Tsarnaev friend too stoned to lie: lawyer Bombing. Testimony began Monday in the trial of Robel Phillipos, who is accused of lying to federal investigators probing the Boston Marathon bombing. Robel Phillipos, a friend of accused Boston Marathon bomber Dzhokhar Tsarnaev, was “high out of his mind” on marijuana after enjoying several joints, a blunt and a vaporizer the day he allegedly accompanied two
men to a UMass Dartmouth dorm where they removed evidence linking Tsarnaev to the deadly bombings. Testimony began Monday in U.S. District Court in Boston for Phillipos’ trial on charges he repeatedly lied to federal investigators about going to Tsarnaev’s dorm on April 18, 2013 — three days after the terror attack killed three people and injured 264. Defense attorney Derege Demissie held a gift-wrapped box in front of the jury and said prosecutors were trying to present “a neatly packaged case decorated with the tragedy of the Boston Marathon bombing.” He

Phillipos later admitted to investigators that he did indeed accompany Kazakh exchange students Azamat Tazhayakov and Dias Kadyrbayev to the room, where they removed a backpack containing empty fireworks shells. Special Agent Dwight Schwader of the federal Department of Transportation testified Monday that he baited Phillipos during one of five interrogations, saying “maybe he was a little b-tch who waited outside and served as a lookout.” Schwader said he wanted to elicit a response from Phillipos, who he claimed had not expressed emotion. “He said he wasn’t a little btch,” Schwader said. Phillipos faces up to 16 years in prison if convicted. He is not suspected in the bombings. MORGAN ROUSSEAU @MetroMorgan

Washington DC. Sudbury man’s terror conviction stands after court appeal
Tarek Mehanna / GETTY
The U.S. Supreme Court on Monday declined to hear a Sudbury man’s appeal of his 2011 conviction on charges of supporting the Islamic militant group al Qaeda. The court turned down Tarek Mehanna’s appeal, which was based on various
activities including a trip to Yemen in 2004 in which he sought military training and his work translating pro-al Qaeda documents from Arabic into English. Mehanna argued that his translation activities were protected free speech. His
lawyers claimed the prosecution needed to prove direct coordination with al Qaeda for Mahenna to be convicted under a federal law prohibiting “material support” to groups deemed to be foreign terrorist organizations. REUTERS
A bomb threat closed Winchester High School for the day on Monday. The threat, emailed to an administrator around 5:15 a.m., was nonspecific in its nature, but school was cancelled out of an “abundance of caution,” said Winchester Police spokesman John Guilfoil. Police, said Guilfoil, searched the school and the campus. An investigation is ongoing. The closure comes after a trio of schools received bomb threats last week. Schools in Swampscott and Bedford, Massachusetts, and Bedford, New Hampshire, cancelled classes following the threats. METRO

Court orders new trial in Green Line lawsuit Citing “transgressions” by the plaintiff ’s attorney, a Massachusetts appeals court decided on Monday to set aside a $1.2 million jury award and ordered a new trial in a lawsuit stemming from a 2009 Green Line crash at Government Center. Scituate resident Colleen Fyffe sued the MBTA after suffering a neck injury in the accident, which sent 50 people to the hospital. The trolley operator, Aiden Quinn, admitted to texting before the crash. The T appealed after Fyffe was awarded $1.2 million during a 2012 trial. METRO

There is “The Great Wave off Kanagawa” and “The Starry Night.” One of those ancient heads from Easter Island and an 80,000-piece dinosaur. All constructed with Legos. Nathan Sawaya’s “The Art of the Brick” exhibition, currently housed at Quincy Market in Faneuil Hall, includes more than 100 pieces of art made from millions of Lego pieces. His work began as a nighttime creative reprieve from his days working as a corporate lawyer. He started to receive commissions to create Lego art. Ultimately, Sawaya, now 41, left the corporate law world a decade ago to become a full-time artist, after his personal website that chronicled his Lego art work crashed from too many hits. He has since allowed his law license to expire and his exhibitions have since been shown around the world. His job now, he says, is to inspire. “The worst day as an artist is still better than the best day as a lawyer,” he says. Sawaya doesn’t deny his art has a built-in accessibility. Most people, he says, have at one time or another played with Legos. “It appeals to a broad range. We’re all familiar with it. Supreme Court dodges ban on gay marriage Gay rights. The number of states permitting gay marriage jumps from 19 to 24. The U.S. Supreme Court declined on Monday to decide once and for all whether states can ban gay marriage, a surprising move allowing gay men and women to get married in five additional states, with more likely to soon follow. On the first day of its new term, the high court without

