Breaking up is hard to do….

It may sound harsh but if you’re going to leave your marriage then it’s best to split on 6 April for optimum tax savings and to give you more time to sort out the financial arrangements. This is one tax area that often causes lots of problems… Q: I separated from my wife in February 2013. We are finally getting divorced now. We have two properties, our family house which was in joint names and a buy-to-let, which was just in my name. We have agreed that I will keep the main house and I will gift the buy-.to-let to my ex to live in. My solicitor has just mentioned that I should check out whether there will be any tax consequence. A: When a couple are married and living together, if they want to transfer assets between each other they can do so without a charge to capital gains tax (CGT). But what many people don’t realise is that this tax benefit of marriage disappears at the end of the tax year following permanent separation, not on divorce. So, in your case you lost the ability to transfer assets between one another tax-free on 6 April 2013. Whether or not CGT will be payable depends on the nature of the asset. Your main home will qualify as being CGT free on transfer assuming that it was your main residence throughout the entire period of ownership. This is because of principal private residence relief which is a CGT relief which applies on the sale or transfer of houses which have been occupied as someone’s main home. This relief is also extended for the last 18 months (recently reduced from 36 months) of ownership, so there should not be any tax charge on your ex-wife’s gift of half of the main home to you. There are reliefs which allow trading business assets to be gifted without a tax charge and cash is also exempt. The problem areas are likely to be second homes or investment assets – for example shares, or as in your case, rental properties. Even though no proceeds change hands, if the current market value of the buy-to let property is significantly more than you paid for it, then there will be a taxable gain. Q: I bought the buy-to-let in 1997 for £70,000 and it’s worth £200,000 now – how much tax will there be to pay? A: The capital gain is £130,000 which will be reduced by your annual exempt amount of £11,000. The amount of tax you have to pay depends on your other income but the rate will be between 18% and 28%, so you could have a tax bill of up to £33,320. The lesson here is that for couples contemplating separation, advice should be taken as early as possible, this will avoid any nasty tax shocks down the line, and HMRC becoming an unintended beneficiary of the divorce settlement! The city centre has always been a popular location for buyers and renters. From young professionals seeking the buzz of city life to couples looking to stay close to the action when they set up home together, the appeal of city centre life is widereaching. However, while for many renters the city centre is often an obvious choice, can the same be said for buyers? “We are always seeing a steady flow of buyers interested in buying one of the fabulous apartments on offer in the city centre,” says Katie Myers, branch manager at Keppie Massie Residential. “Aside from the amenities on your doorstep including excellent travel links, shops, restaurants, bars etc there’s also the added security that the area you’re in is almost always going to be popular. In the suburbs areas can be up and coming one minute and old news the next but

the city centre is always going to be the heart of the city and as such will always be attractive to buyers and renters.” Of course, it hasn’t always been plain sailing for the city centre market. While housing as a whole took a battering following the credit crunch and ensuing economic storm, city centre apartments were hit particularly hard. However, with the recovery well underway, such apartments are proving popular again. “City centre apartments are becoming very popular amongst owner occupiers again due to an increase in confidence with banks and buyers following an upturn in economic conditions,” says James Howarth, valuer at Sutton Kersh. “The market suffered for a long time following the recession and the city centre market was one of the worst hit due to a high level of supply and limited buyers.”

One common misconception of city centre apartments is that they are easy to outgrow. There is an idea that once young professionals decide to start a family city centre living may no longer be suitable. But Keppie Massie’s Katie Myers says this is not the case. “The idea that when you have kids you have to move to the suburbs, get a family car and a pet is quite outdated,” she says. “Many of the apartments available in the city are spacious and open plan and work very well for families”. Frances Lyons, sales manager at City Residential agrees. “Most people have already made the decision of whether they want to buy in the city centre when they come to us,” she explains. “We’re finding a lot of people are happy to raise a family in the city centre, if you find the right apartment it’s not really an issue. Apartments like those at the Albany

are really spacious and have a courtyard for outside space.” Interestingly, despite often being thought of as a first step on the ladder for buyers, city centre apartments are also proving popular for buyers later in life. “The types of people who are buying city centre apartments are mainly people who are downsizing from a lager family home in the suburbs and people buying to use as a second home or weekend residence,” explains James Howarth. So what should buyers looking to purchase in the city centre look out for? “Carry out full due diligence,” says Frances Lyons. “This includes researching the development and looking into the freehold/management company to establish if they are both secure. It’s about knowing your developments”. James Howarth says the most

important factor people need to consider when buying apartments is to check the service charge and what it includes. “Service charges can be very high in some cases and this is an additional cost on top of mortgage payments, energy costs and water rates,” he says. “Service charges can regularly increase so you need to be careful to work out your finances to ensure you can account for this. North Liverpool estate agent picked up a trio of accolades at the prestigious Estate & Letting Agent Awards (ESTAS).

