HMRC DEBT LED TO CUSTOM MARINE LIQUIDATION
Liquidators have been appointed to Custom Marine following the failure of the business due to tax arrears of more than £1 million.
Documents seen by Boating Business state that in December 2022, the company lost its main customer, Sunseeker International, when the yacht builder confirmed it did not want to do business with the director or any connected entities of the company.
Not viable
In addition to the HMRC debt, the company also has debts outstanding to HSBC in the form of company loans and is in arrears with employee pay, including pay in lieu of notice and redundancy pay.
Some of the unsecured creditors mentioned in the company’s financial statements include C-Quip, Marineware, Osculati, Timage and Total Marine Solutions.
Custom Marine began its life as Custom Marine Coatings Ltd in March 2012, providing paint and cosmetic restoration services to the international marine industry.
In 2015, following an opportunity to provide labour to Sunseeker, the company changed its name to Custom Marine Limited. Custom Marine’s order book was approximately 99% Sunseeker dependant from 2016 onwards.
The company turned over a profit until December 2019 when there was a slowdown and reduction of payments from Sunseeker as a result of the Chinese parent company’s introduction of cost control measures due to the start of the Covid-19 pandemic in China.
On 23 March 2020, Sunseeker announced a complete halt in production until the end of April 2020, due to the UK outbreak of Covid-19.
Then on 26 March 2020, Sunseeker implemented “emergency cost control measures”, effectively freezing all payments out of the business. At that time, it owed Custom Marine £435k.
By this time, there were no reserves to continue maintaining running costs and the business was already in arrears with HMRC.
Cost-cutting steps were taken and Covid loans taken out. A payment plan for Sunseeker’s outstanding balance was agreed in July 2020 however Custom Marine’s cashflow was strained and the business struggled to keep up with HMRC payments.
Regular correspondance and communication with HMRC failed to secure a viable payment plan and the company’s director sought professional insolvency advice.
Plans revealed to create York’s second marina
Plans have been revealed for a new marina on the River Ouse in York.
The business behind the proposals, The Boatyard, said that the new 250-berth marina at Bishopthorpe would meet huge pent-up demand for berths and create 30 permanent jobs.
Peter Mandy, co-owner, The Boatyard, told The York Press that the new marina would breathe new life into the village, provide extra facilities for residents and local sports clubs and provide a boost for tourism.
“There are virtually no moorings left in York. We get so many phone calls from people asking for berths for their boats, so this will help meet that demand,” he said.
“Also, by enhancing the existing site, we hope to bring more people into the area and boost the local economy.”
The plans show that the new marina would be a similar size to the one already existing on the other side of the river downstream at Naburn.
Existing moorings on the river will be tidied up and all berths would be made river authority compliant.
Plans also include a permanent camp site created for scouts and guides and a designated field for dog walkers. Land would also be given over to local sports clubs.

OBITUARY: TONY WYER, SBS TRAILERS
Anthony ‘Tony’ Wyer chairman and founder of SBS Trailers, has died.
Tony founded SBS –initially called Small Boat Supplies – after becoming known for his boat fittings.
“He was a keen dinghy sailor from a young age and started making his own boat fittings including shackles, cleats and fairleads for dinghies,” explained his son, Andy.
“He was increasingly asked to make these for other people and so decided to set up Small Boat Supplies.
“The success of this soon led him to incorporate the company in the late 50s and he began making dinghy trailers progressing to supply the burgeoning trailer sailor market of the day and ultimately establishing SBS as the ‘go to’ company for all things trailer.”
Tony’s passion for boats and boating led him to be the original importer of Hallberg Rassy and later Najad Yachts into the UK selling more than 100 boats, and to subsequently buy Fletcher Boats.
Fletcher also came with the contract to mould the Searider hulls for Avon with Tony presiding over some formidable years with upwards of 400 hulls a year produced between the brands.
In 2015, the opportunity to sell Fletcher arose, leaving SBS to concentrate on manufacturing and improving its trailers.
“Whilst he was a traditionalist at heart he was forever innovating and coming up with new solutions to ever improve
his trailers, always ensuring quality was at the heart of everything he did,” explained Andy, who has been running SBS for several years.
“He sadly passed away just before the SBS Boatlife Boat Show at the NEC which he was very proud to have sponsored, having founded and operated the company in the Midlands since its inception in the late 50’s.
“Tony’s DNA runs deep, and we continue his focus on quality and innovation and look to build on his legacy.”
Speedboat skipper cleared of manslaughter
A speedboat skipper has been acquitted of manslaughter after a collision with a buoy on Southampton Water which killed a teenage girl.
Emily Lewis, 15, was fatally injured when the RIB in which she was a passenger hit the navigation buoy when travelling at more than 36 knots in August 2020. Several other passengers were seriously injured.
Skipper Michael Lawrence, 55, was found not guilty of manslaughter by gross negligence but guilty of failing to maintain a proper lookout and failing to proceed at a safe speed.
Michael Howley, owner of Seadogz, operator of the thrill ride, was convicted of not operating the boat safely.
The jury at Winchester Crown Court heard how the Stormforce 950 RIB had crossed the wake of a ferry five times before heading straight for the 15ft high buoy for 14 seconds. Emily suffered severe internal injuries after being crushed against the metal handle in front of her.
In a statement read to the jury, Emily’s mother described the safety briefing given by Lawrence as ‘wishy-washy’ and that she was scared because she felt he was
driving the RIB too fast. Christine Agnew KC for the prosecution said that Lawrence initially blamed a face mask for blocking his vision but later changed his account. The court also heard that a medical cause such as a blood clot in his eye was unlikely to have caused vision loss as it was unlikely to have affected both eyes at once.
After the verdicts, the court heard that Seadogz had received three complaints from injured passengers in the past ten years. None resulted in criminal charges and Seadogz is no longer operating.

