DIMAPUR, FEBRUARY 9 (MExN): The Nagaland Tribes Action Committee (NTAC) today cautioned that the clock is ticking for the end of the deadline for the Nagaland State Chief Minister, TR Zeliang to step down honorably. It warned that at the expiry of the deadline, “the people of the state will be left with no other option but resort to the most extreme step and the consequences arising, out of it will be borne entirely by TR Zeliang and his Cabinet.” A press note from the NTAC said that “dialogues and amicable solution that TR Zeliang suggests are all over.” The only option to bring normalcy to the chaotic situation, it stated, now depends on the wisdom of the Chief Minister. The NTAC further stated that “whether TR Zeliang enjoys the support of the majority of MLAs or not or whether he joins any other Political Party is not our look-out but what the Tribal Hohos demand is that TR Zeliang steps down from the office of the Chief Minister for causing three deaths, leaving many injured and burning down of several offices.” The NTAC termed it “absurd”

NBCC meets NTAC Meanwhile, the Nagaland Baptist Church Council (NBCC) held a discussion with the Nagaland Tribes Action Committee (NTAC) on February 9 at the NBCC office. As a spiritual body, the NBCC is equally concerned about the situation now and on the fate of the society if the CM does not step down as demanded by the people, mentioned NTAC. The discussion mainly focused on the overall scenario and apprehensions if precautionary measures are not made before the deadline expires, informed the NTAC further adding that the NBCC has highlighted its role as a neutral party and that of a mediator/reconciliatory approach. The NTAC will also be meeting the Governor tomorrow at 3.30 pm.

DIMAPUR, FEBRUARY 9 (MExN): Nagaland Chief Minister, TR Zeliang today explained the “ground reality” of the on-going face off between the NTAC and the Government, and the ensuing Bandh which has affected the normal day to day life, to the Union Home Minister Rajnath Singh at New Delhi this evening. The Joint Coordination Committee (JCC) has rejected the one-man Judicial Inquiry Commission (JIC) instituted by the Nagaland state government to probe the incidence of violence, which occurred in Dimapur on January 31. “The JCC and NTAC utterly reject the one man JIC as a one-man Commission cannot comprehend the magnitude of the violence of January 31 across the state,” stated the JCC today. Stating that the one-man JIC be scrapped, the JCC demanded that the state government institute “atleast a three-man Commission” of which one member should be an “eminent person from the non governmental organisations” independent of any government influence. It added that the scope of the inquiry commission should not only be confined to Dimapur but should include all and any incidence of violence across the state in relation to the ULB elections fiasco and “ought to act impartially so as to meet the ends of justice.” Before the JIC as de-

manded is set in motion, the JCC further demanded that the state government suspend the former Commissioner of Police, Dimapur and Superintendent of Police, Longleng and other officials responsible. Responding to the statement of the Nagaland Legislative Assembly Speaker, the JCC termed it as an “insult to the Naga people.” Stating that the Speaker’s role should be neutral, the JCC held that the NLA Speaker by making such a statement has tarnished the “good office of the Speaker.” “All the 60 MLAs are elected by the people and from among the elected representatives the Chief Minister is selected. The Speaker should bear in mind that the post of the CM is not chosen from outside the 60 elected representatives.” Stating that the basis of democracy is the people, the JCC reiterated that the state government should not ignore the voice of the Naga public. With regard to the 3-day ultimatum, it cautioned that in the event the state government failed to meet the demands, the government will be held responsible for any consequences that arises thereof. KUD disassociates from Khiamniungan Tribal Council Dimapur, February 9 (mexN): The Khiamniungan Union Dimapur (KUD) today informed in a press statement that it disassociates with immediate effect from the Khiamniungan Tribal Council along with Vice President and all designated Khiamniungan Tribal Council officials from Dimapur base “owing to the misunderstanding in the matter related to ULB election meeting on January 16, 2017 of the Khiamniungan Tribal Council meeting held at Noklak.” Citing reason for the decision, KUD Executive Chairman C. Shangjeu and President B. THE NAGALAND MUNICIPAL (THIRD AMENDMENT) ACT, 2016 An Act further to amend the Nagaland Municipal Act, 2001 Be it enacted by the Nagaland Legislative Assembly in the fifty-seventh year of the Republic of India as follows: Short title and commencement: 1. (1) This Act may be called the Nagaland Municipal (Third Amendment) Act, 2016. (2) It shall come into force at once. Amendment of Sections 23A and 23B 2. In sections 23A and 23B of the Nagaland Municipal Act. 2001 (as inserted by the Nagaland Municipal First Amendment Act, 2006), the words "Scheduled Castes" and the connected phrases and provisions relating to reservation for Scheduled Castes, shall be omitted. Omission of section 120(1) (a) 3. (i) Entry (a) in sub-section (1) of section 120 of the Nagaland Municipal Act shall be omitted; (ii) All references and operative provisions relating to "tax on lands and buildings", wherever these occur in the Nagaland Municipal Act, 2011, shall be deemed to have been omitted. Amendment of Section 120 (3) 4. In sub-section (3) of section 120 of the Nagaland Municipal Act, 2001, the words "be specified by the Government, by notification," shall be substituted by the words "be proposed by the Municipality and approved by the Government which is to be conveyed by notification,". Omission of sub-sections (4) and (5) of section 120 5. Sub-sections (4) and (5) of section 120 of the Nagaland Municipal Act, 2001 shall be omitted. Amendment of sub-sections (7) and (8) of section 121 6. In sub-sections (7) and (8) of section 121 of the Nagaland Municipal Act. 2001, the words "sanction" and "sanctioned" shall be substituted by the words "approve" and "approved" respectively. Home Government of Nagaland Nagaland: Kohima Statement Several allegations have been levelled against the Chief Minister and the Government that the NBCC and the JCC were betrayed and that we had unilaterally abrogated the January 30 agreement of Chumukedima. As one who was with the Chief Minister to negotiate with the JCC in the presence of the NBCC I feel it is my responsibility to come out with the factual discussions that day. For the sake of convenience and easy understanding by all, the full text of the “January 30th Statement” is reproduced below:

January 30th Statement In the presence of the NBCC (third party), the JCC understand and appreciate the fundamental rights of every voters in Nagaland to participate in the ULB elections. Not withstanding this fact, as a body representing the historical aspirations and rights of the Naga people, the JCC needs two months (subject to Cabinet and State Election Commission decision), with effect from 1st February, 2017, to educate and dialogue with different tribal bodies. It is with this understanding that the JCC request the State Government to postpone the upcoming ULB elections in order to help the JCC to educate the public toward conducting a well-informed election which will promote development and common good of all the Nagas. At the consummation of the 2 months public process, JCC will ensure people’s participation in the conduct of a peaceful ULB elections in the State as stated above (with 33% women reservation). The JCC will call off the bandh subject to the outcome of the final decision of the Nagaland State Election Commission. This, we sign, in the presence of the third party, the NBCC. ***** In the discussions, the Chief Minister and I made it very clear the two of us alone were not competent enough to take the decision to postpone the elections to the ULBs and that the Cabinet would have to take the final call. We also pointed out that even if the Cabinet agreed to postpone, it was further subject to the approval of the State Election Commission. Furthermore, we repeatedly clarified to all that it was a Constitutional requirement to hold elections to the ULBs with 33% reservation of seats for women. And thus, the JCC also agreed to the holding of elections with reservation for women, as contained in the Statement above. On hindsight, the lapse on the part of all the participants was that it was not discussed as to whether the postponement shall cover the entire State or only those towns/ municipalities where the people were protesting against the ULB elections. The JCC went away with the understanding that postponement would be State-wide, and we came back to the Capital with the understanding that postponement would be only for the areas where people were protesting. All said and done, this lapse had happened partly due to the short time available that day and the urgency of the need to arrive at some sort of understanding to avoid physical conflict. This lapse is regretted. No matter what had happened, it is my sincere appeal to all organisations of Nagaland to come forward for dialogue so that opinions and views can be shared and come to an understanding whereby, the present face-off can be resolved at the earliest. At the same time, I also urge non-stakeholders not to mislead or misinform, foment and worsen the misunderstanding or threaten anyone from coming forward for positive dialogue. I would also like to appeal to all not to misquote the NBCC as they have never said that they were betrayed by our CM and the Government as alleged by some quarters. Dated February 9, 2017

Vijay Mallya sacked from United Breweries board neW Delhi, February 9 (aFP): India’s United Breweries has fired indebted beer baron Vijay Mallya from his non-executive chairman role following an order from the country’s market regulator, it said in a stock exchange filing late Wednesday. The UB Group said the Securities and Exchange Board of India (SEBI) has barred Mallya from holding key managerial roles in any listed company. Mallya, who made Kingfisher beer a global brand, was known for his flamboyant lifestyle and styled himself as the “King of Good Times”. He owes banks at least $1 billion, fleeing to Britain last March as pressure grew from banks to pay back the loans. Mallya has repeatedly failed to appear before investigators at the Enforcement Directorate, a financial crimes agency, who suspect him of misusing funds loaned by a state bank. A UB representative did not immediately respond to an AFP email seeking comment. The company’s decision follows Karnataka high court issuing a ‘winding-up’ order on United Breweries Holdings Ltd (UBHL), the firm through which Mallya controlled his once-sprawling business empire, directing an official liquidator to take over all assets. In January, an Indian court ordered a consortium of banks to start the process of recovering roughly $1 billion in loans from Mallya, who refuses to return home from exile. Mallya, who remains a part-owner of the Force India Formula One team, has come to personify India’s problems with bad debts that are piling up on the balance sheets of banks. India placed at 43rd among 45 nations in global innovation index Washington, February 9 (Pti): India ranks abysmally at 43rd out of 45 countries in a global innovation index, according to a report released by US Chambers of Commerce which cited the country’s “anaemic” intellectual property rights (IPR) policy and patent act as challenges to innovation. In the 5th annual International IP Index ‘The Roots of Innovation’ by the US Chambers of Commerce’s Global Intellectual Property Center (GIPC), there is slight improvement in India’s performance -- it was ranked last or next-to-last in the previous four years. “In India, many of the same challenges to innovation remain,” said David Hirschmann, president and CEO of GIPC. According to the 11th annual Cisco Visual Networking Index (VNI), mobile data traffic in India will grow seven-fold by 2021 and mobile video traffic will show an increase by over 11-fold. “Video will be 75% of India’s mobile data traffic by 2021, compared to 49% at the end of 2016 and 3G connections will surpass 2G connections by 2019,” the report noted. It revealed that 59.6 million net new devices and connections were

