he belief that mankind will rise from the grave, an integral part of the three Abrahamic faiths Islam, Christianity, and Judaism, is not just a myth or wishful thinking but is based on real scientific principles. Rising up from the grave and coming back alive can happen simply with the reversal of time. “When we are dead and have become dust and bones, Shall then we indeed be raised again?” (Quran 56:47) “Man thinks that, We shall not assemble his bones, Yes truly! We are able to restore his very fingers!” (Quran 75:3-4) With advancement in science and technology we tend to see the world from the critical eye of science. We see people dying but no one has returned from the dead to tell us about afterlife. Is it possible to really know that there is life after death other than religious belief? There is a surprising answer which we can have as science has advanced to the point that it is possible to look at the very basis of reality as we know it, the fabric of space and time. There are many questions that arise in our minds. What happens to us on dying? What is soul? Does it leave the body to enter the spiritual world, which is beyond human perception in some other dimension? Are the souls reincarnated entering some other body to be recycled again as in the beliefs of some eastern religions? Is the soul captured and kept somewhere until the Day of Judgment to be reunited with the body that rises from the grave? How can a body that had decayed and disappeared into dust regain its original shape and form? We can believe what we wish; however the modern world is based on truthful pursuit of science. Truth cannot be decided on wishful thinking or majority vote; if that was the case then Columbus would have surely fallen of the earth in 1492. We live in a world that demands proof and is not just content with belief. The belief or even the proof is only for the believer, as belief comes from within our hearts. The greatest of proofs will not satisfy the non-believer, while the slightest evidence can be a great source of comfort for the believer. In this context let us look at the story of Prophet Ibrahim (peace be on him) given in the Quran. (Quran 2:260.) Prophet Ibrahim wanted to know how God gives life to the dead. He had the faith of a man who was willing to sacrifice his own son for the sake of God, yet he wanted reassurance; which then was given to him in the form of a great miracle. Ordinary people like us are also in need of reassurance in

The event being depicted is not some local or earthly event caused by atomic war or natural disaster. The verses appear to describe some great final catastrophe that will affect the whole universe. There is mention of the final earthquake, the darkening of the stars and the sun, the opening of gates in the sky and “a time” in which mankind will see what they had done before so that they will become witnesses against their own selves. Quran appears to be describing reversal of time and gravity.“We warn you of doom at hand. A day when a man will look on that his own hand has sent before, And the non-believers will cry: “Wish that we were dust.”” (Qur’an 78:40) “The earth with the mountains shall be lifted and crushed with one crash.” (Qur’an 69:14) The contraction of the universe with reversal of time and gravity will commence the beginning of the end which may last for thousands and possibly millions of years. We will be removed from the regressing effects of reversed time as we come back alive at the point in time which we had died. A beautiful natural mechanism similar to black holes will create openings or gates in the sky and we will be taken across many dimensions to beyond this universe by the angels of the Grand decent. Everyone will be removed no one will be left behind. “A day when the heaven with the clouds will be rent asunder, And the angels will be sent down, a grand descent.” (Quran:25:25) “...And We gather them together, as to leave not one of them behind.” (Qur’an18:47) IS RESURRECTION A PHYSICAL PROCESS? “It is God, Who sends the winds and they raise a cloud, Then leads it to a dead land and revives the earth after its death.
