elcome to the March/April 2017 edition of the Master Plumber Magazine!
I remember my first World Plumbing Day seven years ago; I had only been with MPAQ for eight months or so and had no idea why there was a day dedicated to plumbing. I didn’t get what the big deal was. That year I also worked at my first Conference with MPAQ at Twin Waters, where I sat in one of the sessions and assumed I wouldn’t have a clue what the speaker would be talking about. He started his session with something along the lines of: “First of all, I want to say what an honour it is to be able to speak to people such as yourselves. Your trade is so significantly vital to our society, and you do not get the recognition you deserve. I will never take for granted how clean the water is that I drink every day, how precious the toilet I use is compared to others in the world, how I don’t need to worry about disease and infection like some other countries. Here, I am safe, I am comfortable, I am protected, and I couldn’t feel this way without you.” That speaker really changed my perspective on the industry, and I realised how it seems like such a messy job being the ‘stereotypical plumber’, dealing with toilets, waste, drains, etc. and how society reflects on the industry based upon that, rather than the actual purpose of what plumbers do. You guys are awesome, and I get it. Since then, I’ve loved the fact that I get to work in an organisation that has a goal to maintain the standard of the industry and advance the processes involved in ensuring the health and safety of our community. The group of everyday plumbers and gasfitters that sit on the MPAQ Board give up so much of their time to make important decisions for the direction of MPAQ, as well help spread awareness and encourage others in the industry to be as passionate about it as they are. They work hard for a purpose, and they’re passionate about what they do. That’s pretty cool if you ask me. MPAQ’s World Plumbing Day celebrations this year are focused around our determination to ensure the health of our community, by progressing the future of our industry! Speakers on the day are real employers, apprentices and workers who will share their stories of how plumbing first peaked their interest, where it has taken them and how passionate they are about what it is today. It’s also important to encourage diversity and equality, so MPAQ will be announcing their new Female Ambassador! She will endeavor to educate the younger generations about how a plumbing apprenticeship can be life changing, and how being a female in a male dominated industry can be one of the most rewarding ventures for a person to undertake. Read about how important World Plumbing Day is on pages 16 and 17. If you’re sitting in the background thinking about getting more involved, I hope it will inspire you to get up and do something different this year.

With a total of 18 awards, nominees will have the chance to show their best and be recognised for their efforts. Service Trades Council Information Seminars
The Partners in Plumbing Group was established for the Partners working behind the scenes in plumbing and gas businesses. I know that Partners are the life-blood of the business. It’s important those running the business have the opportunity to connect with other like-minded people, to be able to collaborate and learn from each other on how to develop their business.
So, the STC will be visiting regional areas as part of a Regional Outreach Program to forge strong relationships with key stakeholders across the State. We have already visited Gold Coast, Toowoomba and Sunshine Coast and the next session will be held in Rockhampton on Thursday 27 April. Building Plan Consultation Sessions Thank you to each and every member who has attended the Building Plan Consultation Sessions throughout Queensland. MPAQ has been advocating and lobbying for a number of changes which have been included in the Building Plan Discussion Paper. Key areas of reform for the plumbing industry includes the review of security of payments, the Plumbing and Drainage Act and the licensing review. Thank you also to members who have completed the online surveys.
We understand that most of the time the business partner/ wife / admin person is working solo in the company and is keen to get to know others. We have created a partners in plumbing newsletter, if you would like to receive a copy please email events@mpaq.com.au. MPAQ will be hosting a number of events that will provide women, partners and those working in the business a chance to exchange ideas, find out how other companies manage their workloads and keep up with the demands of running a business itself.

W
e are fortunate enough to have in our wider industry people who contribute and participate in various ways, all for the common good and advancement of the plumbing industry. These people whom I am fortunate to meet, all have a common desire to see the profile and level of respect of the plumbing industry raised and to see plumbing businesses prosper. They are often contacted by people they haven’t met, or did so casually at an event or were referred by someone else because of their skill level or knowledge, or their position in the industry. I could name many people who fit this description, but won’t because they don’t want or see the need for public recognition. My point is that these people are prepared to participate and contribute and make a difference. I have a deep admiration for these people and their motivation for what they do. Unfortunately, we also have a minority group of people in our great industry who do not actively participate or contribute and who do nothing but moan and complain at every opportunity. The frustrating but almost comical aspect to the moaning is that it is usually inaccurate, outdated and without foundation.

