Editor’s Note LISA ROSS – Editor Welcome to the September/October edition of the Master Plumber Magazine The past few months have been a whirlwind of activity for MPAQ, and one event I want to mention in particular is MPAQ’s inaugural Fraser Island 4WD trip. We had just under 40 people for the trip in August (including children) and what a great experience it was! A few members have been requesting we host something like this as an opportunity to get to know other people in the industry and their families. We camped up at Cathedrals on Fraser with most people arriving on Friday afternoon through treacherous high tides on the beach. Luckily everyone was pretty experienced with driving on the sand and made it through without too many problems! We had an early breakfast on Saturday morning, before eight cars headed off toward the Sandy Cape (north of the island) and inland to Wathumba Lake. Another two cars headed south from camp to Lake McKenzie with a stop on the way back to Eli Creek. Some of the kids caught fish during the trip and others enjoyed a nice swim

in the lakes. Only a few dingoes were spotted during our travels, and only one car got bogged on our adventures (sorry Simon, I just had to mention it!). Saturday night included drinks and dinner around the campfire and a bit of light trivia (which was highly competitive), with plenty of prizes given out. Overall the experience was really rewarding, and I believe some great friendships were made. Keep an eye out for the next trip we plan! Check out all the photos from the trip on our Facebook page. Congratulations to all members reaching milestones in this edition, and a warm welcome to our newest members. I hope to see you out and about!

PERSPECTIVE Earlier this year MPAQ surveyed you, our members, to ask a number of different questions to obtain feedback about the Association and the industry as a whole. One of the key questions asked was: “What are the challenges you face in your business?” The highest responses were cash flow, unlicensed people performing plumbing work, managing work-life balance, and lack of compliance in the industry. Penny Cornah, Executive Director

Cash flow Cash flow was the highest chosen challenge, so MPAQ decided to partner with the Australian Taxation Office (ATO) and Xact Accounting to create a Small Business Masterclass specifically for plumbing and gas businesses. We often get asked about cash flow, obligations with the ATO, claiming money back, and more, so we ran two pilot sessions in Brisbane, designed specifically to help plumbing business owners implement good business practices focussing on simple and timesaving digital options. Following feedback from these sessions, MPAQ has broken down the courses into a number of sub sessions, which will be running later in the year and into 2020. Guide to Calculating Charge Out Rates Apart from these sessions, MPAQ also developed a Guide to Calculating Charge Out Rates in conjunction with Xact Accounting. This guide was launched in the previous issue of the Master Plumber magazine and is available for digital download from the MPAQ website. We have received really positive feedback in relation to this guide. We know that undercharging can be easy to do if you do not start with the correct cost base. We understand that some operators do not fully understand the difference between a margin and mark-up and this can lead to minimal business profits, inconsistency in average charge out rates across the industry, and unrealistic expectations from customers on what is a fair fee. The guide helps to show you how to calculate charge out rates to assist you with the growth and profitability of your business. PRESIDENT’S MESSAGE The 2019 Plumbing & Gas Industry Awards were held at the Brisbane Convention and Exhibition Centre in July and what a night it was! Let me start by congratulating all the finalists and especially the winners for lifting the bar to a new level again this year. Once again, this year the standard of the work completed by the Queensland plumbing and gas Kent Vickers, President fraternity was exceptional, and the competition to win each category proved difficult for the judges. The night was a resounding success and the staff at MPAQ delivered an amazing experience for all those that attended.

Safety is Everyone’s Business Each October, Queensland recognises the need for all of us to step back and refresh our focus on safety. We all live such busy lives that a gentle reminder that safety is everyone’s business is always prudent. The world has evolved into a place where we are all responsible for our well being and it is everyone’s right to go home safely to our families. We all understand the importance of personal protective equipment (PPE), Safe Work Method Statements and procedures, but one topic that never seams to attract enough exposure is our mental health. All of us in the Queensland construction industry are aware of the ever-growing focus on completing the job safely, but if we don’t have our mental health right, then there is a much higher risk to injure ourselves and the people we work alongside. Poor mental health contributes to the most frightening statistics for suicide in our industry and those who read this magazine would remember my comments from September last year. Unfortunately, not much has changed, but we must keep trying to reduce the horrifying numbers. There are several programs such as Mates in Construction, Beyond Blue and Lifeline that run excellent sessions, but at the end of the day we know the people we work with better than anyone. It’s often more obvious to us that something is not quite right, and it is up to us to notice, ask, and help each other out especially when life won’t stop kicking you in the guts. From personal experience, the fact that you have noticed something is not right with a mate is often the catalyst they need to open up and start to talk about their problems. If you notice something’s not quite right about one of your mates, please take them aside and tell them that you have noticed a change and ask them if everything is OK. If they are experiencing poor mental health then I suggest you stay with them and put them in touch with one of the agencies mentioned above. Just remember that one day it might be you, and I’m sure you would like someone to notice that you’re doing it tough and ask: Are you OK?

QLD HOME WARRANTY TOWNSVILLE WATER WISE THANKS TO SCHEME PREMIUMS

Townsville residents are set to ‘wise up’ when it comes to water waste with the Queensland Government funded Water Smart Package.

Insurance premiums for residential construction work in Queensland have increased by 3.85% as of 1 August 2019. These increases are necessary to ensure the continued sustainability of the Queensland Home Warranty Scheme. This affects the premium for all contracts for residential construction work signed on or after 1 August 2019.

QBCC’S NEW PLUMBING AND DRAINAGE LICENSEE REGISTER MPAQ has been advocating and lobbying the government to develop a Plumbing and Drainage Licensee Register for occupational licensing. The Queensland Building and Construction Commission (QBCC) launched the new Plumbing and Drainage Licensee Register online in July, which provides the ability for anyone to search for an occupationally licensed person. Included in the public register is: • Licensee name and licence number • Licence status (e.g. Active, Expired, or Suspended) • Description of licences held • Details of any endorsements or conditions Visit https://my.qbcc.qld.gov.au/s/pd-licensee-register to view the online register.

