UP TO £1.6m IN DAMAGES FOR SKIPPER
A professional yacht skipper could receive £1.6m in damages after he was hit on the head by a 10kg steel pulley on a multi-millionaire’s superyacht.
Adam Prior says he had to give up a life at sea after he was struck in the face by the pulley while racing off the Isle of Wight in July 2015 on board the Eleonora E.
Mr Prior, 40, sued Peras Ltd, the company which owns the boat, for £3.2m, claiming he suffered brain damage, blaming unsafe weather and lack of maintenance on the rigging for his accident.
The company denied all blame and said Mr Prior was ‘the author of his own misfortune’.
After a four-day trial at the High Court, Judge Richard Davison ruled that both Mr Prior and the ship’s owners were equally to blame. The amount of compensation is to be assessed but is set to be reduced by 50% due to Mr Prior’s own negligence.
The judge said the yacht’s owners provided unsafe
Multihull designer dies
Multihull designer and boat builder, Derek Kelsall, has died aged 89.
Derek is credited with creating the modern-day trimaran, introducing French sailing legend Eric Tabarly to multihulls and being one of the first to champion foam sandwich construction.
Derek was born in North Wales in 1933, growing up in humble surroundings. He studied engineering at Bristol University but was unable to complete his degree when he ran out of money. His career took him to Texas, at the time when his passion for boating was growing, along with an interest in multihulls, both sailing and building them.
equipment in the shape of a metal rod attached to the 10kg pulley block. Metal sheeting was found to serve no practical purpose and was a cause of the accident.
However, the judge said Mr Prior was equally negligent as he crossed through the ‘danger triangle’, area of the ship - where there was extensive rigging and heavy blocks running free.
The judge was told Mr Prior crossed by the shortest and most direct route however he could have used a safer route. He also failed to crouch or check the blocks were out of the way before moving across.
Mr Prior claimed the wind was gusting up to 30 knots – a claim denied by the defence - and Eleonora E shouldn’t have been racing.
However the judge stated the wind had played no part in the accident.
He enjoyed success with his small trimaran designs, with the 45ft Toria one of the most influential multihulls ever, establishing the fundamental concept of what a racing trimaran should look like.
His use of foam sandwich construction attracted some of the top campaigns including Sir Thomas Lipson’s 1968 OSTAR victory.
KSS, the Kelsall Swiftsure Sandwich technique, used flat panels that could be laid up rapidly on a table, enabling construction time to be dramatically reduced, a process Derek first used in 1973 and constantly evolved over subsequent decades.

CHALLENGING Q3 2022 VIEWPOINT
KATINA READ | Editor kread@boatingbusiness.com
Our hobby is our work
As we look forward into 2023, I’ve been reminded that despite all the problems the industry has faced – and is still facing – we are lucky to be working in a market that is generally our hobby.
The war in Ukraine shows no sign of being over any time soon and the resulting energy and food crisis, high inflation and interest rates and the current recession are affecting everyone.
The industry is still facing supply issues – although these are easing – and it’s facing a slow-down as consumers start to think about their outgoings and defer big-ticket spending, especially in the smaller boat segment.
The papers and the national news are again full of doom and gloom.
However we are lucky that we can still occupy ourselves professionally with the nicer aspects of life.
And what could be more satisfying than working with boats and their components? How many people can say their job involves taking time away from the office to have fun on the water?
The vast majority of those who work in the marine industry either own a boat or have access to one – many businesses were started because boating was the owner’s hobby.
And it’s a great way to take our minds off the current changes and challenges and look to the future.
These challenges will require targeted action and solid cash flows and reserves until inflation eases, interest rates start to go down again, and consumers start spending again.
And we’re going to have to get used to further changes and developments as the industry fights for its share of consumer spending.
And technology will play a major part in this.
Whereas in the past the marine industry has been slow to adopt technology - it’s been called a cottage industry more than once - there’s no doubt that the industry is now much more receptive and has overcome an initial reluctance to adopt new methods of working.
At the recent tech show, CES, companies revealed their thoughts on boating in the future and the use that technology will play in bringing this vision to life while also addressing the world’s biggest challenges.
How to make boating more accessible and open to all was also on the agenda, together with sustainability, from electric boating to recharging and renewables.
The show saw numerous product launches, major company announcements and innovations to help solve global challenges, from transportation – self-drive tech and autonomous boating - and mobility to sustainability.
Innovations to conserve energy and increase power generation, and innovations to provide high power and fast charging options.
We are in the middle of an era of great change which will be with us for some time into the future. And we’re going to have to get used to a new normal after the boom of the last two years.
But at least we get to play with boats while calling it work.
With uncertain economic conditions, supply chain constraints, and an overall reduction in global trade, Q3 2022 was challenging for the boating sector.
Nevertheless, taking pre-pandemic numbers as a baseline, the industry demonstrated remarkable resilience.
According to the latest report from Denison Yachting, globally, customers bought 10% fewer boats than they bought in the third quarter of 2021, a 30% drop from the record sales of the third quarter of 2020. Overall numbers were 9% below Q3 2019.
Sales across all the major yacht markets dropped compared to Q3 2021.
In North America, sales were 9.5% lower than in the same quarter 2021.
In Europe, customers bought 11% fewer boats in France, Italy, Spain, and the Netherlands than in Q3 2021.
In Asia there was a 19% drop in purchases. Customers in China, Japan, and Singapore bought fewer boats in Q3 2022 than in any third quarter since 2015.
In North America, the Southeast, Gulf Coast, Northeast, and Mid-Atlantic regions remained the most dominant yacht markets for the third consecutive Q3.
Collectively, sales in these markets dropped by 10% from the third quarter of 2021, but still made up more than 70% of the total sales in the US.
Five categories
Sales of the top five boat categories in the US – centre consoles, motoryachts, sportfish, trawlers, and day sailboats –were, on average, 8% lower than in the third quarter of 2021. However, some categories performed much better than others.
Centre consoles were the best-selling boats for the second Q3 in a row, accounting for 42% of all boat sales in the US, up from 36% in the third quarter of 2021, the only boat type that recorded higher sales during the quarter than in the same period last year.
Sales of the number-two category, motoryachts, dropped by 32%, a shift that
8 Sales of the top five boat categories in the US were, on average, 8% lower than in the third quarter of 2021
can be partially attributed to a more cautious boat market, with some wouldbe motoryacht customers choosing smaller, more affordable options or waiting for more favourable economic times.
Sportfish sales recorded a 14% drop from Q3 2021 with trawler sales remaining the same as last Q3, while day sailboat sales were down by 20%.
Charter boom
While new boat sales struggled to maintain the momentum of the last two years, yacht charters continued to boom in Q3 2022.
Denison says market reports indicate luxury yacht charters increased by 20% in 2022 compared to 2021 and the company expects the number of people chartering yachts to grow in Q4 and beyond, driven by continued interest from first-time charterers and experienced boaters alike.

