What compensation are you entitled to if your flight is delayed or cancelled?

everal thousand Canadians are dealing with delayed flights due to a technical problem at Sunwing Airlines Inc., leaving some stranded and others out of pocket as they try to return from or take trips abroad. The Toronto-based airline company said a network outage with its check-in systems provider has grounded many flights since Sunday afternoon. As a result, the company has to manually check-in travellers for their flights, writing boarding passes out by hand. The technical issue has stranded travellers and delayed the start of vacations for others, leaving many wondering what rights they have is situations like these. In Canada, air passengers can potentially be compensated for flight delays and cancellations under the Air Passenger Protection Regulations (APPR). If a flight is delayed or cancelled and the reason is within the airline’s control and not safetyrelated, travellers are entitled to “a specific standard of treatment, compensation, and rebooking or a

refund” under the APPR. CTVNews.ca breaks down what rights passengers have when a flight is delayed or cancelled and how to go about getting compensation. When are passengers entitled to compensation? According to the APPR, passengers are entitled to compensation if a flight is delayed for more than three hours for an issue that is within the carrier’s control, but not related to safety. Under the federal rules, airline are liable for expenses or damages caused by the delay of a flight, unless the airline can show that it has taken all reasonable measures to prevent what happened. This applies to all flights to, from and within Canada, including connecting flights. What kind of compensation are passengers entitled to? At least 20% of Canadian MPs hold rental, investment real estate amid housing crunch

t least 65 Canadian members of Parliament hold rental or investment real estate assets, according to their filings with the federal conflict of interest commissioner. However, that number may actually be much higher because 91 MPs either have not yet completed their disclosure process or the conflict of interest commissioner’s office hasn’t yet published their filings. All of that is legal and all of the MPs disclosing the assets have fulfilled their duties under Canadian conflict of interest laws to report their assets to the federal conflict of interest commissioner. Yet their disclosures come at a time of growing scrutiny and frustration

about the role of real estate investors in fuelling the country’s housing unaffordability crunch. The Spiritual Significance Of The Last Ten Nights Of Ramadan

R

amadan is a month of spiritual cleansing and purification for Muslims in which we try to increase our worship, good deeds and acts of charity. The last ten days and nights hold even more significance as Allah shows great mercy to His creation. They are a chance to benefit from the immense blessings of Ramadan and seek salvation before the month comes to an end.

Seeking Laylatul Qadr

Laylatul Qadr, the Night of Decree or Night of Power, is one of the most sacred nights in the Islamic calendar. It takes place in the last ten days of Ramadan and was the night in which the Qur’an was revealed to the Prophet Muhammad (peace be upon him). It is also believed to be the night in which Allah shows great mercy to His creation and the night in which one’s fate is decreed. Allah says in the Qur’an, “The Night of Decree is better than a thousand months,” (Qur’an, 97:3). The Prophet (peace be upon him) said, “Whoever prays on Laylatul Qadr out of faith and sincerity, shall have all their past sins forgiven,” (Hadith, Bukhari and Muslim). Sincerely praying for forgiveness, reciting the holy Qur’an, sending salawat (blessings upon the Prophet) and offering optional (nafl) prayers are examples of beneficial acts of worship on these nights.

The exact date of Laylatul Qadr is unknown, although it is thought to occur on an odd night in the last ten days of Ramadan (e.g. the 21st, 23rd, 25th, 27 or 29th night). The Prophet Muhammad (peace be upon him) said, “Seek it in the last ten days, on the odd nights,” (Hadith, Bukhari and Muslim). When Lady Aisha (may Allah be well pleased with her) asked the Prophet (peace be upon him) “O Messenger of Allah, if it is Laylatul Qadr, then what should I supplicate with?” he replied with the famous dua: “Allahumma, innaka Afuwwun Karimun, tuḥibbu al-afwa fa‘afu anna” – “O Allah, indeed You are Pardoning and Generous; You love to pardon, so pardon us.”

Performing i’tikaf

Many Muslims choose to spend the last ten days of Ramadan in seclusion (i’tikaf), where one solely focuses on worshipping Allah and refrains from involvement in worldly affairs. It is a time to reflect, increase worship and to increase one’s religious knowledge, seeking closeness to Allah. The sunnah is to remain in i’tikaf for ten days but as a minimum it can be one day and one night. I’tikaf is a great opportunity to reconnect with Allah in solitude. It is also a time to implement good religious practices which can be carried on throughout the whole year. This seclusion usually takes place at the

in need. It is a contribution towards the greater good of all humanity, connecting the giver in bonds of concern and equality with all others. Generally, one would think that Zakat or charity is beneficial to the receiver only, however, in Islam the benefits of Zakat go both ways. Zakat means “that which purifies”, and acts as a purification of your

