Editor’s Note Lisa Hilton Editor Welcome to the March/April edition of the Master Plumber Magazine for 2016! We’re stepping in to March already, time flies when you’re busy! The year is in full swing and it seems like everyone is making 2016 their bigger and better year. There’s plenty to read in this issue of the Master Plumber, including details of the recent Security of Payments Sessions, where the Department of Housing and Public Works released a discussion paper to request feedback from industry on the payment process from sub contractors. For those businesses with employees, make sure you prepare for the Easter weekend and other public holidays coming up. The Workplace Relations team have prepared some useful information on page 18. MPAQ have committed to running more events in each of the regions in 2016. Based on survey responses from members in 2015, we have scheduled golf days throughout the year to give plumbers and gasfitters the chance to network and enjoy a social outing with like-minded people. World Plumbing Day is an international event celebrating the important role plumber’s play in protecting community health and the environment. MPAQ’s celebration of World Plumbing Day with the industry’s biggest breakfast in Brisbane will emphasise how important the Association feels recognising plumbers on this day really is. With 2016 marking the seventh annual World Plumbing Day, we believe each year shows a growth in awareness of the importance plumbing plays in our society. Sadly, it is becoming more evident that plumbers no longer garner the respect that they once did. People forget how plumbing and sanitation has freed the populace from many diseases such as cholera, typhoid and dysentery. People have become complacent with the ease at which they can access fresh water by turning on the tap or disposing of waste with the press of a button. The World Health Organisation has declared plumbers, the most important front line health workers around the globe for their contributions to the delivery of clean water and the removal of waste via sanitation. The plumbing industry makes an extraordinary contribution to human health and the environment.
Plumbing & Gas Industry Awards Nominations are now open for the 2016 Plumbing & Gas Industry Awards Program. We are well and truly out and about doing what we need to be doing, working with you and for you. After thinking of what was happening around the place, it soon became evident that this year had gotten off to a flying start with much on our agenda. You have hopefully seen our various forms of media, advising of the meetings MPAQ have had with our new Minister for Housing and Public Works, the Hon. Michael de Brenni MP. At the Minister’s invitation, we have attended the Department of Housing and Public Works Security of Payments Seminars around the State, where he has met with some of our members in the various regions to find out firsthand your experiences and concerns with getting paid. At our first meeting with the Minister, he expressed his concern and interest in the welfare of family businesses. I found the Minister’s interest to be sincere which is very refreshing and encouraging.
Kelvin Slade, the Hon. Mick de Brenni MP and Penny Cornah MPAQ invested the required resources to ensure that we attended and were represented at as many of these meetings as possible. What will be done in this area following the road show? In a nut shell responses will be fed back to the government from three areas: •
The Security of Payment Seminars
•
Responses from open public submissions
•
Responses from the QBCC consumer and industry reference groups
There seems to be an appetite for change by the government in this area, which was confirmed by the Minister first hand at a recent Major Contractors meeting, so let’s hope something worthwhile comes from it. This is lobbying and representation at its finest, and is just one prime example of where your membership subscriptions are contributing to the betterment of our industry. From your perspective, it may seem like behind the scenes work, but in actual fact it is coal face, front line work where we have the opportunity by invitation to actually influence policy, again. In my last article I made mention of a change that is happening in the TAFE sector with regards to onsite assessments. I need to clarify that I cannot confirm if this
is happening throughout the state, but it certainly has been proposed by at least one campus, so I can see the potential for a flow-on effect happening. Innovation is a necessity in any business, but in this realm it cannot, and should not be offered purely as a cost saving measure that ultimately affects the integrity of the learning process and assessment model. Being a trainer and an employer myself, I can understand how this change would benefit all parties involved. But again I stress the need to maintain a high quality outcome in the learning and assessment process. Having spoken to many of our members across the state, I frequently hear the same comments regarding the level of knowledge their apprentices, or recently qualified tradies have. Interestingly, the Federal Minister for Vocational Education and Skills, Luke Hartsuyker recently released a statement stating that he supported a proposal by the Federal Education Department to crack down on the assessment process in training colleges in a bid to clean up the industry. He stated that “improvements in the process are well overdue” and that he “had received significant feedback from employers that people were presenting themselves to businesses without the skills they are supposed to have, given the qualifications they hold”. The statement goes on to say “an incompetent graduate that is deemed competent could have a negative impact on employers and the workplace, or seriously affect public safety”. Is this a revelation to the Government? It’s a long time coming in my opinion and unsurprisingly the Government is slow to react. The only detractors from such a move to clean the industry up would be those negatively affected by the actions taken. However, this is not the one quick fix to solving the apparent degradation of our training system. The issue is complex, which is far reaching and requires the input of all concerned. It also requires the federal and state governments to have the courage and fortitude to take the appropriate actions. So at the national level, MPAQ has representation with Master Plumbers Australia, who in turn have representation on various national committees. On 4 February 2016, it was reported that the Health Minister, the Hon. Cameron Dick confirmed the government will be introducing changes to legislation that will require private health care facilities and nursing homes into quarterly legionella testing with the test results will be made public, following recent legionella outbreaks. This all appears to be centered around the introduction of Water Quality Management Plans. When we have a better understanding of the legislative changes, MPAQ will then clarify what all this means for our industry. This is a much welcome change and something MPAQ has been lobbying successive governments to introduce for some time. All this my friends is how we work with you and for you.

