Arrest in Etan Patz case Police arrest New Jersey man, charge him with 1979 murder of little boy Man said he lured the child into store, then choked him For the first time in 33 years, an arrest has been made in the tragic case of 6-year-old Etan Patz. NYPD Commissioner Ray Kelly announced Thursday evening that police arrested Pedro Hernandez, 51, and charged him with murder. In a bizarre twist, the arrest comes nearly 33 years to the date of the boy’s disappearance on May 25, 1979. About a month ago, police and FBI workers reopened the case and began digging up a basement in SoHo where Patz used to play. The notoriety of the cold case spread, said Kelly, and about a week ago a Hernandez family member contacted the NYPD and said that Hernandez had killed the boy. Police went to where Hernandez now lives, in New Jersey, and took him into custody Wednesday night. He voluntarily returned with them to New York, where he spent more than three hours Thursday telling police what happened 33 years ago. According to Kelly, Hernandez told police he stopped the boy and lured him into a bodega at 448 West Broadway by offering him a soda. Once there, Hernandez said he took the boy into the basement and choked him to death. He then

“We think we have probable cause to go forward with the arrest.” COMMISSIONER RAY KELLY

wrapped his body in plastic wrap and put the body in the trash. Hernandez worked in the bodega stocking shelves at the time, and lived nearby on West Broadway. He later left New York, and in the years since, he told at least one family member he had “done a bad thing and killed a child in New York,” said Kelly. Police said they told the Patz family, who still lives in SoHo, that they made their first arrest in the case. “We can only hope this development brings them some measure of peace,” said a somber Kelly. Kelly said they have a written, signed confession from Hernandez. Sammy Vargas, a super in a building across the street, said he had hoped cops would finally arrest someone and put to rest the case. “It would mean a lot,” he told Metro. CARLY BALDWIN and ALISON BOWEN

Patz was one of the first missing children to have his photograph printed on milk cartons.

Past suspects Long targeted as a suspect in the case was Jose Antonio Ramos, a friend of Patz’s babysitter who was later convicted of child molestation in a separate case in Pennsylvania. He is due to be released from prison in November. Authorities also tore through a workshop used by handyman, Othniel Miller, now 75, who had paid the boy to help him with chores. Miller was questioned by police but was never charged with a crime.

A cold case reopened Although little Etan was formally declared dead in 2001, Manhattan District Attorney Cyrus Vance reopened the case in 2010. Investigators tore apart the SoHo basement in April, looking for clothing and human remains after a cadaver-

‘Law & Order: SVU’ evokes two sex scandals ripped from headlines WIREIMAGE

NEW YORK. New Yorkers watch-

ing the season finale of “Law & Order: SVU” Wednesday night probably experienced deju vu as two of this year’s biggest headline-making scandals were featured in the episode. The show began with a scenario that reflected the real-life rape allegations against NYPD Police Commissioner Ray Kelly’s son, Greg Kelly, who is also a news anchor for FOX 5. In real life, Kelly was accused by a woman who said Kelly took advantage of her after she had too much to drink. The case was handed to the district attor-

Aly Hamamsy has lived in the neighborhood for about 10 years, and told Metro that locals have been “kind of freaked out” by the police presence lately, especially when investigators were excavating. After decades of no breaks in the case, he said he welcomed the news of an arrest. “It’s great that they stayed on it,” he said of investigators. “Those poor parents.” METRO/AB

ney’s office, which later decided not to charge Kelly, based on insufficient evidence that a rape occurred. “Law & Order” put a different spin on the story, though, setting the scene of its season finale at a penthouse bachelor

party for the police commissioner’s journalist son, complete with high-profile bankers and athletes, and a slew of lingerie-wearing “escorts.” After a series of twists and turns, the episode unfolds into a tangled web of escort service wars. A prostitution ring is eventually uncovered and the detectives go after its leader, a woman who reminds us of the so-called “Upper East Side Madam” Anna Gristina, accused of running an elaborate prostitution ring out of an UES apartment. Mayor of West New York charged with hacking WEST NEW YORK, N.J. The mayor of West New York, N.J., a town just across the Hudson River from midtown Manhattan, and his son were arrested and charged with hacking into an e-mail account and website set

up to recall him from office. Felix Roque, 55, and his son Joseph, 22, were to appear Thursday in Newark federal court on charges of gaining unauthorized access to computers and causing damage to them, U.S. Attorney Paul Fishman said in a statement. “The elected leader of West New York and his son allegedly hacked into computers to intimidate constituents who were simply using the Internet to exercise their constitutional rights to criticize the government,” Fishman said. The website, www.recall roque.com, was set up by an unidentified Hudson County resident for the posting of commentary on the mayor and his administration. BLOOMBERG

