform the disused Canberra site in North Watson by developing a master-planned community of 316 affordable homes.

In 1991 Village spent over $1million promoting a proposal to develop a light rail system from Civic to Gungahlin urban Village. 22 years later this idea has been formally adopted as a priority policy of the Labour/Greens coalition in the ACT. Over the last four years it as given $1million towards the national Arboretum’s Visitor Centre and has spent a further $400,000 on the first three ‘Voices In The Forest’ Concerts in the natural amphitheatre of the National Arboretum, attracting international opera stars Anne Sophie Von Otter and Sumi Jo. On 23rd November this year, it will present a performance by Australia’s own soprano, Yvonne Kenny as part of Canberra’s Centenary Celebration.

I have been engaged in the construction industry for most of the past 30 years. My experience encompasses all aspects of the construction industry including high rise construction, residential building and civil works. In the five year period prior to commencing employment with the ACT Government, I was engaged as a Senior Work Health Safety & Environment Manager on construction projects with a value of over $500 million in the Canberra region. I am a firm believer in a commonsense approach to work health safety. It is essential to adopt a considered understanding of construction and safety across Government projects, focusing not just on the severity of individual incidents, and/ or areas of improvement in the management of work health safety but also the broader means of preventing them on an organisational level. Seen in this way Safety is an achievable outcome.

ACTIVE CERTIFICATION IS VIEWED BY MANY IN THE INDUSTRY AS ANOTHER IMPOST IN TERMS OF COMPLIANCE AND COST AND SOMETHING ELSE TO DEAL WITH ON TOP OF OTHER AUDITS ON MATTERS OF SAFETY THAT INDUSTRY IS ALREADY SUBJECT TO ON A REGULAR BASIS. WHAT IS DIFFERENT ABOUT ACTIVE CERTIFICATION FROM OTHER SAFETY-RELATED AUDITS?

The aim of Active Certification is to set the framework and levels of responsibility to be applied in all Work Health and Safety matters, both within an organisation and when dealing with external contractors. Crucially, inspections under the Active Certification Policy are based on the on-site performance of the principal contractor in their management of work health safety.

Safety professionals (auditors) are engaged to take a considered view of practices across an organisation, identifying positive performance as well as identifying areas of non conformance and promoting change where required. To this end, a primary emphasis in selecting Active Certification auditors is prior experience and demonstrated competence in the construction industry. We believe this process will establish a uniform standard required in the management of work health and safety, as well as providing the framework for continuous improvement across the industry. Our work sites are already subject to audits from organisations such as WorkSafe ACT, and some contractors, through their own commercial decisions, have gone on to be accredited under programs such as the Australian Government Building and Construction OHS Accreditation Scheme. While these systems are worthwhile in their own right, they are separate from the Territory’s management of work health and safety on construction sites under its control. The Active Certification Policy is the ACT Government ensuring that it is procuring safe work sites and safe work outcomes.

DO YOU BELIEVE THAT THERE ARE BENEFITS FOR INDIVIDUAL BUSINESSES IN THE INTRODUCTION OF ACTIVE CERTIFICATION? Active Certification is based on the actual performance of the principal contractor’s management of work health safety on-site, not a desk top review, with any site inspection criteria coming from the PCUB site specific Safety Management Plan. This approach offers a real time examination of performance and compliance to the PCUB methods in establishing and maintaining a safe working environment. Audits therefore offer a valuable opportunity for feedback and reflection based on what is really happening where it counts, on site, with the emphasis on preventing problems from arising before they occur. Where non-compliance is identified, the contractor will have the benefit of working with the auditor through the audit process to set the agenda for change and improvement. The process of rectifying identified issues through the audit process is firmly in the hands of the contractor. Where they choose to act and address the identified issues, this positive change is recognised under the Active Certification framework.

WHAT DO YOU THINK ARE THE KEY ISSUES THAT LOCAL BUSINESSES OPERATING IN THE ACT PROCUREMENT SYSTEM SHOULD BE MOST AWARE OF IN MEETING THEIR SAFETY OBLIGATIONS AND MANAGING THEIR ACTIVE CERTIFICATION AUDIT PROGRAM? The Active Certification Policy places particular emphasis on the culture of safety within an organisation. This culture needs to be deeply held at all levels, but must begin right at the top. It

is incumbent on senior management to ensure safety is fully incorporated into the ethos of the business, rather than being perceived as an add-on or inconvenience. Contractors should be aware that active certification auditors are looking for evidence that the importance of safety is recognised right across an organisation.

