Dzhokhar Tsarnaev will have the opportunity to address the court on Wednesday before he is formally sentenced to death, but the question is, will he take the opportunity to speak? The 21-year-old convicted terrorist has only opened his mouth to make a plea of not guilty since his arrest for the heinous bombing that took the lives of three people and injured 264 others on April 15, 2013. Legal experts believe that he has nothing to gain from speaking out now — and that his lawyer will most likely advise him not to. “It is highly unlikely that he will speak and it will not do him any good if he speaks now. Any direct expression will sound disingenuous given his silence throughout the trial,” said Suffolk University Associate Law Professor Chris Dearborn. Dearborn went on to say that speaking out would accomplish nothing for his appeals going forward. “In theory, it could be beneficial if he was seeking commutation of his death sentence from the president. But I think it is more unlikely and almost impossible given the

Tsarnaev was found guilty this spring on all 30 charges against him, 17 of which carried the potential for the death penalty. He carried out the attack with his older brother, Tamerlan Tsarnaev, who was

later killed during a shootout with police in Watertown. Survivors of the attack and family members of the three people who died in the bombing, as well as the family of the MIT police officer who the pair shot dead three days later, will have an opportunity to speak at Wednesday’s formal sentencing.

Criminal Defense Attorney Harvey Silverglate said that most of the procedure will be fairly predictable seeing how many victims have already spoken. But this phase of the trial does allow for one unpredictable element: the judge. George O’Toole will have the chance to speak his mind for the first time throughout the duration of the trial. “It’s obvious that the judge has been pro prosecution and pro death penalty,” Silverglate said. “He’s not constrained by the expectations of law protocol in his remarks during the sentencing.” Tsarnaev is set to be put

to death by lethal injection in the U.S. Penitentiary in Terre Haute, Indiana. But the judge’s sentencing doesn’t mean Tsarnaev, 21, will face imminent death. Defense attorneys will likely appeal the sentence, a process that can take years. “This is the first death penalty sentencing in our collective memory, but we know the end result even if we don’t know whats going to take place,” Silverglate said. “It’s a bit like a three-act play with a conclusion the audience knows in advance.” NATE HOMAN and CHRISTINA BEIENE nate.homan@metro.us

Counterfeit. Medford man gets 3 years for making fake T passes

A Medford man pleaded guilty to charges of forging 3,000 counterfeit MBTA passes, an operation that earned him more than $60,000 and ripped of an estimated $225,000 from the T. Casey Kolenda, 28, pleaded guilty in Middlesex Superior Court on seven counts of counterfeiting. Judge Thomas Billings gave Kolenda three years in state prison and three years probation. “This scheme resulted in significant revenue loss for the MBTA and was patently unfair to riders who paid the full cost

of their transit passes,” Attorney General Maura Healey said in a press release. “Schemes such as this one, in which an individual commits crimes for personal gain at the expense of the public, will not be tolerated.” T police started investigating when they found hundreds of unauthorized tickets in use on the train and bus lines in August 2013. They tracked down multiple legitimate monthly LinkPasses used to create hundreds of bogus tickets and found Kolenda. He’d created fake

$70 monthly passes between October 2013 and March 2014 by copying the electronic data stored on the LinkPass magnetic strip. He then downloaded the magnetic strip data of hundreds of T stored-value cards and applied contact paper with encoded data that would allow users to get through the fare gates without any issue. The T estimates that Kolenda is responsible for more than 3,000 counterfeit MBTA passes in circulation from October 2013 through March 2014. NATE HOMAN

State’s first pot shop

First medical pot dispensary opens Wednesday Massachusetts is set to welcome the opening of its first marijuana dispensary on Wednesday. The Salem dispensary, called

Alternative Therapies Group, will be the first of its kind in the state following a successful bid in 2012 to legalize medical marijuana possession for qualified patients. Gov. Charlie Baker issued a one-time, temporary threemonth waiver to ATG on Friday.

The dispensary asked for the waiver after delays in getting state laboratories ready to conduct quality tests. “Patients have waited to access marijuana for medical purposes for far too long,” Baker said in a statement. SPENCER BUELL

Gridlock. A construction snafu has commuters bracing for traffic problems in Somerville. If a building almost collapses on Davis Square and there’s no bike-riding hipster with a waxed mustache, jorts and a neon kale T-shirt, did it happen? The answer isn’t a joke. Portions of Somerville’s congested crossroads have been closed down after construction at the old Social Security office, at 240 Elm Street, was deemed unsafe due to a structurally compromised wall that was not attached properly to the roof framing. Until the proper shoring is installed, the wall could collapse at any point, authorities said. Construction on the site has stopped, and the well trafficked area is now in danger of further gridlock. The city closed off Elm