or Muslims, the month of Ramadan is a time of reflection and commemoration and although we’re all focused on this opportune time for blessings, we’re also looking ahead and anticipating the approaching climax of our fasting. Quite literally, Eid means a “festival” or “feast” in Arabic but the Eid being discussed here is one of two major Eids in our Islamic calendar. A threeday-long celebration, Eid alFitr is known as the lesser Eid, in comparison to Eid al-Adha, but they both recognize, celebrate, and recall two distinct events that are significant to the history and story of Islam. Eid al-Adha, celebrated the day after the completion of Hajj, commemorates Prophet Ibrahim’s devotion to Allah (SWT) and specifically his willingness to sacrifice his son Ismail when commanded by Allah (SWT). Because of this, Eid al-Adha is the festival of sacrifice in which we slaughter and distribute animals which is the act of Qurbani. Our main focus though is on Eid al-Fitr which means “the feast of breaking the fast”. In this instance, the fast we refer to is Ramadan, the month of fasting in which the revealing of the Quran to the Prophet Muhammad (SAW) occurred. Although Eid al-Fitr concludes the holy month of fasting, it’s important to realize its values. In my opinion, one’s spiritual condition which Ramadan improves

significantly is one that should be maintained. If it is a result of devotion, prayers, and attention to detail while fasting, those attitudes should be maintained on and well past Eid. On Eid, it is valuable to reflect on your own spiritual condition and improvement and to resolve not to lose or perhaps not even improve, but certainly maintain it to seek higher spiritual development. Because it succeeds the month of fasting, this Eid is also seen as a celebration of Allah’s provision of strength and endurance. While we take the time to reflect and rejoice, it is also a time for charity or Zakat, and this is not opinion but simply a crucial pillar of our religion. Eid is meant to be a time for joy and blessing for the entire Muslim community, therefore also a time to distribute one’s wealth. Even prior to or subsequent to Eid, charity to the poor is a highly emphasized value in Islam that is simply highlighted in this time of celebration. Now, these two to three lively days of celebration for Eid usually start with the special Eid prayer which is a significant event, especially in our community. Not only does it strengthen your faith and is notably more rewarding, but reading in congregation benefits one in connecting with your community. Often, the mosques in our area take to the outdoors to accommodate the multitudes of Muslims that join their com-

munity in performing the prayer. Muslims are encouraged to continue worship and to seek forgiveness on these days but other than that, most practices vary from country to country. Even in the lower mainland, traditions are very diverse. A common event is Chaand Raat which literally translates to “Moon Night” and is a large event set up in preparation for the moon sighting for Eid. Stalls are set up to sell and buy clothes and jewelry, get mehndi done, and overall come together as a community to celebrate the end of Ramadan. Regardless of material activities that vary from community to community, the biggest aspect of Eid is to come together as a people, an Ummah. Moreover, Ramadan is a grand time for earning blessings and doing good deeds, and a simple way to continue that onto Eid and afterward is by following Sunnahs. Sunnah is the ways of the Prophet (SAW) and includes everything down to what he said, did, and approved of. These Sunnahs are from the Hadith, recorded and preserved by the companions of the Prophet (SAW). Although we are not required to follow the Sunnah, we will be rewarded for it if we do, for we will be imitating and following in the footsteps of our Prophet (SAW). on the Day of Eid al-Fitr unless he had eaten some dates.” This can clearly be interpreted to suggest that the Prophet ate dates before going to Eid prayer and it is, therefore, Sunnah to do so. Additionally, a footnote in this hadith: Anas also narrated: “The Prophet (SAW) used to eat odd numbers of dates.” So eating an odd number of dates is also Sunnah, not necessarily just before going to Eid prayer. As Muslims, Sunnahs are almost like shortcuts for us to gain more blessings as SubhanAllah, Allah (SWT) has made it easy for us to improve our faith. On Eid day, and the ones that follow, observing Sunnahs is an accurate and useful way to continue to reap rewards even after Ramadan. To conclude, Eid is an important day for us Muslims not only for celebrating but also for reflecting and holding ourselves accountable to the standards we set during Ramadan. Often, we find ourselves becoming forgetful or lenient with the caliber with which we practice our beautiful religion. Sometimes, we need only a reminder so let this Ramadan guide you, and may we all continue to be pious during this month, the next, and all the rest we are fortunate to see.