Member for Mundingburra and Minister for Communities, Disability and Seniors, Coralee O’Rourke, representing Natural Resources Minister, Dr Anthony Lynham, in Townsville, said the $10 million state-funded program was further proof of the government’s commitment to water security and longevity for Townsville residents now and into the future. “This program will benefit at least 19,000 Townsville households, by providing vouchers or rebates of up to $500 for concession card holders, and up to $300 for other Townsville residents,” Mrs O’Rourke said. “There’s a great range of water-wise products that renters, homeowners and body corporates, are able to buy including rainwater tanks, pool covers, low-flow shower heads and shower timers.” “Hundreds of dollars will go straight back into the pockets of almost a third of Townsville’s families and residents, to help them save water. “Our additional $10 million commitment to the people of Townsville, comes on top of the Palaszczuk Government’s $215 million funding for the new Haughton Pipeline and will help ensure Townsville’s water security into the future.” The Mayor of Townsville, Cr Jenny Hill, said the Water Smart Package would boost the local economy and deliver the biggest water conservation campaign ever seen in Townsville. The Palaszczuk Government committed $225 million for Townsville’s water security, with $215 million already put towards the Haughton Pipeline Duplication Project. FREE APPRENTICESHIPS FOR UNDER 21s The Queensland Government announced in August that they are increasing support for young Queenslanders up to the age of 21 by providing access to fully subsidised training across 139 priority apprenticeship or traineeship qualifications. Free apprenticeships for under 21s will cover the cost of training for apprentices and trainees who commence or are undertaking a priority apprenticeship or traineeship qualification from 1 July 2019 to 30 June 2023. Qualifications on offer include traditional trade areas such as electrical, plumbing and engineering, as well as non-trade areas such as healthcare, hospitality and early childhood. To be eligible, you must be employed as an apprentice or trainee under a training contract in one of the 139 priority apprenticeship or traineeship qualifications on or after 1 July 2019. The Queensland Government will cover the full cost of training in the listed priority qualifications, so eligible students don’t contribute to training fees. However, apprentices and trainees may incur related costs such as uniform and resource costs. QUEENSLAND MENTAL HEALTH WEEK 2019

Queensland Mental Health Week (QMHW) is an annual event that aims to shine the spotlight on what all of us can do to look after our mental health and reach out to those who need support. October is National Safe Work Month, and this year’s theme, Be a Safety Champion, demonstrates that anyone, both employers and workers, from any occupation or industry can be a champion for work health and safety. Everyone can support a safety culture at their workplace and promote best practice work health and safety initiatives, and we can all strive to Be a Safety Champion at work this October.

How can you be a safety champion? 1. Visit the Safe Work Australia website, download the available resources, and run a safety initiative in your workplace. 2. Work-related mental health conditions have become a major concern in Australian workplaces due to the negative impact on individual employees and the costs associated with the long periods away from work that are typical of these conditions. Each year: • 7,200 Australians are compensated for work-related mental health conditions, equating to around six per cent of workers’ compensation claims. • Approximately $543 million is paid in workers’ compensation for work-related mental health conditions. 5 SIGNS YOU SHOULD REPLACE YOUR SAFETY GLASSES While the Australian Standards do not indicate a set replacement schedule for protective eyewear, at some point, your safety glasses will need to be replaced. Whether it’s from normal wear and tear or changes to your circumstances, here are five signs that it’s time to get a new pair of safety specs.

EMBRACE EMOTION IF YOU WANT A HEALTHY WORKPLACE The World Health Organisation recently recognised the serious effects of burnout, defining it as a syndrome resulting from chronic workplace stress that has not been successfully managed. The condition is characterised by feelings of energy depletion or exhaustion, increased mental distance from one’s job, or feelings of negativism or cynicism related to one’s job and reduced professional efficacy.

1. Y ou have recently changed jobs, started a new job or increased your responsibilities to include new tasks Choosing protective eyewear is a detailed process that takes into consideration the characteristics of the wearer, task and environment. In other words, you can’t just pick up any old pair of safety specs and assume they’ll do. Any changes to your work environment or tasks may require a new pair.

Recent findings reveal that workers who describe themselves as mentally distant, or disengaged – a key indicator of burnout – had 37% more absenteeism, 49% more workplace accidents, and 60% more issues with accuracy and defects; therefore, businesses need emotionally intelligent leaders who know how to respond to a situation in a way that facilitates positive behaviours. Insight and awareness about the feelings of others is a skill that can be learned and developed. Upskilling managers to both identify and manage their own emotions, as well as those of employees, is vital for a harmonious workplace.

How can you encourage emotions and create a positive workplace? Start at the Top

Leaders set the tone for organisational culture and communication. They can implement proactive resilience initiatives that aid wellbeing and engagement, resulting in an increase in productivity and of wellbeing factors by up to 40%.

Support Constructive Conversations

At some point, we’ve all experienced a well-intentioned attempt to have an honest work discussion that has led to hurt feelings, further distress and avoiding these exchanges altogether. However, creating an opportunity to have these discussions and to clear the air can be very beneficial.

Improve Self-Regulation

Leaders must show the ability to control or redirect impulsive actions and feelings that might negatively impact a highly charged or difficult situation. Try to remain uninvolved in office politics or conflict and avoid impulsive decisions.

Learn about Emotional Intelligence

The best way to develop self-awareness, self-regulation, self-motivation and empathy is to practice these daily in the context of your work environment. This creates a culture that encourages and empowers employees.