There is one thing that I want to make a point of and clear up a misconception, the majority of MPAQ Councillors represent small businesses. We are well aware of the challenges that small businesses and many other members face. Our Council represents a very broad cross section of our industry and they serve voluntarily, representing membership from the Gold Coast, Brisbane, Toowoomba, Goondiwindi, Rockhampton and Townsville. The largest sector of our membership is indeed small businesses. It was once said to me, “The world is run by people who show up”. This is indeed very true. To that end, I encourage everyone to contribute and participate in YOUR industry and take some ownership of what happens.

I have absolutely zero patience for people who fall into this category. If you own a plumbing related business or work in a plumbing related business, guess what? It’s your industry too! Take some ownership of it. Make the effort to stay informed and educated about what is going on, it takes little effort. Here is an excuse I hear often, “I don’t have the time”. This comment is predominately made by the same people who do all the complaining. I also hear “I don’t have the time to read the MPAQ Magazine”, which by the way is your dedicated industry journal. As well as “I don’t have time to read the AS3500 Standard” and “I don’t have time to attend the industry trade shows or expos”. Excuses are rationalisations we make to ourselves about people, events and circumstances. But the same people complain hard and loud when they are told to rectify non-compliant work, all because they didn’t bother or take the time to read the current (2015) standards or check the legislative requirements first. If you have difficulty in understanding the standards or the legislation requirements, MPAQ has a dedicated technical support service which is free to members. The people I mentioned at the beginning, the participators, all have or have raised a family. They all have a responsible demanding business or job and work hard.
Some of you may be asking, what gives me the right to make such statements? I have been in the trade for 42 years, raised 2 now adult sons, this includes the school and extracurricular commitments. I have been in business for around 25 years. I was also a Rotarian for a

Industry News World Plumbing Council Elects New Board, Chairman
T
he World Plumbing Council (WPC) is pleased to announce that Shayne La Combre, CEO of Australia’s Plumbing Industry Climate Action Centre (PICAC) and Deputy Chair of the WPC, has been elected unopposed to Chair of the WPC for the 2016 – 2019 term. This decision cements the important role that Mr. La Combre has played within the WPC and emphasises the role that Australia will play in the future of the WPC in achieving the organisation’s objective of developing and promoting the image and standards of the plumbing Industry worldwide. For the next three years, the WPC will dedicate its efforts to further lifting standards of plumbing and improving access to fresh drinking water and sanitation globally.

The Council places a strong emphasis on the importance of education and training in reaching these key objectives. As CEO of PICAC, one of the world’s most pre-eminent Plumbing Training Centres, Mr La Combre is perfectly positioned to drive this strategy in the years to come. PICAC is a global reference point and industry hub, and was recognised as National Small Training Provider of the Year in 2015 by the Australian Training Awards.

New Queensland Building and Construction Board Minister for Housing and Public Works Mick de Brenni has welcomed the new Queensland Building and Construction Board, setting them the task of meaningful reform of the Queensland Building and Construction Commission (QBCC). “It’s clear that the Queensland Building and Construction Commission has not been meeting community expectations for a long time,” Mr de Brenni said. “Every day I get complaints from both licensees and homeowners about poor customer service, convoluted processes and a lack of transparent practices.” Mr de Brenni said he was confident in the new Board’s ability to deliver on the needed reforms. “The new Queensland Building and Construction Board has a great mix of skills and experience. Mr Dick Williams, the new Board chair, had extensive experience as a company director and a director across a range of industries,” he said. “Mr Williams is well known and has been around the construction industry a long time and has an extensive experience in a regulatory setting.” The New Queensland Building and Construction Board includes Mr Dick Williams – Chairperson, Ms Jennifer Robertson – Deputy Chairperson, Ms Lesley Anderson, Ms Leeanne Bond, Ms Michelle James, Mr Brett Schmiming and Mr Robert Schwarten. MPA represents Master Plumber Association’s across the country in Western Australia, South Australia, Victoria, Tasmania, Queensland, the Australian Capital Territory and the Northern Territory. MPA is the collective voice for the Australian plumbing industry and each Association collaborates together on a national level. Robert is the Managing Director of a plumbing business in Tasmania and was previously the Past President of Master Plumbers Association of Tasmania, as well as a former Councillor of the Institute of Plumbing Australia. Rob provides invaluable consultation on a wide range of policies and procedures that impact not only Tasmania’s plumbing industry but throughout Australia.
MPA represents plumbing contractors from sole operators to medium sized plumbing businesses and large contracting firms. In recent years, MPA has grown in strength, working on the excellent co-operative relationships that exist between member organisations. This has led to the adoption of a unified MPA policy position in the areas of licensing, qualifications and regulation. MPA congratulates Rob on his appointment and looks forward to his contribution as he chairs this important national body.

n Wednesday 30 November 2016, the Government made key announcements about the new Queensland Building Plan, which involves a number of reforms for the building and construction industry.

