MISSED WARNINGS IN COURT REFUSES TO REINSTATE TRAVEL BAN MANCHESTER CASE

A U.S. Appeals Court refused to reinstate the president’s travel ban on people from six Muslim-majority nations, delivering another blow to the White House in a legal battle likely headed to the Supreme Court. In its 10-3 ruling, the U.S. 4th Circuit Court of Appeals said those challenging the ban were likely to succeed on their claim that the order violates the U.S. Constitution’s bar against favoring

one religion over another. The decision, written by Chief Judge Roger Gregory, described Trump’s executive order in forceful terms, saying it uses “vague words of national security, but in context drips with religious intolerance, animus, and discrimination.” The court questioned a government argument that the president has authority to halt the entry of people to the U.S. For more, see page 9. The Manchester bomber slipped through the cracks despite being reported to authorities multiple times, the Telegraph reported. The reports compiled include: Five years ago, two friends of Abedi separately called a counterterrorism hotline after he reportedly said “being a suicide bomber was OK.” Two years ago, Abedi was banned from a Didsbury mosque after confronting an imam delivering an anti-

extremist sermon. The mosque reported him to authorities. Members of Abedi’s family contacted British authorities to report that he was “dangerous.” Authorities knew Abedi’s father (who was arrested in Tripoli while giving interviews to the media) was a member of the “Libyan Islamic Fighting Group.” Abedi was “known” to UK intelligence officials who were aware he had recently returned to the UK from Libya. One of Harvard University’s most famous dropouts, Facebook Inc founder Mark Zuckerberg, returns on Thursday to the Ivy League school to address its graduating class. The 33-year-old tech titan, who dropped out the college to found the pioneering social network company, has been on a nostalgia trip during the week leading up to Harvard’s commencement. On Tuesday, he livestreamed a visit to

the dorm room where he started the website he initially called “thefacebook. com,” made available just to his classmates. “This is literally where I sat. Video showing the leaders caught Trump pushing his way past Prime Minister Dusko Markovic, then confidently adjusting his suit as he emerged in the front of the group, closer to NATO head Jens Stoltenberg. Video of the incident went viral and came as Trump delivered a tough message to NATO allies to dramatically increase their defense spending to ease financial burden to the United States. ZUCKERBERG RETURNS AS COMMENCEMENT SPEAKER

Montana Republican congressional candidate Greg Gianforte was accused of physically assaulting a reporter on the campaign trail on Wednesday, on the eve of a special election to fill the state’s lone seat in the U.S. House of Representatives. Ben Jacobs, a political correspondent for the U.S. edition of The Guardian newspaper, said in a Twitter post that Gianforte had “body

slammed” him, breaking the reporter’s eyeglasses, at a campaign event in Bozeman. Gianforte’s campaign issued a statement saying a physical confrontation with Jacobs occurred when the reporter entered the candidate’s office “without permission, aggressively shoved a recorder in Greg’s face and began asking badgering questions.” REUTERS

Whether it’s a foot fetish or just a fantasy, footjob videos are searched

for more in New York than any other U.S. city, according to data from Pornhub. The world’s largest porn site dove into their database to dish the most popular porn searches, categories and porn stars in New York, Boston and Philly — and we have the scoop. Out of these three cities, New York alone

finds toes tantalizing and searches for footjobs 110 percent more than the rest of the country. When they’re not playing footsie — sorry, we had to — New Yorkers are busy searching for “MILF” and “step mom” videos, proof that they’re not immune to nationwide trends in porn searches. Pornhub

revealed that searches for “MILF” spike on Mother’s Day, and the two mom-centric terms also rank high in both Boston and Philly. The most frequented porn categories as well as porn searches in New York emphasize the city’s broad diversity. “When compared to the rest of the United States,

Categories are no different: “Indian,” “Brazilian,” “Latina” and “Arab” all see a surge in popularity of more than 35 percent over the national average. Perhaps not surprisingly, size seems to matter on all fronts for Pornhub users in The Big Apple: “Big Dick,” “Threesome” and “Big Tits” all rank among the most popular porn categories in New York. Sorry, New York, you have the size but not the stamina. That award goes to Philly; Pornhub users in the City of Brotherly Love sure have a thing for the ladies, and their average watch time is a full 8 seconds longer than the site’s average of 10 minutes and 26 seconds.

