Across the Board A MESSAGE FROM THE PRESIDENT By Melissa Joy, President
Happy New Year, fellow GCNKAA members! What an exciting time to be part of the multifamily housing industry in Greater Cincinnati. The year 2023 was an unforgettable year for the association and our amazing members. Thanks to the hard work of our dedicated staff and committee members, we hosted numerous impactful industry events, conducted education sessions, provided countless networking opportunities, and ended the year Melissa Joy with the largest Holiday Cheers event to Village Green Mgmt. date. Planning for 2024 is well underway and we are excited to share in another year of meaningful work in our quest to be a united voice working toward the betterment of multifamily housing. As we kick off 2024 I would like to extend a sincere thank you to Tonya Petersen for her service as President of the Board of Directors for the past two years. Tonya navigated some unprecedented changes in our association and did so with grace and professionalism. Her passion for the multifamily industry and the people of our industry is truly remarkable. We are grateful that Tonya will continue to support the Association and serve as Immediate Past President, supporting the Board of Directors, and will represent the GCNKAA at the state level. I would also like to offer my deepest gratitude to Gerry Johnson for his years of service on the Associate Council and GCNKAA Board of Directors. While Gerry will be making way for new leadership on the Council and Board, there is no doubt he will continue to be a champion for our association and the industry as whole. Look for Gerry at work with the Trade Show Committee this year and as a constant supporter of our association. With this change, we are elated to welcome Grant Saunders as the 2024 President of Associate Council and Rod Herper as the Associate Council First Vice President - and our newest GCNKAA Board members. Neither Grant nor Rod is a stranger to the GCNKAA and both will be a welcome addition in their new roles. I am proud to share that we now represent more than 110,000 members and will continue to focus on supporting the evolving

landscape of our industry. The GCNKAA was recognized as an Achieving and Excelling Standards Affiliate with the NAA in 2023 based on stringent criteria. Very few affiliates receive this recognition, and it is an honor to be part of an organization that is recognized at the highest level. We are fortunate to have many local association members serving at the National Apartment Association level, including Abbie Huffman, who is currently a RVP for Region III. We have Board Members and other local GCNKAA members serving on the NAA Operations Committee, Education Advisory Board, Diversity Equity & Inclusion Committee, and Legislative Committee. Also, Mr. Don Brunner, past president of GCNKAA and NAA will serve as President of the Columbus Apartment Association in 2024. There is so much to be excited about in the New Year. In just a few short days we will see you at the Officers Installation Dinner. This event takes place on Tuesday January 16 at the Hyatt Regency Cincinnati. We look forward to seeing everyone as we install the Board of Directors for GCNKAA, including my fellow Executive Committee members: Mr. Justin Seger (Vice President); Mr. Craig Coffman (Treasurer); Mrs. Megan Lawhon (Secretary), as well as the AAO, Associate Council, and OAA board members. Looking ahead to 2024, there are so many events to be excited about. Two that are absolutely top of mind for me are the CBRE State of the Industry event on February 20 at Oasis and the highly anticipated return of The Prestige Awards. Nominations for Prestige are due on February 2 and the event will be held on Friday April 19 at the Savannah Center. In closing, I would be remiss if I did not say how humbled, honored, and grateful I am for the opportunity to serve and represent each of you as President this year. I look forward to working alongside our dedicated staff and board of directors to proliferate the mission of the Greater Cincinnati Northern Kentucky Apartment Association. It is my goal to ensure that our organization is well-represented, demonstrates the utmost integrity, and prioritizes the ever-changing needs of our members. I would love to connect with as many people as possible in 2024 and welcome the opportunity to chat via email or at an upcoming event. EPA 608 Certification Section 608 of the Federal Clean Air Act requires that all persons who maintain, service, repair or dispose of appliances that contain regulated substances be certified in proper refrigerant handling techniques. Technicians are required to pass an EPA-approved test to earn Section 608 Technician