Between November 10, 2016 and January 13, 2017, the notes in circulation have increased by Rs 6.78 lakh crore, thereby taking the total notes in circulation to Rs 9.1 lakh crore,” Minister of State for Finance Arjun Ram Meghwal said in a written reply in Rajya Sabha. committee absolves Ku President NPF ‘unequivocally’ endorses TR Zeliang

Mon, February 9 (Mexn): An 8 member Fact Finding Committee has absolved the Konyak Union President S. Manlip Konyak from any wrongdoing and stated that “every executive moves of the KU President was found to be in tune to the resolution of the Konyak Union advisory board council.” According to a press release, the committee comprising representatives from the Konyak Baptist Bumeinok Bangjum (KBBB), Konyak Nyupuh Sheko Khong (KNSK), Konyak Students Union (KSU), KU executive & Advisory board had called upon the Mon Unit KU, its advisory board, 11 ward Presidents and the GBs of Mon town on February 8 and meticulously conducted a post mortem of the recent press accusation (dated February 6, 2017) and the demand for ouster of KU President. During the meeting, the President Mon unit KU informed that

his name was appended without his consent, the release informed. Names of the GBs of Mon Town were also dragged in the media without consent, it added. The committee after discovering that the press statement was doctored and not made with the consent of masses outrightly declared the press accusation as “unconstitutional”. “Such act is a direct threat to the constitution of the Konyak Union,” the Committee maintained and added that Konyaks do not appreciate “such instigative game”. “Hence, the Press accusation is proven to be baseless and instead, it was a cruel act that attempt for moral infliction upon a bona fide Konyak leader,” the Committee further maintained. While upholding the unity and integrity of the Konyak society, the committee shouldered the responsibility for press clarification and strictly directed both parties to restrain/

refrain from further justification through press. “Such measures were initiated through mutual understanding, respect and utmost honour on the sanctity of the constitution,” the Committee insisted. The Committee extended its utmost appreciation to the Mon Unit KU office bearers, its advisory board, Ward Presidents of Mon Town for positioning its stance in tune with the constitution of the Konyak Union (KU). “Their assurance for utmost cooperation and supports to the Konyak Union (KU) is truly applauded,” the Committee stated. The Committee also informed that it had restrained the GBs group from issuing press rejoinder despite their “fury” for dragging and politicising its name. “The involvement of GBs was done without its consent and no further complication should arise at the governmental level for dragging its name in the press

media,” the Committee clarified. The Committee further appealed the KU President S. Manlip Konyak to refrain from any form of counter reaction either through press or in any other form. “The issue had been settled in the spirit of forgiveness and oneness,” the Committee stated and on behalf of the entire Konyak populace appealed that Manlip Konyak continue to serve the Konyaks in upholding unity and integrity. Making it known to its citizens that the Konyak Union has its own established code of law, the Committee asserted that instigation for division is “an act of renegades”. Any individual if found deviating from the code shall face the consequence as per the law of the land, the Committee warned and further urged every Konyak to uphold the fundamental duties of preserving and protecting unity and integrity of the Konyak people.

DiMapur, February 9 (Mexn): The Naga People’s Front (NPF) Party today rejected the call for resignation Chief Minister of Nagaland and said that the whole organs of the Party “unequivocally endorsed” the leadership of its President Dr. Shurhozelie Liezietsu and Chief Minister TR Zeliang. We endorsed the stand and statement of the Chief Minister that “there is no reason to resign,” said a press statement issued and appended by all the Central Office Bearers and Frontal/ Cell Organisations of NPF Party to “make its stand clear on the demand for resignation of Chief Minister of Nagaland.” The Nagaland Tribes Action Committee (NTAC), Kohima, and the Joint Coordination Committee (JCC),

A press release from YTC Vice President H. Tsurito and General Secretary L. Chuba informed that YTC Officials deliberated and investigated the matter thoroughly and concluded that the trio was not officially assigned to attend the meeting. As such their attendance is unofficial and devoid of YTC’s knowledge, the release stated. The release mentioned a February 6 meeting where a decision was unanimously taken to extend full support to the Naga tribal Hohos with regard to the present crisis.

The government’s failure to “address and reason to the demand and appeal” of the Tribal Hohos on ULB elections resulted in the current sequence of unfortunate events, NSF implied in press statement by its President Subenthung Kithan and General Secretary Boveio Poukai Duo.

Federation strongly demanded that the State Government should “take moral responsibility and listen to the voice of the people.” “Concede to the demands of the demands of the general public so as to restore normalcy and in delivering justice," it said. Hukavi Zhimomi, has urged all to endeavour to ensure that normalcy returns without any further delay. “Since now the Government has fully fulfilled the demands of the agitators, and the elections to the ULBs declared null and void, it should be the endeavour of every one of us to ensure that normalcy returns to our society without any further delay,” the Parliamentary Secretary urged in a press statement. Zhimomi also cautioned against taking undue advantage of the non-confrontationist approach of the Government. “If the Government of the day uses an iron hand to contain the situation, no one will dare to come out in this manner,” he remarked. According to Zhimomi, a delegation of JCC members met the Chief Minister on January 25. The Chief Minister, according to Zhimomi, informed the JCC that only the Cabinet is competent enough to decide and recommend to the State Election Commission for consideration.

DiMapur, February 9 (Mexn): The Western Sumi Baptist Akukuhou Küghakulu (WSBAK) has expressed deep pain at the present happenings in the Naga society. The stalemate between the leaders of the tribal Hohos and the state government has been going for so long. “This imbroglio should be brought to a logical conclusion. Both the opposing parties must find an amicable solution in a peaceful manner,” a press note from WSBAK Executive Secretary Rev. Dr. Hevukhu Achumi stated. Keeping in mind the welfare of the people, WSBAK requested all stakeholders involved in the recent impasse to come to a meeting point sooner the better. “Contemplating for long will not bring any good for all of us,” WSBAK said while appealing to everyone concerned “in the name of God” to avoid violence and find solution at the earliest. “We request all the churches to pray sincerely for God's intervention,” it added.

Council (NTC) held a meeting today and resolved on several points with regard to the ongoing turmoil concerning ULB elections in the state A press note from the NTC, listing out its resolutions, urged the state government against seeking ordinance exemption from Part IX A of the Constitution of India, without proper preparation. This, it stated “is found not advisable when there had been instances of ratification made to the Act of Municipal and Town Council by Nagaland in the recent past on public demand to modify, rectify and amend whichever Clause or language is found within the purview of State Govt of Nagaland to make necessary correction.” The state government, it said “must not feel very helpless to defend ourselves from incriminating and harmful Act.” Asking for an official notification from the competent authority to declare the ULB election as null and void, the NTC further asserted that the state government must never have election under the Municipal and Town Council Act in the present form until it is ratified as above. The NTC further accused the Nagaland CM of adopting several “anti-indigenous Nagas of Nagaland policies.” This, it claimed, includes the “Rongmei recognition and the attempt to recognize more tribes from outside Nagaland;” at-

tral areas in the foothills in order to give permanent settlement to non-indigenous people from outside Nagaland through Nagaland Special Development Zone (NSDZ);” the move to “barter away our revenue to non-indigenous outsiders and an attempt to rope the rightful land owners by way of making the State and nonindigenous people as land owner… as under Oil and Natural Gas Rules and Regulation Act of 2012;” and removal of suo-motto power of investigation from the State Vigilance Commission. The NTC further stated that the determination of the CM to “cling into his Chair is the source of all frictions, confrontations and the mess we are in now.” It asked the CM to “realize the importance of the voices of the general public,” and “pave the way for peace and normalcy to return to state by demitting his office.” It also asked the people of the state “not to be swayed by emotions if not by reasons,” and urged all to refrain from abetting violence under any circumstances. “Of all there must never be any more bloodshed henceforth,” it added. The NTC meanwhile expressed concern over the block on social media and internet connectivity, which it stated is “depriving the students and unemployed educated youth of online services and other basic communication works which has become our daily usage.”

Public SPace IMPORTANT EVENTS PERTAINING TO ELECTIONS TO ULBs

1. Article 243-T of Part IX -A was inserted in the Constitution of India by the 74th Amendment in the year 1992 providing 33% women reservation for a period of 10 years to empower women belonging to scheduled castes and scheduled tribes in Municipalities and further extended for a period of 10 years in 2012 and will come to an end in 2022 unless further extended. The 74th amendment came into force on 1st June 1993. 2. In the year 2001 Nagaland Municipal and Town Council Act 2001 was passed in the Nagaland Legislative Assembly, however, 33% women reservation which is a mandatory provision in article 243-T Part IX-A was not included . The 1st election under the Municipal and Town Council Act 2001 was conducted in 2004 in the State without 33% women reservation. Mokokchung Town did not participate on the ground that unless the provision for taxation of land and building are omitted/deleted from the Act, they would not allow the municipal election. The rest of the State participated in the election and functioned till 2009. Prior to 2001, the Nagaland State was following the Assam Municipal Act for the town committees of the State. 3. Miss Khetoli filed a PIL in the Gauhati High Court, Kohima Bench calling the court's intervention to include 33 % women reservation as provided by the Constitution of India under article 243-T of Part IX -A. The Hon'ble High Court in a judgement in the year 2005, directed the State Govt. to include 33% women reservation in the Municipal and Town Council Act 2001. The State Govt. accordingly implemented the High Court Judgement by amending the Municipal & Town Council Act in 2006, and 33% women reservation was included in the Act. However, since the tenure for 2004 election is up to 2009 the women reservation of 33% was not immediately implemented. 4. The Naga Mothers Association, Eastern Naga Women Association and Naga Women Hoho, Dimapur gave a representation to the Chief Minister to implement the Court order. However, the Naga Hoho and other tribal bodies opposed the 33% women reservation and elections to ULBs could not be conducted in 2009, and the women groups

