Desde el ejecutivo en Brasil, Dilma Rousseff lanzó su Plan Nacional de Banda Ancha; Cristina Fernández de Kirchner diseñó Argentina Conectada y muchos otros programas de TIC sociales; España cuenta con un proyecto de Ley de Telecomunicaciones y una Agenda Digital apegados a la norma europea; el presidente Sebastián Piñera de Chile tiene en sus manos el anteproyecto de Agenda Digital; el presidente Juan Manuel Santos de Colombia lanzó el Plan Vive Digital, mismo que fue reconocido en su momento como la mejor política pública en la materia. Los conceptos que emplea la reforma de Peña Nieto, la regulación que propone y los plazos que dispone son los correctos para un gobierno que inicia un mandato y que está obligado a dinamizar el sector. Sin embargo, es importante plantear algunas cuestiones con el ánimo de que la discusión de la iniciativa por los legisladores, y la regulación secundaria, permitan un marco legal robusto en función del derecho a la información. Por esa razón, Mediatelecom Policy & Law propone el Forum 2013, un espacio de dialogo y reflexión para el día después de la reforma; es decir, para la contrucción del modelo regularorio y el diseño de la política pública. La reforma a las telecomunicaciones centra la estrategia en el dinamismo de los servicios de datos fijos y móviles con el despliegue de una red troncal y el aprovechamiento de la banda de 700 MHz. Recientemente, México subió 13 posiciones en el Indíce de Tecnología de la Información del Foro Económico Mundial. Uno de los servicios con mayor dinamismo de los últimos años ha sido la telefonía móvil. En México la penetración se ubica en 85.7 suscripciones por cada 100 habitantes, equivalente a 100.6 millones de suscripciones móviles. Existe un clima de oportunidad porque los usuarios muestran un mayor uso del terminal y sus servicios. El tráfico móvil mostró una tasa de crecimiento de 17.8 por ciento. En el caso de la banda ancha móvil, se reportó un crecimiento de 50.9 por ciento, para un total de 11.3 millones de usuarios, tendencia reportada por los operadores, que ven en este servicio una clara oportunidad de crecimiento en los próximos años. Para que este segmento del mercado muestre una mayor demanda por parte de los usuarios, se requiere de infraestructura física y móvil, despliegue de redes de transporte y liberación de bandas del espectro. Por su parte, la telefonía fija mostró un avance de 1.7 por ciento con respecto al cuarto trimestre de 2011, para lograr 17.1 líneas por cada 100 habitantes. En el caso de la televisión restringida, el servicio satelital (DTH) continúa mostrando la mayor tasa de crecimiento, al avanzar 22.8 por ciento durante el último trimestre de 2012, para alcanzar un total de 6.9 millones de suscriptores. Este es el escenario de las telecomunicaciones en México. Tras la aprobación de la reforma constitucional en materia de telecomunicaciones debemos trabajar juntos para legislar la reglamentación secundaria, diseñar la Agenda Digital y definir los objetivos, estrategias y líneas de acción de política pública en el Plan Nacional de Desarrollo 2013-2018, para combatir la pobreza, generar desarrollo y crecimiento económico con la oportunidad digital.