Progress needs to speed up
According to reports, the global boating boom is coming to an end with sales returning to normal, pre-pandemic levels.
Many countries have seen rising inflation and increased energy costs which are affecting the yacht market and it’s a widely held belief that consumers have slowed the pace when it comes to making decisions due to the uncertain market we’re all facing.
The trend is affecting designers, naval architects, boatbuilders, suppliers and retailers who have all seen a fall in activity compared to last year.
At the larger, luxury end of the market, a drop in enthusiasm for superyachts is predicted by some to last for several months if not years.
Some experts and observers have gone as far as to say the superyacht industry faces an existential crisis, unless it shapes up and future proofs its vessels, from construction of the vessel to technologies on board and the cleaning and detailing products used to keep the vessel looking good.
During the pandemic, the industry was focused on building and selling boats, however with a slowdown, now could be seen as the right time to make further strides when it comes to making boating more sustainable.
Boatbuilders are increasingly reporting that their customers are talking about sustainability and want to be able to make the right choice when it comes to the environment however it’s hard to argue that the resources used to build a yacht for a few weeks’ use a year can ever be considered sustainable. Boats are still seen as rich people’s toys.
Solutions need to be found and the transition to low or zero emission vessels needs to accelerate.
Protests such as that by Extinction Rebellion at the Superyacht Forum will become more frequent and significant.
That’s not to say there hasn’t been progress.
For the last few years there has been a trend away from vessels relying on fossil fuels towards cleaner fuel sources, but boats need to be future proofed.
It’s still possible to travel around the world relying on diesel but in a few years’ time this will change and newbuild yachts need to be built with this in mind.
And what about existing yachts? The lifespan of a superyacht can be several decades and the cost of converting them to another form of propulsion must be considered so the question is what to do with them.
Regulations will no doubt creep in – CO2 targets and increased social pressure, and the industry will need to stay ahead of these to have an advantage.
Investment decisions will need to be made with sustainability in mind.
Progress is being made but there are calls for the industry to be far more proactive, confront and acknowledge the challenges and collaboratively work together on sustainable solutions.

HOW YACHTING’S IMAGE NEEDS TO CHANGE INTO THE FUTURE
The number of superyachts yachts under construction grew by 7% in 2023 with 648 yachts over 30m currently under construction. The shipyards have full order books and some shipyards have already sold yachts for delivery in 2028.
But the sector shouldn’t be complacent, with new yacht sales dropping 29% in 2022 compared to 2021. Despite the drop, 2022 was still the second-best year (after 2021) of the last decade with 221 new yacht sales.
Those are the findings of the annual gathering for the yachting industry, the La Belle Classe Superyachts Business Symposium, organised by Yacht Club de Monaco, where the audience
were told that the sector must act now and change its behaviour in the wake of tighter environmental regulations and growing sustainability awareness.
“When we talk about the reputation of superyachts today, we are talking about a licence to operate. To maintain it we need an action plan to achieve specific

By 2030, it’s expected that there will be methanol and electricity associations, said Dr Daniel Chatterjee, director sustainability, technology management & regulatory affairs, Rolls- Royce Solutions.
He said that methanol is of particular interest for the superyacht sector due to ease of transportation and its current availability. Forecasts predict that by 2050, it will be the fuel of choice for 40% of vessels.2050, it will be the fuel of choice for 40% of vessels.

The Marine Accident Investigation Branch (MAIB) has filed its report on a fatal incident involving kayakers on the Upper Caragh River in Ireland in 2019.
The incident happened on 2 November 2019 when a group of 27 kayakers from the University of Limerick Kayak Club, run by the university’s student union, set out on a down-river trip of the Upper Caragh River, Co. Kerry.
The kayakers consisted of experienced and beginner kayakers, some of which got into trouble during a river-run. Two kayakers needed to be resuscitated after becoming trapped under a tree branch, one of which later died in hospital.
Ill-fated decision
The MAIB found in summary that the prevailing conditions including the