Waterloo-based Logic Estate Agents won Best in County for Merseyside, a Gold Award for the North West and the Grand Prix Gold Award for the Best Estate Agent in the UK at the 2014 ceremony. The awards, currently in their 11th year, were presented at the Hilton Park Lane London in front of 700 of the UK’s best estate and letting agents and were hosted by TV personality Phil Spencer. My private landlord has recently told me he intends to sell the property and has given me one month’s notice to vacate. I have been living in it for five years with my family and don’t know how I’m going to find somewhere else that is suitable in that time. Is there anything I can do? Do I have any rights?

I have had an offer accepted on a property and instructed my solicitors to do the necessary work. I would now like to go back to the property to get some measurements and make some plans but, even though the property is currently vacant, the estate agent selling it has said this is not possible. Why is this?

Your landlord does have a legal right to get his property back at the end of the tenancy as long as he has followed the correct legal proceedings. To lawfully terminate your tenancy, your landlord must serve a Section 21 Notice (Notice Requiring Possession) giving you a minimum of two months' notice. There are two types of Section 21 Notices depending on whether your tenancy agreement is still under a fixed period or periodic. A periodic tenancy automatically follows the fixed-term if the parties do nothing (i.e. they do not sign another agreement) and the tenancy will be on the same basis as the original agreement, with all the same clauses and conditions being operative. If you do not leave by the expiry date on the notice the landlord will then need to apply to the court for a possession order.

You should be able to access the apartment. We would never refuse a buyer access to an empty apartment. It could be that the agent thinks it is more practical to wait until you get the survey results back so that if you have any concerns resulting from it you can address them when you return to the property, however if this is the case it should have been explained to you. If not then you should speak to the agent and ask why you have been refused access. We understand that for buyers it is an important time and a big decision to purchase a property, therefore returning for second viewings is vital and something that should be accommodated whenever possible.

I have recently lost my job but I think I have a case for unfair dismissal, however I never actually signed a contract – does that mean I lose any right to take my employer to a tribunal? P. Thomas, L13

In short, no. A contract of employment includes the basic terms of your employment and can be either in writing or agreed verbally. It’s always helpful, however, to have a written contract so that both the employer and employee know exactly what the terms of the employment are in the event that there is any dispute. From 6 April 2012, employees require at least two years’ continuous employment to be eligible to bring a claim for unfair dismissal in the Employment Tribunal (with some exceptions). It is important to remember there is also a strict deadline of three months (extendable through ACAS) from the date of dismissal when bringing a claim or the employee will be out of time. Recent changes have meant that employees are now required to contact ACAS before lodging a claim. Once ACAS has been contacted, the time for lodging a claim will stop to allow conciliation to take place. If the matter is not resolved, a further period of time will be given to allow the employee to lodge a claim with the tribunal.

HOW WILL LETTING FEES REFORMS AFFECT YOU? The fees would-be tenants pay to letting agents have become a contentious subject in recent weeks, with Labour lobbying to ban them altogether. While the government has rejected that plan, it has revealed tough new reforms to how agents go about publicising the fees they charge. But what does that mean for agents and customers?

Under new rules announced in May, letting agents are required to publish a full tariff both online and prominently in the branch. If they refuse to do so they will be eligible for a fine. Previously the Advertising Standards Authority (ASA) required letting agents to list compulsory charges up front, but rogue agents who include hidden charges would only face naming and shaming on the ASA website instead of any strict legislative action.

