Editor’s Note LISA ROSS – Editor Welcome to the March/April edition of the Master Plumber Magazine Things are looking a bit different, can you tell? We’re shaking things up in 2019 and doing some new layouts with the Master Plumber magazine. We’re hoping these changes will include easier readability and navigation of the various topics covered in each edition. The theme for March/April is Trade Awareness where we want to encourage you to participate more in industry activities and celebrations focussed on your trade. With World Plumbing Day on 11 March and MPAQ’s Plumbing & Gas Industry Award nominations being open for candidates until 12 April, there’s no better time to get involved, work together as a united industry and be willing to accept the recognition you deserve. Times have been especially turbulent recently. Far North and Central Queensland has endured devastating droughts over the years, and more recently had to battle floods as well. Our thoughts are with members still cleaning up or dealing with the repercussions of these natural disasters, and

we are here to support you wherever we can. The recent media attention surrounding security of payments for subcontractors has also highlighted the importance of the significant changes needed in our industry to ensure businesses are being paid for the work they do. MPAQ is constantly working with government and other industry bodies to take action on these issues. Congratulations to our members reaching membership milestones recently and welcome to our new members in this edition. I’m looking forward to seeing you out and about throughout the year.

PERSPECTIVE Penny Cornah, Executive Director On Friday 8 February, I had the opportunity to visit Townsville following the tragic weather events and unprecedented flooding that hit the region in early February. I was shocked to see the town in a state of destruction and despair. The mammoth clean-up will continue following record breaking floods. It is heartbreaking to see what the community has had to endure following these events. I met with Annastacia Palaszczuk MP, Premier for Queensland, and the Hon. Mick de Brenni MP, Minister for Housing and Public Works, Minister for Digital Technology and Minister for Sport, to see how MPAQ can assist with the recovery efforts for Townsville and surrounding regions. MPAQ has been active in warning consumers about not becoming complacent and to place plumbing checks at the top of the priority list, along with electrical work post floods. We are also advising consumers that they need to be aware of scammers offering repairs or services in the wake of the wild weather. We have encouraged consumers to visit the MPAQ website to find local members to undertake work for them. QBCC has created a building disaster recovery search on their website so home owners can search for local licensed contractors. MPAQ is also part of the building recovery committee along with a number of government departments to assist the community through this difficult time. PRESIDENT’S MESSAGE Prevention is better than cure Each year in March we join together as a collective industry and celebrate World Plumbing Day (11 March). It gives us, the stakeholders, the opportunity to put our differences aside and acknowledge our amazing trade and the talented men and women who continuously strive for excellence. As the President of MPAQ, I have had the honour to meet some extraordinary people. Many of them are long-standing members of MPAQ and have given countless hours of their time to lobby for change and fight to maintain our trade at the highest level. The one thing that all these people have in common is their passion for the plumbing and gas fitting trades. The majority of these people have decades of experience under their belt and have earned, through hard work and perseverance, the right to call themselves industry leaders. They have earned the respect of the local, state and federal governments as well as the regional councils and inspectors. Those decades of experience have seen so many changes in materials, tools, legislation, safety, training and standards, yet they still enjoy practicing the single most important trade that protects the health and wellbeing of the world’s population. As our members age, it is important for the next generation to understand the history behind the legacy they are inheriting. It is so important to maintain their focus on keeping our trade safe from the vultures that want to water down, divide or reduce the profession that our forbearers fought so hard to build. I am happy to report that the MPAQ Council currently has the right mix of experience, technical knowledge, determination and passion to lead and preserve the legacy of our predecessors. We have a clear understanding and mandate from our trustees on what is expected and why it is so important to maintain our vigilance and protect the exceptional standard of the plumbing and gas fitting trades in Queensland. I would urge all of you to become more actively involved in our industry and make a conscious effort to support the expos, forums and events that the magnificent staff at MPAQ present throughout Queensland each year. The forums provide an opportunity to have your say and converse with other likeminded people that are often encountering similar issues within the trade. You never know, you might learn something! TRENCH COLLAPSE DEATHS – TRADIES EMPLOYERS OHS BREACH URGED TO PROTECT AGAINST PERMANENT HEARING LOSS WorkSafe has charged civil construction company Pipecon over the deaths of two Ballarat workers who were killed when the trench they were working in collapsed on 21 March 2018.

Hearing loss due to excessive noise from machinery and power tools is one of the most widespread, yet preventable, workplace injuries. But there is good news, with recent findings showing that tradies who use hearing protection devices at work are also more likely to use them during noisy leisure pursuits. A national survey of more than 8,000 Australian adults conducted by the National Acoustic Laboratories (NAL), the research division of Australian Hearing, reveals that workplace users of hearing protection devices are five times more likely to use them at leisure. Men were significantly more likely than women to use hearing protection in 10 out of 20 leisure activities, and those with tinnitus were also more likely to don the earmuffs!