Under the proposed model, these beneficiaries will be the subcontractors who contract direct to the head contractor. The aim of PBAs is to safeguard progress payments from the head contractor to the subcontractor in the event of head contractor insolvency. The government will roll out the PBA model to both government and private sector projects over $1 million from January 2019, subject to successful outcomes from implementation on government projects between $1 million and $10 million. he financial reporting requirements for members of the building industry will be immediately reviewed amid harsh criticism that a policy introduced by the previous QBC Board has weakened the industry regulator’s effectiveness in monitoring the financial health of its licensees.

“All those decisions greatly weakened the MFR Policy, and this was compounded by the lack of resourcing provided to the QBCC Financial Investigations Unit to implement the policy and to act on any financial issues it uncovered. The QBCC was given a half-baked, reactive policy and insufficient resourcing to implement it, creating a system with inadequate regulatory, monitoring and investigative powers.
Chair of the current Queensland Building and Construction (QBC) Board, Dick Williams, said the Minimum Financial Requirements (MFR) Policy introduced by the previous board had significant flaws that decreased protection for home owners and industry members against the financial failure of licensees, and building company collapses.
“This policy just isn’t working as it should be, but my board is going to ensure that it does, by providing proactive powers and appropriate resources to the QBCC so that it can better protect home owners, subcontractors, suppliers and other industry participants against the threat of suspicious financial activity.”

Mr Williams said the policy failed to provide the Queensland Building and Construction Commission (QBCC) with a strong, proactive regulatory tool to deal with potential financial failures and related offences. He said the current QBC Board would immediately review the MFR Policy, and had already started the process of restructuring the QBCC’s Financial Investigations Unit to ensure it had the appropriate capability and capacity to investigate and act upon financial irregularities and reported payment issues in the building industry. “The QBCC, even with an improved MFR Policy, cannot prevent builders from going bust due to bad management, too-thin margins or other matters out of its control. However, what it will assist with is providing the QBCC with another tool to combat the shonky practices that have been allowed to flourish under the current inadequate MFR provisions. “I’m gobsmacked that the current policy puts the onus on building industry members to provide the QBCC with information about non-payment of debts and other serious financial issues before the QBCC can investigate these concerns. This is a policy that had no proactive regulatory component in it for the QBCC to use, which is mind-boggling.” Mr Williams said another significant failing of the MFR Policy was the removal of the requirement for audited financial accounts to be provided to the QBCC when licences are renewed, which has raised concerns about the accuracy of the information available to the QBCC about the financial wellbeing of licensees.