Such is the Resurrection.” (Qur’an 35:9) Above the resurrection of the dead is compared to physical processes which are based on laws of nature like the growth of plants after rain; this suggests that revival after death is also based on some physical laws. We know that the energy from the sun heats up the oceans and water vapor rises to produce the clouds. Temperature differences cause the winds to blow across the continents carrying clouds to distant lands. Dormant seeds sprout into new plants with life giving rain fall even in the harshest of places. Sometimes in the future as our knowledge of the universe, increases the reality of “The Day of Judgment” may become widely accepted as the truth. Verses in the Quran suggest that the knowledge of the Day of Judgment is within the grasp of human understanding and mankind will become aware of this knowledge. “We shall show them our signs on the horizons and within themselves, Until it will

The universe is so vast that the distances between stars and galaxies have to be measured in “light years,” which is the distance traveled by light in a year at the speed of three hundred thousand kilometers per second. n July 9, after a gap of almost three years due to Pandemic Covid-19, the Eid-ul-Adha Prayer was held at the school ground of Princess Margaret High School, Surrey. Thanks to the determination and dedication of event organizers and the management committee of BCMA’s Surrey Jamea Masjid and Rema Masjid, Surrey. Thousands of Muslims poured in, to perform Eid ul Adha Prayers, the Sunnah Way. A large number of Seniors, Women, Childrens, Adults,Youth from every shape, colour, creed and language came together for one reason only, to commemorate the Quranic tale of Prophet Ibrahim’s willingness to sacri-

Lankan meltdown lessons
HE spectre of the Sri Lankan situation has come to haunt many a developing nation facing serious economic challenges. After an economic meltdown, the South Asian country is now witnessing the unravelling of its political system. A mass uprising triggered by rising commodity prices has forced the government out. But the crisis is far from over. As a financially bankrupt country, which doesn’t even have money to import oil and other essential commodities, Sri Lanka is now negotiating with the IMF for a bailout package and seeking financial help from various countries. It needs some $6bn urgently just to keep itself going until the end of the year. The massively indebted country has already defaulted on its external loan repayments making it harder for it to salvage the situation. What led to Sri Lanka’s economic collapse is obvious. Crippled by the shortage of foreign exchange, the country has not been able to pay for imports of even essential commodities such as fuel. In fact, the crisis had been building up for many years as the country piled up foreign debts to the tune of $51bn. A large part of the foreign loans was reportedly spent on huge non-productive infrastructure projects. Meanwhile, flawed economic policies made things worse. While struggling to service the loans, the economic crunch aggravated due to the Covid-19 pandemic. Tourism, which has been the mainstay of the Sri Lankan economy, was the most affected by the prolonged lockdown, greatly diminishing the island’s foreign exchange earnings. in incidents of terrorism and economic and political instability. Consequently, its currency collapsed by 80 per cent, making imports much more expensive. Food inflation rose to 57pc.
The Sri Lankan turmoil is a classic example of an economy caught in an acute debt trap. The Sri Lankan turmoil is a classic example of an economy caught in an acute debt trap, while failing to boost its revenues. Indeed, political corruption, too, played a role in the country’s financial collapse. Now the IMF is the last hope for the country of 22 million, but aid will not come without stringent conditionalities that may increase the hardship of the people. In fact, a bailout by itself won’t provide a long-term solution, which requires undertaking fundamental structural reform to resuscitate the economy. There are many developing countries, including Pakistan, which confront a similar predicament. We may not be in Sri Lanka’s shoes yet, but are not very far off as there are some comparable symptoms. With negotiations with the IMF apparently inconclusive, and the much-awaited financial support from friendly countries yet to come, the country is not in a good state. Without an IMF deal, no international financial assistance will come in. The government may have taken some hard decisions, such as raising fuel prices and increasing taxes, but it seems that not enough has been done to satisfy the IMF which has hardened its position. Time is certainly running out for the government, with the coming debt-servicing obligations.
Foreign exchange reserves are fast depleting. The country needs some urgent help for its external debt-servicing obligations that are projected to be $23bn in 2022-2023. What is most alarming is the component of rising commercial loans. In the next five years, the country will have to repay, on account of amortisation and the mark-up amount owed by the public sector, a sum of $49.23bn. It is an extremely alarming situation, with no signs of any fundamental change in economic outlook. We may not be facing an imminent threat of default, but the prospect is certainly staring us in the face. It could become a reality if we don’t take timely action to stem the rot. The situation has gone beyond the usual patchwork job that we have been doing for so many years. It is not just the external debt but, mainly, the ballooning internal debt that has brought the country close to bankruptcy. The major problem is that we have been living for a very long time beyond our means and have been borrowing money even to run the state. Dependence on foreign aid has further crippled our ability to stand on our own feet. Unfortunately, no government, military or civilian, has made any effort to solve this perennial problem. With the tax-to-GDP ratio hovering at around less than 9pc, the country will remain trapped in perpetual financial crises. What makes the situation even more untenable is the fact that a major chunk of the budget is going towards debt repayment and defence. There is little information available on the defencerelated component of external debts.