Industry News New Version of the Plumbing Code of Australia The new version of the Plumbing Code of Australia (PCA) has been released and will become active as of 1 May 2016. The 2016 PCA calls up the new version of AS/NZS3500 (books 1 / 2 / 3 / 4), these will be called up as of 1 May 2016. Older versions of the standard from 1 May 2016 will be obsolete. Five Big Reasons to Consider Restructuring Your Business In the 2015-2016 Budget, as part of its Growing Jobs and Small Business Package, the government announced that it would provide Capital Gains Tax (CGT) roll-over relief to enable small businesses to restructure. This package stated that under new rules to be implemented, no CGT would be payable where small businesses changed the legal structure of their business. However, the Draft Legislation, released on 5 November 2015, goes a great deal further than what was foreshadowed by the Budget Papers. Not only does the new legislation provide for roll-over relief for CGT assets, but also for many other assets that small businesses commonly use such as trading stock and depreciable assets. This means that, in many cases, it may be possible to completely restructure a small business with no tax impost as a result. “Small business” for these purposes is defined as a business that has aggregated turnover of less than $2m and together with associated entities holds net assets that do not exceed $6m and is not an exempt entity or super fund. MPAQ Major Contractors Networking Lunch On Friday 5 February, the MPAQ Major Contractors held a networking event at the Stokehouse in Brisbane’s South Bank. Over 50 people attended this event, including representatives from the Major Contractors Group, partners of the group, the Interim Commissioner of the Queensland Building and Construction Commission, Kellie Lowe, Acting Chief Gas Inspector, Marshall Holmes and the new Minister for Housing and Public Works, the Hon. Mick de Brenni MP.
The Minister addressed attendees and discussed the recent Security of Payments Discussion Paper, the creation of the Interim Service Trades Council, his insights for future developments of the industry and the State Government’s plans for future expenditure in Queensland. Have Your Say The Department of Housing and Public Works released a discussion paper to request feedback from the industry about the payment process for sub contractors. The purpose of this review is to ensure the security of payments for sub contractors in the building and construction industry. The government understands that this is a complex problem, with no simple solution. The department has highlighted the key problems as being: • insolvency in the contractual chain that leave subcontractors unpaid for work they have already completed. This is a problem for both large scale head contractors and smaller businesses • retention money being used as cash flow by contractors and head contractors, instead of being kept aside for defects • protracted and unjustified delays in payment for work done • a lack of financial management skills in the industry The discussion paper lists five possible options, but this is not limited, voter options or suggestions are welcomed. This article will give a brief overview of each of the options listed in the discussion paper. Option 1 - Project Bank Accounts This option would introduce Project Bank Accounts (PBAs) for the building and construction industry, initially as a trial on government projects. Pending the outcome of the trial PBAs could be used on private contracts. A PBA is a trust account that is normally set up by the principal (the employer or person/entity requesting the work) and a head contractor. The account is set up with a banking institution to facilitate the prompt payment of progress claims by contractors. Option 2 - Retention Trust Fund Scheme This option proposes the use of a Retention Trust Fund Scheme (RTFS) to hold subcontractors’ retention money in a secure manner. A typical construction contract includes a form of performance based security. This security is used to pay for costs associated with: • late completion of work • work not complying with contractual requirements • remedying defects • non completion because of the insolvency of the subcontractor A RTFS requires a head contractor to hold retention money in an account with an authorised deposit taking institution like a bank. Head contractors can only withdraw money from the trust account as set out in the terms of the contract, otherwise financial penalties apply. A RTFS prevents the head contractor from using retention money as cash flow. Subcontractors are beneficiaries of the trust account, and are seen as secured creditors.