Preventative Steps: • One of the most effective ways of reducing noise is to ‘buy quiet’. Next time you need to purchase a new drill, check the manufacturer specifications and choose a model with a lower noise rating. • Choose well-fitted hearing protection to keep industrial noise below harmful levels. • Choose hearing protection that’s comfortable to wear for long periods. Charlie Howkins, 34, was laying pipes in the Ballarat suburb of Delacombe when the trench he was working in gave way, killing him instantly and trapping his 21-year-old colleague Jack Brownlee. Heavy machinery was brought in to widen the trench to free Mr Brownlee, who was buried from the waist down in the five-metre-deep trench. Mr Brownlee died in the Royal Melbourne Hospital the following morning, despite undergoing four operations. Ballarat company, Pipecon has been charged with two breaches of the Occupational Health and Safety Act relating to its failure to use safety equipment, including trench shields and manhole cages to protect workers from engulfment during the excavation. The breaches also relate to the company’s failure to provide supervision to ensure employees were working with the safety equipment. NEW PLUMBING CODE OF AUSTRALIA AVAILABLE ONLINE The Plumbing Code of Australia (PCA) contains the technical requirements for plumbing in Australia. It’s the link between the State and Territory Plumbing Acts and Regulations and the installation standards such as the AS/NZS 3500 suite of standards. The new PCA will take effect from 1 May 2019 and the preview is currently available on the Australian Building Codes Board (ABCB) website (www.abcb.gov.au). If you’re already a registered PCA user, keep an eye out on the website for further information and make sure your National Construction Code (NCC) user details are up to date. If you’re not registered, then do it today at the ABCB website (www.abcb.gov.au).

The PCA online includes many features such as: • Saving favourites – Save your most visited part and/or section to the favourites tab just like you would a website. • Search function – Use key words or phrases in the search bar function for guidance. • Mobile-friendly – The PCA adapts to your device or screen whether using a mobile, tablet device or desktop. • Pop out explanatory information – Making it easier to see the requirements and then access the explanatory information. The PCA is free to access online or download. Simply register by clicking on the yellow icon button on the right hand corner of the ABCB’s website (www.abcb.gov.au).

NEW ANNUAL REPORTING OBLIGATIONS FOR CONTRACTORS The new Minimum Financial Requirements (MFR) Regulation commenced on 1 January 2019. The Regulation will operate alongside the current MFR policy, which was introduced in October 2014. These laws will support the security of payment initiatives within the building and construction industry. Under the new laws, Queensland Building and Construction Commission (QBCC) licensees who hold a contractor grade licence will be required to meet annual financial reporting obligations.

What do you need to do today? If you are a QBCC licensee within financial categories selfcertifying 1 (SC1) to category 3:

There is no immediate impact. You will need to submit your financial information to QBCC by 31 December 2019. QBCC will send you a reminder in early 2019 including guidance about what information is to be submitted.

You may be interested to know that these changes to the law will require the biggest builders in Queensland to provide detailed financial information to the QBCC before April 2019. These legal changes will assist the QBCC to determine whether a licensee is experiencing financial distress. This requirement to send information in early 2019 does NOT apply to you.

If you are a category 4 to 7 financial licensee:

Before April 2019 you will need to provide your financial statements for the last financial year to the QBCC, these will need to include the profit and loss statement, balance sheet, debtors and creditors report, and cashflow statements. If you are a licensee who already provides copies of your annual ASX or ASIC reports to the QBCC then you do not need to provide a separate report. To make it easier for you to submit information, you will be able to upload your reports though the online my QBCC portal, which will be available from early 2019. CHANGES TO THE AS/NZS3500:2018 SERIES With the 1 May release date for the National Construction Code (NCC) 2019, the new Plumbing Code of Australia (PCA) will reference the AS/NZS3500:2018 series, effectively making these documents live and able to be used. • Backflow Prevention – Fire services backflow protection requirements reviewed to remove the option of using ‘single check nontestable’ devices and to clarify that containment protection is required. Plastic Pipes in Direct Sunlight – Amended and made consistent as appropriate with the relevant clauses in Parts 2 and 4 regarding plastic pipes and fittings installed in direct sunlight. Circulatory Heated Water – Revised to provide deemed-to-satisfy provisions for the design, installation and commissioning of circulatory heated water piping systems. Non-Drinking Water – Section 9 ‘Non-Drinking Water Services’ reviewed to address a number of issues. General Changes – Technical revision to include general minor clarifications, clarify pipe separation from underground electrical supply cables, as well as improve the provisions for installation, testing and commissioning of rain water tanks. Clarification of Jointing Methods – Revised to simplify and clarify allowable methods for joining tube products. Soft solder shall not be used for any new joints.

3500.2 • There is significant re-numbering, including Appendixes. • Amendment 2 to AS/NZS 3500.2:2015 to include a deemed-to-satisfy solution for the installation of vacuum sanitary drainage systems. • Relining of Pipes – Deemed to satisfy provisions relating to the installation of structural plastic liners for renovating sanitary plumbing and drainage systems included. • Plastic Pipes in Direct Sunlight – Amended and made consistent as appropriate with the relevant clauses in Parts 1 and 4 regarding plastic pipes and fittings installed in direct sunlight. • General Changes – Changes to make improvements to the ventilation requirements, as well as various miscellaneous changes including corrections and clarifications to ensure consistent application of the Standard. Amendments to the use of “square” junctions. • A new appendix F.

3500.3 • The Standard has been revised to include innovative drainage systems, such as siphonic drainage, that are currently used within industry but were not included in the Standard as a deemed-to-satisfy solution.