were asked to bring court order to implement their demand. Accordingly, Writ Petition in the Gauhati High Court was filed by women groups and the Single Bench of the Gauhati High Court vide order dated 21.10.2011, directed the State Govt. to complete the process of election by 20-01-2012. 5. Government appealed to the Division Bench, and on 31.07.2012 the Division Bench in a judgement set aside the order of the learned Single judge by order dated 31.7.2012. 6. The Govt. on its part constituted a Select Committee headed by the then Parliamentary Affairs and Planning & Co-ordination Minister and as per direction of the then Chief Minister and Legal Advisor recommended that article 243-T infringed article 371-A, and the matter, was referred to the Committee to scrutinise Parliamentary Laws for application to Nagaland and the Committee took up the matter and gave its recommendation to the Assembly. Accordingly on 22nd September 2012, the Nagaland Legislative Assembly passed a resolution moved by the then Urban Development Minister that the article 243-T of Part IX-A is not applicable to State of Nagaland on the ground that it infringes article 371-A. 7. The women group challenged both the judgements of the Division Bench, and the Assembly resolution in the Supreme Court by filing a Special Leave Petition (SLP) in 2014 and the Supreme Court admitted the same and stayed the decision of the Division Bench pronounced on 31.07.2012. The Supreme Court admitted the SLP of the women group on 5th April 2016 and the argument put forward in the affidavit of the SLP stated that 74th amendment and article 243-T supersedes article 371-A. 8. Senior Advocate in the Supreme Court opined that the best option is to go back and arrive at an amicable agreement with the women group to withdraw the case, since the State had also implemented the Act by calling the ULB elections in 2004. The Assembly resolution was merely an expression of intention to do something. 9. The Govt. had a series of discussion and dialogue with the various stake holders

such as Joint Action Committee on Women Rights (JACWR) representing various tribal women organizations for as many as 4 times, and offering them nominations with voting rights. But the women group refused to take nominations, and insisted to have elections as per the provision of the article 243T of the Constitution. 10. The Govt. on its part also have conducted series of consultations with Naga Hohos, ENPO and other tribal hohos. The Consultative meeting was call on 16.11.2016 at Capital Convention Centre with various tribal organizations and to invite necessary suggestions in relation to Municipal and Town Council Act 2001, including 33% women reservation. The Ao Senden suggested the removal of the provision for taxation of land, and buildings, which was accordingly complied by the Govt. The Angami Public Organization (APO) suggested to remove the provision for reservation of seats for Scheduled Castes on the ground that Nagaland State do not have scheduled castes, which was accepted and omitted. It was also agreed that for the proposals for levying of taxes by the Municipal and Town Council and should not be by the Govt. but by the respective Municipal and Town Councils, and Govt. should only be the approving authority was also accepted. 11. On 05.12.2016 in the meeting with the tribal hohos represented by, Angami, Chakhesang, Zeliang, and six tribes of ENPO held in the official residence of Chief Minister, the matter was explained to the 9 (nine) tribes regarding the impending danger of the SLP pending in the Supreme Court, which may lead to the adverse interpretation of article 371-A by the Supreme on account of this women reservation issue. 12. On 17/12/2016 the meeting with the Naga Hoho and ENPO attended by the Ministers and Parliamentary Secretaries in the private residence of Hon'ble Chief Minister at Dimapur, the issue was reiterated including all the impending dangers that may come about, if the Supreme Court give adverse ruling and interpretations of article 371-A. The hohos asked for five minutes separate time. However, since the Naga Hoho, ENPO and other tribal hohos were meeting the NMA

and JACWR on 19.12.2016, they were requested to communicate their decision. However, the tribal hohos could not convince the NMA and JACWR to withdraw the case, or to accept the nomination with voting right. The options before the Govt. become very limited, either to wait for the Supreme Court Judgement or to pre-empt the decisions. The options are:I. To wait for the Supreme Court judgement. II. To pre-empt Supreme Court decision by going ahead with the ULB election. The Government had several rounds of discussion and opted for the Option-II to pre-empt the Court decision by bringing Amendment in the Municipal and Town Council Act 2001 by incorporating 33% Women Reservation when all options to bring about amicable resolutions failed. The Election Commission was accordingly asked to proceed with the conduct of ULB election. The Election Commission accordingly proceeded with the Notification for the conduct of the ULB election. This decision on the part of the Government is aimed at protecting and preserving the sanctity of Article 371-A and thereby avoiding any interpretation of Article 371-A by the Court. 13. The Government intention was solely to protect the article 371-A and decided to go ahead with the elections, but will not force it upon the people. 14. The meeting between the Government and Joint Coordination Committee (JCC) on the intervention of Nagaland Baptist Church Council (NBCC) came up with the statement on 30/01/2017 enclosed. Reading between the line the joint statement was not the final, but subject to the decision of the cabinet and State Election Commission. As a Government constitutional obligations cannot be avoided. Therefore, keeping in mind the constitutional obligation on the one hand and the wishes of the people on the other hand, the State Cabinet recommended municipal councils and town councils where there was no opposition from public to go ahead with polls as scheduled (1st February, 2017) and defer those municipal councils and town councils where people/public had objection for two months.

15. The Govt. going ahead with the elections was necessitated because of the Writ Petition filed by the JACWR in the Supreme Court. 16. The State Govt. of Nagaland is a tribal population and the article 243-T being mainly aimed for empowering scheduled castes and scheduled tribes women, Nagaland is not exempted. Nagaland State does not fall under sixth schedule or scheduled areas where the Act is exempted. To go for election now without 33% women reservation is not permissible under the constitution. If the people do not want municipalities and towns councils in the State, it is possible. Since the women group have submitted withdrawal Petition of their SLP from the Supreme Court the people can decide whether to have municipalities and town councils in the State of Nagaland or not. 17. Now the options are:(a) Wait for the Supreme Court Judgement if the withdrawal of the SLP filed by the JACWR is not accepted. (b) Have no ULBs in the State OR (c) The State Govt. in view of the recent agitation and violence, take up the issue with the Govt. of India to exempt the State of Nagaland from the provisions of Part IX-A in the line with the provision of Part IX of the Constitution of India. The Government is of the view that even after the case is withdrawn, India being a free nation, any person, lawyer or woman activist, not necessarily a Naga woman, may file again a similar petition. In that event, it will be back to square one. If the State Government and all the stakeholders cannot arrive at an amicable resolution of this issue at the earliest, the best option appears to be to seek exemption of Nagaland from Part-IXA of the Constitution, which contains a mandatory provision under Article 243T for 33% women reservation in ULBs, which will put to rest the issue and avoid further misunderstanding among the people. A labyrinth of crises

I

t is the “worst of times…age of foolishness…season of darkness…winter of despair…we have nothing before us…” These powerful opening lines of Charles Dickens’ ‘A Tale of Two Cities’ strikes the mind when one thinks of today’s Naga People’s Front (NPF) which has fielded 15 candidates in the ensuing March, 2017 Manipur assembly election. The kind of situation in which the cock party is in should not evade a critical scrutiny of NPF ideologues and party stalwarts. This is the “worst of times” and the “season of darkness” for the cock party, such that the party is hobbling to chalk out relevant poll strategies at the moment. With the Central NPF leaders facing a labyrinth of crises in Nagaland, the Manipur State Unit of the party cannot expect much help from their leaders when they need them most. The NPF Working President of the Manipur State Unit has resigned not only from his post but also from primary membership after he was denied a party ticket. This development has, perhaps, sent a major jolt to the party. Pandemonium has come to rule the roost in the party in Manipur as many ticket hopefuls felt they were not given the kind of returns they claimed they deserved. With just 28 days to polling, when Central NPF leaders are supposed to scatter themselves in Naga areas of Manipur, canvassing and boosting the electorate, they will not even be able to step out of Kohima as the prevailing crisis in Nagaland deepens by the hour. NPF candidates have to eke out their ‘requirements’ on their own. Worse for the NPF, the United Naga Council (UNC) which had endorsed the party in the ensuing Manipur assembly election last year is pre-occupied with the district creation issue confronting the Manipur State Government at the moment. This is also the time the UNC needs mass support in the movement spearheaded by it against the creation of seven new districts by the Ibobi Singh Government. Given this picture, indulging in electoral politics by the UNC is bound to tremendously affect the ongoing movement “to fight against the insidious design of grabbing our land on the pretext of administrative convenience till the same is withdrawn and also to fight against any other moves that would affect our land and identity”. In the last assembly election in Manipur, the NPF had won four seats. However, thinking to fish with the same fishing net used five years ago in today’s troubled waters would be a mistake for the cock party. The NPF is a party injected with Naga national fervor, and every Naga will have emotional linkage with the party in a state like Manipur. However, if the Naga electorate snubs the cock party for any other party, Naga voters should not be blamed for it. There must be a serious reason for it. One reason could be as simple as this question—have the party leaders and workers done enough to exhibit the charms of the NPF that the people get attracted? If so, and if that has been the case, the prevailing situation confronting the NPF today will not affect the poll prospect of the party adversely. But, as of now, it appears that there are more misses than hits. Any attempt to substitute coercion for the misses in the ensuing assembly election campaigns of the party in Manipur will be a costly affair for the Nagas. Ignoring this pertinent observation would be akin to ignoring the genuineness and the very purpose of the party.

Indian film heroes tackle land rights & champion underdog

villainous company. Corrupt government officials. A heroic defender of farmers emerging victorious from a fight over land. This is far from a typical storyline for Indian film, which more often promises movie-goers a diet of syrupy romances, family dramas or all-action flicks. But a slew of regional-language movies has made unlikely heroes of those who defend Indians' land rights, showing how the fight over land now influences the country's popular culture, which generally shies away from contentious issues. "At this moment in time, the bad guy in the movies is the one taking land from the poor farmer or villager," said S.V. Srinivas, a professor of cultural studies at the Azim Premji University. While land rights have featured in small-budget, regional films in the past, at least half a dozen recent, big-budget movies from the southern states of Tamil Nadu, Andhra Pradesh and Telangana have been about land. India's voracious movie-going public has also seen popular actors starring in the top roles, with the underdog emerging on top. "Seeing the hero beat up the land grabber or put him in jail is the winning formula now," Srinivas told the Thomson Reuters Foundation. Conflicts related to property have risen as demand for land for industrial projects has grown to boost development for India's 1.3 billion citizens. Legislation passed in 2013 was meant to protect the rights of farmers, ensuring consensus in any land transaction, rehabilitation for those displaced, and compensation up to four times the market value. But several states, including Andhra Pradesh and Telangana, have since introduced laws to make acquisitions easier. Earlier this month, a Telugu language film 'Khaidi No. 150', starring popular actor Chiranjeevi, took more than 1 billion rupees ($15 million) on its first weekend, the definition of a blockbuster in India. The film is a remake of the Tamil film Kaththi (Knife), about farmers committing suicide after their land is acquired for a factory. It was one of the biggest Tamil films of 2014. Another Tamil film, 'Rajapattai', featuring popular actor Vikram, told the tale of an old man forced to give up his home. The 2015 Odisha film 'Adibhumi' (Ancestral Land), about a family forced out of their village for a steel plant, is loosely based on the unrest caused by South Korean firm POSCO's plan to set up a steel plant in the eastern state in 2005. Violent protests ensued as indigenous communities resisted the takeover of forest land for what was then India's biggest foreign investment deal of about $12 billion. "I am no activist, but I was deeply affected and wanted to show how our land acquisition policy is flawed, and how it affects poor, marginalised people most," said Satyabrata Dwibedy, the director. Earlier this month, a popular classical singer starred in a music video appealing for the protection of common lands. Other Telugu movies with land as a theme include last year's blockbuster 'Sarrainodu' (Right Man) and 'Racha', about land taken for mining.

