Spreetail ACQUISITION LEADS TO INNOVATIVE GROWTH IN LOGISTICS

Spreetail, one of the biggest names in e-commerce in Nebraska, has advanced its capabilities with the recent acquisition of Echo AI, an artificial intelligence platform that provides customer data insights to improve sales.

The Lincoln-headquartered company, which currently employs approximately 1,300, has offices in Lincoln, Omaha and the United Kingdom. Dubbed an e-commerce accelerator, Spreetail assists brands within online marketplaces such as Amazon, Walmart.com and Target. com. It specializes in big and bulky, emphasizing expedited shipping for these items.

Journey to global

Spreetail got its start in 2006 refurbishing IBM computers and reselling them on eBay. The company expanded into logistics for new items and found new segments to grow the business.

“We noticed there were a lot of people searching online for inflatable spas that didn’t exist,” said CEO Joshua Ketter. “So we actually worked with brands to create those. That is a very large, multimillion dollar market that Spreetail effectively brought to market, particularly in the United States.”

Ketter took over the global CEO post this July, succeeding Brett Thome, who transitioned to a strategic support role. Following the transition, the company ensured it would remain in Silicon Prairie.

“It’s an important part of our DNA and our history, and I think it always will be,” Ketter said of its Nebraska homebase. “So that was the commitment that I made to the company, that we would continue to be a Nebraska-based corporation. There are not a lot of billion-dollar businesses in Nebraska, and so we certainly wear that badge with honor.”

In recent years, Spreetail has demonstrated its ability to expand globally. In 2021, after experiencing years of growth within the United States, the company went international. In 2022, it acquired Buy Box

Experts, an Amazon seller marketing agency. In 2023, it successfully closed a $208 million funding round. The latest acquisition of Echo AI cements the company’s commitment to continued expansion and development.

Putting action into acquisition

“We started to acquire a lot of expertise, and one of our focuses for our brands is, how do we help them grow their businesses? We like to think of ourselves as their e-commerce team,” Ketter said. “When I looked at what Echo is doing, not just with their AI solution, but what their team is capable of doing, I noticed they built a product that gave product insights for R & D purposes back to brands.”

He said these capabilities give insights in real-time, allowing for modifications in listings on Amazon to make better assortment choices. These actionable insights can then help brands pull data from online reviews to fix defects or tout features that customers love, for instance.

One example is the Yakima, a roof cargo box for vehicles commonly used for transporting skis. Spreetail analyzed the products online with Echo AI.

“We realized that one of the most frequently cited things that customers loved was the fact that you actually get two keys to the locking mechanisms, and a lot of other products only had one, and if you lose that, well, there you go, right?” Ketter said. “It was something that we didn’t mention in the product benefits at all before. Being able to put that in our product descriptions, we enhanced our conversion in a meaningful way.”

He reiterated that heavy and bulky items are within an underserved market.

“Most of e-commerce is built around small items, and there’s not a lot for heavy, bulky items,” Ketter said.

Ketter’s resume gives a good indication he knows what he’s talking about. Having spent seven years at Amazon and three at Target in fulfillment and finance positions, he noted that Amazon, in particular, shies away from large items because they are not conveyable in its highly automated fulfillment facilities. In fact, he said, e-commerce corporations disincentivize online sales of large items. Home and garden, sports and outdoor retailers are often left with selling at higher costs than what consumers are willing to pay. By specializing in the big and bulky, Spreetail is able to drive down the costs.

“We’re certainly excited by the number of brands that are constantly reaching out to us looking for help,” he said. “We’re in a very large space. But I talk about our growth as a kind of a flywheel, and so for me, that flywheel is really just focused on adding value to the brands, which means I have to be able to grow their products online better than anybody else. So I’m going to continue to invest in things like Echo AI that help me do that.”

Tumultuous industry

Working within a global industry, Spreetail often faces new and varied challenges.

While short-lived, the port strike from the International Longshoremen’s Association has caused a ripple in logistics. Ketter noted that for each day of the strike, there is approximately a week’s worth of backlog, along with higher fees, which could lead to increased prices on goods.

An even larger and growing giant, the Chinese direct-to-consumer market has taken hold with more than 50% of the top sellers on Amazon being Chinese manufacturers, according to Marketplace Pulse.

“It’s something that’s an exciting opportunity for us, but it’s also changed the dynamic in a way,” Ketter said. “We’ve invested in hiring Mandarin speakers as well as teams over in mainland China and Hong Kong. It’s very difficult to navigate a large part of the e-commerce ecosphere nowadays because that’s been a meaningful shift that we’ve seen.”

Another challenging avenue is simply getting consumers’ eyes on a product in a crowded marketplace. Rather than organic search bringing the top results on Amazon, brands are now having to pay for advertising to get to the top of search results, creating a much more demanding environment.

“We have some proprietary systems that help us balance that and make sure that when it makes sense to pay to play, we’re doing that, and when it doesn’t, we’re able to show up in the top 10 search without it,” he said.

It’s clear Spreetail is in the position to expand in the current e-commerce market, and Ketter said the company won’t be slowing down anytime soon.

“Our goal is to be the world’s most brand-centric company, we’re going to continue to seize retail, doing some M&A, investing into AI capabilities, and making sure that we’ve got an ecosystem that disproportionately grows brands above the market,” he said.

Entrepreneurship After 65

VENTURES GROW IN POPULARITY

“I started making cards and stationery and letterhead when I was in grade school,” Lea Beach said. “I’d sell a set with an envelope for 5 cents. People bought them.”

Beach always wanted to be an artist, but it wasn’t until later in life that she became an entrepreneur. After retiring at age 64, she founded Find the Creative You in Omaha, teaching painting.

Beach is representative of research indicating entrepreneurship in retirement offers an opportunity to pursue passions, maintain social connections, generate supplemental income and capitalize on experience.

An Edward Jones Age Wave study reports that 60% of retirees and pre-retirees say the ideal retirement mix includes leisure and work, while SCORE reveals that more than half of U.S. small business owners are age 50 or over.

Giving back

“The ages of our clients have continued to climb even in the past five years. People are interested in giving back and finding purpose as they age,” said Allan Hale, chapter chair, Greater Omaha SCORE.

Hale himself had three careers including ownership in the grocery industry for 25 years.

He bought his first store, Hinky Dinky, in 1985 with two partners at age 30, before purchasing two convenience stores at 36 and another with a partner at 49. For most of his career he was also working for another company, Hale said.

He was also president of the Fremont Area Chamber of Commerce and executive director of the National Electrical Contractors Association. Today, he mentors others.

Older business owners are better equipped to manage their business because they have experience and “are in a better position financially to weather the storms of business cycles,” Hale said.

