Local and National Happenings

T

here is so much going on at NHHBA and NAHB that I don’t even know where to start. Locally, there have been a lot of excellent chapter meetings. I was fortunate to be able to attend the holiday functions for Southern New Hampshire as well as Greater Manchester-Nashua. The charitable efforts during these events were amazing. The Lakes Region hosted a health insurance panel that was extremely well received. The most significant local activity of late is the merger of the CT Valley and Southwestern locals. They saw the opportunity to be stronger together, and with some assistance from NHHBA and NAHB, the merger was approved during the winter board meeting of NAHB in Orlando in January. Look for a renewed level of enthusiasm and some great events to come from the new combined group. At the state level, NHHBA has been hard at work. We continue to get our state association more in line with the rest of the state associations across the country with the focus on advocacy. The state will continue to be the conduit for important national information and is there to assist the locals with things like mergers or publicizing events on a statewide basis. We will also continue the membership administration until the new NAHB system rolls out later this year at which time NAHB will be handling it on line for everyone. Our 50th Home Show will be held on March 17-19th in Manchester. It looks to be another great show for NHHBA, and the show committee and staff have been working tirelessly to ensure that for our members and attendees. We are always in need of more volunteers and I encourage you to reach out to the state office and let us know if you can help out for a few hours on one of the days. It’s a great opportunity to network with your fellow members and have fun at the same time. We have also been notified that NAHB second vice president Greg Ugalde will be on hand for the ribbon cutting and to attend the show. Greg is a home builder from Connecticut and it’s nice to know someone from New England will be heading up NAHB soon. Some other big news is that NHHBA has just been awarded a $20,000 grant for advocacy. NAHB set aside $1,000,000 for states and locals to apply for grants for whatever they felt would help their association. The program was brought forward to the board by Lakes Region member Joe Landers. We submitted an application, and even though there was about $3,000,000 in requests, we were fortunate enough to be informed during the International Builders Show that we were a recipient. We were also awarded one of the higher amounts. This is an example of NAHB recognizing the hard work of our government affairs team and also seeing the work we are doing to streamline what the state association does. A big thank you goes out to Sharon Wayman, of the budget committee, and Joe Landers. If it were not for them, this would never have happened. Lastly, from a national front, I am proud to say that during the International Builders Show, I was sworn in as your Area 1 National Area Chairman (NAC). I am humbled and honored to be able to serve you in this capacity. There are 15 NACs at NAHB, each representing an area of the country. I represent New England. We report to the five senior officers and help direct the efforts of the NAHB State Representatives. If you ever have any concerns you would like brought forward, please don’t hesitate to let me, as NAC, or State Representative Greg Rehm know. I am so proud of everything we have accomplished over the past seven months at NHHBA. Board meetings have been well attended and lively to say the least. Lots of personalities and lots of opinions make for a better and stronger association. I look forward to the continued growth and increased relevance of The New Hampshire Home Builders Association and encourage you to be as active as you can. I guarantee that you will find it personally and professionally rewarding. Yours truly,

New Hampshire State Home Show Celebrates Golden Anniversary

T

he longest-running and largest show of its kind in Northern New England is returning to New Hampshire. The Association and its allies keep a close watch on pending legislation, providing explanations and how it can affect your business. Inaction could lead to problems throughout the industry, according to NHHBA leaders. The New Hampshire State Home Show, sponsored by the New Hampshire Home Builders Association, marks its 50th year this year, as it returns to the Radisson Hotel in Manchester from March 17-19, with hundreds of experts, interactive exhibits, informative seminars, the New Hampshire Home Builders Association Junior Lego Build and a Tiny House Village. “The New Hampshire State Home Show is the only place where home owners or home owners to-be can find all the resources for remodeling, buying or building a home under one roof,” says Dianne Beaton, owner of 2DiFore Marketing Solutions, NAHB national 8

associate chairman and representative to the NH NAHB Build Pac. “We are also excited to have the Tiny House Village at the show. This is sure to be a big draw and you can bid on the tiny homes on display. The Jr. Lego Build is back bigger than ever. Since it’s St. Patrick’s Day weekend, we will also have some surprise giveaways on both the 17th and 18th.” This year marks the 50th anniversary of the New Hampshire State Home Show, as well as the 75th Anniversary of the National Association of Home Builders. Organizers have created special events to mark the occasion. With more than 300 vendors participating, the show is also a networking opportunity, leading many vendors to return year after year. “The show is the biggest networking opportunity that the New Hampshire Homebuilders Association provides to its members,” Beaton says. “This is the one venue where you can not only meet large numbers of potential clients and sell your services, but also SPRING 2017