Speaking with reporters at a news conference in Waterloo, Ont., Wednesday morning, Prime Minister Justin Trudeau said the reported spike in hate crimes in Canada can be linked to the COVID-19 pandemic and greater political polarization. Mr. Trudeau was asked about the federal government’s plans to increase funding toward anti-racism infrastructure in Canada in light of recent attacks at Ontario mosques. This past weekend, five men were attacked in a drive-by shooting outside a mosque in Scarborough, Ont. Last month, a man wielding an axe and bear spray attacked worshippers at Dar Al-Tawheed Islamic Centre in

Mississauga, Ont. No one was harmed. The April 2022 budget announced $85-million in funding over five years related to a new anti-racism strategy and combatting hate. It also announced $11-million over five years for a special envoy on preserving Holocaust remembrance and combatting antisemitism, as well as a special representative on combatting Islamophobia. “Over the past years, we’ve seen a rise in hate crimes, a rise in intolerance and racist acts. Part of it is the pandemic, sure, and the stress and the anxiety that comes from that, but a part of it is a trend toward greater polarization in our politics, greater intolerance in our communities,” Mr. Trudeau said. The increase compared with a gain of 5.7 per cent in February, and was the highest reading since inflation hit 6.9 per cent in January 1991 when the GST was introduced. Fuelling much of the increase in March were higher prices at the pumps as gasoline prices rose 39.8 per cent compared with the same month one year earlier. Statistics Canada said the consumer price index would have been up 5.5 per cent year-over-year if it had excluded gasoline from its calculations, suggesting far broader price pressures. The agency said prices were driven higher in March on the back of the country’s hot housing market, supply-chain constraints and the war in Ukraine that has affected prices for oil and food. By Habeeb Sohail Al-Aidroos The second great Islamic event that took place in Ramadan was Fatah Makkah (the conquest of Makkah) on Ramadan 20, 8 AH (630 AD) when Muslims victoriously entered the city after being forced into exile for eight years and after 21 years of long struggle. This event marked the ultimate victory of the Islamic forces in Arabia and marked the beginning of a new era in the history of mankind. The conquest of Makkah takes one even further back in time. Prophet Ibrahim (peace be upon him) and his son Ismael had purified and raised the foundation of Bait-Allah, the House of Allah, the Ka’bah in Makkah, for the sole worship of Allah. Later the people degenerated into shirk (polytheism), associating partners with Allah. The Arabs started believing in hundreds of gods and goddesses, and kept stone idols in the Ka’bah. On the eve of the conquest, Abu Sufyan adopted Islam. When asked by Prophet(SAW), he conceded that the Meccan gods had proved powerless and that there was indeed “no god but Allah”, the first part of the Islamic Prophet’s confession of faith. In turn, Prophet(SAW) declared Abu Sufyan’s house a sanctuary because he was the present chief, and that all the others were gathered over his territory, therefore: “Even he Who enters the house of Abu Sufyan will be safe, He who lays down arms will be safe, He who locks his door will be safe”.

“Allah has made Mecca a sanctuary since the day He created the Heavens and the Earth, and it will remain a sanctuary by virtue of the sanctity Allah has bestowed on it until the Day of Resurrection. It (fighting in it) was not made lawful to anyone before me. Nor will it be made lawful to anyone after me, and it was not made lawful for me except for a short period of time. Its animals (that can be hunted) should not be chased, nor should its trees be cut, nor its vegetation or grass uprooted, nor its Luqata (most things) picked up except by one who makes a public announcement about it.”

Bear in mind that for any one who is slain the blood money is a hundred camels. People of Quraish, surely God has abolished from you all pride of the time of ignorance and all pride in your ancestry, because all men are descended from Adam (A.S), and Adam (A.S) was made of clay.” Then Prophet(SAW)turning to the people said:“O Quraish, what do you think of the treatment that I should accord you?” And they said, “Mercy, O Prophet of Allah. We expect nothing but good from you.” Thereupon Prophet Muhammad‫ ﷺ‬declared: “I speak to you in the same words as Yusuf (peace be upon him) spoke to his brothers. This day there is no reproof against you; Go your way, for you are free.” Prophet’s(SAW)prestige grew after the surrender of the Meccans. Emissaries from all over Arabia came to Medina to accept him. Ten people were ordered to be killed: Ikrimah ibn Abi-Jahl, Abdullah ibn Saad ibn Abi Sarh, Habbar bin Aswad, Miqyas Subabah Laythi, Huwairath bin Nuqayd, Abdullah Hilal and four women who had been guilty of murder or criticising Prophet (SAW) or had sparked off the war and disrupted the peace. However, they were not all killed; Ikrimah lived to adopt Islam and fight in future battles among Muslim ranks. Of the two singing girls who were outlawed by Prophet(SAW) one was slain but the other spared because she converted to Islam. Ibn Abi Sarh had been granted protection under Uthman ibn Affan (May Allah be and pleased with him) and when he initially refused to take the mandatory oath of allegiance to Prophet(SAW) the bystanders still did not kill him, much to the regret of Prophet(SAW). Ramadan is therefore more than just the month of fasting or personal piety. Firefighters were called to the two-storey heritage home at 1112 Caledonia Ave. at 1:15 a.m. and immediately found the mother clinging to a second-storey window as the house burned. “The flames were going from the ground level all the way to the roof,” Victoria fire battalion chief Doug Carey told CTV News. “There was also a female occupant of the house clinging to the window ledge on the left side of the house here.” Firefighters attacked the flames with water while others got a ladder up to the window and rescued the woman from the ledge. “The father ran down the stairs through the flames to escape the house,” Carey said.

