Despite the initial opposition to Home Information Packs, they have become a firmly established part of the conveyancing process, and will soon become even more user-friendly.

What’s happening with HIPs From 6 April, sellers must have a HIP in place as soon as a property is marketed. The list of compulsory documents is also to increase and set to include a Property Information Questionnaire (PIQ). Introduced to provide potential buyers with important information about a property for sale, HIPs have been criticised in the past for being both too onerous on the seller, and for not going far enough in providing the necessary information for buyers. However, according to a 34 Your Move

government survey the latest figures on HIPs show that consumers are already benefiting from their introduction. More than one million homeowners are now aware of their energy ratings as a result of the inclusion in the pack of an Energy Performance Certificate which, in turn, is helping people save money on their fuel bills and cut carbon emissions. Another effect has been greater competition in the property searches market, with some local authorities reducing their search fees by up to £120.

From the sellers’ point of view this is the cloud’s silver lining, considering they have had to take on responsibility for obtaining the local searches from buyers. Fred Dures, of The Dures Partnership, commented :“Estate agents now need to revisit their HIP provider and arrangements they have, to ensure they have a fully compliant HIP for day one marketing, and not to be deceived by low headline HIP costs as additional costs are usually in the small print." In addition to the required documents, which must be

within a HIP, there are a number of optional documents that can be included, depending upon the seller’s requirements. Further searches (usually the responsibility of the buyer) can go in although, as their accuracy can only be relied upon within three months of the search, it is advisable to leave them to the buyer. Tom O’ Clee, Energy Reporter, commented: “As the questionnaire is filled in by the vendor the information is free and should, therefore, not cost the HIP providers anything. The PIQ should improve the

quality of the HIPs and give potential purchasers valuable information.” He added: “HIPs have finally grown up and they are here to stay. The days of massively overpriced HIPs are numbered. The days of rogue HIP and search providers are numbered and we at Energyreporter could not be happier to be leading the way.” Paradoxically one of the optional documents is the Home Condition Report, which was originally to be the bedrock of HIPs. A form of mini-survey (but without the advice) the HCR was intended to speed up the conveyancing process by helping buyers and mortgage lenders secure valuations, thus eliminating the need for a physical inspection of the property. The Council of Mortgage Lenders, however, was reluctant to rely upon anything less than a traditional survey and so the HCR’s inclusion was demoted to optional rather than compulsory. Housing Minister, Margaret Beckett, believes that the changes to HIPs will improve the home buying process. Issues connected with a property, such as the neighbours, traffic, local amenities and services, are often as important to a buyer as the property itself. As it is the duty of seller to answer the questions truthfully (for example, by disclosing any disputes they have had with neighbours) buyers can be assured that they have a clearer picture before signing the contract. Paul Bibby, Managing Partner at MSB Solicitors, believes that the importance placed upon energy efficiency within HIPs will secure their future. He said: “The government place great store in the information that the Energy Performance Certificate provides in connection with their obligations to climate change.” Creating a HIP There is nothing to stop sellers preparing their own HIPs but the prospect may be daunting. This has led to the growth of

Sale statement This includes basic information such as: address; whether the property is freehold, leasehold or commonhold; registered or unregistered; being sold with vacant possession or not and in what capacity the seller is selling the property.

HIP providers who offer the service to sellers, in addition to estate agents and solicitors who can also provide them. Care must be taken when choosing who will create the HIP, due to the rigorous legal requirements - it’s an offence to leave out a compulsory document or to include any form of advertising. Skill is also needed when prioritising which optional documents will maximise the property’s marketing potential. Paul Bibby believes that many HIPs are being prepared on the market with hidden payments. “I would like to see solicitors taking control of the HIP market allowing clients to negotiate their best possible deal with an estate agent to sell their house.” In this way the seller should be able to separate what is being paid for both legal services and estate agency. Sellers You have responsibility for making sure that if the property is to be marketed after April 6 a HIP is prepared in time. You also have responsibility for paying for the HIP. Certain important documents must be no more than three months old so if property is on market for longer remember to renew the necessary ones. Whether you hire an estate agent, solicitor or HIP provider make sure it is signed up to a code of practice, such as the HIP Code.