Certification. • Type I – Persons who maintain, service, or repair small appliances must be certified as Type I technicians. • Type II – Persons who maintain, service, repair, or dispose of the medium-, high-, or very highpressure appliances (except small appliances, MVACs, and MVAC-like appliances) must be certified as Type II technicians. • Type III – Persons who maintain, service, repair, or dispose of low-pressure appliances must be certified as Type III technicians. Please note that – as changes happen on a daily basis – this version of the floorplan may not be completely up-to-date. 2. Look at the floorplan and decide which booth you would like, then simply either: • Visit www.gcnkaa.org and go to the event calendar to reserve your booth online. Available booths will be listed on the registration page. Log in, complete your selection and submit your request immediately. • OR fill out the booth contract, complete with your first three (3) booth choices and fax back to 513 407-7868. Michele will follow up with you to let you know which booth is available. BOOTH RESERVATIONS AND PAYMENTS • After you have selected your booth with the Apartment Association, you must either forward GCNKAA a signed contract or remit full payment to reserve that booth. • We will hold all booths for 14 days without signed contract or payment. • You may pay for your booth with check or credit card or call the office for an invoice. • We cannot hold a booth longer than 14 days without contract or payment. After those 14 days, if we do not receive a contract or full payment, GCNKAA will contact you for payment or contract. If no response, GCNKAA may release the booth you selected. • Full payment of all booths must be received by February 27, 2024. Most event facilities hold a liquor license that does not allow for outside alcohol to be brought into the facility or onto the grounds of the event venue. Outside alcohol brought in by members, guests, and event attendees is a direct violation of State liquor law and is cause for immediate expulsion from the event with no refund and could jeopardize your association membership as it would be a violation of the ethics clause.

GREATER CINCINNATI NORTHERN KENTUCKY APARTMENT ASSOCIATION EXHIBIT RULES & REGULATIONS 1. AGREEMENT By signing the Exhibit Space Application and Contract, the Exhibitor agrees to abide by these Rules and Regulations and all amendments thereto and the decisions of Show Management. For purposes of this Agreement, the terms “GCNKAA” shall mean the Greater Cincinnati Northern Kentucky Apartment Association, “exhibit hall” shall mean the Sharonville Convention Center, and “Exhibitor” shall mean any company, firm or person who has applied for or been allocated any space at the Exhibit Hall. 2. UNDESIRABLE ACTIVITIES The Exhibitor agrees that his exhibit shall be admitted into the Show and shall remain solely on strict compliance with all the rules herein described. GCNKAA reserves the right to reject, eject or prohibit any exhibit in whole or in part, or any Exhibitor with or without giving cause. GCNKAA’s liability for rejection without giving cause shall be limited to a refund to the Exhibitor of the amount of rental unearned at the time of ejection. However, if an exhibit or Exhibitor is ejected for violation of these rules or any other stated reason (with cause), no return of rental shall be made. Exhibitor shall not exhibit any merchandise other than that specified in the application. 3. BOOTH ASSIGNMENTS Booth selection by Exhibitor is available on a first-come, first serve basis and there is no first right of refusal. GCNKAA’s confirmation of requested booth space is final and shall constitute an acceptance of the Exhibitor’s offer to occupy space. Confirmation will be made only after receipt of the Exhibitor Agreement and the appropriate booth fees. After confirmation, space location may not be changed, transferred, or canceled except upon written request and with the subsequent written approval of GCNKAA. Not withstanding the above, GCNKAA reserves the right to change location assignments at any time, as it may, in its sole discretion, deem necessary. 4. SPACE RENTAL Exhibitor fee includes a 8’x 10’ exhibit space, materials to define exhibit space (pipe & drape), a two-line sign showing Exhibitor’s company name and booth number, one 6’ table with skirting, two chairs and wifi access. No signs or advertising devices shall be displayed outside the exhibit space other than those furnished by GCNKAA. Booth displays not to exceed nine (9) feet in height across the back. No backdrops or booths higher than five (5) feet in height are permitted along the sides of the booth. Booth displays cannot block neighboring booths. Electric, carpet, additional table and chairs, and landlines are available at Exhibitor cost through separate contracted vendor. 