Occupy Wall Street sues city over alleged book destruction Occupy Wall Street amassed thousands of books while at Zuccotti Park.

They said police and sanitation workers destroyed these books when they were seized.

The self-appointed librarians of Occupy Wall Street’s “People’s Library” filed a lawsuit Thursday against the city and the NYPD over the destruction of 2,798 books. The five protesters who filed the suit, which also names Mayor Michael Bloomberg, seek $1,000 in punitive damages and $47,000 in damages for the books and materials that were removed and destroyed during the November 15 eviction of Zuccotti Park. Six computers and some metal shelves were also damaged, according to Norman Siegel, an attorney for OWS. Siegel said he and his clients came up with that figure by using Amazon to determine the average cost of a book and multiplying it by the number of Occupy Wall Street’s damaged or missing books.

“We hope to hold the Bloomberg administration accountable for the violation of OWS rights that occurred during the eviction of Zuccotti Park.” NORMAN SIEGEL, ATTORNEY FOR OWS

“We’re cautiously optimistic,” Siegel told Metro when asked about the protesters’ chance of winning the suit. “We hope to hold the Bloomberg administration accountable for the violation of OWS rights that occurred during the eviction of Zuccotti Park.” After the books were confiscated, they were taken to the Sanitation Department.

Protesters were invited to retrieve them, but many complained that hundreds of books were missing and others were damaged. The lawsuit also seeks to uncover the details surrounding the NYPD’s plan to raid Zuccotti Park and evict protesters. “The raid struck not only at Constitutional rights but at a fundamental tool of enlightenment — thousands of library books and materials were destroyed,” members of the OWS press team said in a statement. “Although they had the power to conduct the raid, this lawsuit raises the issue of whether they had the right to conduct it in the manner they did,” Siegel said about the NYPD and the Bloomberg administration.

Occupy candidate One Brooklyn-native is hoping to Occupy Congress. George Martinez, an adjunct political science professor at Pace University and an OWS protester, is planning a run against Rep. Nydia Velazquez this fall. The self-described “Occupy candidate,” a Democrat, first grabbed attention as a performer within the city’s hip-hop scene. His political goals include federal oversight on stop-and-frisk and student loan forgiveness, according to his campaign website. METRO/CG

WALKING THE PRESIDENTIAL PLANK The heaving surf and blustery winds of the presidential race provoked a rash act on Mitt Romney’s would-be ship of state this week. With little warning and undeniable bravery (or foolishness) Captain Romney stalked out to the edge of a political plank to make a bold proclamation about what his first term would bring.

2 BROLIN IN BLACK Josh Brolin, who plays Tommy Lee Jones’ 1969 counterpart in ‘Men in Black 3,’ takes our time-travel pop quiz Spoiler: He doesn’t know his ‘Back to the Future’ facts

Review

‘Chernobyl Diaries’ Director: Bradley Parker Cast: Jesse McCartney, Olivia Dudley Rating: R Grade:

J

WILSON WEBB

osh Brolin knew he was taking on a challenge when he signed on to play a younger version of Tommy Lee Jones in the time travel-themed “Men in Black 3.” But how ready was he for the challenge of Metro’s Time-Travel Pop Quiz?

Q&A OK, you can only make one time-travel trip. Would you rather go forward or backward? Wow. That’s a great question. Forward, for sure. Selfishly, I’d like to backward because there’s a lot of people that I would love to meet, you know? Obviously a lot of very important people from your Jesuses to your Mahatma Gandhis to the obvious. But if you go forward, you can see what actually is the consequence of what we’re doing now, come back and actually have proof that will happen if we don’t change.