The Russian market of leisure ships is facing stagnation, as the ongoing military conflict between Ukraine and Russia and unprecedent sanctions leads to a sharp drop of the industry both in terms of output and sales, writes Eugene Gerden.
According to data from the Russian Alto Consulting Group, prior to February, 24, 2022 the average number of leisure craft produced in Russia was in the range of 65,000-70,000 units per year. Domestic producers account for 95% of the market in volume terms (mostly small and mediumsized leisure boats), with the remaining accounting for superyachts, most of which are not registered in the Russian jurisdiction.
In terms of production, currently the Volga Federal District remains a leader boat-producing region in Russia with a share of about 57.5% in the overall output.
Among the leading domestic leisure ships’ brands in Russia are Baikal Yachts, Bering Yachts and Boat Marine.
RUSSIAN MARKET FACES STAGNATION
The results for 2022 are currently not available, however, most of the local experts expect the decline of boats’ output in the country to be in the region of 15-20%, compared to 2021. That will be around a 30-40% decline of the market from
that observed during the period of 2020-2021.
According to data of experts of Delovoy Peterburg business paper, at present the Russian leisure boat market is valued in the range of RUB 13-15 billion (US$200-250 million).
In terms of the structure of the market, motor boats account for up to 75%, while the remaining 25% is for sailing yachts.
MARINE TRADE BOOK ACQUIRED

Aston Lark, a Howden company, has acquired the commercial direct marine trade book from Navigators & General (N&G), part of Zurich UK.
The acquisition of the commercial direct marine trade book from N&G will allow Aston Lark, together with its Haven KnoxJohnston brand, to offer insurance to businesses across the marine industry.
N&G’s commercial marine products and underwriting capacity remain unchanged. N&G will continue to offer commercial marine products to customers through insurance brokers, alongside its specialist cover for pleasure craft.
“We believe the needs of commercial customers are best served by brokers,” said Graham Clark, head of
Navigators & General. “Today’s announcement gives our customers
access to the benefits of a specialist insurance broker, whilst retaining the marine
underwriting expertise of Navigators & General. We look forward to continuing to develop our strong relationship with Aston Lark as we further grow our business.”
RETURN PUMP OUT CUSTOMER
Warwickshire based Marine pump out company LeeSan has replaced the original pump out station at Waverney River Centre, on the Norfolk Broads, which had been in service for over a decade.
“It’s always good when a customer is happy to come back to us for replacement equipment,” said Karl Sutcliffe,
LeeSan’s technical director. “It shows that they are happy with both the kit and the service.”
The new unit is a LS200W pump out station fitted with a 2in peristaltic pump, with a safety control panel linked to a token mechanism and stop button.
The station is timer controlled to eliminate any dry running and to
allow the marina to charge appropriately for each use.
To overcome the challenges of flooding as well as wash from passing boats on the Broads, it has been mounted on a plinth.
Ongoing work will be undertaken to improve the installation with additional groundworks and relocation of the pipework in an underground duct.