3500.4 • Amendment 1 to AS/NZS 3500.4:2018, Section 6 – The orientation of solar collectors has been amended, separating the requirements for class 1 and 10 buildings from the requirements for class 2 to 9. It provides a new option for class 1 and 10 buildings to orientate panels beyond 45° east or west of true north, subject to being reliant on certificates issued by a third party (the Clean Energy Regulator). For Queensland we will need to assess how these new solar amendments relate to the current variation for solar orientation that is applied through the Queensland Plumbing and Wastewater Code (QPWC) part 7. • Plastic Pipes in Direct Sunlight – Amended and made consistent as appropriate with the relevant clauses in Parts 1 and 2 regarding plastic pipes and fittings installed in direct sunlight. • Circulatory Heated Water – Revised to provide deemed-to-satisfy provisions for the design, installation and commissioning of circulatory heated water piping systems. • Clarification of Jointing Methods – Revised text amendments included to simplify and clarify allowable methods for joining tube products. • Soft solder shall not be used for any new joints. • TMV Taps – Amendment of Clause 1.9.3 (a) to include thermostatically controlled tapware as an additional deemed-to-satisfy option for the delivery of 45°C water. PASSIVE FIRE PENETRATION REGISTERS: GETTING IT RIGHT THE FIRST TIME EVERY TIME! Across the construction industry there has been a growing pressure to achieve passive fire compliance; however, miscommunication has led to a disconnect of compliance, which in turn has led to disputes and expensive consequences. Since the 2017 Queensland Building and Construction Commission (QBCC) crackdown there has been a notable increase in scrutiny, not only when it comes to passive fire works but also the documentation and certification surrounding them, including penetration registers. To avoid being caught out, it is crucial that everyone becomes more aware, ensuring you get it right. When it comes to tackling penetration registers the obvious solution is to speak to a licensed passive fire certifier, but it is also important to have an understanding of the current legislation and what is required within the registers to ensure your team’s work is acceptable to the building certifier. Penetration registers not only serve as a record of all relevant information regarding the passive fire works that have occurred but can also be called upon as a reference point in future audits or investigations. They can also be used to identify systems and show details that cannot be gleaned from illegible penetration stickers or if works have been covered with plasterboard. More importantly, the record provides baseline data to ensure anyone carrying out future works in the building can easily identify this information. In Queensland, it is also legislation in the Building Act 1975, which states that if there is any fire safety installation installed in a building then a list

of all of the installations (penetration register) and drawings showing their location (marked up drawings) must be given to the building certifier. AS 4072.1-2005 Components for the Protection of Openings in Fire-resisting Separating Elements provides guidance in Appendix B for the registering of ‘as installed’ penetrations and the protection methods installed because it is an informative appendix and isn’t strictly required for compliance. However, it is included in the standard as ‘good practice’. Without registering each penetration, identifying the fire stopping system used, and noting the fire resistance level (FRL) achieved, it is difficult to verify the evidence of suitability of the installation. It is also extremely difficult to identify installed systems in future routine service inspections or refurbishment work. Plus Passive Fire recommends the form of register similar to that detailed in Appendix B of AS4072.1, which is to be provided to the owner for future reference. WATERMARK CERTIFICATION CHANGES FOR THE PLUMBING INDUSTRY The Australian Building Codes Board (ABCB) have released an update to the WMTS-040:2016 Waste Pipe Connection Outlet and Gratings, Separate or Integral Specification. WaterMark Technical Specification WMTS-040: 2018 Waste Pipe Connection Outlets and Gratings, Separate or Integral was prepared by industry to supersede WaterMark Technical Specification WMTS-040:2016. The updated certification was adopted by the ABCB on 31 October 2018. The objective of this Technical Specification is to enable product certification in accordance with the requirements of the Plumbing Code of Australia (PCA). The revision specifies suitable materials for waste pipe connection outlets and gratings. The WaterMark Technical Advisory Committee (WMTAC) found WMTS-040 had no materials specified, leaving it open to interpretation. This change means only stainless steel, copper and copper alloys, and some plastics are suitable for use as sanitary drains and gratings. Aluminium, while generally durable and reliable, is unsuited to specific applications due to corrosion susceptibility in stagnant, oxygen deprived environments. While tolerant to pH values between 4 and 8.5, products such as mortar, cement, concrete, tile glue, grout and bricks can generate highly alkaline solutions up to pH 13. When this solution contacts the aluminium, particularly corners or surface scratches, corrosion can occur. The WMTAC concludes that the use of aluminium should be restricted in its use under WMTS-040, particularly where exposed to wet environments, such as shower recesses and bathroom floors. An international event initiated by the World Plumbing Council, World Plumbing Day is an opportunity to recognise the important work that plumbers do to maintain and improve the health and safety of communities all over the world. This is a day to celebrate all the plumbing work, big and small, that affects the quality of life we lead, while also reflecting on the steps that need to be taken to improve health and safety in other countries around the world. While we, in Australia, are blessed with clean drinking water and great sanitation, the same cannot be said for those less well-off where plumbing is either limited or even non-existent. The lack of an effective plumbing infrastructure is a huge factor in the tragic statistics we are sadly becoming numb to. • Inadequate drinking water and sanitation are estimated to cause 502 000 and 280 000 diarrhoea deaths, respectively. • 2 billion people worldwide use a drinking-water source contaminated with faeces. • In low- and middle-income countries, 38% of health care facilities lack an improved water source, 19% do not have improved sanitation, and 35% lack water and soap for handwashing. World Plumbing Day is an opportunity for the wider community to recognise the hard work their local plumbers and plumbers across the country do to ensure that they do not become one of those statistics. But more than that, World Plumbing Day is an opportunity to both celebrate the progress that has been made globally and raise awareness of the work that still needs to be done.