Focus on Mental Health and Wellbeing

With mental health issues receiving significant attention in the media and with 72% of employees asking their employers to champion mental health and well-being, leaders need to create an environment where talking about them is normalised. Sharing their own strategies for promoting mental health and wellbeing allows staff to open up about their own experiences and to ask for help. 2. Your safety eyewear is damaged

If your safety specs or goggles get damaged, then they’re unable to do their job of protecting your eyes. Whether it’s a knock from a projectile that cracks the lens or notable scratches that impair your vision, you don’t want a damaged pair of specs between you and a hazard.

3. Your safety eyewear is old

While an old pair of safety specs may have served you well, it’s worth checking out new products to see if you’re missing out on features that could be offering greater protection. As new technology and materials enter the market, personal protective equipment (PPE) may be reinvented to increase its effectiveness, comfort and fit. Any time a Standard is updated, you should double check that your current PPE is still compliant.

4. Your prescription changes

This one is for all of you out there using prescription safety eyewear. Anytime your prescription is updated, you need to get a new pair of safety glasses. No excuses.

Perhaps your lenses stay blurry despite cleaning, they’re always fogging up, or the sun’s glare is bothering you more recently. TRADIES RAISE $55K FOR MENTAL HEALTH

Following a 3,500 kilometre ride through hail and snow that saw 25 plumbers and electricians stop at some 30 townships as they looped Victoria and South Australia in June, riders reunited to present a cheque for almost $55,000 to staff at the Beyond Blue headquarters in Melbourne.

This is the third ride for O’Brien Electrical & Plumbing and Laser Plumbing & Electrical members since 2014 when the tradies rode to the Gold Coast on recycled postie bikes and then rode to Cairns from Melbourne in 2017. In total, the riders have raised $330,000 for the charity with another $80,000 raised in 2015 when the group took on the challenge of walking the Kokoda track. Mark Hailes from Laser Electrical Lilydale is proud of what the riders have achieved over

the years. Starting initially as a way for the business owners of O’Brien Electrical & Plumbing and Laser Plumbing & Electrical to escape the stresses of business and talk to other men with a common interest, the ride developed into regular catch-ups with even a few members from New Zealand joining in. “In talking, we found that many of us had experienced issues with anxiety and depression, and we wanted to do something about it. We never thought that the ride would grow to what it has become, but we’re glad it has as it means people are understanding the importance of talking about your problems. RESEARCH SHOWS TRADIES ARE GETTING HEALTHIER, BUT BLOKEY CULTURE STILL EXISTS Seven out of 10 tradies consider themselves fit and try to eat healthily – challenging the pie eating, chocolate milk drinking stereotype – but a persistent blokey culture is leading to serious injury. The Australian Physiotherapy Association’s (APA) annual survey, released in August to mark Tradies National Health Month, revealed some concerning attitudes amongst tradies and a disconnect between their attitudes to work and sport. APA National President Phil Calvert said, “Our research shows that of those tradies who exercise or play sport regularly – more than half will spend a few minutes stretching and warming up because they know this helps reduce injuries. Yet when it comes to starting work for the day, in many respects another type of ‘sport’, less than a quarter will warm up, even though they know it could prevent stiffness and soreness at the end of the day.” “When we dug deeper we found the majority of tradies were open to the idea of warming up

if they felt their boss would be supportive of it. So there’s a real opportunity for trade employers to take a proactive position and encourage their employees to spend a few minutes each day getting their bodies warmed up for the physical work ahead.” “Tradies are at particular risk of a range of injuries as a result of the intensity and repetitive nature of their work, so it’s important that they put these preventive health measures in place and get help before little niggles turn into more chronic issues. In this respect physios can be a tradies best friend.” The Tradies Health Survey 20191 highlighted the blokey culture still symptomatic of many Australian tradies, including: • 88% reported taking good care of their tools while just over 60% said they take good care of their bodies and mental health. • Only one quarter of tradies felt comfortable talking to co-workers about a mental health issue affecting their work, while just over half (53%) were open to discussing physical health concerns.

• 69% believe that it is normal to be sore as a result of the work they do. • 42% push their bodies past their healthy limits. • 32% follow safe lifting guidelines. • Almost half (48%) hadn’t taken a sick day in the past six months. “At the end of the day we all want to go home safely to our families, so tradies should look at all options to make sure they are in the best physical and mental shape to get through the day. That might include warmup stretches at the start of the day and open dialogue with bosses and co-workers about personal injuries or issues affecting their work.” Tradies National Health Month is an annual awareness campaign that focuses on the health of Australian tradies and the benefits of physiotherapy to support better health outcomes. SAFETY IN CONSTRUCTION Construction is hard work. It’s exposed to the elements and it’s physical. It’s arguably the most hazardous industry in which to work. Workers’ compensation statistics reveal that more claims were paid to construction workers in Queensland than any other industry in 2017-18 – around $157 million. On average, 60 working days are lost for each construction compensation claim. Most of these injuries are caused by hazardous manual tasks, such as carrying heavy loads or maintaining awkward postures for prolonged periods. The risks of asbestos are now well-known across the industry. More recently, the spotlight has been shone on products containing crystalline silica, including stone, concrete, bricks and tiles. Working with these products carries acute risks for many construction trades. A less deadly but perhaps more insidious issue is the prevalence of ‘sprains-and-strains’ in the industry. This makes up half of all compensation claims and often becomes chronic, with 15% of affected workers not returning to work. Research has shown that construction workers are three times more likely than the general population, and 1.5 times more likely than other blue collar workers, to acquire a sprain-and-strain injury. These trends are being exacerbated by the ageing population.