“The mom woke up the children, took them into the one bedroom and shut the door behind her and then passed one child through the window to dad below, then another child down.”“The third child didn’t wait,” Carey said. “She jumped and was injured slightly on her way down.” Vyshnevskyy said his eldest daughter was treated in hospital for cuts she sustained from broken glass.

Someone is going door-to-door in Kelowna, claiming to be collecting money for a cancerrelated charity and then pocketing the cash, police say. Mounties are warning the public about a scam reported in the Okanagan city

They were told the man, who called himself “Ella,” said to residents he was raising money on behalf of a cancer foundation. It was reported that the man, who was about 25 and spoke with an “Eastern European accent” was particularly pushy, and said he would only accept cash.

He was wearing a blue and yellow jacket and jeans at the time, officers said in a news release Tuesday. It is unclear what he planned to do with the “donations,” or whether he made off with much money. Police said they were called by someone who got suspicious and refused to hand over any cash. The quick-thinking potential victim called a reputable cancer foundation, and a spokesperson confirmed to them that the foundation doesn’t do any in-person fundraising. Officers are warning the public to take the time to “do your homework” and find out if a cause is legitimate before making a donation.

Any suspicious persons or activity can be reported to the RCMP at 250-762-3300. The Kelowna detachment pointed those looking to learn more about scams to a provincial government website with links to the Canadian Anti-Fraud Centre and the Better Business Bureau. The province warns that a person who falls for a scam may never be able to get their money back, so the best defence is education. Those who’ve been a victim of fraud are asked to report it. Khan said she initially thought someone had fired shots into her home, but later discovered her house’s front windows were smashed. She told CBC that police arrived shortly after

she called 911, and that Surrey RCMP gathered evidence at the site, including CCTV footage from her home that showed three people using baseball bats to smash the windows. Surrey RCMP has confirmed with CBC that there is a mischief investigation underway in relation to the incident, but declined to comment further. This is not the first time Khan has been on the receiving end of hate. In June 2018, several shots were fired at her vehicle while she was driving in Surrey near 176th Street and Fraser Highway. Liberals must remove red tape to bring families of Afghan interpreters and collaborators to Canada

The federal government is further delaying the process which could cost more people their lives OTTAWA. NDP Critic for Immigration, Refugees and Citizenship Jenny Kwan called out the Liberal government for requiring Afghan interpreters and collaborators to complete even more bureaucratic red tape before they can bring their families to safety in Canada. Only days after the interpreters held a protest and hunger strike to highlight the already frustrating and lengthy process in March, the government requested even more documentation from their family members seeking asylum. “Afghan interpreters and their families have gone through enough,” said Kwan. “Just days after their protest, the government decided to complicate the process even more for these Afghan interpreters and their family members threatened by the Taliban. While the families flee for their lives in Afghanistan, the government is burying their loved ones with more onerous paperwork. For some, this may as well be a death sentence.” In an email to Afghan interpreters, the government says they have 30 days to submit additional documents, or their families’ applications may be refused. The families have already submitted abundant documentation to Immigration, Refugees and Citizenship Canada (IRCC) when they first applied. Now, eight months later, the government is putting up more hurdles for the families. Justin Trudeau’s Liberals need to make good on

their promise to bring the families of Afghan interpreters to safety in Canada. “Former Afghan interpreters are part of the Canadian military family — they deserve recognition,” said Kwan. “They have already gone through layers and layers of vetting and security checks when they served with Canadian troops. The Canadian military has vouched for them with certifications. At the Special Afghanistan Committee, all the former interpreters said that they will vouch for their family members. If the government doesn’t stop with this bureaucratic red tape, more lives will be lost.” The NDP is calling once again on the Liberals to waive the documentation requirements, issue single travel journey documents to the family members to reach a third country and, from there, organize evacuation flights to reunite them with their loved ones in Canada. The NDP is also calling on the government to waive the refugee determination requirements and allow Afghans to apply for the special immigration measures from within Afghanistan.