Heavy domestic borrowing at very high interest rates is at the heart of the macroeconomic crisis faced by the country. That has also been the reason for our becoming a permanent client of the IMF. The stringent conditionalities that come with bailout packages also shackle economic growth. Meanwhile, population explosion has made it harder to feed the increasing number of people in the country, making us more reliant on the import of food items. All that needs a long-term approach to deal with the economic challenges that cannot be resolved through taking makeshift measures and seeking bailouts from external sources. It is becoming increasingly apparent that there is a limit to our resort to the ‘begging bowl’ and that even ‘friendly countries’ are reluctant to help. We cannot continue to cash in on our geostrategic importance for long. Moreover, perpetual political instability, a deteriorating internal situation and the higher cost of doing business have discouraged the flow of direct foreign investment in the country. True, our exports nominally increased last year, but this was not enough to address the increasing current account deficit. Some external factors such as the rise in petroleum and commodity prices may have also contributed to worsening the crisis, but it is mainly our policy flaws that are now coming to haunt us. ‘A very difficult decision’: PM Trudeau defends returning Russia-Germany pipeline turbines
Prime Minister Justin Trudeau is defending Canada’s decision to grant a two-year Canadian company an exemption to federal sanctions, allowing them to return turbines from a Russian pipeline that supplies natural gas to Germany. The prime minister said that while it was “a very difficult decision,” Russia is trying to “weaponize energy as a way of creating division amongst the allies,” and that Canada’s move was made to help Germany in the short-term as it and other European countries work to reduce their reliance on Russian oil and gas. “Canada has been one of the strongest countries in the world in standing with Ukraine,” Trudeau said during a press conference in Kingston, Ont. on Wednesday, vowing the continuation of support such as sanctions, while citing the billions of dollars in military and humanitarian aid offered to-date. The turbines, part of the Nord Stream 1 pipeline, were sent to Siemens Canada in Montreal for repairs, but once the federal government imposed sanctions on Russian state-owned energy company Gazprom, the company was restricted from sending
Petroleum levy to stay unchanged at Rs10 per litre ISLAMABAD: On Prime Minister Shehbaz Sharif ’s explicit instructions to reduce the price of petroleum and products in line with the reduction in their international price the Finance Division on Wednesday moved a summary seeking up to 15 percent reduction in petroleum prices with effect from July 16 – one day prior to the 20 by-elections to be held in Punjab that would determine the fate of the Punjab government. As usual, the final decision in this regard will be taken by the Prime Minister. “Any reduction in the price of petroleum and
products will be in line with the IMF agreement with the Petroleum Levy (PL) remaining unchanged at 10 rupees per litre while the reduction in the international price will be passed onto the consumers”, an official of Petroleum Division told Business Recorder on condition of anonymity. At present the PL on petrol stands at Rs10 per litre, on HSD, SKO and LDO at Rs 5 per litre each while sales tax is zero. National Assembly has approved a rise in the maximum limit of PL from Rs 30 per litre to Rs 50 per litre to achieve the budgetary target of Rs 750 billion in Finance Bill 2022-23. Sources in Petroleum Division told this correspondent that it the government is unlikely to fetch Rs 750 billion from PL in the current financial year at the current PL rate as that would enable a maximum collection of Rs14 billion per month. Additionally, a revenue shortfall of Rs 45 billion per month would be experienced if the 17 percent general sales tax (GST) is not slapped on these products. Source: dawn.com

No slowdown yet in U.S. inflation, as rate rises to 9.1% in June
Cost of living went up by 1.3% in the month of June alone.
The U.S. annual inflation rate defied expectations and rose to a new multi-decade high of 9.1 per cent in the year up to June. The U.S. Bureau of Labour Statistics said Wednesday that the cost of living rose by 1.3 per cent in the month of June alone, and in three of the past four months. Rising costs for gasoline, shelter and food were the main drivers of the annual uptick.
