Prohibition of a Different Color The Feds’ Fight to Keep Pot Illegal Looks a Lot Like 1920s-Era Prohibition By Scott Bomboy, Constitutional Daily The decisions of two states to legalize marijuana have sparked a big debate over the rights of states versus the federal government. But
could homegrown pot face an easier legal battle? For now, federal officials aren’t talking about the referendums in Washington and Colorado to allow state governments to control recreation marijuana consumption. The two state laws directly conflict the federal controlled substance act that bars marijuana consumption in any form.

taxes. No one has to be personally responsible. No education; no motivation; no life plan? No problem. The government will take care of you. One thing Romney might have done better is to have featured more people who had overcome government dependence by embracing the values he was promoting. Example trumps philosophy and success should trump victimhood. Inspiration follows perspiration. But in our “entitlement” age even that might have been impossible to overcome. Other signs of cultural decay are accepted with little notice. According to data from the Centers for Disease Control and Prevention, 40 percent of babies born in America are born to unmarried women. Shrug. Abortion clinics continue to operate. Yawn. There is no longer any cultural cor-
rective because we have abandoned the concept of objective truth. Nothing is right or wrong, because that suggests a standard by which right and wrong might be defined. Personal choice is the new “standard,” which is no standard at all. One might as well develop individual weights and measures. Politicians bid for votes, making promises they can’t keep to voters who will believe anything, as long as it appeals to greed, envy and their sense of entitlement. This undermines our culture. This fuels our massive debt, weakening our economic power and America’s standing in the world. Standards used to be defined and mostly accepted, if not always universally practiced. Many grew out of religious principles. According to a recent Pew Poll, a growing number of people, especially young people, no longer believe in God or religion. In this, and in our increasing flirtation with socialism, America is becoming more like Europe. Government seems to be replacing God as the only acceptable “deity.” So what is the answer? Should conservatives throw in the towel and say America, as passed down to us by previous generations, is no more? That was President Obama’s announced goal four years ago when he promised to “fundamentally transform America.” He’s doing it and sufficient numbers of us appear happy to let him. When they realize what they have done, however, it may well be too late to reverse course.

Interview
Braxton Southwick on preparing for Doomsday By Trevor Watson
humans are to each other in a crisis. This triggered him to begin training with weapons. Braxton and his family practice firearms training that parallel that of the military and police. His family is well prepared, with chemical suits, masks, 600 gallons of fresh water, 100 gallons of gas, 100 gallons of diesel fuel, 1,000 lbs. of coal, 300 lbs. of charcoal, 14 guns and eight chickens. This fall, Braxton and his family will be featured in National Geographic Channel’s hit-series, Doomsday Preppers.
“We are prepared for the worst, but pray each night for the best.”
B
raxton Southwick is a family man juggling six kids in the suburbs of Salt Lake City, Utah. He fears terrorists will attack the U.S. with smallpox, causing an epidemic that would kill thousands and cause widespread panic. Professionally, he rides motorcycles and is a mechanic. He believes both skills will be handy in a doomsday event. Braxton began prepping about 10 years ago when he and his wife, Kara, started food storage for their family of six children. They now have built it into a two-year storage including 700 lbs. of flour, 600 lbs. of sugar and 800 lbs. of wheat. In 2009, Braxton began his involvement and passion for prepping. When he spoke to his family and friends about prepping, they were less than enthusiastic. He then decided to write a book about the end of the world, what to expect and how to prepare for each event. His book, “A Letter to My Friends,” took one year and an estimated 400 hours to complete— a long time, but well worth the effort because all his friends and family are now preppers. While writing his book and providing examples of major catastrophes, including the earthquake in Haiti and Hurricane Katrina, Braxton quickly learned how truly horrible
So what will you and your family do all day? Struggle to live. It will not be easy to hunt and garden every day on top of protecting our cabin and helping others around us survive. We will have but a couple of minutes in the day to our selves. This huge project must be costing you a fortune. Give us an idea about how much you have spent so far? We have been working on our preps for 12 years so I have not felt the sting of the dollar. Any advice for us poor folks? Ha ha. I’m poor too. Start small with food and water first. Have a goal to have a month supply then increase from there. After you have six months, start thinking of a heat source and generator. And be sure to hide the price of your big buys from your wife. If it’s not a toy, she will not really notice.
I had the opportunity to ask Braxton a few questions… What got you interested in or pre-occupied with doomsday? I have always been interested in prepping, but after 9/11 it consumed me. I started prepping heavily after that. How might doomsday look to you? In the NGC show you will see that I’m most concerned with a biological terrorist attack with weapons grade smallpox. That one event is the first domino to fall causing dozens more, the fall of our government, our monetary system breaking down, marauding gangs, civil unrest, etc. What is the ETA for doomsday? I’m not sure but I feel it will be In my lifetime. Is it going to be a dog-eat-dog scenario? If it gets bad enough, yes it will. If we