JUST HOW WILLING AND/OR FLEXIBLE DO YOU SEE RELEVANT AUTHORITIES WILL BE IN NEGOTIATING CONTENTIOUS MATTERS THAT MIGHT BE FOUND THROUGH AN ACTIVE CERTIFICATION AUDIT PROCESS? It is important to emphasise that Shared Services Procurement is not a regulatory body in the mould of organisations such as WorkSafe ACT, and its audits are not connected to or a part of their role as the regulator. An Active Certification auditor may, at any time, suspend an audit upon reasonable grounds, including concerns for their own safety or the safety of others on the work site. However, the Active Certification Policy stands apart from the regulatory bodies, and it remains the sole preserve of regulators to take action such as issuing Improvement or Prohibition Notices.

Who’s making news this issue Robert Neil

ACT Commissioner for Sustainability and the Environment Mr Robert Neil headed south to Canberra in 1990 to join the ACT government’s asbestos removal program after 18 years in heavy industry, the last 12 at the bauxite mine and alumina refinery at Gove in the Northern Territory. Three years later, Bob moved to the Environmental Protection Agency where he worked for nearly 20 years including 5½ years holding the statutory position of the ACT’s Environment Protection Authority. As current Commissioner for Sustainability and the Environment, his role is to provide independent scrutiny and reporting, and to advise the community and government in the ACT on sustainability and environmental issues. People tend to see sustainability and the environment as a limiting factor or a complex issue, Bob argues that is not always the case. Efficient and effective use of resources is the basis of any successful business and it is the basis of sustainability. The construction industry can really change the way we approach the use of our resources. They can usually adapt and move faster than the government. The challenge: you live here and you build this city; build one you are proud of now and will provide us and future generations a healthy future.

Boral Concrete & Quarries One of the MBA’s most dedicated supporters has decided to retire after 47 years of service to the construction industry. Tony has worked in concrete and quarries at Newcastle / Hunter Valley, Kempsey, Gosford, Port Macquarie, Wollongong and for the last 20 years in Canberra with Boral. He has been involved with many extraordinary projects including the National Portrait Gallery, Kooragang / Stockton Bridge, the Akubra Hat Factory in Kempsey and the Clybucca concrete road north of Kempsey, which was one of the first continuously reinforced concrete roads in Australia. Tony has also enjoyed being on the ACT Corporate JDRF Committee (a charity organisation known as the Juvenile Diabetes Research Foundation) for about ten years. This has included involvement in fund raising, and physical participation, in the annual bike ride in Adelaide “Ride to Find a Cure” and countless hours toward the Annual MBA/Boral JDRF Charity Golf Day.

SHE LEADS

Diploma of Management scholarship The Master Builders Association of the ACT and the ACT Training Fund Authority have announced that Elyse Francis is recipient of the She Leads Diploma of Management scholarship. In June this year, the Master Builders and the ACT Training Fund offered a fully funded scholarship for a Diploma of Management course designed to develop young women’s skills that would help them break through barriers they might face in the early stages of their careers, and to support them in their development of leadership qualities. The YWCA of Canberra delivers the ‘She Leads’ Diploma of Management and is well placed to provide this rare opportunity to young women. She Leads draws on the organisation’s eighty years of experience in fostering young women’s leadership, and also on its ability to offer a nationally recognised qualification. The course offers students the opportunity to gain practical management skills while learning from distinguished women leaders. These including Julie McKay, Executive Director of UN Women Australia, Helen Conway, Director of Workplace Gender Equality, Sarah Hadid, Australian Director of Global Poverty Group, and Virginia Haussegger, journalist and presenter of ABC News.

Seven outstanding applications were considered for the scholarship, with Elyse Francis from Hindmarsh being selected to undertake the 12 month program. Beginning at Hindmarsh in 2012 as a cadet, Elyse worked on the $240m College of Science project at the ANU. At the end of 2012, she was nominated to be part of the new project team that was established to manage the construction of the new five storey office block at 1 Canberra Avenue.

Elyse said “So far, the course has provided me with the opportunity to network with likeminded young females from a range of fields and industries. I have also had the privilege of meeting with a number influential female leaders who shared their advice and stories of influencing change.” In the coming months the course will focus on career progression and the development of practical management skills.

Master Builders ACT Deputy Executive Director Jerry Howard said “at the Master Builders we recognise the continuing importance of women in construction and the important role that they will play in the future of our industry. Elyse Francis, who is studying the Bachelor of Building and Construction Management at the University of Canberra, is the perfect example of the future of our industry; she has made the commitment and set a career path for herself that will place her in a frontline management role. We are delighted to grant the scholarship in conjunction with the ACT Training Fund Authority to Elyse and hope this helps her satisfy her career objectives.” The Scholarship, funded by the Master Builders Association of the ACT and the ACT Training Fund Authority, is aimed at encouraging women in construction. Master Builders is committed to increasing the participation of women in the construction industry above the current level of just 11.7%.