Internally Displaced Women: Social rupture & political voice

Displacement is social as well as geographical. Women’s welfare and survival depends significantly on their social relationships; displacement destroys this resource

D

isplacement is at its highest level since records have been kept - over 60 million people world-wide are currently displaced from their homes and communities. Most media and popular attention in the developed world is focused on the Syrian refugee crisis which has produced 4.8 million refugees in its neighbouring region alone in the five years since violence erupted. While Europe struggles to decide how to respond to the 1.1 million Syrian refugees that have so far arrived on its shores since 2011, there is another population, hidden from view, that makes up two thirds of the forced migration iceberg. People internally displaced, that is, forced from their homes and communities but still within the borders of their country, make up slightly more than 40 million of the 60 million figure cited. Internally displaced people (known as IDPs in the field of forced migration) have similar experiences to refugees - their departure was forced by conflict or disaster, there was rarely time to plan their move, take possessions with them, say good-bye to loved ones or plan a destination. IDPs may end up in IDP camps (we are familiar with the images of tents and tarpaulins emblazoned with humanitarian logos) or less visibly dispersed among urban slums such as Birere in Goma (DRC) eking out a living however they can. The urban displaced generally receive little help. They rely on conflictaffected social networks and are often exposed to exploitation, homelessness and violence. People displaced into camps often get basic aid from international NGOs, but are subject to the regime of camp organisers - sometimes an NGO, as is most common in DRC, and sometimes the military as was more common in northern Uganda and Sri Lanka. Encamped IDPs often have restricted mobility and little opportunity for autonomy or incomegeneration - factors which often lead to despair and dependency with long term impacts. International responses tend to focus on geographical displacement and respond to immediate survival needs, including when displacement last years or even decades as in Colombia, Uganda and DRC. What is under-recognised is the social displacement - the expulsion from social and kinship networks which make life both possible and worthwhile. When we look at displacement through a social rather than geographic lens, we begin to see how displacement differs for men and women. During fieldwork conducted in 2014 and 2015 for a research project exploring women’s experiences of justice after mass violence in DRC, Kenya and Uganda we met a great many displaced and formerly displaced women. They prompted us to think differ-

work in the fields, and that domestic and public violence is ‘rampant’. Women traced a direct causal line between encampment and their present experiences. As Faith, a widow and mother of four children explained: ‘Yes, indeed there is a great link between the experiences of camp life and the problems the people are facing up to today.’ Camp life shattered social and cultural norms which would previously have prohibited much of the drinking and violence, as well as profoundly damaging the social institutions that today are failing to restore justice, dignity and order. While there has been some assistance for returning IDPs to resume livelihood activities, there has been little attention paid to the repair of social relationships. This has left women and children bearing the burden of work, violence, and poverty, with little power to establish a political voice. How we think about displacement guides how we respond to it. The geography of displacement is important, but it is only one part of the experience. The social elements of displacement are too easily relegated to the category of ‘higher needs’ or a luxury to be addressed when conditions permit. But social relationships are fundamental, and if we want to reduce displacement and ensure successful return and healing, the international community needs to think and act differently.

Gender norms trigger the displacement of women Internally displaced women in eastern DRC (where a recent study estimated that 1,152 rapes occur every day) explained that pre-existing gender norms mean that families may disown a woman who has experienced sexual violence. A 41-year old mother described her experience of social exclusion ‘… before being raped my health was very fine and I had sufficient means. After rape, my husband left me… Even if he comes, I am unable to satisfy his needs, so I am nothing in the society.’ The social meaning attributed to a ‘raped woman’ causes catastrophic consequences and frequently means that she is rejected by her spouse, family and community. In patriarchal and fragile states such as the DRC, women’s welfare is not seen as a state concern, but rather is determined by their relationships with fathers, husbands and sons. It is the men in their lives that enable them to access food, shelter, protection and a secure place in society. Rejection by families, some women explained, means expulsion from social networks essential for life. As a group of women in an IDP camp in Rutshuru commented, ‘When the family gets aware that you have been a victim of that act, no one can draw near you… they will only be rebuking you saying they do not want you to approach in order not to contaminate [them]… they hated us because of the act we were victim of.’ NGOs are spreading information about the ‘72-hour-rule’ - that getting medical help within 72-hours of rape can avert pregnancies and infections, and women are taking great risks to reach a medical clinic within the timeframe. But there is little evidence of attempts to engage community and religious leaders in beginning the long, slow process of attitude change so that women who have been raped need not be victimised again through social expulsion and stigmatization. The focus

Damaged social relations last for years Broken or damaged social networks caused by experiences of persecution and displacement can have a long-term impact on women’s place in communities. Uganda’s twenty-year war between the government and Joseph Kony’s Lord’s Resistance Army (LRA) caused massive internal displacement - 1.84 million people at the height of conflict. The Ugandan government forced almost the entire population of Acholiland, the epicentre of LRA activity, into overcrowded, poorly serviced IDP camps for over ten years. Men and women were not permitted to farm their lands and were dependent on aid from international agencies for survival. Camps were usually erected around military bases and followed strict rules such as curfews and restrictions on movement which made it impossible to continue important family and cultural rituals. The focus was on meeting the material survival needs that resulted from losing their homes, farms, businesses and livestock. Little or no attention was paid to the immense damage done to the social fabric of Acholi communities. Alternate economies emerged in the IDP camps, economies that centred on alcohol, violence and sex. tunning progress against malaria in the past decade has allowed the world to imagine a different future: Finally, a malaria-free Africa is within our reach. With Africa taking the lead, we are on the threshold of eliminating this deadly disease from the continent for good. The last chapters of our fight will be the most difficult yet. Eliminating malaria in Africa will take bold commitments from African leaders in the public and private sectors. We must double down on our existing malaria control efforts and think creatively about new funding sources, innovative new tools and unique partnerships to drive down cases and deaths and move more countries toward elimination. Strong leadership has been key to progress across the continent. Since 2000, we have cut malaria mortality rates in Africa by 62 percent. Ten years ago, malaria was killing a child every 30 seconds on our continent, and a scant five percent of the population at risk of malaria slept under insecticidetreated mosquito nets. Now, more than half of the at-risk population sleeps under bed nets. These are extraordinary achievements. Our continent is demonstrating that we can lead the charge in the malaria fight. But malaria still ravages our fami-

lies, communities and economies. In many African countries, malaria reduces GDP growth by 1 percent annually. In Nigeria, for example, malaria costs approximately US $1 billion a year in prevention and treatment costs, absenteeism, loss of productivity and disability. So why are we hopeful? Momentum is building across the continent. In Nigeria, which shoulders 29 percent of the global malaria burden, the public and private sectors are joining forces to fight malaria. Late last year, the Nigerian Ministry of Health and the Dangote Foundation launched the Private Sector Engagement Strategy, which leverages business expertise and innovation and capitalizes on the strength of government efforts to control malaria. An innovative financial instrument now under discussion in Nigeria will seek up to USD$300 million from investors to finance malaria control. We are inspired by the progress made by our ministers of health, our health workers and our communities with support from our partners in countries across the continent. The world’s oldest and deadliest disease is finally in retreat. In 2005, there was no data on how many Liberians were dying from malar-

ia. Nor did national healthcare officials know how many children with a fever had the disease. So Liberian health and finance ministers, non-governmental organizations and others joined forces against malaria. They strengthened diagnostic capacity at the local level, improved case supervision at the county level, and enhanced management systems for health data. Ten years later, Liberia’s malaria-related deaths have been cut in half. Today, all public and private health facilities in Liberia are supplied with rapid diagnostic tests. Nigeria has made remarkable progress in expanding the use of insecticidetreated bed nets. At the end of 2015, it was estimated that 69 percent of Nigerian households owned at least one bed net. The impact of these interventions has been significant: malaria prevalence in young children declined from 42 percent to 27.4 percent between 2010 and 2015. Similar advancements are underway across Africa thanks to the leadership of the African Leaders Malaria Alliance (ALMA), a ground-breaking coalition of heads of state and government from African Union member countries fighting malaria through high-level advocacy and action. Both the ALMA Scorecard for Accountabil-

ity & Action and the ALMA 2030 Scorecard Towards Malaria Elimination are helping track country-by-country progress and drive action on malaria control and elimination. ALMA recently recognized seven countries for achieving more than 40 percent reduction in malaria incidence and deaths. The need for renewed leadership, creative approaches to financing and new tools to fight malaria is why we, along with three other African leaders, joined the End Malaria Council, which was launched recently alongside the World Economic Forum in Davos, Switzerland. The End Malaria Council is a group of public and private sector leaders committed to keeping malaria elimination high on the global agenda. This includes encouraging African leaders to continue to increase domestic funding to fight malaria. All of us have a role to play in ridding our continent of this disease – from researchers and scientists to health workers, business leaders and government officials at every level. The end of malaria starts now. Ellen Johnson Sirleaf, the President of Liberia, received the Nobel Peace Prize in 2011. Organic manures as an amendment of acid soil