where you can network with colleagues and build those relationships that are so essential to success. This is a prime opportunity to make important contacts.” Merrimack County Savings Bank has been participating in the show for 13 years, and has also been a show sponsor for that length of time. “Participating is invaluable to us,” says Mark Chalifour, vice president of Residential Mortgage Lending for Merrimack County Savings Bank. “Whether people are looking to purchase or improve a home, we can help them. Being at the show helps us establish a better relationship with our community and with members of the Homebuilders Association. It’s important for us to make people aware of what we do and how we can help.” Johnson says the show is always busy so it is easy to connect with many potential clients in one weekend. “We actually take appointments right at our booth,” says Cindy NHHBA.com

We also walk around the show and introduce ourselves. Even though our bank has been around for 150 years, it is still good to make people aware of our services and let them know we are here to help.” Kevin Salemi of Lewis Builders in Atkinson, will be new to this year’s home show, but his company is not. “We have been attending for the past five years,” he says. “It’s important to be part of an event that is so significant to the building community. We know it is great exposure for our brand and allows people to get to know our services and see samples of our work.” Lewis Builders goes all out on its booth, with two video displays, slide shows and giveaways. While Salemi feels the dynamic visuals may encourage people to come over, ultimately it is the face to face conversations that make the most impact. GRANITE STATE BUILDER MAGAZINE

Tiny Houses, Little Blocks a Big Draw at NH State Home Show Outside of the hundreds of vendors, two of the biggest draws at this year’s show will be the return of the Junior Lego Build and the Tiny Village. Contestants in the Junior Lego Build will have one hour to build a house with Legos provided by the NH Junior Lego League. This year’s event will have a theme that ties in with the 50th Anniversary of the show. Because last year’s event was so popular, the 2017 contest will have 5 to 8-year-olds competing on Saturday, and 9 to 12-year-olds competing on Sunday. This year’s Tiny House Village includes work by students from four different vocational/technical schools from around New Hampshire. The students have built five different Tiny Homes which will be on display, which will be auctioned off at the show. The schools involved include the Seacoast School of Technology; Alvirne High School, of Hudson; Laconia’s Huot Career and Technical Center; and Kennett High School, of North Conway. “New Hampshire, and other states, need to encourage more young people to consider careers in the building industry in order for our growth to continue,” says Todd Mezzanotte, NAHB associate national director and chair of the Tiny House Oversight Committee. Last year, Kendall Buck, former executive officer of the New Hampshire Home Builders Association, and Scott Palmer, former NHHBA membership director, had the idea to reach out to the vocational/technical schools about each building a Tiny Home, Mezzanotte says. They also approached the New Hampshire Lottery Commission for assistance in funding the project.

The schools have also received in-kind donations from companies such as Dead River Company, F. W. Webb, Harvey Building Products, Cyr Lumber, and Pella, with some sending teams to the schools to teach the students best practices and installation techniques. Mezzanotte says that since the Tiny House project began, other students have been asking how they can get involved in building careers, and the communities have gotten behind the project as well. “It’s been a win-win for everyone involved,” he says. “These little homes have captured people’s imaginations and everyone is amazed by how well the students have done. Many people have asked how they can help.” Each home is roughly 200 square feet and can sleep three. They have bathrooms, mini kitchens and living areas and are fully insulated, wired and prepped for heating. Some of the designs can be seen online at tumbleweedhouses.com. “Getting the chance to talk with people about what they want, what questions they have and how we can serve them is priceless,” he says. “We get a sense of what their needs are, and that allows us to better assist them. Being at shows like this also generates tremendous word of mouth and brand awareness.” Salemi is also looking forward to talking with other vendors and getting to know his colleagues in the home building trades. “I know there are lots of great connections to be made and it will be fun to see the cool stuff other people are doing,” he says. “You rarely get to come together like this with others in your field, so this event is well worth it.” Lynnette Rogers, of Homescapes of New England in Epping, is another veteran of the annual event, having participated for six years. “We offer James Hardie fiber cement siding, so the show is a great way to educate a large swath of the public about our products,” she says. “Plus, as an association member, we get a discount on our booth so it’s a good deal. Participating in the home show consistently gives us leads, whether from current homeowners or people planning to build. We’ve even had people bring in their house plans to show us. Some folks may not be planning to build for a few years, but want to learn more about our siding, so it’s a great chance to share information.” 10