For the plumbers, there will be a special emphasis on maintaining water systems to prevent Legionnaire’s Disease. However, CSQ and government agencies can only do so much. The bottom line is that the industry must find ways of working that are less physically demanding. We are already seeing a trend toward offsite construction. This makes it possible to accommodate many less hazardous task designs. Factories can be air-conditioned, production can be arranged so the work is brought to the worker rather than the other way around, and autonomous machines and robots can relieve much of the manual burden. Yet the reality of our industry means that some degree of manual exertion and heavy lifting will continue to be asked of human operators. For example, there will always be a need to send workers into crawlspaces to repair or retrofit existing plumbing work. So-called ‘wearable’ technology holds great potential for reducing the risks of these tasks. The most promising example of a wearable device is the ‘exosuit’ – a lightweight vest that reduces the perceived load associated with manual handling. This means a worker lifting and carrying a 20kg bag of concrete mix would experience a weight of only 10kg. These devices are already in wide use across the automotive, shipbuilding and logistics industries, and are making their way onto construction sites in other parts of the world. Alongside the world class projects, this year the plumbing industry recognised exemplary leadership, exceptional business acumen, and the growth, knowledge and skills of Queensland’s best apprentices. This year also introduced some new categories into the fold, including passive fire excellence, a businessperson of the year, and a plumber drainer gas fitter of the year, reflecting the ever changing standards and growth of our industry. It was a night of trophies, certificates, and recognition. It was a night of mirror dancing, laser violinists, and hand clappers. It was definitely a night to remember!

Bray Warry, EEP Plumbing – Australian Industry Trade College School Based Apprentice of the Year Bray is passionate about quality workmanship and believes that unlicensed handymen are one of the biggest issues in the plumbing industry. In the future he would like to travel abroad to help build schools and hospitals and one day own his own business. Connor Stafford, Allanna Plumbing Services – Construction Skills Queensland Merv Harris Memorial Bursary Award Plumbing has played a significant part in Connor’s family history, and he will become a fifth generation plumber on completion of his apprenticeship. His biggest training achievement to date is winning one of 10 Rheem plumber grants through a nation-wide competition, and looking ahead he hopes to take over the family business one day. “The event was a great experience, and it was really amazing to go to a lovely dinner surrounded by so many important figures from the plumbing industry.” William Cross, Slade Bros Plumbing – simPRO Second Year Apprentice of the Year While completing his apprenticeship at Slade Bros Plumbing, William has been enjoying all facets of maintenance plumbing and particularly likes backflow and gas. He was a finalist for the 2018 awards program as well and hopes to start his own business in the future. “Winning this has given me motivation to try for another award next year, in particular the Merv Harris Memorial Bursary Award, which my dad won 30 years ago.” Nathan Crowley, Axis Plumbing – The Plumbers’ Union Queensland Third Year Apprentice of the Year (EBA) Nathan is currently employed by Axis Plumbing and is studying at the Service Trades College. Nathan considers this career path to be the best decision he’s ever made and looks forward to finishing his plumbing apprenticeship with his sights set on sprinkler fitting in the future. “For anyone that gets nominated in the future, my advice would be to grab it with both hands and run with it. For someone else to go out of their way to nominate you for something as big as this award; it means they see you putting in the work and think you should be rewarded for it.” Kurt Finch, All About Plumbing SEQ – MPAQ Third Year Apprentice of the Year This was Kurt’s second win in a row, having taken out the Second Year Apprentice category last year. He commenced his apprenticeship as a mature age apprentice, and his passion currently lies with civil constructions. His employer described his work ethic as brilliant and said he is the best plumber they have ever had. “Winning this award reinforces to me and my family that I made the right choice to change careers and become a mature age apprentice.” Patrick Wright, CC P & D – The Service Trades College Fourth Year Apprentice of the Year and Reece Queensland Apprentice of the Year Patrick has a fierce passion for the trade and demonstrated a great understanding of the challenges faced by the plumbing industry in terms of unlicensed and poor quality work. He recently won the Plumbing Industry Climate Action Centre (PICAC) plumbing apprentice competition and has since travelled to the US to compete in the international plumbing competition. Patrick’s employer described him as the future of the company and said that you might get only three apprentices like Pat in a lifetime. “Being an apprentice plumber has created opportunities beyond my expectations and for that I am truly thankful for all those involved in helping me achieve such goals.”