Energy prices have increased by 41.6 per cent in the past year. Food costs are up by 10.4 per cent. Shelter costs are up by 5.6 per cent. Economists had been expecting the rate to decline slightly from the 40-year high of 8.6 per cent reached the month before, but instead it ticked even higher, reaching its highest point since 1981. Royce Mendes, an economist with financial services conglomerate Desjardins called the numbers “red hot” and says they will likely compel the U.S. central bank to raise its lending rates even more aggressively in the coming months, upping its rate by 0.75 of a percentage point in August and again in September. “The Fed will take some relief from the fact that commodity prices and market-based inflation expectations have been falling recently. ne of the things that held me back from pursuing my dreams for many years was fear of failure … and the lack of self-confidence that I needed to overcome that fear. It’s something we all face, to some degree, I think. The key question: how do you overcome that fear? By working on your self-confidence and self-esteem. Without really thinking of it in those terms, that’s what I’ve been doing over the years, and that’s what helped me finally overcome my fears, and finally pursue my dreams. I still have those fears, undoubtedly. But now I know that I can beat them, that I can break through that wall of fear and come out on the other side. I’ve done it many times now, and that success will fuel further success. Taking control of your self-confidence If you are low in self-confidence, is it possible to do things that will change that? Is your self-confidence in your control? While it may not seem so, if you are low in self-confidence, I strongly believe that you can do things to increase your selfconfidence. It is not genetic, and you do not have to be reliant on others to increase your self-confidence. And if you believe that you are not very competent, not very smart, not very attractive, etc. … that can be changed. You can become someone worthy of respect, and someone who can pursue what he wants without negativity You can do this by taking control of your life, and taking control of your self-confi-
prove your competence, your self-image, you can increase that self-confidence, without the help of anyone else. 1. Groom yourself. This seems like such an obvious one, but it’s amazing how much of a difference a shower and a shave can make in your feelings of self-confidence and for your self-image. There have been days when I turned my mood around completely with this one little thing. 2. Dress nicely. A corollary of the first item above … if you dress nicely, you’ll feel good about yourself. You’ll feel successful and presentable and ready to tackle the world. Now, dressing nicely means something different for everyone … it doesn’t necessarily mean wearing a $500 outfit, but could mean casual clothes that are nice looking and presentable. 3. Photoshop your self-image. Our selfimage means so much to us, more than we often realize. We have a mental picture of ourselves, and it determines how confident we are in ourselves. But this picture isn’t fixed and immutable. You can change it. Use your mental Photoshopping skills, and work on your self-image. If it’s not a very good one, change it. Figure out why you see yourself that way, and find a way to fix it. 4) Kill negative thoughts. Goes handin-hand with the above item, but it’s so important that I made it a separate item. You have to learn to be aware of your selftalk, the thoughts you have about yourself and what you’re doing. When I was running, sometimes my mind would start to say, “This is too hard. I want to stop and go watch TV.” Well, I soon learned to recognize this negative self-talk, and soon I
my life: I would imagine that a negative thought was a bug, and I would vigilantly be on the lookout for these bugs. When I caught one, I would stomp on it (mentally of course) and squash it. Kill it dead. Then replace it with a positive one. (“C’mon, I can do this! Only one mile left!”) 5) Get to know yourself. When going into battle, the wisest general learns to know his enemy very, very well. You can’t defeat the enemy without knowing him. And when you’re trying to overcome a negative self-image and replace it with selfconfidence, your enemy is yourself. Get to know yourself well. Start listening to your thoughts. Start writing a journal about yourself, and about the thoughts you have about yourself, and analyzing why you have such negative thoughts. And then think about the good things about yourself, the things you can do well, the things you like. Start thinking about your limitations, and whether they’re real limitations or just ones you’ve allowed to be placed there, artificially. Dig deep within yourself, and you’l 6) Act positive. More than just thinking positive, you have to put it into action. Action, actually, is the key to developing selfconfidence. It’s one thing to learn to think positive, but when you start acting on it, you change yourself, one action at a time. You are what you do, and so if you change what you do, you change what you are. Act in a positive way, take action instead of telling yourself you can’t, be positive. Talk to people in a positive way, put energy into your actions. You’ll soon start to notice a difference.