have a complete break down of society you will have a land of lawlessness. Will you be prepared to shoot and kill other human beings if necessary? A man will not fight because of what is in front of him, he fights to protect what is behind him. Are you prepared for the long haul? How long? If it’s the end of the world, is it really worth hanging around? Ha ha. You would think so and that is the easy way out. You can say you will lift your arms and end it with out a fight but humans are programmed to fight for life. Make it easy on your self and prep now. Is it going to be a cleansing of the Earth? It could be. I prepare for the worst and that is the mother of all worst. BUT if there is a natural disaster, I can be on the front line helping other because I was prepared and I don’t have to worry about my family and me.
So, if two elderly people hobbled to the front of your fort and asked to be let in, what would you do? Help them with anything they needed. Feed them and give them means to protect themselves if they have nothing and than send them on their way.
Over 30 Years experience
Any natural traits that you have that make you a great prepper? I’m smart and I fully think everything out. What happens on the show “Doomsday Preppers?” You will have to tune in to National Geographic Nov. to find out. I can promise you don’t want to miss it. You will be hooked from the very moment you watch. Doomsday Preppers is now playing on the National Geographic channel.

The fight over “marijuana prohibition” is reminiscent of some of the battles over alcohol prohibition in the 1920s.
On Sunday, California Governor Jerry Brown weighed in on the issue, which is being framed as a states’ rights problem, in addition to a social rights issue. “It’s time for the Justice Department to recognize the sovereignty of
the states,” Brown told CNN. “I believe the president and the Department of Justice ought to respect the will of these states.” President Barack Obama’s administration doesn’t favor the legalization of marijuana, and it could file a fed-

tation of intoxicating liquors” in the United States, and it was enacted by the Volstead Act on October 28, 1919. The act didn’t bar the consumption of alcohol by citizens, especially at home. There were loopholes for home consumption, medical use and religious use. Those exceptions remained in place through the entire Prohibition Era until the 21st Amendment repealed the Volstead Act in 1933. That amendment returned the regulation of alcohol back to the states. Today, there’s no amendment barring marijuana consumption, but there is an act that is stricter than the Volstead Act. The federal Controlled Substances Act of 1970 puts marijua-
The federal government raided more than 500 marijuana dispensaries in several states during the past two years, but no one has faced federal prosecution for personal use. The new Colorado law allows adults to possess up to one ounce of marijuana, and six marijuana plants, though public use of the drug and driving while intoxicated are prohibited. Washington state’s liquor control board would administer sales of small amounts of marijuana. In both states, the products would be heavily taxed and controlled. When federal and state laws conflict, they usually wind up in the lap of the Supreme Court. And it wouldn’t be the first time the justices have giv-
en a decision about marijuana use. The case of Gonzales v. Raich in 2005 contains a few clues about how the court could rule, if it makes a decision to hear a similar appeal. The court ruled 6 to 3 in favor of the federal government power to regulate the growth and consumption of marijuana for medical use, through the power of the Commerce Clause. Justice John Paul Stevens, writing for the court majority, said that Congress clearly had the power to regulate marijuana, even if is was grown for home consumption. “The regulation is squarely within Congress’ commerce power because production of the commodity meant for home consumption, be it wheat or marijuana, has a substantial effect
on supply and demand in the national market for that commodity,” he said. The three dissenting justices had strong opinions, especially when it came to the use of homegrown marijuana and states’ rights. “If the majority is to be taken seriously, the Federal Government may now regulate quilting bees, clothes drives, and potluck suppers throughout the 50 States. This makes a mockery of Madison’s assurance to the people of New York that the ‘powers delegated’ to the Federal Government are ‘few and defined,’ while those of the States are ‘numerous and indefinite,’” said Justice Clarence Thomas. “If the Federal Government can regulate growing a half-dozen cannabis plants for personal consumption (not because it is interstate commerce, but because it is inextricably bound up with interstate commerce), then Congress’ Article I powers–as expanded by the Necessary and Proper Clause–have no meaningful limits. Whether Congress aims at the possession of drugs, guns, or any number of other items, it may continue to ‘appropria[te] state police powers under the guise of regulating commerce,’” he also said. Justice Sandra Day O’Connor also pointed to Madison in her dissenting opinion. “We would do well to recall how James Madison, the father of the Constitution, described our system Continues on page 15>

