A message from our President Dear MFDEA member and friends, As I write this article, I’ve just completed my first year as President of MFDEA. The year flew by as Cathy and I attended many district meetings, a leadership conference, NFDA Convention, and had several MFDEA meetings, spent much time at the state capital working on legislation and culminated the year with our MFDEA Convention in St. Charles. Thank you to Don, Cindy and Kathleen at the MFDEA office that do a great job with the day to day administration and also special thanks to our executive board Tom Hebner, John Moore and John Pautz and our MFDEA District Directors for helping make this a successful year. The 2015 MFDEA Convention was great and after speaking with some of the vendors and others, it seems we had a very successful convention and look forward to next year which will be the Tri-State Convention in Kansas City. Special thanks to Tom and Ginger Hebner and all who assisted. Remember that being a member of MFDEA has many benefits for you and your funeral home from legal forms, district meetings, special events and convention updates and other information, MFDEA magazine, free legal consultation and the opportunity to invest your preneed funds into Missouri Funeral Trust. As I write this we are disappointed that Governor Nixon has vetoed HB 618 which many of us worked very hard on this year. We are not sure why as the bill passed both houses easily, so we will plan to present the bill again during the upcoming override veto session, we will need all your help at the time, so watch for updates. Hopefully many of you will attend your upcoming area district meetings as they are scheduled and will plan to support Missouri by attending the NFDA Convention to be held in October in Indianapolis. It seems that many of us have had record rain this spring causing damage to many communities. I hope and pray that everyone has made it through all the storms without too much damage. We ourselves had a building flooded and are in process of putting it back together. Also as summer is upon us, I hope you can find time for your own family and get away together. Sometimes as owners we put our business and serving others ahead of our families. (Don’t let the opportunities pass you by, make a way for it to happen for your family and you). Thank you for being an MFDEA member and serving your families with care and sincerity. As we all work together to raise the standard of funeral service, one thing is for sure “We are Stronger and Better Together”.

Executive Director’s Report Who’s “In Charge?” In the past year a number of out-of-state companies have been doing funeralrelated business in Missouri. The methods and ways these companies do business vary. In some cases it is a cremation service that does all of its business on the internet. In some instances it is a “donate-your-whole-body” organization that reaches families through hospices or nursing home referrals. Some things seem to be the same for all of them however: 1) They hold themselves out as an “affordable” alternative to a traditional funeral and 2) they deal with the family directly, not through a funeral home, and 3) They do not have a Missouri Funeral Establishment license. This article is not about the legality of those businesses doing business in Missouri. MFDEA has already raised to the Missouri State Board of Embalmers and Funeral Directors its concerns about people and businesses possibly conducting funeral arrangements without a license in this State. If you think this is a problem that needs to be addressed, you should also contact the State Board about your concerns and try to attend a State Board meeting in person to express those Donald C. Otto, Jr. MFDEA Executive Director & General Counsel concerns. Rather, this article is about something else that these businesses have in common: They often hire a Missouri Licensed Funeral Establishment to file the Death Certificate and do other work for them. In some instances the Missouri Funeral Home may be paid to do the pick-up and removal. Sometimes the funeral home may store the body until the company can arrange for it to be picked up. Sometimes the funeral home itself delivers the body to a crematory or other location where somebody else takes over. In some cases the funeral home never actually sees the body but is paid to do the paperwork. The key issue, in all of these cases that we are concerned about here, is that the Missouri licensed funeral establishment is asked to file the Death Certificate. The problem here is that if you sign the death certificate, you are stating that you are the “Funeral Director in charge of the final disposition” of that body. Are you? Are you really “In Charge”? When you sign that Death Certificate you are putting your license on the line if something goes wrong and, rest assured, if anything does go wrong, you will be part of the lawsuit. Even if you or your funeral home had nothing to do with something bad happening as part of this disposition, you stated on an official Missouri document that you were the person “In Charge” of this case so you may be held responsible. Susanna E. Garber, age 98, of Versailles, passed away Sunday, June 7, 2015, at the Good Shepherd Care Center in Versailles. She was born August 5, 1916, on her family’s farm outside of Versailles, a daughter of the late Lawrence and Susan (Badertscher) Aeschbacher. On February 1, 1942, at the Versailles United Methodist Church, she was united in marriage to Raymond C. Garber. They have shared the last seventy-three years together. Susanna was active in many organizations throughout the Versailles, Laurie, Gravois Mills and Sunrise Beach communities. She was a member of the Versailles United Methodist Church