TARGETING TRANSPARENCY What the changes mean for customers is greater transparency and the government hopes it will ensure tenants are not hit with hidden charges after agreeing to rent a new home. Letting agents have welcomed the changes. Ian Taylor, lettings manager at Reeds Rains, says: “The transparency is really important for tenants as they are aware from the start of their viewing journey that they will need extra funds for fees. Most are now aware that they will need a deposit and advanced rent, so it just makes everything a bit more straightforward.” For the changes to come into effect, the government will first need to amend the Consumer Rights Bill. This will happen at a future stage of the bill and will be followed by a review after 12 months to see if more needs to be done. Ashleigh Sumner, an agent at Farrell Heyworth, says: “We have welcomed this and as the private rental sector continues to grow, transparency around fees is vital to ensuring the lettings industry is trusted by landlords

and tenants alike. For this reason transparency is part of our code of conduct.”

WHAT ARE THE MAIN CHANGES? Labour intended to scrap fees altogether when it announced it wanted to amend the Consumer Rights Bill. However, the government has rejected that plan outright. Housing Minister Kris Hopkins labelled the proposal as a ‘short-term gimmick’ and says: “It would also destroy investment in new housing, push up prices and make it far harder for people to find a flat or house to rent.” Elizabeth Fell, lettings manager at Abode Crosby, adds: “If agents’ fees were to stop it wouldn’t benefit anyone. It could push up the fees agents charge the landlords and landlords would then be forced to increase the rents. Or it may have lead to landlords choosing to let properties without using agents, which leads to tenants not having security in knowing their deposit is held in a deposit scheme.”

WHAT’S NEXT FOR LETTING FEES? Following on from the new rules, the government wants to improve standards in the industry further with the introduction of a new code for management of property in the private rented sector, a voluntary, model tenancy agreement to provide extra security for tenants on longer tenancies and extra guidance for councils to tackle rogue landlords and illegal evictions, including harsher penalties for offenders.

JOB: What does your job entail? Managing staff, assessing vacant buildings, spearheading marketing campaigns, carrying out media work and presenting sales pitches to clients. What’s your favourite thing about your job? Each day is different and you never know what you will see or who you will meet. I’ve done everything from TV and radio work to looking around derelict police stations. What’s your least favourite thing about your job? The travelling. Although I’m based in and responsible for the North West, I spend a lot of time in Birmingham, London and our international head office in the Netherlands. I enjoy being in other places but it’s the getting there I don’t! If you weren’t working in property what would you be doing? Ideally, captaining Liverpool FC and having just lifted the Premier League trophy. In reality, working in business in some capacity. What are you going to do straight after this interview? I have an important sales pitch to an insolvency practitioner this afternoon so I’ll be putting the finishing touches to that then tackling the M62.

My first job was part-time in Topshop. My first full-time job was as a dental nurse, which was really interesting.

HOLIDAY: It was to Malta with my family. I remember

going to Popeye Village, where they filmed the Popeye movie!

RECORD: I can’t remember but it was probably something by Oasis.

As the artistic director of the Liverpool-based dance organisation Merseyside Dance Initiative (MDI), Karen Gallagher has long been championing the art form as a means for the city to express itself. Having inspired and worked with both professional dancers and local people from all walks of life, as well as helping to make dance a focus of the Liverpool’s cultural scene, Karen has already received royal recognition with an MBE and is also set to become an honorary fellow of Liverpool John Moores University (LJMU) next month. We caught up with Karen to find out more about her passion for dance and plans for the city.

INTERVIEW BY NATASHA YOUNG

How did your career in dance begin? It really began during secondary school at Notre Dame High School in Woolton, now St Julie’s, as they took dance quite seriously as part of the PE curriculum. Our teacher set up a whole GCSE programme in the school, and was a really good choreographer. She went on to head up the dance department at Liverpool Community College and from there I started to do other classes at the IM Marsh campus at LJMU with a woman called Irene Dilkes, who trained with the Martha Graham Contemporary Dance Company in America and was instrumental in the London Contemporary Dance Company in the early 70s. Another guy - Elroy Josephs - was one of the first black dancers to be in West Side Story in the West End, and he also taught at IM Marsh so it was quite a special introduction to dance. From there I went to the Laban Centre in London and then came back to Liverpool. What made you want to inspire others through dance as opposed to just being a dancer yourself? At Laban I was considering what it meant to be involved in community dance. There was a whole movement called the ‘dance animateur’, which was all about animating where you live through dance. As part of my course I did a lot of community dance work and was able to set up youth dance companies in London, so when I came back to Liverpool I had that drive to do a bit of performing but also teaching and choreographing with community groups. I worked with what is now known as DaDa, going to hospitals and day care centres and seeing the difference dance made. I then trained people on a Youth Training Scheme and they were involved in theatre training and theatre dance. They didn’t necessarily go into that industry, but it gave them an ability to articulate themselves so they felt confident to go for interviews and get jobs. When I started at MDI I wanted to look at the art form in its own right and support artists to be