BOATING FOR EVERYONE VISION
8 Volvo Penta could deliver a range of services to boaters through a series of floating islands
Below the waterline these islands could play a crucial role in helping the marine environment for example by hosting a mussel farm.
Artificial intelligence, subscription-based services and even purposebuilt islands are the future of leisure boating, according to a new vision from Volvo Penta.
The company presented ‘ground-breaking thinking’ focused on making boating more open and accessible at this year’s Consumer Electronics Show.
Johan Inden, president of Volvo Penta’s global marine business, said that being on the water created emotional connections for people. “It’s difficult to convey the true experience
and enjoyment you get from exploring, seeking out new adventures or spending time there with friends and loved ones,” he said.
“We want to take this further and make it available to a wider population - boating for everyone.”
Technology will play a big part in realising these ambitions, says Volva Penta. Key focuses include boating as a service using subscription-based, on-demand services and boating experience ‘packages’.
Sustainability is, of course, high on the agenda with a range of possibilities like vesselto-vessel energy sharing, automatic recharging using submersible ‘Stingray’ pods, and signal-sharing between boats when vulnerable marine life is in the vicinity.
Most striking is Volvo Penta’s ‘Island experience’, a floating independent island offering recharging facilities, restaurants, support and concierge services. Each would be powered by renewables and capable of positioning itself where needed.

How I got into this industry... I think I was influenced by my father really. I desperately tried to stay out, but ended up working for a charter company down in Cornwall for a Summer prior to going to university and was pretty much hooked since.
Best advice I’ve ever received... Really get to know the people you work with, both within your company and your customers. I have made and built some great friendships with people I have met along the way.
One thing the industry needs less of is...
Barriers to entry – we need to open ourselves up to everyone. It still seems that it is very hard to get into boating. There are some people who are working really hard on this and having some success, but it still seems to be too hard.
Most hated buzzword or workplace expression... Reach out – God I hate that phrase.
Best place I’ve been... I love cycling and skiing and so the alps are my favourite place. It seems to cover both which is a plus
Don't worry about... Things you cannot control. I have only learnt this recently, but it does shift a lot of weight off your shoulders.
Favourite meal... Without doubt - Lasagne.
One thing I couldn’t live without... My bikes.
How I cope with stress... Cycling – I believe that there is no better place to sort out your thoughts and feelings than when out on the bike.
Something about you that people might be surprised by... Before working in the charter business in Falmouth and going to university, I spent a year at drama college in London.

Welcome to 2023 and all the opportunities that it will bring.
Stepping back from the current recession or slowdown worries that dog the Westen world, my thoughts turn to a bigger long-term problem that’s never really been addressed in the industry.
If you work on the basis that our leisure marine sector is in reality a small sector that over performs in terms of its impact being driven by knowledge, enthusiasm and connections – how do you sustain this in the years ahead?
Bear with me here. Look around you. See the people you have always seen, but who are older, businesses that have long industry associations. How do you create the opportunities for the newer business and younger folk to come through and develop?
Yes, to a degree our sector has always been about who you know and using links to broaden your web of contacts, but if you were looking from the outside looking in who would you speak to and how would you connect with the right people?
Social networks I hear you cry, yes some are useful, but let’s be honest how many messages do you get that you don’t even look at, as you assume (mostly correctly) that it’s just someone trying to sell something you never knew you wanted or need…
What we need is a network to encourage the new, the people the business and most of all the enthusiasm for our amazing world, before it’s too late.
When I have seen us get together at events, we are amazing. We are open and inclusive, we are encouraging of new, if only we had a mechanism to regularly achieve this, the UK industry would truly honour its roots.
Let’s start a revolution, not just from our beds.
Recreational boat owners will no longer eligible for Returned Goods Relief (RGR) on boats kept in the EU following a decision by the Government.
The ruling means that boat owners who lawfully purchased and kept their boat in the EU at the time the UK was an EU member, will need to pay a second VAT charge.
The latest decision is contrary to previous advice given by the Government.
“It is therefore a deeply disappointing outcome and falls well short of resolving the issue for those who have been caught out by incorrect advice provided by the Government,” said Mel Hide, RYA Director of External Affairs. “It would also seem to fall short of the Government commitment to assist UK industry as we forge our future outside of the EU.”
In April 2019, and November 2020, the Government confirmed that the intended UK policy was that a UK vessel would not
VAT U-TURN FOR BOAT OWNERS
lose its status as VAT paid in the UK because it is outside UK territorial waters on EU Exit Day.
However, in December 2020 HMRC stated that
previous advice was incorrect and that it would be unable to apply an easement for returning vessels after the UK left the EU.

REVENUE GROWTH FOR HANSEYACHTS
An increase in demand and the worldwide shortage of new boats being produced have led to record order books and revenue growth for HanseYachts.
The boatbuilder has increased sales prices by around 30% over the last 12 months, has a full order book and has reported significant revenue growth after terminating its loss-making investment in French catamaran manufacturer Privilège Marine, in October 2022.
In the last financial year, turnover increased by 23% to 132.4 million euros.
A total of 568 boats were produced and 561 invoiced - compared to 446 and 463 in the previous year.
Group-wide there were orders of around 210.6 million euros, compared to the previous year’s figure of 234.8 million euros.
High absences due to
Covid and the Russian Ukraine war, increased material, personnel and other operating expenses led to a deterioration in earnings before interest, taxes, depreciation and amortisation (EBITDA) to minus 6.2 million euros.
Adjusted for the discontinued Privilège
Marine business unit and its losses of 7.8 million euros, which will no longer affect the consolidated result in the next financial year, the consolidated net loss for the year amounted to 12.9 million euros.
For the 2022/23 financial year, orders are expected to be between 130 million
euros and 170 million euros with EBITDA expected to be in the low positive singledigit million range.
Financing is secured until the end of 2025 and beyond, with a capital increase of around 7.7 million euros.