BOAT BLAZE AND DEATH INVESTIGATION
River Canal Rescue was called out on Friday 24 February to recover a burnt-out boat and male body found on the Shropshire Union Canal. Fire and ambulance crews and Staffordshire Police were first on the scene at 2.43am to the boat at Pendeford Lock, Bilbrook, where a male body was discovered along with a dead dog on the towpath.
“This is a very delicate job and we’re working to preserve as much of the boat and its contents as possible so the police and fire brigade can try and piece together what happened,” said Stephanie Horton, RCR MD.
”Our thoughts at this time are with the relatives of the deceased and anyone associated with the dog.”
Wreckage recovery
Following the incident, RCR was asked to put together an emergency team to recover the wreckage at the crime scene with the
need to preserve evidence.
The ongoing investigation means that each item had to be removed and stored for forensic investigation. The team assessed the location and situation, but concluded that due to the severity of the blaze, pumping out the vessel was not an option.
RCR chief executive officer
Trevor Forman, chief rescue co-ordinator, Pete Barnett, response team Kerry Horton and Andy Spencer and engineer Rob Turner, instead opted to attempt to use air bags, compressors and lines to try and right the vessel before trying to raise it.
Anti-pollution boons were positioned nearby to contain any spills.
Fambridge Yacht Haven has installed two state-of-the-art interceptor tanks, designed to ensure oils, paint fragments and other materials are prevented from re-entering the river when boats are lifted ashore. The new system - the ‘Morclean Reclaim System’ - is housed in an ‘Environmental Wash Centre’ alongside the slipway and collects and cleans the water used when washing boats, making it available for further use, thus reducing water wastage. In addition, following a partnership with a new waste provider, the marina now also boasts that zero site waste ends up in landfill.
Appointment
UK based Ocean Marine Systems (OMS) has appointed Superyacht Hydraulics (SYH) as its official service agent in Palma. OMS design and manufacture hydraulic cylinders and thrusters for marine applications. They also design and manufacture custom sail drive legs seen on many large highperformance yachts.
Automated
Once the search and aerial survey was completed, RCR continued the recovery late into Friday afternoon.
The excess weight was then removed before the vessel was lifted out and transported away for further investigation on Saturday.
An automated, carbon fibre composite wing sail for yachts has been selected as a finalist for the 2023 JEC Innovation Awards. Developed by superyacht spars and sailing systems company Rondal with project partners Curve Works and Artemis Technologies, the new wing sail concept aims to increase the market share of windpropelled yachts.

How I got into this industry...
I sailed my first dinghy race on the River Trent aged four and the love of the water never went away. I followed the conventional route into crewing charter yachts and then found myself sailing on the European Formula 40 multihull circuit for a couple of years which lead onto more big multihull sailing. Ultimately, I got bored living out of a kit bag so after a few false starts found myself working for Chay Blyth from 1990 – 2006, working with an incredible team and great mentor, Andrew Roberts, who had looked after all Chay’s yachts for years. Ocean Safety was a big supplier to The Challenge Business and so it was a great natural progression to move into the marine safety industry.
Best advice I’ve ever received...
From Chay – ‘Always make a decision and make it so that things keep moving forwards. Most of the time you will get it right but if you don’t then solve the issue but at least things haven’t stopped’. It was great advice while battling to get fleets
One thing the industry needs less of is...
People who don’t have knowledge of being at sea. Theory is great but putting theory into practice and coming up with practical solutions to product and process is vital. It is one of my key mantras at Ocean Safety – everything we design and develop has to be practical in the situation it is intended to work. For most of our products that means it has to work at the worst possible time.
Most hated buzzword or workplace expression...
‘Think Outside the Box’ and ‘Blue Sky Thinking’!! Firstly, you shouldn’t be in a box and secondly you don’t need ‘Blue Sky’ to think!!
Best place I’ve been… Wellington, New Zealand. During three of the Global Challenge events, they were great partners. The city and the people embraced what we wanted to achieve and helped us at every turn. It’s also a great fun place to be!!!

Most things Mediterranean – most of it’s supposed to be healthy as well!!
One thing I couldn’t live without...
Unfortunately for work it has to be my iPhone (sad I know) and for my personal life, my family – my wife and girls are everything to me.
How I cope with stress...
I swim in the morning five times a week, sometimes further than other days but it is something I did as a teenager and somehow water and making sure I breath seem to put things in perspective.
Something about you that people might be surprised by...
I get really really frustrated when I have to over analyse figures in business – I’m not very good at it!! I very much believe that if something feels right it will be right and hiding behind analysis means you don’t have ‘the feel’ for something.

“Decarbonising sea transport and recreational boating no longer requires a leap in imaginative engineering and science. It’s possible right now,” said Ocean Zero’s managing partner, Chris Anderson. “Boats produce more atmospheric CO2 each year than all the airlines in the world. This is a massive problem that has solutions that can be adopted immediately.
“We need innovative companies like Zen Yachts to lead us into the new world of boat electrification.”
The ZEN50 is designed from the keel up to be an exploration-oriented ocean-going solar electric yacht with unlimited range and performance due to its lightweight carbon fibre structure and a hightech computer operated Wingsail from its partner the French company AYRO.
The craft will be selfsufficient and rely only on sustainable energy sources.
It will be built using high-tech solutions including ultra-lightweight construction and interior, to the latest energy management and propulsion systems.
ZEN’s carbon hulls will be manufactured by an industrial composites partner in the South of Spain.
The outfitting and finishing of the yachts will be controlled by ZEN Staff in its assembly yards.
Ocean Zero was the lead investor in AYRO’s Series A raise last year. The first four ZEN50 production slots have been reserved.