Buyers If you are interested in a property ask whoever is advertising it for sale for a copy of its HIP. You must receive a copy of the pack free of charge, although you may be charged a reasonable fee for the costs of copying and postage. The following compulsory documents must be included in your HIP: Home Information Pack Index The index lists the documents in the pack and, where a document is missing, must state the reason why and list the steps being taken to incorporate it. Property Information Questionnaire (from April 6) This needs to be competed by the seller. It provides a helpful overview of the property and connected issues such as neighbours and boundaries (Beware, as failure to complete truthfully could result in a potential misrepresentation claim by a future buyer.) Energy Performance Certificate The EPC gives homeowners – and potential buyers information about the energy efficiency. In an effort to increase the rating, and make it more saleable then, sellers should consider cavity wall and loft insulation before marketing a property.

Evidence of title To prove who owns the property: registered will require official copies from the Land Registry and unregistered will require an Epitome of title (all documents which prove at least 15 years unbroken ownership.) Standard Searches Local land charges register for the property being sold. A search of the records held by the local authority on matters of interest to a buyer (for example, road building proposals, traffic calming initiatives.) Details of the provision of drainage and water services. In addition to these compulsory documents leasehold properties must provide a copy of the lease and new build homes must offer a Sustainability Certificate showing information about the environmental impact of the development.

Q A visitor to my property recently suffered an accident and is seeking to bring a claim for compensation against me. What should I do?

A If you own your property as the occupier in control of it, it is your responsibility to ensure that any visitor is safe and does not suffer an injury. You need to carefully investigate the alleged cause of the accident to determine that the alleged incident was your responsibility. For example, if it was caused

by a defect in the property that may well be your responsibility, however the visitor’s own actions may have contributed to the incident. Depending upon the nature of the allegations you could seek to reduce some or all of your liability by way of the visitors own contributory negligence.

If you have received a letter seeking to bring a claim for compensation from anyone acting on behalf of the visitor you should acknowledge receipt of the letter within 21 days, that will then give you 3 months in which to investigate the alleged accident and make any proposals for settlement, if appropriate. You should immediately notify your insurance company, including household contents insurance which normally covers such incidents, of the accident, even if no claim has been notified to you. Most insurance policies include a contractual requirement that you must notify the insurers immediately of any potential claim and if you fail to do so your insurance company could seek to avoid to cover you for the alleged claim. Once you have notified your insurer they normally take over conduct of the matter and if necessary appoint solicitors on your behalf to investigate the alleged accident. It is crucial to have sufficient insurance cover in place to avoid such occurrences. If there are any defects which you would believe would cause an accident you should immediately repair them and ensure that until they are repaired that you take sufficient precautions to prevent any accidents. In bygone times, West Derby had a castle and a royal hunting ground, as recorded in the Doomsday Book. Today, West Derby Village is still famous for its historic courthouse, which still stands today, and opens its doors to the surprisingly small interior on summer Sundays from 2pm until 4pm. Along with the yeoman’s house, which also dates from 1586, it is the oldest building in the village. More recently, the Casbah Club has become known for hosting The Beatles, tying the area into the city’s musical history. When the village’s cultural past is not the central focus, the rest of the week sees the sleepy suburb enjoy passing trade in

the local shops and dog walkers make tracks through the nearby parklands. The Village Cross is certainly a point of interest for visitors. Designed by Eden Nesfield, who also designed the three red brick Victorian cottages behind the cross, it was built between 1861 and 1870. King John is represented at the top of the cross, linking the village to the Magna Carta. It’s said that King John had strong links with the area, donating money for the castle to be fortified against invaders. In the centre of the village, a stone drinking fountain bears the inscription ‘Water is Best’ – perhaps an antidote to the plethora of pubs in the square today. On the high street of local shops, a florist’s and a post office sit near to a traditional butcher’s shop, which now

