elcome to the July/August 2017 edition of the Master Plumber Magazine!

The second half of the year is here… how many days until Christmas? July is one of the best months of the year, because it’s the time of year we run our Plumbing & Gas Industry Awards dinner. The amount of time and effort put into this event is phenomenal, not only from the Events and Communications team, but also the rest of the MPAQ office, the sponsors, judges and various other people. The event is such a good cause though, it’s exciting to see people in our industry win something of significance, to have some form of recognition for how great they are. If you’re coming along, I hope to see you there. If you aren’t coming yet, you should! So far this year, the Events team have run 17 events, with 14 left to go. We’ve covered Brisbane, Toowoomba, Mackay, Townsville, Cairns and the Sunshine Coast so far, and we’re recharging our batteries in preparation for the rest of the year. As our Treasurer, Mr Salmon says, “Our focus is as clear as potable water.” All the hard work that goes into these events is worth it when we get to meet people from the industry all over the state, who express their gratitude for our visits. Most notably for me was the Mackay Bowls Day – thanks Dave for the ride to the airport! Launched in June was MPAQ’s Toolbox Rewards for Contracting Members. What’s cool about this new initiative is that the MPAQ staff also got to sign up with an account. I save about $50 a month on my groceries at Woolies, which equates to over $600 a year. That’s a new pair of heels, and the Mimco handbag I’ve been wanting for months! I also bought my Dad a new BBQ for Father’s Day in September (if you’re reading this Dad, look away. Also, brownie points to me for being so organised). Using my highly advanced negotiating skills, I managed to bargain a sweet deal at BBQ’s Galore. Then to top it off, I bought a voucher from the MPAQ Toolbox Rewards and saved another $65. If you’re a bargain hunter and love saving money, I’d strongly suggest you sign up. Executive Director 2017 – 2018 State Budget

Small Business

he 2017- 2018 Queensland State Budget was released on Tuesday 14 June with a theme of ‘Jobs for Queensland’. The Hon Curtis Pitt MP, Treasurer and Minister for Trade and Investment delivered the Palaszcuk Government’s third budget. Jobs, supporting the regions, infrastructure and household bills are the focus for the 2017- 2018 budget, which also focuses on paying down debt and improving business confidence.

The government is contributing to the successful initiative of raising the payroll tax rebate for apprentices and trainees from 25% to 50%. Employers who hire apprentices will receive a payroll tax rebate of 50% on their wages in addition to their wages being exempt from payroll tax until 30 June 2018. The rebate will be used as an offset against payroll tax payable on the wages of other employees, and will enable Queensland to continue developing a highly skilled workforce into the future.

Of particular interest to the building and construction industry is the Housing Strategy which promises to boost construction across the state with 4,000 new social housing dwellings planned for the next five years, six hundred of which will be built in the first year. As part of the Strategy there is also a commitment to unlocking government land and working with the private sector to deliver more housing.

Advancing Small Business Queensland Strategy 2016 – 2020, was launched in 2016 and is continuing to create an environment for small business to flourish, including being a strong advocate for small business, simplifying service delivery and connecting small businesses to opportunities.

I

t would seem we may well be going to the polls again before the year is out to vote in a State election. Nothing is certain but that seems to be the scuttlebutt going around. The very thought may well have some saying who cares? Well for one, I certainly do care. Not because I look forward to sitting in front of the tele on election night watching and listening to political commentary and all the political theatrics that go with it, but for what currently is on offer to the construction industry, as well as what has recently happened and what should be done about it. I am talking about two subjects that have far reaching implications and how they affect the community in general. They are security of payments and non-conforming products. Both of these topics have certainly been a discussion point in recent times and have been discussed in both Federal and State government arenas. Regardless of where your political elegances lie or where you operate in the construction sector or trades, you would have to agree that both of these topics in one way or another need improvement. I have written about and discussed the security of payments issue in previous ramblings, as recently as the last issue, so I wont rehash it again now, but SOMETHING HAS TO CHANGE! Non-conforming products are just as big an issue and have the potential to be very deadly. How so you ask? Well here are two examples. Firstly, the Grenfell Tower blaze in London which happened in June this year. Lives were lost and there was a warning given about the potential and very real danger well before the fire. A very sad event indeed. Secondly, the new children’s hospital in WA where two very concerning situations have surfaced. Following water sampling, lead was found in the water supply within the building. Fingers are being pointed in the direction of possibly non-conforming products being used in the water services within the building. The other concern is that asbestos was apparently found in the ceiling tiles within the building. The tiles reportedly imported from china were asbestos free, as anything containing less than 5% asbestos is considered ‘asbestos free’. Now I ask you, would you send your sick child or grandchild to such a hospital? We are in the year 2017 not 1977. How do such things occur? I am a business owner and I am certainly focused on the profitability of my business, and no doubt the same goes for the builders of this new health care facility in Perth, but it would seem the focus has been taken to a new level without regard for the potential affect on the very community the facility is being built to serve.