Passion for painting and joy

Beach said she was always an entrepreneur, having started three other businesses, but it was always difficult to balance with a full-time job.

“When you’re working for somebody else eight hours a day, you don’t have an opportunity to do all the things you want to do,” she said.

After 21 years at Dex creating ads and later for Edward Jones, her focus began to shift toward planning a business and seeking a better way to teach beginners how to paint.

“I wanted something for the beginner, something for the totally inexperienced, and something for that artist who has talent,” Beach said. With encouragement from a friend and collaboration with the American Legion Post #1 in Omaha, she launched the business in 2022, regularly holding classes at the Legion and private lessons and classes at her home studio. Her husband plays a role in helping with materials and logistics.

Beach doesn’t see herself stopping because she loves teaching others to paint and seeing their joy.

“They tell me it’s enriched their creative life,” Beach said.

Discovered need, discovered love

In 2010 Mary Ann Stallings retired from Lincoln Public Schools where she was a 7th-grade math teacher.

“The next day I was out at the Lancaster County Event Center with the Women’s Expo and had a business,” she said. “You’ve got to be willing to take a risk if you’re going to do it.”

She founded Bridge to Better Living in her early 60s after experiencing the challenge of finding retirement and living resources for her own

family. This motivated her to create a business plan and research senior living options for others in Lincoln and Omaha. She continues leading the company today as president and CEO.

“By 2030, all the baby boomers are going to be 65 and older,” Stallings said. “We’re looking at between 74 and 75 million. I could see then that we would still have growth in the business down the road.”

Her family is part of the business, including her husband, son, daughter and grandchild.

Meeting with families and finding the right place for their loved ones during a stressful time is rewarding, she said. She mentioned the importance of addressing their social, physical, medical, and financial needs while also building a strong, supportive bond throughout the process.

“It is just the satisfaction of helping people,” Stallings said. “We take away friendships, hugs and smiles. I love what I’m doing and doing what I love.”

Franchising and family

Jim Haiar was 57 when he and a partner bought a HOODZ franchise in 2009. The company specializes in cleaning kitchen exhaust systems to prevent fires. At that time, he was still working as an Omaha police officer. He retired from the police force but continued to work as a Saunders County sheriff’s deputy until recently. All the while, he was running HOODZ.

“I’d already retired from one job, and I just couldn’t stand sitting around,” he said.

Haiar said being a business owner enables him to set his own hours and focus on decision-making. At 71, his motivation is in service and passing along his years of training, whether it be in law enforcement or with his franchise.

While he took advantage of a training program offered, he declined the financing.

“Take your savings,” Haiar said. “Take a little of that, and invest in yourself, which would be kind of a novel idea in this day and age.”

Haiar’s family is a part of the business equation, with his daughter now owning part of the business and his son-in-law serving as operations manager. Haiar’s wife and granddaughter are also involved.

“The succession plan is something you’ve got to think about, no matter what business you’re getting into,” Haiar said. “You’ve got to have that plan in the beginning for about how you want to end it.”

Entrepreneurial spirit

In 2005, Chuck King founded IT Nexus, Inc. offering technology consulting services to small and medium-sized businesses.

“The genesis of it really started a few years earlier than that, probably several years, in the sense that I knew what I wanted,” King said. He took time researching competition, services and funding, while focusing on risk reduction.

After 15 successful years, he sold the business to Scantron five and a half years ago.

Using his business sense and entrepreneurial spirit, he transitioned to consulting by supporting the development of business owners through organizations like the Nebraska Angels Network. He is now a retired entrepreneur and investor.

“Now you’re not in the driver’s seat of running the business,” King said. “You’re off on the side in the bleachers. You are kind of a fan cheering them on, but you’re still involved in the game.”

Shared learning

These entrepreneurs agree that starting a business after traditional retirement can be a transition to another phase of life, along with a desire to share what they’ve learned.

“Just do it,” Beach said, adding it is good to save money along the way. “When you have people around you who are encouraging, it’s easy to do that.”

Stallings emphasized the importance of finding something you are passionate about, using community resources and networking.

Haiar stressed the importance of hiring reliable people to handle parts of the business you’re not skilled at and trusting them to share your values, then lead by example.

“Many times, retirement becomes boring and starting a business can bring purpose and challenge into our life,” he said.

King concluded that a successful business is a personal journey.

“If you find something that you learned, are good at, and enjoy, put those two things together. You’re really going to have success and make a difference somewhere,” he said.

Crafting a Solid Future EXPERTS BULLISH

Experts suggest that despite challenges such as rising costs and a limited labor pool, Nebraska’s manufacturers have reasons to be optimistic.

“Manufacturing in Nebraska gets anWA grade,” said Mike Johnson, chief operating officer and executive vice president of manufacturing with the Nebraska Chamber of Commerce and Industry. “Manufacturers are presented with opportunities for career growth, skill enhancement, diverse experiences and unique work through on-the-job training.

“What is also driving people toward work in manufacturing is that they get to see the fruits of their labor at work in the real world. Whether it is seeing the products they produce on the road, on the shelves of stores, helping produce the food we eat, or everywhere in between, those who work in manufacturing can literally point to their work and say, ‘My team and I made that.’”

Economic force

The National Association of Manufacturers reported almost 10% of Nebraska’s workforce is employed in manufacturing, accounting for about 10.5% of the state’s total output at $13.53 billion. Johnson stated that manufacturing is being driven by a national trend toward bringing supply chains back to the U.S.

“There has been a trend toward more U.S.-produced goods since the pandemic,” he said. “Recently, Nebraska recorded a 6.3% increase in manufacturing employment growth since the start of the pandemic, making us the sixth fastest-growing state in the country for manufacturing careers. This far outpaces the national average of 1.7% growth.

“Nebraska’s manufacturing is a key component of our agricultural economic value chain, where manufacturing buys ag products and refines them, processes them, and turns our agricultural output into higher-value products for sale around the world.”

Bioscience a sleeping giant

Rob Owen, executive director of Bio Nebraska, a nonprofit trade association, said while the biotech sector has a lot of opportunity, it also has steep challenges that must be met.

ON FUTURE OF MANUFACTURING

“In general, Nebraska’s bioscience industry is in a good position, especially the biomanufacturing sector, but there is work to be done to keep the industry moving in the right direction,” he said. “It should be no surprise that the workforce is a challenge, but capital and infrastructure are also challenges that need to be addressed.

“Workforce issues are not unique to the biosciences, however, I believe we can start chipping away at these workforce issues with simple awareness. There are over 18,000 jobs associated with biosciences in Nebraska with an average annual salary of $82,718. The average salary of Nebraska’s total private sector is $54,059.