Bid Paris enters race to host 2024 Olympic Games Paris on Tuesday officially announced its bid to host the 2024 Olympic and Paralympic Games and bring the global sports event back to the French capital for the first time in a century. Paris, which narrowly missed hosting the 2012 Olympics, now begins a two-year selection process in which the world’s most visited city will

face off against the likes of Boston, Hamburg and Rome, which lost out to Paris in 1924. “Paris 2024 promises a feasible and flexible Games concept,” French National Olympic Committee (CNOSF) head, Denis Masseglia, said. His team and others had flagged a Parisian bid for months. The International Olympic Committee (IOC) will announce the candidate cities that made it to the shortlist in 2016, before voting for a winner in the summer of 2017. French President François Hollande welcomed the move. “The state will make every effort to ... support this candidature which will be exemplary on the environmental, economic and civic front,” he said in a statement. “It is a unique moment for a whole generation to come together and show the world France at its best.” However, Paris’ Olympic plan took some time to emerge. One of the main suppliers of a toxic alcoholic brew that killed 102 people and sickened 40 others in the slums of Mumbai has been arrested. Deputy Commissioner of Police Dhananjay Kulkarni identified the primary bootlegger as Mansur Latif Shaikh, according to a One India report. “The government has ordered a probe under the chief secretary to inquire into the deaths caused in the unfortunate Malwani hooch tragedy and submit the report within three months,” a government spokesman said. The government is also considering harsher laws to deal with illegal booze sellers.

Searchers comb resort after two tornados hit Illinois Searchers with rescue dogs combed through a large lake resort west of Chicago on Tuesday, looking for people who might be trapped after a tornado toppled trailers and recreational vehicles, state officials said. On Monday night, a tornado tore through Woodhaven Lakes campground in Lee County, a two-hour drive from Chicago, Gov.

Bruce Rauner’s office said in a statement. Another tornado then hit the village of Coal City 55 miles away, injuring a handful of people and damaging some 30 homes and businesses, officials said. The Woodhaven Lakes campground, near the town of Sublette, has more than 6,000 sites but many were unoccupied on Monday evening, according to a nearby business owner. “We’re very fortunate that it wasn’t on a weekend or a big holiday,” said Cynthia McCoy, who owns a nearby restaurant. South Carolina lawmakers voted to open debate on Tuesday on removing the Confederate flag from the State House grounds in the aftermath of last week’s massacre of nine African-Americans at a historic Charleston church. Both chambers of the legislature voted overwhelmingly to take up the issue as hundreds of people, chanting “Take it down,” rallied outside the capitol building in Columbia, about 120 miles from Wednesday’s shooting. The Senate will consider a similar measure. The Civil War-era flag of the pro-slavery Confederacy has become a lightning rod for outrage over the attack and the racist motives that apparently lay behind the shooting. “Cultures and generations change. No one should have any association with something that is used as an excuse to take nine lives just because of different skin color,” said Vincent Sheheen, a Democrat who has served in the South

Carolina Senate for more than three decades. Federal authorities are investigating the massacre at Charleston’s Emanuel African Methodist Episcopal Church as a hate crime. The accused gunman, a 21-year-old white man now charged with nine counts of murder, had posed with a Confederate flag in photos posted online with a racist manifesto. One of the most prominent U.S. flag makers, Valley Forge Flag, said on Tuesday it would stop manufacturing and selling Confederate flags. We’re officially into summer, which means many shows are off for a few months. Instead of plowing through our Netflix binge-watch list, we’re brainstorming ways to shake up our favorite shows. Let’s start with the Zooey Deschanel-led “New Girl.” The show has taken some odd turns over the years, partly because it’s locked into place by its premise: A kooky woman moves in with three dudes. Here are three ways the show can get its groove back.

Stop messing around with Schmidt

We have no interest in revisiting the Schmidt who dated two girls at once in Season 3, and we’re a little anxious that he and Cece jumped straight from friends to engaged. Let’s see the relationship actually work out for them.

No more Nick/Jess

Last season ended with hints that the duo might reunite at some point, and while we enjoy Nick the romantic

lead quite a bit, we don’t need our hearts broken again.

Change up the loft

Interview. The star of “A Little Chaos� reveals how she chills out her fellow actors. Believe it or not, “A Little Chaos� is Kate Winslet’s first full-blown costume drama in over a decade. Her last film involving corsets and puffy dresses was “Finding Neverland,� in 2004. “I was excited to do that period,� she says. “It’s like, ‘Oh, back to basics. I remember what this feels like!’ Then after a day I was like, ‘Oh god, I remember what this feels like.’� In the film she plays Sabine de Barra, a woman (alas, fictional) commissioned to design a garden at Versailles for Louis XIV (Alan Rickman, who also directed).