5. USE OF DISPLAY SPACE A. Restrictions on Space Rental: Exhibitor may not sub-let, sub-divide or assign his space nor any part thereof, nor purchase multiple booths for the purpose of subletting or assigning to third parties, nor permit in his booth non-exhibiting companies’ representatives without the express written permission of GCNKAA. Only companies or individuals that have contracted directly with GCNKAA shall be allowed on the show floor as an Exhibitor. Failure to comply with this provision shall be sufficient cause for GCNKAA to require the immediate removal of the exhibit and/or the offending Exhibitor at the expense of the Exhibitor. Failure to comply may also result in forfeiture of all further rights to exhibit at future shows sponsored by GCNKAA together with all fees paid. GCNKAA may lease any space so forfeited to another Exhibitor and retain all revenues collected. B. Exhibitor shall design and maintain the general theme and tenor of show. 6. INSTALLATION AND REMOVAL GCNKAA reserves the right to fix the time for the installation of the booth prior to the show opening and for its removal after the conclusion of the show. Installation of all exhibits must be fully completed at least 30 minutes prior to the opening of the Show. Failure to adhere to this requirement could restrict Exhibitor’s entry into any future shows produced by GCNKAA. Any space not claimed by 3:30 p.m. on Wednesday, March 27, 2024, may be resold or reassigned without refund. All exhibits and booth materials must be removed by 9 p.m. on Wednesday, March 27, 2024. 7. EARLY REMOVAL OF EXHIBITS NOT ALLOWED No exhibit shall be packed, removed or dismantled prior to the closing of the Show without written permission from GCNKAA. If the Exhibitor acts in breach of this provision, it shall pay as compensation for the distraction to the Exhibition’s appearance, an amount equal to one-half of the total space charge for the Exhibitor’s allocated area, in addition to all sums otherwise due under this Agreement. 8. EXHIBITOR APPOINTED CONTRACTORS (EAC) Any exhibitor using an EAC agrees to notify GCNKAA of such appointment and agrees to indemnify and hold harmless GCNKAA, the exhibit facility, and their respective officers, directors, staffs, employees, and agents and all official contractors from any and all liability or losses for any act, complaint, damage, or loss to any other Exhibitor, the exhibit hall, the property of any contractor or any consequential damages arising out of any such act of loss from the time the independent EAC first arrives at the hall until the final move-out is complete. The Exhibitor further agrees that GCNKAA may prohibit the EAC from working in the hall if the EAC does not fully comply with all rules and regulations set forth for them at this event. Any Exhibitor using an EAC agrees to advise its EAC of all rules and regulations. 9. PROHIBITED ACTIVITIES A. All demonstrations, sales activities, and distribution of circulars and promotional material must be confined to limits of the Exhibitor’s booth. B. Exchange of money or consummating the sales of goods or services on the exhibit floor is prohibited. Orders may be taken for future delivery only. C. Exhibits which include the operation of musical instruments, radios, sound motion picture equipment, public address systems, or any noise-making machines must be operated so that the noise resulting from there will not annoy or disturb adjacent Exhibitors or their patrons. Exhibitor represents and warrants
that no musical work protected by copyright will be staged, produced or, otherwise, performed via either “live” or “mechanical” means, or by or on behalf of Exhibitor, unless Exhibitor has previously obtained written permission from the copyright owner’s designee (e.g., ASCAP, BMI, or SESAC) for such use. D. Exhibitors are prohibited from displaying any devises or objects in the booth that exceed the height of the back wall (9 ft.) without prior written approval from GCNKAA and the exhibit hall. No backdrops or booths higher than five (5) feet in height are permitted along the sides of the booth. Booth displays cannot block neighboring booths. E. The use of inflatables (or ‘bounce houses’) is restricted without approval from GCNKAA, Sharonville Convention Center, and/or neighboring exhibitors. F. Exhibitors are not allowed to conduct any activities that could be considered an illegal lottery under Ohio law. G. Electrical equipment that is not UL approved may not be used in the exhibit hall. No wiring, installation or spotlights or other electrical work shall be done except by the electrical contractor authorized by GCNKAA or