1

First of all, how many giga-watts are required to energize the flux capacitor?

Um ... 360,000? Nope, 1.21.

I’m glad I got that so wrong. [Laughs]

2

While time-traveling, can you interact with your past or future self, or would that cause a catastrophic event? There isn’t much redemption in watching a film like “Chernobyl Diaries.” Then again, there’s not supposed to be. As a gratuitous spectacle set at the now-abandoned site of the world’s worst nuclear disaster, a group of tourists get stranded only to discover they’re not alone. Oren Peli’s (“Paranormal Activity”) script isn’t wholly original, but mere suggestion and shaky cinematography will likely be enough to sell many tickets. STEVE GOW

It would cause a catastrophic event. But Boris the Animal does [in “Men in Black 3”]. I just know that time-travel, as is understood by Hollywood and their storytelling, has been if you in any way affect the past that you go into, that it always has a negative effect on the future. That’s what I’ve been told, at least.

3

Say you travel back in time and you arrive standing alone in front of a young Adolf Hitler. What do you do?

Befriend. That’d be the best way to get in there, and then you can detour him. Befriend and detour.

4

What kind of adventure did Bill and Ted have?

An excellent one. When I met Keanu Reeves, that was the first

Will Smith, right, brings Josh Brolin, left, into the “Men in Black” fold.

thing I said. I was like, “Bill and Ted, right on dude!” I did “SNL” recently and we did “The Californians,” and I think that was what I did, some version of guys I grew up with and Keanu Reeves in that movie. It’s funny because they came up to me during rehearsal and were like, “We’d like you to do more of a California voice.” And I said, “Dude, honestly, being from California, I’m doing the only voice that’s California. Everybody else is doing the funny version. I think I’m just doing the accurate version.”

5

The T-1000.

that I’ve seen, just because it was so fantastical, and Terry Gilliam is such a brilliant director. Like “Brazil” and “Fear and Loathing,” the lenses that he uses are so warped and all that. It’s brilliant. I like that movie a lot.

The T-1000. Very good, man. You know your stuff.

A lot of people say “Back to the Future.”

In “Terminator,” is Arnold Schwarzenegger a cyborg, an alien or a wacky twin?

A cyborg, of course. But a different type of cyborg than Robert Patrick in No. 2, right? What’s it called?

6

Which movie, in your opinion, gets time-travel the most right?

God, man. “Time Bandits” by Terry Gilliam was probably my favorite time-travel movie

To me, “Time Bandits” was a different level of it. “Back to the Future” is fun and kind of like, [in a Valley Girl voice] “Oh my God, it’s so much fun! He’s skateboarding and it’s a rocket! Oh my God!” [Laughs] I

haven’t seen “Time Bandits” in a while, I need to watch it again.

7

I’ll give you a chance to redeem yourself on the gigawatts question if you can tell me how fast the DeLoreon in “Back to the Future” has to go to travel through time.

Oh God, I know this. Sixty-five? Eighty-eight.

F—! I wouldn’t get very far. NED EHRBAR METRO WORLD NEWS IN LOS ANGELES

Will Smith boards his 1960s intergalactic alien-fighting machine in “Men in Black 3.”

I

t’s been nearly four years since Will Smith has had a movie out — his last being the weepy dud “Seven Pounds” — so you’ll understand if he wanted to ease his way back into things with something a bit familiar. “I haven’t worked in three years, so I wanted to put on some shoes that I knew fit,” Smith says. Hence “Men in Black 3,” re-teaming Smith with Tommy Lee Jones as the black-suited, Ray Bans-donning men of mystery keeping Earth safe from aliens its citizens aren’t even aware of. This time, they toss in the element of time-travel — but it’s still very much a “Men in Black” film. “It was very important for me, having been away that long, to come back in a way that I was comfortable and to come back with a project that was kid-friendly,” Smith says. “That was something that Eddie Murphy said to me a few years ago. He said, ‘Man, if you’re lucky enough to be in this business, every 20 years you have to go back and get the kids.’ I was looking at ‘Dr. Doolittle’ and ‘The Klumps’ and everything, the idea of matur-