M
78% Go Broke
uch has been said recently about NFL players squandering away their hefty salaries and going broke. A 2009 Sports Illustrated report asserted that within two years of retiring, 78% of NFL players face financial stress. This number and the subsequent investigations and stories into what causes so many NFL players to hit financial rock bottom are alarming.
The Pro Bowl Retiree At the age of ten, Rod Smith sat in front of his television watching an episode of “Where Are They Now?” on HBO. At the time, Smith didn’t recognize the impact that the scene being portrayed on the television screen would have on his financial success. “There was a guy on the show who played in the NFL and then became homeless. At that point in my life, I was watching every NFL game and also playing football. When I saw that, I thought, ‘when I get into the NFL, there is no way I’m going broke,’” a retired Smith said on an October afternoon.
Fourteen years after watching that HBO documentary, Smith finished an impressive collegiate career at Missouri Southern State University. There, he completed three degrees in business, economics and finance, and marketing and management. Smith also excelled on the gridiron, going so far as being named a finalist for Division II’s version of the Heisman Trophy. Yet, when the final name in the 1994 NFL draft was called, Smith’s name was not announced. Thus, it was without any bells, whistles, glitz or glamour, that Smith’s three-time Pro Bowl appearance and 14-year NFL career began. This beginning would foreshadow the way in which Smith secured his financial stability. Although he was not drafted, Smith signed with the New England Patriots in 1994. The team released him prior to the season, but he was thereafter signed to the Denver Broncos’ practice squad. “I didn’t get drafted, so that helped me build financial stability. I had a chance to be in the NFL, but not a chance to be in the NFL lifestyle, because I didn’t have the income for it.” Smith notes
that one way young NFL players get into financial trouble is by attempting to keep up with the financial luxuries of other players in the locker room. “I didn’t come into the NFL with money. I started on the practice squad making $60,000 my first year. It was a whole lot of money to me, but nothing in comparison to the lifestyle of the guys I was around in the locker room. I was making $3,000 a week and people around me were making $100,000 per week. You could get caught up in that,” Smith said. As the size of his contract grew during the course his career, Smith remained relatively frugal. He cites
this frugality as the basis for his current financial stability six years into his retirement from the NFL. “The most luxurious thing I bought was my house. I wasn’t a big jewelry or car guy. I don’t have Ferraris and Bentleys. I had a motto that I lived by, ‘There are two places I want to look good at: home and practice.’ Most guys get caught up in looking good on the streets. If you have to show people you have money, you’re not rich,” Smith said. Ultimately though, it was that fear instilled in Smith as a ten-year-old boy watching the life of an NFL hero unravel on a TV screen that drove him to ensure his post-NFL financial secu-

rity. “I snuck up on my locker for 14 years. I saw them fire people, and when they did, the first thing they did was take their name off of the locker and put their stuff in a trash bag. That was my fear. For 14 years, I walked up to my locker, saw my name and thought, ‘I have one more day.’ I was always in fear that one day they were going to decide I wasn’t good enough. I took advantage of everyday and went to work,” Smith recalled. The tangible fear within Smith led him to push himself during and outside of practice to become the best football player he could be. “During the off-season, we got paid up to $100 to workout. I would have endorsement deals, where people would pay me $10,000 to do an autograph signing. I wouldn’t go to the signing, and they’d say I was crazy. I said if I went to offseason workouts and did what I was supposed to do, I’d make millions,” Smith noted. Smith asserts that a similar work ethic is lacking in the league today. “You have these guys who call themselves celebrities now. They are not professional football players. As soon as the reality show is over, real life hits, your career is over and you are broke. If you look down and there aren’t cleats on your feet, that’s a problem.”
In retirement, Smith continues a practice he began in the Broncos locker room when Mike Shanahan was coaching, of mentoring younger players about financial responsibility. “I appreciate Shanahan, because he let me teach a financial class to the rookies. Nobody was teaching me these principles. I learned them from watching people,” Smith explained. Ultimately though, Smith credits the fear put in him by that HBO documentary for his financial success. “I was always in fear. That fear made me a little more conservative. That fear has me here five years later, living the way I want to live. My lifestyle hasn’t gone down at all. It’s actually getting better because of some of the things I’ve done outside of football.” Stories of NFL players going broke will continue to persist, so long as the world is at their fingertips. The truth remains, though, that by seeking out sound investment advice, surrounding themselves with legitimate advisors and realizing that NFL careers and the associated paychecks do not last forever, there is no reason for any NFL player to go broke.