Although Boston consciously navigates to feminist porn 20 percent more than the rest of the country by clicking on the “femalefriendly” category, New Yorkers might be more into feminist porn than they know. Three prison guards sexually assaulted female inmates Three male prison guards repeatedly sexually assaulted and raped several female inmates under their supervision at a federal detention center in New York over time periods of up to three years, federal prosecutors said on Thursday. The guards, who face multiple charges stemming from grand jury indictments that followed a year-long investigation, were arrested and were to be arraigned Thursday in federal court in the city’s Brooklyn borough, prosecutors said. Acting U.S. Attorney Bridget Rohde submitted documents asking a federal magistrate to deny bail for the three guards until

their cases come to trial. “By using their authority and power to prey upon and abuse female inmates in their care, these defendants violated their oaths of public service as well as numerous criminal laws,” said Rohde. The charged guards are Carlos Martinez and Eugenio Perez, both of whom are lieutenants, and Armando Moronta, an officer at the U.S. Metropolitan Detention Center in Brooklyn. Lawyers for the defendants could not immediately be identified. Martinez, 47, faces 20 charges of sexual abuse, aggravated sexual abuse, sexual abuse of a ward and deprivation of civil rights, and could be sentenced to life in prison if convicted. REUTERS

In the 100-plus years since

World War I began, more than 645,000 men and women have given their lives to defend the United States in conflicts across the globe. While Americans honor those who have served or are serving in various ways, one of the universal symbols of remembrance is a red poppy flower, which originated in 1918

with Moina Bell Michael. Michael, a humanitarian and college professor, was inspired to always wear a poppy in memory of those who lost their lives in the Great War by the opening line of John McCrae’s “In Flanders Fields” war poem: “In Flanders fields the poppies blow / between the crosses row on row.”

Today, the poppy remains an iconic military symbol, one that is going digital thanks to a partnership between the United Services Automobile Association (USAA), the Veterans of Foreign Wars (VFW) and the American Legion Auxiliary, whose inaugural National Poppy Day falls on May 26. “Leveraging the

New York is known for having a world-class food scene, and the city’s infamous food trucks are just as much a part it as multi-star restaurants. Like their brick-andmortar brethren, food carts are subjected to health inspections, but only restaurants must publicly post their sanitary grades. Until now, that is, thanks to a vote this week by the City Council Health Committee. According to the unanimous vote, food trucks are now required todisplay their letter grades. “Everyone who handles food should be subject to the same rules,” City Councilwoman Karen Koslowitz of Queens told the New York Post. “People have a right to know if the [eating] conditions are really sanitary.” Koslowitz, a Queens Democrat, told the Post she sponsored the bill in

February after she saw vendors serving food past midnight in her neighborhood in Forest Hills. “Do they wash their hands? It’s something the public has a right to know,” she said. Since there was no opposition to the bill, both from the public and food truck vendors, it passed but still needs to be signed into law by Mayor Bill de Blasio. Then, it will take effect within 270 days. “A vast majority of street vendors support a letter grading system, since it brings increased legitimacy to their businesses. With this more transparent system in place, consumers will have fewer worries about their food being unsafe when they pick up a falafel, a hot dog or a taco on the go,” Democratic State Sen. CAN’T TOUCH THIS I didn’t think we’d have to go over this again after kindergarten, but apparently, I was wrong. What are the rules? Play nice. Do your own work. Wait your turn. No sharing secrets with the Russians. And – most importantly – keep your hands to yourself. This last point has become an issue lately. Let’s review: In Montana, a congressional candidate allegedly body-slammed a reporter, sending the guy off for Xrays while the police came to charge the candidate with misdemeanor assault. Before the set-to, a major issue there was land use, now it’s hand use. As my colleague Brianna Keilar tweeted, “Remember the good old days when political reporters could only expect a threat to be broken in half and thrown over a balcony?” (And yeah, a few years ago, that happened too.) Considering the population of Markovic’s whole country is about 700,000, this is like the Leader of the Free World roughing up the mayor of El Paso. I won’t get into President Trump’s knuckle-cracking handshake with France’s Emmanuel Macron, or

The decision, written by Chief Judge Roger Gregory, described Trump’s executive order in forceful terms, saying it uses “vague words of national security, but in context drips with religious intolerance, animus and discrimination.� The White House de-

clined comment and referred questions to the U.S. Justice Department, which did not immediately respond to a request for comment. The administration had said the temporary travel ban would prevent terrorist attacks. In its 10-3 ruling, the U.S. 4th Circuit Court of Appeals said challengers of the ban, including refugee groups and individuals, were likely to succeed on their claim that the order violates the U.S. Constitution’s bar against favoring one religion over another.