in our region to make, present and export work. I also wanted to look at the community side and the difference dance can make to young and older people. MDI is said to be one of the UK’s leading agencies of dance. Did you expect it to have such an impact? We’re one of the more regional agencies, so we’re a smaller organisation in that we don’t really have a building like others and work in partnership with venues and organisations to make sure we’re getting the work out there. We’ve been developing a reputation for really good, interesting and innovative work, both in terms of our festivals but also large scale community dance participation projects. That reputation has been growing nationally, so we do get some national as well as local recognition for the work we do. Does Liverpool’s cultural scene provide many opportunities to broaden awareness of dance? Liverpool has a real opportunity to be one of the greatest dance destinations outside of London. A turning point for MDI specifically was the Capital of Culture year, when we were able to bring some of the best projects to the city. We hosted the British Dance Edition - a big business to business dance affair creating opportunities for 500 national and international delegates to come and see the best dance that was happening. We also did our Leap Festival and supported the work that the city did as part of Dance on the Waterfront. In 2010 we were able to establish the Year of Dance. It was our 18th anniversary at the time and we were able to invite artists that we wouldn’t normally have been able to bring to the city, like Joel Hall from Chicago. It was a real opportunity for us to try new ways of presenting work. You’re about to be named an honorary fellow of LJMU and you’ve already got an MBE. How does it feel to get that kind of recognition? It’s just amazing. I’m born and bred in Liverpool to a very working class family, and when I said to my mum I was going to dance she was like ‘what would you want to be doing that for?’. It wasn’t what the family did so to suddenly be honoured in such a way, both by the Queen with the MBE and then to get the honorary fellow, which was nominated by the dance department of LJMU, is

fantastic. It really means a lot and I feel very privileged. It’s about how I can use it to gain even more recognition, not just for the work of MDI but the work of dance at large in the city. What are you most proud of so far? Personally the MBE was magnificent and getting the fellowship is going to be fabulous, but in terms of the organisation it had to have been in 2010 when we got the Year of Dance off the ground and were having so much going on in the city. With getting the BeMOBO from the MOBO Awards too and appearing on national television, there were so many highlights rolled into one. Where does your inspiration for new dance projects come from? I go to see work around the world in places such as Italy, Holland, Canada and Uganda. You get inspiration from those artists’ work and want to make sure Liverpool gets to see those artists. Then you want to find ways to work with the artists that are in this city to develop their practice. Sometimes an idea will come from me or sometimes it will come from another member of the team. I quite like spontaneity too, where you might just be walking down the street and suddenly there’s a dancer in the window performing or on the street itself like a busker. Those kinds of things interest me when I’m considering a dance programme, but then sometimes it’s just about giving the artist the artistic opportunity. One big project you’ve got coming up is the ‘We Are the City’ event in Anfield. Can you tell us a bit about it? The idea is that the parade will have different groups presenting choreographic formations along the street. They’ll be made up by what participants do, so we’ve got street cleaners, bikers, the ambulance, fire service, people who knit and bee keepers. It’ll be like watching a moving installation of Liverpool life down the road of the city and then they enter into the park, where there’ll be a final short choreographed performance with live music. It’s going to be fantastic, it’s very challenging and we’re all out of our comfort zones a little. These are people who wouldn’t normally dream of being involved in a project so you’ve got to get them enthused, then get them to commit and work with you on the project. The proof will be in the pudding when they perform.