There are signs that the global boating market is returning to normal after sales surged during the Covid-19 pandemic.
Online marketplace, Boats Group, reports that the total number of boats sold worldwide decreased last year for the first time since before the pandemic.
The change towards more typical market conditions emerged in 2022 as the total number of boats sold dipped by just 4.3% compared to the same period pre-pandemic in 2019. By comparison, boats sold in 2020 and 2021 were down 15.9% and 11.8% respectively, compared to 2019.
“For the first time in three years, we’re seeing consumer demand soften,” said Courtney Chalmers, vice president of marketing at Boats Group.
“However, the effects of the demand and supply chain disruption during the pandemic are still very apparent. Boats continue to

In my many years in this amazing marine industry, one thing always pops up as an issue time after time lack of employee interest.
All too often employees think it’s just a job. Well maybe create actual engagement with what we are about - on water enjoyment. That’s were we differ from so many other employment options.
I am not talking here about engaging the wider masses in getting out on the water, enough organisations run programmes to encourage this, maybe if that work was linked to a popular TV programme that glamorised boating (not Jaws) this would really give a kick to those efforts. Oh, how I miss Howards Way…
What I mention is the engagement of those working in the industry to experience the delights of getting out on the water. Learning, experiencing, understanding the world we all work in. It’s easier for us the further you’re up the tree of life you are, but how many of us think about those below and how we can develop a passion for what we do, making coming to work more than just a job.
I do wonder how you can apricate what your involved in, how something works, why it is done in certain way, until you have seen the fruits of your labour in action. Also, how can you understand what you’re doing or asking of others if you don’t understand the basics of being on the water.
So, this Springtime maybe think about engaging with others in the industry and creating a mechanism of employee engagement, on the water. Just think how your team might flourish if they actually develop enthusiasm through engagement.
Let’s face it we work in the toy industry after all, it’s to be enjoyed, not just at the top of the tree…

MAHLE Powertrain is leading a project to develop sustainable propulsion solutions for retrofit to high-performance marine vessels.
The company, which says its jet ignition technology optimised for hydrogen combustionHyJet, is suitable for uses where battery and other electrified technologies may not be practical, and is collaborating with the RNLI, the University of Nottingham’s Powertrain Research Centre and Clean Air Power.
Hybrid Marine Power will act as a consultant.
The consortium says the low energy density and high weight of current battery technologies, coupled with the need to quickly replenish for the next mission, means that alternative green propulsion solutions are required.
“The current and predicted future state of battery technology alone can’t offer the range and performance required by the RNLI at an acceptable weight for retrofit to its lifeboats,” explained Martin Berger, vice president Corporate Research and Advanced Engineering at MAHLE.
Advance tickets are on sale for the 2023 Crick Boat Show.
The event, which takes place at Crick Marina, near Daventry in Northamptonshire, will be held across the late May Bank Holiday Weekend 2729 May 2023, with a Trade & Preview Day on Friday 26 May.
The event is Britain’s biggest inland waterways event and is organised by Waterways World in association with the Canal & River Trust and Crick Waterside and Marina and is expected to attract more than 26,000 visitors.
The show is expected to see more than 200 exhibitors, with more than 30 new boats to view, plus

“The HyJet project offers an exciting opportunity to investigate and learn about potential solutions that could help meet our challenging sustainability targets and to fulfil our ambition to move away from fossil fuels.”
The HyJet technology
consists of a small prechamber which can be fitted into a cylinder head. Combustion is initiated in this pre-chamber, with the resulting hot combustion gas forced through small orifices into the main combustion chamber as a series of jets which then ignite the remaining mixture.
This ensures clean, efficient combustion throughout the main chamber with little or no pollutants such as nitrogen oxides.
The HyJet project will analyse usage data collected from the RNLI’s vessels to help identify the optimum approach for clean operation, considering the issue of on-board fuel storage and refuelling.
The project is funded by the Department for Transport as part of its Clean Maritime Demonstration Competition.

Electronics manufacturer Raymarine and autonomous boat navigation provider Avikus, are to exclusively cooperate on the development and launch of what is believed to be the world’s first autonomous leisure boat solution, the Raymarine x Avikus NeuBoat.
In addition, they will develop and launch a range of autonomous leisure boat systems designed for different boat sizes, types and uses.
The agreement is aimed at enhancing the boating experience, from autodocking to ensuring a bigger catch or finding the perfect sunset spot.
The two companies envision that autonomous boating will lower the barriers for new boaters to buy a boat, helping grow and diversify the market.
“Raymarine is the perfect partner for Avikus,” said Dohyeong Lim, Avikus CEO. “Their technology and experience bring us the best opportunity to reach out to customers.”
He added: “We are incredibly excited to shape the future of boating with Raymarine, a future where
The condition of Britain’s waterways continues to deteriorate, with government funding decreasing.
That’s the concern of the IWA which says the Canal & River Trust and Scottish Canals financial situations are critical.
The organisation is calling on national and local government to fund all waterways at a level that keeps them as major assets that can continue to contribute to the economy, peoples’ health and wellbeing, and coping with the climate crisis.
“Our waterways benefit millions of people in the country, and it is essential that government continues to invest in them to ensure that these benefits can be maintained and increased,”