I have a comment I wish to direct towards Federal and State politicians.

“Have the courage and the fortitude to do something about these two very real issues!” If one of your family members was killed in the Grenfell Tower fire, you would certainly be motivated to do something about it. Any change regarding non-conforming products in the Federal arena directly affects policy related to the Free Trade Agreement currently in place, and consequently the sometimes dreaded term ‘The Global Economy’. My own views on this are: 1) We are not a dumping ground for product or dangerous material that we did away with decades ago. 2) Our local industry invests heavily to produce conforming fit for use products. The Free Trade Agreement should not be seen as an easy way for industry outside Australia to short step our standards and certification processes. 3) The health and wellbeing of the Australian community should always be put first and foremost. Now having said all that, I know the Palaszczuk government has an agenda to introduce policy to change the current issue on non-conforming products and security of payments, but I am doing my best here to remain apolitical. I have previously acknowledged the work being done by the Hon Mick de Brenni MP, Minister for Housing and Public Works and Minister for Sport for his work in this area and I do so again. Well done Sir. I am also trying to ignite a political debate on these two life affecting, physically and financially devastating topics. I urge everyone to consider these issues and talk to your local member, regardless of which political party you belong to. Ask them what they know of the issues and what, if anything, they are prepared to do about it. Judge for yourself whether they are genuine about it and make your own decision as to what you should do about it.

The increase only applies to employees that get their pay rates from the national minimum wage, a modern award or in some cases a registered agreement.

Any premium increases are regretted, however they are essential to ensure the continued sustainability of the Queensland Home Warranty Scheme, which provides peace of mind to Queenslanders.

The new national minimum wage will be $694.90 per week or $18.29 per hour. The national minimum wage applies to employees who aren’t covered by an award or agreement. The Fair Work Commission have issued draft determinations and orders about how this decision affects each modern award. MPAQ have issued the new wages information sheets for 2017 – 2018 on the MPAQ Website under Workplace Relations (www.mpaq.com.au). Improving the Compliance Assessment Process T he compliance assessment and inspection process in Queensland maintains the highest standard of design and installation of plumbing systems in Australia. The system we have in this State is regularly held up by other States as a model they would aspire to. In saying this however, the system can be quite onerous and complicated, particularly for simple projects such as small tenancy fitouts. Changes in legislation in 2012 allowed for certain plumbing jobs to be completed under a Form 4, Notifiable Minor Work. This negates a full compliance assessment and helps to streamline the process for projects that meet the criteria. Most consultants saw this as a positive step, even though it probably cost them some of the design work that they had performed up to that time. However, the compliance assessment of plumbing designs, with all its positives, is also the cause of the most frustration for hydraulic consultants and their clients.

Hydraulic consultants produce documentation that is coordinated and suitable for tender/construction, however to meet the overall design and construction program, they are generally required to submit drawings to Council as early as possible, in order to alleviate any delays to starting work on-site. The plumber/ drainer is normally one of the first trades on site to carry out in-ground drainage installations. This cannot begin unless a compliance permit has been issued by Council.

Hydraulic consultants face the dilemma of needing to complete several tasks simultaneously, beginning with the approval of documentation and its lodgement to Council. While the compliance assessment is carried out, consultants continue to coordinate their designs with the design team and, following on those decisions, produce their tender documentation. Should they need to change their drawings substantially in this process, a revised application to Council may be necessary. The submission process has been made somewhat easier with most Councils, where they allow drawings to be