exhibit hall. H. Approval for distribution of food items must be obtained by the Sharonville Convention Center prior to the event. I. Sharonville Convention Center prohibits the use of glitter, confetti guns, fireworks and helium balloons inside their facility. J. Live animals (except service animals) and firearms are prohibited inside SCC. 10. CANCELLATION BY EXHIBITOR The Exhibitor specifically recognizes and acknowledges that GCNKAA will sustain losses if the Exhibitor cancels its exhibit space after it has been assigned and confirmed by the GCNKAA. Due to the difficulty of determining said losses, the Exhibitor agrees to pay the following amounts as liquidated damages, and not as a penalty, all cancellations must be received in writing. Booth cancellations received after September 1, 2023, and prior to February 27, 2024, will be issued a refund minus a $100 administrative fee. Booth cancellations after February 27, 2024, will forfeit all booth fees and will be responsible for full booth payment. Upon cancellation by the Exhibitor, GCNKAA has the right to resell the space and retain all revenue collected. 11. CANCELLATION OR POSTPONEMENT OF SHOW In the event that any unforeseen occurrence shall render the fulfillment of this Agreement impossible by GCNKAA, the parties shall mutually amend or terminate the agreement at GCNKAA’s option. The Exhibitor hereby waives any claim against GCNKAA for damages or compensation. GCNKAA may return a portion of the amount paid for space after deduction of any amounts necessary to cover expenses incurred in connection with the show. Such expenses include, but are not limited to all expenses incurred by GCNKAA as a result of contracts with third parties for services or products incidental to the show, and all overhead expenses attributable to the production of the show. No monies will be returned should the dates or location of the show be changed by GCNKAA, but Exhibitor will be assigned space that the Exhibitor agrees to use under these same rules and regulations. GCNKAA shall not be liable in the event the show is interrupted, canceled, moved or dates changed except as provided herein. 12. ERRORS AND OMISSIONS GCNKAA assumes no responsibility or liability for any of the services performed or materials delivered by official show contractors or other suppliers to the show, their personnel, or their agents. 13. LIABILITY AND INSURANCE A. All property of the Exhibitor remains under its custody and control in transit to and from exhibit facility, during installation and removal, and while it is within the confines of the exhibit facility. Neither GCNKAA, the service contractors, the management of the Sharonville Convention Center nor any of the officers, staff members, or directors of any of the same are responsible for the safety of the property of Exhibitors from theft, damage by fire, accident, vandalism or other causes. The Exhibitor expressly waives and releases any claim or demand he may have against any of them by reason of any damage to or loss of any property of the Exhibitor. B. Exhibitor understands that neither GCNKAA nor any sponsor carries business interruption and property damage insurance coverage for loss or damage of Exhibitor’s property. The Exhibitor agrees to obtain adequate insurance during the dates of the trade show, including move-in and move-out days, and shall be prepared to furnish a certificate of insurance to GCNKAA. 15. ENFORCEMENT OF REGULATIONS GCNKAA has full power to interpret and enforce all regulations of the show and the power to make amendments and/or further regulations, orally or in writing, that are considered necessary for the proper conduct of the show. Such decisions shall be binding on Exhibitors. All Exhibitors agree to be bound by terms of GCNKAA’s agreement with the facility in which the show is held. 16. CONFLICTING MEETING AND SOCIAL EVENTS In the interest of the entire Show, the Exhibitor agrees not to extend invitations, call meetings, or otherwise encourage absence of members, Exhibitors, or invited guests from the educational sessions or exhibit hall during the official hours of the sessions or show. Hospitality suites may not be reserved without prior approval of Show Management. 17. WAIVER Waiver by either party of any term or condition or breach shall not constitute a waiver of any other term or condition or breach of this agreement. The rights of GCNKAA shall not be deemed waived as specifically stated in writing and signed by an authorized representative of GCNKAA. 18. SEVERABILITY In the event any provision of this Agreement is held invalid or unenforceable then neither the remaining provisions of this Agreement nor other applications of the provisions involved shall be affected thereby.