Cheech & Chong of joint sovereignty to the people of New York: ‘The powers delegated by the proposed constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite… . The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liber-
ties, and properties of the people, and the internal order, improvement, and prosperity of the State,’” she said. Since 2005, the federal government has sporadically enforced its laws about medical marijuana use, citing steep costs. The costs would only be steeper if it had to enforce laws about recreational use across several states. If the marijuana issue makes it
back to the Supreme Court, the justices would face new questions, such as the prospects for “marijuana tourism” in Colorado and Washington, complications to the Commerce Clause question, and the fact that federal government hasn’t really been enforcing medical marijuana laws. Also, only five of the nine justices who heard the Gonzales v. Raich case

Heard the one about the . . . ‘Twas the night of Thanksgiving, but I just couldn’t sleep... I tried counting backwards, I tried counting sheep. The leftovers beckoned...the dark meat and white, but I fought the temptation with all of my might. Tossing and turning with anticipation, the thought of a snack became infatuation. So, I raced to the kitchen, flung open the door and gazed at the fridge, full of goodies galore. I gobbled up turkey and buttered potatoes, stuffing with gravy, green beans and tomatoes. I felt myself swelling so plump and so round, till all of a sudden, I rose off the

Happy eating to all -- pass the cranberries, please. Asked to write a composition entitled, “What I’m thankful for on Thanksgiving,” a student wrote, “I am thankful that I’m not a turkey.” A turkey farmer was always experimenting with breeding to perfect a better turkey. His family was fond of the leg portion for dinner and there were never enough legs for everyone. After many frustrating attempts, the farmer was relating the results of his efforts to his friends at the general store get together. “Well I finally did it! I bred a turkey that has 6 legs!”
They all asked the farmer how it tasted. “I don’t know” said the farmer. “I never could catch the darn thing!” If April showers bring May flowers what do May flowers bring? Pilgrims! Why did the turkey cross the road? It was the chicken’s day off. Why do turkeys always go, “gobble, gobble”? Because they never learned good table manners! What sound does a space turkey make? Hubble, hubble, hubble. Why did the police arrest the turkey? They suspected it of fowl play.

Automotive 2013 Hyundai Santa Fe Sport AWD Continued from page 3
safer cars on the road, with emphasis on enhanced structural layout and mechanical competence via the organization’s forward looking engineering theory. Our Santa Fe Sport Turbo features a 264-horsepower 2-liter 4-cylinder that develops 269 lb. ft. of torque and spirited acceleration. Fuel mileage is good, with 21 city and 31 highway for front drive versions and 20 and 27 for our AWD model. The base model, which starts at $24,450, utilizes a 2.4-liter inline four that puts out 190-horses and
delivers 22 city and 33 highway. Power is transferred via a finely built six-speed automatic, and there’s even an Eco button that calibrates the transmission shifting to be more fuel mileage friendly. On the road, Santa Fe is reserved and comfortable on the freeways, although I wouldn’t call it a great handler when pushed in corners. The Sport FE Turbo relies on 19-inch tires on lightweight alloys for traction while an active on-demand AWD system guarantees the best of traction during inclement whether. The safety list is expansive, as most every item is included in the base price from four wheel disc brakes to traction control. Built on the same wheelbase as the previous generation, the new Sport features a larger front grill, a revamped interior that offers more legroom front and rear than a Lexus RX350 and new styling at the sides and rear that add to Santa Fe’s aesthetic charm. Although the design is not too far removed from its award winning second generation, the new Sport is more sculptured and spherical than last year. Notable is a steering system that allows the driver to select from Normal, Sport or Comfort settings. Hyundai says that the firmness in the wheel will vary by going from Sport to Comfort modes, but I couldn’t really feel much of a difference regardless. I really like the heated steering wheel, which comes as part of a $2,900 technology package that includes a panoramic sunroof, eight-inch touch screen Navigation, 12-speaker 550-watt Infiniti sound system and manual pull down rear window shades. A $2,450 Leather & Premium packages adds leather seating, power front passenger seat, sliding and reclining second row seats, heated rear seats, dual climate control, rearview safety camera and a 4.3 inch color display if you don’t add the technology package. These are expensive options, and consumers who don’t need full packages can check with their Hyundai dealer for options less expensive. Some of these notables, like the heated steering wheel, should be standard on the top line model. Hyundai’s Santa Fe Sport looks to be a winner at the showroom, and there’s even more good news as a sevenpassenger model, dubbed solely Santa Fe, is on its way. The three-row Santa Fe replaces the Veracruz and will offer a V6 engine and a longer wheelbase. Overall, Santa Fe Sport Turbo is a great crossover, so if you are shopping for a well-built midsize Crossover, Santa Fe Sport deserves a close look. Likes: Power, new design, interior room, fuel mileage, safety. Dislikes: Large B-pillar blind spot, not sure Eco mode really helps. malcom floyd By Art Garcia Jr.
T
hey say that good things happen to people who wait. For Malcom Floyd, his waiting came to an end in September when that Chargers signed him to a three-year, $11 million contract extension with $8 million guaranteed. Signed as an undrafted free agent out of Wyoming in 2004, the 6-2, 225-pound Floyd had shown flashes of brilliance throughout his eight years with the club, however, injuries had slowed his potential in all but one season. Despite the signing of highly-touted receiver Robert Meachem over the offseason, Floyd
leads the team in receptions (39) and receiving yards (572). With the Chargers struggling to keep pace with first place Denver Broncos in the AFC West, Floyd answered a few questions from MP reporter Art Garcia Jr. prior to their game against the Tampa Bay Buccaneers. AG: How different was it for you coming back to the team after signing that big contract this year knowing you are the number one receiver? MF: It was different than previous years because we had Vincent (Jackson) here, of course, but I think Coach Turner kind of molded me into this role. It’s just being aware and know-