comment rejected appeals in cases involving five states — Virginia, Oklahoma, Utah, Wisconsin and Indiana — that had prohibited gay marriage, leav-
ing intact lower-court rulings striking down those bans. The decision is likely to be followed by six more states that are bound by the regional federal appeals court rulings that had struck down bans. That would leave only 20 states that prohibit same-sex marriage. But the move by the nine justices to sidestep the contentious issue means there will be no imminent national ruling on the matter, with litigation likely to continue in states with bans. Gay couples in affected states are expected to seek marriage licenses immediately. REUTERS

TRADE LIKE A MILLIONAIRE
TIMOTHY SYKES TIMOTHYSYKES.COM Timothy Sykes is a millionaire stock trader and entrepreneur.

Characteristics of successful people My top goal as a stock trader was to make as much money as possible, and now my top priority as a teacher is to create successful students. I’ve already made several million dollars and now have several millionaires under my belt, but success is much more than just financial earnings. Here are three characteristics that, I find, successful people possess:
1: Dedication No matter what your goals are, to be truly successful you must dedicate yourself to your craft and understand that achievement is a result of hard work

and perseverance. Do not fear failure or mistakes. Everything you do wrong is one step closer to you achieving your goals because you’ll then know what not to do. Far too many people expect overnight success, and for the vast majority, that’s not how it works. Be patient.
2: Having the right plan Unfortunately, hard work and determination are not enough to guarantee success in this world; you must be on the right path and ideally also have the right plan to increase your odds

of getting to where you want to be. It’s OK to pivot from your original plan or even start all over with a new strategy, but I’ve met too many 9-to-5ers who work their butts off getting nowhere in life because they’re slaving away, working hard for someone else’s dreams. If you love the 9-to-5 world, that’s great, but don’t de-prioritize your passion and dreams and get stuck in the daily bustle of just trying to make enough money to get by in life.
3: Ambition I was determined to become a millionaire at a young age, so
My favorite college football team is Notre Dame — thanks largely to the film “Rudy” — and we just had a huge win against Stanford!
For exclusive commentary, visit Metro.us/blogs. I studied my butt off in high school and achieved my goal at the tender age of 21. Next, I wanted to become a hedge fund manager, and I checked that off at age 23. I became a best-selling author at age 26 and in 2007, my new goal was to create millionaire students from scratch. Now with three millionaire students in the bucket, I want to create many more millionaires. Every single day I work with my overall goal in mind. It’s a good way to live. Dream big.