On her gardening skills: “Oh, I don’t have any. So I’ll be happy to talk about my gardening talents, which don’t really exist, truth be told. I’m just not very good at it. I love gardens, and I’d love to be a gardener. Every year, I say I’m going to learn French and I’m going to learn to garden properly. And then the next year comes around and I say, ‘Right, this year I’m going to learn French and learn how to garden properly.’ I can sit here and say, ‘This year, I’m going to learn.’ And I’ll just keep on not doing it.�

On telling director

Alan Rickman she was pregnant: “I told him the second day of filming. I thought, get the first day out of the way, because it was so stressed. I was nervous to tell him because, even though I knew he’d be really excited, at the same time I knew he’d be like, ‘Oh, f—.’ I called him into the trailer and I said, ‘I really don’t know how to say this, so I’m just going to say it really quickly: I’m pregnant.’ He went [lowers head], ‘Right.’ I said, “But look, it’s completely fine, I’m completely with it, we just have to carry on. You might just have to accept that my boobs are going to get massive.’ And he was like, ‘I think I can cope with that.’ [Laughs]

On relaxing fellow actors on set:

I was a smoker: I used to sit down and pull out my roll-up cigarettes, which was my quirky thing I used to do. Then I would visibly see people go [sighs], and they’d relax and say, ‘Oh, she’s normal.’ And one by one they’d say, “Actually, can I have one of those?’ I haven’t smoked for quite a long time, so that’s gone. But what I do have in its place is I have a pencil case, and it’s got a little cartoon figure on it, and it says ‘Poo,’ and this person is squatting. That’s my relaxation tool. Following in the footsteps of the farm-to-table movement, Great Performances — a catering and events company that sources its produce from its farm in upstate New York — is all about using local flowers to create beautiful arrangements, something they’ve dubbed “farm-to-vase.” “Just as eating farm-totable has been sort of a macro-trend over the past decade, we’re finally seeing that transfer over to flowers, too,” says Josh Tierney, the entertaining and decor expert at Great Performances. Not only is using local flowers more sustainable and community minded, he says, but it’s also cheaper than buying flowers imported from Europe or South America. Tierney shows us four simple ways to incorporate farmer’s market blooms into our next summer soiree.

Potted herbs

It’s all in the details

Add wholesome charm and avoid the “What do I do with these?” centerpiece dilemma by displaying potted herbs. Bonus: Guests will be glad to take them home as party favors. “It’s this idea of recycling the decor— having something that lives on that you can use to cook with,” says Tierney, who suggests potting clusters of rosemary, basil, thyme and oregano. These can also be styled to fit any event whether rustic or modern. “You can do them in recycled cans like we’ve done, in terracotta pots or in all sorts of funky flea market vessels,” he says.

One way to fool guests into thinking they’re dining at a five-star restaurant: Ditch the parsley and use edible flowers as garnish, or use them to dress up a summer beverage. “You can grow edible summer flowers in your garden, or those without the yard space or green thumb can purchase edible flowers at places like ShopTerrain. com,” Tierney says.

Teacups make adorable vases

Teacup flowers work really well as a centerpiece for a food platter or, as Tierney suggests, placed down the center of a long table at a wedding, a brunch or, fittingly, a tea party.

Whether you’ve had grandma’s heirloom china stored away in a cupboard or you’ve amassed your own mismatched collection from flea market hunts, just clip some roses or peonies to add instant elegance to your summer soiree. Worried that it might look like your 3-year-old nephew just slipped some flowers into a party-goer’s teacup? The trick is to make these arrangements look purposeful, explains Tierney. Here’s how: Take some clear Scotch tape and make a grid across the teacup.

Fill the cup with water, and then place the stems into that grid. “That gives you a bit of control when you’re composing the arrangements,” he says.

Spread the love If a typical floral centerpiece seems a bit dated to you, scatter bud vases around the table instead. “You get what looks like all these single flowers just growing out of the table,” Tierney says. This idea is perfect for family-style meals, a recent trend in entertaining, because it frees up room that would otherwise be occupied by a traditional centerpiece.

Tierney’s picks Sunflowers: “They’re really hardy, big and beautiful. You can always find them at the green market, and they last a while. I even love when they start to die — they just remind me of a Van Gogh painting.” Zinnias: “I love using zinnias because they’re hardy and can withstand the heat. Also try marigolds and cosmos!” Peonies: “The bigger and more open they are, the more beautiful they are. They have a very short window of blooming, so now’s the time to enjoy them.”