Because Homescapes of New England’s sidings are not as common as vinyl, Rogers finds that a big draw at their booth is having lots of samples on display. She says customers love having the chance to touch and feel the product. “It’s not something most are familiar with, so getting to see all the different options is critical,” Rogers says. “It’s also key that we get to have conversations with the consumer. I used to work for the manufacturer, so I can answer a lot of their questions and get them up to speed on the products’ benefits and uses. I would never be able to reach as many people as effectively if it weren’t for the show.” Beaton expects this year’s crowd to rival or exceed last year’s attendance. “Attendance has steadily surged since the economic downturn, and we feel confident that this will be another strong year. People still dream about having a home or having a certain kind of home. he National Association of Home Builders’ (NAHB) Remodeling Market Index (RMI) posted a reading of 53 in the fourth quarter of 2016, a decrease of four points from the previous quarter, but on par with levels seen in the first half of 2016. Remodeler confidence has held firm in positive territory for 15 straight quarters. An RMI above 50 indicates that more remodelers report market activity is higher (compared to the prior quarter) than report it is lower. The overall RMI averages ratings of current remodeling activity with indicators of future remodeling activity. “Many remodelers are seeing consumers commit to larger, long-term home improvement projects,” said 2017 NAHB Remodelers Chair Dan Bawden, CAPS, GMB, CGR, CGP, a remodeler from Houston. “As Americans are seeing wages and home values rise overall, it gives them greater confidence to go ahead and invest in their homes.” Returning to levels seen early last year, the RMI’s current market conditions index 16

dipped to 53, down three points from the previous quarter. Among its components, major additions and alterations waned one point to 53, demand for smaller remodeling projects decreased by four points to 52, and the home maintenance and repair component declined by five points to 54. The index measuring future market indicators reached 52, about the same level as early 2016, but six points lower than in the third quarter. Among its four components, calls for bids and appointments for proposals fell to 49 and 54, respectively, the backlog of remodeling jobs dropped three points to 55, and the amount of work committed declined five points to 50. “At 53, the Remodeling Market Index is consistent with NAHB’s forecast that remodeling market activity will continue to grow over the next two years, but at a more moderate annual rate of 1 to 2 percent,” said NAHB Chief Economist Robert Dietz. New home sales fell 10.4 percent in December 2016 to a seasonally adjusted annual rate of 536,000 units. “We are encouraged by the growth in the housing sector last year, and by the fact that builders increased inventory by 10 percent in anticipation of future business,” said Robert Dietz, chief economist of the National Association of Home Builders (NAHB). “NAHB’s forecast calls for continued upward momentum this year, with housing starts expected to rise 10 percent over the course of 2017.” “To ensure sales continue to move forward in 2017, builders need to price their homes competitively, especially given that mortgage interest rates are expected to rise this year,” said NAHB Chairman Granger MacDonald, a home builder and developer from Kerrville, Texas. The inventory of new home sales for sale was 259,000 in December, which is a 5.8-month supply at the current sales pace. The median sales price of new houses sold was $322,500. Regionally, new home sales increased 48.4 percent in the Northeast. Sales fell 1.3 percent in the West, 12.6 percent in the South and 41 percent in the Midwest. SPRING 2017