Challenges for press freedom in Kashmir

ashmiri journalists are already working in a dangerous environment and under a climate of fear, given the various threats they face from multiple actors. This climate of fear has been exacerbated also by state surveillance, police questioning journalists about their reporting, and criminal and anti-terror cases that have been filed against journalists,” Committee to Protect Journalists. It was on this day that the United Nations adopted one of its first major achievements, that is known as the ‘Universal Declaration of Human Rights’ (UDHR). The Assembly proclaimed the Declaration: “a common standard of achievement for all peoples and all nations.” Included in the Declaration is the ‘Freedom of Movement.’ The clear trend of modern history is towards greater individual freedoms. The guarantee to move freely throughout one country or in this global village is one of the greatest individual freedoms man has ever had. There are different levels of freedoms. But perhaps the purest expression of freedom is that of movement. This is exactly what the Berlin Wall exemplified. The Berlin Wall was not a defensive barrier nor an obstacle to keep enemies of Germany out, but it was a wall to keep ordinary citizens belonging to the same family away from each other. Fortunately, that Berlin Wall has crumbled. It does not exist anymore. But we still have many more Berlin Walls with different names like one known as Cease-fire Line in the occupied State of Jammu and Kashmir. The European Community has realized the importance of freedom of movement and has passed legislative measures guaranteeing this very important right. These measures seek to abolish national discrimination by member states and to ensure that a citizen of any of the European Community can live and work without restrictions in the member state of his choice. Europeans now pass and move freely country to country. Gone are the security check points and the border patrol guards. The Europeans have realized that freedom of movement is fundamental to all economic freedoms. It is difficult for people, like the people of the

tormented land of Kashmir, to comprehend the real significance of declarations, such as that ours is a global village, where we must abide according to the Charter of the United Nations, the Universal Declaration of Human Rights and its principles. To them, these principles, and these slogans are never real. The reality is otherwise because people are arrested as along as their tormentors please and there is no recourse to legal defense. In such cases, the United Nations remains a silent observer, procrastinating on enforcing its will, especially so when the affected people are insulated from the civilized eye. How can I ask the people of Jammu & Kashmir to repose their trust in the principles of the United Nations; how can I ask them to believe in the Universal declaration of Human rights; and how can I make them believe in this right to ‘Freedom of Movement’, when they see that those who violate the will of the United Nations are not placed under the economic and political pressure that is specified by Article 13 (2) of the Universal Declaration of Human Rights and Article 12 (2) of the International Covenant on Civil and Political Covenant. The United Nations Human Rights Council has to examine whether or not the behavior of a member state is in accordance with the pledge it made under Article 55 and 56 and is justified in “a democratic society.” When one examines the state’s actions in the light of the United Nations pronouncements, then many more questions arise as to its commitment to protecting the freedom of movement. The UN Human Rights Committee that was established by a 1966 human rights treaty, has expressed that states are liable under the Political Covenant for violations of a person’s rights recognized in that Covenant and committed by its agents in the territory of another state. The United Nations and its affiliated organizations have a stake in the substance of this right – Freedom of Movement - in Indian Occupied Kashmir. Since 1947, the people of this land have been unable to avail of their right to internal and transnational movement. Instead, they have suffered the pain of four displacements, expulsions, exiles and refusals to return. The Kashmiri refugees, overshadowed by international crisis, from

Syria to Afghanistan to Myanmar to Ukraine, say the world has forgotten them. And, like refugees everywhere, they say one of their worst trials is uncertainty. In Indian occupied Kashmir, an ominous pattern of violations of the right to freedom of movement is taking place. As these are occurring in the course of an armed conflict in the exercise of the right to selfdetermination, international scrutiny is imperative. Violations of the right to freedom of movement by the Indian forces can be characterized as breaches of the Fourth Geneva Convention in addition to breaches of international human rights law standards. Dr. Nazir Gilani, President, JKCHR says, “There is a special guarantee of freedom of travel including the lawful entry and exit given in the UN Security Council Resolution of 21 April 1948. Travel of the local inhabitants and of many others to and from the Valley has come to a standstill. So much so that Indian administration has denied the request made by the officials of the office of the UN High Commissioner for Human Rights to visit the Valley.” Here are a few examples of violations of the right of freedom of movement occurring in Jammu & Kashmir. Jammu and Kashmir is one political and geographical entity divided artificially by a ceasefire line which has come into existence as a result of intervention by the United Nations. 2. Movement of one and all is restricted when an entire locality is put under, what is locally known as a crackdown in Kashmir. Entire locality is besieged by the Indian army during cordon and search operations. When the entire male population of an area is detained at a particular place, in the open, sometimes in sub-zero temperatures, sometimes extreme heat, rain without food and water for the whole day which may even extend to parts of night. 3. land. There have been many occasions where vehicles have been fired upon by the Indian army killing and injuring people while in travel. 4. Movement to the hospitals too has got restricted as the Indian army has not and does not spare these institutions too. 5. Passports are denied selectively. Some political leaders have not been given passports even to receive medical treatment outside India or simply to travel to other countries. We urge the UN Human Rights Council to apply the ECOSOC Resolution 1990/78 that was adopted on July 27, 1990 to the benefit of those who have been denied their right of freedom of movement, forced to take refuge elsewhere, displaced from their homes, exiled and expelled from their homelands, examples; Dr. Ghulam Nabi Mir of the United States, Nazir Ahmed of the United Kingdom, Dr. Mubeen Shah who is residing these days outside India and many others. We call upon the United Nations and all its agencies to provide a coordinated response in alleviating the conditions of these people without any delay. We also appeal to the UN High Commissioner on Human Rights, in the name of humanity and justice to help stop these atrocities and listen to cries of anguish and pain of the innocent people of Kashmir. Islamic Relief Canada Hosts Annual Grand Iftaar for Orphans in Need. Surrey, British Columbia – Islamic Relief Canada hosted their annual Grand Iftaar at Surrey Riverside Banquet Hall, Sunday April 17th, with keynote speakers Mufti Aasim Rashid and Ustadh AbdelRahman Murphy from Qalam Institute in Dallas, Texas. Islamic Relief Canada hosted its staple Ramadan event for the first time in two years after pandemic restrictions eased for British Columbia. Apart from fundraising for