Hundreds of thousands of pounds of debts are likely to remain unpaid after the administration of a Plymouth based boat refit company.
Yacht Solutions Worldwide Ltd, which was founded in April 2018 by two former Princess Yachts workers, has been in the hands of administrator, Steve Henson of Castle Hill Insolvency, since April 2021 after it faced financial difficulties during the Covid pandemic.
Claims totalling more than £184,000 have been received from six creditors. Claims from a further 23 creditors amounting to almost £70,000 have yet to be received by the administrator.
Other debts include t hree more than £97,000 in PAYE and almost £252,000 in VAT.
In his latest report, the administrator states it is unlikely there will be enough cash to pay unsecured creditors.
DEBTS SET TO REMAIN UNPAID
Shortly after the administrator’s appointment, the business assets were sold to a new company, Yacht Solutions Europe Ltd, run by the same directors, in a pre-pack deal for £60,000.
Documents filed at Companies House show that the company was set up by Paul Eccles and David Watson both of whom resigned on good terms from Princess Yachts and the boatbuilder still represented the majority of the work undertaken by the company.
The company experienced financial difficulties during the Covid-19 pandemic which hindered the ability for work to be carried out
with difficulties in gaining materials, staff off sick and not working due to restrictions and also travel restrictions contributing.
A Coronavirus Business Interruption Loan of £110,000 was obtained in November 2020.
When faced with demands from HMRC, the administrator was called in.
A pre-pack sale was considered necessary as there were insufficient funds to enable trading through the administration process and a sale as a going concern represented the best return to creditors.
The pre-pack sale was for 33% higher than an alternative offer.
In April 2021, it was estimated the company had £108,300 of assets available for preferential creditors. There are more than £500,000 of claims.
Controlling European alternative investment firm, Squircle Capital, has increased its controlling stake in superyacht refit, repair and maintenance group MB92 Group. The transaction was planned as part of the initial acquisition of MB92 in October 2019 and means Squircle Capital is now a 93% shareholder in the group. The purchase of the additional shares follows MB92’s installation in La Ciotat, France, of MB92’s second shiplift, a 45,000sqm platform built around a 4,300 tonne shiplift.
Production Brunswick Corporation has broken ground on its Fort Wayne manufacturing facility extension. The new 17,000sqft freestanding building next to its existing facility, will be used for the production of fiberglass parts for its Harris and Cypress Cay pontoon brands. The multi-million-dollar investment will reduce lead times, help manage costs and create nearly 50 new jobs. The expansion is expected to be completed by May 2023.
Installation
Oyster Yachts is strengthening its partnership with Yanmar Marine International by installing its sail drive solution onboard its Oyster 495. Following installations in the 50ft bluewater cruiser, the British boatbuilder has now selected the Yanmar engine as standard fit for the Oyster 565 and 595 yachts, to further extend the companies’ collaboration.