“It is important for us to make sure junior and senior high school students, teachers and parents are aware of the bioscience companies in Nebraska, the jobs offered by these companies and the wages that go along with these jobs.”

As for capital, Owen said startups can initially benefit from Nebraska’s Business Innovation Act program, but once firms outgrow those resources, the financing picture becomes murkier. Equally important is addressing a critical lack of infrastructure for biotech companies.

“The entire state of Nebraska has 7,700 square feet of available wet lab space and all that space is located on the Nebraska Innovation Campus in Lincoln,” he said. “Surrounding states have hundreds of thousands of square feet of wet lab space. If Nebraska wants to keep startups and attract companies from out of state, there needs to be an investment in wet lab space, which is not cheap.”

New tech, new training

Johnson and Owen both gave the state’s colleges high marks for curricula that support the manufacturing industry, calling such programs vital to the health of the industry.

Bryan Geise, a professor in the advanced manufacturing program at Metropolitan Community College, said for as much as is new in the modern factory, there’s more coming.

“From the standpoint of students today, the focus is robotics, which local companies are more interested in than in any other sort of automation that is available,” he said. “We’ve actually just incorporated a robot into

one of our classes; it’s kind of basic, but it is a start to get that moving.

“The other major thing that we are seeing is a shift from subtractive manufacturing to additive manufacturing. In subtractive manufacturing, you take a block of material and you remove that material until it makes a part. For additive manufacturing, we’re talking about 3D printing. The latest technology can print in metals, allowing someone whose technical skill isn’t as high to design a part in 3D and hit print.”

Geise said while such technology isn’t necessarily attracting new waves of students, it does reinforce those who seek to work with their hands.

“I think it does give a greater sense of accomplishment when somebody is able to design a part and build it start to finish,” he said. “It gives you that sense of completion that you did the whole thing yourself.”

HOW NON-CASH ASSETS CAN TRANSFORM YOUR CHARITABLE GIVING

Before we head into the busy season around the holidays, now is a great time to plan your charitable giving for the rest of the year — and the most effective donations may not include your checkbook at all.

Though cash is easy to donate, it may not be the right option for all situations. Donating other assets can have the advantage of maximizing tax benefits for you and your family while allowing you to give more to the causes and organizations you care about the most. This ensures your donations have the greatest impact in the community while also providing you with the most tax advantages possible.

Below are some examples of non-cash assets you can donate that will benefit your favorite nonprofits and your tax planning.

Appreciated Stock or Business Interests

If you own closely held or publicly traded stock that has increased in value, gifting it to a nonprofit or a Donor Advised Fund at the Omaha Community Foundation offers benefits that cash donations simply can’t match.

The key advantage of donating appreciated stock lies in capital gains taxes. Normally, if you sell a stock that has grown in value, you’d be subject to capital gains tax — potentially up to 20% — on the difference between the initial value and the sale price. However, when you donate the stock directly, you avoid paying those taxes. This means the nonprofit receives the full value of the stock, and you receive a deduction for the stock’s fair market value at the time of the donation.

It’s a win-win: you can put more into your Donor Advised Fund and enjoy a significant tax benefit. If you’re looking to support causes close to your heart, this is

one of the most impactful ways to give.

Charitable IRA Rollover

If you own an IRA, a Charitable IRA Rollover (also known as a Qualified Charitable Distribution) is a tax-savvy way to use your retirement assets during your lifetime to make charitable gifts.

In 2024, if you are 70 1/2 or older, you can donate up to $105,000 per year from an IRA directly to a charitable organization, including a fund at the Omaha Community Foundation. The donation is excluded from your taxable income and counts toward your required minimum distribution.

The Charitable IRA Rollover operates separately from the rules that limit the tax benefit of individual charitable giving. So, if you are inclined to give more than the standard deduction, this rollover is a great option for you. You may find that the rollover provides greater tax savings than cash donations because your adjusted gross income is lower.

In addition, if you name a nonprofit as a full or partial beneficiary on your IRA or other retirement accounts, neither you nor your children will pay taxes on that portion of the distribution.

We learned that we must be attractive to talent, both from a financial perspective as well as through our team-based culture. We operate a robust law-clerk program to train future lawyers starting as early as their first year in law school. Our clerk program has produced

some of the very best lawyers in the region and pays dividends for our firm year-after-year.

Q: How does your company balance short-term financial performance with long-term growth objectives? What roles does sustainability play in your growth strategy?

A: Any time you add talent to a law firm, whether it is through a lateral hire or a new law school graduate, there is inevitably a rampup period that may require a higher investment relative to revenue production in the short term. However, in a service business like ours, that investment can lead to exponential growth through the development and expansion of expertise that grows our ability to serve current and new clients.

Q: What advice would you give to other business leaders who are looking to accelerate their growth, particularly in the current economic climate?

A: You must be willing to invest in talent and culture, while at the same time, focusing on accountability. A willingness to adapt to an everchanging business landscape is imperative because the status quo will eventually become stale. The Rules are Different in the Digital World

“Unprofitable tech.” It’s a phrase we’ve heard a lot over the past 15 years during the rise of the digital economy. Oftentimes, it is used as a knock against “growth” investing or a sign of a broken or overvalued business model. We heard such proclamations in the early days of Amazon, Netflix, Salesforce, Uber, and many others. We were reminded of this recently with reports that privately held OpenAl doesn’t expect to reach profitability until 2029, incurring losses of $44 billion between 2023 and 2028. If such companies are losing money, what’s the point? How can you even value them? Traditional value investors seemed bewildered, and often times, disgusted. Many just chalked up the existence of such bizarre anomalies to the Fed’s low-interest rate policy.

What some fail to realize is that this is intentional. These aren’t unprofitable business models. Quite the opposite. Inherently, selling a byte of software code is incredibly profitable and requires minimal human and financial capital relative to firms in the traditional economy. Rather, many digital companies choose scale over profits to establish network effects and market share.

Some economic laws don’t apply to digital firms in the same way as traditional ones. There is a concept called the law of diminishing marginal returns. In layman’s terms, this means that the more product a business produces, the less valuable each incremental unit becomes. If John Deere flooded the market with combines, it would become oversupplied and prices would fall. The same would happen with many others, such as Coca-cola, Proctor & Gamble, or Johnson & Johnson. However, the opposite is often true in the digital world. The more people that Meta’s Facebook or Instagram attracts, the more valuable that product becomes for both users and advertisers. The same is true for Ebay, Netflix, Amazon, Salesforce, etc. Unlike some firms that sell physical units, digital products tend to become more valuable over time as new features and users are added. This necessitates a re-prioritization of profits versus scale.