lodged electronically together with the relevant fees. These fees (aside from the plumbing inspection fees) are sometimes in excess of what the consultant is paid for completing their design documents (including any subsequent changes during the tender documentation process), particularly on larger projects. The compliance assessment carried out by Council can take weeks, provided Council do not find non-compliance issues or determine insufficient fees have been paid. If this is the case, an information request is issued and the process is halted until the item raised is addressed, delaying completion further. Issues that can sometimes catch the consultant out in this process are generally related to specific Council requirements that depart AS/NZS3500 and are, for whatever reason, undocumented by that Council. The most frustration however is after the compliance permit has been issued and the plumber has started the installation. Consultants are constantly faced with the Council inspectors defecting installations that comply with the approved drawings. This leads to claims of variations, delays on-site and embarrassment with their clients. Many consultants have lost clients on this issue. The Association of Hydraulic Services Consultants (AHSCA) finds that this particular issue is the cause of most complaints by consultants during their meetings. The question is constantly asked, “Why are we paying fees to Council for compliance assessments when the approved drawings are then not being honoured by them?” The fees paid to council for this assessment can be substantial and sometimes more than what consultants are paid to complete the design and documentation. The payment of these fees must then require Council to carry a thorough compliance assessment and not a cursory overview. Form 4 or Form 1 for Trade Waste? A

s a licensed plumber you should be aware of each water or sewer authority’s trade waste categorisations. For example, what is considered trade waste under one local authority may not be considered trade waste under another. Some of the below categories are sometimes found to have been installed under a Form 4, when they should have been installed under a Form 1: • • • • • • • • •

Bars Clubs (without cooking) Hairdressers Beauty Salons Veterinary Practices Community Halls Kitchens School Canteens Commercial Swimming Pool Backwashes Cooling Pits

If the client informs you that there is no trade waste (which they could be aware of because they have asked the local council if a grease arrestor needs to be installed) it doesn’t mean it can be under a Form 4 as opposed to being lodged and approved under a Form 1. For example, a hairdresser requires a trade waste licence but doesn’t require a grease arrestor, so it therefore requires a Form 1 to be submitted. Another item which may require a Form 1 to be submitted is anything that requires a cooling pit to cool the discharge before entering the sewer. For example, a tenancy that only washes kitchen utensils or new machine parts with water to remove the oil may be required to be submitted as a Form 1 due to the temperature of the water being discharged to sewer, even though no dangerous chemicals are being used and only very minor trace oil is being sent to the sewer. If in doubt, always ask your service provider, hydraulic consultant, the plumbing inspector or your local trade waste inspector for advice. After all, it is your licence on the line. Removing Heatpumps W

hen a heatpump water heater is removed or replaced, what is being done with the old unit? A few members have posed the question to the MPAQ Technical Team on how to properly dispose of the refrigeration units that contain refrigerant gasses. Plumbers performing maintenance on water heaters often replace faulty or malfunctioning units. Disposing of the old unit has various options, as there is a scrap value if either you organise the disposal of the old steel/copper tank for your customer to the local scrap dealer or rubbish tip, or the owner may choose to dispose of it themselves. This isn’t a complicated job as most scrap merchants/rubbish tips will take the unit as is, although some will pay a higher scrap value if the case and insulation are removed from the tank prior to scrapping. All well and good for your average storage cylinder, but not so much with the average heatpump. Heatpumps are comprised of a storage cylinder and refrigeration unit. Some units are integral and some are split (remote) from the cylinder, either way, the refrigeration unit cannot just be dumped or scrapped whilst it contains the refrigerant gas. If the heat pump hot water system contains refrigerants which come under the Australian Refrigeration Council (ARC) Tick Licence Scheme, then there is a legal obligation for this gas to be recovered by an appropriately licensed person through the ARC, before the systems are discarded/recycled, where there is a risk that the gas may be emitted. ARC encourages plumbers removing heatpumps to engage an appropriate ARC licensed person to recover the gas prior to disposal of the systems to landfill or a waste transfer station. Discharging fluorocarbon refrigerant is illegal under the Ozone Protection and Synthetic Greenhouse Gas Management Act 1989 and potential penalties of up to $54,000 for individuals and $270,000 for corporations may apply.

QBCC Assistant Commissioner, Esther Blest, said that QBCC investigators interviewed nine individuals from 13 building sites to ensure plumbers, drainers and fire protection workers on the job were appropriately licensed.

In a report from The Guardian1, a leading Australian fire safety engineer has compared the task of removing flammable aluminium cladding from high-rise buildings in Australia (the same as the material blamed for the London disaster) to ridding the country of asbestos, saying it could affect tens of thousands of buildings. According to Safety Experts, Australian buildings have this material in thousands of structures across the country.

