suit against the city and the NYPD for what they allege is brutality against their dog. When police officers entered Ronald and Giselle Estevez’s apartment during a drug raid last October, the family’s seven-pound miniature DobermanPomeranian mix, Chuwie, was backhanded by a cop, alleges the family. Chuwie didn’t try to bite the police, according to the suit, but only stood on the bed barking — until a police officer slapped him so hard he fell out a third-story window. Cuomo’s press secretary reportedly called Albany Mayor Jerry Jennings to ask the state police to enforce the park curfew, and arrest protesters if they didn’t leave. Jennings, however, refused to comply. METRO

joice: More trains are headed straight to your station. Beginning next summer, the MTA will increase subway service on the sorely-needed L line. The MTA will add 16 trains to weekday service schedules. On the weekends, 11 trains will be added to Saturday’s service and seven to Sunday’s. TRANSIT Forget the trash. Now the MTA is taking out the cans. Transit officials launched a pilot program two weeks ago to remove trash receptacles from the platforms of two subway stations. The Eighth Street N,R stop and the Main Street stop on the 7 line will be free of trash cans for the next two months. The MTA is trying the pilot to reduce the amount of litter in the subway system. The transit agency is testing the effectiveness of a “carry in, carry out” policy, similar to that of the PATH system, Tom Prendergast, the head of NYC Transit, said yesterday. But riders dismissed the MTA’s idea. “We need trash cans in stations,” said software developer Sam Napolitano, 30, who works near the Eighth Street N,R stop. “Otherwise, people will throw trash on the ground.” “If there’s trash on the ground, there will be more rats,” Nadjeda Estriplet, 23, a student at NYU said.

“What if trash gets thrown on the tracks and catches fire?” Currently, eight refuse trains traverse the tracks and pick up trash from 359 stations per evening. Less rubbish would require fewer trains, explained Gaito. But nobody is committed to the idea yet, he cautioned. “It’s just an experiment,” said Gaito. “If it’s successful, we’d look to branching it out.” Two possible solutions, he said, would be to remove trash bins entirely, or remove bins at stations with the fewest riders. Subway riders endured delays on the 4, 5 and 6 trains in both directions during yesterday’s morning rush, after an uptownbound 6 train derailed just before 4 a.m. There were no injuries reported in the derailment, which happened at the Brooklyn Bridge/City Hall station. Two cars on the train derailed and the subway was carrying 19 riders at the time. The cause of the derailment is under investigation. METRO/CB
Bus driver attacks up NEW YORK. Attacks on MTA bus drivers are up 20 percent, according to a Daily News analysis of MTA data. Attacks are on the rise compared to last year and there are seven attacks on bus drivers every month, the paper found. Yoga studios may be as ubiquitous as coffee shops in New York City, but finding a class specifically tailored to cancer patients and survivors is not so easy. The Libby Ross Breast Cancer Foundation stepped in to fill that void last month with the introduction of Pose for Pink, a series of free yoga classes for both cancer survivors and those currently battling the disease. “Studies show the use of yoga, breath work and asanas [yoga positions] help speed and aid recovery while undergoing treat-

Lifeline thrown to homeowners in over their heads U.S. homeowners who owe more than their properties are worth got new help yesterday when a U.S. regulator expanded a government program in a step that could help up to 1 million borrowers. The Federal Housing Finance Agency, which oversees mortgage finance giants Fannie Mae and Freddie Mac, eased the terms of a refinancing program that helps so-called underwater borrowers who have been on time with payments but are unable to refinance. The overhaul, which would only help a fraction of the 11 million underwater borrowers, is the latest effort to deal with a problem at the center of the

seems silly if you try and pretend. It’ll just make you look silly.” To be sure, Taylor does not look silly. And CANT’s recently released debut, “Dreams Come True,” is a force to be reckoned with, albeit a dark force. Where Grizzly Bear is harmonic and folky, CANT is elec-
tronic and moody. It’s as if one is a consequence of the other. “When I got out of touring and recording — and production work in the meantime — which was six or seven years, I realized I had sacrificed a lot of personal relationships,” he says.
It’s not as if Taylor has nothing to show for the time that he was neglecting his personal relationships. In addition to playing bass and producing Grizzly Bear albums, he has produced critically acclaimed albums by Twin Shadow and the Morning Benders, and he recently started his own label, Terrible Records. But with “Dreams Come True,” he confronts his decisions head-on. “The whole idea of the record is sort of to deal with stuff, and face fears, and not shy away from them, especially the more scary ones,” he says.