Like other digital firms, there will be a “prove it” moment for OpenAI. Just don’t confuse the financial modesty of these companies with broken or overvalued business models. We believe in yielding patience and looking beyond near-term profits and valuation multiples

Bio:

Kimberly Barnes has spent the bulk of the last two decades advocating for underserved communities. She was named executive director of CASA for Douglas County in October 2022 and was recently elected to the Urban Leadership Council of the National Court Appointed Special Advocate/Guardian ad Litem Association. Locally, she serves on committees for the Greater Omaha Chamber, the Nonprofit Association of the Midlands, the Rising Leaders Institute, and the Omaha Community Foundation.

Questions:

You were recently appointed to the Urban Leadership Council of the National CASA/GAL Association. What is the council’s objective and why did you accept this role?

The Council will operate through a model that engages urban leaders to address network challenges as well as external factors relative to child welfare, support the development of strong state CASA/GAL organizations and local CASA/GAL programs, and develop strategies, goals and objectives. I accepted this role as I wanted to be more impactful in the space of child welfare and governing policies within the urban sector. In this work, I will help to define and practice true collaboration and inclusivity. I will utilize the significant expertise that I have at the local program level at CASA for Douglas County to find optimal resolution to issues impacting urban programs related to the child welfare system.

Your career has focused on advocating for children and communities at risk. What brought you to this line of work? What has inspired you to stick with it?

I was a teen mom at the age of 18 and faced many challenges. It was a difficult life change and many attempted to tell me to settle for what seemed to be the road to take as a teen mom. I was determined to beat the status quo. Along the way, I had to advocate for myself in spaces where many pegged me to be a statistic. I learned that lived experiences carry you beyond the content of a textbook. I found my voice and I have not stopped speaking up for the one who has a small voice due to shame or circumstance. It is my passion to advocate and stand alongside children, families and underserved communities to ensure they are represented in spaces where they are generally overlooked and silenced. This brought me to the career I have and love. Many children, especially black and brown children, are constantly fighting to beat statistics due to life circumstances. My inspiration to stay in this

I strongly believe in and advocate for self-care. After a hard day, my self-care includes a good book to read or a crossword puzzle with a glass of wine with a Monte Cristo cigar. If it was a hard week, a 90-minute massage and some shopping at the Home Store. I also go to the gym every morning at 5:15 a.m. to aid in my self-care.

restaurants should operate with the utmost cleanliness and professionalism. Food is immediate gratification, and a great atmosphere adds to the experience.

A friend or family member is visiting Omaha for the first time. Where do you take them?

I would gladly take them to the Malcolm X Memorial Foundation, and/or the Great Plains Black History Museum.

What is the best piece of advice someone has given you?

My father, who has passed away, would tell me, “You better know a little about a lot of things. But the things you really care about, you better know a lot and never hold your tongue speaking up for things that matter to you!” I am using nice words as my dad would use some stern words. My dad was key to my self-confidence.

White Lotus Group Announces MURAL

MIXED-USE DEVELOPMENT IN THE WORKS FOR DOWNTOWN LINCOLN

Construction has begun on a new mixed-use development, MURAL, in downtown Lincoln at the site of the former Pershing Auditorium. The name of the development pays homage to the iconic mural within the auditorium.

“MURAL represents a significant step forward for the Lincoln community. By integrating residential units with vibrant commercial spaces, we’re creating a development that not only provides much-needed affordable housing, but also strengthens local businesses and services. This project is designed to enrich the urban core, fostering a more inclusive, accessible, and thriving neighborhood for all,” said Drew Sova, executive vice president and general counsel for White Lotus Group.

The $30 million development will feature both residential and commercial space. The building will include 90 apartments, 47 underground parking spaces and space for commercial tenants. The project is slated to be completed in December 2025.

UNMC

Development Dubbed EDGE District HEALTH-FOCUSED DISTRICT TO TOUT INNOVATION

A new University of Nebraska Medical Center (UNMC) district in the works has been named EDGE District.

“EDGE District will become a dynamic hub for health-focused scientific discovery, entrepreneurship and commercialization, some of the key items needed to ensure the state of Nebraska remains competitive on the national stage,” said H. Dele Davies, MD, interim chancellor at UNMC in a press release. “Not only that, the district will also become a premier destination within the city — a place where individuals want to work, live and experience vibrant entertainment. In essence, EDGE will not only elevate the university’s role as a leader in innovation and research but also strengthen the city’s economic vitality and enhance the state’s reputation as a center of excellence and opportunity.”

The over 30-acre property, bordered by Saddle Creek Road, 48th Street and Farnam/ Douglas streets, serves as a hub for new development for UNMC. Within this district, developments are currently underway. Catalyst, serving UNeMed and UNeTech with its Innovation Hub, is set to open in early 2025. The Campus Operations and Research Excellence (CORE) building will include lab space and an incubator for startups.

Children’s Nebraska RECOGNIZED AMONG NATION’S BEST CHILDREN’S HOSPITALS

Children’s Nebraska was recently named among the top 50 pediatric facilities nationwide by the U.S. News & World Report in its 2024-25 Best Children’s Hospitals list.

TEXT: A BILL FOR AN ACT relating to education scholarships; to amend sections 77-2715.07, 77-2717, and 772734.03, Revised Statutes Supplement, 2023; to provide for education scholarships; to repeal the Opportunity Scholarships Act; to harmonize provisions; to provide operative dates; to repeal the original sections; and to outright repeal sections 77-7101, 77-7102, 77-7103, 77-7104, 77-7105, 77-7106, 77-7107, 77-7108, 77-7109, 777110, 77-7111, 77-7112, and 77-7113, Revised Statutes Supplement, 2023.

Be it enacted by the people of the State of Nebraska,

Section 1. (1) The Legislature finds that: (a) Funds appropriated for the education of students in kindergarten through twelfth grade are for a fundamental public purpose of state government and constitute an ordinary expense of state government; (b) Enabling the greatest number of parents and legal guardians to choose among quality educational opportunities for children will improve the quality of education available to all children; (c) Privately operated elementary and secondary schools in Nebraska satisfy the state’s requirements for legal operation and provide quality educational opportunities for children; (d) Parents and legal