To the Cliffs of Insanity and back Memoir. Cary Elwes takes fans behind the scenes of the making of the cult classic, “The Princess Bride.”
For a certain subset of the population, the phrase “as you wish” has some pretty magical connotations. It’s the coded phrase Wesley says to Buttercup throughout “The Princess Bride” that she eventually comes to realize is his way of telling her he loves her. It’s also the title of a new memoir by Cary Elwes, who played Wesley in the film, about the making of the film. (The full title is “As You Wish: Inconceivable Tales from the Making of ‘The Princess Bride.’”) It’s not just Elwes’ memories in the book, though. There are interviews throughout with almost everyone involved in making the movie, from screenwriter William Goldman to director Rob Reiner to Buttercup herself (“House of Cards” star Robin Wright). “I can’t take complete
credit for this book,” admits Elwes. “I did get the rest of the cast to share their experiences.” The book is full of odd little stories about the making of the movie, like the time Elwes broke his toe trying to drive Andre the Giant’s four-wheeler — and then, concerned he’d make director Rob Reiner so angry he’d be recast, continued trying to film.
That injury was something of a serious concern. He and Mandy Patinkin spent months learning how to fence, because Goldman had helpfully included in the script directions that the Wesley/Inigo Montoya battle should be the “greatest swordfight in modern times.” Whether it was or not is, of course, up to the viewer, but Patinkin’s interview about filming the big scene reminded Elwes of something he’d forgotten. he “Mandy reminded me that we had to m change some of the ch fight sequence at the fig last second because las it didn’t work for the camera angle that Rob ca had chosen,” says Elha wes. Reiner gave them w something like 20 so minutes to fix it (the m battle they’d rehearsed b for three months) and fo “we went and re-cho“w rreographed a whole ssection on the stairs, aand got it and did it rright in the first take, which I’d forgotten w aabout,” says Elwes. Elwes says he was iinspired to put the book together after b tthe cast reunited for the 25th anniversary
CULTURE Theater
No campfire singalongs? The love that the whole cast and crew had for the process is evident throughout the book. Elwes says the experience felt almost like “theater camp,” a mood set by Reiner himself. “He set the tone by being so fun, so nurturing and being an actor himself,” says Elwes.
See Elwes in person on Oct. 17 at the Brattle Theatre at 40 Brattle St. in Cambridge at 6 p.m. / MIRANDA PENN TURIN
at the Lincoln Center, which didn’t give him quite enough time to share the full experience of working on the film, but was a reminder of how much fan interest there is in any hint of trivia about it. “We
all get asked, every one of us, by fans, what it was like all the time,” Elwes admits. “I thought now is a good time before my memory starts to fail to try and jot it all down and share it with the fans.”

Reintroducing ‘The Flash’ New shows. The speedy DC Comics superhero gets his own show (with a little help from “Arrow”). For Grant Gustin, winning the role of Barry Allen/The Flash was, well, kind of like getting struck by lightning and becoming the fastest man in the world: It was a life-changing event that placed him in the spotlight, for better or worse. “This is my fa-
vorite character I’ve ever gotten to play thus far in my young career,” says Gustin, who had recurring roles on “90210” and “Glee.” “I’m having the time of my life.” There are the obvious upsides (playing an iconic superhero), and the inevitable downsides (overprotective fans of the original comic book character). But Gustin and the crew behind The CW’s “The Flash” aren’t new to this arena. Gustin was introduced — and well-received — as Barry in Season 2 of “Arrow,” the network’s series about the adventures of that DC character. “The Flash” ex-
ists within the “Arrow” universe, and crossover episodes are planned for this year. Still, none of the hype would matter if the show and its characters didn’t stand on their own. So it’s a good thing Barry is so likable. “He’s just so endearing. He’s so sweet. He’s curious,” Gustin says of his forensic scientist-turned-crime-fighter. “He’s a nerd … and now he’s a superhero. “Now he has these powers and he can use them to help other people. There aren’t that many better characters out there to play.”

Zita West: Baby food Your fertility. A celebrity baby guru explains what goes into a healthy pregnancy. “Eat Yourself Pregnant might sound like a step-by-step guide to creating a food baby, but it is in fact a new book by the so-called “fairy godmother of fertility, Zita West. Over the past 30 years, the Londonbased midwife has helped thousands of women — including Princess Diana, Cate Blanchett, Kate Winslet and Stella McCartney — through conception, pregnancy and birth. West’s “baby bible offers 80 recipes to get your body ready for the bump. We asked her to tell us a little more about the nutritional theory behind her meals.
You both are what you eat
“When you are trying to conceive, perhaps the saying ‘you are what you eat’ should read ‘you both are what you eat.’ The maturing egg, sperm, endometrium (womb lining) and fetus depend upon nutrients for development. If the diet contains too many environmental endocrine-disrupting chemicals (like trans fats, refined sugars or excess additives) — or if it’s depleted of nutrients altogether — then fertility can be significantly affected. “Most women have problems balancing their blood sugar and are ruled by their moods, foods and hormones during their reproductive years. Imbalanced blood sugar plays havoc with fertility and hormones, so slow-releasing carbohydrates can help. “Other habits, such as eating on the run, leave a lot of women with digestive problems because they are not absorbing nutrients properly. Another feature of modern lifestyles is stress. Stress robs the body of essential nutrients needed for hormone produc-