As much as Ava Theater District, which is now in its initial opening phase on Stuart Street, is situated in the thick of things downtown, it’s also designed to have its own internal community life. A private one, which only residents or their guests might experience. “It’s what we call activating social,” says Michael Roberts, senior vice president

of development at AvalonBay Communities. “That means it is open plan with gathering spaces for people to get together outside their apartments.” The four-story Ava Theater District has 398 apartments and, sitting right next to one of Boston oldest establishments, Jacob Wirth, its modernism stands in stark contrast. Still, with Boston’s downtown now a mostly pleasing mix of old and new, it doesn’t look out of place. Some tenants have moved in already, and that’s before the rooftop Sky Pavilion is even finished. “The Sky Pavilion will be the residents’ lounge,” Roberts says. “It will be an indoor-outdoor space with a patio with great views look-

ing over the city and right over to the Blue Hills.” Ava is national developer AvalonBay’s new, more youthful brand, which is specifically designed with a funky edge. “Ava is geared toward millennials,” says Roberts. “Our core customer is the twenty- to thirtysomethings who want to live in the city and be near everything.” This location delivers. Ava Theater District is minutes from Boston’s major theaters and many entertainment venues. It’s also a short walk to the Public Gardens and the Common, it’s on the edge of Chinatown and Downtown Crossing and it offers a pleasant walk to the Rose Kennedy Greenway and the waterfront. But for all that, Roberts says his favorite thing about the building is the entrance lobby. “I just love it,” he says. “We built an interior forecourt with a water feature, which gives a real special front-door experience. We had a unique opportunity to create something special and we did just that.”

Pricing Living in the heart of town doesn’t come cheap. Pricing at Ava Theater District is based on floor location and views: the higher up and better the view, the more expensive the rent, of course. Studios range from 474 to 666 square feet and have a monthly rent of $2574 to $3905; one-bedroom apartments range from 557 to 922 square feet and go from $2874 to $5250; and twobedroom apartments are from 798 to 1,400 square feet and are priced from $3780 to $9000.

It’s time to consign the Confederate flag to a museum I struggle with how it is permissible, or legal, to have the symbol of the Confederacy flying on a public building. Beyond the painful racial implications, this flag is a symbol of a challenge made to the sovereignty of the United States. First, a civil war was

Gronk making smart financial choices Rob Gronkowski is known for his pass-catching abilities, his separation from defenders and his off-the-field partying — and apparently now his financial management. You read that right. In his upcoming autobiography titled “It’s Good to be Gronk,” the 26-year-old speaks of how he has not spent a dime of the $16.3 million he has earned in his five years in the NFL. Gronkowski backs his statement by writing that he lives off of his endorsement money and doesn’t blow it on expensive cars, jewelry or tattoos. He even goes on to say that he still wears his jeans from high school. If Gronkowski continues to take his own advice and abide by his investment strategy, he could have enough to buy the entire state of Massachusetts a pair of jeans.

Nguyen has had puzzling 2015 season so far for Revolution MLS. The New England Revs will need to get more from Lee Nguyen if they expect to play to their peak potential this season. Being comfortably situated in second place in the JV Eastern Conference (where only two of the 10 teams are above .500) has masked many issues on the Revolution (6-5-6) so far in the 2015 regular season. Near the top of that list has to be the mysteriously poor play of their star midfielder Lee Nguyen. You’ll recall that Nguyen was the runner-up for MLS MVP last season after he exploded for a career-best 18 goals and five assists while helping to lead New England to the 2014 MLS Cup against Los Angeles. He had the assist on Charlie Davies’ pretty goal in Sunday’s frustrating 2-1 loss at D.C. United (9-5-4), but it was only his third assist of the season and he has just one goal in this entire campaign. “It’s obviously not what we wanted,” said Nguyen after the loss. “It’s just one

of those games where we’ve got to close them out and we didn’t. You let a team like D.C. hang around long enough, they’re going to find holes and that’s what happened.” It was the start of what,

potentially, could be a big week both for the Revs and Nguyen. They go to Columbus (4-6-5) on Wednesday (7:30 p.m., CSNNE), then host Vancouver (9-6-2) on Saturday (7:30, CSNNE), and additionally the 23-man ros-

ter for the Gold Cup (which includes a match at Gillette Stadium vs. Haiti on July 10) will be announced. Nguyen was named to the preliminary roster and he’s received many call-ups to the U.S. men’s national team since

his breakout season last year with New England. Nguyen has played in 15 matches (starting in 14 of them) and he leads the Revs in shots on goal (35), so it’s hard to explain why six guys on the Revolution have scored more goals than him this year. In fact, his lone strike came on a converted penalty kick way back on April 4 at Colorado (a 2-0 win by New England). He’s 28 years old, but this is only his fourth season in MLS, meaning that this should be the prime of his career. There are still four months left before the playoffs begin, so there’s plenty of time for Nguyen to figure it out. With him at his best, New England could finally end its Cup drought.