guardians of limited means are less able to choose among quality educational opportunities for their children; and (e) Making it possible for more parents and legal guardians to be able to choose privately operated schools benefits Nebraska parents and taxpayers. (2) For purposes of this section: (a) Education scholarship means a financial grantin-aid to be used to pay all or part of the cost to educate an eligible student attending a qualified school; (b) Eligible student means a resident of Nebraska who: (i) Is receiving an education scholarship for the first time and is (A) entering kindergarten or ninth grade in a qualified school or the first grade level offered by the qualified school, (B) transferring from a public school at which the student was enrolled for at least one semester immediately preceding the first semester for which the student receives an education scholarship to a qualified school and is entering any of grades kindergarten through twelve, or (C) a member of an active duty or reserve military family transferring into Nebraska from another state or another country and is entering any of grades kindergarten through twelve in a qualified school; (ii) Has previously received an education scholarship under this section and is continuing education at a qualified school until such student graduates from high school or reaches twenty-one years of age, whichever comes first; (iii) Has previously received an education scholarship under the Opportunity Scholarships Act, as such act existed prior to its repeal by this legislative bill, and is continuing education at a qualified school until such student graduates from high school or reaches twentyone years of age, whichever comes first; (iv) Is the sibling of a student who is receiving an education scholarship and resides in the same household as such student; or (v) Is currently enrolled in a qualified school and is a member of a family whose household income is no more than two hundred thirteen percent of the federal poverty level; and (c) Qualified school means any nongovernmental, privately operated elementary or secondary school located in this state that (i) is operated not for profit, (ii) complies with the antidiscrimination provisions of 42 U.S.C. 1981, as such section existed on January 1, 2024, (iii) complies with all health and life safety laws or codes that apply to privately operated schools, and (iv) fulfills the applicable accreditation or approval requirements established by the State Board of Education pursuant to section 79-318. (3) The State Treasurer shall establish a program to provide education scholarships to eligible students to pay the costs associated with attending a qualified school. Under such program, the State Treasurer shall: (a) Establish a priority system for awarding education scholarships under the program. Such priority system shall: (i) Give first priority to: (A)

Eligible students who received an education scholarship under this section or under the Opportunity Scholarships Act, as such act existed prior to its repeal by this legislative bill, during the previous school year; and (B) The sibling of a student who is receiving an education scholarship, so long as the sibling resides in the same household as such student; (ii) Give second priority to: (A) Eligible students whose household income levels do not exceed one hundred eighty-five percent of the federal poverty level; (B) Eligible students whose application for the enrollment option program established in section 79-234 has been denied; (C) Eligible students who have an individualized education program; (D) Eligible students who are experiencing bullying, harassment, hazing, assault, battery, kidnapping, robbery, sexual offenses, threat or intimidation, or fighting at school; (E) Eligible students who are in foster care; and (F) Eligible students who are in a family with a parent or guardian in an active duty role in a branch of the armed forces of the United States or in the National Guard, or whose parent or guardian was killed serving in the line of duty; (iii) Give third priority to eligible students whose household income levels exceed one hundred eighty-five percent of the federal poverty level but do not exceed two hundred thirteen percent of the federal poverty level; and (iv) Give fourth priority to eligible students whose household income levels exceed two hundred thirteen percent of the federal poverty level but do not exceed three hundred percent of the income indicated in the income eligibility guidelines for reduced price meals under the National School Lunch Program in 7 C.F.R. part 210; (b) Limit the maximum scholarship amount awarded to any eligible student to the cost necessary to educate the eligible student at the qualified school such student attends; and (c) Limit scholarship amounts awarded to eligible students in a manner that assures that the average of the scholarship amounts awarded per student does not exceed seventy-five percent of the statewide average general fund operating expenditures per formula student for the most recently available complete data year as such terms are defined in section 79-1003. (4) The annual limit on the total amount of education scholarships awarded under this section for fiscal year 2024-25 and each fiscal year thereafter shall be ten million dollars. (5) On or before December 1, 2025, and on or before December 1 of each year thereafter, the State Treasurer shall electronically submit a report to the Governor and the Legislature that includes the following:

(a) A summary description of the State Treasurer’s policies and procedures for awarding education scholarships; (b) The number of eligible students receiving education scholarships in the most recent fiscal year; (c) The total amount of education scholarships awarded in

the most recent fiscal year; (d) The number of eligible students currently wait-listed or denied from receiving an education scholarship and the reason for the wait-listing or denial; and (e) The demographic information of eligible students receiving education scholarships, including, but not limited to: (i) Income level; (ii) Grade level; and (iii) Geographic location. (6) The State Treasurer may enter into contracts with up to three program managers for the purposes of carrying out the education scholarship program described in this section. (7) It is the intent of the Legislature to appropriate ten million dollars from the General Fund for fiscal year 2024-25 and each fiscal year thereafter to the State Treasurer for the purpose of providing education scholarships as provided in this section. (8) Up to seven and one-half percent of the funds appropriated for purposes of this section may be used by the State Treasurer, or by the program managers with which the State Treasurer contracts, for administrative expenses. (9) This section shall not be construed as granting any expanded or additional authority to the State of Nebraska to control or influence the governance or policies of any qualified school due to the fact that the qualified school admits and enrolls students who receive education scholarships or as requiring any such qualified school to admit or, once admitted, to continue the enrollment of any student receiving an education scholarship.

A vote “FOR” will enact a statute which: (1) provides eligible employees the right to earn paid sick time for personal or family health needs; (2) entitles employees of employers with fewer than 20 employees to accrue and use up to 40 hours of such time annually and those employed by employers with 20 or more employees to accrue and use up to 56 hours of such time annually; (3) specifies conditions regarding paid sick time; (4) prohibits retaliation against employees for exercising such rights; (5) adopts documentation requirements; and (6) establishes enforcement powers and a civil cause of action for violations.

A vote “AGAINST” means such a statute will not be enacted.

Be it enacted by the people of the State of Nebraska:

Section 1. Act, how cited; declaration of purpose. (1) Sections 1 to 11 of this act shall be known and may be cited as the Nebraska Healthy Families and Workplaces Act. (2) The purpose of the act is to provide eligible employees in Nebraska the right to earn paid sick time for personal or family health needs and provide certain provisions naturally and necessarily related to that purpose.

Sec. 2. Terms, defined.

