Ouster by university trustees comes after two days of growing criticism Governing body said his departure ‘not an easy decision’ Penn State University’s governing body ousted legendary coach Joe Paterno last night along with university President Graham Spanier, ending Paterno’s 46-year reign in Happy Valley. “It was not an easy decision,” board of trustees Vice Chairman John Surma said last night shortly after 10 p.m. “In our view, things had reached a point that a change was necessary in the long interest of the university.” Riot police were dispatched to the university’s main campus in State College in anticipation of students’ reaction to Paterno ouster. For the last couple days, students publicly supported Paterno on and nearby the campus. Hundreds spent hours outside Paterno’s home off campus Monday and Tuesday. JoePa’s firing comes after a day of growing criticism about the university’s silence on the coach’s future. Vince Fumo yesterday tried to paint a picture of a man who continues to lie to suit his needs. Fumo was sentenced to 55 months in prison in July 2009 after he was convicted of defrauding the state Senate, the Citizens Alliance, and Independence Seaport Museum out of millions of dollars, but an appeals court tossed out the sentence by U.S. District Court Judge Ronald Buckwalter. Prosecutors want the sentence increased to 18 years, while Fumo’s defense is pushing for the same sentence.

Testimony yesterday largely focused on Fumo’s health and his application for a drug treatment program at the Ashland, Ky., prison where he’s confined. Dr. John Manenti, regional medical director for the Bureau of Prisons, testified that Fumo’s overall health has been stable despite serious medical conditions. “He’s done quite well,” Manenti said of Fumo’s improvement with anxiety attacks and renal failure.

Assistant U.S. Attorney Robert Zauzmer also claimed that Fumo applied for residential drug abuse treatment in order to get a reduced sentence. Though they’ve yet to file for divorce more than a year after separating, David Arquette says his marriage to Courteney Cox is definitely over. When pressed by Howard Stern during a radio interview if he would break up with new girlfriend Christina McLarty and move back in with Cox if she asked, Arquette gave a simple “no.” And while Stern has previously gotten plenty of information out of Arquette, the recent “Dancing with the Stars” contestant is looking to stay more tightlipped going forward: “I’m trying to keep my personal life personal,” he says. “It’s very hard for me because I’m a very honest person.”
Town is warned about Harry Prince Harry has moved on to Gila Bend, Ariz., for the final leg of his helicopter training in the U.S. — and his reputation has apparently preceded him. “We have some very pretty girls here,” Gila Bend Mayor Ron Henry tells the Daily Mail. “Some of the dads won’t take too kindly to a prince fornicating the night away and drinking into the small hours. It is a very quiet town with a lot of good Christian people. This isn’t a party town.” And yes, he said “fornicating.”

enny Craig attracts, let’s say, “midlevel” celebs to be their spokespeople. Sara Rue, Valerie Bertinelli, Phylicia Rashad and Jason Alexander are among those who have been paid handsomely to shill the company. But they must have paid buckets of cash to afford their latest spokeswoman, Mariah Carey. The company’s big celeb get was revealed yesterday at New York City’s Four Seasons. Carey arrived 20 minutes late to the conference and was escorted all the way to the stage to what we thought would be to take questions from reporters, which is why we were there. Instead, she was just interviewed by Gayle King about her involvement with Jenny Craig, which, by the way, is now just called “Jenny.” Carey says she started Jenny in July and has lost 30 pounds so far. She told King she was approached by three different weight loss companies while pregnant but picked Jenny because she clicked with the people. “Some other suitors have great money, have great ... whatever it is that their concepts are — I didn’t really connect with the people, and this was only over the phone at first. In the summer of 1996, Oasis were at the peak of their career. The Gallagher brothers had been declared legends, and in front of the castle Knebworth they were crowning their success with the biggest double concert ever in the United Kingdom — in front of 250,000 fans. Fifteen years later Oasis have split up, brothers Liam and Noel only communicate through their lawyers and they have separate music careers. I don’t write songs about my amazing kids — that would be a pretty boring album. I hope that whoever listens should see something of themselves in my songs. You have said that the recording of this album reminded you of the time when you made “Definitely Maybe.”
The similarities are that this is my first solo album and that was Oasis’ first album.
The excitement about the unknown is the same, I think. We didn’t have an audience then — and I don’t have an audience now. How are things between you and brother Liam?
We haven’t spoken in two years. How does that feel? He is your brother after all?
But he isn’t your brother.
And if he were, you wouldn’t talk to him either. Will there ever be an Oasis reunion?