7) Change a small habit. Not a big one,
like quitting smoking. Just a small one, like writing things down. Or waking up 10 minutes earlier. Or drinking a glass of water when you wake up. Something small that you know you can do. Do it for a month. When you’ve accomplished it, you’ll feel like a million bucks. 8) Focus on solutions. If you are a complainer, or focus on problems, change your focus now. Focusing on solutions instead of problems is one of the best things you can do for your confidence and your career. “I’m fat and lazy!” So how can you solve that? “But I can’t motivate myself!” So how can you solve that? “But I have no energy!” So what’s the solution? 9) Smile. Another trite one. But it works. I feel instantly better when I smile, and it helps me to be kinder to others as well. A little tiny thing that can have a chain reaction. Not a bad investment of your time and energy. 10) Be grateful. I’m a firm believer in gratitude, as anyone who’s been reading this blog for very long knows well. But I put it here because while being grateful for what you have in life, for what others have given you, is a very humbling activity … it can also be a very positive and rewarding activity that will improve your self-image. Surrey Mayor Joins Vancouver Bohras’ Canada Day Celebrations

oug McCallum, Mayor of the City of Surrey, was Guest of Honor at the Canada Day celebrations of the Dawoodi Bohra community of Vancouver. After a recital of the Holy Quran, the Vancouver Bohra community’s leader, Huzeifa Hamid, reminded everyone that the Dawoodi Bohras adhere to Prophet Mohammed’s saying that love and devotion towards one’s country are part of the faith. He informed Mayor McCallum that, “If there is anything the community can do towards the betterment of the City of Surrey, we would be happy to help.” An introductory video on the Dawoodi Bohras preceded a presentation by Mr. Khozema Khambati on the community’s activities over the last year. Mayor McCallum commented how Surrey is both multicultural and the fastest growing city in BC. He noted how people from all over the world are welcome to live in the vibrant city of
Surrey. He described how knowing your neighbor is an important part of Surrey life, and the role of the City is to build the infrastructure to keep its community members safe. “I can see in your eyes how excited you are,” the Mayor said, “and it is nice to see all the pleasant faces with smiles. We want to work and learn from each other. Canada is a Great Nation with a strong history. It is a real pleasure to be here today.” The Mayor commended the community on their tree planting activities, part of the Dawoodi Bohras’ global Project Rise initiative, saying that caring for the environment was important and helps to keep our communities healthy and active. Putting Islam into your Child’s Summer Fun

very spring, school-age children practice their counting skills-the daily count down before summer break. Children view summer as a time of carefree play, little responsibility, and little structure. But is this the best course for parents to treat their children’s summer vacation? Children who attend school during the academic year are used to 180 days, 8 hours a day; 5 days a week structured environment. Therefore, the summer can be boring for a child if left in a totally unstructured environment. In addition, with a little creativity there are endless opportunities for incorporating fun learning activities that utilize Islamic concepts into a child’s summer days. These activities can range from Islamic day-camps and trips overseas to parent organized activities with other Muslim children within the same community. We have all heard of children who have memorized the Qur’an at a young age in traditionally Muslim countries; but how many of us have heard of a child in the West accomplish this task? The merits of obtaining Islamic knowledge in the Qur’an and Sunnah are numerous. The Qur’an states,“...Allah will exalt in degree those of you who believe and those who have been granted knowledge...” [58:11]. It is imperative that the parents teach their children Islamic knowledge. Furthermore, because of the additional time, summer provides an excellent opportunity for families and children to focus on obtaining Islamic knowledge. While this includes Qur’an, Arabic, prayer, and fasting, it also includes such necessary items as learning Islamic Adaab (manners) and Akhlaaq (moral development). Another important issue is that
children also need to be provided with Islamic activities that incorporate socializing with other Muslim children. After all, socialization is an important part of childhood. It can also play an important role in the development of a child’s overall Islamic identity. Dr. Hamdan believes that socializing with other Muslim children over the summer is especially important for the child attending public school. “This may be the only time for children attending public school to socialize with other Muslim children.” This re-emphasizes that it is essential that parents monitor what types of experiences are available for their children. Brother Riyad also suggests that parents need to make the effort to participate in their children’s activities. With parental participation, activities tend to run much smoother. Furthermore, parents participating in their children’s activities provide the perfect opportunity for parents to have fun with their children while leaving behind the usual dayto- day routine of every day life.

While book work and classroom instruction is an important part of acquiring Islamic knowledge for children, so is learning about Islam through life experiences. For some parents who have the financial means, traveling overseas to visit relatives, perform ‘Umrah, or attend summer Arabic language programs are methods of acquiring Islamic knowledge. Two years ago, brother Atif Sawaie discovered that when he took his five-years-old son Raji to Jordan, Raji’s Arabic language skills improved 30% during his one-month visit. “When he first went to Jordan he know very little Arabic. At the end of the visit he was able to communicate most of his needs to our family in Arabic.” One of the reasons for Raji’s dramatic language growth was his interaction with other children. While initially there was a small degree of language miscommunication between the children, by the end of the visit any problems from language differences
were nonexistent. Furthermore, Raji viewed the trip as being very positive and a lot of fun. Brother Atif very strongly recommends traveling overseas with your children. He believes that this is his son’s best chance to learn Arabic. Other positive learning experiences included learning both Islamic manners and Arabic culture.