Option 3 - Insurance schemes The concept of retention money is similar in nature to an insurance scheme. For example, retention money is held by a contractor to essentially insure against: • late completion of work by the subcontractor • a subcontractor’s work not complying with contractual requirements • remedying defects in the subcontractor’s building work; and • non completion because of the insolvency of the subcontractor. This option proposes an insurance scheme to replace this concept and function of retention money. The insurance scheme would eliminate the need for contractors to hold retention money. This is important as it often represents the entirety of the subcontractor’s profit. Option 4 - Federal legislative changes This option proposes to change the balance of Corporations Law to better favour subcontractors. This option would seek to review relevant Commonwealth legislation including the Corporations Act 2001(Cth) and the Bankruptcy Act 1966 (Cth) to grant subcontractors a priority payment in the event a head contractor becomes insolvent. Such an option would require a collaborative approach with all estates and territories by lobbying the Commonwealth Government to review and amend legislation. Option 5 - Education This option proposes an education program to increase the financial and business skills of industry. This aligns with submissions to the Senate Committee. These submissions reveal that the building and construction industry lacks skills in financial management, particularly in smaller businesses. The discussion paper also requests feedback about the 2014 amendments to the Building and Construction Industry Payments (BCIPA) Act 2004. In order to obtain feedback from sub contractors the department have been running a number of consultation sessions across the State with the first one being held in Nambour. The Hon Mick de Brenni MP, Minister for Housing and Public Works and Peter Wellington, Independent MP attended the first session to hear first hand feedback from sub contractors. The Minister has also attended a number of other sessions throughout Queensland. MPAQ has attended a number of sessions around the state. Some of the initial feedback indicates that whatever system is selected that it needs to be applicable to all work undertaken not just on government projects that are over 20 million dollars. MPAQ will be preparing a submission in consultation with members. World Plumbing Day 2016 March 11... every year, everywhere! The World Plumbing Council’s Mission Statement says it all – “To promote the role of plumbing in improving public health and safeguarding the environment, by uniting the World Plumbing Industry for the benefit of all.” It is now widely recognised that plumbing has made a significant contribution to the well being of human society providing fresh water, effective sanitation and yes, at the same time safeguarding the environment. There is no doubt that the widespread establishment of sanitation systems and indoor plumbing was the most significant development over the past 150 years or so, as a result the average lifespan of mankind across many regions of the World virtually doubled. Deadly diseases such as typhoid and cholera rapidly declined as a healthier, more comfortable living environment was created.
However, if we as a human society needed to be reminded of the link between plumbing and public health we only need to consider the so-called SARS (severe acute respiratory syndrome) epidemic in 2003. At the time, the World Health Organisation (WHO) concluded that inadequate plumbing may have contributed to the spread of SARS. Perhaps an even more dramatic and tragic reminder of this link between plumbing and health is to be seen in those parts of the world that do not yet have ready access to fresh water and sanitation and the millions who continue to die each year, particularly children, from diarrheal diseases, cholera and typhoid. The World Plumbing Council encourages everybody either directly involved or just associated with the industry to celebrate
World Plumbing Day and spread the word in their local communities and through their industry organisations. The Queensland plumbing and gas industry celebrates World Plumbing Day in 2016 with the industry’s biggest breakfast of the year at the Brisbane Convention and Exhibition Centre. Easy Upgrade for Provisional Licensees From 1 April 2016, changes to the Plumbing and Drainage Regulation 2003 will make it easier for a provisional licensee to upgrade to an open plumbing and drainage licence. Currently when a person completes their Certificate III in Plumbing (or equivalent) or Certificate II in Drainage, they are able to apply to the Queensland Building and Construction Commission (QBCC) for a provisional plumber’s or drainer’s licence. A provisional licensee can then upgrade to an open licence after completing 12 months of practical experience and posttrade courses as decided by the QBCC Commissioner. This has created issues for provisional plumbers, particularly those who have held a provisional licence for many years, as they are not recognised as ‘full plumbers’ despite having completed the technical qualification for plumbing. Provisional licensees must also renew their licence annually, whereas open licensees can renew for up to five years, thus increasing their costs. “With this change to licensing requirements, a provisional licensee will no longer have to complete post-trade training in order to upgrade their licence,” said QBCC Acting Commissioner, Kellie Lowe. “After completing their 12 months of practical experience, they will be able to apply to the QBCC to upgrade to an open licence.” This change will greatly benefit the industry in a number of ways: • making the Certificate III in Plumbing (or equivalent) the standard qualification for a plumbers and drainers licence will create an even playing field for all licensees • licensees will be able to renew their licence for up to five years, reducing administrative fees for licensees and processing costs for the QBCC Provisional licensees wishing to operate their own business and contract direct to the consumer will still need to undertake the Certificate IV qualification. Ms Lowe said that public health and safety would still be protected, as the post-trade qualifications will still be required in order to apply for a trade contractor’s licence. Provisional licenses will still be required for licensees during their first 12 months of work, and for any overseas-trained practitioners who apply for an occupational licence. Licence Requirements for On-site Sewerage Facility Work The Queensland Building and Construction Commission (QBCC) recently contacted licensees working in the on-site sewerage facility industry to remind them of their requirements to hold both occupational and contractor licenses for work. To install an on-site sewerage facility, you must hold a drainer’s licence or a restricted drainer – on-site sewerage facility (maintenance and installation) licence. To maintain an on-site sewerage facility, you must hold an endorsement on a drainer’s licence for on-site sewerage facility maintenance, or a restricted drainer – on-site sewerage facility (maintenance only) licence. If you are contracting with a member of the public or a builder to perform any plumbing or drainage work, including on-site sewerage work, you must also hold a trade contractor’s licence from the QBCC. 7 Big Trends for the Queensland Construction Industry The last five years have been a tumultuous time for the Queensland construction industry. During this relatively short period we have experienced a housing boom, the Global Financial Crisis, a mining boom and increasing technological change. The return of new builds