tion. “Protein, fats and carbohydrates are needed for the healthy reproduction of sperm, eggs and the embryo. Fruit and vegetables are necessary to protect against free radical damage to which eggs and sperm are sensi-
tive. There are too many food fads today that exclude key nutritional building blocks, including low-fat foods and processed foods.
Weight matters “Being underweight or overweight both cause issues. Some women who are underweight have given up completely on carbohydrates, but this is not the way to go. You need carbs for energy, and many women are overwhelmed by how they crave carbs in early pregnancy. “Being overweight is now known to be a risk factor for infertility, IVF failure, miscarriage and problems in pregnancy. Many IVF clinics will not allow a client to undertake an IVF cycle unless they have a BMI below 30, as the risk of failure is so high. Many people find it difficult to access the right dietary information and, in their haste, will often put themselves on unhealthy weight-loss regimens.

“Being underweight can affect your health and fertility just as much as being overweight. Studies have shown that even small changes in body weight (loss of 5-10 percent of ideal body weight) may be associated with alterations in the menstrual
cycle and infertility as well as lack of bone density, and the quality of estrogen depends on how much body fat you have.

I have one very simple question: Why the hell are we letting people who have contracted Ebola overseas back into the States!? It is the most asinine thing I have ever heard. Why would we risk the lives of this entire country by taking all these different people to different hospitals in different states. It’s absolutely ridiculous. Animals, plants, etc., are all quarantined for a 21-day period after leaving other countries, especially countries filled with virtually

Jaguars sorry for mascot’s Ebola sign The Jacksonville Jaguars organization apologized for a mocking sign that their mascot, Jaxson de Ville, held up in the fourth quarter of the Jags’ game against the Steelers Sunday. The sign read “Towels carry Ebola,” poking fun at the “Terrible Towels” Steelers fans often wave. “Improvisation and humor have both been key elements to the character of Jaxson de Ville,” Jaguars president Mark Lamping told ESPN. “On Sunday, the person who has played Jaxson de Ville over the past 20 seasons made an extremely poor decision in that regard.”

Kings (46-28-8) History isn’t on their side since the last team to repeat as Cup champion was the Detroit Red Wings back in 1998. Still, there has to be a repeat winner at some point and the Kings are in very good shape heading into the 2014-15 season. It’s going to be tough to knock off a team with established stars like goaltender Jonathan Quick, center Anze Kopitar and defenseman Drew Doughty. Supplement that crew with a clutch performer like last year’s playoff MVP Justin Williams and this team could very well do it all again this coming spring.

Ducks (54-20-8)
Sharks (51-22-9)
Flyers (42-30-10)
Stop us if you’ve heard this before: a favored Bruce Boudreau team fell short in the postseason. Yes, it happened again last spring as the Ducks lost to their Southern California neighbors, the Kings, in the second round.
This feels way too high for a team that pulled off yet another monumental choke job, losing to the Kings in the first round after owning a 3-0 advantage. It’s unfathomable as to how Joe Thornton and Patrick Marleau remain Sharks.
The Flyers have been stuck in neutral the past few years. They’ve made the playoffs from time-to-time, but have not done much once they get there. They will again only go as far as Claude Giroux will take them.

Jackets (43-32-7)
This feels like a big year for the Penguins, in the sense that they haven’t done all that much in the last few postseasons. Christian Ehrhoff should help their shaky defense and better health for Pascal Dupuis is key.
The Blues are another team that always look better on paper than on the ice. Trading for Ryan Miller was the right move at the time, but it never really panned out for the organization. It’s now Jake Allen’s show in the St. Louis net.
Coming into the season without Nathan Horton and Boone Jenner thanks to injuries it means that Columbus could struggle in the early-going. Goaltender Sergei Bobrovsky will have to pick up his game for the short-handed club.