For purposes of the Nebraska Healthy Families and Workplaces Act: (1) Department means the Department of Labor; (2) Employ means to permit to work; (3)(a) Employee means any individual employed by an employer, but does not include an individual who works in Nebraska for fewer than eighty hours in a calendar year. (b) Employee does not include an “employee” as defined by 45 U.S.C. 351(d) who is subject to the federal Railroad Unemployment Insurance Act, 45 U.S.C. 351 et seq.; (4)(a) Employer means any individual, partnership, limited liability company, association, corporation, business trust, legal representative, or organized group of persons who employs one or more employees. (b) Employer does not include the United States

or the State of Nebraska or its agencies, departments, or political subdivisions; (5) Family member means: (a) Any of the following, regardless of age: A biological, adopted, or foster child, a stepchild, a legal ward, or a child to whom the employee stands in loco parentis; (b) A biological, foster, step, or adoptive parent or a legal guardian of an employee or an employee’s spouse; (c) A person who stood in loco parentis to the employee or the employee’s spouse when the employee or employee’s spouse was a minor child; (d) A person to whom the employee is legally married under the laws of any state; (e) A grandparent, grandchild, or sibling, whether of a biological, foster, adoptive, or step relationship, of the employee or the employee’s spouse; or (f) Any other individual related by blood to the employee or whose close association with the employee is the equivalent of a family relationship; (6) Health care professional means any person licensed under any federal or state law to provide medical or emergency services; (7) Paid sick time means time that is compensated at the same hourly rate and with the same benefits, including health care benefits, as the employee typically earns during hours worked and that is provided by an employer to an employee for the purposes described in section 4 of this act, and in no case shall the amount of this hourly rate be less than that provided under section 48-1203;

(8) Public health emergency means a declaration or proclamation related to a public health threat, risk, disaster, or emergency that is made or issued by a federal, state, or local official with the authority to make or issue such a declaration or proclamation;

(9) Retaliatory personnel action means a denial of any right guaranteed under the Nebraska Healthy Families and Workplaces Act and any threat, discharge, suspension, demotion, reduction of hours or pay, or other adverse action against an employee for exercising or attempting to exercise any right guaranteed in the Nebraska Healthy Families and Workplaces Act;

(10)(a) Small business means an employer with fewer than twenty employees during a given week, including fulltime, part-time, or temporary employees. (b) Small business does not include an employer that maintained twenty or more employees on its payroll in each of twenty or more calendar weeks in the current or preceding calendar year; and (11) Year means a regular and consecutive twelve-month period as determined by the employer.

Sec. 3. Accrual and carryover of paid sick time; paid sick time following transfer or return after separation from employment. (1) All employees shall accrue a minimum of one hour of paid sick time for every thirty hours worked. Unless the employer selects a higher limit, this section does

not entitle an employee to earn or use more than:

(a) Forty hours of paid sick time in a year for an employee of a small business; or (b) Fifty-six hours of paid sick time in a year for an employee of an employer that is not a small business. (2) Employees who are exempt from overtime requirements under 29 U.S.C. 213(a)(1) of the federal Fair Labor Standards Act, 29 U.S.C. 201 et seq., shall be assumed to work forty hours in each workweek for purposes of paid sick time accrual unless their typical workweek is less than forty hours, in which case paid sick time accrues based upon that typical workweek. (3) Paid sick time as provided in this section shall begin to accrue at the commencement of employment or October 1, 2025, whichever is later. An employee shall be entitled to use paid sick time as it is accrued. An employer may provide all paid sick time that an employee is expected to accrue in a year at the beginning of the year. (4) Accrued paid sick time shall be carried over to the following year. A small business is not required to permit an employee to use more than forty hours of paid sick time per year, and other employers are not required to permit an employee to use more than fifty-six hours of paid sick time per year. Alternatively, in lieu of carryover of unused paid sick time provided pursuant to this section from one year to the next, an employer may pay an employee for unused paid sick time provided pursuant to this section at the end of a year and provide the employee with an amount of paid sick time that meets or exceeds the requirements of subsections (1) and (3) of this section that is available for the employee’s immediate use at the beginning of the subsequent year. (5) Any employer with a paid leave policy, such as a paid time off policy, who makes available an amount of paid leave sufficient to meet the requirements of the Nebraska Healthy Families and Workplaces Act that may be used for the same purposes and under the same conditions as paid sick time under the act is not required to provide additional paid sick time under the act. (6) At its discretion, an employer may loan paid sick time to an employee in advance of accrual by such employee. (7) If an employee is transferred to a separate division, entity, or location, but remains employed by the same employer, the employee is entitled to all paid sick time accrued at the prior division, entity, or location and is entitled to use all paid sick time as provided in the Nebraska Healthy Families and Workplaces Act. When there is a separation from employment and the employee is rehired within twelve months of separation by the same employer, previously accrued paid sick time that had not been used shall be reinstated. The employee shall be entitled to use accrued paid sick time and accrue additional paid sick time at the recommencement of employment.

Sec. 4. Use of paid sick time; employee notice and documentation; multiemployer paid sick time fund, plan, or program. (1) Paid sick time shall be provided to an employee by an employer for: (a) An employee’s mental or physical illness, injury, or health condition; an employee’s need for medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or an employee’s need for preventive medical care; (b) Care of a family member with a mental or physical illness, injury, or health condition; care of a family member who needs medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; care of a family member who needs preventive medical care; or in the case of a child, to attend a meeting necessitated by the child’s mental or physical illness, injury, or health condition, at a school or place where the child is receiving care; or (c) Closure of the employee’s place of business by order of a public official due to a public health emergency; an employee’s need to care for a child whose school or place of care has been closed by order of a public official due to a public health emergency; or an employee’s need to self-isolate or care for the employee or a family member when it has been determined by the health authorities having jurisdiction or by a health care professional that the employee’s or family member’s presence in the community may jeopardize the health of others because of exposure to a communicable disease, whether or not the employee or family member has actually contracted the communicable disease. (2) Paid sick time under this section shall be provided upon the oral request of an employee. When possible, the request shall include the expected duration of the absence. (3) An employer that requires notice of the need to use paid sick time in accordance with this section shall provide a written policy that contains reasonable procedures for employees to provide notice. An employer that has not provided to the employee a copy of such written policy shall not deny paid sick time to the employee based on noncompliance with such a policy. (4) An employer shall not require, as a condition of an employee’s taking paid sick time under this section, that the employee search for or find a replacement worker to cover the hours during which the employee is using paid sick time. (5) Paid sick time under this section may be used in the smaller of hourly increments or the smallest increment that the employer’s payroll system uses to account for absences or use of other time. (6) For use of paid sick time for more than three consecutive work days, an employer may require reasonable documentation that the paid sick time has been used for a purpose covered by subsection (1) of this section. Reasonable documentation shall include (a) documentation signed by a health care professional indicating that

paid sick time is or was necessary or (b) if the employee or a family member did not receive services from a health care professional, or if documentation cannot be obtained from a health care professional in reasonable time or without added expense, a written statement from the employee indicating that the employee is taking or took paid sick time for a qualifying purpose covered by subsection (1) of this section. (7) An employer signatory to a multiemployer collectivebargaining agreement may fulfill its obligations under the Nebraska Healthy Families and Workplaces Act by making contributions to a multiemployer paid sick time fund, plan, or program based on the hours each employee accrues pursuant to the act while working under the multiemployer collective-bargaining agreement, if the fund, plan, or program enables employees to collect paid sick time from the fund, plan, or program based on hours they have worked under the multiemployer collectivebargaining agreement and for the purposes specified under the act. Employees who work under a multiemployer collective-bargaining agreement into which their employers make contributions as provided in this subsection may collect from the paid sick time fund, plan, or program based on hours they have worked under the multiemployer collectivebargaining agreement and for the purposes specified under the act.