Traditionally new builds account for about 9 out of 10 building projects in Queensland, with the balance coming in the form of additions, alterations and conversions. In the years following the Global Financial Crisis (GFC), many people opted to renovate instead of build anew. During this time, the proportion of new builds dropped to as low as 80%. But the data indicates the historical pattern is being restored, and CSQ predicts the share of new builds will stabilise around the 90% norm in 2016.
A healthy residential sector

Residential building has been doing everything it can to pick up the slack left by the steep wind-down in mining construction over recent years. Both 2014 and 2015 saw doubledigit growth in building starts in Queensland. While this trend will soften in 2016, CSQ expects solid single-digit growth for Queensland building starts, probably around 5%.

The decline in total construction activity across Queensland in recent years led to a surplus of construction workers. There are simply fewer projects than people ready to work. CSQ predicts this surplus will peak in 2016, and begin its return toward balance. It is estimated that the number of unemployed construction workers in Queensland will average around 16,000 in 2016, about 8% of the construction workforce.

Independent Contractor vs Employee’s? This is one of the questions that our MPAQ Workplace Relations team are asked on a regular basis, so where do you stand legally? The Fair Work Ombudsman uses the Independent Contractors Act 2006 which is also read in conjunction with the Fair Work Act 2009 to determine if a worker is an Independent Contractor or an Employee. There are a number of different factors that are taken into consideration. It is important to note that no single indicator can determine if a person is a contractor or an employee, the Fair Work Ombudsman will look at each situation on a case by case basis and each determination is based on the individual merits. Below is a table with some common indicators that may contribute to determining whether a person is an employee or a sub-contractor: Indicator