This Year in the State House

T

he new legislative session in Concord is well underway, with plenty of bills that impact the residential home building interests in play. Some are old, some are new and all are on the watch list of the NHHBA Government Affairs Committee. This year’s top priority is the same as last year: Building and Fire Codes. We are currently governed by the 2009 versions of the International Residential Code and its ICC brethren. We are also under the 2009 version of the NFPA1 Fire Code. Both of these codes have legislation pending to adopt the 2015 versions. At the time of this writing, NHHBA has only one issue left to be resolved that is common to both proposed codes – that of the protection of lightweight construction (I-joists and floor trusses) in the event of a basement fire. Under the current versions, there is no requirement to do anything different than if your floor joists were simply sawn lumber, like a two-by-twelve. Under both of the proposed 2015 building and fire codes, you would have to install sheetrock below these lightweight floor assemblies as a means of fire protection. There is another alternative: install a fire sprinkler system. Good faith meetings have been taking place between the home builders, the state fire marshal, town fire chiefs and code officials in an effort to find an acceptable compromise for this code requirement. Most of the discussion has centered around use of the domestic water lines and sprinkler heads that can be installed by a plumber, presumably at less cost than a standard sprinkler system. So far, these talks have been cordial but have not yielded an acceptable solution. Given the lag between the time of this writing and the publishing of this magazine, you should contact us for the latest on this important code item. Given our recent victory last year, we are closely monitoring three separate bills regarding regulation of Accessory Dwelling Units (ADUs). Sen. Kevin Avard (R-Nashua) has a bill that attempts to lower and simplify the complications that can arise with ADUs, existing septic systems and DES requirements. His bill is helpful and intended to remove barriers to this important housing choice. Sen. Martha Fuller-Clark (D-Portsmouth) has one that prohibits ADUs to be used for short term rentals, a problem in destination cities like Portsmouth. There is another bill in the House by Rep. Carolyn

Matthews (R-Raymond) which addresses whether towns may prohibit ADUs in a condominium. The Government Affairs Committee is watching all of these bills closely so that ADUs remain a viable alternative means of housing. In terms of issues that seem to come up every session, a bill has come back that once again seeks to regulate the development of dry land through the Wetlands Permit Program. Known in the past as the indirect impacts, the bill would expand the jurisdiction over dredge and fill in wetlands to include buffer areas in the adjacent uplands. First, it defines wetlands on a tiered basis and assigns statewide setbacks to said wetlands depending on the importance of their functions and values. This approach relies heavily on criteria from various state agencies and the opinion of certified wetland scientists which can vary with individuals. It is further problematic in that local ordinances can supersede these state buffer setbacks in numerous ways. The result is that there will certainly be a serious loss of otherwise developable land and the home builders are therefore strongly opposed to the measure. Related, but far less worrisome, is a bill by Sen. Jeb Bradley (R-Wolfeboro) that tweaks the Shoreland Protection Act. The various minor changes this would bring about were evaluated for their effect and the Association has not found reason to object. Since the time of the major updates to the Act over the last decade, members report satisfaction with the program both in terms of permit application turnaround and the resulting developability of shorefront tracts. So, while the Senate version is acceptable, we remain watchful in case the House wants to fiddle with it any further. In addition to the important bills listed above, we are also monitoring legislation that would impact the way ZBAs vote on variances, notify abutters and continue public hearings. The municipal process is important for fair and timely outcomes to land use applications. There are bills that would turn the administration of the lead paint LRRP over from the federal EPA to the NH Health and Human Services Department, a measure we have opposed in the past and will again this year. Issues in this session are as narrow as the circumstances under which an arc fault receptacle may be replaced and as broad as a $25,000,000 appropriation for the NH Affordable Housing Fund. New Hampshire Condo Law Enhanced Governance Requirements Take Effect for Condominium Associations provide unit owners with an opportunity to comment, except for meetings in executive session, which may be closed but where no final vote or action is allowed to be taken. Directors are now expressly prohibited from using incidental or social gatherings to evade open meeting requirements.

New Member Meeting Requirements

S

ignificant changes to the way condominium owners’ associations elect officers and directors, conduct meetings and adopt budgets under the New Hampshire Condominium Act, RSA 356-B, became effective on August 1, 2016. Builders preparing bylaws for new residential condominium developments or purchasing development rights at an existing condominium should familiarize themselves with the new requirements.

