Asleep at the wheel? Federal govt report blames driver fatigue in horrific Bronx bus crash Investigators say driver Ophadell Williams had hardly any sleep in the three days before he got behind the wheel Severe sleep deprivation may be even more dangerous than driving drunk NTSB

Company shut down The bus company, World Wide Travel Bus, was shut down after the crash, but many employees were transferred to another company, Great Escapes, according to The Associated Press. That tour bus company still operates. The report also chastised World Wide for not using an

Three charged in Rye High School hazing Three students at Rye High School in Westchester are facing criminal charges for alleged hazing, as part of a ritual known as “Freshman Friday.” Sean Pinson and Tristan Scragg, 17, and Max Meyerson, 16, are accused of driving three eighth-graders to a wooded area and beating them with a paddle. The teens were charged with felony assault, since investigators say the boys were covered in bruises. METRO/CB

Similar to drunken driving Several studies show that the little amount of sleep Williams had would have rendered him even more impaired than had he driven while intoxicated.

In the news A support pole tore the roof off the tour bus entirely. The bus was bound for Chinatown.

Backing Bloomie First lady Michelle Obama offered her support to Mayor Michael Bloomberg for his proposed ban on sugary drinks in servings larger than 16 ounces. In an interview with The Associated Press, the first lady said she “applauds anyone who's stepping up to think about what changes work in their communities.” METRO/CB

The driver of a Chinatown tour bus that toppled over last March, killing 15, hadn’t slept for three days and should never have been behind the wheel, found the National Transportation Safety Board in a new report about the horrific crash. The federal agency announced yesterday that the probable cause of the 2011 accident was driver Ophadell Williams’ failure to control the bus, which they attributed to fatigue. Ophadell Williams had nearly no sleep in the three days leading up to the March 12, 2011 crash, officials reported. Williams was unable to properly steer the bus away from the road’s edge and a deadly support pole sliced through the vehicle, ripping the roof off. The pole tore through the entire bus, from front to back. The

bus toppled over on I-95 in the Bronx. Fifteen of the passengers aboard died, and 17 were injured. Williams also received minor injuries in the crash. Investigators asked Williams to detail the three days leading up to the crash, and he recalled how he arrived home at around 11 a.m. and had to wake up again at 4 p.m. for another night’s drive. He claimed he would sleep for a few hours in the bus seats while passengers gambled, he said. But investigators noted that his cell phone and rental car were in use in the daytime hours, according to the report, leading them to suspect that he

had been out and not sleeping. The investigation concluded that Williams “was impaired by fatigue” at the time of the crash, according to the report. They did not say he was asleep. “His lack of evasive braking or corrective steering action as the bus drifted off the roadway was consistent with fatigue-induced performance impairment,” the report added. The bus, traveling at 78 miles per hour in a 50 mile per hour zone, careened to the right off Interstate 95 around 5:30 a.m., driving over the rumble strips on the right shoulder edge and crossing the 10-footwide shoulder, according to the report. The bus was on its way back from the Mohegan Sun Casino in Connecticut. ALISON BOWEN

alison.bowen@metro.us

During one study, people who were sleep deprived for 24 hours straight had the cognitive equivalent of being legally drunk, The New York Times reported. Another study in the British journal Occupational and Environmental Medicine found that drivers who had been awake for 17 to 19 hours performed worse than those with a blood alcohol level of .05 percent, about equal to downing two alcoholic drinks. Response speeds were up to 50 percent slower for people

going on 17 hours without sleep, according to that same study. Airplane pilots are required to receive a minimum 10hour rest period, including an opportunity for eight hours of uninterrupted sleep, pointed out Dr. Marlynn Wei, a Manhattan psychiatrist and sleep expert. “(Sleep) is particularly important for people in transportation, just for public safety reasons,” Wei said. “For a driver, it would be reaction time, decision-making.” Without regular sleep for several days, she said, “You would first be very fatigued, so your reaction time might be extended.” “Decisions might not be what you would normally make if you were fully rested,” she continued. “Your senses aren’t impacted, but your reaction time might be delayed.” METRO/AB

Where is Williams now? Williams pleaded not guilty to manslaughter and criminally negligent homicide charges, and is in Rikers on a $250,000 bail. His next court date is in September, according to the Bronx district attorney’s office. Williams had not turned in driver’s logs, according to the AP, and had been fired twice. At the time of the accident, his license had been

suspended 18 times. The bus company hired him even though he had a suspended license at the time, investigators found. METRO/AB

Life in prison for murder of cleaning lady An elevator operator who was convicted of savagely killing a cleaning woman in a Financial District office building in 2009 was sentenced to up to life in prison yesterday. On the evening of July 7, 2009, Joseph Pabon, 28, was working as a freight elevator operator at an office building at 2 Rector St., according to Manhattan District Attorney Cyrus Vance. Rodriguez, 46, worked as a member of the cleaning staff at the same building. That night, after all the office workers had gone home, Pabon followed Rodriguez to the eighth floor of the building, after asking other cleaning staff where she was. There, he attacked her and suffocated her with industrial tape, said the DA.