Sec. 5. Exercise of rights protected; retaliatory personnel action prohibited. (1) It shall be unlawful for an employer or any other person to interfere with, restrain, or deny the exercise of, or the attempt to exercise, any right protected under the Nebraska Healthy Families and Workplaces Act. (2) An employer shall not take retaliatory personnel action against an employee or former employee because the person has exercised or attempted to exercise rights protected under the act. Such rights include, but are not limited to, the right to request or use paid sick time pursuant to the act; the right to file a suit or complaint or inform any person about any employer’s alleged violation of the act; the right to participate in an investigation, hearing, or proceeding or cooperate with or assist the department in its investigations of alleged violations of the act; and the right to inform any person of the person’s potential rights under the act. (3) It shall be unlawful for an employer’s absence control policy to count paid sick time taken under the act as an absence that may lead to or result in a retaliatory personnel action or any other adverse action.

Sec. 6. Notice and posting. (1) Employers shall give employees written notice of the following at the commencement of employment or by September 15, 2025, whichever is later: That beginning October 1, 2025, employees are entitled to paid sick time;

the amount of paid sick time; the terms of its use guaranteed under the Nebraska Healthy Families and Workplaces Act; that retaliatory personnel action against employees who request or use paid sick time is prohibited; that each employee has the right to file a suit or complaint if paid sick time as required by the act is denied by the employer or the employee is subjected to retaliatory personnel action for requesting or taking paid sick time; and the contact information for the department where questions about rights and responsibilities under the act can be answered. (2) The notices required in subsection (1) of this section shall be provided in: (a) English; and (b) Any language that is the first language spoken by at least five percent of the employer’s workforce if the department has provided a model notice in such language. (3) The amount of paid sick time available to the employee, the amount of paid sick time taken by the employee to date in the year, and the amount of pay the employee has received as paid sick time shall be recorded in, or on an attachment to, the employee’s regular paycheck. (4) Employers shall display a poster that contains the information required in subsection (1) of this section in a conspicuous and accessible place in each establishment where such employees are employed. If an employer does not maintain a physical workplace or an employee teleworks or performs work through a webbased or app-based platform, the employer shall provide notice of such information via electronic communication or a conspicuous posting in the web based or app-based platform. The poster displayed shall be in: (a) English; and (b) Any language that is the first language spoken by at least five percent of the employer’s workforce if the department has provided posters in such language.

(5) The department shall create and make available to employers, in all languages spoken by at least five percent of Nebraska’s workforce and any language deemed appropriate by the department, model notices and posters that contain the information required under subsection (1) of this section and for employers’ use in complying with subsections (1) and (4) of this section.

Sec. 7. Department of Labor; enforcement and implementation powers; rules and regulations. (1) The department shall be responsible for implementation and enforcement of the Nebraska Healthy Families and Workplaces Act. The department may adopt and promulgate rules and regulations as necessary to carry out the act. (2) The Commissioner of Labor may subpoena records and witnesses related to the enforcement of the act. The commissioner or his or her agent may inspect all related records and gather testimony on any matter relative to the enforcement of the act when the information sought is relevant to a lawful investigative purpose and is reasonable in

scope.

Sec. 8. Enforcement. (1) The Commissioner of Labor shall issue a citation to an employer when an investigation reveals that the employer may have violated the Nebraska Healthy Families and Workplaces Act. (2) When a citation is issued, the commissioner shall notify the employer of the proposed administrative penalty, if any, by certified mail, by any other manner of delivery by which the United States Postal Service can verify delivery, or by any method of service recognized under Chapter 25, article 5. The administrative penalty shall not be more than five hundred dollars in the case of a first violation and not more than five thousand dollars in the case of a second or subsequent violation. (3) The employer has fifteen working days after the date of the citation or penalty to contest such citation or penalty. Notice of contest shall be sent to the commissioner who shall provide a hearing in accordance with the Administrative Procedure Act. (4) Any employer who has an unpaid citation for a violation of the Nebraska Healthy Families and Workplaces Act shall be barred from contracting with the state or any political subdivision until such citation is paid. If a citation has been contested as described in subsection (3) of this section, it shall not be considered an unpaid citation under this subsection until after such contest has been resolved.

(5) Citations issued under this section and the names of employers who have been issued a citation shall be made available to the public upon request, except that this subsection shall not apply to any citations that are being contested as described in subsection (3) of this section.

(6) An employee having a claim for a violation of the Nebraska Healthy Families and Workplaces Act may institute suit for legal and equitable relief in the proper court. In any action brought to enforce the Nebraska Healthy Families and Workplaces Act, the court shall have jurisdiction to grant such legal or equitable relief as the court deems appropriate to effectuate the purposes of the act. If an employee establishes a claim and secures judgment on the claim, such employee shall also be entitled to recover the full amount of the judgment and all costs of such suit, including reasonable attorney’s fees.

(7) If an employee institutes suit against an employer under subsection (6) of this section, any citation that is issued against an employer under subsection (1) of this section and that relates directly to the facts in dispute shall be admitted into evidence unless specifically excluded by the court. If a citation has been contested as described in subsection (3) of this section, it shall not be admitted into evidence under this subsection until such contest has been resolved. (8) A civil action brought under this section shall be commenced no later than four calendar years after the cause of action

accrues.

Sec. 9. Confidentiality and nondisclosure. (1) Unless otherwise required by law, an employer shall not require disclosure of the details of an employee’s or an employee’s family member’s health information as a condition of providing paid sick time under the Nebraska Healthy Families and Workplaces Act. (2) Unless otherwise required by law, any health information possessed by an employer regarding an employee or employee’s family member shall: (a) Be maintained on a separate form and in a separate file from other personnel information; (b) Be treated as confidential medical records; and (c) Not be disclosed except to the affected employee or with the express permission of the affected employee.

Sec. 10. No effect on more generous paid sick time policies or laws; nonwaiver of rights and remedies. (1) The Nebraska Healthy Families and Workplaces Act provides minimum requirements pertaining to paid sick time, and nothing in the act shall be construed to: (a) Prohibit an employer from the adoption or retention of a paid sick time policy more generous than the one required by the act; (b) Diminish the obligation of an employer to comply with any contract, collectivebargaining agreement, employment benefit plan, or other agreement providing more generous paid sick time to an employee than required by the act; (c) Diminish the rights of public employees regarding paid sick time or use of paid sick time as provided in state or local law; or (d) Preempt, limit, or otherwise affect the applicability of any other law, regulation, requirement, policy, or standard that provides for a greater amount, accrual, or use by employees of paid sick time or that extends other protections to employees. (2) The rights and remedies under the Nebraska Healthy Families and Workplaces Act shall not be waived by any agreement, policy, form, or condition of employment. Any such waiver shall be void and unenforceable.