MPAQ LAUNCHES A NEW CONSUMER CAMPAIGN Could you live without your plumber? In March 2019, MPAQ launched a new consumer campaign to promote the importance of using a licensed plumber. Generally, building work over the value of $3,300 must be carried out by a Queensland Building and Construction Commission (QBCC) licensed contractor; however, plumbing, drainage, gas fitting, hydraulic services design, and fire protection are among some of the types of building work that must be performed by a licensed contractor, regardless of the value of the work. Through video and social media campaigns, MPAQ hopes to educate the community about the value of using a licensed plumber, particularly from a health and safety perspective. It is important that consumers are aware that by using an unlicensed person they may be putting their home and family at risk as they may not comply with important regulations.

Find a Master Plumber Find a Master Plumber is a database made up of a list of MPAQ members and enables members of the public to find licensed plumbers in their area who offer the services they require. MPAQ’s consumer campaigns will be advising members of the public that they can source a list of licensed plumbers at www.findmymasterplumber.com.au. WHY YOU NEED TO PUT YOUR PRICES UP... TODAY Written by Jon Mailer, CEO of PROTRADE United

The cost of doing business is continually rising. Your materials are increasing in price, as are overheads such as insurance, power, fuel and salaries. Let me ask you: how long has it been since you last raised your prices? When asking this of first-time clients, most often the answer comes back as “over 12 months ago”, “18 months ago”, or “2 years ago”. When clients have not put their prices up for over 12 months I ask: why not? The answers are usually few and far between and rarely justified. Let us explore why as a business you need to put your prices up regularly. Your expertise is growing. As you increase the number of years you are in business, and also the quality of your team, your expertise needs to be rewarded. Customers are paying for your experience, not your time. Therefore, if you charge a flat rate on the majority of jobs, it is up to you to deliver in the shortest amount of time.

1. You are probably already undercharging for the labour component of your work.

Do you know the true cost of employing your team? When you take into account the hourly rate that you pay someone, superannuation, an allowance for annual leave, sick leave, public holidays, RDOs, non-billable travel, and meeting time, you find that the hard cost to employ someone can be anywhere from 1.3 to 1.5 times their nominal paid hourly rate. You then need to add an overhead component to every hour that the employee is on site. This is often referred to as an overhead recovery cost, and would vary from business to business. You’ll then add your margin on that hour to the total of all of this. How clear are you on what this is in your business?

2. It’s better to be at the top of the price range of your industry than at the bottom.

Some clients would automatically want to use your services because you are more expensive than the rest. We work with our clients to ensure that they are in the top 10% of the pricing bracket of their industry... and deliver the value to ensure that the clients’ expectations are met. I guarantee that you have paid more for something than you originally thought you were going to because you saw the value.

3. Your standards need to rise.

Your business results are often a reflection of the standards you set for yourself. By valuing yourself as a professional of your trade, and an expert in your field, you deserve to be paid more for what you do. You deliver quality every time and, therefore, as you continue to improve the quality of what you deliver, in time, your remuneration should rise.

4. You can do less work for the same profit.

When you know your numbers, you will recognise that you can get by doing less work to meet the same profit margins when you increase your price. An example is, if your gross profit margin is 50% and you increase your prices

by 10% you can afford to do 25% less work during the year and make the same gross profit. Doesn’t that sound exciting? AMP STUDY FINDS FINANCIAL STRESS COSTING AUSSIE BUSINESSES BILLIONS AMP’s annual Financial Wellness report has found there are currently 2.44 million Australians suffering from financial stress. This stress is having a significant impact on the economy, costing Australian businesses an estimated $31.1 billon per year in lost revenue. Two in five Australian workers admitted feeling financial stress, with 24% of women and 14% of men admitting to being impacted by financial stress. According to the report, employees suffering from financial stress were also more likely to take up to 2.4 extra sick days a year. Many people think money worries are a personal issue, but research shows being financially stressed spills into working life and impacts productivity.

The research showed no income group was immune from financial stress. Those earning $50,000 – $74,999 reported the highest level of financial stress (26%), followed by $25,000 – $49,999 (24%), $75,000 – $99,999 (16%), $100,000 – $149,999 (12%) and $150,000 and above (11%). “The research found flexible working hours and the ability to work from home improved employee performance, engagement and financial wellness. We need to make sure talking about money isn’t seen as taboo and implement financial literacy campaigns within our businesses to help employees achieve their financial goals,” said Ms. Anderson. WOMEN’S PLUMBING ALLIANCE

JESSICA’S JOURNEY Meet Jess Pasfield, a Women’s Plumbing Alliance (WPA) member, and one of only a small number of female apprentice plumbers in Queensland. Everyone has a story about how they ended up in the plumbing and gas industry. Jess’s husband, Dan Pasfield, reached out to share Jess’s journey to date in the hope that her story might become an inspiration for other women who have been through the same battles and challenges she has faced.