Pabon then used the freight elevator to transport her body to the 12th floor of the building, where he hid her body in an air duct. Someone made the gruesome discovery four days later. In April, a jury found Pabon guilty of murdering the mother of three. According to Vance, Pabon’s DNA was found under the woman’s fingernails, indicating there was a struggle as she fought for her life. “I hope that the verdict and today’s sentencing brings a small measure of peace to the victim’s family, said Vance. Pabon has consistently denied the crime; it’s unclear what triggered the attack. CARLY BALDWIN

QUEENS. A baggage cart employee who worked at JFK Airport was charged yesterday with allegedly stealing $20,000 in cash from a passenger’s computer bag. Anis Rehman said that on May 2 he accidentally left his computer case, which contained $20,000, on a baggage cart in an empty parking space in the blue parking lot of the airport. Rehman said he then headed to the terminal for his flight.

Closing time for Mickey Mantle’s After 24 years of delighting baseball fans, Mickey Mantle’s Restaurant on Central Park South is closing. The owner of the once iconic restaurant announced yesterday they will shutter the space after being open since 1988. “It’s a very sad and difficult decision,” owner Christopher Villano said. “Having ‘Mickey Mantle’ on the awning was an honor we took very seriously. Mantle was one of the great names in New York’s rich sports history.” The restaurant was named after the famous Yankees center fielder, and, before he died in 1995, Mantle was often spotted inside, where he would eat, drink and provide free autographs for customers. “We went there for my brother’s elementary school graduation,” recalled Brook-

Gwyneth Paltrow has spent the past couple days dealing with the fallout over her now infamous tweet from a Jay-Z and Kanye West concert in France. (Your day doesn’t include petty Twitter arguments? Fascinating. We’ll catch you up: She tweeted a photo of herself dancing onstage with the rappers and a caption that read “N***as in paris for real.”) Most people weren’t buying Paltrow’s initial argument that the caption was a harmless play on a song title from the JayZ/West album “Watch the Throne” and not an N-word violation — probably because she runs a “lifestyle” blog and starred in “Shakespeare in Love.” But now The-Dream has jumped in to defend the actress, claiming that he took the photo from her phone and also sent the offending Tweet. “Fyi Sorry for the Confu I typed Ni**as in paris for real from Gwens Phone my bad I was Fkd up please excuse it! We were lit!” the rapper posted. Now, we’re going to let Twitter and The-Dream sort out who is allowed to say what words and when — real issues

Bruce Willis and Demi Moore’s 20-year-old daughter was arrested for drinking a beer in public in New York City on Monday night — and showing a fake ID to cops probably didn’t help, either. Scout Willis was booked for criminal impersonation and having an open container before being released without bail.

Baby makes three at Barrymore wedding During his wedding to Drew Barrymore, Will Kopelman took a moment to acknowledge that their family is about to expand, according to Us Weekly. “Will said something like, ‘I’m excited to marry you. I’m excited to meet the newest member of our family,’” a source tells the magazine.

After splitting in May, the singer and her boyfriend, “Vampire Diaries” star Taylor Kinney, are back together. “They sure looked like they were back together — holding hands and being cute everywhere they went,” a source tells UsMagazine.com. Kelly Clarkson will play a mentoring role on the upcoming singing competition “Duets,” and she hopes that she’s learned from the mistakes that “American Idol” made when she was a contestant. “I’m going to be completely honest — I had no one looking out for me. They were looking out for the show, and it was horrible,” she says. “I was 19 years old. I was smart enough to know that it wasn’t about me, but that didn’t make it any easier. I’m all cried out about it, but my first four years, I hated my life; I almost quit a dozen times.”