They won the Service Excellence award last year, and innovation and goal setting is something that Jessica strives for in business every day. She is also currently in her first year as a plumbing apprentice and has already been approached by a number of ladies, both at industry events and online, interested in her journey and how they too could get involved. “Building a company from the ground up is seriously hard work. We have hit the ground running and been non-stop, so this award really does feel like we are doing the right thing and achieving our goals!” Sonya Hughes, Hughes Plumbing Contractors – Tradelink Andrea Vogler Women in Business Award Sonya believes that leadership stems from strength and collective positive steps forward within a company, from both the director and employees across to the customers and stakeholders. Over the years he has trained and mentored two apprentices (who are now fully qualified plumbers) and has his third apprentice due to qualify this year. His wife, Tracey, describes him as a quiet achiever, and customer testimonials only helped to highlight Nathan’s profound leadership skills and do it right the first time attitude and work ethic. “It is an incredible honour to win this inaugural award. Thank you to our loyal customers who make all of this possible.” Kelvin Slade, Slade Bros Plumbing – WFI Industry Leadership Award Kelvin has worked in various sectors and roles in the industry throughout his career. He joined the family business, Slade Bros Plumbing, in 1991 and is now the owner manager with his wife Mandy. In November 2016, Kelvin was awarded a Churchill Fellowship to travel the world to research legislation and best practice in legionella management and treatment. He has held many leadership roles throughout his career and has been active on industry panels and boards, as well as being a registered trainer and delivering training courses across Queensland. “Winning the award was fantastic but when you strip away the glitter, it’s the peer recognition behind the award that is the most rewarding and humbling.” Rory O’Malley, DMA Engineers – AHSCA Qld Hydraulic Consultant Design of the Year The $120 million Sundale Garden Village project is the Sunshine Coast’s first health and aged care facility to be certified under the national EnviroDevelopment sustainability certification and the first to receive ‘six leaf’ accreditation in all six defined sustainability program categories. The client’s desire to “kick some seriously green goals” inspired some specific design innovations including electric instantaneous hot water and a fully coordinated ‘wet’ stormwater system in the basement. “The work we do is often behind the scenes, so it’s great for the team to get some rare recognition for the hard work we do each day. It’s equally rewarding for us to see our client’s project be recognised.” Robert Sharman, A N & R Sharman – Reliance Worldwide Corporation Businessperson of the Year This year Robert will celebrate being a licensed plumber, drainer and gas fitter for 44 years. Beavis and Bartels (Brisbane Quarter) – Qleave Commercial and Industrial Technical Award Brisbane Quarter encompasses a complete city block and will include Australia’s first purpose built W Hotel. It also includes two levels of riverside dining and luxury retail shopping beneath a 40 storey state of the art Prime Grade office tower, as well as an 82 storey luxury residential apartment building. All towers had complex systems including cold water, stormwater, hot water, sanitary plumbing and drainage systems. The natural gas system that has been installed serves the entire complex. This system is one of the largest in Brisbane City and one of the most diverse as it serves all three towers and every single commercial tenancy on the podium. “I would like to say a big thank you to all the B & B team for their efforts over the past year, it has been a big year and without each individual in the company going above and beyond in their daily roles we wouldn’t have been able to receive this award on the night.” Hollywood Plumbing (Howard Smith Wharves) – Department of Housing and Public Works Innovative Project Award The site is a 3.4 hectare, 560m parcel of Brisbane CBD located under the Northern side of the Story Bridge and now contains a five-star hotel, multiple restaurants and function venues plus green space gardens and lifestyle areas. Drainage systems were installed using a piping system made with the latest technology in polypropylene and mineral fibres to ensure minimal noise levels were generated during operation. There was also innovative pumping solutions utilised to maintain a dry basement in the 360 bay underground carpark. “Winning this award gives a greater sense of achievement for our staff and a heightened company profile to promote.” Plumbing Logix – BUSSQ Service Excellence Award Plumbing Logix deliver design and construct projects across South East Queensland, and as a company they value logical and strategic approaches. ELECTRICAL ISOLATION FOR WATER HEATERS It has come to our attention that information previously relayed to industry has either changed or was incorrect. The original information described that “like for like” water heater replacements did not fall under the definition of a “new” installation and, therefore, did not require the installation of electrical isolation at the Ernie Kretschmer, water heater – this is still the case. Technical Services However, this information included Manager, MPAQ that water heater tank size was a contributing factor to determining “like for like” – this is not the case. It has been confirmed with the Electrical Safety Office that determining “like for like” is based on the below: • The current rating of the replacement system does not exceed the current rating of the existing circuit protection device. • No modifications or rerouting of electrical cabling is needed to accommodate the new system. Deviating from the above would not be a “like for like” replacement and is, therefore, treated as a new install, triggering the requirement for electrical isolation and safety switches to be installed for the unit. CHRISTMAS AND NEW YEAR ANNUAL CLOSE DOWN The festive season is fast approaching, with Christmas just around the corner. Are you closing down for a period over the Christmas/New Year break? If so, here is a reminder of the process that you must take when informing your employees. The Fair Work Act allows for an employer to close down the work place during traditionally slow periods, such as between Christmas and Kym Campbell, Senior New Year. During this time the Act provides Human Resources Advisor, MPAQ general provisions for an employer to direct an employee to take accumulated annual leave for the duration of the close down, depending on the type of employee and the modern award they are covered by. Under both the Plumbing and Fire Sprinklers Award and the Building and Construction General On-Site Award an employer may direct their employees

to take paid annual leave during all or part of a period in conjunction with the Christmas/New Year holidays and close down the business for the purpose of providing such leave. As the employer, you must provide a minimum eight weeks’ notice to employees that the business will be closing down over the Christmas/New Year period and that they will be required to take annual leave. Under both the Clerks – Private Sector Award and the General Retail Industry Award, as the employer, you must provide a minimum of four weeks’ notice to employees that the business will be closing down over the Christmas/New Year period and that they will be required to take annual leave. For any employees that do not have sufficient accrued annual leave for the close down, they may be required to take leave without pay or they may be granted pre-approved annual leave for the period. HAVE YOU LOST THE INSURANCE IN YOUR SUPER? The Protecting Your Super legislation that came into effect on 1 July 2019 includes changes that may impact the insurance you have within your super. Super funds are now required to cancel your insurance if your super account has been inactive for 16 months (no contributions or rollovers received for 16 months). This will mean you will no longer be protected in the Sharon McEwen, event of accident or ill health, unless you have Insurance Claims and insurance cover elsewhere. Underwriting, BUSSQ Building Super This legislation change will ensure fund members are not paying for insurance cover that they do not know about, nor paying for premiums that are potentially eroding their retirement savings. Before a member’s super account becomes inactive, a super fund must notify the member to give them the opportunity to take steps to maintain their insurance cover, if they wish. Maintaining insurance cover is as easy as: • Making a contribution or rolling over super; or • Electing in writing to maintain your insurance. Please check your situation. QBCC Licensing Issues

SUCCESSION PLANNING FOR PLUMBING BUSINESSES What happens to your contracting business if you die? Sadly, we have recently had a case where the owner of a contracting business died unexpectedly. It is always terribly tough on those left behind, but when the business is QBCC licensed there are additional issues that the family and those attending to the affairs of the deceased will need to deal with.