Sec. 11. Severability. If any section in this act or any part of any section is declared invalid or unconstitutional, the declaration shall not affect the validity or constitutionality of the remaining portions.

(c) Cannabis does not include hemp, as defined in Section 2-503(13) of the Nebraska Hemp Farming Act, nor does it include the mature stalks of the plant, fiber produced from such stalks, oil or cake made from the seeds of the plant, the sterilized seed of the plant which is incapable of germination, or cannabidiol contained

in a drug product approved by the federal Food and Drug Administration; (3) Cannabis accessories means any equipment, products, or materials of any kind that are used, intended for use, or designed for use in storing, vaporizing, or containing cannabis, or for ingesting, inhaling, or otherwise introducing cannabis into the human body;

(4) Caregiver means: (a) In the case of a qualified patient who is eighteen years of age or older and is not under the protection of a legal guardian, a person who: (i) Is at least twenty-one years of age; and (ii) Has been designated by a qualified patient in a signed affidavit;

(b) In the case of a qualified patient who is younger than eighteen years of age or a qualified patient under the protection of a legal guardian: (i) The legal guardian or parent with authority to make health care decisions of the qualified patient; or (ii) A person designated in a sworn affidavit by the legal guardian or parent with authority to make health care decisions; or (c) A health care facility as defined in section 71-413 or a home health agency as defined in section 71-417, if the facility or agency has been designated by a qualified patient or the legal guardian or parent with authority to make health care decisions of a qualified patient in a sworn affidavit and if the facility or agency has agreed in writing to serve as a caregiver for the qualified patient;

(5) Health care practitioner means a physician, an osteopathic physician, a physician assistant, or a nurse practitioner licensed under the Uniform Credentialing Act or who is licensed in any state and practicing in compliance with the Uniform Credentialing Act;

(6) Qualified patient means: (a) An individual eighteen years of age or older with a written recommendation from a health care practitioner; or (b) An individual younger than eighteen years of age with a written recommendation from a health care practitioner and with the written permission of a legal guardian or parent with authority to make health care decisions for the individual; and (7) Written recommendation means a valid signed and dated declaration from a health care practitioner stating that, in the health care practitioner’s professional judgment, the potential benefits of cannabis outweigh the potential harms for the alleviation of a patient’s medical condition, its symptoms, or side effects of the condition’s treatment. A written recommendation is valid for two years after the date of issuance or for a period of time specified by the health care practitioner on the written recommendation.

Sec. 3. (1) Subject to the requirements of the Nebraska Medical Cannabis Patient Protection Act, it shall not be an offense under state or local law for:

(a) A qualified patient to use, possess, and acquire an allowable amount of cannabis

and cannabis accessories for the alleviation of a medical condition, its symptoms, or side effects of the condition’s treatment; or (b) A caregiver to assist a qualified patient with the activities set forth in subdivision (1)(a) of this section by possessing and acquiring an allowable amount of cannabis and cannabis accessories on behalf of the qualified patient and delivering an allowable amount of cannabis and cannabis accessories to the qualified patient. (2) Conduct protected by this section shall not be subject to the Uniform Controlled Substances Act.

Sec. 3. (1) Subject to the requirements of the Nebraska Medical Cannabis Regulation Act, it shall not be an offense under state law for a registered cannabis establishment, its employees, and its agents to possess, manufacture, distribute, deliver, and dispense cannabis for medical purposes, provided such conduct complies with applicable rules and regulations adopted and promulgated by the Commission pursuant to the Nebraska

Medical Cannabis Regulation Act. (2) Conduct protected by this section shall not be subject to the Uniform Controlled Substances Act.

Sec. 4. (1) For purposes of providing the necessary registration and regulation of persons that possess, manufacture, distribute, deliver, and dispense cannabis for medical purposes pursuant the Nebraska Medical Cannabis Regulation Act, the Nebraska Medical Cannabis Commission is created. (2) The commission shall consist of no fewer than three and no more than five members.

(3) The three members of the Nebraska Liquor Control Commission shall be ex officio members of the commission, serving terms and receiving appointment in the same manner as provided in section 53-105. (4) The Governor may appoint two additional members, subject to confirmation by a majority of the members elected to the Legislature, to serve with the members of the Nebraska Liquor Control Commission as members of the Nebraska Medical Cannabis Commission. The members appointed pursuant to this subsection shall serve six-year terms. (5) The Governor may reappoint members of the commission, subject to approval by a majority of the members elected to the Legislature.

Sec. 5. The power to regulate all phases of the control of the possession, manufacture, distribution, delivery, and dispensing of cannabis for medical purposes by registered cannabis establishments in the state pursuant to the Nebraska Medical Cannabis Regulation Act is vested exclusively in the commission.

Sec. 6. The commission shall:

(1) No later than July 1, 2025, establish criteria to accept or deny applications for registrations, including adopting, promulgating, and enforcing reasonable rules, regulations, and eligibility standards for such registrations; (2) No later than October 1, 2025, begin granting registrations to applicants that meet eligibility standards and other requirements established by the commission; (3) Grant, deny, revoke, and suspend registrations based upon reasonable criteria and procedures established by the commission; (4) Have the authority to adopt, promulgate, and enforce distinct sets of rules and regulations for different categories of registered cannabis establishments; (5) Administer oaths or affirmations as necessary to carry out the Nebraska Medical Cannabis Regulation Act; (6) Issue subpoenas for the attendance of witnesses or the production of any records, books, memoranda, documents, or other papers or things at or prior to any hearing as is necessary to enable the commission to effectively discharge its duties; (7) Inspect the operation of any registered cannabis establishment for the purpose of verifying compliance with rules and regulations adopted and promulgated by the commis-

sion; (8) Have the authority to impose, subject to judicial review under the Administrative Procedure Act, administrative fines for each violation of any rules and regulations adopted and promulgated pursuant to the Nebraska Medical Cannabis Regulation Act; (9) Collect administrative fines imposed under this section and remit the fines to the State Treasurer for distribution in accordance with Article VII, section 5, of the Constitution of Nebraska; (10) Establish procedures for the governance of the commission; (11) Acquire necessary offices, facilities, counsel, and staff; and (12) Do all things necessary and proper to carry out its powers and duties under the Nebraska Medical Cannabis Regulation Act, including the adoption and promulgation of rules and

regulations and such other actions as permitted by the Administrative Procedure Act.