and the United Methodist Women. She was also a member of the Order of the Eastern Star Versailles Chapter 410 where she served as Past Matron. She was an avid sports fan. She enjoyed watching Missouri basketball and Cardinals and Royals baseball. In addition, she and Ray never missed an event in which her grandchildren participated. Susanna cherished many things throughout her life. Along with Ray, the couple had a passion for travel, and ventured throughout the United States to visit forty-nine of the fifty states. Her favorite retreat was Alaska. The two always drove, making their fifth adventure to the extreme northwest in their eighties. Active in her community, Susanna loved to visit with people. She had a genuine heart that spoke of her love of people and community through her

faith in God. Her witty, sharp humor was complemented by her determined spirit. Susanna believed in her children, grandchildren and great-grandchildren. She was a quiet, unselfish benefactor in many ways to help her family achieve their aspirations. Susanna attended Providence school and later graduated from Versailles High School in 1935. This year marked her 80th class reunion. After working for various industries and traveling with Ray through the Air Force, Susanna became an integral part of forming Kidwell-Garber, Inc. As a licensed funeral director, she was at Ray’s side as they took ownership of Kidwell Funeral Home. Her vision helped expand to serve more of the lake area. In 1979, the Laurie/Sunrise Beach Chapel and Garber Memorial Estates was developed, perpetuating a legacy that remains within the business and her
family. She was a loving wife, mother, grandmother and great-grandmother. Her most cherished times were those spent with her family. She is survived by her husband, Raymond, of the home; her children, Sue Akin and Gary Garber both of Versailles; her grandchildren, Suzanne Hall and husband Corey of Versailles, Nathan Garber and wife Michelle of Versailles, Landon Akin of Osage Beach and Michael Garber and wife Shannon of Versailles; her great-grandchildren, Ila Garber, Ethan Garber, Landri Hall, Rose Garber, Matthew Garber and Pearl Garber all of Versailles; several nieces, nephews and many friends. In addition to her parents, she was preceded in death by her granddaughter, Meredith Garber, her sister, Lois “Joy� Metzker and her son-in-law, Larry Akin. Funeral services were held at 11:00 a.m., Wednesday, June 10th, at the Kidwell-Garber Funeral Home in Versailles. Graveside services and
entombment followed in the Versailles Cemetery with Suzanne Hall, Nathan Garber, Landon Akin, Michael Garber, Brian Graber and Mark Graber serving as casketbearers. Memorial contributions are suggested to the Versailles United Methodist Church or the Bethel Mennonite Church. Christopher Scott Liley, age 52, of Marble Hill, MO; passed away on Tuesday, June 16, 2015 at his residence surrounded by his loving family. He was born February 28, 1963 in Cape Girardeau, MO; son of W. Kenneth and Judith Charlene Dettmer Liley. He and Christa Barker were united in marriage on December 6, 1997. Chris was Vice President of Liley Family Enterprises, a past president of the Mid-America Monument Builders
Association (MAMBA), Member of the Monument Builders of North America, a Licensed Missouri Funeral Director and member of the Missouri Funeral Directors Association. He was also a Charter member of the Cottage of Grace General Baptist Church, where he served as Sunday School Superintendent, played guitar for the church choir and a member of the Bluegrass group Cabin Fever. Chris loved to fish, hunt, and spend time with his family and especially his granddaughters. Survivors include; his wife Christa of the home; sons Joshua William Liley of St. Charles, MO; Adam Christopher (Nikki) Liley of Marble Hill; Joey (Jamie) Schag of Plano, IL; Jason Schag of Cape Girardeau; daughter Danielle Monique (Matt) Torbet of Cape Girardeau; father Kenneth (Judy) Liley of Marble Hill; mother Judith (Tom) Scott of Ballwin, MO; grandmother Dorothy Dettmer of Fredericktown, MO; brothers Michael Lynn (Tammy) Liley of Marble Hill; Eric