Plan Organized Community Activities
A sister living overseas once described the United States as the “land of Islamic conferences.” If traveling overseas is not an option, perhaps a family vacation at an Islamic conference or camp would help family members acquire Islamic knowledge and experience an Islamic environment. Many national organizations hold mini-conventions, workshops, or camps during the summer months. These camps tend to focus on the fun activities while maintaining an Islamic environment and experience. According to brother Riyad Shamma the benefits of an Islamic environment are tremendous for the child. “An Islamic environment brings out the very best in people,” he said.
Plan your Own Activities
While some parents opt for trips overseas, organized Islamic camps, or attend Islamic conferences, the majority of parents end up planning their own children’s activities for the summer. For most, the typical summer activities and day trips include going to the zoo, parks, library, museums, and other historical attractions. It is possible to incorporate Islamic concepts in these activities. It just takes a little creativity and organization. Furthermore, with some additional planning, why not expand your activities to include other children within your community? For example, why not plan a picnic at the park for several families in your community. Besides the usual activities that center around food and free play- several mothers could plan an activity for the children that utilizes an Islamic theme (i.e., Qur’an recitation or a game that relies on Islamic knowledge). Another meaningful activity is to organize an Islamic Scouting Troop for your community. Other activities which may be of interest for
older children is to donate their time and energy to improving their local communities. Such activities could include tutoring English to non-English speaking brothers and sisters, cleaning the Masjid once a month, or grocery shopping for a sick Muslim. These types of activities help lay the foundation for children to learn the importance of helping our fellow Muslims. Planning group activities for youth is not as complex as it is seems. The key is organization and cooperation of several other community members. Finally, it is time to develop a plan of action with attainable deadlines. It is important to plan activities in advance in order to work out any unexpected problems. Planning and implementing plans does not have to be an adult-only adventure. Try to involve the children as much as possible. This is especially important for the teenagers. When motivated, they have good ideas about what activities would benefit them not to mention they tend to be very zealous planners. More importantly, by involving older children in the process you are teaching them valuable skills in organization and planning which they can utilize in the Ummah as adults. In conclusion, Summer lends itself as a perfect time for family activities. Use this opportunity to acquire Islamic knowledge, do righteous deeds and have fun at the same time? The benefits are enormous. Besides creating stronger family bonds, it may also gain additional blessings and good deeds for the Day of Judgment. One obtains the benefits from the activity by the intention put into the activity. From Umar ibn al-Khattab who said that Allah’s Messenger said, “Actions are according to intentions, and for every person is that which he intended. So he whose migration was for Allah and his Messenger, then his migration was for Allah and His Messenger, and he whose migration was to attain some worldly goal or to take a woman in marriage, then his migration was for that which he migrated.” (Bukhari). Suri’s unilateral ruling did not enjoy parliamentary immunity: SC
SLAMABAD: The Supreme Court has issued a detailed judgement explaining the reasons behind its decision to set aside a controversial ruling by the National Assembly speaker on April 3 that dismissed the noconfidence motion against then prime minister Imran Khan. In the verdict authored by Chief Justice Umar Ata Bandial, the top judge stated that by dismissing the no-confidence motion against Imran Khan, Mr Suri prima facie breached his constitutional duty. Justice Bandial said the April 3 ruling failed to qualify for protection of the internal proceedings of parliament under Article 69(1) as it was “not the outcome of a vote in the national assembly instead, it was a unilateral decision”. Justice Bandial observed that the controversial action by the deputy speaker triggered a chain of events, the most concerning aspect of which was that it allowed the then PM to claim the constitutionally repugnant outcome of avoiding the no-trust motion without a vote by the assembly. The court’s foremost priority was the maintenance of constitutional order which could only be achieved if the assembly was restored, Justice Bandial added.