Electric Connections Rates quoted for electrical connections cover only the bringing of service to the booth in the most convenient manner and do not include any special wiring. NAA RELEASES TOP 2024 POSITION STATEMENTS: EVICTION EXPUNGEMENT; GAS STOVES; “JUNK” FEES; RENTERS CHOICE/ SECURITY DEPOSITS By Pat Crowley, Vice President of Governmental Affairs The National Apartment Association (NAA) has released its top four federal position statements for 2024.

GAS STOVES At every level of government, policymakers are increasingly considering restricting, or even outright banning, the use of natural gas-powered appliances to help cities reduce building emissions as well as address perceived health and safety risks from the indoor air pollutants generated by
these appliances. But the NAA makes clear that research has found no evidence of an association between the use of gas as a cooking fuel and either asthma symptoms or asthma diagnosis. When it comes to the indoor air quality of cooking with electricity or natural gas, the health driver is the food being prepared, not the fuel being used for cooking. The NAA opposes limitations on gas-powered appliances or mandated retrofits and urges policymakers to consider how these requirements would impact the provision of rental housing and housing affordability for renters. FEES The Biden administration and members of Congress are voicing concern about how housing providers determine required upfront costs and rent, fees and charges that are assessed to residents. Housing providers are increasingly facing the threat of legislative and legal action as regulators redefine some rental fees as unfair, hidden or “junk fees” under consumer protections laws. But it is critical to remember that housing providers determine rents, deposits, fees and other charges in accordance with applicable laws. These fees are not junk fees; they reflect actual costs of do-
ing business to manage and operate rental communities. The NAA urges policymakers to preserve housing providers’ ability to assess fees that reflect their business needs and will continue to collaborate with policymakers on efforts to provide renters with greater transparency in their housing costs. SECURITY DEPOSITS Overly prescriptive security deposit laws, like renters’ choice policies, often result in housing providers’ increased reliance on more conservative resident screening criteria as they look for alternative methods of managing risk, which harms low- or moderateincome renters who have insufficient, unscorable or poor credit history. The NAA opposes proposals that overly prescribe or mandate security deposit policies, products or services and supports security deposit laws that preserve the ability of housing providers to manage their risk using whatever strategy best fits their needs and the needs of their residents. EVICTION EXPUNGEMENT Proponents of eviction expungement laws are urging automatic eviction record sealing and prescribed court processes to petition for expungement. Policymakers argue these measures improve housing choice and access for renters who have negative rental histories. But eviction expungement policies can limit housing providers’ access to valuable information that helps them manage their financial risk and maintain the viability of their rental communities. The NAA urges policymakers to preserve access to consumer information to ensure housing providers can make informed housing decisions in the resident screening process. The NAA also supports efforts to improve data quality of information contained in consumer reports.

Happy New Year! Welcome to 2024. I would like to start by thanking Janie Evans (Cassady Schiller), Emily Howard (Reserve at 4th & Race) and Sean Blythe (Heritage Hill Capital Partners) for their years of dedicated service on the Apartment Association Outtreach (AAO) Board of Directors. Their commitment to our organization and the causes we support is truly appreciated. I am honored to have been elected to serve as the President of the AAO. We have been Justin Seger fortunate to have someone as dedicated and talented as Megan Lawhon with PLK Communities as our President the last two years. I will do my best to fill Megan’s shoes and look forward to continuing to have her on our Board during my term. She has done an admirable job of continuing the momentum of fundraising and community support following the creation of the Champions for Outreach Program. In 2023, our organization was able to contribute more than $200,000 back into our community. Our focus on Rental Assistance, Food Pantry Support, Senior Events, and Back to School Support continues to have a major impact on the region. I look forward to working with our loyal membership and Board of Directors to continue the momentum in 2024 and beyond!