O

rganic manures are those materials derived from animal, human and plant residues which contain nutrients in complex organic forms. The sources for preparation of manures are crop residues like straw, sugarcane trash, stubbles; cattle shed wastes-dung, urine; poultry droppings; sewage, sludge; human habitation waste; slaughterhouse wastes-bone meal, meat meal, blood meal, horn and hoof meal, fish meal; by-products of agro industries-oil cakes, press mud; water hyacinth, weeds and tank silt, green manures etc. Some of these sources except green manures are not used as such, as it has to be decomposed first and upon decomposition they release nutrients. Comparing to the chemical fertilizers the nutrient content in the organic manures are less but they have longer residual effect besides improving the soil organic matter content, increase the beneficial microorganisms, maintain the fertility of the soil and improves soil physical condition (Fig. 1). When the chemical fertilizers are applied in soil it acts only as the plant nutrients and helps in increasing the yield of crops. But when organic manures are applied it acts as the plant nutrients and at the same

ha is applied to fodder grasses and vegetables. In such cases farmyard manure should be applied at least 15 days in advance to avoid immobilization of N. The existing practice of leaving manure in small heaps scattered in the field for a very long period leads to loss of nutrients. These losses can be reduced by spreading the manure and incorporating by ploughing immediately after application. The entire amount of nutrients present in farmyard manure is not available immediately. About 30% of N, 60 to 70% of P and 70% of K are available to the first crop. time improves the soil health. Types of organic manures Organic manures can be group into two types: (i) Bulky organic manures and (ii) Concentrated organic manures 1. Bulky organic manures: Bulky organic manures are those which contain small percentage of nutrients and they are applied in large quantities. It includes• Compost: Compost is prepared from plant residues and animal waste. The process of making compost is known as composting. It is largely a biological process in which aerobic (oxygen is present) and anaerobic (absence of oxygen) micro-organisms decompose organic matter and lower the carbon-nitrogen (C:N) ratio of the refuse. There are different types of compost(i) Rural/Village Compost: This type of compost is prepared from farm waste products, e.g. straws, crop stubbles, crop residues such as sugarcane trash, groundnut husks and leaves, cotton stalks, etc. Weeds, waste folder, urine soaked earth, litter from cowshed and hedge clippings. This type of compost contains 0.4-0.8% N, 0.3-0.6% P2O5 and 0.7-1% K2O. The nutrient value of farm compost can be increased by application of superphosphate or rock phosphate at 10 to 15 kg/t of raw material at the initial stage of filling the compost pit. (ii) Urban Compost or Town Compost: This type of compost is prepared from town waste and night soil. This type of compost contains 1-2% N, 1% P2O5 and 1.5% K2O. (iii) Vermicompost: Vermicomposting is applied for composting various non-toxic organic solids and liquid wastes available from farms, cities, dairies, sugar and distillery units, pulp and pa-

The chemical composition of FYM is 0.5% N, 0.2 % P2O5, 0.5 % K2O and 76%water. • Green manures: Green manuring is a practice of ploughing or turning into the soil undecomposed green plant tissues for improving physical structure as well as soil fertility. The green-manure crop supplies organic matter as well as additional nitrogen if it is a legume crop, and it can protect against erosion and leaching. It is of two types- green manuring (Fig. 3) and green leaf manuring (Fig. 4). The nutrient content of some of the green manure crops are shown in table 1.

2) Concentrated organic manures: Concentrated organic manures have higher nutrient content than bulky organic manure. The important concentrated organic manures are oilcakes, blood meal, fish manure etc. These are also known as organic nitrogen fertilizer. Before their organic nitrogen is used by the crops, it is converted through bacterial action into readily usable ammonical N and nitrate (NO3)-N. These organic fertilizers are, therefore, relatively slow acting, but they supply available N for a longer period. (i) Oil Cakes: Richest source of plant nutrient of all organic manure. Oil cakes are the by-products of oil seeds crops. Oil cakes are the important and quick acting organic nitrogenous manure. • Edible oil cakes (i.e., used for cattle feeding): This type of oil cake is used for feeding cattle in the form of concentrations, e.g. mustard oil cakes, groundnut cake, sesame or til cake, linseed cake, coconut cake, etc (Table 2).

these are a good source of nitrogenous manure. The amount of N varies with the type of oil cake. Oil cakes are insoluble in water. But their N becomes quickly available in about a week or ten days after application to crops. The nutrient content of some of the non-edible oil cakes are shown in the table 3.

(ii) Blood meal and bone meal: Bonemeal and blood meal are amendments that add nutrients to soil, and they can be used together. Blood meal is dried and powdered animal blood; it increases soil nitrogen levels. Bonemeal is ground animal bones; it increases soil calcium and phosphorus levels. There are different types of it (Fig. 7, 8 & 9) and the nutrients content differs according to the source (Table 4).

Advantages of Organic manures application in soil 1. Addition of organic manures like green manures and animal wastes to acid soils can reduce Al toxicity and increase P uptake and crop growth on P-deficient soils. 2. The application of organic manures to acid soils minimizes the requirement of lime and P fertilizers. 3. Organic manure provides all the nutrients including micronutrients that are required by plants in small quantities. 4. It improves the physical properties of soil like structure, texture, aggregate stability and water holding capacity of soil. 5. It helps in maintaining C:N ratio in the soil and also increases the fertility and productivity of the soil. 6. It increases the biological activity in the soil which in turn have many benefits like enhance nutrient cycling, decomposition, and increase mineralization of nutrients and maintains soil health. 7. It increases the organic matter content in the soil which minimizes the evaporation losses of moisture from the soil 8. Plant parasitic nematodes and fungi are controlled to some extent by altering the balance of microorganisms in the soil. 9. Application of organic manures maintains the environment health by reducing the level of pollution.

3. Green manures: Green manure to be incorporated in soil before flowering stage because they are grown for their green leafy material, which is high in nutrients and protects the soil. Green manures will not break down in to the soil so quickly, but gradually, add some nutrients to the soil for the next crop. When it is applied for the current crop it has to be incorporated 20-30 days in advance by ploughing. 4. Oil cakes: Nutrients present in oil cakes, after mineralization, are made available to crops 7 to 10 days after application. Oilcakes need to be well powdered before application for even distribution and quicker decomposition. De-oiled cakes have the petroleum residue of about 0.2% and it comes in flake/chip. The residual petroleum gets reduced substantially if the cakes are powdered. It is therefore suggested that oil cakes should be allowed to be used only in powder form. It is also advisable to sprinkle water on these cakes before using it.

Method of application of Organic Manures 1. FYM: Partially rotten farmyard manure has to be applied 3-4 weeks before sowing while well rotten manure can be applied immediately before sowing. Generally 10-20 t/ha is applied, but more than 20 t/

wastes or from sub soils. 2. Compost: Compost can be applied directly to soil. In general it is recommended that it can be applied 10t/ha once in three years to maintain the organic matter content in soil and besides providing N, P and K to the crops.

Importance of Classical Swine Fever (CSF)

Introduction: Classical swine fever (hog cholera) is a highly contagious viral infection of swine caused by an RNA virus in the genus Pestivirus of the family Flaviviridae. CSF is one of the most economically- damaging pandemic viral diseases of pigs in the world. In a susceptible (unvaccinated) herd almost all the pigs are affected. Fortunately, there is only one serotype of the virus and attenuated vaccines are highly effective. It is a notifiable disease in most countries of the world. Virus is most often transmitted through the ingestion of contaminated feed or garbage. However, the virus may also be spread through open wounds and mucous membranes, contact with bodily secretions or faeces of an infected pig, physical transfer from a contaminated object, sow to piglet transfer or inhalation in close quarters. Also, it does not spread on

the wind or on insects or birds so standard precautions of farm biosecurity should keep it out. However it persists in uncooked and cured meat and these should not be fed to pigs.

Clinical signs: Clinical signs usually appear first in a small number of growing pigs which show non-specific signs of depression, sleepiness and reluctance to get up to eat. They walk and stand with their heads down and tail limp. Over the following few days these signs get worse and more pigs become affected. Younger piglets may appear chilled, shiver and huddle together.

Opposition, BJP on warpath over PM Modi's 'raincoat' barb at Manmohan

neW Delhi, February 9 (ians): Prime Minister Narendra Modis "bathing with a raincoat on" jibe against his predecessor Manmohan Singh triggered a political outrage on Thursday with the BJP defending the remark and lashing out at the Congress for disrupting Parliament proceedings over the row. Congress Vice President Rahul Gandhi ridiculed Modi for his "penchant" to grab headlines and said the remark was an insult to the nation. Addressing a rally in the poll-bound Uttarakhand, Gandhi said Modi was the first Prime Minister who can't speak with respect about his predecessors. "Modi has this weakness of grabbing headlines. The day he isn't in the news, he doesn't get a proper sleep. To get into headlines, be it inside Parliament or outside, he creates

The so-called secret city appears to be a figment of the Pakistan imagination," said External Affairs Ministry spokesperson Vikas Swarup at a briefing here. "India has always been in compliance with all its international obligations. A division bench of Chief Justice G. Rohini and Justice Sangita Dhingra Sehgal posted the matter for Monday (February 13) on the plea filed by an NGO, Fariyaad Foundation. The foundation said there was a Delhi government notification in 2015-2016 banning sale, supply and manufacture of 'gutka' and other chewable tobacco products but it was not being strictly implemented. The alleged inaction by the authorities showed their callousness, said the PIL, while seeking directions to the Delhi government and its food safety department to strictly implement the ban.

He said that locals of Bakhtiyarpur village in Khagaria district had yesterday spotted the gap in a joint of the railway track on Mansi-Katihar rail section and informed the Railway officials at around 6:50 AM. Sought lie-detector tests on Tytler, Verma in 1984 riots case: CBI neW Delhi, February 9 (ians): The CBI on Thursday said it has sought the court's permission for lie-detector tests on Congress leader Jagdish Tytler and arms dealer Abhishek Verma in connection with a 1984 anti-Sikh riots case. The agency moved a written application in the Karkardooma court on Wednesday on the issue after the arms dealer's accusation against the Congress politician of influencing a witness Surender Singh by giving him money and promising to send his son Narender Singh to Canada. Tytler is accused of leading a mob in the 1984 Pul Bangash case in which three Sikhs were killed. The Central Bureau of Investigation (CBI) had earlier given a clean chit to Tytler in the case but reopened investigation following December 4, 2015, court order in the wake of Verma's allegation. The court also ordered the agency to found out whether Verma's statement was authentic.