Industry Regulator’s Audit Program Boosts Compliance N otifiable work, as most licensees will be aware, is a type of plumbing and drainage work which was introduced in 2012 to reduce the administrative burden on plumbers, drainers and fire protection workers. Prior to notifiable work, licensees were required to obtain a permit and arrange for the work to be inspected on completion by local government. Assistant Commissioner for the Queensland Building and Construction Commission (QBCC), Esther Blest, said that today when a licensee completes work classified as ‘notifiable work’,
they must lodge a Form 4 to the QBCC within 10 days of completing the work. “The QBCC conducts an audit program that includes licensees, companies and other entities such as real estate agents to make sure licensees comply with their obligations. “In 2016, the QBCC’s audit program mainly focussed on the hot water industry, which enabled the QBCC to engage with companies performing this work, educate about the requirements of Form 4s and help raise compliance. “As a result of last year’s audit activities, the number of Form 4s lodged increased from 52,000 in 2015 to 77,000 in 2016.”
Ms Blest extended her thanks to all those licensees who complied with the laws for doing their part to help protect the plumbing and drainage industry, and the health and safety of Queenslanders. “Notifiable work is an essential part of plumbing and drainage regulation in Queensland, which allows work to be done quickly and cost-effectively without compromising our high standards. “It is great to see that so many more licensees are coming on board and complying with these laws.” Ms Blest said that given the audit program was a legislative requirement, the QBCC intended to continue the program in 2017 with random audits of approximately 500 licensees and companies planned to take place across Queensland. She said that this should serve as a timely reminder to all licensees to make sure they are lodging their Form 4s on time. The QBCC’s audit program is available on the QBCC website (www.qbcc.gov.au). new ‘notifiable works’ (NW) online service is set to replace the current plumbing application service (PAS) in the coming months, with the first suite of system enhancements scheduled to roll out by the end of this financial year. Assistant Commissioner for the Queensland Building and Construction Commission (QBCC), Esther Blest, said that the new system would be easy-to-use and more reliable than the problematic PAS. “In the new system, licensees can search for site addresses and take advantage of improvements made to the ‘type of work’ selections that will
make it easier for them to correctly submit their NW forms (Form 4/4A),” she said. Ms Blest said that plumbers, drainers and local government authorities alike have been integral to the consultation process, with council representatives providing insight into the challenges posed by the current system from a regulatory and auditing perspective. “Access to the new NW service will be via QBCC’s online portal, myQBCC, which plumbing contractors who pay Queensland Home Warranty Scheme policies online may already be familiar with. “This means that plumbing and
drainage licensees will soon be able to conduct all of their submission and payment functions in a one-stop shop so they can save time and get on with the rest of their day.” She said that it was important for licensees to ensure that the QBCC had their current contact details, including their email address, so that they were informed of system changes. Any licensee who would like to update or check their contact details is able to do this online at my.qbcc.qld.gov.au (licensees who are new to myQBCC will need to create an account and provide their current email address as part of the registration process).

What is a Confined Space? From time to time, Workplace Health and Safety Queensland (WHSQ) receives enquiries as to the definition of a confined space under the Work Health and Safety Regulation 2011 (the Regulation). As new construction methods and technologies arise, so do new types of confined spaces that can test the definition. It’s important for plumbers, drainers and gasfitters to know exactly what confined spaces are so it is easy to identify one when you see it. You are required to comply with the relevant safety regulations regarding confined spaces. The following material expands on the guidance provided in the Confined spaces code of practice 2011.
Defining and Identifying a Confined Space In the Regulation, a confined space is defined as follows:
Confined space means an enclosed or partially enclosed space that— (a) is not designed or intended primarily to be occupied by a person; and (b) is, or is designed or intended to be, at normal atmospheric pressure while any person is in the space; and (c) is or is likely to be a risk to health and safety from— (i) an atmosphere that does not have a safe oxygen level; or (ii) contaminants, including airborne gases, vapours and dusts, that may cause injury from fire or explosion; or
In order to be classified a confined space, it must be an enclosed or partially enclosed space and both clauses (a) and (b) must be true and at least one of (i), (ii), (iii) and (iv) must also be true.
Risk Assessments are Essential The Regulation requires a risk assessment to be conducted once a confined space has been identified. However, for cases where a confined space is suspected (clause (a) and (b) true) and it is not clear whether there is a risk to health and safety from any of the hazard types (i) to (iv), a risk assessment can help to identify the presence of these hazards.

This somewhat complex definition is often misunderstood. This has led to instances of workers/supervisors in control of a confined space failing to identify it, and allowing people to enter the area without the necessary precautions in place.

ith the recent incident of the three family members who died at a rural property in New South Wales from suspected gas poisoning, MPAQ would like to express our deepest condolences to the family. Subsequently, we would like to ensure our industry is aware and informed of what’s involved with confined spaces and what the risks are associated with working in them.