Aussie Battler Jess was raised in a stable and very loving family. Her parents worked hard to give Jess and her younger siblings every opportunity they could, including private schooling and after school sporting activities, encouraging them to pursue their passions, despite the financial stress this caused. Jess started working at the age of 15 at Spotlight, where she often worked double shifts and studied in between. Then, when Jess was in her late teens, her life was turned upside down when her father, her role model, died of a heart attack. At just 18 years old, Jess became the main income earner for her family, working two jobs almost seven days a week to help her mother with food, bills and paying the mortgage. “During this stage of her life, I witnessed Jess’s love and dedication for her family, and it was admirable to see the way she stepped up to the plate during this difficult time,” Dan said.

New Challenges At the age of 21 and 22, Dan and Jess bought their first house in Beenleigh—a fixer-upper that required a lot of work. Dan said, “We bit off more than we could chew really. This was a challenging time for us as we had just got married, we were learning to live with each other, and we were living in an old, run-down house that needed a lot of work, but every cent we had went into paying it off.” Despite being told by doctors that she would probably not be able to have children, Jess unexpectedly fell pregnant in her mid-twenties. She continued working full-time in human resources at a large trucking company during a difficult pregnancy until high blood pressure putting her unborn baby at risk forced Jess to stop working. The loss of a second income became a real struggle for Jess and Dan.

Jack of All Trades After the birth of their daughter, Dan took a high paying Fly-In-Fly-Out job to support his growing family, which left Jess to raise their daughter on her own for large parts of the six months that followed. It was at this time that Jess and Dan made the decision to start their own business together,

accepting the risks of not having the safety or guarantee that they had as employees. As their business grew, Jess took on the responsibility of running the business, taking bookings, chasing payments, accounting, business development, banking, and everything else that comes with running your own business—all of this on top of being a new mum and wife. Jess didn’t want to stop there though. One day, just as she was starting to get back into a routine, Jess decided she wanted to do her plumbing apprenticeship, so within two weeks of making this decision she had signed up. “I am starting to feel like I am working towards a goal I can achieve. I want to say I have a career. I want to know more and know what I’m talking about when I’m on the phone to customers. I want to help further develop our business,” Jess said. Jess has become a very active member of MPAQ and the Women’s Plumbing Alliance, and she loves talking to other women in the industry. FIGHTING FOR POSITIVE CHANGE We’re advocating to improve safety standards for customers, for better homes and buildings, for a stronger, fairer building industry protecting the health and safety of the community.

Master Plumbers Australia, representing the associations in Australia and New Zealand, is lobbying on behalf of members to deliver positive change for our industry. We have identified five key issues where we want national action and will ensure all parties wishing to form or influence national governments are aware of these.

Lifting standards Master Plumbers Australia Chair Robert Pearshouse said this initiative was about advocating across the political spectrum to lift standards for our members and the community at large. “To build a stronger plumbing industry and a safer community we are calling on all political parties to commit to five national priorities,” Mr Pearshouse said. “These are critical changes we need to ensure the health and safety of all communities. As experts in our profession, it’s our duty to inform our political leaders of areas where we need to lift the bar nationally. This work is to the benefit of all licensed plumbers and the long-term future of our profession.”

Master Plumbers Australia and New Zealand comprises the Master Plumber associations of Victoria, Tasmania, Queensland, South Australia, Western Australia, ACT, the Northern Territory and New Zealand. It develops, informs and represents the industry on national issues.

All plumbing products sold, imported into and used in Australasia must hold WaterMark certification

WaterMark certification is the industry standard for plumbing products in Australia and is there to protect consumers – it guarantees a plumbing product is constructed to a defined quality and standard deemed safe, appropriate and acceptable for Australian use. A licensed plumber must install WaterMark certified products in their work. Yet non-conforming plumbing products are available for sale in retail and trade stores across Australia, are imported into Australia and are used in Australian homes and buildings. These non-conforming products are generally of a poorer quality and build and can pose significant risks to the health and safety of consumers because of flaws in their construction, capability and durability. They can also include hidden dangers such as extremely high levels of lead. Compliant plumbing products sit side-by-side on the same retail shelves as non-compliant products, giving the consumer the choice of product without explaining the difference between them. This is potentially misleading the consumer and short-changing them in terms of the quality and safety of the products they are purchasing. In Queensland, under state legislation, plumbing products can’t be sold in retail or trade stores unless they hold WaterMark certification – Queensland is the only state or territory where this is the case.

We wish to support the introduction of a Watermark Certification program in New Zealand that aligns to Australia.

Call to action:

• We want the Queensland retail model embraced and applied at a national level. • In addition, we want to extend this model to make it illegal to import plumbing products that do not hold WaterMark certification into Australia and for it to be illegal to use plumbing products that do not hold WaterMark certification in Australian buildings of any type. This is to safeguard consumers and ensure the building industry delivers better and safer homes and buildings for everyone. • As a first step, it should be compulsory for all Australian retailers to display WaterMark certification at point-of-sale to give consumers the information they need to make an informed choice. • We wish to support the introduction of a Watermark Certification program in New Zealand that aligns to Australia.