The report, titled 'Constitutional and Legal Challenges Faced by Religious Minorities in India' and sponsored by the US Commission on International Religious Freedom (USCIRF), said the religious minority communities and Dalits face discrimination and persecution in India where hate crimes, social boycotts and forced conversion have escalated dramatically since 2014. "Under Congress Party and BJP-led governments, religious minority communities and Dalits, both have faced discrimination and persecution due to a combination of overly broad or ill-defined laws, an inefficient criminal justice

"India is a religiously diverse and democratic society with a Constitution that provides legal equality for its citizens irrespective of their religion and prohibits religion-based discrimination," said USCIRF chair Thomas J. Reese. "However, the reality is far different... India's pluralistic tradition faces serious challenges in a number of its states." "During the past few years, religious tolerance has deteriorated and religious freedom violations have increased in some areas of India. To reverse this negative trajectory, the Indian and state governments must align theirs laws with both the country's constitutional com-

Quoting India's Home Ministry figures, it said that in 2015, India experienced a 17% increase in communal violence, when compared to the previous year. In 2015, there were 751 reported incidents of communal violence, up from 644 in 2014. The report recommended the US government to urge the Indian government to push its states that have adopted anti-conversion laws to repeal or amend them to conform to international norms. It further urged the Indian government to immediately lift its sanctions against non-governmental organisations working for the welfare of the minorities in India. The report further stated that Indian government should reform the anti-conversion laws and appreciate that "both conversion and reconversion by use of force, fraud,

or allurement are equally bad and infringe upon a person's freedom of conscience". It said that India should not impose Hindu personal status laws on Sikh, Buddhist, and Jain communities, but instead provide them with a provision of personal status laws as per their distinct religious beliefs and practices. It recommended that India adopt the International Convention on the Elimination of All Forms of Racial Discrimination. "Operationalise the term 'minority' in its federal laws and comply with the United Nations Declaration on the Rights of Persons Belonging to National or Ethnic, Religious, and Linguistic Minorities. Lastly, it said that India should also not impose Hindu personal status laws on Sikh, Buddhist, and Jain communities, but instead provide them with a provision of personal status laws as per their distinct religious beliefs and practices.

Legal battle over travel ban pits Donald Trump’s powers against his own words NEW YORK, FEbRuaRY 9 (REutERs): A U.S. appeals court is weighing arguments for and against President Donald Trump’s temporary travel ban, but its decision this week may not yet answer the underlying legal questions being raised in the fast-moving case. The 9th U.S. Circuit Court of Appeals in San Francisco is expected to rule only on the narrow question of whether a lower court’s emergency halt to an executive order by Trump was justified. Trump signed the order on Jan. 27 barring citizens from seven Muslim-majority countries for 90 days and halted all refugee entries for four months. The appeals court has several options. It could kick the case back to lower court judge James Robart in Seattle, saying it is premature for them to make a ruling before he has had a chance to consider all the evidence. Robart stopped Trump’s order just a week after he issued it and before all the arguments had been developed on both sides. Or the panel of three appellate judges could side with the government and find halting the order was harmful to national security, reinstating it while the case continues. Their decision is “one step in what will be a long, historic case,” Stephen Yale-Loehr, a professor at Cornell University Law

“Would anybody be able to challenge that?” Canby asked. Flentje emphasized that the order did not ban Muslims. He said the president made a determination about immigration policy based on a legitimate assessment of risk. The government has said its order is grounded in a law passed by congress that allows the president to suspend the entry of “any class of aliens” that he deems “would be detrimental to the interests of the United States.” When asked by the third judge - Michelle Friedland, appointed by Democrat Barack Obama - if that meant the president’s decisions are “unreviewable” Flentje, after a pause, answered “yes.” When pressed, Flentje acknowledged, however, that constitutional concerns had been raised about the order. RELIGIOUS DISCRIMINATION One of the main concerns is allegations by the states, civil rights groups, some lawmakers and citizens that the order discriminates in violation of the constitution’s First Amendment, which prohibits favoring one religion over another. The judges will have to decide whether to look exclusively at the actual text of the president’s order, which does not mention

any particular religion, or consider outside comments by Trump and his team to discern their intent. Washington state’s attorney Noah Purcell told the hearing that even though the lawsuit is at an early stage, the amount of evidence that Trump intended to discriminate against Muslims is “remarkable.” It cited Trump’s campaign promises of a “total and complete shutdown of Muslims entering the United States.” In a tweet on Monday night, Trump said “the threat from radical Islamic terrorism is very real” urging the courts to act quickly. Chaos and anarchy spurred by the strike continued in the coastal state to the north of Rio de Janeiro, despite the deployment of 1,200 army soldiers and federal police and the promise that more help was on its way. Most of the violence was centered in the state capital Vitoria, a wealthy port city ringed by golden beaches, where mining and petroleum industries have a strong base. State officials said they needed hundreds more federal troops and members of an elite federal police force to help establish order and make up for the 1,800 state police who nor-

Duterte defends drugs war; rejects advice of ‘idiot’ ex-Colombia president

MaNILa, FEbRuaRY 9 (REutERs): Philippine President Rodrigo Duterte made a vigorous defence of his war on drugs on Wednesday, rejecting not only allegations of extrajudicial killings, but the advice of a former Colombian leader who urged him not to repeat his mistakes. The ex-prosecutor promised to stand behind those on the front lines of his war and called Cesar Gaviria an “idiot” for a newspaper article in which the former Colombian president warned Duterte that a security-centred approach “do more harm than good”. Duterte last week suspended police from anti-narcotics operations after a South Korean businessman was murdered by rogue drugs squad police. He has put the Philippine Drug Enforcement Agency (PDEA) in charge, and plans to deploy troops as reinforcements. Duterte said his campaign was about destroying the apparatus of the drugs trade, not killing, and only he would be accountable if law enforcers were accused of wrongful killings during raids and sting operations. “Those done in the line of duty I take full responsibility,” he said in a speech. “If someone should go to jail, it’s not police, not military, not the PDEA - It’s me.” Duterte’s war on drugs has attracted global attention due to its high death toll in his first seven months in office and the shock factor of images in media of bloodied corpses lying in streets and slums. As at Jan. 31, some 2,555 Filipinos were killed in what police said were shootouts during anti-drugs operations. More than 7,700 deaths have been recorded overall, and the cause of many of those are much in dispute. ‘BIG FISH’ The Catholic Church used sermons at the weekend to speak out about the drugs war, saying killings were not the solution and the poor were being worst hit. A Feb. 1 report by Amnesty International said the same, and concluded that police had behaved like the criminal underworld they were supposed to suppress, taking payments for killings. The report said many killings were “systematic, planned and organised” by authorities. Duterte rubbished those claims and said it was necessary to provide undercover police with cash to buy drugs in sting operations, referred to as “buy-busts”, otherwise prosecuting dealers would be difficult. He denied his campaign was focusing on small-time users and pushers only, and he had proved local politicians were on his radar. “There is always a contention Duterte is killing the poor,” he said. “So where is the big fish? We started with the mayors, they were killed along the way, so there’s the big fish,” he said. In Tuesday’s New York Times, Gaviria, who was Colombia’s president from 1990-1994, appealed to Duterte to use alternative strategies to fight drugs and explained why his country’s crackdowns on cocaine cartels had failed. He hoped Duterte would avoid a heavy-handed approach and “not fall into the same trap”. “Trust me, I learned the hard way,” he wrote. Duterte said Gaviria was “lecturing” and the Philippine case was different to Colombia, because “shabu”, or methamphetamine, was damaging to the brain whereas the behavioural impact of cocaine was less severe.

The games people play through the Prism of the 33% Reservation for women T.N. Mannen IAS (Rtd)

M

uch has been said and written on the views and understandings on the special protective constitutional provision provided to the Nagas under the Art.371(A) vs the 33% Reservation for women all over the country which is a mandatory provision in the 73rd & 74th amendments 1992 under Art243(D)cl(3) and 243(T) cl(3). The Nagas are still confused and concern about the actual interpretation and its implication. I’d also like to express my humble understanding on the issue which is yet to be arrived at clearly and in a legally justifiable terms, which may even affect the very Naga identity in the future that would go beyond the immediate satisfaction of achieving the reservation objective. It is a fact that the Nagas generally are fiercely independent in nature and emotionally attached to the land, their tradition and customary practices however archaic it may be. In the past too, the Ahoms, our immediate neighbor, during their 600 years of their reign in Assam had left the Nagas in their independent existence despite many conflicts between them. The British had also in their shrewd wisdom, avoided full subjugation and allowed them to live in their own way without much interference. At the time of creation of the 16th State of Nagaland, the National Law makers had wisely taken cognizance of the Nagas distinctive characteristics and their psyche and felt it pertinent to provide the protective provision of this unique feature in the Constitution under Art. 371 (A). The Nagas are guarantee with the right to manage and regulate their life according to their own genus in its own pace. The Nagas have taken this special constitutional provision as recognition of their distinctive and unique Identity and are proud of it by one and all. Any slightest apprehension of direct or indirect compromise or encroachment on this right would be considered as a threat to their very Identity. This core sentiment has been hurt by the recent hasty action of the state government in amending the Municipal Act 2001, incorporating the 33% Reservation for women in the Urban Local Body (ULB) as per the prescribed norm

envisaged under Art. 243(T) clause3, which provides reservation of seats in every Municipality for women which shall be not less than one-third of the total number of seats. In the absence of any established tradition or customary practices to guide, the state government had conveniently resorted to the general constitutional directive contain in the Art mentioned. Thereafter immediate conduct of election to the ULBs was announced to be held on 1st Feb.2017. The tribal Hohos and the Naga public were alarmed with this sudden move and appealed for more time for consultation with the stakeholders on its likely implication to the traditional and customary practices infringing the rights guaranteed under the Art. 371 (A). It was unfortunate that the overwhelming appeal by the people for more in-depth understanding of the important issue for the Nagas but the public outcry was completely ignored by the state government. The matter was aggravated by the volte-face of the government from the tripartite agreement involving even the church leaders, for postponement of the election for two months and further consultation during that time with the stakeholders on the sensitive issue to all the Nagas. Undoubtedly giving women an appropriate political empowerment which was denied to the Naga women in the traditional setting is accepted as fair demand but the manner in which the government had maneuvered to complete the whole process was unusual. The people only wanted some time to digest its implication before it become irreversible. This is certainly a mandatory provision to be implemented in all the ULBs all over the country. However, in view of the special provision of constitutional guarantee provided to the Nagas to continue enjoying their traditional and customary practices as envisages in the Art 371(A); an alternative method to sort out the issue could be possibly thought of. Because, it categorically stated that, “notwithstanding anything in this constitution:--no Act of Parliament’ shall be applicable …Unless the Legislative Assembly of Nagaland by a Resolution so decides’. In the light of the above wording in no uncertain term, the Nagas may not be