ing when you’re out there running the routes that you have to run like the ball is coming to you. AG: So you figure that the ball is going to come to you more as the number one receiver? MF: Oh, no – you just have to run the route like the ball is coming to you (every pass play). Every route, you have to run it like the ball is coming to you and I think it carries over to you being a number one receiver. AG: Did you train or prepare any different over the offseason knowing you were going to be the go-to receiver? MF: No, not really. I mean, at the end of the year I took that one week off and then stayed active the rest of the way. We have so many guys with so much talent that I just wanted to make sure that I was doing my part. I just wanted to help the team out and be ready by the time the season came to help contribute.
AG: Were you surprised that the Chargers stepped up to the plate and offered you that big money contract? MF: Yeah I was surprised, but I’ve been surprised ever since I started because of the injuries and everything and them still keeping me on the team. It’s a tough business knowing its performance based and I really appreciate it and I’m honored to know that I’m thought of that highly in this organization. AG: Did you ever dream that you would be in this position? MF: You know what, not when you’re young. I mean, I watched my brother (Malcolm) play in the NFL and I knew how talented I was … but when you get here (the NFL); there’s just so much work and effort that you have to put into the game to get good results out of it. You learn how to manage the game over time just based on experience and you get to this point, I guess, where you’re making plays and you’re confident out there (on the field). AG: After you signed the contract did you feel any pressure to not only stay healthy but to live up to the kind of money the team is paying you? MF: Actually, no. I felt more relaxed and I felt more part of the ‘family’ because a lot of other guys, like Philip (Rivers) and (Antonio) Gates, and all those other guys that paid their dues and played at a high level for so long, they had their contracts already. True Crime – 1969
The Chappaquiddick incident
The Chappaquiddick incident took place on July 18, 1969 and refers to the death of Mary Jo Kopechne, a female passenger of U.S. Senator Edward M. “Ted” Kennedy when he accidentally drove his car off a bridge and into a tidal channel on Chappaquiddick Island, Massachusetts. Kennedy swam free and left the scene, not reporting within nine hours, but Kopechne died in the vehicle. In the early hours of July 19, Kopechne’s body and the car were recovered. Kennedy pleaded guilty to a

charge of leaving the scene of an accident after causing injury and received a two-month suspended jail sentence. The incident became a national scandal, and may have influenced Kennedy’s decision not to campaign for President of the United States in 1972 and 1976.
The party
On July 18, 1969, U.S. Senator Edward M. “Ted” Kennedy hosted a party on Chappaquiddick, a small island con-