ing. What’s great for me is that that target audience is in my house.” That wasn’t the only piece of wisdom from his elders Smith has held on to, as it turns out. “I was in Australia in 1990 with Sylvester Stallone, Arnold Schwarzenegger and Bruce Willis, and they were opening Planet Hollywood,” Smith remembers. “I go sit there with those guys, and Arnold says, ‘Young man, I want you to know that you cannot be a movie star only in the United States. You’re only a movie star if they know you around the world.’ They put that idea into

my mind very clearly, and then from that point that’s when I started to make it a point to open in new markets. We went into Russia with ‘I, Robot.’ It used to be a time where you could just have hit movies in the United States, but that’s not the case. So, to me it’s just about taking those laps around the world to maintain that.”

S

o with that kind of global stardom in mind, does that mean Smith will continue easing his way back into acting, possibly with a visit to another popular franchise like “Bad Boys”? Because co-star Martin Lawrence has certainly expressed interest. Smith is not so sure. “I love making those movies. It’s Miami, the tight T-shirt and fast cars,” he says. “But just at this point in my career, the material has to be right. I’m 43. I’m looking at maybe seven more years where I can run and jump a little bit, and then I’m going butt and gut for the rest of my career.” NED EHRBAR METRO WORLD NEWS IN LOS ANGELES

cized from his boy scout group and Suzy, a problem child within a broken family — fall in love and decide to run away into the wilderness together, sending the community into a comically militaristic search for them. The trouble with Anderson’s previous films like “The Darjeeling Limited and “The Life Aquatic may’ve come from the fact that those stories had veered off in strange tangents that upset the overall tone of the film. “Moonrise Kingdom, by contrast, remains a consistent, coherent work of art that never betrays the sweetness at its center. Though he may have had varying degrees of success in the past, the melancholic innocence that Anderson brings into focus in “Moonrise Kingdom shows that no matter how much fascinating artifice he jams into his movies, the heart is always in the right place.

In the arena, a cockfight unfolds JOAN MARCUS

Set on a patch of green carpet surrounded by the audience in a small, sparse, plywood arena, “Cock,” at the Duke on 42nd Street, is a cockfight if ever there was one. Punctuated between scenes — or rounds — by bells reminiscent of those in a boxing match, it’s a verbal slugfest that rages unheard within the head of John (Cory Michael Smith) and crackles between him and his two lovers, M (Jason Butler Harner) and W (Amanda Quaid). With its rapidfire dialogue by Mike Bartlett and deft direction by James Macdonald, it’s a knockout without a champion. John is gay. He lives with M in a committed, if somewhat fractious, relationship. Then he meets W and finds intimacy with her surprisingly fulfilling. It seems that he loves her. But he also loves M. It’s time for a decision, to be announced at a dinner M prepares for the three of them and his father (Cotter Smith). But decisions are not John’s strong suit.

Love is never easy, but sometimes it’s an outright fight: Jason Butler Harner, left, and Cory Michael Smith star in “Cock.”

The script is almost nonstop talk, so the few silences take on a weight that’s palpable. The cast is flawless — especially Smith, who anchors the play with striking honesty. His performance is like the set and the play itself, devoid of decoration. With no props and no fur-

niture, the beauty of “Cock” lies in its bold, theatrical simplicity. But there’s nothing simple about its ambiguous ending: It resonates with the contradictions of life itself. MICHAEL BRACKEN

Don’t expect the rapper’s brand new album to sound like a sequel to ‘Airplanes’ Why he enlisted Taylor Swift to help him with his sophomore effort

B.o.B. HAS HIS

After the massive hits on his debut, B.o.B. is primed for an easy smash of a follow-up, if he just follows the formula. But he probably doesn’t even need to do that. The Atlanta-based emcee and multi-instrumentalist gained a worldwide audience with “Nothin’ On You,” featuring Bruno Mars, and “Airplanes,” featuring Eminem and Hayley Williams — but he went the opposite direction with his new album, “Strange Clouds.” The new work features such hit makers as Lil Wayne (on the title track), Chris Brown, Nicki Minaj, T.I., Trey Songz and