Risks of Confined Spaces
The consequences of any of the hazard types (i) to (iv) materialising in a confined space can be serious or fatal, and the rescue of workers often difficult and dangerous. As such, if there is doubt as to the classification of a confined space, it’s best to be conservative and treat it as a confined space. For any below ground space, it may not be possible to rule out the risk of atmospheric contamination or engulfment, therefore these spaces should generally be considered to be confined spaces.
Domestic Roof Cavities and Crawl Spaces Roof cavities and under-floor crawl spaces in domestic houses are generally not classified as confined spaces as there is negligible risk of atmospheric contamination or engulfment if a person enters to perform work or inspection. However, if certain hazards are introduced (gas flame brazing torches or flammable solvents), then a risk to health and safety from atmospheric contamination may arise and the space could be classified as a confined space. Anyone planning to enter a roof cavity or crawl space should consider what hazards might be present or introduced when they enter. The space should be classified accordingly. (Note: leaks from small propane or MAP gas cylinders have caused serious explosions in work vehicles and the same could happen in a roof cavity or crawl space.) Of course, when you’re working in confined spaces you are not immune from the general dangers of your job, such as exposure to UV (solar & welding), asbestos, trenching (possible collapse), hazardous chemicals, manual tasks and underground services (power, gas, water etc.). The World Health Organisation (WHO) estimates that each year 2.4 million deaths are caused by unsafe water and lack of sanitation. 90% are children under the age of five, mostly in developing countries. The WHO estimates that 88% of diarrhoeal disease is attributed to unsafe drinking water supply and inadequate sanitation and hygiene.

Water can be the bearer of dangerous contaminants in the form of bacteria, viruses and protozoans. These include bacteria such as toxigenic Escherichia coli and Campylobacter, viruses like Norovirus and Hepatitis E, and protozoans like Giardia and Cryptosporidium. The risk of infection and disease and the public health burden is determined by the severity of illnesses that are caused by the pathogens, the extent of the exposure, their infectivity, and the physical condition and susceptibility of the exposed population.

Microbial Growth in Plumbing Since the end of the 19th century the main health focus for drinking water supply has been on microbial risks. Microbial contamination remains the most significant, imminent and large scale manageable risk associated with drinking water when water is not properly managed.
Four out of 10 people (approximately 2.4 billion people) are without adequate sanitation. This figure will rocket to half the world’s population by 2025.
Heterotrophs Microorganisms grow in drinking water distribution systems, especially in the absence of a residual disinfectant. The principal determinants of growth of heterotrophs are lack of disinfectant residual, warm temperature, availability of nutrients including organic carbon, and stagnation. Most heterotrophs are not harmful to healthy persons, but they can be a nuisance by generating tastes and odours or discoloration of water supplies.
Legionella Legionella are among the exceptions to harmless growth organisms in distributed water, and they are not measured by HPC tests. Legionella can grow to significant numbers in warm waters, hot water heaters, hot tubs, hot water lines and shower heads, and probably in the plumbing systems of large buildings, and in cooling towers for air conditioner heat exchangers.
Pseudomonas aeruginosa Pseudomonas aeruginosa microorganisms also grow in piped plumbing and distribution systems and on devices under the conditions cited above. They can cause a range of infections but rarely cause serious illness in healthy individuals. Getting Your Mind into the Gutter Achieving compliance through the Acceptable Construction Practice (ACP) of NCC Volume Two
T
he National Construction Code (NCC) has a number of requirements to ensure rainwater that is collected or concentrated by a building is disposed of in a way that prevents water entering a building or damaging other properties. Compliance can be achieved through various means but one method in particular, which was revised for NCC 2016, is the Acceptable Construction Practice (ACP) in Part 3.5.2 of Volume Two. This ACP, entitled ‘Gutters and Downpipes’, provides a prescriptive Deemed-To-Satisfy (DTS) Solution for Class 1 and 10 buildings for eaves gutter design, acceptable overflow measures, and downpipes appropriate to different gutter designs. It can be applied not only through Volume Two but also Volume Three, the Plumbing Code of Australia (PCA), through its reference in Part D1.
How are eaves gutters designed?
Eaves gutters are designed based on two parameters: the roof catchment area size (M2;) and the rainfall intensity for the location (20 year 5 minute duration (mm/h)). These parameters are used to determine the appropriate eaves gutter type for the roof, ranging from Type A to F. They are further defined by shape and cross-sectional area.
Downpipes
Once an eaves gutter type has been chosen, selecting the downpipe is simple. The acceptable downpipe types are based on the chosen gutter type. Downpipe location is important as each downpipe can serve no more than 12m of gutter length. They should also be located as close as possible to valley gutters.

Overflow from eaves gutters

Overflow measures are part of the design process of eaves gutters and downpipes. They are provided to allow rainfall to be removed from the roof based on a 5 minute duration rainfall intensity with an average recurrence interval of once in 100 years. The required overflow volumes are calculated in isolation to the gutters and downpipe design. This ensures that no rainwater will enter the building in a 100 year rainfall event, even if the downpipes are blocked. For eaves gutters, this is achieved by two overflow measure options: continuous and dedicated. Continuous measures operate over the length of the gutter while dedicated measures account for overflow in a given location along the gutter. The two options can be used separately or together to meet the required overflow volume of a 100 year rainfall event.