Introduce stronger national legislation and defined processes to guarantee security of payment for construction industry contractors and sub-contractors

Plumbers, gasfitters and other trades generally work as contractors and sub-contractors in the construction industry and, as such, are down the project chain in terms of getting paid for the work and goods and services they provide. Yet, like any other Australian business, they need cash flow to maintain their operations and are entitled to get paid appropriately and in a timely fashion for the work they do. It’s only fair. This is why security of payment is such an important issue in our profession as it underpins the long-term viability of all plumbing and gasfitting businesses. Existing state legislation and processes relating to security of payment vary but still leave contractors and sub-contractors vulnerable – they focus on protecting prompt payment and fair payment but offer no protection if a company above a contractor or sub-contractor goes out of business. When things go wrong on a building construction project it’s common that the contractors and subcontractors get squeezed on payment or end up not getting paid at all. This is in part why almost 1,700 construction businesses went out of business in the last financial year. Even under current state-based legislation, there are still too many occasions where buildings are constructed, on time and on budget, and yet, many years later, some contractors and sub-contractors are still to get paid.

This is unacceptable practice for any worker in Australia, and the construction industry employs one in 10 of Australia’s workers directly. We need national legislation that ensures security of payment for contractors and sub-contractors. It must ensure any company collecting money on behalf of a contractor or sub-contractor must put this money aside and cannot spend it as they wish. We also need a simple, quick, clearly defined process of recourse to enable contractors and sub-contractors to collect money they are owed in a timely way. Recent construction industry reviews have recommended the introduction of cascading statutory trust accounts to ensure payment to contractors and sub-contractors and this must be closely examined.

Call to action:

• The Australian Government should identify the best model to ensure security of payment for construction industry contractors and subcontractors.

The Australian Government should implement legislation at a national level to ensure consistency.

Introduce a Continuing Professional Development program and mandatory minimum four-year apprenticeships across the plumbing industry. Master Plumbers Australia strongly advocates for the introduction of a nationally consistent program of Continuing Professional Development (CPD) for plumbers and gasfitters, as exists in many other professions. We believe accreditation and lifelong learning ensures the future standards of our profession and with it the health and safety of the community we serve. The program should be tied to the renewal of a plumber’s licence to provide confidence in our profession’s ongoing capability. Plumbing is regulated on a state/territory basis and the scope of plumbing work varies across jurisdictions, so a national CPD program needs flexibility to cater for these differences. Master Plumbers Tasmania has partnered with the Tasmanian State Government to deliver a state CPD program for plumbers.

Master Plumbers associations in other states such as Victoria and Western Australia are already working together to develop voluntary CPD programs based on the Tasmanian approach. The federal government can support and encourage this national cooperative approach through advocacy in all jurisdictions. As much of our profession is learnt on the job, we also recommend the introduction of a mandatory minimum four-year apprenticeship for all plumbers under the supervision of a qualified plumber.

Call to action:

• Encouragement of a nationally consistent CPD program linked to the renewal of licensing for plumbers. • Mandatory minimum four-year supervised apprenticeships for all plumbers before being eligible to apply for a licence.

Bring plumbing industry employment legislation into line with standard business practices

There are shortfalls in current employment legislation in Australia relating to redundancy in the plumbing industry which are unfair to those running plumbing and gasfitting businesses. They fall short of standard business practice and are uncompetitive for our profession. Under current minimum entitlements, a plumbing business is liable to pay redundancy under a very wide range of circumstances. Employers already do and should remain liable to pay for genuine redundancies, but the scope for these payments must be brought into line with standard business practice.

Call to action:

• The Australian government should bring the whole of Section 18 of the Plumbing and Fire Sprinklers Award into line with the National Employment Scheme (NES).

Ensure that offsite constructed modules in the construction industry, commonly called pods, are certified by a licensed plumber if they involve plumbing works

The construction industry is evolving and one trend we have seen in recent years is the increasing use of pre-constructed modules (pods) on major building construction projects. These ‘pods’ are self-contained units such as fully fitted bathroom or kitchen units that are put together offsite and then delivered to the construction site as one module, to be fitted as a single unit into the end building. There are two problems here from a safety perspective: • The ‘pod’ must include WaterMark certified plumbing products but if they are not assembled by a licensed plumber there is no guarantee these products have been correctly and safely put together. Currently these ‘pods’ bypass critical compliance testing that an in situ construction would require for consumer safety. • The ‘pods’ themselves are usually self-contained units, so a licensed plumber connecting them into the end building has no ability or line of

sight to assess that the ‘pods’ do indeed include WaterMark certified plumbing products, and that these products have been assembled correctly within the unit. • The installation of pipes, fittings and fixtures is plumbing and drainage work regardless of whether it is performed on or offsite.

• That it be a legislated national requirement that all ‘pods’ involving plumbing works used on any building construction in Australia must be certified by a licensed plumber at the point of the pod’s construction. • The current ability to certify complete ‘pods’ under WaterMark must be removed.

WHY YOU’LL LOVE IT: Garie is supposedly an Aboriginal word for sleepy, and on most days, especially during the week, it lives up to its name. It’s a great spot for hiking and is terrific for a surf. Hard-core walkers and waxheads might like to book a bed at the couldn’t-be-more-basic Garie Beach YHA, a beach shack with no electricity, fridge, phone or shower, but it does have running water and a drop loo. Take your own toilet paper, torch and food. It’s not for everyone, but if you want to escape from it all for a couple of days and don’t mind roughing it, it’s great.

