ORDER On August 8, 2013, this court denied the Defendant’s motion to dismiss, granted the Plaintiffs’ motion for summary judgment on Count I, and entered permanent injunction against the Defendant. On August 21, 2013, Defendant filed an appeal. On September 24, 2013, this court denied the Defendant’s motion to stay the action relating to the remaining counts. On December 13, 2013, the Seventh Circuit denied Defendant’s motion to stay the action. On January 16, 2014, the parties appeared before this court and indicated that they had reached a settlement in principle relating to the matter, subject to certain actions by the City Council of Elgin. Based upon the parties’ representations, this court indicated its inclination to the Seventh Circuit that upon remand this court would grant the motion of the parties to vacate its order of August 8, 2013 [36]. On January 17, 2014, the Seventh Circuit remanded the matter to this court, which was reflected on this court’s docket on January 21, 2014. Therefore, this court entered an order [64] relating to this action on this date. As stated in the court’s order [64], the August 8, 2013 order [36] is vacated. All other findings and provisions of said opinion [36] remain in full force and effect, and the Defendant is enjoined from enforcing its temporary use regulations against Plaintiffs. This matter is set for status on March 20, 2014 at 9:00 A.M. All previous dates set by the court relating to this matter are stricken. In the event the parties do not finalize the settlement, the court’s order of August 8, 2013 [36] will be reinstated in its entirety and the case will proceed on all counts. ________________________________ Samuel Der-Yeghiayan United States District Court Judge Dated: January 22, 2014