Lopez not too busy for some TV shows

Although he insists there’s no date set for his wedding to Angelina Jolie, Brad Pitt has been treating the Cannes Film Festival like a bit of a bachelor party. At a black-tie after-party for his new film “Killing Them Softly,” the actor partied with everyone from Kylie Minogue to Diddy — who stopped by for a congrats drink before getting back to his yacht — and put back some expensive booze. “With Brad’s impending wedding, it almost had the feel of a sophisticated pre-bachelor party, with bottles of $390 Johnnie Walker whiskey and plenty of cigars,” a guest who we assume didn’t arrive by yacht tells Us Weekly. “It was definitely a night for Brad to remember.” You’d think so. But then again, swanky whiskey with Diddy on the French Riviera might be Brad Pitt’s equivalent of warm wine-coolers with the cat.

Curtis Stone dishes on ‘80 Plates’ JUSTIN STEPHENS/BRAVO

The TV chef, now hosting Bravo’s ‘Around the World in 80 Plates,’ tells us about the global gastronomy scene

O

n “Around the World in 80 Plates,” Bravo’s cross between “The Amazing Race” and “Top Chef,” cheftestants travel the world and complete culinary challenges based on the culture of the city they’re in. Though the series is sending its competitors everywhere from England to Morocco, you don’t have to leave your kitchen to add some of the global flair host Curtis Stone says you can bring to any Americana dish. “That’s the great thing about a show like this — there’s all sorts of inspiration to be taken from so many different sorts of people. The home cook will learn a lot by watching this.” Here, he breaks down some lessons learned from his time abroad.

Get involved in the show Now until July 31, you can rate international food from eight New York restaurants to raise funds for charity. Visit Chase Sapphire’s Facebook page to choose your favorite dish. For doing so, Chase Sapphire will donate $1 to Feeding America, up to $100,000 nationwide. Gilt Taste, Gilt Groupe’s online food market, has also partnered with the show: Each week, you can visit its “Around the World in 80 Plates Marketplace” to purchase exotic ingredients like chorizo and green curry. You can also check out recipes tied to each episode.

Spice it up

Stone says. His top spices for rich flavors:

“The culture in Tuscany was just so steeped in tradition, and some of our contestants tried to do stuff that was a little out there — they were just like, ‘That’s not in season right now!’ ‘Basil in a ribollita? Why?’”

for some of those flavors next time I’m drinking a wine.’” Thailand: One base, many dishes

France: Explore your food

"[In our episode in France] they do a tasting of different cheeses and have to identify which ones are made with sheep’s milk. I think that opens your eyes to be like, ‘Oh, sheep’s milk, cow’s milk, goat’s milk — what’s the difference?’ They also do a wine challenge where they have to try and match a bowl of ingredients that have the same bouquets and aromas that the wine has. Watching something like that makes you think, ‘OK, I’m gonna look out

Paprika Cumin Cayenne Fennel seeds and fennel a la grecque Fresh herbs (not dried)

Spices add exotic finesse to any meal. “If you're talking about a burger, you can do Thai burgers, Moroccan burgers — you can do all these different things,”

Italy: Customs are important

“Around the World in 80 Plates,” hosted by Curtis Stone and Cat Cora, airs Wednesdays at 10 p.m. on Bravo.

“In Chiang Mai, Thai food really comes alive, and they do so much in a mortar and pestle. They use things like galangal, which is very similar to ginger, and they also use ginger, lemongrass (something that I don’t think we use enough of in the Western world), lime leaves (used more similarly to

how we use bay leaves), palm sugar, lime rinds themselves, garlic, cilantro (both the stems and the leaves) — of course lots of fresh chilies — and all that’s pounded together to create this delicious paste. It’s so adaptable, whether it goes into a green papaya salad or a curry. That’s how the Thais cook, which is really inspirational.”