Sunshine Beach WHERE IS IT? About 7km south of Noosa, along David Low Way. It abuts Noosa Heads National Park, so it’s a pristine environment well worth exploring. WHY YOU’LL LOVE IT: With 15km of sand stretching all the way down to Peregian Beach, there’s always somewhere to get away from the madding crowd. It’s one of those quintessentially Australian beaches that overseas guests go all open-mouthed about, because it looks like it’s endless. It’s also got great surf, is dog friendly, and at the right time of year you’re bound to spot a few dolphins and whales.

WHERE IS IT? It’s part of Lincoln National Park, 50km south of Port Lincoln and 650km south-west of Adelaide. Access to Memory Cove Wilderness Area is 4WD-only.

WHERE IS IT? You’ll find the beach off Kitty Miller Rd, on the south-western side of Phillip Island. Phillip Island is 140km south-east of Melbourne (a 90-minute drive).

WHY YOU’LL LOVE IT: The five campsites are right on the beach, the scenery is seriously stunning, the fishing excellent, and with no more than 15 vehicles allowed in at any one time, it’s never going to be crowded. This is truly one of the most elite experiences you can have in Australia but without the five-star prices. It’s just $8.50 for park entry per car, a $6 camping fee per car, and $16 per vehicle per night.

WHY YOU’LL LOVE IT: This secluded cove at the base of an extinct volcano not only has great surf, but it boasts that windswept and interesting rugged appeal you look for in a Victorian beach (well, more northerly Australian dwellers might, anyway). Strong rips and the odd shark sighting mean surfers should take care, and swimmers should look elsewhere for a dip.

WHERE IS IT? Garig Gunak Barlu National Park is around 570km (by road) north-east of Darwin and is accessible only by 4WD. It’s impassable during the wet season, November-April. Bring all your own food, unless you count on catching some fish (which practically jump onto your hook!). WHY YOU’LL LOVE IT: It’s a place of pristine beaches, carpeted in seashells, where turtles come up to lay their eggs and the world’s largest remaining herd of banteng (wild cattle) roam in the monsoon forests behind the high-tide mark. Even better, only 20 permits to enter the park are issued at any one time, so you know you’ve got the place pretty much to yourself. Forget about swimming though, this is saltwater crocodile country.

Friendly Beaches WHERE IS IT? Within Freycinet National Park, Friendly Beaches are 20km south of Bicheno on the Coles Bay Road. WHY YOU’LL LOVE IT: Freycinet is Tassie’s most popular coastal park, and the famous Wineglass Bay can get positively overrun (by Tasmanian standards) during summer holidays. Not so for Friendly Beaches, with their squeaky white silicone sand, crystal clear water and views that stretch forever. With the pelican-covered Saltwater Lagoon at one end and Freshwater Lagoon at the other, in reality Friendly Beaches are really just one very long stretch of pristine sand stroked by an aqua ocean. Just be careful of rips, because these are ocean beaches and at the mercy of strong tidal currents.

Lime Bay WHERE IS IT? This beautiful beachside camping spot is part of the Coal Mines Historic Site on the northeastern shore of the Tasman Peninsula, not far from Saltwater River, a 25-minute drive from Port Arthur. WHY YOU’LL LOVE IT: Leave behind the crowds of Port Arthur and wander freely though the evocative ruins of Saltwater River Convict Station with its dingy underground cells – and a waterfront view to die for. The beach is fringed by limestone rocks that have been sculpted by the wind, and there are ample opportunities for wildlife, wildflower and bird spotting.

NEW FAIR WORK REGULATION INTRODUCES OFFSETTING RULES FOR CASUAL LOADING PAYMENTS Employers who incorrectly classify employees as casual instead of full-time or part-time could be responsible for back paying various entitlements under the National Employment Standards (NES), following a recent Federal Court of Australia decision in Workpac v Skene [2018] FCAFC 131. However, the Government has varied the Fair Work Regulations 2009 to clarify that employers, in certain circumstances, may claim that an employee’s casual loading payments should be offset against certain NES entitlements owing to the employee. This regulation comes into effect on 18 December 2018.

How does the new regulation work? The new regulation applies where all of the following criteria are met: • An employee is employed by their employer on a casual basis; • The employee is paid a casual loading that is clearly identifiable as being an amount paid to compensate the person in lieu of entitlements that casual employees are not entitled to under the NES, such as personal or annual leave;