RAND unveils future of boating vision
Electric boating company, RAND Boats, has unveiled its vision for the future of boating.
The RAND Masterplan 2030 encompasses five strategic goals all aimed at ‘creating harmony between the oceans and mankind’. Deliver a product for all leisure boating activities – between now and 2030
RAND aims to launch two or three new, net-zero products per year, building to a total fleet of 26 boats which will cater for 90% of all leisure boating needs.
Develop intelligent volume production – as part of RAND’s partnership with the Danish Green Fund, the company is committed to developing sustainable production methods and materials and is improving its facility in Split, Croatia to help achieve this.
Solve net-zero boating –RAND has a bold ambition to move all its boats to electric propulsion by 2030. Last year 55% were electric and the company is closing the gap with a proprietary high-speed sterndrive system and intelligent interface.
Make boat ownership easy – as part of a push to make boating accessible to all, RAND has introduced a new owner app which makes sharing boats straightforward and transparent.
Make boating available to the masses – RAND has launched ‘GoBoat Connect’, a fully electric boat club concept giving members access to a large fleet of RAND boats, eliminating the need for the administrative or practical commitments of boat ownership.
ELECTRIC POWERED STEEL TRAWLER IS A WORLD FIRST
The latest Vripack designed steel trawler is thought to be a world first.
Built by Steeler, it is an electric powered craft, designed with sustainability in mind.
The Steeler 61S craft is 18.6m in length and custom built with an open plan, single level, living area, which Vripack achieved by eliminating the side decks.
“A key stipulation from the owner was to ensure the main living area fell on one level,” explained Bart Bouwhuis, co-creative director at Vripack. “He was really focused on creating an architectural style home at sea, and with 80% of the interior given over to his living space, that’s what the Steeler 61S provides.”
On the top deck, the wheelhouse has an asymmetric helm close to the starboard door allowing the owner – who self-pilots the boat – to step outside and look over the edge.
Oceanco has unveiled its new yacht design, the Aeolus, which it says is in tune with evolving perspectives on the environment and lifestyle.
One thing that sets the yacht apart is its Energy Transition Platform (ETP), an adaptable architecture to enable a future-proofed pathway to net zero.
It has been developed by Oceanco and Lateral, together with Aeolus’s technical partners ABB and MTU.
“Any yacht built today, will have to span the energy transition, a period of significant change in available fuel types and associated technologies,” said James Roy of Lateral.
”Lateral and Oceanco have developed the ETP to ensure multiple technical pathways can be pursued as technologies
The aft cockpit has a folddown transom hatch leading to the main salon. There is a heated plunge pool on the foredeck. Sustainable materials, such as steel, wood, leather and composite teak decking are used throughout and though the vessel is equipped to run a 75kW diesel generator, the 61S is also equipped with a 90kW electric propulsion motor
and can run on shore power.
“The owner was determined to have the most sustainable boat possible, and one that can adapt as battery technology develops,” says Hans Webbing, owner of Steeler Yachts. “To date, the owner regularly enjoys eight hours of continuous sailing at 5 knots on batteries alone, with normal energy consumption
onboard and without needing to engage the diesel genset.”
When cruising at 6 knots, the boat averages a 2000 nautical mile range. Solar panels and windmills mounted on the roof help to feed the 184kWh battery pack.
STYLE AND SUSTAINABILITY
mature during the energy transition timeline.”
Aeolus has been designed by Giles Taylor and is complemented by interior design from Njord by Bergman Design House.
At the heart of the vessel’s design is a reference to the J Class sailing yachts of the last
century. Its interior has a strong focus on fully sustainable and traceable materials, including the use biomaterials.
Oceanco has worked with some of the world’s most innovative artisans in biomaterials and sustainable development in the design of the yacht.
Names include Desserto, a premium vegan leather alternative that is made from climate-positive cactus plants and Oliveri Homes, which works exclusively with Global Organic Textile Standard cottons and uses non-toxic processes and dyes to create its materials.

Sinot Yacht Architecture & Design has launched its BEACH range, a line of three distinctive superyachts in 77m, 88m and 99m LOA designs.
The concept, developed to honour this year’s Dubai International Boat Show, offers future owners a variety of yacht sizes, as well as the opportunity to operate multiple yachts as a family or group of friends.
“We named our new design concept BEACH, reflecting the clear connection with outdoor living and the idea of being close to the water in perfect harmony with the aquatic environment,” said Sander Sinot, designer, Sinot Yacht Architecture & Design.
“The beach theme is the basis for the interior style, while individual customisation allows for a personal touch. Options and customisation ensure private exclusivity for each yacht.”
Comfort and flexibility
The BEACH family of superyachts is said to embody the next step in comfort and flexibility.
The new FJORD 41 XP from HanseYachts will be powered by two Mercury V12 7.6 litre outboard engines.
Designed by Patrick Benfield, the craft will be able to reach speeds of around 40 knots, with navigation equipment and intelligent steering chosen to make manoeuvring easy and intuitive.
Even at full speed, the T-top and various windscreen options will protect those on board against the elements.
“With the new FJORD 41 XP, we have consistently advanced the successful concept of the 41 XL for a powerful outboard drive,” said Andrea Zambonini, product manager at FJORD. “With the 41 XP as the first series yacht with V12 outboards, FJORD is defining a new standard.”