also sells fish and groceries. Alan Nicholson bought the shop 25 years ago, and has worked in it for 30, starting as a Saturday boy. He grew up locally before moving to Huyton with his family: “We’re a local shop, and if I don’t see someone for a while then I’ll ask another customer. There’s a nice community feel. I started to stock fresh fruit and vegetables, and eggs and dried goods, as some of the older couples who come in like to be able to pick up a few things in one go. “Meat is my specialty, and it’s all British, but I started selling fish after the fishmonger closed.” The counter also contains a selection of cheeses and other goods to rustle up a healthy meal: “Since Jamie Oliver had a recipe for pork shoulder,

I’ve had some special requests for it, but we serve the full range of classic joints here,” said Alan, as he rearranged the window display. A rare site in many suburbs, it’s to be hoped that local support will keep the high street of shops busy. Adam Rastall from Belvoir Lettings in West Derby commented that West Derby has always attracted families, because of the local amenities and access to schooling: “The typical properties in West Derby tend to be three bedroom semi-detached homes, but in the past five years there has been a large rise in apartments with several different types popping up here. “The prices range from £500 for a two bed apartment up to £1200 for some really

How did you get into property? I’d always been interested in the hotel industry having studied travel and tourism at school. I took a receptionist job but wanted to further my career and branch out. I felt that there were more opportunities in property and that being able to help people find the right home would give me great job satisfaction.

How has your career progressed? I applied to Homelets for an administration role and after six months was promoted to lettings negotiator which has allowed me to grow and progress. The role is challenging but interesting as each day is so varied. Moving home plays a huge role in people’s lives! I’m lucky enough to meet so many different people, each with a different story. Seeing the smiles on their faces when they find the home they’ve always wanted is very rewarding.

Which tunes are currently on your iPod? At the moment top of my playlist are Kings of Leon and their ‘Only by the Night’ album as I love Caleb Followill’s raw and edgy vocals, although Pink is my all time favourite artist! I’ve got every album she’s ever done and can’t wait to go and see her at the ACC in April.

A. There is a special HM Revenue and Customs concession which allows small companies to avoid a full liquidation at the end of their life. Extra Statutory Concession C16 (ESC C16) is often used alongside a ‘strike off’ of unwanted companies and the distribution of the assets to the shareholders as a capital distribution. The concession effectively puts the owners of the company in the same position as if they had followed a formal liquidation route, and allows them to take advantage of significant tax advantages. Without the benefit of the concession, the recipients of the assets remaining in the ‘struck-off’ company at the end of its life would be taxed on an income distribution, just like a dividend. This would leave higher rate taxpayers with a 25% tax liability on the funds distributed. The concession means that Capital Gains Tax applies, meaning a maximum tax rate of 18% – which would reduce to a rate of 10% if Entrepreneurs’ Relief was available on the distribution. The annual exemption for Capital Gains Tax can further reduce the amount of tax payable. Q. How do I go about doing this? Are there any problems with going down this route? A. You will need to seek clearance from HMRC. As ESC C16 is a concession, HMRC do not have to agree to it. The main reasons that they may not allow you to proceed are as follows: Outstanding tax matters – such as waiting for a form to be filed, tax to be paid or if they are considering an enquiry into some aspect of the company’s affairs. Tax advantage – if they consider that ESC C16 is being used to give a tax advantage to the shareholders of the company. This would apply for example when, after closing down one company using ESC C16, a new ‘phoenix’ business was set up. My experience is that most genuine requests for clearance at the end of a company’s life are granted, although you should be aware that HMRC have recently announced a question mark over the future of ESC C16, so the time available to take advantage of this valuable concession may now be limited. There are other important considerations, so you should take professional advice before proceeding. As with many decisions you really do need to take independent financial and tax advice. Movers Why did you choose this property? We were struggling for space, which we now have loads of one of the bedrooms has even been transformed into a dressing room for Paula’s clothes and shoes. It looks amazing, and we’ve decorated it in blue and silver. How is it laid out? The unique style of this particular town house is that the third bedroom is built into the roof space, so as well as creating more room it also looks compact and neat. What are the benefits of buying a new-build? You can decide which added extras you want before the house is ready. We chose to upgrade it so that the whole house is fully fitted with dark wood and is carpeted upstairs. Our kitchen has been tiled beautifully too. How have you decorated the dressing room? We’ve found that mirrored furniture suits the room perfectly. We fell in love with it after seeing very similar items in Next and then, luckily, finding it all on sale at BHS. The wallpaper is from Monsoon and lights up the mirrored surfaces really well.