Introduction of a New Amendment Bill

On Thursday 25 June 2017, the Hon Mick de Brenni MP, Minister for Housing and Public Works and Minister for Sport introduced the Building and Construction Legislation (Non-conforming Building Products - Chain of Responsibility and Other Matters) Amendment Bill 2017 into Parliament. The Bill has gone to the Public Works and Utilities Committee, where it is to report by 7 August 2017. The primary functions of the Bill are to: • Confer responsibilities on the building product supply chain participants that ensure a building

product, so far as reasonably practicable, is not a non-conforming building product. • Enable the Queensland Building and Construction Commission (QBCC) to ensure buildings are safe and better align its powers with those of other Queensland safety regulators. • Facilitate safety on building and construction sites by requiring QBCC licensees to notify the QBCC about activities on a site that might present a work health and safety issue. • Require the QBCC to report to regulatory agencies about work health and safety issues, where there is a serious injury or death. • Enable the QBCC to enter into information sharing arrangements with other regulatory agencies, particularly in relation to work health and safety issues. • Widen grounds for the QBCC to take disciplinary action against a licensee, to include convictions relating to laws that can impact on health and safety or if the licensee’s work on a building site may have caused a death, grievous bodily harm, or a serious risk to the health or safety of a person.

The current responsibility for the use of non-conforming building products is placed solely with the installers and licensees of the QBCC. The proposals in the Bill will place this responsibility for the safety of building products and their use with participants along the supply chain, to ensure reasonable actions are undertaken so that building products are fit for the intended purpose, safe and that sufficient information is provided by participants to facilitate this outcome. The participants of the supply chain are defined as designers, manufacturers, importers, suppliers and installers. A non-conforming building product is defined in the Bill as a building product for an intended use: • If the association of the product with, or could be with, a building for the use is not or will not be safe, • If the association of the product with, or could be with, a building does not comply with the relevant regulatory provisions, or • If the product does not perform, or is not capable of performing, for the use to the standard it is represented to perform.

Powers after entry will also allow an inspector to search an entered place and search for or seize documents and other evidence of offences, as well as non-conforming building products and dangerous places. They will also be empowered to direct and even undertake remedial action to make a place safe in emergency situations. Safeguards have been included and these powers are generally similar to those provided for under similar safety legislation. The powers will allow QBCC inspectors to effectively discharge their responsibilities as a safety regulator.

Enforcement Provisions

Additional Inclusions In addition, the Bill: • Amends the QBCC Act to provide a positive obligation on QBCC licensees to notify the QBCC about any activity on a site that might present a work health safety issue. • Provides in the QBCC Act that QBCC licensees have a positive obligation to notify the QBCC that if the licensee believes that a person has failed to comply with an order or notice issued by the Electrical Safety Office.

This will ensure compliance early in the supply chain, as well as maintain safety during the installation stage of a product’s life-cycle.

The Bill provides for enforcement provisions such as the acceptance and enforcement of undertakings relating to compliance with provisions, as well as appropriate penalties to establish a deterrent effect, allowing courts to apply meaningful and appropriate penalties and to emphasise to the community the seriousness of the offences under this legislation. The Bill also grants the Minister powers to issue a recall order and to publish a warning statement about a non-conforming building product. These powers are designed to raise public awareness of a non-conforming building product, enforce compliance by affected participants of the building product supply chain and withdraw a product or batch from the marketplace for safety reasons. These powers are intended to

• Amends the QBCC Act to enable the QBCC to enter into an information sharing arrangement with other regulatory agencies, in particular work health and safety regulators. Information can be shared if the information helps the QBCC or the other agency perform its functions or disclosure of the information is reasonably necessary to protect the health or safety of a person or property. • Amends the QBCC Act to provide a positive obligation on the QBCC to report to health and safety agencies about a notifiable incident. A notifiable incident is the death or serious injury to a person or an incident that exposes a person to risk of serious injury or illness.