In addition to these new members, Tonya Petersen (Vinebrook Homes), and Jordann Morgan (FATH Properties) have been elected as our Treasurer and Secretary, respectively. I know I speak for the entire Board when I say we are energized to work with everyone that has so generously supported AAO over the years, while expanding our fundraising, and doing our absolute best to expand our service projects, rental assistance, and food pantry support. Various types of machines pose hazards to employees that can result in injuries that include crushing, entrapment, amputations, and even death. These hazardous areas, known as danger zones, are machine parts that must be guarded to protect employees from injury. The Occupational Safety and Health Administration (OSHA) defines a danger zone as “any place in or about a machine or piece of equipment where an employee may be struck by or caught between moving parts, caught between moving and stationary objects or parts of the machine, caught between the material and a moving part of the machine, burned by hot surfaces or exposed to electric shock.” Per OSHA’s General Requirements for Machine Guarding (29 CFR 1910.212), employers are required to perform an evaluation of the machinery in their workplace in order to identify and adequately guard the danger zones to provide protection to employees. In fact, machine guarding violations frequently show up as one of the OSHA’s top ten most cited violations each year. So not only is it essential to protect employees, but an effective machine guarding program will help in the event of an OSHA Inspection. It is essential first to understand the movements of machinery to identify the danger zones. There are two types of hazardous movements that a machine makes: Mechanical Motions and Mechanical Actions.
1. Mechanical Motions – Mechanical motions include gears, pulleys, or moving belts. There are basically four different types of mechanical motions. a. Rotating – Rotating motions include collars, couplings, cams, flywheels, shaft ends, spindles, and horizontal or vertical shafts. These are dangerous as they may grip hair, clothing, and body parts. Additional dangers on rotating parts include when projections exist, such as set screws, bolts, nicks, and abrasions. b. In-running Nip Points – These hazards are caused by rolling parts on machinery. The basic types of in-running nip points include parts that rotate in opposite directions, such as rolling mills and calenders, and rotating and fixed parts that create a shearing, crushing, or abrading action. In addition, rotating parts between power transmission belts and pulleys, a chain and sprocket, and a rack and pinion. c. Reciprocating – Reciprocating is an action caused by a back-and-forth motion where a worker may get struck by or caught between a moving and stationary part. d. Transversing – This movement is a straight, continuous line, such as the motion of a belt to moving parts. 2. Mechanical Actions – These actions are defined as where the

work is being performed. There are four types of mechanical actions. a. Cutting – The cutting action involves rotating, reciprocating and transverse motions. Types of these actions include bandsaws, circular saws, boring and drilling machines, lathes and milling machines. b. Punching – Punching action refers to power when applied to the ram (slide). Work examples of punching include stamping of metal or other materials. c. Shearing – The shearing action refers to applying power to slide a knife to trim or shear material. Shearing machines can be powered mechanically, hydraulically, or pneumatically. d. Bending – The bending action refers to power applied to a slide or ram to draw or stamp metal or other materials. Types of equipment that bend materials include power presses and press brakes. Once you understand the different types of danger zones, perform an audit of your facility. Keep an open mind and check every department with machinery, regardless of the equipment size. Once you’ve identified the machinery, check to see if the guarding meets OSHA’s General Requirements for Machine Guarding (29 CFR 1910.212). If not, you will need to upgrade to meet those requirements. There are different types of guards, but they typically fall under two categories: 1. Barrier Guards – This can involve physical barriers, such as fences, screens, or shields, to prevent access to the danger zone. Barrier guards should be designed to prevent contact with moving parts while allowing the machine to function effectively. The basic types of guards include:
a. Fixed b. Interlocked c. Adjustable d. Self-adjusting 2. Interlocks and Safety Device Guards – Use interlocks and safety devices to ensure that machinery cannot operate unless all guards are in place and secure. These devices can include safety switches, sensors, and emergency stop buttons. Types of interlock and safety device guards include: a. Photoelectric b. Radiofrequency c. Electro-Mechanical d. Pull Back and Restraints e. Safety Trip Controls f. Two-Hand Control or Two-Hand Trip g. Gate Once you’ve installed the barrier guard or interlocks/safety device guard, train employees, schedule regular maintenance and develop any needed Lockout Tagout procedures. This is a great way to communicate the purpose of the guard to employees. It would be best to place warning signs or labels to identify the danger zone clearly. These warnings should be easily visible and understood by all employees. Properly guarding the danger zone is a critical aspect of workplace safety, and employers should prioritize it to protect their employees and comply with safety regulations. Additionally, continuous monitoring and improvement of safety procedures are essential to adapt to changing circumstances and prevent accidents.