orphans, the venue hosted a series of displays where families can enjoy their time and be educated about Islamic Relief ’s work at home. Upon entry guests were met with Disaster Response Coordinators controlling the crowd and handing masks, and a series of outfits that corresponded with the ways people can volunteer with the organization. It should be noted that 90% of Islamic Relief ’s volunteer base locally is 18-25. With the help of Allah and support of the community and 450 attendees, the fifteen minute fundraiser by the former CEO of Is-

lamic Relief Canada and staffer from Islamic Relief UK, was able to support 301 orphans annually, and fundraised enough for a micro dam in Africa that will support thousands every month. Islamic Relief ’s 1:1 orphan sponsorship program provides sustainable support through medical care, higher education, and monthly support for necessities. A yearly subscription for each orphan includes reports carried by local field offices for safeguarding and who also carry out assessments of the orphan’s livelihood situation prior to dis-

tributing funds, and the ability to visit the orphans/ forward gifts throughout the year (free of overhead costs). Some background, we have over 41 active volunteers who have been preparing for this fundraising for over 3 months. We had over 100 volunteers who worked tirelessly on

the day of who distributed over 2,000 food boxes across the Lower Mainland. They also made the event happen at the Musallah. isa Homes Vancouver welcomed its guests at Afghan Chopan on April 14 for a community Iftar. Nisa Homes is a not-for-profit charity that provides a safe haven and support services for women, with or without children, who are fleeing domestic violence, poverty or seeking asylum. The event began with the recitation of Holy Quran by Sheikh Nabil Khan of BCMA who explained the importance of giving for the sake of Allah SWT. He mentioned that every cent you give is between you and Allah. Think whatever money you give today; it won’t bother you tomorrow. When you give to an organization like Nisa Homes, you are giving someone shelter, food, life. He also discussed a hadith of Prophet Muhammad (SW) according to which the best moment to give charity is when you are in between two states: You see that you can invest this money, you can benefit from it or you don’t want to part from it because you think you my need it for something in future. (Hadith). The next speaker of the event was Aisha Amijee, founder of Voices of Muslim Women (VMW). Aisha opened up about her own personal experiences and highlighted the importance of having support systems like Nisa Homes that can help

Abuse is an ongoing issue and the community has to think about putting adequate resources in place such as accessible counselling and mediation services which can prevent situations from escalating and provide the needed help at an early stage of a conflict. At the end, Sh. Nabil Khan made a dua for everyone at the Iftar and in the community and encouraged everyone to donate.

arwin’s theory, ‘Survival of the Fittest’ can be translated into Machiavelli’s political theory by saying, ‘The best amongst the cooks has the right to rule.’ Machiavelli was an Italian Philosopher, his book, ‘The Prince’ published in 1532 is said to have been a bed side table read for Napoleon, Stalin, Zulfiqar Ali Bhutto, Senior Bush and many other great leaders of the world. Machiavelli identified virtue as Power and justified engagement in necessary evil when it was advantageous to maintain power. An ideal ruler, according to him; is ruthless, and upon recognizing traps must be to be a fox and a lion to scare the wolves. His overall philosophy is simple: “The ends justify the means.” Recently deposed Prime Minister of Pakistan, Mr. Imran Khan is advocating a case of foreign intervention by the USA in ousting him from the office. It is also true that the United States of America has a rich recorded history of regime change in Latin America, the South West Pacific and in many other countries around the world. The American involvement in Pakistan is not yet confirmed though, but Imran Khan has brilliantly blown it up to an extreme by taking advantage of an anti American sentiment. Khan has touched extreme popularity figures over night not only in Pakistan, but also in many countries around the world. On 30th March, Khan pulled out a piece