wrong to adopt its own formula suited to the Nagas in the spirit of traditional uniqueness without the apparent infringement of the rights provided to the Nagas. That is not an illusion but logical inference for the Nagas to explore its possibility and applicability. The people suspected ulterior motive on the part of the government for rushing into passing the reservation bill mechanically without digesting properly in the opposition-less Legislative Assembly. Thus not agreeing to the overwhelming demand and appeal from the public to have further dialogue with the stakeholders to dispense with any misgiving before going ahead with the poll was a clear indication of not genuinely concern about fulfilling the political empowerment to women nor in the interest of the people but main target is to get hold of the central fund before the yearend for obvious reason. Evidently so as in 2012, a similar move for reservation bill in the Assembly was unanimously rejected stating that it would amount to infringement of the rights provided in the constitution which considered as inviolable by the Nagas but found it appropriate to go ahead in Nov.2016, in the same legislative Assembly, without any visible change in the status and situation. These are some of the searching questions the public wanted the state government to clarify before proceeding with the election. The argument about getting generous fund for development of urban areas from the central funding once the reservation process is completed could not convince the people without further scrutiny, if it compromises on their rights affecting every Naga of both the gender. The cabinet had on 4th Feb.2017, curiously, decided to send a Memorandum urging the central government to initiate a constitutional amendment to this provision contained in Part IX-A, Art.243 (T) cl3. This is a meaningless exercise to buy time, as the process for any constitutional amendment is a very long drawn process and not likely to be considered for the state of Nagaland alone. In any case everyone knows that sending a Memorandum is not a solution to the current crisis between the people and the state government. Such an ir-

relevant action will only create further suspicion and mistrust. The Naga civil societies are genuinely worried and concerned how such an Act would be a compromise to their rights and interests of the future of the Nagas. But the adamant refusal to have the dialogue with the people compounded by the subsequent u-turn on the tripartite agreement was not expected form a person of authority of the government. It was the last straw to end the TRUST of the people on the present elected government which is supposed to take care of the welfare and protect the interest of the people. The public anger was spontaneous and uncontrollable leading into avoidable bloodshed and the tragic loss of innocent lives. The mandatory constitutional provision, under the Art243 (T)cl3(74th Amendment 1992)say that;- not less than one-third (including the seats reserved for SC&ST women) of the total seats shall be reserved for woman. The main purpose of this general directive is to ensure adequate representation for the weaker sections like, the SC, ST and woman uniformly in all the ULBs in the country. How compatible is the reservation provision with the Naga tradition and customary practices. On critical examination, a question may be asked whether an exception can be possible exempting the applicability of this provision in Nagaland state be justifiable in view of the overriding constitutional guaranteed to the Nagas under Art.371 (A) on any matter relating to the Traditional and customary practices, religious practices, administration of civil and criminal justice and the ownership of land, transfer and its resources. This is a comprehensive right given to the Nagas to protect preserve and regulate their lives in accordance with their traditions and customs. Though the municipality or Town Council is of modern Institution, it is established within the Naga territory and for the regulation of the lives of the Nagas, so it automatically attracts the right guaranteed. However, strict observance by the state government on the provisions relating to the Woman Reservation in Art.243 (T) clause(3), at the time of the last Amendment to the Municipal Act 2001, may have given

an impression that the traditional and customary procedure is inadequate to take care of Legislative requirement in today’s situation. Nevertheless, the procedure adopted in moving the bill for 33 % reservation for women, and subsequent passing as an amendment to the municipal act was inconsistent with the spirit of the rights guaranteed to the Nagas. Because it is considered as interference to the rights provided. Sadly, the adoption of the amendment by a unanimous resolution in the assembly in November 2016 legitimized its applicability in the State of Nagaland unless a corrective measure is taken in reversing the Act. In that context it is felt that the state government may be the competent authority to legislate on it as deem fit to suit their system. Definitely there is an urgent need to undertake the codification of the various Naga tribal customary laws and practices making it uniformly applicable to all the Nagas especially on common issues and to filter the archaic and irrelevant contents. The tradition and customary practices should grow and improve to suit the changing need of the day, otherwise they will become inadequate and irrelevant to the fast changing need of the time. It can be codified in the line of the British Common Laws which was literally the compilation of the tribal law practices, conventions and usages of their different tribal groups in the past. We may, also look from a different angle at the constitution of the ULB on the composition of the members, power and responsibility. It will be comparable to the power and functions of ‘the Council of Elders’ in the village Republics of the past, from where the foundation of the tradition and the customary practice had been originated out of their tested experiences of life distinguishing the Nagas from the others. If the competency of the state Assembly is accepted, then a separate unique legislation can be adopted by reserving a certain number or percentage out of the total seats for the women in ULB organization as deemed fit suiting to the spirit of the Naga tradition. That will take care of preserving the sanctity of the constitutional guarantee provided to the Nagas at the same time enable the women to participate in de-

cision and policy making body. A reasonable measure empowering the women to enable to take part in the decision making body may be a departure from the traditional practices. However, their participation will be a real asset for the overall development and growth of the societies. The women activists today understandably, are not contented with the traditional role. They have been asserting the last few years to implement the constitutional mandatory provision of reservation of 33% seats in local urban bodies. To be fair to the demand, equipped with better education (pen is mightier than sword) and with the economic emancipation the women sensibly demand political empowerment asserting that the decision making responsibility is no monopoly of men, needs to be taken positively. It is a reasonable voice which will rather accelerate healthy holistic growth of the society. Unfortunately, the genuine voices of the women have been once again sidetracked in the controversial hustling of the tribal Hoho and civil society vis-à-vis the state government which has emanated out of this genuine issue but now it becomes unsure when will it come alive again. The need of the hour is that every sensible citizen must look at the event with calmer reflection and with restrain. We should not allow the event to divide further among the Nagas nor should allow relegating the reasonable and legitimate demand of the Naga women in larger interest of the society. At the same time we can not in any case accept erosion of the rights being protected through the special provision which is the unique Identity. The unfortunate death of three persons must be generously compensated by government but regret to observe that so far no such decision seems to have made in this regard. In any case, their sacrifice should not go in vain. It symbolizes the Naga freedom and unity for a purpose and willingness to sacrifice in defending a noble common cause. it has once again renew faith in our common strength and reaffirm that the ultimate strength lies with the people which can bring positive change that is required and the sincere voices of the people must be respected by all.

Will anti-women quota stir in Nagaland Are we undermining the power of Article 371 (A)? affect BJP’s plan for a uniform civil code? Ashwaq Masoodi

t is the same old story again. This time coming from the north-eastern state of Nagaland, where women are supposedly empowered and safe. All the social indices and National Crime Records Bureau reports present a rosy picture of Nagaland. But the recent incidents across the state make the statistics look like numbers that don’t quite reflect the social realities. Can women demand political representation if, under customary law, only men are entitled to run institutions of governance? This is the summary of the fight going on in Nagaland where women say they are entitled to 33% reservation in urban local bodies as is the case in the rest of the country. The Naga Hoho, the apex body representing 16 main tribal groups, and others opposing, insist that the provision of 33% reservation for women violates Article 371A of the Constitution, according to which no Act of Parliament will apply to Nagaland if it goes against customary laws. They argue that they are not against women’s representation in these bodies but against them standing for elections. They prefer to nominate women rather than have them stand for elections. The arguments of those who oppose the reservation are on the same lines as those presented by the Muslim men and women who oppose the abolition of the practice of triple talaq. One says customary laws are sacred, the other says personal laws are sacrosanct. Both cases have cleaved the respective societies into two: those who believe in personal and customary laws being sacrosanct, and those who believe times have changed and there is a need to adapt to the change. Resistance to such an extent from Nagaland to protect its customary laws, even when it comes to an issue like women’s political participation, is particularly significant at a time when the ruling party, the BJP, is vouching for a uniform civil code (UCC). In November last year, a group of 14 Naga tribal bodies and civil rights organizations met to discuss the UCC, and strongly opposed any such move by the Central government, saying that if enacted, the UCC will have a serious impact on religious and customary laws of Nagas and so, Nagaland should be exempted from the proposed code. As the violence within the state is growing, the stories of struggles of women within Nagaland are coming out. Not a single woman has been elected to the assembly in the state’s more than 50-year-old history. The first legislative assembly election was held in 1964 and till the last election in March 2013, only 15 women candidates contested through the years. The only time when Nagaland elected a woman legislator was during the 1977 Lok Sabha elections in which Rano M. Shaiza won. In the 2013 elections, there were two women contestants but both of them lost. To be sure, political parties have women wings, but they are not recruited to run for elective offices. “(Of the) Women who have contested in the elections, majority of the candidates were independent candidates. This highlights the reluctance of the political parties in Nagaland to sponsor Women as candidates in the election. Without the backing of major political parties, chances of winning is doubtful,” according to a 2014 paper published in the International Research Journal of Social Sciences. This fight for 33 % reservation might have made headlines, but this isn’t the only fight Naga women

are fighting. Naga women are not allowed in the traditional village councils, they have no land rights, no property rights and no inheritance rights—so much so that if a man who doesn’t have a son, dies, the property and land will be inherited by a male relative who may be five or six cousins away in family line. Women are generally not allowed to participate in fighting or hunting, and can’t participate in debates of public interest, or accept honors or titles. A recent study by the grassroots organization North East Network (NEN) of women from various Naga tribes, found that they continue to be discriminated against under tribal customary laws. ‘Enquiry into the status of women in Nagaland’, a 192-page report brought out by the Nagaland chapter of the NEN, brings out the voices of 132 such rural women belonging to three of the 11 districts of the state. The status of these women, who belong to six (out of 16 major tribes) Naga tribes, was documented between January 2014 and March 2016. The study highlighted that “on consideration of a woman’s physical weakness, an Ao Naga (a tribe) woman suffers from disqualification in the following ways: She can’t become a member of Putu Menden (traditional village/clan/tribal council which is the highest decision making body in Ao society). She can’t become the patir/putie (village councillor) though she may be the oldest person in the village. She is debarred from performing religious rites and sacrifices. An Ao woman also can’t inherit landed property. After the father dies, even the mother has to seek the son’s permission to cut firewood from his land. A November 2016 piece in The Wire quoted Monisha Behal, chairperson of the NEN, saying, “The customary laws of Chakhesang Nagas state that when a married woman is caught for adultery, she is forced to leave her husband’s house with only the clothes she is wearing, with a fine imposed on her depending on the gravity of the situation. But if a married man brings his lover home and creates disharmony in the family, he doesn’t need to leave, but will have to give his wife half the property acquired during his married life.” Patriarchy manifests itself in various forms. Naga women run commercial establishments, work in offices, teach in universities; are seen working in local markets, or campaigning against social ills like alcohol abuse, their role in the family is considerably recognized, compared to the counterparts in the rest of the country, but as a 2016 piece in a local Nagaland newspaper, Morung Express (http://morungexpress. com/women-reservation-nagaland/) pointed out, “women’s role is consciously and subconsciously assigned to the private sphere, not in the public realm.” So far, two young boys have been killed in the violence. The elections have now been put off, and the protestors are seeking the resignation of the state chief minister. Maintaining that this reservation infringes upon the traditions and customary laws of the state, one group of tribal leaders has also claimed that women anyway enjoyed equal rights in Naga society and hence, providing quota or reservation was meaningless. Unlike Muslim women, whose rights got the attention of the ruling party BJP, and even Prime Minister Narendra Modi came forward saying “in the country, lives of Muslim women cannot be allowed to be ruined by triple talaq”, as of now, the political commitment is seen in trying to control the situation and not as much for the rights of these Naga women.