A Liverpool school is celebrating its move to a brand new building by holding a three-day Mission Week event this July. St John Bosco Arts College is moving to the new facility, which is based on the same site as the current school at Stonedale Crescent in Croxteth, in September. The Rainbow of Hope event, which will take place 7-9 July, will feature a number of activities including a talk by Barry and Margaret Mizen, the parents of London school boy Jimmy Mizen who was tragically murdered in 2008. A Dazzle Ship

A

n historic pilot ship with a dazzling camouflage paint job will be revealed on 12 June, as part of the Liverpool Biennial celebrations. Painters at the Cammell Laird shipyard have been decorating the Edmund Gardner ship with the garish design, which creates an optical illusion that makes it difficult to see which direction the ship is travelling. The ‘dazzle ship’ technique was perfected during the First World

War as a way of reducing the likelihood of a German submarine strike and the new design has been commissioned to mark 100 years since the beginning of the war. Contemporary artist Carlos Cruz-Diez designed the artwork for the ship, which has been preserved by Merseyside Maritime Museum. The project was co-commissioned by Liverpool Biennial, Tate Liverpool and 14-18 NOW WW1 Centenary Art Commission, and

the ship will keep the livery until 2015 when it will return to its original state. Ahead of the forthcoming unveiling, Cammell Laird CEO John Syvret says: “The newly dazzled Edmund Gardner will create an important and thought provoking public monument for Merseyside and the wider UK. We are also very pleased to support the Liverpool Biennial in its efforts to encourage visitors and investment to the region."

Renshaw Street, L1 2SJ When it comes to independent shops, bars and cafes in Liverpool city centre, Bold Street’s vibrant offering tends to steal the limelight. However, just around the corner Renshaw Street has long been a hive of hidden gems, quirky curiosity shops and an Aladdin’s cave of vintage wares. It’s no wonder then that its latest arrival, 81 Renshaw, fits in perfectly. The arts cafe and venue recently opened up without a fuss, but is already pulling in crowds looking for a creative and laid back environment. As my dinner date and I paid an early Friday evening visit, 81 Renshaw was busy and buzzing with chatting diners, as well as those simply popping in for a relaxed drink. Meanwhile an acoustic live music performance was taking place, providing entertainment and adding to the atmosphere but not overpowering the small space. On Friday and Saturday nights 81 Renshaw serves a mouth-watering selection of homemade tapas with all dishes priced at £3.50 each, or a very reasonable three for

£10 including bread and oil. At a quick glance, every dish sounded as delicious as the next and I was relieved when the ladies behind the new venture offered to pick out a selection for us. All that was left for us to do was grab a drink from the choice of beers, wines and spirits, and wait patiently for our platter to arrive. As we perched by the window – a perfect spot to watch the world go by – we spent our short wait for food browsing the collection of art for sale on the walls, as well as the mismatching vintage furniture and eye catching trinkets on display. A bowl of seasoned and still warm popcorn also tickled our taste buds before the main feast. When our tapas dishes arrived, they were clearly homemade and fresh. A portion of olives – a staple of any tapas evening – was accompanied by delicious, sizzling chorizo cooked in sherry. A highlight of the meal, the chorizo was tender and came with a spicy kick, meanwhile slices of halloumi in olive oil and chilli were

also cooked to perfection. As we eagerly tucked in to try a bit of everything on the plate, whilst cautiously trying not to fill up too soon, we couldn’t help but quickly mop up the beautifully textured dollop of houmous, which was sweetened with caramelised onion and was a perfect match for the selection of breads. Small but hearty dishes of Albondigas – pork meatballs in tomato sauce – and goats cheese with walnut and honey were also full of flavour, and the baba ganoush aubergine dip was a refreshing way to round off our selection. We left feeling satisfyingly full and ready for Friday night drinks around town, although with such a warm and welcoming atmosphere you could happily see the night through at 81 Renshaw. Alternatively its delicious sounding breakfasts, lunch time sandwiches and homemade soups, including vegan, vegetarian and glutenfree options, make it a perfect pit stop at any time of the day.

CITY HOSTS FIRST ROCK ‘N’ ROLL MARATHON

unners and rockers came out in force as Liverpool hosted a marathon with a musical twist. The city’s first Rock ‘n’ Roll Marathon took place over the bank holiday weekend, combining a gruelling 26-mile running challenge and half marathon with a line-up of live music performers entertaining crowds of spectators. Runners set off from Albert Dock, with England Rugby International and Strictly Come Dancing star, Austin Healey officially starting the sprint. The Christians and The Farm led a line-up of over 30 local performers on the day, as the route took fundraisers and fitness enthusiasts around the city and back to a waterfront finish line outside Echo Arena Liverpool.
