Judge suspends stop-and-frisk ban in Bronx Judge Shira Scheindlin, a Manhattan federal judge who ordered the NYPD to stop carrying out their stop-and-frisk policy around some buildings in the Bronx, lifted that restriction yesterday, the NY Post reports.The city requested she hold off on enacting her ruling pending their appeal. The American Beverage Association and other coplaintiffs presented opening arguments yesterday in a lawsuit alleging that the Board of Health “overstepped its authority by trying to issue new policy” with the soda ban. The soda ban is a new regulation prohibiting the sale of sodas larger than 16 ounces in arenas, restaurants, and movie theaters. It does not apply to businesses like 7-11, where the majority of sales comes from packaged food as opposed to prepared food. Those businesses are affected by retail regulations, not health department regulations, according to J. Justin Wilson, a senior research analyst at the Center for Consumer Freedom. The ban is set to take effect in March.

The big soda ban is under fire from a number of groups, including the American Beverage Association, the NAACP and the Hispanic Federation.

Manhattan Borough President Scott Stringer called for an investigation by the MTA yesterday after a spate of subway fatalities. Three subway deaths within 24 hours last weekend is putting the city on pace to surpass the 55 victims hit by trains in 2012, he said. In a letter, Stringer asked the MTA to review safety programs that could prevent these types of deaths. “Too many people are dying in our subways,” he said. METRO/AB

In his State of the NYPD speech yesterday morning at the Waldorf-Astoria Hotel, Commissioner Ray Kelly discussed new technology in development that may be used to scan people for concealed firearms. The device detects “terahertz,” a natural radiation emitted by people and objects, according to Kelly. Mayor Michael Bloomberg and Brooklyn Borough President Marty Markowitz broke ground yesterday on the restoration of the historic Loew’s Kings Theatre in Flatbush, Brooklyn. Originally constructed in 1929, the theater is the largest indoor theater in Brooklyn. Its design was influenced by the Palace of Versailles and Paris Opera House. The $93.9 million project will create more than 500 construction jobs and 50 permanent jobs, the city said. As part of the project, the theater will expand from 68,000 square feet to 93,000 square feet. METRO/AH

Police Communications Technician Coryse Hercules, 28, saw another rider’s eyes widen when an 18-year-old moved a gun from his pants to his backpack, police said. Imagine struggling for months to find a job, only to find out that the first strike against you is that you are looking for one. The City Council voted yesterday to prohibit employers from using employment status in hiring decisions. Just over half — 51 percent — of unemployed New Yorker have been actively searching for work for six months, according to the Council. But not everyone is on board — Mayor Michael Bloomberg has vowed to veto it, saying it would make employers fear potential lawsuits. Park Slope resident Yvonne Girela, 53, told Metro that after taking time off to care for her dying brother, employers did not warm to her over50, unemployed status. “I get discriminated all the time because I’m unemployed,” she said. The United States and African leaders threw their full diplomatic weight yesterday behind a campaign to expel Islamist rebels from Mali, as French air strikes harried the al Qaeda-allied fighters in their strongholds. It also may dent any hopes that Clinton, who mounted an unsuccessful presidential campaign in 2008, may run for the White House again in 2016. By turns emotional and fierce, Clinton choked up as she spoke of comforting the victims’ families and grew angry when a Republican senator accused the Obama administration of misleading the country over whether the Benghazi incident stemmed from a protest.

Notre Dame football star Manti Te’o told ABC News’ Katie Couric that he had lied to keep up a hoax involving a nonexistent girlfriend two days before the Heisman Trophy winner was announced. In a preview of the interview shown yesterday on “Good Morning America,” Te’o talked about the girlfriend, Lennay Kekua. He mourned her Sept. 12 death from cancer — but it later turned out that she never existed, except as part of an online fraud. “Now I get a phone call on Dec. 6 saying that she’s alive and then I’m going be put on national TV two days later,” Te’o told Couric. “And [they’re going] to ask me about the same question. You know, what would you do?” A Heisman contender, Te’o was passed over for the award, which went to

f you think the essence of Bob Marley & the Wailers includes waving a Red Stripe in the air and singing “every little thing is gonna be all right” along with a cover band, you may be surprised by what you hear at Brooklyn Bowl tonight. Led by founding member Aston “Family Man” Barrett, the Wailers are playing the 1979 album, “Survival,” in its entirety. This is the first time the band has dedicated a tour to a single album since Marley’s death in 1981. The 10-song collection starts with the desperate “So Much Trouble in the World” and only goes into darker, more militant territory. So why this album? Why now? “The crisis that’s happening around the globe right now, it’s reminding us of the ‘70s,” says Family Man. The 66-year-old Rastaman speaks like his signature way of playing bass. His voice is deep and he takes pauses that end right after you wonder if you’ll hear from him again. It’s sometimes tricky to decipher his words through his thick Jamaican patois. haun Hergatt, the executive chef at ESquared Hospitality, comes to New York from the land down under. With an endless list of accomplishments and awards under his belt, Hergatt is set to open Juni, a fine-dining restaurant in Midtown, this spring. He grew up in Cairns, Australia, surrounded by passionate and professional cooking by way of his Scandinavian grandmother and his father, who Hergatt observed in the kitchen. “It sounds cliche, but I

knew I wanted to be a chef from a very young age,” Hergatt says. When he was 17, he pursued a four-year apprenticeship at a fine-dining restaurant in Cairns that trained him in classic French cooking. After winning countless competitions, he moved to Sydney; a few years later, he became the Chef de Cuisine of The Dining Room at the Ritz-Carlton, Sydney. Hergatt moved to the U.S. in 2003 and after a brief stint in both Washington, D.C., and Boston, and he became the executive sous chef of Atelier at The Ritz-Carlton, Central Park. Hergatt promises that

Australian vs. American food From his experience, Hergatt says both Australians and New Yorkers appreciate good eats. “The one thing about Australia is that it’s very organic,” he says. “The food there is very healthy. America is now changing its mind. The way people are looking at food here is changing. They want to know the origin of their food.” Another major difference? Hergatt says Australians eat more veggies and less protein. “America is obsessed with steak,” he says.

ing ideas for his new project. The restaurant will be very vegetable-centric, without being a vegetarian restaurant. Hergatt wants to use fresh ingredients that are in season. “If we’re in the middle of summer and strawber-