The information below should help you decide: • If your sub-contractor is a Sole Trader and is paid wholly or principally for their personal labour and skills, then you must make Superannuation, WorkCover and QLeave contributions on their behalf. • If your sub-contractor is a Company, Trust or Partnership and is paid wholly or principally for their personal labour or skills, then you do not need to make Superannuation, WorkCover and QLeave contributions on their behalf.
• If your sub-contractor is a Sole Trader and is not paid wholly or principally for their personal labour and skills, or does not have to perform the contract work personally but is able to delegate, or is paid to achieve a result rather than for hours worked, then you do not have to make Superannuation, WorkCover and QLeave contributions on their behalf. Verbal agreements are lawful but are difficult to rely upon and enforce. MPAQ recommends that all sub-contractor agreements are formalised in writing. Legionella in Ice Machines
The Master Plumbers’ Association of Queensland (MPAQ) distributed a media release on 4 February 2016, commending the Queensland Government’s decision to change legislation in providing transparency to the public regarding test results for legionella.
The recent outbreak of a hospital patient contracting the deadly Legionella Bacteria infection at the Wesley hospital is another demonstration of the critical importance of being vigilant on testing for contamination and pathogens in all aspects of our water systems.
New law changes planned to be introduced to Parliament in 2016 will ensure care facilities will be required to notify the Department of Health within 24 hours of the detection of Legionella. Under the proposed law, facilities failing to report detections could be fined in excess of $20,000. The recent outbreaks of hospital patients contracting the deadly Legionella Bacteria infection demonstrates the critical importance of being vigilant on testing for contamination and pathogens in all aspects of our water systems. Whilst a requirement for testing of cooling towers already exists, testing for contamination and pathogens is not mandated in Queensland for hot water systems. MPAQ is advocating and calling on the State Government to increase requirements for regular and mandatory testing inline with NSW, to ensure that hot water systems are tested every 12 months.

Legionella is among several bacteria that have been detected in ice machine water dispensers and ice recently. While the presence of these bacteria in ice is generally not a significant risk for disease transmission, those who are severely ill, immunocompromised and bedridden are the most vulnerable. They are at a greater risk for aspiration-fluids entering the upper airway to the lung by way of choking or by micro-aspiration. Research confirms ice machines as a potential source of exposure for some cases of Legionnaires’ disease. Study has shown that while ice dispensers are supplied with cold water, the condenser/ compressor can heat the piping inside the machine and warm the cold water enough to support bacterial growth. Filters on the cold water supply remove chlorine and contaminates can also become colonized. That water is ultimately dispensed or made into ice. Most bacteria do not multiply in ice, but they can survive at these low temperatures. While there is concern about any source of Legionella within healthcare facilities, the hot/warm water distribution system remains the most significant source of exposure to Legionella. This should be the primary focus for infection control and Legionnaires’ disease prevention. Disinfection devices should protect the cold water system prior to entry to the building (and water heaters), which in turn protects both hot and cold systems.

Annual Testing for Tempering Valves The Association also believes that tempering devices should be tested annually as well. Storage water heaters are required to store water at a minimum of 60°C in order to inhibit bacteria growth. Australian Standards require that the delivery temperature in areas primarily for personal hygiene for water is to be tempered to 45°C for the aged, the sick, children or people with disabilities in healthcare and aged care buildings, early childhood centers, primary and secondary schools and nursing homes, or similar facilities. Delivery temperature of water must be at 50°C at the outlet of sanitary fixtures used primarily for personal hygiene purposes for all other situations. These temperatures are reached by the use of tempering and thermostatic mixing valves which mix cold water with the high temperature water from the hot water heater (stored about 60°C in a storage system). It is a requirement to hold an endorsement on the plumber’s license when commissioning, servicing and testing thermostatic mixing valves. The Australian Standard (AS4032.3) requires thermostatic mixing valves to be tested every 12 months and a major service every five years. This standard also states that tempering valves are to be tested every 12 months, however the afore mentioned is not a legislative requirement in Queensland. The Association will continue to urge the government to consider implementing a mandatory maintenance scheme state wide for temperature control devices for hot water. Effective plumbing services are critical for maintaining and enhancing community health, as well as protecting the environment.