he State of Nagaland came into existence not just by chance. Nor was it carved out of Assam for administrative convenience. In fact, it was bought by the blood and sheer sacrifice of our ancestors. The 16 Point Agreement and subsequently the Nagaland State Act, 1962 are the basis on which the State of Nagaland was formed. Though, the patriotic Naga leaders who gave their all to see an independent Nagaland might consider it as a treacherous act, but perhaps, this was the best thing to do considering the Political-Social problem that was prevalent at that point of time and as such, we should honor the wise decision made by the leaders of the yore. Article 371 A, which was incorporated in the Indian constitution through the 13th Amendment Act guarantees special status to the Nagas of Nagaland in four Primary areas. In order to save space and time, it would be better not to delve into the nitty-gritty of Article 371 A. However, as Sir Ivor Jennings called the Indian Constitution “Paradise of Lawyers”, the Constitution of India considering its vastness could be interpreted by different people in so many different ways. Therefore, we need to be cautious while dealing with sensitive issues vis-àvis Article 371 A which is considered as a boon for us. The recent imbroglio with regard to the ULB polls and the impasse between the State Government and the Tribal Hohos could have been averted had the State Government decided to hold proper consultations with the stakeholders before deciding to proceed with the elections. In any civilized society, especially in a democracy, any misunderstanding could be amicably solved between the contending parties through discourse and the same could have applied in our case. But what more could be expected of an ignorant Government, which held its Assembly for just 15 Minutes! The Nagaland Municipal Act (Third Amendment) 2016, which is formulated in line with ‘The Municipalities’ (Article 243 P-Z G) under Part IX-A (74th Amendment) of the Indian Constitution does not explicitly state that it shall not apply to the State of Nagaland unlike the ‘The Panchayat’ under Part IX of the Indian Constitution which clearly states in Article 243 M 2 (a) that “nothing in this part shall apply to the States of Nagaland, Meghalaya, and Mizoram”. However, given the power under Article 371 A, which reads as notwithstanding anything in this Constitution, — (a) no Act of Parliament in respect of (i) religious or social practices of the Nagas, (ii) Naga customary law and procedure, (iii) administration of civil and criminal justice involving decisions according to Naga customary law, (iv) ownership and transfer of land and its resources, shall

apply to the State of Nagaland unless the Legislative Assembly of Nagaland by a resolution so decides. It clearly states that the 60 Legislative members of the NLA have been endowed with special power. It is thus, the prerogative of the NLA to decide whether any Act of Parliament shall apply in Nagaland or not. Now, coming to the question on whether Article 243 T of the Indian constitution with regard to Women Reservation infringes with the Article 371 (A) or not. Let us have a closer study of Article 371 A. The Tribal Hohos have been advocating that 33% reservation for Women infringes with the customary laws of the Nagas. However, one aspect that needs due consideration is regarding the Article 371 A 1 (a) i) which reads as “religious or social practices of the Nagas”. Here, the “Social Practices” of the Nagas may be put forth for discourse. The term “Social Practices” may subject to varying interpretations. Oxford dictionary defines ‘Social’ as “Having to do with society and its organization”. The term Practice can be defined as “the usual way of doing something” or “to do something regularly as part of one’s normal behavior” or “follow the teaching and rules of (a religion)”. The question of 33% Women Reservation comes into play here because it is contrary to our practices. Although our society is patriarchal, the womenfolk are neither discriminated nor subjugated. In fact, they have always had a fair share when compared with the mainland women. Reservation only implies that they are not treated on equal footing with the menfolk which is not true in our Naga context. But it is also a fact that not a single woman had been represented in the NLA, not even once, although they have made considerable progress in other spheres. The only iconic figure of Naga Women in politics was Rano M Shaiza who represented the State in the Lok Sabha in 1977. Other than that, there is no mention of any Naga Women in the field of Politics. Since the issue is about the upliftment of our women in Politics, it is time we reconsider this issue. Women should be given chance in politics based on ‘Equity’ and not ‘Equality’. The 33 % Women reservation although implemented in its present form would benefit only a handful who have connections with the higher echelon of society. A serious consultation comprising of the Govt., Hohos, Mothers associations and intellectuals should be held at the earliest without compromising Article 371A. Now, there are also some proponents of 33 % Women Reservation who are of the view that the very institution of democracy or the government and its institutions are not in accordance with our customary laws or for that matter even Christianity is not the actual practice of the Nagas and as such should be discarded. But, the very fact, that we gave ourselves to the Indian Constitu-

tion through the Nagaland State Act, 1962 (13th Amendment) which is also not in accordance with the customs and traditions of the Nagas is a clear indication that Customary laws and any tradition and customs of the Nagas can be subject to change in order to keep pace with the changing world. The customary laws can be amended by our legislators after due consultations with the stakeholders without distorting the rich heritage of the Nagas. However, the step taken by the Naga Mothers Association by filing a writ petition and furthermore SLP in the Supreme Court was a grave mistake. It only tantamount to digging our own grave. Did the NMA even think what implications it would have on Article 371 A? Did they not know that the verdict given by the Supreme Court would definitely be in consonance with the Supremacy of the Constitution of India? Or they were of the belief that they would eventually triumph? If they thought of the latter, either they were misguided or they were blinded by the quest for power because the way in which the present Municipal election would have held. It would have benefitted only the fortunate few. It is also surprising to note that the Cabinet had decided to seek the Prime Minister’s intervention to exempt Nagaland from the Part IX-A of the Indian constitution. This is an absurdity in its purest form. This construes that we ourselves are undermining the Power of Article 371 A. It is in the knowledge of every Naga that the State Machinery has miserably failed to carry out its bounden responsibilities. The Fuel adulteration scam, the Food & Civil supplies scam are some of the glaring examples where the present Government made a fool of its electors but a substantial proof was needed and this time they have left no room to show that they no longer represent the aspirations of the people and as such they should step down without further delay. The death of the two young souls in this ensuing conflict was very unfortunate and should not be in vain. This issue although marred with controversies has surely opened the eyes of many Nagas. It has brought together all the Nagas which has long been fragmented by tribalism. The Nagas have finally come to the point of realization that there is indeed ‘Strength in Unity’. Perhaps, it is time we realize that the custodians of the sacred Article 371 A should be upright and true leaders. That they do not just become ministers and MLAs but are elected by us. At the end of the day, it all comes back to square one. Would we choose money or principle? While we are arguing over the issue of women reservation in the ULB election, Tamil Nadu is all set to elect VK Sasikala, the Party’s General Secretary as the next Chief Minister in the next few days. Shouldn’t this be an eyeopener to us!

"I wouldn't say it was worse, but it made it harder. To be frank with you, I actually was going through a really difficult time when they started production. "I went away for 90 days, and I actually met a ton of kids in this place that were talking about issues that these characters are experiencing." Selena grew up in the spotlight as a child Disney Channel star, thanks to her work on the U.S. network's Wizards of Waverly Place, and although her teenage years were unconventional, the 24-yearold insists she was just as "confused" as any other adolescent. "Whether it was just kids or growing up in the biggest high school in the world, which was Disney Channel, it was also adults that had the audacity to kind of tell me how I should live my life," she recalls of her teenage struggle. "It was very confusing for me. I had no idea who I was going to be." Gomez's teenage plight came to life on the set of 13 Reason Why: "I was there for the last episode," she explains. United posts 18% rise in second-quarter revenue

LONDON, FEBRUARY 9 (REUTERS): English soccer club Manchester United on Thursday said it was on course to meet its full-year financial targets as it posted an 18 percent rise in second-quarter revenue despite its absence from the lucrative Champions League. United, whose best known players include Paul Pogba and Zlatan Ibrahimovic, are currently sixth in the 20team English Premier League. The club's adjusted earnings before interest, tax, depreciation and amortisation for the three months to December 31 rose to 69 million pounds ($86.6 million) from 56.1 million pounds a year earlier. Revenue increased by 18 percent to 157.9 million pounds. The club reiterated its revenue target of between 530 to 540 million pounds for the year to the end of June.

BERLIN, FEBRUARY 9 (REUTERS): Future UEFA presidents will be limited to a maximum of three terms and a total of 12 years in the job, European soccer's governing body said on Thursday, after its executive committee approved a set of governance reforms. Past presidents of the organization had no such restrictions, with former chief Lennart Johansson in charge for a full 17 years. Current president Aleksander Ceferin, who replaced disgraced Frenchman Michel Platini in September, has pledged to reform the organization. UEFA said part of the reforms approved by the executive committee was the "introduction of term limits for the UEFA President and members of the UEFA Executive Commit-

tee, with the possibility to serve for a maximum of three four-year terms." Other changes include granting two member positions on its Executive Committee to representatives of the European Club Association (ECA). Candidates for election on the committee must also hold an active office in their respective national association. "I am very pleased that the executive committee gave a unanimous backing to reforms I consider essential for the strengthening of UEFA," Ceferin said. "I am convinced that our member associations will also endorse these good governance proposals to create a stronger and more transparent governing body for the good of European football." The reforms will now need to be ratified at a UEFA congress on 5 April in Finland.