True Crime nected via ferry to the town of Edgartown, Massachusetts on the nearby larger island of Martha’s Vineyard. The party was a reunion for a group of six women, including Kopechne, known as the “boiler-room girls,” who had served in his brother Robert’s 1968 presidential campaign. Also present were Joseph Gargan, Ted Kennedy’s cousin; Paul F. Markham, a school friend of Gargan’s who previously served as the United States Attorney for Massachusetts; Charles Tretter, an attorney; Raymond La Rosa; and John Crimmins, Ted Kennedy’s part-time driver. Kennedy was also competing in the Edgartown Yacht Club Regatta, a sailing competition which was taking place over several days. According to his own testimony at the inquest into Kopechne’s death, Kennedy left the party at “approximately 11:15 p.m.” He said that when he announced that he was about to leave, Kopechne told him “that she was desirous of leaving, if I would be kind enough to drop her back at her hotel.” Kennedy then requested the keys to his mother’s car from his chauffeur, Crimmins. Asked why he did not have his chauffeur drive them both, Kennedy explained that Crimmins along with some other guests “were concluding their meal, enjoying the fellowship and it didn’t appear to me necessary to require him to bring me back to Edgartown.” Kopechne told no one that she was leaving with Kennedy, and left her purse and hotel key at the party.
Legal proceedings On July 25, seven days after the incident, Kennedy pleaded guilty to a charge of leaving the scene of an accident after causing injury. Kennedy’s attorneys suggested that any jail sentence should be suspended, and the prosecutors agreed to this, citing Kennedy’s age, character and prior reputation. Judge James Boyle sentenced
Malcolm Floyd Continued from Page 26 With the contracts being based on performance, I just haven’t been performing up to my potential – hopefully this year I can reach that point. AG: What kind of goals, if any, did you set for yourself this year? MF: My only goal is to stay healthy and productive and to stay out there and help my team out just to get wins; no personal stat numbers. I just want to stay out there and help my team get some wins. AG: This team has showed, at times this year, what kind of team you can be when it’s clicking on offense, defense and special teams. What is it going to take for you guys to get it together consistently game-to-game? MF: You know, hopefully this week we can be able to put it all together and play a complete game like we have in the past. We’ve had good weeks of practice and all we have to do is adjust to the new stuff that the teams are throwing at us – that’s all it is. We scout them and we practice against those looks during the week but it’s
Kennedy to two months’ incarceration, the statutory minimum for the offense, which he suspended. In announcing the sentence, Boyle referred to Kennedy’s “unblemished record” and said that he “has already been, and will continue to be punished far beyond anything this court can impose.”
Televised statement At 7:30 p.m. that evening Kennedy made a lengthy prepared statement about the incident which was broadcast live by the television networks. Among other things, he Teddy said that: “Only reasons Kennedy of health” had prevented his wife from accompanying him to the regatta. There was “no truth whatever to the widely circulated suspicions of immoral conduct” regarding Kennedy’s and Kopechne’s behavior that evening. He “was not driving under the influence of liquor.” His conduct during the hours immediately after the accident “made no sense to [him] at all.” His doctors had informed him that he had suffered cerebral concussion and shock, but he did not seek to use his medical condition to escape responsibility for his actions. He “regard[ed] as indefensible that fact that [he] did not report the accident to the police immediately.” Instead of notifying the authorities immediately, Kennedy “requested the help of two friends, Joe Gargan and

Paul Markham, and directed them to return immediately to the scene with [him] (it then being sometime after midnight) in order to undertake a new effort to dive down and locate Miss Kopechne.” “All kinds of scrambled thoughts” went through his mind after the accident, including “whether the girl might still be alive somewhere out of that immediate area,” “whether some awful curse actually did hang over all the Kennedys,” “whether there was some justifiable reason for [him] to doubt what had happened and to delay [his] report,” and “whether somehow the awful weight of this incredible incident might in some way pass from [his] shoulders.” He was overcome “by a jumble of emotions—grief, fear, doubt, exhaustion, panic, confusion and shock.” Having instructed Gargan and Markham “not to alarm Mary Jo’s
friends that night,” Kennedy returned to the ferry with the two men, and then “suddenly jumped into the water and impulsively swam across, nearly drowning once again in the effort, returning to [his] hotel around 2 a.m. and collapsed in [his] room.” Kennedy then asked the people of Massachusetts to decide whether he should resign: If at any time, the citizens of Massachusetts should lack confidence in their Senator’s character or his ability, with or without justification, he could not in my opinion adequately perform his duties, and should not continue in office. The opportunity to work with you and serve Massachusetts has made my life worthwhile. So I ask you tonight, the people of Massachusetts, to think this through with me. In facing this decision, I seek your advice and opinion. In making it I seek your prayers. For this is a decision that I will have finally to make on my own.
Cause of death John Farrar, the diver who recovered Kopechne’s body and captain of the Edgartown Fire Rescue unit, asserted that Kopechne did not die from the vehicle overturn or from drowning, but rather from suffocation, based upon the posture in which he found the body and its position relative to the area of an ultimate air pocket in the overturned vehicle.