• Expands the grounds upon which the QBCC may take disciplinary action against a licensee, or suspend or cancel a licence, to include where a licensee has been convicted of an offence relating to work health and safety laws or if the licensee’s work on a building site may have caused the death of a person, grievous bodily harm or a serious risk to the health or safety of a person. Minimum outlet size requirement is an important element of plumbing regulations as a surface drain with too small an outlet for wastewater will not be compliant. ll Type A gas devices are natural gas or LP gas appliances used in domestic, recreational or light commercial areas that have an appliance badge. All Type A gas devices must be approved/certified by the Chief Inspector of the Petroleum and Gas Inspectorate, or by a person or body approved by the Chief Inspector. It is an offence under the Petroleum and Gas Act to operate a Type A Gas device in the absence of a Gas Safety Approval. The Queensland Gas Association (QGA) have an Individual Type A Gas Device Scheme, providing a cost effective and practical pathway for approval, allowing manufacturers and importers to produce or import one-off or low quantities of Type A gas devices. This ensures an acceptable level of safety while still allowing for market testing and gas device design innovation, without the financial burden of laboratory based type testing.

Assistant Commissioner for the Queensland Building and Construction Commission (QBCC), Esther Blest, said it is unlawful for persons to continue to perform plumbing and drainage work without applying for a licence once they have completed their apprenticeship. “Unlicensed individuals face hefty fines of $1,219 per offence for carrying out plumbing and drainage work in Queensland, and so do the supervisor and the employer.” “A supervisor can wind up with multiple fines if they are supervising multiple unlicensed people, so it is in their best interest to make sure those working onsite are appropriately licensed,” she said. The problem is that the domestic building requirements do not count value the same way. A deposit includes all demands for payment before physical work starts on site. So if no physical work has commenced on site when the materials are delivered, any demand for payment will be considered part of the deposit.

(a) is directly related to the progress of carrying out the subject work at the building site; and (b) is proportionate to the value of the subject work that relates to the claim, or less than that value. So if no physical work has commenced on site when the materials are delivered to site, the value of the work carried out on site is still $0, and as a result you cannot claim for any extra amounts at this time. Once the materials have been used and constructed as part of the building you can then demand for payment to the value of the work constructed.

A Simple System?

am a Registered Adjudicator under the Security of Payment Act. I have decided dozens of adjudication applications.

When introduced, it was intended that the Security of Payment system would be so simple that legal advice would not be needed. However, since the legislation is different in every State and Territory, contractors operating in different parts of the country find it quite confusing, given different requirements, different time frames and entirely different procedures are effective in each area.

One of the things that never ceases to astound me is how poorly prepared adjudication applications often are.

Why Many Adjudication Applications Fail I have dealt with an application where the applicant, even though they had a lawyer, didn’t include a copy of the contract in the application. In a number of other adjudication applications I have decided, the applicants have seemingly thought that all they had to do was put in the contract, their invoices and a statement that they have done the work. In any contested adjudication application, particularly where the other party has a lawyer, it will more often than not mean you will lose if you do not give me actual evidence proving that you have done the work.

As well as this, many adjudication applications involve hundreds of thousands, sometimes and even millions of dollars, vast quantities of documents and complex and confusing contracts with all sorts of ‘get out’ clauses in favour of the principals or builders.

Reference Dates – A Big Problem in Some Jurisdictions As those of you familiar with the payment claim systems in Queensland, NSW and the ACT will know, before you can send a payment claim you must have a reference date. In a contract which provides that you can deliver a progress claim, the date on which you can deliver the progress claim is the reference date. In all other cases the reference date is the last day of the month.

written into their ‘standard contracts’ clauses which restrict the number of reference dates. Many of those attempts have been rejected by the Courts, but not all.

Unfair Contract Laws to the Rescue Last year the Commonwealth Parliament passed legislation which deems ‘unfair contract terms’ unenforceable in certain circumstances. That legislation applies where one of the parties employs fewer than 20 people and the upfront price under the contract is less than $300,000 (including GST) or $1 million if the contract is to last more than 12 months. Given that almost all contracts for over $1 million will have a defects liability period of 12 months, they will be contracts which have a period of more than 12 months so the unfair contracts provisions will apply. Judges, tribunal members and adjudicators can now be asked to rule that a particular clause in the contract is ‘unfair’ and unenforceable. Bigger contractors can be caught in a very difficult position where the contract they have with the builder or principal has all sorts of unfair terms in it which they are bound by because the unfair contract legislation does not apply to that contract, yet in the sub-contracts they have with their own subcontractors, any such unfair terms would be unenforceable.

Project Bank Accounts A number of states have introduced Project Bank Accounts (PBA) or are planning to do so. At this stage, the PBA systems in place, and even those which are proposed to be introduced in other jurisdictions such as Queensland, are quite limited but they might ultimately help subcontractors and prevent builders from withholding payment without justification.