Cypher not shown to court
Justice Bandial, while referring to the cypher used by Mr Suri to dismiss the motion against Imran Khan, explained that the text of the cypher was not shown to the apex court, though its contents were partially disclosed in the detailed reasons issued in support of the deputy speaker’s ruling. The detailed reasons in addition to cabinet decision of April 2 acknowledged the need for an inquiry to establish the alleged collusion between the opposition and a foreign state.“Such an inquiry into facts can, in the first place, be carried out either by a commission constituted by the federal government under the 2017 Act or by a specialised commission constituted under an Act of parliament or an ordinance,” Justice Bandial observed. The PTI’s plea that the apex court should take suo motu over the defence of national security and allegation of breach of sovereignty was without precedent, the ruling explained. Moreover, the opposition members who filed the notice were granted leave to move the motion against the then PM on March 28, crystallised the constitutional right and obligation for there to be a vote under Article 95(2) on the motion. This right/obligation cannot be defeated or
curtailed except by a vote on the floor of the assembly, the ruling said, adding: “Since the deputy speaker’s ruling unilaterally refused the right of vote granted by the constitution, no immunity under Article 69(1) attaches to it and the same can be reviewed by the court.”
High treason
Meanwhile, Justice Mazahar Alam Khan Miankhel, who retired on July 13, in his additional note observed that the exercise of authority was a sacred trust which was violated by the president, then PM, the then speaker, the then deputy speaker and the then law minister. “Whether these acts attract Article 6 of the Constitution (high treason) is also left open to be determined by the parliamentarians to ponder should they leave open the doors for such unconstitutional acts or take suitable measures to stop such like mess in future,” Justice Miankhel suggested. The elected representatives of the people were prevented from voting on the resolution and for such blatant transgression of the Constitution there must be consequences and the law must take its course, Justice Miankhel added.
‘Doctrine of necessity’
Justice Jamal Khan Mandokhel, in his additional note, observed that the action of the deputy speaker was biased, on the basis whereof, if permitted to hold fresh elections, would amount to giving licence to an authority to misuse the extraordinary power of the doctrine of necessity. This country has already experienced misuse of the doctrine of necessity by the hands of unconstitutional forces time and again, which were legitimised by the apex court, but it did not achieve the desired results, he added. Rather, the democracy suffered a lot because of misuse of the doctrine of necessity, Justice Mandokhel observed. PTI moves ECP against ‘rigging’ ahead of Punjab by-elections

he PTI on Wednesday filed a petition in the Election Commission of Pakistan (ECP) against “pre-poll rigging” ahead of the by-elections on 20 Punjab Assembly seats scheduled for July 17. The petition, a copy of which is available with Dawn. com, was filed by PTI’s Omar Ayub Khan. The petitioner stated that he was actively participating in campaigning for the upcoming polls when he observed “numerous irregularities and things that are impeding fair and impartial elections”. He highlighted that the electoral watchdog was bound to conduct free, fair and transparent election in accordance with the law. Highlighting 19 constituencies where byelections are to be conducted, he alleged that voter lists had been altered while voters had been “reshuffled” in violation of the Election Commission Act, 2017. “One of the most egregious examples of their illegality is electoral roll/voters list of PP-140 Sheikhupura. In this constituency, final electoral
roll/voters list issued, dated May 20, was after the announcement of [the] election schedule, which again is a violation of the law.” The petition stated that the total number of voters as per the lists issued in 2018 and 2020 was 2,239 and 2,875, respectively, which rose to 5,573 in May 2022. “This sudden increase is ambiguous and casts serious doubts on the transparency of [the] upcoming by-elections.” The petitioner said that the way things stood in the province, “no free, fair, transparent or impartial elections” could be held. He alleged that officials, on the directives of the “acting government”, were “taking notes and interfering” with the upcoming by-polls.“A prime example is of DC Rajanpur, who can be seen campaigning with PML-N candidates which is a clear violation of both ethics and Section 187 of the Election Commission Act, 2017.” He also alleged that the Jhang district police officer had clearly been posted to commit “pre-poll rigging” while the government’s candidate
for PP-07 was offering bribes to voters in an effort to influence them. ‘Govt shifting blame of pre-poll rigging onto establishment’ Addressing a press conference in Lahore later in the day, PTI leader Fawad Chaudhry reiterated the party’s claim that pre-poll rigging was being conducted prior to the bypolls. He alleged that the party’s candidates and workers were being harassed by the police, who were acting on the directives of the provincial government. He claimed that the provincial government was trying to portray as though it was receiving “orders from above”.“The establishment should beware of the snakes up their sleeves such as Attaullah Tarar and Rana Sanaullah. They are carrying out [raids] and putting it on the establishment.” Fawad went on to claim that the government had planned pre-poll rigging in some areas and later tried to shift the blame onto the establishment.