of paper from his pocket and waived it to a huge crowd gathered in Islamabad. He claimed that the paper was evidence of an international conspiracy hatched to topple his government. The said letter was written on 7th March, a day before the No Confidence Motion against Khan was filed in the National Assembly. According to Khan, “The letter stated that the no-confidence motion was being tabled even before it was filed, which means the Opposition was in contact with them.” This is also correct that no one else other than the top leadership of the opposition in Pakistan was aware about the time of filing the motion. Khan alleged that the letter contained details from a meeting between Pakistani Ambassador and his team in Washington with the Assistant Secretary of the State Department, responsible for South and Central Asian Affairs and other members of his team. Khan called it a conspiracy against him as the letter stated that if the no-confidence motion against Khan passes then Pakistan will be forgiven and if not then there will be consequences for Pakistan. Following reasons for throwing him out of office by the U.S.A. were furnished by the supporters of Imran Khan: a) During June 2021, in a TV interview with Jonathan Swan on HBO, Imran Khan responding to a question of providing bases to the CIA said, “Absolutely Not” Imran Khan’s response, ‘Causes Stir’ reported the BBC. b) In December 2021, Imran Khan declined an invitation extended by the U.S.President Joe Biden to a Summit for Democracy of 110 countries. c) On February 6th, 2022, Prime Minister Imran Khan and Russian President Vladimir Putin visited China for the Winter Olympics games. The games were boycotted on diplomatic level by the USA, Britain, Australia and Canada. d) On February 24th 2022, Russia carried out a full-scale invasion of Ukraine after a

few hours of arrival of Imran Khan in Moscow. Pakistan abstained from voting against Russia in the United Nations Assembly. The letter is now confirmed to be genuine as a demarche was sent to the US Foreign office when advised by the National Security Committee in Pakistan. The Committee concluded that the contents of the letter used undiplomatic language and it amounted to blatant interference in the internal affairs of Pakistan not acceptable under any circumstances. Imran Khan has taken advantage by propagating foreign intervention and regime change practices of the U.S.A. Masses in Pakistan displayed strong anger against the U.S. intervention and came out on Khan’s call in such a humongous manner that might had even surprised him. A Machiavellian fox move of Khan rejected and disallowed the no-confidence move by the Deputy Speaker relying on Article 5 of the Constitution of Pakistan. Faces of the opposition leaders were seen hanging long in complete shock and humiliation. Asif Zardari and Shahbaz Sharif considered master crooks of Machiavelli’s political arena were outsmarted by someone better than them. Fast declining popularity of Khan, due to his poor governance and economic incompetence took a sharp climb because of American intervention theory presented by him. Immediately after the rejection of the no-confidence motion, Khan, at regaining his full Prime Ministerial powers dissolved the National Assembly and announced fresh election within 90 days. There couldn’t be a better than now time for him to opt for election. In a later development, The Chief Justice of the Supreme Court of Pakistan considered it a constitutional crisis and took a suo

moto action. A verdict with a unanimous agreement of 5-0 judges’ order stated the deputy speaker’s ruling to be, “contrary to the Constitution and the law and of no legal effect, and the same hereby are set aside.” The court’s verdict reconvened the session of the National Assembly and Khan was finally voted out of office of the Prime Minister. The US State Department in U.S.A. rejected the claim, “Allegations of US involvement in the no-trust motion and ‘threat letter’ to PM Imran Khan are baseless.” White House also rejected by saying, “absolutely no truth to that allegation.” Now Imran Khan is out on the road demanding immediate election. He needs to slow down on his anti American statements. He has achieved the maxim and now is a time to focus on his demand of an early election. Continuation of anti American slogans would not do any good to his long term programs. Newly formed government of Shahbaz Sharif simply cannot afford to go for election at this point in time. His government is in dire crisis. Prime Minister Shahbaz Sharif has not announced his cabinet till seven days later since taking oath on 11th April. There is a greater possibility of Imran Khan coming back to power with a better majority if the elections are held in near future. He needs to learn from his previous mistakes of arrogance, no negotiation policy with the opponents and self righteousness. Better reasons can be found in having an understanding with the Peoples Party of Zardari and Bilawal Bhutto. Political power game of Pakistani politics is moving in an interesting manner - it is yet to determine the Fox and Lion quality leader or the best crook as described by Machiavelli.