Donald Lee "Don" Jensen of Arnold, formerly of Knob Lick, passed away Monday, June 22, 2015, at St. Anthony Medical Center at the age of 81 years. He was born on November 20, 1933, at Knob Lick, son of the late Jesse E. and Edith D. (Kinney) Jensen. In addition to his parents he was preceded in death by his wife Gail Jensen, a son Ronald Jensen, and two sisters Leota Foxx and Stella Lyons. Donald grew up south of Farmington and attended school at Knob Lick and Farmington. He proudly served his country in the U.S. Army during the Korean War. He later attended the Kentucky School of Embalming and became a licensed funeral director and embalmer in the state of

Missouri. He began his career working in Farmington for the Cozean Funeral Home, serving his apprenticeship under the late C.H. Cozean, Sr. Later under the encouragement of Mr. Cozean, he moved to the St. Louis area and eventually purchased Baumman Colonial Funeral Chapel in Overland. He owned operated the funeral home for the rest of his working career. After selling the funeral home and retiring, he moved to Arnold where he remained until the time of his passing. He is survived by a sister Jean Kinneman of Farmington and a brother Charles (& Patricia) Jensen of Bedias, TX, numerous nieces, nephews and other relatives and friends. Graveside services were held at 2 p.m. on Thursday, July 2, 2015, at the Knob Lick Cemetery with full military honors to follow. Memorials may be made to the Southeast Missouri Funeral Directors Association Scholarship Fund.
David PloessnerNew Federated Insurance Rep I grew up in St. Louis, Missouri and moved to Jefferson City after starting with Federated in June 2014. I am an Eagle Scout, Community Emergency Response Member, and avid water skier. I was the President of Delta Sigma Pi Business Fraternity at Mizzou, and VP of Motorcyclists of Mizzou. Adopted at birth, my twin brother and myself both grew up in St. Louis. My father is a small business owner and my mother a nurse. I have been dating my High-school sweetheart Sarah and have plans to get engaged when the time is right. Sarah is a 5th grade teacher working on her Masters. I have extended family that farms in northern Missouri where I love to spend time. I am a proud alumni of the University of Missouri- Columbia (Mizzou). I earned a degree in Business Management, emphasizing in entrepreneurship. I later earned my insurance licenses and spent nine months in Federated’s training program prior to taking over the MidMO territory. My first job was at age 15 as cart and maintenance boy at a golf course. After a year working part time at the golf course I added shifts as a Life Guard at a local pool during the summer. Looking to gain sales and customer service experience I added a job as a Call Center Agent. I was promoted to maintenance manager at the golf course after 2 years and eventually named employee of the month 2 times at the call center. In college, I had the opportunity to open my own painting business which was operated in the St. Louis area during the spring and summer months while going to school at Mizzou. That painting company expanded to Southern Illinois and Columbia, Missouri over the
next three years. I grossed more than 900 clients in St. Louis, Columbia, and Southern Illinois before deciding to take another opportunity as an intern at Altria Group. I accepted a job as a Marketing Representative with Federated and started the training program following graduation. It’s doubtful that I will be the slickest, best-looking, or fast talking insurance salesman to walk through the doors of your business. I do guarantee however that I will be the hardest-working insurance agent you could hire to protect you and your company. You have worked hard to build your business to provide for your family – the last thing you need is a slick, fasttalking salesman selling coverages that benefit him more than they do you. I take my job very seriously and want to earn your trust and respect. It is my desire to show how can bring value to your business and be a resource to you. If you are the one filing the Death Certificate – and if it would be at all possible for you to talk to family members – doing this would be a direct violation of Missouri regulations that requires the funeral director to obtain the personal data of the deceased from “the next-ofkin or best qualified source available.” Who is the most qualified source for personal data? The family you can talk to yourself or an out-of-state company? Again, if something goes wrong, you will be the one that takes the blame for any mistakes and it’s your license that could be disciplined. If you are filing the Death Certificate and you can talk to the family to get the personal information on the deceased, you should talk to the family to get the personal information on the deceased. The plaques were presented to Mr. Otto and Mr. Sam Licklider, MFDEA’s Lobbyist, in recognition of their efforts to pass HB 618. The bill does several important things. 1) It allows, WITH the doctor’s approval, people other than the doctor to be the one actually typing the data into the EDRS system. This will make it possible for the Doctor authorize the funeral director who can then enter it into the EDRS system on the doctor’s behalf - the doctor still must determine and sign the “cause of death” but someone else can input that data. NOTE: this is only if the Doctor wants to do this. The bill does not force Doctors who currently enter the data to change how they do things. 2) It allows, with the primary doctor’s permission or in his/her absence, other medical professionals to certify the cause of death - this will be very useful with the “hospitalists” who may no longer be at the hospital where the person died. 3) Provides improved liability protection to everybody involved in the EDRS system. 4) Creates a “task force” that will meet this Summer and Fall to look at the entire DC process to see how it can be improved.