Ranking
Azimut Benetti has come top of the ranking in the megayacht global order book for the 23rd year running. With 168 projects under construction, totalling 5,991 metres in length, Azimut Benetti Group leads the annual ranking of the largest yacht builders known as the Global Order Book by Boat International. The ranking puts the global yacht builder as the top manufacturer among 189 shipyards, both in number of projects and total length. The gap between first and second place grew sharply over the past year, as the Italian company founded by Paolo Vitelli extended its order portfolio into 2027, recording a production value of more than €1.2 billion for the current year.
A new propeller technology capable of reducing the underwater radiated noise (URN) generated by ships’ propellers has been developed.
The PressurePores system, developed by Oscar Propulsion Limited and the University of Strathclyde, works by applying a small number of strategically placed holes in the propeller blades.
It’s a technology that is suitable for all vessel types, including yachts.
“Increasing noise levels, especially in the low-frequency range, is disorientating marine fauna. We now have a costeffective, easy-to-apply solution that prevents this from happening,” said Lars Eikeland, marine director, Oscar Propulsion.
Scientifically based The technology was developed following four
PROPELLERS REDUCE UNDERWATER NOISE
years of comprehensive computational fluid dynamics (CFD), modelling and cavitation tunnel tests during the solution’s development phase at Strathclyde.
Tests demonstrated that PressurePores can reduce cavitation volume by almost 14% and URN by up to 10dB.
Results were further
verified in tests on the sub-cavitating propellers on Princess Royal, a 19m research catamaran operated by Newcastle University. Last year, CFD Finite Element (FE) propeller stress tests were successfully completed in accordance with classification society DNV rules.
“We have found the optimum number of holes required to reduce the noise. So long as the right number of holes are placed in the most effective positions, a cavitation sweet spot can be achieved,” said Mr Eikeland.
But he also warned that it’s not a case of simply drilling holes into the blades, as this will affect the propeller’s thrust capability.
”We know exactly where to place the holes for maximum efficiency and for optimum noise reduction,” he said.
BENETEAU PLACES SUSTAINABILITY FIRST
Groupe Beneteau has raised its 2025 ambition with a stronger focus on sustainability going forward. The group is rolling out its B-Sustainable program which is centred around three pillars - ethical growth, engaged care of employees and preserving the ocean.
Gianguido Girotti, Boat Division CEO of Groupe Beneteau, said: “On the product development side, we are currently focused on reducing the environmental impact in two key areas: composite materials and propulsion systems.”
Eco-partnerships
To this end, Beneteau is working towards creating more ”eco-partnerships” in order to take a more ecoresponsible approach.
The development partnerships in place with Torqeedo, Vision Marine and Volvo Penta will enable the group to offer ecoresponsible alternative propulsion solutions adapted
for all of its models by 2030.
Beneteau’s two new electric sailing yachts the Oceanis 30.1 and the First 44, powered by Torqeedo, are the continued realisation of the group’s sustainability strategy.
The First 44 racer/cruiser is equipped with a Torqeedo emission-free cruise pod drive system and was built with recyclable resin.
Beneteau’s partnership with Torqeedo is already a success for two other Groupe Beneteau brands:
Excess and Delphia, with the delivery of a hybridelectric test platform for the Excess 15, powered by Torqeedo’s Deep Blue saildrive and two 100% electric models from the Delphia brand - The Delphia 10 and the Delphia 11.
Beneteau’s Delphia 11, its first boat sold with a 100% electric version, will become the group’s first fully electric brand.
Another partnership with Multiplast will see the group build around 100
8 The Oceanis 30.1 is one of two new electric sailing yachts from Beneateau
Jeanneau Sunfast 30-One Design units, continuing to move forward with the development and industrialisation of fully recyclable sailing yachts.
These initiatives will make it possible to take action across the entire lifecycle of Beneteau boats, from upstream and production through to decommissioning.

Lying on a CV can have some serious consequences for both employees and employers. It may be that a CV includes inaccurate details around a person’s job history or qualifications. It may be that gaps between jobs are disguised, writes Mark Stevens.
Regardless, making dishonest claims on a CV can amount to fraud by false representation. The Fraud Act 2006 states that a person is guilty of fraud if they dishonestly make a false representation, and intend, by making the representation, to make a gain for themself or another, or to cause loss to another. If there is fraudulent information on the job applicant’s CV, then not only could this lead to a claim for damages from an employer, but the job applicant could also be guilty of a criminal offence.
Options for employers
If a prospective employer has discovered that a job applicant has lied on their CV before the individual’s employment has actually started, consideration should be given to revoking the employment offer.
Where possible, job offers should be made conditional and subject to satisfactory references or evidence of qualifications.
Serious inaccuracies and lies on a CV and / or during an interview may result in a breach of the duty of trust and confidence that is implied in every employment contract. Lying on a CV could amount to gross misconduct entitling the employer to summarily bring the employment relationship to an end.
Lying on a CV can therefore allow an employer the right to summarily dismiss the employee without notice or compensation. Care
BUSINESSMATTERS
MARK STEVENS: Senior Associate at VWV LLP
LYING ON A CV - THE CONSEQUENCES FOR ALL
in a CV is misleading or inaccurate. Employers should make it clear to the job applicant what specific information is being relied upon when discussing and offering contracts of employment to those employees. Employers may wish to go a step further and ask job applicants to sign a written declaration to confirm that their application, and information provided during the course of the recruitment process, is true and accurate.
should be taken, however, to ensure that the breach is sufficiently serious to justify summary dismissal - a genuine mistake or minor inaccuracy on a CV or during an interview may not be sufficient to irretrievably damage the trust and confidence between employee and employee entitling summary dismissal.
An employer could also pursue a misrepresentation claim to seek compensation for the loss suffered as a result of the inaccurate information. An employer could argue that they were induced to enter into a contract of employment by an inaccurate statement by the employee. If it can be established that the misrepresentation was a material factor in inducing the offer of employment, then the employer may be entitled to compensation.
Potentially this could include the cost of replacing the employee and any recruitment agency fees and training fees incurred.
The consequences
As stated above, fraud is a crime and therefore a person lying on their CV could be committing a
criminal offence.
Lying about skills or qualifications may also mean that an employee will not be able to perform their duties to the required standard. If this happens, the employee may be unable to complete their probation period or find that they are subject to a performance management process. This could lead to formal warnings, capability meetings and ultimately dismissal.
Lying on a CV could impact the content of an employment reference. There is no legal obligation on an employer to provide a reference in respect to a formal employee but if they do so the reference must be true and accurate. This could mean that reference to the inaccuracies could be recorded on an employment reference. This will cause further problems in the future for that employee when trying to secure alternative employment.
R v Andrewes
In the recent case of R v Andrewes (2022), a court found that Mr Andrewes had falsely claimed to have relevant qualifications and experience which
were essential to the CEO position he applied for. Mr Andrewes was appointed to the role in 2004, however his employment terminated in 2015 when the truth about his qualifications and experience came to light. In 2017 Mr Andrewes was convicted of obtaining a pecuniary advantage by deception and of two counts of fraud. He was sentenced to two years’ imprisonment and the Crown sought a confiscation order against him. The Supreme Court ordered that nearly £100,000 of his earnings should be confiscated.
Although this case is a rarity, it does show that CV fraud can lead to serious consequences for an individual.
Steps for employers
Firstly, the employer should make it clear to job applicants that they will be attaching significant importance to the accuracy of the information provided in the job applicant’s CV. The employer can also highlight that it reserves its right to summarily dismiss and or seek compensation if any information provided
Employers should seek proof of the job applicant’s qualifications and ask to see evidence relating to them. Employers should consider the risk posed by a prospective employee providing inaccurate information and investigate accordingly.
It would be prudent to make offers of employment conditional on the employer receiving satisfactory references. Further questions may need to be asked of a recruitment agency where necessary - it should not be assumed that background checks have been carried out thoroughly.
Employers should also review the way in which they run a recruitment process, for example, putting an assessment in place for job applicants.
Consider data protection
Lastly, an employer should think carefully about the information and data that they will be collecting in relation to candidates an employees. The employer should also have good reasons for doing so and provide candidates and employees with the appropriate privacy notices. Information must be stored securely in line with data protection laws.