Today’s cover magic prize goes to the good people over at Vanity Fair who, instead of trying to Photoshop a little will to live into Kristen Stewart’s eyes, just plopped a fluffy Pomeranian on her lap. Inside, Stewart laments losing her privacy after “Twilight.” “You can Google my name and one of the first things that comes up is images of me sitting on my front porch smoking a pipe. It was taken the day the movie came out. I was no one. I was a kid. I had just turned 18,” she says. “The next day it was like I was a delinquent slimy idiot. Big deal. But that changed my daily life instantly. I didn’t go out in my underwear anymore.” Oh Kris, we have galleries full of red carpet photos that beg to differ.

Alexander apologizes for cricket comments Former “Seinfeld” star Jason Alexander is offering an apology for his comments about cricket, which he called “a gay game” during an interview with Craig Ferguson. “The worst part is, I should know better,” he says. “My daily life is filled with gay men and women, both socially and professionally. I am profoundly aware of the challenges these friends of mine face and I have openly advocated on their behalf.”

“I’m not that Jewish,” Josh Young states as he bites into banh tap — shrimp crackers with pork. The actor who plays Judas in “Jesus Christ Superstar” met with us during his only available downtime, between a matinee and evening show, at a Vietnamese restaurant in Midtown. The rest of his week has been stuffed with promotional appearances, performances and rehearsal for the Tony Awards. The only other option I had was to not go on.” Perhaps thanks to those ups and downs, he teeters between modesty and mettle: “I’m not a typical choice,” Young states about the role. “I know the other guys who’ve played [Judas] on Broadway in the past, and I’m very different from them. ... I would have to say I’m outside the bad-boy, rock ’n’ roll box.” But he’s quick to add, “I can do whatever anybody else can.” We tell him we’re going to print that, but the rising star won’t back down now. Facebook will disappear by 2020, says analyst Facebook‘s sliding stock price has one hedge fund manager predicting a dismal decade ahead for the social network. “In five to eight years, they are going to disappear in the way that Yahoo has disappeared,” Ironfire Capital founder Eric Jackson told the CNBC show Squawk on the Street on Monday. “Yahoo is still making money, it’s still profitable, still has 13,000 employees working for it, but it’s 10 percent of the value that it was at the height of 2000,” Jackson added. “For all intents and purposes, it’s disappeared.” So how exactly does Jackson see Facebook’s power eroding by decade’s end? He says it will be the continued emergence of the mobile Web — and

Facebook’s struggle to adapt to that paradigm shift. “I think those who are dominant in their prior generation are really going to have a hard time moving into this newer generation,” he said. “Facebook can buy a bunch of mobile companies, but they are still a big, fat website, and that’s different from a mobile app.” Facebook bought the popular mobile photo-sharing app Instagram for $1 billion in April. Still, the company has acknowledged mobile as a potential stumbling block for sustained growth. In its required initial pre-IPO disclosure of 35 “risk factors” released February, the company admitted that as mobile use of Facebook continues to expand, its ad-free mobile platform will become more problematic. evaluates my body fat, discusses my goals (flat stomach like Gisele — duh), hands me her DVD to practice techniques at home and introduces me to the six women working out today. The intimate class size instantly relieves some of my gym anxieties — and is part of the A.R.T. appeal. Among weights, blocks and exercise mats, you’ll find basil plants growing on window ledges. Phoenix, Walsh’s adorably happy pitbull rescue, often makes visits. And class chatter includes where a gal can find the best blowout in town — my kind of place. A self-professed “house head,” Walsh curates a playlist before each grueling workout, which consists of sequences involving weights, planks, lunges, push-ups, crunches and squats.

When the going gets tough When the burn of your 40th leg lift is too much to bear and you’re considering lowering down, Walsh will yell: “You didn’t climb up six flights of ugly stairs to hang out” or “Your pictures are forever!” “She’s got a great sense of humor and such good energy,” says Kelly Rosen, 29, who first signed up for boot camp before her wedding in 2010. “No matter how exhausted you are, she’ll get you to kick it into high gear.” Marisa Sannicandro

joined A.R.T in 2012 to “look as good as I could in my wedding dress.” She admits that she “hated going to the gym and never did,” but says, “this class is so fun.” After seeing her waistline shrink from 28 inches to 23 in eight weeks, the 32-year-old is a convert. “It’s only an hour, and you feel so much better after,” she says. And those aren’t the only perks. “What I love about Terri is when she’s teaching, she makes you understand what you’re doing,” says Rosen, who lost 11.5 inches during her boot camp. “It was like my body transformed. You feel strong. She’s very empowering.”