Avalanche (52-22-8)

Red Wings (39-28-15)
The Blackhawks are still the most talented team in the NHL not named the Kings and they return a star-studded roster (Patrick Kane, Jonathan Toews, Ducan Keith, etc.). They’ll be motivated, coming off a loss in the conference finals.
Making the Cup Final last season may have been a fluke, but what else do we have to go on at this juncture? Henrik Lundqvist played the best hockey of his career and the Rangers grinded out wins over Philly, Pittsburgh and Montreal.
For our money, the Avs are the best young team in the NHL. The presence of veteran Jarome Iginla can only help the likes of Nathan McKinnon, Ryan O’Reilly, Matt Duchene and Gabriel Landeskog reach another level of play.
This might be a shot in the dark, but we think a healthy Steven Stamkos and Ben Bishop make Tampa Bay a legitimate contender in the East. The Lightning can’t wait to get left wing Jonathan Drouin into the lineup as well.
Detroit is a proud team with many holes. Injuries to Pavel Datsyuk and Henrik Zetterberg before the regular season has even started have lowered expectations. Gustav Nyquist and Tomas Tatar will need to develop quickly.

Bruins (54-19-9)
Canadiens (46-28-8)
Wild (43-27-12)
Stars (40-31-11)
Predators (38-32-12)
The President’s Trophy winner from last season, the Bruins had no excuse for playing so poorly against Montreal last spring. The majority of the team returns, although replacing Jarome Iginla’s production will be a major issue.
The Canadiens were primed to advance to their first Stanley Cup Final since 1993 after beating the Bruins, but they fell apart against New York. Still, with Carey Price and P.K. Subban returning, this team will again be elite.
The Wild probably went about as far as they’ll ever go in the loaded West last season, losing in the second round to Chicago. Thomas Vanek should really help matters, since they historically struggle to put the puck in the net.
The Stars took the first step back to relevancy last season by simply making the postseason. Expect Tyler Seguin and Jamie Benn to rack up the points while ex-Senator Jason Spezza figures to benefit from a change in scenery.
We’re betting on a healthy Pekka Rinne turning around Nashville. Also, Seth Jones is going to improve and Shea Weber is still one of the top defensemen in the league. As usual, scoring will be an issue in Nashville, however.
NFL. Brady says he still has input on play calls Tom Brady dismissed an ESPN report that said that there’s tension between he and the Patriots coaching staff. “I’ve always had input and there’s not one play that’s ever been called in the game that I’ve said, ‘Look, I don’t want to run that play or that’s not the way it works,” Brady told WEEI’s “Dennis & Callahan.” METRO

Pats respond well to success NFL. The Patriots face the Bills in upstate New York this Sunday with first place in the AFC East on the line. When the Patriots are clicking and are playing with the type of intensity that they exhibited Sunday night at Gillette, there’s little doubt they can beat any team in the league — Seattle and Denver included. Sustaining that level of play week-in and week-out will be next to impossible going for-
ward, but it will be interesting to see how the Pats respond to great success after responding so well to great failure. First place in the AFC East will be on the line this coming Sunday (1 p.m., CBS) in Orchard Park, New York, when the Pats and Bills tussle. Buffalo has impressed so far this season, beating the Bears in Chicago in Week 1, beating the Dolphins in Week 2 and beating the Lions in Detroit this past Sunday. Buffalo’s losses came to the Chargers and Texans, two teams with a combined 7-3 record so far this season. The Patriots have fared well
Clearing up The Patriots upcoming schedule doesn’t seem nearly as daunting after they took care of business against Cincy. •
New England is at Buffalo before coming home for a Thursday-night date with the Jets on Oct. 16. They host the Bears the following week, on Oct. 26.
•
The Patriots’ next three opponents have a combined record of just 6-9 this season.