With a QBCC licensed business, however, there are licensing issues that are going to have to be attended to pretty well straight away. Because of this, it is likely that you will be better off making sure the lawyer handling the estate of the deceased is also experienced with QBCC licensing issues and understands the contracting industry more generally. For a QBCC licensed business to continue to hold its licence and operate the business, even if it is merely to wind that business down, the requirements under the Queensland Building and Construction Commission Act and its Regulations still need to be complied with. Commonly, the nominee of the contracting business, for QBCC purposes, is the sole director, and if that is the person who has died these issues will need to be dealt with quite quickly. Like any QBCC licensed business operating through a company structure (as most do), there must be a nominee with the appropriate trade qualification. If that was the deceased, a new nominee needs to be appointed. If a new nominee is not appointed within 28 days: • QBCC can suspend/cancel the company’s licence; and • The company will be taken to have committed an offence. If the business is operating through a company, and the deceased was the sole director, a new director will also have to be appointed. If the deceased had given a Deed of Covenant and Assurance to the QBCC in support of the licensed entity’s financial position, this will need to be considered as well. Exactly who can give a Deed of Covenant and Assurance has been tightened up with the recent changes to the Act. So this issue needs to be fully examined by the executors of the deceased together with a lawyer who understands QBCC licensing issues. It will also be necessary to ensure that the business continues to comply with the Minimum Financial Requirements of the QBCC. If the executors of the deceased’s estate decide they are going to close down or wind down the business, this can pose a challenge. A business in wind down mode will not have the same cash flow as one that is operating as normal. So one of the first steps has to be to consider what the cash flow effect will be on the business moving forward, particularly if the decision has been made to wind it down or close it. Generally, the QBCC is sympathetic in such unfortunate circumstances but nevertheless, the requirements of the Act and the Regulations must be complied with. In addition, the practical considerations of running jobs currently underway, existing tenders, retention monies or bank guarantees held, all have to be dealt with.

Consider the Effect on Other People Another very important thing to bear in mind, is that if the business ends up going into administration or liquidation, any person who has been a director, secretary or an influential person (such as a nominee or possibly general manager) of the company, could end up becoming an excluded individual, losing their own QBCC licence and being banned from obtaining a new one for the next three years. This would happen if the business goes into administration or liquidation while a director or nominee who replaced the deceased was still in one of those positions or if the business went into administration or liquidation within two years after they ceased to hold those offices. The only exception is if the person who held that position can prove that when they ceased to hold office, the business was solvent (s56AC (4) QBCC Act). Case Study: When It Goes Wrong

Taxpayers need accurate records when they’re lodging their tax returns and rental property claims. Plumbers and other tradespeople play a key role because they provide documentation about the type of work they’ve carried out. Sometimes taxpayers might think they can get an advantage by claiming deductions for work done on their main residence by reporting that it was done on a rental property. They might ask a tradie to change an address or a date to help them out. This is unfair to other taxpayers and places the tradesperson in a difficult position. The Australian Tax Office (ATO) doesn’t want tradies who are trying to do the right thing getting caught up in inaccurate claims. The new and improved Tax Integrity Centre will provide a single point of contact for reporting all known or suspected phoenix, tax evasion, or black economy activity. As of 1 July 2019, you can make a tip off to the ATO online at ato.gov.au/tipoff, by using the Tip-Off form available in the ATO app or by calling the Black Economy hotline on 1800 060 062.

Most tradespeople correctly reflect the work carried out and keep their records up to date, but occasionally the ATO sees invoices where work has been incorrectly reported. Take the below example: A taxpayer had three rental properties located in the city, and a main residence located on the Esplanade. The ATO’s data matching technology detected unusually high deductions in the taxpayer’s return for repairs and maintenance of the rental properties, so an audit of the taxpayer’s affairs was started. A sewerage pump was claimed as a repair at one of the rental properties. Purchase documentation for the pump showed the installation address as one of the rental properties. The properties were cottages built around the early 1900s. The ATO used publicly-available resources such as Google Maps but couldn’t see any obvious signs of the pump being used at that address. Driving by the properties didn’t help, and there was no development application lodged for the rental properties with the local council. On the other hand, during the same period the taxpayer’s main residence was being substantially renovated and a review of council development applications for the main residence revealed some $800,000 worth of works on the family home. The renovation included the installation of a self-contained apartment. The sewage pump was installed as part of that fit out. The plumber who completed the work told the ATO that the real location of the job was the taxpayer’s residence – not the rental property. The taxpayer received significant penalties, interest and was referred for prosecution. The plumber wasn’t prosecuted because he cooperated with the ATO. The falsification of documents can carry penalties under the Crimes Act. There could be other implications on professional registrations and insurance too.

Follow these top tips to help you get your record keeping right and get a more accurate picture of your business: • Make sure you keep records of all of the income you receive, including through cash and electronic payments. • Keep records that support your claims for expenses and show how you worked out the business portion if you purchased something for both business and private use. • Make copies of your paper receipts to avoid them fading – scan them, take photos, or use the myDeductions tool in the ATO app. • Keep your records electronically if possible – many accounting software packages can help with your reporting. • Keep your business and personal records separate. • Keep your records for at least five years.

Businesses will no longer be able to claim deductions for payments they make to their workers from 1 July 2019, where they have not withheld and reported their PAYG withholding amounts to the ATO. Claiming deductions for non-compliant payments is a behaviour that directly fuels the black economy. It means businesses gain an unfair advantage as they undercut competitors by not following the rules. This change will encourage businesses to stop doing the wrong thing by denying them deductions. This new measure will take effect for payments made to workers from 1 July 2019 for income tax returns lodged for the 2020 income year onwards. HOW MUCH MONEY SHOULD I BE MAKING?