You must eat “I don’t believe in diets,” Walsh says. She requires boot campers to eat three proteinpacked meals and send her a daily food diary. “Before Terri, I ate no breakfast — and for dinner, [I ate] whatever junk food I could grab on the way home. She taught me how to eat healthfully,” says Sannicandro.

More than numbers Every few weeks, Walsh measures her students to make sure they’re on track. But for this trainer, the greatest sign of success is when a student finally nails a move. “My favorite part is watching someone go from uncoordinated to coordinated,” she says. “I like the person in the back row. I like the person

that’s trying to hide from me. Everyone thinks you have to come out of the box understanding what to do, and that’s not the case at all.” Teaching people how to be physically capable may be even more important than results. “Of course I’m going to make your butt tighter, of course I’m going to give you the abs you want, of course your arms are going to look good,” Walsh says. “But what keeps people showing up is

that there’s never-ending learning and discovery when you actually practice what I teach you to do.” The favorite part for us students? Even better than how great our jeans look now is the walk down those stairs after each class. You’ll feel so badass — bring on the final dress fitting!

Greedy corporations are anti-American RE: “WE MUST PAY RICH OR THEY’LL LEAVE US!”: Corpora-

tions who send American jobs abroad for love of money over country are traitors! They can go bankrupt, for all I care. Once global wages inflate closer to ours (and they’re rapidly doing so!), those same companies will be begging to come back. Screw ‘em! Sleep in the bed you made yourselves. Since when did profit mean more than country?! This is why Republicans are trying to destroy unions. The living wage unions represent should be the norm, not the $4/hour slave wages of China and India. Who could live on that? For this treason, the GOP should go extinct. They’re evil puppets working hard for billionaires

looking to further line their pockets at the expense of the American worker. Is there class warfare today? You bet! But hard-working folks didn’t start it, corporate raiders did. The question now becomes: Will my neighbor stand with me, trying to make a better life for my family? Or will he stand with greedy, profiteering billionaires hell-bent on destroying the way of life for an entire generation in the name of vulture capitalism? I know where Joey Whitmoyer stands. How do women vote for Republicans?! The Republican party has voted overwhelmingly against the paycheck fairness act and against the Lilly Ledbetter Act that gives women recourse if they are paid less than a man for the same job. The churches themselves are not being held to the new health care law, it is Catholic business that is being held to it. If the Catholic Church wants to do business then it must abide by the same rules as everyone else; if it wants to stick with religion, then it can be exempt, but it must abide by religious dogma and give away its services for free as charity. It can’t have both.

IS THIS THE END?

Devils’ season on the brink, trailing 0-3 to Kings in Stanley Cup final Only three teams have ever come back DeBoer keeps positive outlook ANDREW D. BERNSTEIN/NHLI/GETTY IMAGES

Brodeur

Brodeur least of concerns for DeBoer Devils head coach Pete DeBoer absolved goalie Martin Brodeur of blame even though he has allowed eight goals on 78 shots in the series. Brodeur has a .897 save percentage and 2.66 goals against average through the three games. By comparison, Kings goalie Jonathan Quick has a .972 save percentage and 0.66 goals against average while limiting the Devils to two goals on 72 shots. “Marty Brodeur bouncing back is the least of my concerns,” DeBoer said. “[Our] desperation level is high. You’re in the Stanley Cup final. I don't think there’s a way of heightening the desperation level. We’re down 3-0. We just have to stick with it.” METRO/DG

The scenario facing the Devils is brutally simple — win Game 4 of the Stanley Cup final and keep their season alive. The Devils trail the Kings in the best-of-seven series three games to none. Should the Devils lose Game 4 tonight at Staples Center, they will author an unwelcome piece of franchise history — its first sweep in a Stanley Cup playoff series. “Try to get this thing taken back to New Jersey [for Game 5],” Devils captain Zach Parise said during his media availability yesterday. “That’s all we can do right now. That’s all we can think about.” Contemplating the alternative can only lead to dejection. The only team in NHL history to win the Stanley Cup after falling behind 0-3 in a series was the 1942 Toronto Maple Leafs. Only three teams have ever won a playoff series after falling behind 0-3 in a series: the aforementioned Leafs, the 1975 New York Islanders in the quarterfinals and the 2010 Philadelphia Flyers in the Eastern Conference semifinals. “We haven’t talked about the statistics of the situation we’re in. We feel we don’t belong in the hole we’re in right

now based on the way we’ve played, but we are,” Devils head coach Pete DeBoer said when he met with reporters

yesterday. “[We’ve] got to stick with it and win one game. That’s where it starts.” The Eastern Conference champions have not been able to consistently gain the offensive zone, to say nothing about implementing their forecheck in the same manner that they did against Florida, Philadelphia and the Rangers. “I grew up in Ontario. Heard a lot of stories about the Leafs,” DeBoer said through laughs when asked about the 1942 Leafs. “I think ‘42 is a little far back for anything I remember.” DENIS GORMAN sports@metro.us