They say the “ticking time bombs” are present in many new homes and apartments built in Australia over the past 10 - 15 years. Forensic plumber Russell Kirkwood, who looked at thousands of homes over the past decade in his role with insurers and as a consultant, said he believed the vast majority of homes built during this period had the fault.

In extreme cases of high UV exposure, materials engineer Trevor Rowlands said they might only last years rather than decades. “If there’s then a gas leak and it’s not detected ... there would be a risk of a gas fire and in a worst case scenario potentially an explosion,” he said. Mr Rowlands said a source of ignition such as a spark from a lawn mower, cigarette or naked flame could cause an explosion. Depending on the proximity of any leak, the gas could also enter the house and make the occupants ill. “This is a major safety issue,” Mr Kirkwood said. Increasing Awareness of Legionella I
n June 2013, an outbreak of legionella at the Wesley Hospital raised awareness about the dangers associated with this disease. While legionella is just one of many water-borne diseases, its high mortality rate means that it continues to get media attention. Assistant Commissioner for the Queensland Building and Construction Commission (QBCC), Esther Blest, said that while many safeguards have been introduced to prevent infections since then, due to the high risks associated with legionella it remains an important topic for the plumbing industry. “Legionellosis is a collection of infections that emerged in the second half of the 20th century. “The severity of legionellosis varies from mild febrile illness (pontiac fever) to a potentially fatal form of pneumonia (legionnaires’ disease) that can affect anyone, but primarily affects those who are susceptible, due to age, illness, immunosuppression or other risk factors.”

Ms Blest said that legionella was a well-recognised problem in developed nations, although data was scarce.

“We know that water is the major natural reservoir for legionella, and the bacteria are found worldwide in different natural and artificial aquatic environments with a range of environmental conditions. For example, it may occur in water systems in hotels and ships, or even respiratory therapy equipment. “The fact that legionella are found in hot-water tanks or thermally polluted rivers emphasises that water temperature is a crucial factor in the colonisation of water distribution systems. “Legionella has been shown to be able to withstand temperatures of 50°C for several hours, but does not multiply below 20°C,” she said. Ms Blest said that it is for this reason that the recommended temperature for storage and distribution of cold water is below 25°C and ideally below 20°C. “It is important to be aware that mains water temperature in Queensland may be well above these recommendations
during the warmer months, and the presence of legionella in an aquatic environment and warm temperatures are factors that can increase the risk of Legionnaires’ disease.” She said that the presence of biofilms is also a factor in legionella survival and growth in water systems. “Legionella are found in sources such as distributed drinking-water supplies, which then feed into water systems within buildings and cooling towers, accounting for the bacteria’s presence and subsequent growth in these artificial environments. “The high risk of legionella has been recognised with hospital and residential aged care facilities now required to have a new Water Risk Management Plan (WRMP).” Ms Blest said that the WRMP requirement was introduced as part of an amendment made to the Public Health Act 2005 last year, and plans needed to be in place by 1 February, 2017. “The purpose of the WRMP is to improve the management and control of health risks associated with the supply and use of water in these facilities, in particular, the health risks associated with legionella bacteria. “The WRMP must include testing for legionella bacteria, and it is a requirement for reports on the testing to be provided to Queensland Health,” she said. She said that it was recommended that the team responsible for developing the WRMP included a person from building maintenance, who could provide expert advice on the water distribution system and water quality. This person may be a plumber. If a plumber is approached by a hospital or residential aged card facility to assist with developing a WRMP and/ or to undertake work associated with such a plan, there is useful information about WRMPs, including a template on the Queensland Health website: www.health.qld.gov.au. At the start of the year, a Brisbane-based business operator was fined a total of $50,000 for fraudulent activity, which included sending businesses invoices for unsolicited services and making false and misleading representations. These kinds of scams are more common than you might think, with ScamWatch reporting that there were 14,634 reports of false billing scams over 2016. With the pressures of deadlines and workloads, sometimes business owners just don’t have the time to double check every invoice they are paying, especially when being pressured for payment. Time poor businesses are being targeted because they are likely to pay an invoice without enquiring into it too deeply.