One of the number one questions I get asked by plumbers is ‘how much money should I be making?’ The answer to this question depends a little bit on what type of plumbing work you do and how big your company is. But as a general rule of thumb, I tell plumbing business owners that you should be making your wages (e.g. $90K) plus 15% of your turnover.

For example, if you turnover $600K, then you should make the following; • Wages for yourself = $90K • Net profit of 15% = $90K • Total earnings = $180K If you have a spouse working in the business, then you should be making a further amount to cover that person’s wages for doing however many hours she/he does in the business each week. While this may seem like a lot of money to some people (and about right to others) there has to be a reward for the long hours, sleepless nights and difficulties managing people, or why not go back to wages and save yourself the trouble?

So how does it all break down? Every business will be different but the below numbers can be used as a very good guide.

Gross Profit Margin 40%

Gross Profit is determined by taking the costs of doing the job away from the amount you receive for doing the job. The amount spent doing the job is called the ‘’Cost of Goods Sold’’ and in your industry this includes: • Plumbers’ wages and on-costs (workcover, superannuation, etc.) • Materials costs • Job vehicle costs

Maximum Overhead 25%

Overheads are all of the other costs to run the business including: • Office administration wages • Telephone and internet • Advertising and marketing costs • Office rent • Accounting and legal • Software subscriptions and other fees

Net Profit Margin 15%

Net Profit Margin is a financial ratio used to calculate the percentage of profit a company produces from its total revenue. It measures the amount of net profit a company obtains per dollar of revenue gained. The net profit margin is equal to net profit divided by total revenue, expressed as a percentage. NO DEDUCTIONS FOR NON-COMPLIANT PAYMENTS From the 2019–20 income year, a business taxpayer cannot claim a tax deduction for a payment that it makes to a worker — whether an employee or a contractor — unless it has complied with all pay as you go (PAYG) withholding obligations that apply to that payment. These payments are ordinarily deductible under the general deduction provision. New legislation denying a deduction for non-compliant payments was introduced by Schedule 1 of the Treasury Laws Amendment (Black Economy Taskforce Measures No. 2) Act 2018 (the Act), which received Royal Assent on 29 November 2018. This legislative change implements recommendation 7.5 of the Black Economy Taskforce Final Report, and was intended to create a disincentive to businesses making payments to workers operating in the Black Economy.

A Summary of the PAYG Withholding Rules Under the PAYG withholding system entities must withhold an amount from certain payments for work and services. These include a payment: • of salary, wages, commissions, bonuses or allowances to an employee; • of directors’ fees; • to a religious practitioner; • under a labour hire arrangement; and • for a supply of services where the payee (i.e. a contractor, or an interposed entity) has not quoted its ABN. The Taxation Administration Act 1953 (TAA) requires an entity to withhold from the provision of non-cash benefits in circumstances where an amount of withholding under subdivision 12 would have resulted if such a payment had been a payment of money. A payer must pay an amount — calculated based on the market value of the benefit — to the Commissioner before providing the non-cash benefit. Division 14 does not apply to the provision of fringe benefits, exempt fringe benefits and employee share schemes. The ‘no ABN withholding’ rules require an entity to withhold, at the top marginal rate, from payments made to another entity where the other entity does not quote an ABN. Exceptions apply. The ATO has published a range of tax tables to help employers work out how much to withhold from employees and other payees. The ATO has also provided tax withheld calculators. To access this information, visit www.ato.gov.au. Entities that are required to withhold must: • pay the withheld amount to the Commissioner; and • notify the Commissioner (including if the amount withheld is a nil amount). For payments to employees and contractors, the amount required to be withheld must be withheld at the time of making the payment. An entity that is obliged to withhold an amount is required to pay that amount to the Commissioner. An entity that fails to pay PAYG withholding to the Commissioner by the time required will be liable to pay the general interest charge (GIC).

For most employers, certain withholding payments — including salary and wages paid to employees — must also be reported to the ATO electronically at the time that the payment is made under Single Touch Payroll (STP). Penalties apply for not complying with the PAYG withholding obligations. Broadly, where a business fails to withhold a PAYG or no-ABN withholding amount, the penalty is equal to the amount that should have been withheld. There are also penalties for failing to lodge the required information under STP or through the required reports.

New Rules for Non-Compliant Payments A non-compliant payment is a payment to which the PAYG withholding regime applied, and the payer did not: • withhold the amount from the payment as required; or • notify the Commissioner when required: • for payments — under the PAYG withholding or the STP provisions (as applicable); and • for non-cash benefits — under the PAYG withholding provisions. Not all withholding payments fall under the new rules. Only the following payments are affected: • a payment: • of salary, wages, commissions, bonuses or allowances to an employee; • of directors’ fees; • to a religious practitioner; • under a labour hire arrangement; or • for a supply of services — excluding supplies of goods and supplies of real property — where the payee (i.e. a contractor, or an interposed entity) has not quoted its ABN; and • a non-cash benefit provided in lieu of a cash payment. There are three statutory exceptions to the non-deductibility rule.

1. Where the withholding amount is a nil amount

A deduction is not denied if the amount required to be withheld — or the amount required to be paid to the Commissioner — is a nil amount.

2. Where an ABN is quoted by a misclassified employee

An employer that makes a payment or provides a non-cash benefit to an employee they believe to be a contractor is not denied a deduction if — had the employer been correct in characterising the employee as a contractor — the employer would not have been required to withhold (assuming the worker quoted their ABN). If the misclassified worker did not quote an ABN and the employer failed to withhold, the deduction is denied.