Second generation
The Enata Group has launched the second generation of its foiling yacht control system.
The upgraded Wingman Gen 2 control system is twice as powerful as the original and allows for smarter functionality, including the ability to monitor and control aspects of the company’s Foiler flying yacht through a mobile phone.
Designed with clear lines and sculptural hull, construction is minimal and open. Balustrades are transparent and there are floor-to-ceiling glass façades.
The exterior decks culminate in the aft deck beach, with an embedded infinity pool and steps descending to the waterline. The beam-wide swim platform offers access
to the water and acts as a mooring spot for private limo tenders and water toys. The exterior forward deck features a private seating area for sunbathing and a large jacuzzi.
The BEACH 77, 88 and 99 superyachts all have fullbeam forward owner’s state rooms, convertible cinema lounges and multiple VIP and guest cabins.
The owner’s state room
position can be changed with the position of the wheelhouse and a central core setup allowing for a free walk-around inside the glass façade. VIP and guest cabins are based on requirements and there is a choice in beauty, treatment, gym, or spa facilities.
TWIN OUTBOARDS POWER PRODUCTION BOAT
darkened with a soundproof sliding door that is recessed into the bulkhead to save space.
A galley or a second toilet are also possible.
The high-performance sandwich hull had an inner grid for stability and an automatic retractable anchor system is fully integrated into the hull.
“The Foiler represents a unique and unparalleled step toward a future of boating, and the evolution of the Wingman control system highlights the technological skill that resides with Enata,” says Alois Vieujot, Enata director. “It opens up new possibilities for new and existing owners alike and demonstrates our commitment to creating the most advanced and efficient yachting experience.”
The 9.8m carbon craft uses America’s Cup foiling technology allowing it to operate in conventional mode, or at 12 knots, it will ‘take off’ with its quad foils lifting the hull from the water.
Although the craft is advanced in its design and build, the control system means advanced piloting skills are not required.
Wingman Gen 2 monitors and analyses data from more than 250 data points on the Foiler, giving control over aspects such as fuel consumption and enabling preventative maintenance.

The cockpit is shaded by a large T-top with robust roof pillars that are integrated into the bulwarks. There is a second sun lounge on the foredeck and a bathing platform on either side of the engines.
An internet connection will unlock diagnostic data sharing with Enata HQ as well as system updates.
The system has been designed not only with newbuilds in mind but also as a retrofit option to existing boats, both foiling and nonfoiling, and is also used on Enata’s drones.

In a fast-moving world where prices are rising at a pace not seen in decades, firms are struggling to keep pace and, worryingly, stay in business,
The natural reaction to rising prices is to pass on cost directly to customers. However, that’s not always possible, especially when dealing with commercial customers.
James Crayton, partner, and head of commercial at Walker Morris, says that firms should initially assess their current commercial arrangements to get a fix on the current position. He says that “while the simplest mechanism is a fixed price, often more detailed mechanisms to determine price are included in longer term agreements and you should assess if this price is broken down into components which may be able to be changed.”
But if the contract specifies a fixed price, then he advises considering if the contract contains provisions with regard to price indexation. “With such a clause,” says Crayton, “the contract will provide for the price to increase in relation to an index, such RPI or CPI.”
And with general price reviews or adjustments, there needs to be an express clause in the agreement that provides the right to do so. Crayton adds that the contract may contain provisions for an annual price review, but “these tend to be about setting a framework for prices to be agreed, rather than a unilateral right to increase.”
Force Majeure
Next is the force majeure clause. It is not a ‘get out of jail free’ card but may, in some circumstances, suspend a party’s obligations when they are prevented from completing
DEALING WITH SPIRALLING COSTS
without the need to terminate. Customers may be willing to accept this in order to guarantee continuity of supply, or there are limited alternative suppliers.”
Where a firm is able to renegotiate, and certainly for any new agreements entered into, as Crayton emphasises, “you should ensure your contractual provisions provide adequate protection for any ongoing or new challenges faced due to cost price increases.”
He explains that his firm has assisted clients in many industries with preparing wording to include in their quotes which reserves the right to amend prices in circumstances where there are material increases in input costs, including energy, labour, and fuel.
an agreement by events outside of their control. Sometimes it includes rights to terminate.
Crayton says that these events are often listed within the clause or definition. He notes, however, that “the supplier would need to demonstrate that circumstances beyond its control prohibit it from complying. A general change in the economic climate or market conditions
affecting profitability is not likely to be considered a force majeure event.”
And where there is no force majeure clause, Crayton says that a supplier “may have to rely on the doctrine of frustration, which is notoriously limited in its application.” In essence, this can set aside a contract where an unforeseen event either renders contractual obligations impossible, or radically changes the principal purpose for entering into the contract.
More contractual terms to examine
Other elements of the contract that Crayton advises looking at are “the basis of the agreement, and whether you are bound to supply, or whether it acts as a framework under which call-off orders/purchase orders are issued and subject to your acceptance.”
Then there’s a material adverse change which Crayton defines as “an event or circumstances which have a material adverse effect on the ability of the parties to perform their obligations.”
He says that while this is not something typically seen in short-form standard terms and conditions, “it may be included in a long form agreement and may allow for termination or suspension of obligations and a renegotiation of the contract.”
The fall-back position is termination of the agreement altogether. But
care should be taken; firms may need to continue to supply up to the expiry of any notice period.
The absence of contractual provisions
So, if with careful review of the contract it’s found that there are no suitable provisions embedded in the agreements, or, worse, they offer little or insufficient protection from the various price pressures the firm is facing. Are there any other options that can be considered? There are.
Crayton says that the obvious approach is to maintain an open dialogue with customers. He says that “they are unlikely to be surprised by requests for price increases.” He continues: “Where the request is genuine, rather than exploitative, and particularly where it can be backed up by evidence, there may be an opportunity to vary your agreement
Another tack is to add wording that states that quotes only remain open for acceptance for a short time period, and future supply will be subject to updated quotes.
Looking to the future, Crayton highly recommends detailed thought about the use of various pricing mechanisms and whether it would help to link them to inflation, or at the least, have price reviews at certain points throughout the contractual period where the parties can renegotiate the price. He says of this that “we are seeing a trend towards including indexes or pre-agreed price rises linked to certain commodities and a move away from the price being fixed for the term of the agreement.”
His last suggestion is to “consider working on a purchase order basis; as seen by the cost of living crisis, the economic climate is unpredictable, and a more flexible agreement may be more beneficial, such as supplying on an ‘order-by-order’ basis may be preferable.”