Usually they write, â&#x20AC;&#x153;And Gloria says something in Spanish,â&#x20AC;? and they let me say whatever I want, you know? Theyâ&#x20AC;&#x2122;re not going to tell me what to say in Spanish. And of course I say something that I think is funny.

Each track features several difficulty levels and comes equipped with the official music video. There is also a mode that allows you to partner up with your friends in coordinated routines. ‘A Very Harold & Kumar 3D Christmas’ Our favorite modern-day Cheech and Chong are back six years after crashing Guantanamo Bay for a very stoney Christmas adventure. Prepare to dodge eggs, hats, fingers and traffic cones in what is probably the only comedy to make the most of its 3-D effects. METRO

Whiskey Fest barrels into town
The annual celebration will feature tastings of more than 200 varieties of the hard stuff Master distiller Lincoln Henderson on the joys of Kentucky bourbon After nearly four decades as master distiller for the Brown-Forman Corporation, overseeing namebrand bourbons Woodford Reserve and Old Forester, Lincoln Henderson was looking forward to a peaceful retirement. That dream ended when his son Wesley approached him with the idea of starting up their own distillery operation. “I told him he was stupid,” Henderson recalls in his warm Kentucky drawl. "But he went ahead with it, the whiskey became mature, we put it in port barrels for about six months, and now we have Angel’s Envy.” Angel’s Envy, which Henderson has referred to as his “life’s work,” will be one of more than 200 spirits available for tasting at the eighth annual Philadelphia Whiskey Festival, where the distiller himself will be on hand, as will Fred Noe, great-grandson of Jim Beam, who will be signing bottles of the family business’ Devil’s Cut

Indie rock, classic 1960s soul and sweaty energy all meet up in Fitz and the Tantrums More fans are ‘Pickin’ Up the Pieces’ as the LA six-piece graduate to larger venues
E
verything about Michael Fitzpatrick is befitting of a man who fronts a band called Fitz and the Tantrums. In performance, he’s a dancing machine, and in conversation he’s quick with a quip and prone to emotional reactions. “Nobody gives anybody in rock ’n’ roll s— for being in the 10 millionth rock band,” he says when the topic arises of other contemporary soul-influenced acts like Mayer Hawthorne, Sharon Jones and the DapKings and Eli “Paperboy” Reed. Fitzpatrick has only kind words for his peers, and he’s keen to point out that within the genre, “everyone’s doing their own thing.” As far as Fitz and the Tantrums are concerned, that’s certainly true. “We don’t adhere to the form as rigidly as some of these other artists do, and I love their music. That’s just not what we wanted to do,” he says. “We wanted to do something that was more of a hybrid. We just weren’t afraid to let something that felt like it was outside of the character of soul music make its way onto the record.” What’s immediately ap-

Brett Brackett, the newest member of the team’s practice squad and proud Penn State alum, was immediately swarmed yesterday by reporters. Shockingly, none of them wanted to hear about his new job. Brackett, who caught 39 balls for 525 yards last season as a senior captain, shared his thoughts on the sex scandal rocking his alma mater. “First and foremost, my thoughts and prayers go out to the families of the victims, which is something you can never imagine having to deal with,” he said. Brackett said he hasn’t

been following the case too closely, as he tries to learn the Eagles’ playbook, and never had any contact with disgraced former de-

My grandfather constantly says that nobody gets out of this world without ends,” said Brackett. “So whether it’s an end to your career, end to your life, things come to an end.