BIO-TECHNOLOGY INSPIRED OUTBOARD
FinX has closed a 6 million Euro fundraising round and taken delivery of its first engines which will be shown at boot Düsseldorf 2023.
The French company says it aims to revolutionise nautical propulsion with
its technology that is inspired by fish swimming, eliminating the need for a propeller on a boat.
Undulating membrane technology is the result of ten years of R&D, initially for industrial fluid transfer pumps.
The membrane
thrusters - that propel a craft using vibration - not only help protect the environment but also avoid entanglement with seaweed or fishing lines.
Maintenance is also simplified compared to a conventional outboard with fewer components.
8 The Fin5 uses undulating membrane technology
15 patents
“By suppressing the rotational movement of the propeller, FinX eliminates the risk of injury and causes less disturbance to shallow environments such as coral reefs, mangroves etc,” said the company. “The fluid, propelled in a straight line, produces less turbulence, avoids lifting particles to the bottom of the water and damaging marine animals and fragile aquatic ecosystems.”
The company has filed more than 15 patents and has an exclusive licence for the boating industry.
The first product is the Fin5 electric outboard connected to an external 48V battery which produces 2kW and is suitable for boats up to 3 tonnes.
The engine is controlled via a tiller and there is a manual and automatic lift if the engine hits the bottom.
It has an integrated onboard computer with GPS calculation of the remaining distance and voice assistance when required.
A larger engine – the Fin150 - is currently under development with a planned launch date of summer 2024.

Here’s what’s in store for 2023 from a social media perspective.
1. Short-form video to dominate. This trend isn’t going anywhere! With up to 82% of global consumer internet traffic driven by videos, it’s no surprise shortlength videos will continue to dominate in to 2023. Easy to create and inexpensive, they can result in effective user-generated content.
2. Social commerce. Social media is booming as a virtual shopping space. Buyers are more informed than ever and are comfortable completing purchases within social media apps. In 2023, social media will become further entwined with ecommerce so brands need to ensure these areas are aligned to attract customers and encourage sales.
3. Social media for customer service. Social media continues to evolve as a customer service platform. It enables customers to reach companies quickly and get instant responses. Brands need to ensure fast response times on their social channels to meet customer expectations and gain trust.
4. Authenticity is key. Another trend that continues to grow – customers are more likely to buy from brands they have an emotional connection with, so companies need to focus on creating authentic content that establishes brand values.
5. The growth of usergenerated content (UGC) Consumers are more likely to trust a brand with usergenerated content than any other marketing content. While organic UGC has been around for years, there is a definite rise in paid UGC Creators.