Among the latest new products available from C-Quip is a Push Button Cabinet Latch.
When the button is pushed in, the product becomes flush. In addition, pushing the button in when the door is closed will lock it. Pushing the button again will unlock the door.
The latch is available in chrome or gold with a choice of a white or black body.
One of C-Quip’s most popular cabinet latches is the square cabinet latch with a stitched, real leather face that is available in black, brown or tan.
The face has a 40mm x 40mm diameter and the latch is suitable for doors from 5mm to 21mm in thickness.
“There is the meeting of form and function with the fittings used, especially around touch points,” explained C-Quip MD, Ian Cooke.
“Rarely is a hinged noticed unless it squeaks or fails, but the cabinet door handle is seen and felt every time the door is opened, so make sure it looks as good as it functions, ideally for the life of the boat.”
Made out of high-quality aluminium, the lighting fixtures in the range have been die-cast or forged and mechanically worked to ensure durability. Wi-Fi connectivity allows anglers to wirelessly stream sonar and share user data, such as waypoints and routes, between two ECHOMAP UHD2 units.
The chartplotters
incorporate refreshed hardware and design, alongside Garmin’s latest user interface and graphics. A newly redesigned quick release bracket makes it easier to remove the unit from the boat at the end of the day.
TRACKER PROVIDES TRIP AND RACE DATA
Sailmon’s MAX Mini, awarded with a DAME Award special mention at METSTRADE 2022, is now available.
The portable tracker will automatically send all performances on the water to the Sailmon App afterwards or live as the action takes place via integrated LTE-M internet connectivity.
Users can then relive and analyse their trips based on a graph/map, data and even imported videos.
Data such as course over ground, heel and pitch can be analysed with the best results ranked on leaderboards that can be categorised by data, class or period.
Additionally, the Sailmon App can provide further insights such as up-and downwind performance, general statistics and personal highlights.
“Based on our commitment and unconditional love for the sport, we at Sailmon are working 24/7 to make watersports like sailing, wingfoiling and surfing more challenging and fun for the participants, coaches and audiences,” said CEO Kim Coster. “We achieve this through innovative and affordable solutions. MAX mini fits in seamlessly with this mission.”
The tracker can also be supplied to an entire racing fleet, making sailing
events more inviting for any audience.
And Kim explained that MAX Mini is another step in Sailmon’s mission to make sailing more digital.
“We believe that capturing and sharing your performance makes you a better sailor, surfer

NEW CHARTPLOTTER IS THE FASTEST EVER
Raymarine has launched a range of new products including its new Axiom 2 Pro chartplotter.
The chartplotterRaymarine’s fastest ever – is an all-in-one display, powered by the latest LightHouse 4 operating system.
It integrates with Raymarine’s advanced navigation network that includes radar, autopilot and Lighthouse charts as well as FLIR thermal night vision technology.
An upgraded six core processor enables fast chart scrolling, instant response and the ability to run multiple apps simultaneously.
The Axiom 2 Pro is developed with Raymarine’s HydroTough coating, which repels water. There are customisable keypad
controls across all size models including a choice of autopilot control or programmable soft keys.
The Axiom 2 Pro RVM model features Raymarine’s new RealVision MAX builtin sonar. This premium sonar builds upon already impressive Raymarine technology, allowing users to
see deeper, with more clarity than previously.
Another new product from Raymarine is the RVM1600, a remotely mounted sonar solution module for Raymarine’s Axiom displays. The RVM1600 embeds
RealVision MAX CHIRP sonar technology and multichannel sonar capabilities. DownVision, SideVision, 3D, and conventional CHIRP sonar have all been upgraded with extended range and superior resolution. The CAM300 mini day/night IP camera is equipped with an HD video sensor and transforms the Axiom into an onboard video observation system.
The camera can be combined with the AR200 sensor, enabling ClearCruise Augmented Reality to overlay AIS targets, waypoints and chart objects directly on Axiom’s highdefinition video display.
In addition, there are new expanded regional LightHouse charts which are created from official hydrographic chart sources,
”Display 2 responds instantly to anything you throw at it, from zooming and panning the chart, to automatic routing and rich instrument panels,” said a company spokesman.
The Display 2 is built for the sunshine ad is equipped with a 10in Lumen HDX screen which gives 1000 nits sustained brightness with a 1200:1 contrast ratio.
This brightness, combined with Lumen HDX’s high resolution makes viewing instruments and chart details possible in direct sunlight.
Meanwhile, the etched glass surface minimises screen glare and the TrueShift optical film lets a user view the screen with polarised sunglasses at any orientation.
The device also has a thermal coupled backlight which is embedded in the Orca Display 2’s thermal backbone. The backbone dissipates heat from the ultrabright backlight and incoming sunlight, which gives the device its functionality.
Orca’s Display 2 gives up to eight hours of batterypowered navigation and the device supports 25W ultrafast wireless charging via the Orca Charging Mount. Users can also charge via QI or USB-C when at home. Orca Display 2 will be available for pre-orders in the first quarter of 2023.