Hello MFDEA members and friends! Well another Missouri only convention is over. The turnout in St. Charles was excellent, with great meals, programs and the showroom. If you attended the Cardinals game, that was awesome, because the Cards won! The next convention will be the Tri-State at the Overland Park Convention Center, May 8-11, 2016. I look forward to seeing you there! One of the many programs offered at the convention that I thought was interesting, was presented by Scott Gilligan, General Counsel for the National Funeral Directors Association. The program was on the Top Ten Funeral Rule Compliance Issues. The following are the items that if your funeral home was shopped might keep you out of the hot seat. 1. Combine your General Price List with your Casket Price List and Outer Burial Container Price List. When you give out the price list with all three combined, your safe. 2. Package Price Lists. Include your Package Price List with your General Price List. Here again you don’t have to remember if you gave out the Package Price List if it’s all together. 3. If your funeral arrangements are made in rooms containing caskets or outer burial vaults, the

Price List must be given before entering or as soon as the family sits down. If the funeral director is running late to the arrangement and the GPL is not given out yet, you’re in violation. 4. If you give your GPL and other price list information in a funeral home packet, you must point out that the price lists are in the packet. No hiding. 5. Avoid Laminating GPL’s. Funeral homes have been cited because the GPL’s have been laminated and placed in a nice binder on the arrangement table. While this appears more professional, it also implies that the GPL is not given to them to keep. Always give a copy to the family and tell them it is their copy to keep. 6. Update Price Lists. If your Price List with an effective date are four or five years old, the FTC will presume that you have failed to update your price lists. If nothing has changed as of the first of the year, put that date on the GPL. 7. Undercover Shopping Myth 1. It was reported that the FTC is more likely to shop a funeral home that is located within a 100 miles of a Regional Office. Not so, they are selected for reasons other than location. 8. Undercover Shopping Myth 2. FTC is more likely to shop a funeral home that has changed ownership. Again, not so. FTC doesn’t keep track of that data. 9. Undercover Shopping Myth 3. Giving a Package Price List before the GPL. This is not a violation. If the GPL is handed out to the family in a timely fashion, it doesn’t matter where the package prices are. They could be on the front page. 10. Filling Fee for Urns. Funeral homes had questions about filling third party urns. If you don’t charge to fill your urns you shouldn’t charge to fill third party urns. If you want to have a charge, put it on the GPL and charge for all urns. information class with our Funeral Assistant who handles the front desk about the ten items just mentioned and what the funeral home would have to go through if we were shopped and found in violation. The second week in July a lady came into the funeral home and approached the Funeral Assistant at the desk and wanted to ask some questions about caskets. First thing he said was, “I need to give you our General Price List which includes our Casket Price List and Outer Burial Price List.” Now how may I help you? The lady responded with a smile and said, “I believe this is all I need” and left. He didn’t recognize her as being someone from the area. If she was with the FTC, the 15 seconds it took to hand out the GPL was well worth the time taken. The second item that I thought was beneficial, was the Certified Celebrant Training. The class was taught by Doug Manning and Glenda Stansbury. Over three days, you learned the Value of a Funeral, Service Planning, and Ceremonial Public Speaking. During the Service Planning, a great deal of time was spent on understanding the importance of personalization of the funeral. Demonstrating the skills necessary for meeting with the family: listening, understanding, interviewing, note taking, writing and organizing. Understanding the basic options available for various types of funeral service including music and literature. Your role as a Celebrant and the relationship between the funeral director and the funeral home. During the last half of the class, participants were paired up and given a scenario of a death. With this scenario you were to create a service and present it. Following your presentation, the class critiqued your service. The class was very enlightening and informative. I wished I had this earlier in my career. If you have the opportunity to attend this class, it would be a valuable investment of your time.