Meets Little Business Changes have recently been made which will extend rules on unfair contract terms, previously applied only to day-today consumers, to small business contracts – which may include contracts you sign!
the remainder of the contract will be binding on the parties. The idea is that this will reduce the incentive to include and/ or enforce unfair terms in small business contracts and thus provide a suitable remedy for small businesses.
These changes are in place now, but businesses have been given a grace period to November 2016 to become compliant.
How does this affect you?
There are no changes to the current regime, its reach has simply been extended. As such, the existing concepts underpinning unfair contract terms remain in force.
What is the current regime? Under the existing consumer contract term protection legislation, a Court can declare an unfair contract term to be void if it meets the requisite criteria. That is, if the term is unfair and if the contract is a standard form contract. A term will be “unfair” if a Court determines that: (1) the contract term causes a significant imbalance in the parties’ rights and obligations under the contract; (2) the term would cause a detriment (economic or otherwise) to a party if relied upon; and (3) the term is not reasonably necessary to protect the legitimate interests of the party seeking to enforce it. When deciding if a contract is a standard form contract, the test is not as clear. However, there are certain factors that the Court is required to consider including, for example, whether one party was required to accept or reject the terms on an “as is” basis and whether a party was given an effective opportunity to negotiate the terms.
Small business contracts The legislative changes affect small business contracts. A contract will be considered a small business contract if, at the time the contract is agreed, one party is a small business (that is a business that employs fewer than 20 persons, excluding casual employees not employed on a regular systematic basis) and where the value of the contract does not exceed either $300,000, or $1,000,000 if its duration extends beyond 12 months. The rationale for extending the existing provisions to small business contracts is that small businesses, like consumers, are more vulnerable to unfair terms in standard form contracts. Small businesses are considered more vulnerable as they lack the resources to effectively negotiate and are generally in a position of limited bargaining power.
The effect of the amendments on key contract terms A Court will now be able to declare an unfair term of a standard form small business contract void, just as it can for an unfair term contained in a standard form consumer contract. If the Court declares a term void, it will be removed from the contract (as though it never existed) and
The rationale behind these amendments indicates the Government’s emphasis on protecting small business from unfair contract terms. Therefore, it is important to review your current standard form contracts and to ensure that any negotiations for small business contracts are open and all terms are laid out on the table. Any indication of hiding terms in “fine print” will damage a party’s position before a Court in determining whether a contract term is unfair. All businesses should review the enforceability of their standard term contracts to reduce the risk of any terms being declared void. It may not be possible to create a “one size fits all” standard contract, as when and if a term will be declared void will depend on the circumstances of each transaction and the perceived or actual bargaining power of each party. Although the changes will not be enforced until November this year, now is the time to review your contracts to ensure they are compliant with the new regime. Residential Backflow Prevention… Is it really necessary? Peter McLennan Over the years I have seen numerous occurrences of cross connections that if exposed to a backflow event could well have contaminated the public water supply. Luckily very few backflow events have eventuated (or been recognised) so generally the water we drink is delivered as the water supplier intended. When you understand that the function of a backflow preventer is to protect others from an illegal cross connection within a user’s piping system, it is then obvious why most Councils and Water Authorities Australia wide make use of residential water meters that have an approved backflow preventer built into the meter body. This prevents the water in the supply main in the street from becoming contaminated by a cross connection that may exist after the water meter. This protection then ensures that the water you get has not been contaminated by your neighbour. So, what can be hazardous to the water supply in the residential environment? 1. Think about what you do with your garden hose. It gets left in the pool or spa to fill slowly overnight. It gets attached to a pressure water cleaner, which often has a function where detergents and cleaners can be added to the water. It gets poked down blocked drains and left in car radiators to flush them. Lastly, one of the most dangerous is the common garden fertiliser injector spray system. It is designed to mix the water with all types of chemicals used for killing bugs and fertilising your plants.

One item that seems to be growing in use is the DIY home Bidet and body washing equipment. When not protected anything that comes in contact with the hose can potentially get into your water and end up in your morning coffee.