The case could be appealed to the U.S. Supreme Court, which could make the final decision. The government could also file an emergency application seeking to put the order into effect while the litigation continues. Gregory cited statements by Trump during the 2016 presidential election calling for a “Muslim ban.� The judge wrote that a reasonable observer would likely conclude the order’s “primary purpose is to exclude persons from the United States on the basis of their religious beliefs.� The government had argued that the court should not take into account Trump’s comments on the campaign trail since they occurred before he took office on Jan. 20. But the appeals court rejected that view, saying they provide a window into the motivations for Trump’s action in government. REUTERS

Stealthing, a form of sexual assault in which a condom is removed or tampered with during sex without consent, is growing as a practice, and lawmakers are not only taking notice but are also striving to make it a punishable crime. New York Assemblyman Francisco Moya of Queens is one such legislator. He is introducing a bill that would make stealthing a felony. “After recent media coverage brought it to my attention, I looked at our current penal law and found that there really wasn’t any explicit language classifying this type of assault,� Moya told Metro via email. “Especially because this phenomenon is so unknown to so many people, it’s important to give prosecutors and judges clear direction. My legislation amends the section of law to put stealthing right next to

sexual contact without consent, which is a class E felony with a prison sentence of up to four years.â€? Under Moya’s bill, a person can be charged if they remove or harm a condom or other preventative device like a sponge or diaphragm that they initially agreed to use prior to having sex. Victims of stealthing, which can result in a sexually transmitted disease or an unplanned pregnancy, might not even know they’ve been assaulted, which was a primary driver of the assemblyman’s proposal. â€œBecause this type of assault is only just now getting the coverage it deserves, there are still many victims who have been unsure of what to think about their own experience and have been suffering in silence,â€? Moya said. “By making it explicit in our court system that this is rape, we send a clear

message to everyone who has committed or has thought about committing this crime, and hopefully encourage more victims to come forward to hold their attackers accountable.â€? Moya is searching for a sponsor for the bill within the state Senate before the legislative session ends in less than a month, the New York Daily News reported. Should Moya’s bill eventually pass, New York would join California and Wisconsin in attempting to criminalize stealthing. “This is rape. This is nonconsensual sexual assault. We need to call it what it is,â€? Melissa Sargent, a state rep from Wisconsin who introduced a bill there this month, told NBC Los Angeles last week. California state Rep. Cristina Garcia proposed her stealthing bill last week. “It’s becoming common enough that we have to look for legislation that handles this issue before it becomes out of control,â€? Moya reiterated to the Daily News. “Like with any rape case, it would be on the prosecutors to determine what happens through the use of evidence and testimony.â€?Â

when he largely worked on the stage. “I spent a lot of time in the early part of my career in the theater,” Rush recalls. “A lot of that time I was in companies, working with the same writers and directors and actors. You don’t get that a lot in film. But on a big saga like these five ‘Pirates’ films, you do get a chance to go back and get to know people.” The latest “Pirates” isn’t Rush’s only highprofile gig right now. His show “Genius,” in which he plays Albert Einstein, is currently in the middle of its first season on the National Geographic channel. It arrives at a miserable time for much that the brilliant mind stood for — when leaders and large parts of the public question scientists, when they deny climate change, when

people like Michael Gove say we should stop listening to “experts.” “Even as we were shooting it, we could feel the rise of nationalism in certain parts of the world. There were so many strong echoes with what was going on now and the totalitarian states in Europe between the wars,” Rush explains. We need more Einsteins right now, Rush feels. “He was such a wonderful anti-hero to have moving through the landscape of late 19th century scientific and industrial development,” Rush says. “It was a thrilling time. The motion picture was invented, the motorcar was invented, they were discovering X-rays, there was Marconi. There was so much scientific development, all leading up to a tumultuous period of two global wars, all within a generation. It feels very relevant.” Not that we don’t have our own celebrity scientists today carrying on the good fight. “There’s people like professor Brian Cox from the U.K. and Neil deGrasse Tyson,” he says. “They’re creating very popular, no-holds-barred stories about the cosmos. Luckily, people seem genuinely fascinated by them.”