It’s a flat, unbroken quiet, void of what he thinks are normal shipboard noises — voices calling, Navy-issue soles clomping by at a run, the rush of fluid in pipes. Above all else, the bang and roar of the catapult a few yards away as the Hellcats go off like ungainly birds, rolling and yawing in the launch wind. Feathers says they may take on new aircraft when they go to Hawaii in a
few months, something with a gull wing. Tommy can’t imagine such a creature. In the meantime there are launches and landings to practice, this time in the Caribbean. The deep-sea swells are long and commanding and compared to them the Chesapeake seems a pond. Tommy’s guts have quieted somewhat, but now and then they remind him that he’s still on probation. Now there’s dark and quiet. He has no idea where he is, knows only that it’s as black as it is silent — near-total darkness, lit only by the radium hands of his alarm. Then Tommy realizes whose cabin he’s in: it’s Kraweski’s, the chief navigator. Correction — former chief navigator. Now Kraweski the arrested, Kraweski the imprisoned, Kraweski the repatriated. Soon to be Kraweski the cashiered. Tommy swings his feet over the side of his bunk and rubs his eyes. Four a.m., end of the dog watch. He’s on duty in half an hour. He senses the movement of the ship. Nice even motion: no oncoming chop, no wallowing down wavetrains, no storm swell at all. Feathers said the Trinidad high should hold all month. It’s the Ides now, mid-January, and so far Feathers has nailed it. It’s been day on perfect day for two weeks, and Tommy Atkinson has a farmer’s tan. He snaps on a light and looks around him. Not bad at all. Two portholes for fresh air and a view. Better yet, he’s twice as far away from the Christ-afflicted catapult pistons. Best of all, he’s the whole length of the ship away from the kerosene tanks and munition stores, which means he’s as safe as anyone gets in a carrier. Tommy yawns and stretches. He hasn’t slept so well in weeks. He’s clad in a towel with one hand on the door latch when he remembers he doesn’t have to shuffle down the companionway to use the head. The chief navigator’s cabin is its own small suite: not just bunk and shelves but head and desk as well. A hundred and thirty square feet of privacy in a ship that gives Continues on page 34>

November 15, 2012 THE MILITARY PRESS 33
From Our Readers To the Publisher: I have enjoyed your November 1st issue of Military Press, especially the article, “Eliminating God,” by Doug Hagin. In the late 1970s I directed a project at Fort Bragg, North Carolina, called the Army Data Distribution System (ADDS) Experiment. My on-site contractor representative from the Science Research Institute (SRI) was a retired Marine Corps Colonel named Doug Hagin. I would appreciate it greatly if you could contact the author of the article and determine if he is the same Doug Hagin. If so, I would also appreciate it if you could gibe him my address and phone number, and ask that he contact me. He was one of my favorite people. Many thanks. I am planning to keep my money in America by going to a ball game with a tattooed prostitute that I meet at a yard sale and drink beer all day. Sincerely, Billy R. Lawson Colonel, U.S. Army, Retired To the Publisher: Thanks for publishing the article by Doug Hagin. It was right on point. The situations he mentioned are why
I wrote Supernatural & Strange Happenings in the Bible: An Engineer Looks at Scripture. Six publishers offered to take this title but their contracts required me as the author to take on much of the cost for initial layout and production. I’ve written seven books for other publishers several years back and published several dozen books [on small business pricing] myself through my company. So I am self-publishing this work (even if this title is outside the genre of books I normally produce). The forces of evil are working overtime trying to push all of us away from God and any religious reality. And millions of people are concerned, if
not downright frightened about the End of Time scenario for next month. After 10 years research, I’m not, and I wrote this book to explain that the evil in this world can’t win over the forces of good. God is about to kick — and I’m thrilled to be here to see it. Thanks for printing “Eliminating GOD.” Another good article in a terrific publication. Robert Brenner, MSEE, MSSM LCDR USN (RET) (Mustang) To the Publisher: Doug Hagin’s article is very disturbing, but not surprising. I won’t argue the fact that many people need to be more sensitive to the feelings of
others. As a child, I heard my parents use terms that definitely would be considered offensive today, but knowing who they were, I can say without hesitation that they were not racists and they meant no offense by their comments. But, we, as a society have gone overboard. We can’t say prayers in school or have Christian pictures on the wall. The ten commandments are not permitted to be displayed in our government buildings. The next thing you know we’ll have to remove “In God We Trust” from our money. My guess is that these restrictions are indeed offensive to we who believe in God and his teachings. But, who’s fighting for our rights. It’s the minority that rules. We offend them if we say or do certain things, but if they offend us, who cares. There’s something wrong with this line of thinking. Maybe the majority better start speaking up for themselves before we lose everything. I think God is watching and wondering when we will do what is right in his eyes. Thanks for your article in the Military Press. Respectfully, Michael F. Rager