Article 63-A: ‘Is disloyalty to party not dishonesty?’ asks SC judge

S

upreme Court Justice Ijazul Ahsan questioned on Wednesday whether disloyalty to a political party by a parliamentarian was dishonesty and could lead to his disqualification. He raised the questions during the hearing of a presidential reference seeking the apex court’s interpretation of Article 63-A of the Constitution, which is related to disqualification of lawmakers over defection. A five-member bench headed by Chief Justice of Pakistan (CJP) Umar Ata Bandial and comprising Justice Ahsan, Justice Mazhar Alam Khan Miankhel, Justice Munib Akhtar and Justice Jamal Khan Mandokhail, heard the reference. “Is disloyalty not dishonesty?” Justice Ahsan asked PPP counsel Farook H Naek who presented his arguments during the hearing today. He further asked whether a lawmaker could be disqualified over “dishonesty”. Naek replied that “disloyalty” was a strong word, adding that it was not mentioned in Article 63-A. At the start of the hearing today, Naek recalled that Article 58-2(b) — under which elected governments had been sent packing

in the past — was abrogated in 1997 through the 13th Amendment but was brought back by military dictator Pervez Musharraf in 2002. The article was again removed through the 18th Amendment in 2018, he said. Article 63-A was made a part of the Constitution via the 14th Amendment, he said, adding that it gave broad powers to party heads. The Election Commission of Pakistan (ECP) did have not have the authority to reject the party head’s decision prior to a presidential order amending Article 63-A in 2002 that reduced the powers of party heads, the PPP counsel said. The 18th Amendment further reduced the powers of party heads and transferred them to the parliamentary leaders of the parties, he said, adding that after Article 63-A was amended, the authority to make the final decision was given to the SC. “According to the 18th Amendment, the authority to make a decision on a reference related to Article 63-A was given to the ECP.” The amendment also bound the ECP to announce a decision within a month, he informed the court. He contended that the presidential reference seeking the court’s opinion was only related to sub-clause 4 of Article 63-A — which states that a parliamentarian would no longer be a member of the house and his seat would become vacant once the ECP confirms the party head’s declaration stating his defection. Justice Ahsan pointed out that Article 62(1) (f) did not specify the length of disqualification but its interpretation was provided by the SC. Naek responded that lawmakers had not determined the length of disqualification

for defecting lawmakers under Article 63-A. ‘Ticket holders take oath against deviation’ Justice Ahsan remarked that ticket holders swear in their nomination papers that they would not deviate from party policy. Naek said that the rules for punishing a party worker for violating party discipline were underlined in Article 63-A of the Constitution. “Whether it is dishonesty or disloyalty, the consequences of both are underlined in the Constitution,” he said. The PPP’s counsel said that a dissident party member would effectively lose his seat. Justice Munib Akhtar remarked that not abiding by one’s oath amounted to “dishonesty”, adding that a dissident is elected on a ticket from a particular political party. “What is cancer? Cancer is when the body’s cells begin destroying the body,” he commented, adding that deviation from the party had also been called a cancer. The CJP remarked that in four instances, loyalty had been equated to party policy. He added that during the attorney general’s arguments, the court was told that Article 63-A was related to loyalty. “Loyalty is a basic constitutional principle,” the CJP said. “Article 5 states that every party member should be loyal to the state,” he said, adding that “disqualification was a minor matter”. The CJP remarked that the basic purpose of Article 63-A was to ensure loyalty to the party. “When a member says he is part of a particular party in his oath, that means he is bound by the party policy.” Naek argued that a party worker was not a “slave” that he would listen to all directives. Justice Ahsan asked whether government

employees would be considered slaves. “All parties have some rules and regulations which must be followed,” Justice Ahsan said. The CJP went on to say that if a person is qualified on the basis of dishonesty, they would also be disqualified from the next election.“This is not written anywhere in the Constitution,” Naek argued. “Show me where it is written and I will leave the rostrum.” Justice Ahsan said that Articles related to the qualification and disqualification of a lawmaker were not a “wall of fire”. Naek said that loyalty only existed within the monarchy, adding that the people should be allowed to decide who to elect. Justice Ahsan then asked whether Articles 62 and 63 should be removed from the Constitution. Justice Mandokhail noted that a “big punishment” such as disqualification could not be handed down without a trial. He added that an independent candidate who joins the party after winning does not take an oath swearing allegiance to the party. Naek argued that no party member takes an oath to obey all the directives of the party chief. Justice Ahsan remarked that political parties were the backbone of the parliamentary system. “How can the system be run where the backbone is plagued by cancer?” he asked. Naek said dissident members were de-seated but not disqualified. The chief justice observed that Article 63-A had been invoked in only one instance since 1998 which meant that it was not taken seriously by party heads.