It is one thing identifying the hazards, but how do we protect our water from these cross connections? An inexpensive backflow prevention programme comprising of hose tap protection, a backflow preventer at the rainwater tank connection and the water mains protection as part of the water meter will protect us at all levels from potentially harmful cross connections found in the residential environment. People will of course complain of the cost associated with this protection, but for a minimal outlay, you know your family are protected. In our houses, we have to have electrical safety switches to prevent electric shock and smoke detectors to protect us from fire hazards, why shouldn’t we also have water protection? Jason’s Story Encouraging Construction Workers to Speak Up A recently released work safety film named Jason’s story aims to encourage all workers, especially younger and less experienced ones, to speak up if they feel something is not right or unsafe at their workplace.
“It’s hard to get a break mentally, you can’t stop thinking about the - what ifs. He never even got a pay cheque,” Michael said.
Jason’s story recounts the events leading up to and following the tragic electrocution of an easy going, fun loving, 20-year-old Jason Garrels at a Clermont construction site in 2012. The story delves into the impact his death has had on his family, friends and workmates.
A senior nurse educator at Clermont at the time, Lee was called to the hospital following the accident only to find out the person who had been electrocuted was her son Jason.
Produced by Workplace Health and Safety Queensland, the short film targets young workers and their employers in a bid to cut deaths and injuries on construction sites, and was recently launched by the Minister for Industrial Relations Grace Grace. “Jason’s story takes a confronting, very honest look into the heartache of losing a son and a mate to a preventable workplace incident,” Ms Grace said. “It raises awareness about the importance of work safety and the need for effective communication between the various sub-contractors on construction sites.”
“I had said to Jason prior to the tragedy that if it’s dodgy, it is not worth your life and he said “it’s going to be ok, Mum, they’re gonna fix it up’. But they never did,” Lee emotionally recalls. Michael has since become a driving force in the Interim Consultative Committee for Work-related Fatalities and Serious Incidents (the Committee) which was established to ensure an ongoing forum for injured workers and families affected by workplace tragedies.
It’s hoped this film will go a long way to preventing deaths and injuries at construction worksites not only in this state, but also much further afield.
“I joined this group to empower and give other people affected by workplace tragedy a voice and help them through the path to reach the right government departments,” he said.
“It looks at why there has to be appropriate supervision and supportive mentoring for young workers in any industry,” she said.
“Through this Committee, we are seeking to make the aftermath of these tragic incidents as least harrowing as is possible under the circumstances,” Ms Grace said.
“This tragedy could’ve easily been avoided, but instead it’s impacted on the lives of Jason’s family, friends and colleagues.”
“But it would be far better that nobody has to go through this heartache in the first place, so we are also working with the construction industry to prevent these injuries and fatalities.
Jason’s parents Michael and Lee Garrels have worked tirelessly campaigning to prevent further workplace tragedies. Not only are they lending support to those affected by these workplace tragedies, they’re raising the issue with key stakeholders and decision makers. Michael still can’t believe Jason had only been on the job for nine days when tragedy struck.

Working in the Heat: Fluid Consumption Guidelines Consuming enough fluids each day is critical for the human body’s physical and mental performance, however the amount of water one should drink varies significantly between individuals, according to a new research paper. Thorzt’s Workplace Hydration White Paper analysed a range of industry-leading scholarly research and says the average 70kg male body is made up of around 60% water, and around 2-4 litres of this is lost in a sedentary day through urination, breathing and through the skin. Lost fluids must be replaced, and generally accepted broad recommendations are for the consumption of around 2.6 litres, or around 10 x 250ml glasses of water each day, the paper says. However there are a number of other factors influencing individual fluid intake requirements which may demand far greater fluid consumption, especially for the blue collar worker in hot Australian conditions.
Fluid Loss Influences Physical activity, diet, heat acclimatisation and fitness status, metabolic rate, body mass, size and environmental conditions such as temperature, humidity, wind, solar load and the amount and type of clothing worn all contribute to fluid intake requirements, according to the paper. The paper provides broad fluid intake guidelines for those working in hot and humid conditions - around 250-300ml of fluid every 15-20mins, however variables outlined influence that figure.

Staying Hydrated in the Workplace While it is important to consume as much fluid during and after a shift as has been lost, intermittently guzzling large amounts of water is not a good way to stay hydrated, and may lead to the dangerous condition of hyponatremia, according to the paper. Instead it recommends that broader diet and lifestyle structures are implemented along with hydration and heat stress awareness training for workers. Strategies to facilitate fluid consumption such as programmed drinking and worker monitoring should also be identified. Alcohol consumption should be avoided or discouraged as it contributes to dehydration by acting as a diuretic and increasing urine output, while sugary drinks and energy drinks should be avoided, with energy drinks being banned on some sites. The paper says that food intake also plays a role with a large amount of our fluid requirements potentially coming from food. Eating well will help hydration efforts while also providing the body with electrolytes, essential amino acids and nutrients, especially important for those who have been sweating heavily. Michael Yarrow, apprentice plumber at Yarrow Plumbing Services is one of 32 competitors in Brisbane who won the Queensland Regionals in the Worldskills Competition in 2015.

Congratulations Keith! WorldSkills Australia is a national, notfor-profit organisation that provides young Australians aged 23 and under the opportunity to gain new skills, compete against their peers in their chosen trade and fast track their skills and career development. Michael will be making the journey to Melbourne to compete against the nation’s best at the 2016 Worldskills Australia National Competition. Over 500 competitors across the country will compete for the coveted title of ‘National Champion’, which progresses them to compete at the International Worldskills Competition later in 2016. Congratulations Michael and good luck!