Continued from page 33 its crew an average of one-fifth that amount. Tommy smiles as he takes the first private piss he’s had since rejoining the Navy. Up on the flight deck it’s cool and delicious. The only breeze seems to be from ship’s way. A month ago off Delaware, he thought he’d never be warm; here in the British West Indies, he’s thankful the minute the mercury goes below ninety. In all his years in the Navy, Tommy will never get used to how he’s jinked around from climate to climate. A shape looms up and touches its hat. Tommy returns the salute. He knows Feathers even when it’s too dark to see a face. Good morning, sir. Another fine day in the wings. Fine for launching or just for fishing? Calm’s no good to us, Feathers. Carriers need wind. It won’t be perfect, sir, but it shouldn’t be bad. Two months till trade winds but we’re close on Andros Island so we’ll get a land breeze soon. Nothing yet though, says Tommy. That’s correct, sir. Oh-seven-hundred is my guess. Morning, gentlemen! Captain Schaeffer says. Discussing the weather? Of course, sir, says Feathers. Too soon since landfall to talk about women. Lieutenant Mason thinks we’ll be good to launch in two hours, sir. You’ve verified our position? Shot Polaris the minute I got on deck, sir. We’re where we should be. To your usual half-inch, Tommy? Tommy grins unseen. Yards anyway, sir.
Good, good. Keep me briefed, both of you. Schaeffer returns their salutes and leaves for the bridge. Great class, sir, Feathers says. Tommy looks at him. Cassidy and Schaeffer, Feathers says. Both Annapolis ’09. Tommy nods. It was a great class. An hour later a red sun leaps from the ocean and Air Group Fifty stands ready to fly. Four by four, two per elevator, the TBMS and Hellcats of CAP 1 rise from the hangar deck. Salt air grows thick with hydrocarbons as the engines fire. Tommy spots Ensign Ander and swaps a grin and thumbs-up. The land breeze appears as promised and the launches go like clockwork, just as they did on the Chesapeake. The tbms race by on mock torpedo runs. They lock on the con island, come in low, and sheer off just before impact. Strange when you think about it, sir, says Feathers. Any one of those little bitty aircraft could sink this great big ship in seconds. Not if I direct AA fire, Lieutenant. Feathers smiles, says nothing. At oh-ten-hundred the recoveries start, TBMs followed by Hellcats. Plane after plane descends and is secured. Ander, as always, floats down like a balloon. Then there’s trouble. The final Hellcat comes in high and is waved off by the flagman. It climbs, circles, comes in for another pass, and descends. Shit, says Feathers. Too fast, too fast. Why is he . . . Feathers speaks quickly. Sir? Face down on the deck please?
Tommy frowns. Lieutenant, this is no time — Get the f**k down! Feathers hits Tommy hard between his shoulder blades. Tommy’s on deck in an instant, Feathers beside him. Left cheek upward, right cheek against steel, Tommy sees the final fighter try its second landing just as Bataan rises on a wave. The Hellcat overshoots the arresting cables, smashes to the deck with a sound of snapping metal, bounces high, strikes hard again, and breaks in half. Its aft end slews sideways, tears through a wire-rope safety net as if the cables are knitting wool, and vanishes overside. The fore end of the Hellcat, engine racing for the anticipated waveoff, bores ahead at ninety miles an hour and strikes the island. The Hellcat’s fuel tanks explode. Tommy feels the heat like a flatiron pressed against his face. Men are yelling; someone’s triggered an alarm. The smoke above the flight deck changes from blue to black and there’s a smell like roast meat and acetone. Slowly, Feathers and Tommy stand. Tommy feels helpless. Christ, Feathers says. Tommy can’t speak. The Hellcat’s forward section has just chewed through a five-man fire team with its prop at full revs. Excerpt from TOMMY: A World War II Novel by William IIlsey Atkinson © 2012 by ECW Press.