John Kelly animates love and loss in ‘Find My Way Home,’ his take on the Orpheus and Eurydice myth In 1988, as many of the best and brightest in New York’s performance community were struggling with AIDS, unclassifiable theater artist John Kelly unveiled his version of the myth of Orpheus and Eurydice. “Find My Way Home” is set in the Great Depression, with Orpheus (Kelly) as a singer invited to entertain some hard-edged plutocrats and Eurydice (Kyle de Camp) as a maid who survives her grim situation by listening to the singer’s voice emanating from the radio. She winds up, Cinderella-like, in his arms. With his ineffable skill, Kelly assembles a pastiche score ranging from Gershwin and Porter to the great operatic strains of Gluck and Verdi. Though much of the music is performed (by Kelly himself, on recordings and by a live ensemble of singers, a cellist and a pianist) in languages other than English, we somehow always know what’s going on. No sooner have the
lovers found each other than Eurydice dies in an accident; Orpheus blindly pursues her, winding up first in the purgatory of a marathon dance contest and then in the Underworld, which looks mightily like a Paris cabaret. The moment he locates her the inevitable happens: He looks her in the eye and loses her forever. Between the original production and the present revival, the stage has quadrupled in size and the theater capacity doubled. We’re no longer on top of the action — and the new distance, oddly, seems to slow it down. But Kelly’s vision still packs an emotional punch, the cast is pitchperfect and the issues explored — class distinctions, conspicuous consumption and premature death — could not be more timely.

The Giants enter the toughest part of their schedule with an advantageous record. But unlike previous campaigns, Big Blue is hoping to avoid yet another late-season flameout.
Head coach Tom Coughlin said before he sent his team off for its bye week, he reiterated the importance of understanding their situation and to not feel as if they’ve accomplished anything despite being in sole possession of first place. “They got the message,” he said. “I feel comfortable with that.” Quarterback Eli Manning got the message loud and clear and heeded Coughlin’s words. He said the bye week came at a good time,
as players should be returning healthy, and added he feels his team will be ready to tackle the tough part of their schedule. “[We’re] coming off a big win [and] it was good to get away from things,” Manning said. “But we have to make sure we come back from things refreshed, legs under us, ready to continue to work hard, have a great week of preparation and get ready for Miami.” TONY WILLIAMS sports@metro.us
The biggest thing Eli Manning needs to work on so they can avoid another lateseason collapse is his performance in clutch situations. “I think we can definitely improve on third down [and not] get into as many thirdand-long situations,” Manning said. “It’s really been the third-andseven-plus where we’re not as good as we need to be. Sometimes it’s a bad decision by me or a bad route. … We just have to make sure we’re sharp and consistent — and making sure we keep the ball in our hands.” The Giants are converting just 31 percent of their third-down opportunities. There is no question the story of the Giants season has been injuries. After fielding questions about the multitude of players returning to the practice field after the bye, head coach Tom Coughlin may finally be seeing the beginnings of a full roster. “It is something that we have been looking for,” Coughlin said. “I don’t know if uplifting would be the word. It is a good sign to have guys out there. Hopefully we will have the consistency of all these guys practicing and it will give us extra gas in our tank.” Both the offensive and defensive lines should benefit from the time off — starting with two-time All-Pro defensive end Justin Tuck. Coughlin said
Sunday outlook A heaping of players returned to practice with the Giants yesterday, but who will actually play? DE Justin Tuck (groin/neck) Tuck might be the biggest piece the Giants have missed. Coughlin said he’s markedly improved, but he’s still a question mark. RB Brandon Jacobs (knee) Coughlin said the swelling in Jacobs’ knee had gone down, so they are hopeful he’ll play. But that will depend on if it stays down. OG Chris Snee (concussion) Coughlin’s son-in-law is expected to play Sunday. He’s been headache-free for over a week and passed all of the concussion tests. CB Prince Amukamara (foot) The rookie is still limited in practice and said he won’t know if he’ll play until Thursday or Friday. That’s generally not a good sign.

Snee suffered a concussion against Seattle and has missed the last two games. “Everything is fine,” Snee said. “I passed all my tests last week and have been headache-free for over a week.” Unsurprisingly, Coughlin wasn’t ready to admit to needing the time off himself though. “The bye is where the bye is and I don’t have anything to do with it,” he said. “We take it as it is and we use it as a positive. But here it is in Week 8, and it’s Ballard who has shocked and awed everyone in the facilities. “I thought he would be a good blocker. You saw a big strong kid who could hold his own with defensive ends and outside linebackers,” said Gilbride. “[But] the real surprise has been

skills and size and applied them to his position.” The unassuming Ballard was on the practice squad all of last season and was thought of as a plodder because of his size (6-foot-6, 275 pounds), but quickly climbed the depth chart once Boss left via free agency to Oakland. Since becoming the go-to “receiving” tight end, Ballard has improved every week. His 15 catches ranks fifth on the team, while his 273 receiving yards ranks third — ahead of starting wideout Mario Manningham. Ballard, who also has
two touchdowns, has stayed humble. “It’s not really a shock,” he said. “I’ve always had the confidence in myself and knew what I could do.” Earning the trust of such a respected and accomplished quarterback as Eli Manning wasn’t easy, according to Ballard. Manning said his uneasiness to throw to the tight end has dissipated each passing day. “Jake’s done a great job,” Manning said. “He’s come in and he’s worked hard.” TONY WILLIAMS