Subway grades idea is an epic FAIL RE: “CITY COUNCIL SUGGESTS GRADING SUBWAY STATIONS”: Are

these really the types of ideas our City Council is spitting out? Letter grades for restaurants are pointless enough but at least they work in promoting competition between the restaurants. What other subways are the MTA competing with? Sounds like the taxi lobbyists have been pulling overtime at city hall. How about instead of wasting money telling people how dirty their subways are, they use to money to clean them up. HANS HAUGEN, ASTORIA If “City Council suggests grading subway stations,” why not grade the council? The report card could include votes raising taxes, increase spending and long-term debt,

legislation infringing on civil and economic liberties, attendance at committee and full sessions, monies raised from pay-for-play campaign contributors, amount of lulus from $4,000 to $28,000 supplementing their $113,500 base salary for a part-time job, number of personal drivers, frequency of using private City Hall parking spots; ownership and use of MetroCard traveling around town, share of millions in pork barrel member item projects and relationship to campaign contributors, numbers and salaries for paid staff to ghost write newsletters, speeches, op-ed and letters to the editor, cost for out-oftown travel, value of free tickets to events and using one public office to run for another. Rangers not making any guarantees BRUCE BENNETT/GETTY IMAGES

If you’re looking for a guarantee from this year’s Rangers team, you won’t get it. Mark Messier’s guarantee before Game 6 of the 1994 Eastern Conference finals is irrelevant to a Rangers team that finds itself in a 3-2 series hole going into a win-or-theseason-ends match in New Jersey, exactly like the captain’s

happened, but that has nothing to do with how we’re preparing, I guess, is the best way to put it,” Rangers coach John Tortorella said. The only player on either team that played in the 1994 series is Martin Brodeur. Then, like now, he was the Devils’ starting goaltender. “I don’t even think about

All eyes on QBs Sanchez, Tebow dominate attention on first day OTAs are open to media Incumbent starter strong, ‘backup’ throws picks Too soon they say JEFF ZELEVANSKY/GETTY IMAGES

If the media is playing up a competition between starter Mark Sanchez and the recently acquired Tim Tebow, then neither the Jets quarterbacks nor their teammates are seeing it. Following Thursday’s organized team activities, the focus in the locker room was squarely on Sanchez, now entering his fourth year as starter, and Tebow, the popular quarterback who won the starting job in Denver last year. Try as the Jets might to downplay Tebow’s role, his every movement was analyzed, critiqued and tweeted during the twohour practice. During a three-play span in 7-on-7 drills, Tebow was intercepted by linebacker Bart Scott, had a rather plebian handoff to running back Bilal Powell and then was picked off again, this time by newly signed safety Yeremiah Bell. When asked about those two interceptions, Tebow managed to piece together a perspective that most of the media surrounding him seemed at a loss to find. “I’ll learn from it. Honestly it won’t bother me again. When you make a bad play you have to put it behind you and move on, and I feel like I did and I went out the next team

Special teams coach Mike Westhoff missed OTAs Thursday after having his 10th leg surgery. He was diagnosed with cancer in his left femur two decades ago.

‘94. In '94 I still had hair. It was that long ago. That plays no part in what we’re doing,” Devils coach Pete DeBoer said. “I don’t see anything that is similar,” Brodeur said. “That’s 18 years ago. That’s a long time. I know I’m feeling a lot different. I’m feeling a lot more appreciative of what’s going on.” DENIS GORMAN

period and felt like I did OK,” Tebow said. “You have to remember where you are and what you’re doing and it was 7-on-7 and the first time around on those plays.” Sanchez understands the aura behind Tebow and takes it in stride. “It’s maybe more at OTA time, but we’ve been in the playoffs around here and we know what it’s like to have different media outlets,” Sanchez said. “When you have a guy as popular as Tim, it’s only natural. It’s good exposure for our team and everybody.” KRISTIAN DYER sports@metro.us

Nicks down One day after the Giants lost a minor piece in cornerback Brian Witherspoon (torn ACL), they lost a major one in wide receiver Hakeem Nicks. Nicks, who had 78 catches and 1,192 yards last season, broke his right foot in OTAs Thursday. He will undergo surgery on Friday to insert a screw in his fifth metatarsal and will be out for three months. The Giants have mandatory minicamp from June 12-14 and then training camp opens on July 26. He’ll miss both and be pushing right against the season opener Sept. 5 versus Dallas.

Tim Tebow, left, and Mark Sanchez might as well have been the only ones on the field Thursday.