Just bear down? Pete DeBoer is still talking like a coach that expects his offense to break through at any moment this series. “We’ve got to bear down a little bit more. We’ve got to get some more traffic,” DeBoer said. “We’ve got to find a way. [Jonathan Quick has] played very well. He’s played very well — for me — early in games. We’ve never been able to grab momentum.”

Yankees reliever David Robertson spent part of yesterday throwing 35 pitches in a bullpen session with the next step facing live hitters. If that goes well, he will likely appear in a minor league rehab game. In terms of returning Robertson to the closer role, it sounded like manager Joe Girardi is leaning towards retaining Rafael Soriano in the role. “We’re probably going to put Robby in some situations in the eighth inning when he comes back and then we’ll just go from there, Girardi said. “Soriano has done a very good job, whatever we’ve asked him to do. Kyle Schuneman shows our apartments some California love.

yle Schuneman wants to help you think inside the box — that is, the miniscule one-bedroom that commands half of your monthly income. Earlier this month, Hautelook.com asked the 26-year-old interior designer (named a “Tastemaker” by Los Angeles Magazine) to make over three typically small East Village apartments in his signature California style. The challenge, he said, was to conjure a coastal theme in a small space “without making it feel like a seafood restaurant.” Schuneman, whose book “The First Apartment Book: Cool Design for Small Spaces” publishes this August, chatted with us about how to invite some much-needed West Coast ease into our often-cramped East Coast quarters.

How do you define West Coast style?

I think it’s casual, I think it’s approachable. I think if you look at it and it’s effortless, and it doesn’t feel like it’s designed by anyone specific and it just feels organic, then that’s California for you. So the size constraints of the typical New York apartment aren’t a problem?

Not at all. California is full of an eclectic mix; I think it’s important to embrace that and find your own style. It’s all about feeling — if people stop by, they can come in and it’s warm and inviting. It doesn’t feel uptight. Can West Coasters take any tips from East Coasters?

You guys do crazy things with your storage; I’ve learned a lot about using every nook and cranny. You have such beautiful

architecture to pull from, but you don’t have the luxury of space. So you have a very structured approach to design, and I think that it can be really mixed well with California style at the same time. What inspired you to focus on small spaces?

I grew up in a 1,200-square-foot apartment with four people; my parents turned the master bedroom into another bedroom and turned the closet into my sister’s room. ... I think you guys have constraints, but they’re creative constraints. I think that having a box to work in is sometimes easier than having an unlimited space. Think from an architect’s point of view, start with function and build from there. REBECCA FINKEL letters@metro.us

Floor-to-ceiling window treatments and painted moldings bring up the eye.

Kyle’s tips for small spaces: “Everything has to function at least twice.” Choose furniture

that also functions as storage. “Think of your rug as your fifth wall.” Aggressive wall colors and patterns can make a small space feel smaller. Keep your walls neutral and go wild with your

floor coverings. “Bring the eye up.” What your apartment lacks in depth, it can usually make up for in height. Highlight decorative moldings and opt for floor-toceiling window treatments.

Grow up, not out A vertical pallet garden makes the most of tiny city back yards Directions for how to get yours started Outdoor space is hard to come by in a city, but you don’t need a sprawling lawn to spruce up your home with plants and flowers. Instead of gardening out, garden up. With vertical gardening, you plant on a wooden pallet or metal panel, then attach it to a wall or prop it up against a deck or balcony railing. “If you can wake up in the morning and look out at what was previously a brick wall and is now full of green living plants, it

garden center in Philadelphia. The trick, he says, is to arrange the plants so they all get enough light, which means making sure bigger ones don’t throw a shadow on the little guys. Most types of plants, flowers, veggies and herbs will work, says David Prendergast of Greensgrow, an urban farm in Philadelphia. The farm, open seven days a week, has examples on display for aspiring vertical gardeners.