Changes Applicable to Association Directors and Officers Bylaws must now specify the powers and responsibilities of the board of directors and it is no longer permissible for an Association to operate without a board of directors. The Condominium Act still recognizes a period of developer control under RSA 356-B:36, during which the powers and responsibilities otherwise assigned to the association board of directors may be exercised by the declarant, provided that the condominium declaration appropriately reserves such rights. Members seeking election as officers or directors may now be subject to a background check, if authorized by an association’s bylaws. If elected as director, the new law imposes a fiduciary relationship between the board and the association members, making director (and officer) insurance coverage more important than ever. Such coverage serves to both protect directors (and officers) and attract qualified candidates who might be wary of the heightened potential liability imposed by a fiduciary standard. Boards of directors are encouraged to provide greater transparency to their members under the new laws. Regular board meeting must be held at least quarterly with 10 day advance notice to unit owners, except in the case of emergency. Board meetings must be open and 20

Condominium owners’ association meeting and voting procedures requirements are also significantly expanded. Members are entitled to compel a special meeting on any matter if called for by members representing 33 percent or more of the voting interest in the association, or any lower percentage the bylaws may specify. Any former uncertainty over whether meetings may be called for the express purpose of removing an officer or director is resolved with a new affirmation of that lawful purpose. Now, any officer or director may be removed from his or her position at a meeting, with or without cause, if votes in favor of removal exceed votes against. Associations may also vote on matters without meeting, upon prior notice and ballot compliance. Proposed annual budgets or special assessments must be supplied to unit owners in advance and ratified or rejected at a meeting. Unless a proposed budget or special assessment is rejected by the votes of two-thirds of the unit owners, it is deemed ratified. Emergency special assessments adopted by two-thirds of a board of directors are exempt from the unit owner voting and ratification requirement. Association meeting notices may now be delivered electronically if an email address is designated by a unit owner. One final observation – be sure to stock up on copies of Roberts’ Rules of Order Newly Revised for elected officers and directors because all meetings are now required to follow those procedures, unless waived by the bylaws. This article highlights certain of the recent key changes to association governance provisions of the Condominium Act, but the full scope of the changes to the Condominium Act is broader. Condominium owners’ associations that ignore these new requirements risk a range of consequences, from having future actions rescinded to potential litigation. Builders creating new condominiums or amending existing bylaws to suit their development needs may take advantage of authority to strengthen, relax or waive certain governance requirements, but only if the bylaws include a clear statement of that intention. 55+ Housing Market Ends Fourth Quarter on Record High

B

uilder confidence in the single-family 55+ housing market remains strong in the fourth quarter of 2016 with a reading of 67, up eight points from the previous quarter, according to the National Association of Home Builders’ (NAHB) 55+ Housing Market Index (HMI) released today. This is the highest reading since the inception of the index in 2008. “The significant increase in the index reading is attributed partly to a post-election boost, as many builders and developers are encouraged by President Trump’s commitment to cut burdensome regulations that negatively impact small businesses,” said Dennis Cunningham, chairman of NAHB’s 55+ Housing Industry Council and president of ActiveWest Builders in Coeur d’Alene, Idaho. “Builders and developers in this market segment are also encouraged by the fact that for the next 15 years, 10,000 baby boomers will be turning 65 every day. The consistent pressure of this age group wanting to downsize from a large home, shifting to other regions of the country or just simply looking for a newer home or community also play a key role in the index movement.” There are separate 55+ HMIs for two segments of the 55+ housing market: single-family homes and multifamily condominiums. Each 55+ HMI measures builder sentiment based on a survey that asks if current sales, prospective buyer traffic and anticipated six-month sales for that market are good, fair or poor (high, average or low for traffic). An index number above 50 indicates that more builders 22

view conditions as good than poor. All three index components of the 55+ single-family HMI posted increases from the previous quarter: Present sales and expected sales for the next six months posted index-highs, increasing 11 points to 74 and 10 points to 75, respectively, while traffic of prospective buyers rose two points to 49. The 55+ multifamily condo HMI decreased two points to 46. The index component for present sales fell one point to 50, expected sales for the next six months increased one point to 52 and traffic of prospective buyers dropped three points to 35. All the four indices tracking production and demand of 55+ multifamily rentals increased in the fourth quarter. Present production rose six points to 54, expected future production increased 11 points to 60, and current demand for existing units and future demand posted index-highs, jumping 12 points to 71 and 17 points to 76, respectively. “The strong performance of the 55+ HMI at the end of 2016 is consistent with recent increases in broader measures of the housing market, including new home sales and the NAHB/Wells Fargo HMI,” said NAHB Chief Economist Robert Dietz. “We expect continued growth in the 55+ market in 2017, although builders in many places will still face challenges in finding adequate supplies of inputs like labor and lots.” For the full 55+ HMI tables, please visit www.nahb.org/55hmi.