3. Where the employer makes a voluntary notification

A deduction that would otherwise be denied is restored — in the original income year — if the employer voluntarily notifies the Commissioner of their mistake before the Commissioner tells the entity that an examination is to be made of its affairs relating to a taxation law. The Australian Building Codes Board’s update to waste outlets and gratings (WMTS-040:2018), which comes into effect at the end of October, now includes a list of recommended materials. PLUMBING THE DEPTHS OF A WORKING RELATIONSHIP

MPAQ’s Executive Director, Penny Cornah, and Technical Services Manager, Ernie Kretschmer, were approached by the Associations Forum to be interviewed for an article in the ASSOCIATIONS Magazine that looks at their working relationship, which is now in its thirteenth year.

In 2006 when Penny started, there was just a small team of eight and Penny was very proactive and motivated to shake things up a bit so we focused on things that MPAQ hadn’t done before, like trade shows. I was just the muscle who helped her make it happen. Now, over 13 years later, MPAQ has 17 staff and presents about 40 events and in excess of 35 accredited training courses across Queensland throughout the year. You would be hard pressed to find anyone with a stronger work ethic than Penny. Whatever has been required, she gets the job done – there have been many late-night stints and midnight emails from her. Penny is a strong leader in a male dominated industry, and I have a great deal of respect for her resilience and the relationships she has fostered with the members and the Queensland Government. What I would change about Penny: Probably get her to share the load a little more. Penny Cornah – Executive Director

I started at MPAQ in 2006, and straight away I was very keen to start trying different ways to support our members. I was constantly saying “let’s do this” or “let’s try this” and although my then boss was very supportive, we had a tiny team and very few resources. Ernie had already been in the organisation for over a year by then, and I couldn’t have delivered some of my ideas without his help and support. In those early days, when we were reintroducing trade shows to the industry, I would rely heavily on Ernie to help me actually pull off the event on the day or in the lead up to it. Over the next few years I worked my way up in the association, becoming Acting Executive Director in 2012 and then Executive Director in 2013. A large part of my role involves tackling potential legislative changes and fighting a push to deregulate our industry, and I wouldn’t be able to do this without Ernie’s support and understanding of the legislation. Members always call to ask technical questions about legislation and standards and Ernie is very knowledgeable in this area, which frees me up to concentrate on other things. What I would change about Ernie: He is a very dedicated staff member and sometimes turns up in the office for meetings when on holidays, even though he definitely deserves the break.

As a second-generation plumber and drainer, I’ve been around the plumbing industry my whole life and am passionate about its future. I left the tools full time due to an injury and joined MPAQ in early 2005 in the role of Technical Officer. My current role involves managing the technical and training departments. A major part of my role is legislative, standards and codes review, interpretation and translation. I’ve also helped the association deliver quality training to the plumbing, drainage and gas industries here in Queensland, and orchestrated developing MPAQ as a Registered Training Organisation (RTO) and delivering training state wide.

PRESSURE GUN HAPPY 90% of injuries involved in using high pressure water blasters are generated by hose or gun failure. Australian Pumps’ experience indicates that many pressure cleaner operators, professional and even semi-professional, continue to use high pressure guns that are leaking, worn or broken. “Safety alerts from the industry, both here and abroad are quite consistent” said Aussie Pumps Operations Manager, Hamish Lorenz. “We see operators using hoses that are years old, often badly abraded with the wire showing through the rubber sheath. We notice hose to gun couplings that are worn and potentially dangerous,” he said. The new Australian and New Zealand safety standards for pressure cleaners cover a series of rules about the safe use of pressure cleaners. They include instructions for operators to continually check accessories for leaks or wear and to replace as required before their use by date. HOW TO KEEP THE FAMILY BUSINESS IN THE FAMILY

With some 70% of Australian businesses being family owned and operated entities, the dilemma of how to incorporate the dreams and aspirations of the younger generations joining the family business, while maintaining the legacy and tradition of the founders, is being grappled with by thousands of companies. Not surprisingly, the plumbing sector is not immune to this. In fact, Master Plumbers’ Association of Queensland member NCP Group on the Sunshine Coast, are a key example of this. For NCP, a 65-year-old plumbing business incorporating sales, plumbing contracting and a sheet metal workshop, the death of the family patriarch and founder of the business was the

catalyst to consider what the future of the family business might hold. “When dad died five years ago, mum also stepped back from running the business and it was left to the second generation to take the business forward and think about balancing the family and business for the third generation,” NCP Director, John McDonald, said. “We have an active interest in the business’ success and that changing dynamic really did bring about challenges and adjustments to our business. There were a few times there where it could have potentially been quite messy. “It was important to us that we future-proof the business and we recognised that to do that we needed to get some professional help to put the right structures in place, so we joined Family Business Australia who connected us to Susanne Bransgrove from LiquidGold Consultants, one of their accredited advisors.”

Transitioning to the Next Generation The first step in developing a strategy for successfully balancing the needs of the incumbent and next generation as they work together in business, is finding out what each person and generation wants and needs from the business, what motivates them and what their vision for the future is. The second step is aligning individual aspirations and visions with the bigger business

picture, creating a common language around shared values and creating a basic set of rules for the family and their involvement in the business. “We held a series of meetings with the Directors (second generation) of the business to work out guidelines for our family and business philosophy,” McDonald said. The third step is to make sure the succession and transition plans remain fluid enough to respond to changes as they happen but are structured enough to give clear guidelines and procedures. “It will always need to be a work in progress,” McDonald said. “A process we continue as the business grows but we have structures and clear understanding of what is needed now.” There is no doubt family businesses can be wonderful places to work, but when families in business can’t find a harmonious way forward, the cost is far greater than most think. It impacts individual family members, the staff and in the worst case, the entire community that relies on the business to prosper. The McDonald family decided to take a proactive approach to create the right structures to give their family business the best chance to continue on the legacy passed on by their parents.