What the Flush!? Scientists Use Solar-Powered Machine to Turn Urine into Beer
M
ankind has been turning beer into urine for centuries. Leave it to science to find a way to reverse that process. From sewer, to brewer. Scientists at Belgium’s University of Ghent say they’ve created a machine that turns urine into potable water, and fertilizer, using solar energy. The scientists have since crafted small batches of Belgian ale from the recycled water. The machine collects urine in a big tank which is then heated in a solar-powered boiler. As the heated water evaporates, it passes through a membrane, which separates the H2O from nutrients like phosphorous and nitrogen. Those nutrients can then be used to enrich fertilizers for plants. The water is then diverted to a separate tank.

Since the system requires no electricity, the researchers hope it can be used to provide clean drinking water for people in developing countries. According to Derese, the process could help organize agriculture in a more sustainable way throughout many rural communities more susceptible to drought.

ichael Caine is an Academy Award winning legend of the big screen. Having been knighted by the Queen in 2000, and with many iconic roles in films that have captured the minds and hearts of three generations, it is easy to forget that Caine once lived a humble life in London, England as the son of fish market porter and a cook. Before landing his breakthrough role in Zulu, he had to perform manual labour to make a living. After his service in the Korean War, he worked many jobs, including time spent as a plumber’s assistant. But plumbing wasn’t meant to be for Caine, and he has gone on to become one of Hollywood’s most loved and respected faces.
But the system can also be used for commercial purposes to quickly purify water where there are a lot of people—who have to go to the bathroom a lot—like sports stadiums, shopping malls and airports. Scientists recently presented the machine at a 10-day music and theatre festival in central Ghent, using the slogan #peeforscience, according to the New York Daily News. The team recycled 1,000 liters of water from urine collected at the event. Now the scientists plan to use that water to brew even more of their signature “Brewer to Sewer” beer. Stealing Staff and Customers Former employees “stealing” staff and customers on the rise… How employers can fight back.
I
t seems like every week there are stories of where a business owner has had a former employee either steal their customers, steal their staff or steal their systems/other intellectual property. In some cases, customers, staff and intellectual property have all been targeted. While sometimes this is simply down to unscrupulous former employees, the real fault and solution often lies at the feet of the employer. Commonly, senior staff are not bound by appropriate restraints when they could quite easily have been if the employer had been on the ball. Employers who have found themselves in this position can sometimes rely on the equitable obligation of confidence implied as a matter of law. Where the employer is a company, they can often invoke the protections set out in sections 182 and 183 of the Corporations Act. However, where the employer is not a company and even quite often where it is, without a specific clause in the contract of employment, it is difficult for the employer to stop a former employee from wreaking damage to the business after they leave.

When it comes to stealing staff, there is no implied term at common law, and if you do not have a clause in your contract of employment or other agreement with your staff member restricting the right of a departed employee to approach your staff, there is usually nothing you can do about it.

Many employers also fail to protect their important intellectual property, paying no regard to IT security within the business. Sometimes the theft of intellectual property is obvious. Other times it is more difficult to detect. In these circumstances it can often pay to use a forensic IT investigator. By examining the former employee’s computer and any other devices which they used whilst they were working for you, an IT investigator with forensic skills can uncover all sorts of inappropriate conduct by a former or even existing employee, which you were completely unaware of. In a recent case with McKays Solicitors, after the client consulted them, they arranged for a forensic IT investigator to go through the former employee’s computer and devices, such as mobile phones he had been using. The investigator found that the employee had downloaded to a USB drive enormous quantities of the business’ records, including its financial records and had been making repeated calls to eight of the business’ most important clients for months before he left, even though he was not doing any work for them. Ultimately, the investigator’s evidence proved critical in successfully pursuing the former employee and putting an end to the ongoing damage.

Be cautious as to which employees you allow access to certain business records
Be forever vigilant and do not assume that your employees are not looking at information and records they should not, and never assume that nobody is downloading what they should not Keep an eye on the telephone records of your employees, particularly senior staff and certainly any of those you have suspicions about Ensure you have proper employment contracts by which the employee agrees to be restrained from poaching staff, stealing customers and setting out clearly that all intellectual property created on the job belongs to the business. They should also clearly set out that all records, such as emails and telephone calls, may be inspected at any time without notice If you have doubts or suspicions, do not just cross your fingers but do something. First, call an employment lawyer so you can be sure exactly where you stand and secondly, give serious consideration to engaging a forensic IT expert to examine the records at work.