New approach from Henri-Lloyd
In 2023 Henri-Lloyd will introduce a range of new fabrics across its outershell, mid and base layers in the form of Dri-Pro, Dri-Shell and Dri Fast as well as a newly developed range of products featuring Smart-Therm.
This is a new approach from Henri-Lloyd to midlayer and multipurpose products.
The technology has been developed to map a body’s need for heat regulation and moisture management.
The designs also incorporate a targeted ‘Y-stretch’ panel detail that will allows the products to move with the wearer’s body when used as a midlayer or as a stand-alone piece of kit.
Henri-Lloyd was founded 60 years’ ago by Henri Strzelecki who wanted to revolutionise waterproof clothing.
The business was initially supported by financier Angus Lloyd – hence the Henri-Lloyd brand was born.
Henri and his team developed Bri-nylon to create a lightweight and flexible foul weather clothing.
To seal the holes where the fabric was stitched and make the seams waterproof, Henri glued a durable tape over the seam with pressure applied by hand.
Further developments followed and Henri-Lloyd is believed to be the first to use velcro on clothing.
Working with Swiss Riri, a non-corrosive zip was invented, integrated harnesses and buoyancy within jackets.
Henri-Lloyd clothing has been worn by Sir Francis Chichester, Sir Alec Rose, Sir Robin Knox-Johnston, Sir Chay Blyth and Tracey Edwards MBE.
SUSTAINABLE MARINE CLOTHING
OCEANR has collaborated with BCOME’s smart methodologies to carry out a life-cycle eco-impact analysis to offer customers traceable, sustainable clothing.
“I think it is quite impressive that 50% of fabrics comes from the ocean waste and another 30- 40% comes from recycled polyethylene,” said Tom Cotter, founder, OCEANR.
“Traceability is just one way of staying accountable to our customer base and to the planet.”
BCOME provides global sustainability management, and has more than 1 million traced, measured and evaluated products on the market.
A QR code will be applied to OCEANR products so consumers can see where the plastic comes from, how far the product has travelled, and the people involved in producing it.
OCEANR’s recycled polyester fabrics
New season launches from Zhik include new sailing gloves, shore jackets, deck pants and an insulated vest.

LESLEY ROBINSON British Marine CEO
With all the recent political and financial upheaval, combined with challenging short term financial constraints, pending cost of living crisis, skills shortage and supply issues affecting the sector, many organisations may find themselves tightening their belts, thinking more carefully about events they attend, the functions they run or what the ‘must do’ activities are for the coming year.
Point in case is the British Marine National Conference. After the hugely successful inaugural event in February 2022, plans were underway to deliver the 2023 conference in February. However, after much deliberation it has been decided by the British Marine Board to defer the planned British Marine National Conference for a year.
This decision has not been taken lightly, but the 12-month deferment will ensure the delivery of an uncompromised event, with strategic long-term planning and in a hopefully more optimistic financial climate. There is obvious disappointment, but we would rather make this decision now rather than hosting a watered-down event which would not be as successful and highly regarded as the 2022 conference.
We must stress that the Conference has not been cancelled, as there is still strong appetite from all to see this event succeed moving forward and we will return in 27-28 February 2024 at the ICC in Wales.
NEW WINDLASS KIT

NEW COMPACT 220V WATERMAKER
HP Watermakers KILO watermaker is aimed at boats from 35ft to 50ft and can produce 120 litres of water an hour using 1kWh.
“HP KILO was born from the demand that came mainly from the French market,” says HP Watermakers co-founder Gianni Zucco.
“However, having plenty of fresh water on board is a need that is very much felt by all yacht owners, on both motor and sailing yachts, from 35ft to 50ft.
“Until now, if limited amounts of electricity were available, the solution used has consisted of a 12VDC or 24VDC watermaker which, when operating continuously for long periods, have unfortunately clearly proven to not be fully reliable.
“HP Watermakers has therefore chosen to solve the problem with an
innovative solution that promises to shake the market: a 220V watermaker that uses only 1 kWh to continuously produce 120 l/h of fresh water.”
The watermaker uses alternating current to extend the life of the electric motors and their efficiency. In addition, electricity absorption is more fluid and

“I am thoroughly looking forward to supporting the growth of the company within the design team and getting involved with some of the new and innovative projects over the coming months,” said Oscar.
Dan Bloice-Smith, Development Director at Williams Jet Tenders, added: “We are lucky to have a forward-thinking and passionate design team at Williams and are looking forward to working with Oscar and seeing him thrive in his new role.”

Mike Smith MBE Noss on Dart Marina
Premier Marinas has appointed Mike Smith MBE to the post of Marina Manager at Noss on Dart.
Mike, who is a Certified Marina Manager, joins Premier from a background in marine, events and hospitality including more than 21 years with MDL – most recently as Regional Operations Manager.
Mike brings with him a wealth of knowledge and experience which he will be able to draw upon as the redevelopment at Noss on Dart enters its next phase.
His priority will be delivering exceptional customer service, aiming to make Noss one of the best marinas in the country.
In 1994, Mike received the MBE for services to the community having raised significant funds for the RNLI, including five D-class inshore lifeboats.
Mike rallied a team through numerous physical challenges across the South West and beyond – cycling, swimming and running – a dream he devised whilst on tour in the Gulf.
Helena Lennerstedt has been appointed CEO of Humphree.
Mike Jeffrey
“We’re really excited to welcome Mike to Aston Lark,” said Steve Hook, head of marine for Aston Lark. “As an experienced marine trades underwriter, he will continue to look after his clients as he has done for many years and help us widen the range of insurance products and solutions for businesses that service the marine industry.”
Commenting on his appointment, Mike Jeffrey added: “I am thrilled to be joining my new colleagues at Aston Lark. By adding marine trade insurance to complement their brilliant Haven Knox-Johnston offering, I am really looking forward to helping add to their fantastic reputation as the UK’s leading marine insurance specialist.”
The International Maritime Rescue Federation (IMRF) has appointed Caroline Jupe as its new CEO effective from 1 February 2023.
She will replace Theresa Crossley who is retiring following a five-year tenure.
Caroline joined the IMRF in March 2016 as Fundraising Manager before becoming the organisation’s Head of Fundraising & Projects. She has played a key role in the development of IMRF initiatives designed to improve the capabilities and best practices of search-and-rescue organisations around the world.
“Maritime search and rescue is constantly evolving in response to new challenges, but we are stronger when we face those challenges - and work out solutionstogether,” said Caroline.
Helena has held leading positions in several different companies in the Swedish industry; for the last seven years she has been Vice President Purchasing at Volvo Penta. She has a Master’s in engineering from Linköping University and has studied International Business.
“I’m proud that we have been able to attract Helena Lennerstedt as the new CEO for Humphree,” said said Johan Inden, Chairman of the Humphree Board of Directors.
“Helena’s team-focused leadership style combined with her experience in building deep relations with customers as well as suppliers, and from scaling industrial supply chains will be a great addition to the organisation.”
Helena will continue developing Humphree’s offering together with the current management and employees to increase the experience of boating.
She succeeds Hannes Norrgren who has taken up the role of Senior Vice President for Business Unit Industrial at Volvo Penta.
Technical Marine Supplies has appointed Steve Mobbs as business development manager for the South West and Wales territories.
Steve brings many B2B skills to TMS alongside a strong history of global sales experience focused on high-production OEM markets and custom projects for a more discerning client.”
An experienced and passionate sailor, Steve is well suited to this role, and we are confident he will be a valuable asset to the team,” said TMS.