What unique touches have you added? We have four-foot high leaves from the Lotus Rooms in the living room, and the patterned chair is from DFS. We found our dining table and chairs on a fantastic website www.quatropi.com and the light was a great buy from Argos. In the kitchen we have quite an unusual clock from Utility, designed with kitchen utensils.

What would be your dream buy for the house? If money was no object it would have to be a heated swimming pool, although I don’t know where we would put it…!

What’s your theme? Most of the rooms are black and white with just a flash of colour. In the living room we have colour from the red sofa and big round mirror made from tiny pieces of red glass we found at the Lotus Rooms. Both our bedroom and the living room are black too. The black gloss furniture looks amazing but needs constant dusting to keep it looking sleek and shiny.

Deborah Shackleton Interview //// TALENT IN THE CITY

With 30 years’ commitment to residents in Liverpool – currently 53,000 tenants Deborah Shackleton, Group Chief Executive of the Riverside Group, has secured her place as an honorary Scouser. She spoke to Your Move about her life in and outside of work.

In my Liverpool home What directed your path towards a career in housing? It was actually a chance happening. I had trained with the Tourist Board in London but wanted to relocate to the north of England. A job came up in Liverpool in 1980, I applied for it, and I’ve been here ever since. When I first arrived in Liverpool with my husband, who also had an interview, it was a very wet and rainy day. I slipped in Church Street and 60 Your Move

at least three people rushed over to help me, making sure I was alright and offering cups of tea to make me feel better. It was a wonderful welcome to the city and I have never forgotten it. Coming here was a fantastic opportunity and I’ve loved every minute of it. It really has been a privilege, as what we do at Riverside impacts upon people’s lives, and I consider myself very lucky. I work with such fabulous people that it is a pleasure to come to work.

What do you consider to be your greatest achievement at Riverside? In the time I have been here it has grown massively, and I believe that both the quality and the reputation of the service we offer has improved. I am really proud that we were awarded Social Landlord of the Year in 2008, in recognition of what we do for our customers as well as how we operate as a company. As a housing association we have a long history of transforming lives and revitalising neighbourhoods. Especially unique to Riverside is the staff, made up of 2,500 people who help make us more than just a landlord concerned with the bricks and mortar. We have initiatives such as English Churches’ Housing, which has done some fantastic work with vulnerable and homeless people. What do you think are Liverpool’s unique points in terms of housing? The city has a strong legacy of industrial housing, look at the amount of terraced properties we still have, but many are not as suitable as they were in the 20th century. As a city Liverpool is rising to the challenge of investing in more choice, which in turn leads to more properties for a wider range of people with different housing needs. When the transformation of council housing took place, with stock transfer, I was very involved with housing corporations and witnessed how unique Liverpool was in terms of its community activism. Local communities were skilled enough to develop and design their own homes in response to their needs. Deborah, how do you relax outside of work? I try to spend as much time as I can with my family, go to the cinema, meet friends for dinner…basically I work hard but also play hard. One recent hobby that has

become quite addictive is researching my family tree. When I have an hour or two to spare I browse the Web for interesting ancestors. Already I have made some fascinating finds: a possible murderer from the 1700s and a Shackleton relative - the name comes from Shackleton weavers - who lived in Hawarth and actually conducted the marriage service of a Patrick Bronte!