• Despite being classified by the employer as a casual, the employee was in fact a full-time or part-time employee for some or all of their employment for the purposes of the NES; and • The employee has made a claim to be paid for one or more of the NES entitlements (that casual employees do not have) that they didn’t receive for all or some of the time that they were incorrectly classified as a casual. If all of these points are satisfied, an employer can make a claim to have the casual loading payments made to the employee taken into account when working out the entitlements owing to the employee for the relevant NES entitlements. The new regulation applies to employment periods that occurred before, or that occurred on or after, 18 December 2018. EXTENSION OF THE ADULT APPRENTICESHIP EMPLOYER INCENTIVE The Federal Government recently announced that it will extend the Adult Apprenticeship incentive paid to employers, which will incentivise employers to take on apprentices between the ages of 21 and 24 years. From 1 July 2019, eligibility for the Support for Adult Australian Apprentices (SAAA) payment will be extended to employers who take on an eligible apprentice studying a Certificate III or IV in an area experiencing a ‘skills need’. Eligible employers will receive a one-off payment of $4,000. As Plumbing is included in the ‘skills need’ any employer that employs an Adult Apprentice (aged 21 years or over on commencement of their apprenticeship) will receive the one-off payment of $4,000. Minister for Small and Family Business, Skills and Vocational Education, Senator Michaelia Cash, says that the $27.7 million initiative is about making it easier for Australians to start an apprenticeship. “Older apprentices are some of the best workers in our community. The experience and maturity they bring to their apprenticeship – after years of studying or working elsewhere – are highly valued by employers,” she said. “Extending the incentive payments initiative for adult apprentices will support 12,500 apprentices over three years from 2019 to 2020.” Until now, eligibility for the SAAA payment was limited to employers who engaged an eligible apprentice aged 25 years or over when they commenced their training, creating a disincentive for businesses to take on an apprentice aged 21 to 24 years and resulting in a decline in the total number of adult apprentices. PRIVATE WORKPLACE RELATIONS COMPANY TAKEN TO TASK BY ACCC Over the past few years I have taken calls from members who had been misled into signing with a private workplace relations company. When members who had signed for between three and five years approached the company to terminate their contract, they were quoted unrealistic exit fees as there was no termination clause in the contract. The Federal Court will convene a hearing for an Australian Competitive and Consumer Commission (ACCC) prosecution of employment advice provider Employsure for allegedly misleading small business operators into believing it was the Fair Work Ombudsman or the Fair Work Commission or that they were connected to them. The Employsure advertisements on Google represented themselves until late last year as “Fair Work Ombudsman Help – free 24/7 employer advice” and referred potential customers to domains such as fairworkhelp.com.au, employersupport.com.au and employerline.com.au. The ACCC says phone numbers on the advertisements went to a central call centre “primarily operated to secure marketing leads and book faceto-face meetings to sell Employsure’s advisory services, not to provide free advice”. The ACCC states that it will also be pursuing Employsure for its alleged unconscionable conduct in its dealings with four small business operators, believing that the terms of the contracts are unfair. They will ask the Federal court to make declarations, issue injunctions and order penalties, redress for consumers and costs. The ACCC is specifically asking the court to find contracts signed over two years from November 2016 void as a result of the alleged unfair terms. BIOFICIENT DOMESTIC WASTEWATER TREATMENT PLANT Leading global Wastewater Treatment System manufacturer, Kingspan Water & Energy, is the first domestic wastewater treatment plant manufacturer in Australia to receive product certification under the latest Australian Standard for its BioFicient Series 1 Wastewater Treatment Plant. All Trades Queensland are eager to announce that on 17 May 2019, they will be holding the first All Trades Apprentice of the Year Awards. This event will highlight the apprentices that demonstrate their values of integrity, passion, excellence, teamwork and caring. For a bloke who says he never smiles, self-employed plumber Ross Weber could not help but turn his mouth up at the edges at news he was voted FNQ’s Top Tradie by Cairns Post readers. Mr. Weber said “it’s a good feeling,” to know his work is respected and his way of doing business is admired by many. “It’s nice to be recognised,” he said. “I think it is communication and letting them know what is actually happening and not trying to hide it,” he said. Flat out all week with leaking roofs and backed up drains in the wake of unprecedented monsoon rains, Mr. Weber was the picture of humility when receiving a Cairns Post prize pack to the value of $750 in February. Running his own business for 10 years in Cairns, Mr. Weber said the biggest challenge on the job in Far North Queensland is the weather. “I worked all last week in the rain and it has been non-stop. You can’t get on the roof to fix leaks, so you try to jam as many jobs as you can in but you still can’t get to them all,” he said. Established in 2008, Mr. Weber’s plumbing business is a local, familyowned and operated business and is licensed by the Queensland Building and Construction Commission (QBCC). Mr. Weber said being voted as Far North Queensland’s Top Tradie was a real feather in the cap of his business and he was happy to be acknowledged for his work. Grate standards. The Australian Building Codes Board have released an update to the WMTS-040:2016 waste pipe connection outlet and gratings. This Technical Specification enables product certification in accordance with the requirements of the Plumbing Code of Australia (PCA) and specifies suitable materials for waste pipe connection outlets and gratings. The WMTAC found WMTS-040 had no materials specified, leaving it open to interpretation. Inclusion of a Materials section avoids confusion which has allowed unsuitable materials including aluminium to be used as waste pipe connection outlets and gratings, either separate or integral. Aluminium, while generally durable and reliable, is unsuited to specific applications due to corrosion susceptibility in stagnant, oxygen deprived environments. While tolerant to pH values

between 4 and 8.5, Products such as mortar, cement, concrete, tile glue, grout and bricks can generate highly alkaline solutions up to pH 13. When this solution contacts the aluminium, particularly corners or surface scratches, corrosion can occur. The WMTAC concludes that aluminium use should be restricted under WMTS-040, particularly where exposed to wet environments. Stortmech welcomes this update to the Watermark specification, and all Stormtech grates and drainage products are 100% compliant with WMTS-040:2018.