Andy Scott is a rarity when it comes to those working in the marine industry.
He doesn’t own a boat, and he freely admits that boating is not one of his hobbies.
However, he does have one factor in common with his industry colleagues – he loves being in the marine business, both in the leisure and commercial sectors, he enjoys being with the people in it and he’s passionate about supporting everyone with the best products and service that he can.
Andy started his working life as a mechanical engineering apprentice.
Following this he worked in a variety of roles first as a quality control inspector then as a service engineer for anaesthetic equipment, and then cold calling selling some ‘pretty wacky’ German promotional gifts, all of which have given him the experience he now draws on.
“One of my customers was a gentleman by the name of Eric Cave, who at the time was the marketing manager for Sowester, who eventually persuaded me to work for him as a sales rep, then shortly afterwards as sales manager, looking after Mercruiser engines, Bennett Trim Tabs, Morse Controls and later Lombardini engines.”
Andy went on to work for several other companies selling equipment, “from jet boats that looked like a Porsche Boxter (including lights and foot throttle), to lifejackets and liferafts for some of the largest global manufacturers.”
He’s now come full circle and is selling Bennett Trim Tabs, among other products, for Marine Components International which was founded in 1990 by Eric, together with Blake Bennett, the American owner of Bennett Marine.
PROFILE
Andy
Scott Marine Components International MD
The business was founded primarily as a European warehouse for Bennett Trim tabs, supplying all Bennett dealers across Europe.
Since then, it has expanded to distribute other products, primarily premium products that have a technical element to them.
Mentors
And Andy says over the years he has learnt a number of lessons over the years, and had many friends and associates who he would consider mentors, including Eric.
Also, Geoff Billington at RFD and later ISP along with John Rogers.
“I guess my key focus has always been, not only to be successful at selling products, but also making sure that I understood the needs and interest of the client and potential clients, which helps to not waste anyone’s time in trying to sell something that isn’t really what they need or want.”
But he says his main influencer and mentor has been his wife and partner, Janet, who has always supported him.
And Andy says the most
rewarding aspect to his career so far has been the many customers and suppliers over the years who have become great friends across the world, and the appreciation of great customer service being delivered.
However, it hasn’t all been plain sailing with many challenges along the way – and lessons learnt as a result.
And as for low points –
Andy says he tries not to let anything get him down for too long – apart from when he’s playing golf badly…
But there are also many high points including securing what at the time was the largest ever order for inflatable lifejackets for ISP to the Polish Defence Services, and the largest single order for commercial inflatable liferafts to a Greek ferry operator.
And lessons to pass onto others – as Andy says, this could take a long time…
Customers’ shoes
But he does advise that anyone involved in selling should try to put themselves in their customers’ shoes and understand what it is that would work for them.
“The other main thing I would say in general, (and I know that others may say I don’t always practice this myself), is to try and treat everyone you meet the same as you would like to be treated.”
And he says it’s important to learn as much as possible about the products and market – including any legislation – that you are working in, including competitor’s products.
“Another would be to always believe in your own ability.”
And he suggests that “if you think you would benefit from training in any particular area, find a course that would give you what you want, and if would benefit your company, ask to go on it.”
He adds: “Also never be afraid of change, as humans we seem to be programmed to not like change, but many times change can help you grow as a person.”
And he says that the industry has become more professional over the years he has been involved, from by and large a ‘cottage’ industry to become much more professional, with more acceptance of technology.
But he cautions, while there is still a need to have past knowledge passed down to the next generation, there is still a need to attract younger people into the marine sphere.
“Otherwise we will spent forever re-inventing the wheel.”