“As a housing association we have a long history of transforming lives and revitalising neighbourhoods.” What does Liverpool have to offer in terms of a work/home life balance? It is a fabulous place to live. I moved here in 1980 and have enjoyed every minute. In terms of work life I have witnessed a growth in job opportunities; as a governor at John Moores University we have attracted science and knowledge jobs with the introduction of the Science Park. Then there is the growth within the creative industries. Outside work there is lots to do - museums, galleries, yet all within an area small enough to bump into friends whilst out and about. The regeneration has also made a huge difference over the past year. What was the best piece of advice you have ever received? Don’t try to be what you you’re not, but be who you are. And always try to support your colleagues.

Baroque as a design movement which started around the beginning of the 17th Century in Rome, Italy, signifying drama and grandeur. //// MARYA MCCANN INTERVIEWS TOMMY CONSTANTINOU AT RAVEN IRISH AMERICAN BAR

The Guinness at Raven’s Irish American bar is the best in Liverpool, so I was already sold when I arrived to meet my guest. Yet, I hadn’t really taken in my surroundings until I came to meet Tommy Constantinou, the lettings manager at Andrew Louis. I scanned the room: dimly lit but for the evening light in the dock hitting the room through huge windows, and moss green walls covered with shelves of dusty books, chamber pots, jugs, and pictures of Victorian eroticism and vintage adverts – this was no clichéd Irish bar with The Wild Rover on a loop. Putting an Irish American bar inside a dock’s exwarehouse is fitting; think of the indoor scenes in ‘Gangs of New York’ to get the picture. The shabby sofas, old scuffed tables and colossal glass lanterns manage to make Raven look as though it has been here for years and years and years. Even better was the background music, a combination of traditional Irish music and Bluegrass. Tommy arrived after a busy

week, with still more to do. Market conditions are massively different this year and the firm has had to adapt. Said Tommy: “In response to the circumstances we now have a really varied client base, from footballers at the top end of the property price range downwards.” One such change is that the firm now accepts housing benefit from tenants who have lost jobs. The menu is steered towards dishes inspired by typical Irish homes but with a twist: fish and chips is beer battered cod using Caffrey’s beer and the sirloin steak is from Irish beef with an Irish whisky sauce. We decided on food from the bar menu, a farmer’s board for me and country paté with pickles for Tommy, who was pleased that such a large serving of paté did not have an overbearing taste. Instead, it was mild enough to spread thickly with the pickle onto two slices of toast. My wooden block was covered with studded ham, olives, gherkins and three very big blocks of cheese. As we ate Tommy talked me through the refurbishment of

the Andrew Louis office on Stanley Street, which has been causing a stir. “It’s now fully fronted with glass,” he said, “People keep walking past and assuming there’s a new bar. We have a café-style front of house, where our clients can meet and talk to negotiators so it’s much more informal and comfortable.” The firm celebrates its 20th anniversary this year, and is always looking at the best ways to serve its clients. It currently manages over 3,500 units in the region. When I asked Tommy about life outside of work cooking came out as a clear-cut winner, even ahead of football. He said: “Being part of a Greek family from Cyprus it’s quite obvious where my main interests will be. I’ll spend as long as possible planning what I’m going to make when I have a full day to prepare.” As he got ready to leave for the next meeting Tommy remembered one of his future ambitions, which is connected to his love of cooking. “I’d love to establish my own Greek restaurant,” he said. Liverpool Fashion Week celebrated all things stylish with various events across the city. One of the highlights had to be the free catwalk shows at Liverpool One, showcasing an array of chic, colourful offerings from various Liverpool One stores. Students from LIPA took to the catwalk to model clothing ranges from Karen Millen, Suits You and Oasis to name just a few. The main theme of this particular show being ‘at the races’, it was an ideal opportunity to gain inspiration for the spring wardrobe. Excited crowds gathered to enjoy the show and partake in some late night shopping as Liverpool Fashion Week drew to a close. A live model also appeared in The La Senza store window earlier in the afternoon to model the latest underwear collections, causing quite a stir!