Linda Cardellini is deep into some family drama. The “Freaks and Geeks” actress heads into the third and final season of Netflix’s “Bloodline,” the Islamorada, Florida-set thriller about a tightly knit family unraveling after the black sheep, Danny (Ben Mendelsohn), returns home. In her turn as daughter Meg Rayburn, the “Mad Men” alumna plays a charming, yet tightly wound lawyer, who does her part to mend the rifts in the family while wrestling with her own demons. Since Danny met his fate, literally at the hands of the eldest son John (Kyle Chandler), in season one, siblings Meg and Kevin (Norbert Leo Butz) have tried to cover up and recover from the mess. But Season 2 closes with even more bloodshed. Heading into the show’s final 10 episodes, airing Friday, May 26, “there’s even more splintering of the family,” Cardellini tells us. “Where they were trying to survive together last season, now they’re trying to survive on their own.”

The 41-year-old actress calls in from Boston, where she’s filming the comedy “Daddy’s Home 2” alongside Mel Gibson, Will Ferrell and Mark Wahlberg — quite a departure from the intensity of “Bloodline.” In a way, Meg and Kevin betrayed John last season. Up until that point, at least, they were loyal to each other. That’s the fun thing about the show: It’s all about whose side you’re on. Because if you’re on Meg’s side or Kevin’s side, you could look at it like they were just trying to help [John] and they just kept going down this rabbit hole. For Meg, I think she really believes that she picked up the phone and helped her brother, and she didn’t kill anybody, but from an outsider’s perspective, she was very much an accomplice in everything. Where do they stand and how guilty are they? It weighs on their own moral center to figure out how they’re going to deal with it and live with themselves and with

each other. Danny was the scapegoat for them for a long time, and once he was gone, everybody points to the other as the reason their life is miserable. Meg does a good bit of drinking, especially this

season. What’s it like playing a lush? [Laughs] It’s always slightly daunting, but it’s really fun, too. She’s a mess and a lot of times she has feelings she can’t really cope with, so that’s her coping mechanism. It’s been in the family for a long time; the family drinks together a lot and on their own as

well. And there are varying degrees of it, too; times when she’s just a little tipsy and other scenes where she’s just sort of out of it, she’s so wasted. It’s trying to find degrees of how drunk she is. The setting is so key to the show. What was it like filming down there and how does the show reflect the culture of the Florida Keys? The Keys are a very fascinating place. On the one hand, it has this history of people hiding

out there after they do strange, nefarious things. And then it has this other part of it, this beautiful, heavenly, gorgeous, tropical paradise. Going there and being there over the past few seasons — it’s been beautiful. We’d have manatees come up to where we were living. And then it’s hot and it’s humid, and the sweat on us is all real. Living in a very sunny place and having really dark things happening … it’s the swamp meets paradise meets hell. [Laughs]

The turmoil that New York basketball fans have been enduring for now close to two decades could have ended last week at the 2017 NBA draft lottery. For the first time since drafting Kristaps Porzingis fourth overall in 2015, it looked as though the Knicks had a good chance at adding another promising neophyte to grow alongside the 7-foot-3 Latvian. This was going to be the moment the tides shifted for the Knickerbockers. So they sent in their former fifth-overall draft pick who was part of the last Knicks team to win an NBA Championship, Walt “Clyde” Frazier, in hopes he would bring them some good fortune. But who are we really kidding? The New York Knicks get lucky? Not this

There has been far too much off-court controversy that the Knicks have created for themselves over the past 17 seasons. Most of the problems are to blame on management. They have refused to commit to a serious rebuild, continue to waste their time with horrendous contracts and try to win by spending money. There is only one team that has time and time again proven that they can buy their way to championships in New York and that is the damn Yankees. It’s time the Knicks stop wasting money on so-called superstars, and acquire some draft picks and young players to rebuild the franchise with a winning identity. It’s time for management to stop being greedy and put some real stock in the guys on the court.