Jim Boulton grew up around boats, pulling the engine starter cord on an outboard motor when he was just seven years old.
However working in the marine industry wasn’t his first choice – instead he wanted to become a fulltime radio DJ.
When this didn’t work out, like many other marine industry professionals, Jim decided to turn his passion into his career. And turning it around, he now DJs on local radio as his hobby instead.
“I studied small craft design at Southampton Institute and then got a job at Fairline.
“I was a senior buyer in purchasing for many years, working with new product design and development.”
Looking back on the ‘80s, Jim remembers it as a time where the marine market was beginning to mature with more use of technology.
“Marine electronics were coming in, taking over from analogue instruments; we worked with propeller designers taking boats from around 25 knots to more than 30.
“Fairline was sold and there was a new MD. I headed up quality and aftersales and took the business through ISO 9000. A dealer management programme was launched, and I ended up managing 35 dealers. We were building 300 boats a year.
“The Squadron 62 was launched, one of the first production 60 footers of the modern era. Both the industry and the customer base were moving up in size.”
After almost 14 years with Fairline, Jim worked with Lee Sanitation before being offered a job with the Spanish yacht broker Castlemain.
“A deal had been tied up and there were five boats
Jim Boulton Business development consultant for Amare SRL and Alrose Products
126m long Octopus yacht, at the time the largest yacht that had been built globally.
“It was quite a personal moment, I had to pinch myself.”
On the other side of the coin, one of the lowest points was during the 2008 recession when customers were having their property portfolios revalued.
“One customer had bought a boat then after his portfolio was revalued, had to cancel the sale, it was make or break for many manufacturers”
When it comes to advice for others, Jim believes it’s important to learn the basics thoroughly first and know your subject inside out.
on order, and someone was needed to manage the products. I fitted the bill.”
90% supplied
He added: “It was incredible, I was based in Spain, the boats were being built in Italy and we were delivering all over the Med.”
With the market dipping in 2002, Jim returned to the UK in early 2003 and began working as Sales / Technical Director for what is now DA Watts & Sons, heading up the teak decking sector and supplying 90% of the UK market.
“They needed someone with both a technical and commercial background and bought me back to the UK. It was a good move. It’s all well and good living abroad but I missed a lot of the UK. I do have a love of Spain, and I made a lot of interesting contacts.”
During the five years
Jim spent with Wattsons, technology introductions included digital scanning which transformed the manufacture of boat decks. Deck moulding products had an eight to ten-week lead time.
“We could model them in 3D which massively shortened the development time. We were able to work
at the plug stage.”
With a yearning to return to boat building, Jim left Wattsons and headed up Sea Ranger with Rory Shepherd, later becoming involved in the teams building Birchwood and then Pearl Yachts, looking after the Chinese manufacturing.
A stint with Trend Marine as Director of Sales and Engineering followed, with the task of building the OEM business before parent
company Taylor Made Group were purchased by Lippert.
Jim currently works as a business development consultant for Amare SRL and Alrose Products and says looking back at his career there are certainly many highlights.
Personal moment
One of which was rocking up to HDW in Kiel to scan the
“If you don’t know, go and find out, it saves so much time.
“There is a lot of knowledge and people who are happy to pass it on. It’s a two-way thing.
“Many of the young people succeeding in the industry seem very well informed.”
In addition, Jim says he was always taught by his mentor, Fairlines MD Sam Newington, to ‘get the routine things out the way first and the rest of the day will become more productive and fun’.
Jim’s last thoughts are in relation to collaborative working.
“When I was at Fairline, I remember Tom Murrant of Sealine calling to see if we had any Volvo Penta engines in stock.
“He sent the Sealine van to Fairline to pick up a pair and was told ‘pay us when you’ve finished the boat’.
“That’s how it used to be, we all needed to succeed, and we all worked together. There’s seems to be much less cooperation these days.”
He concludes: “The industry wouldn’t be what it is without the people, collectively we will succeed.”
