Q&A With Derek Dawson, Solicitor (Litigation Department) Q I have a tenant who owes rent and has promised my managing agent to pay the arrears, but the tenant has failed to do so. My agent has suggested that I take action to evict the tenant so that the property can be relet. I am reluctant to take action against the tenant as previously she has paid the rent, what should I do? A I agree with your managing agent, you should take action against your tenant. With the economy still suffering regretfully tenants are increasingly falling behind in paying rent, particularly where paying debts are being prioritised and those that are being pursued are the ones that get paid. If you take no action the rent arrears will increase and adversely affect your financial position, particularly if you have a buy to let property and the rental income is used towards the mortgage. The longer you don’t take action the higher the arrears will be and the less likely the tenant will be able to pay them. As long as there are more than 2 months rent arrears you can issue a Section 8 Housing Act 1988 notice, notifying your tenant of the amount of unpaid rent. If there are less than 2 months arrears your agent can write to pursue the rent arrears. If the tenant is serious about her promises to pay the rent and arrears, she can contact your managing agent and pay them. Alternatively if you are agreeable, she can enter into an arrangement to pay the existing rent and a reasonable amount from the arrears. The tenant must keep to that arrangement and continue to pay the existing rent and reduce the arrears. If there is no payment of the rent and a Section 8 notice has been issued, you can issue Court possession proceedings. You would be entitled to an order for the eviction of the tenant and a Court judgment for the amount of the rent arrears. If an offer is made after the Court proceedings are issued by the tenant for her to pay the existing rent, and a reasonable amount from the arrears, and you are agreeable to this, a postponed possession order can be granted by the Court. That will allow you to enforce the order and seek the eviction of the tenant if she fails to keep to the agreement. The postponed order should concentrate your tenant’s mind, and, if she is serious about paying the rent it will allow her to remain in the property while also protecting your interests. New vision for Kings Park Plans to modernise Seaforth One Vision is to spend £20m modernising three high rise tower blocks in Sefton. The works by the Bootle-based social housing provider will see improvements to Montgomery, Churchill and Alexander Houses in Seaforth. One Vision also aims to remodel the open spaces around the Kings Park area over the next few years. The Kings Park plan will incorporate ‘Home Zones’ in an attempt to improve conditions for pedestrians and residents. The measures include reducing traffic speeds to 10mph, improving street lighting,

“I have been trying to sell my property through an estate agent for a number of months. Whilst there have been a number of buyers interested, their offers have been below my asking price. I am keen to sell sooner rather than later. Would selling at auction be a better option?”

A

Property auctions can provide the fastest route to achieving a sale. The whole process from marketing to completion can take as few as eight weeks. Not every property is suitable for selling through auction. In general, chain free properties, dwellings in need of substantial repair or modernisation, and buildings that have quirky appeal or that are difficult to value make ideal lots. If you are unsure as to whether your property falls into one of these categories then seek professional advice from a local auction house. Initial market appraisals are free and there is no obligation on you to proceed. Success at auction is achieved by setting realistic reserve and guide prices. Whilst the valuation figure will be lower than if sold through estate agency methods, there is no price ceiling at auction. Auction creates the opportunity to bring all interested purchasers in to one room. If a bidding war ensues, buyers can end up paying more than they would have done had they been given more time to negotiate. When the gavel is brought down, a legally binding contract is formed between the buyer and the seller. The buyer must pay a 10 per cent deposit immediately and the remaining balance within 28 days. This not only means a quick cash flow injection for the seller, but also makes the chance of the buyer gazundering or withdrawing from the sale negligible, which can often be a problem when selling through an estate agent. If your property is sold at auction, then you will be able to identify the date by which the sale will complete allowing you to plan ahead more effectively. I am thinking of letting out one of our family’s properties, but am not sure where to start and I don’t want to overlook potential costs. Do landlords and tenants get a good deal from their managing agents?

A

Many people are tempted to bypass the managing agent, and follow the ‘Do It Yourself ’ property management route. As a reputable managing agent, I believe that this is dangerous ground for the inexperienced simply because there is so much legislation and regulation attached to letting a property nowadays that you could fall foul of the law without even knowing it! Quality managing agents help landlords to achieve optimum rental levels. From thereon, they have access to strong internet marketing such as Rightmove (which doesn’t allow individuals to advertise on it). Agents also have a database of applicants waiting for property; they carry out all the referencing enquiries, take the deposits, submit it to the appropriate scheme, and draw up the tenancy agreement. Once a tenant is moved in, managing agents carry out inspections to ensure that the conditions of the tenancy are maintained in addition to rent collection, and maintenance issues. Unless you’re a full time professional landlord, all the above is a big ask to keep your tenants happy. Good managing agents engender good positive relationships with your tenant, ensuring that there are no issues which would colour the tenants’ time at the property unfavourably. It’s the managing agent that will attend the property to fix a faulty boiler at three in the morning, so the landlord doesn’t have to get out of a comfy bed and the tenant is happy because he is being looked after. What about the bathroom?

What’s the area like? The development is really handy for the Cables Retail Park and other amenities such as Prescot train station. For families, Prescot Primary School is a couple of minutes away.

The master bathroom has a big bath and is finished in classic white, while the showers in the en-suites are larger than you’d usually find in most homes. They have been really generous with the bathrooms.

What were your first impressions? The size of the house is really impressive. It’s over three floors. The development as a whole seems really spacious. As you enter you notice how clean and modern and well appointed everything is. As with most new builds the house retains heat well and there’d be no work needed when you moved in.

Tell us about the living room... It’s a through room so there’s plenty of light. The furnishings are contemporary, as they are throughout the house, while the predominant theme is black and off-white with splashes of colour. They’ve used a leather suite and stylish wooden furniture. It was a pretty comfortable room to relax in.

And the kitchen? This was probably my favourite space in the house and I imagine they prove pretty popular at Speakman Gardens. I found the black granite worktops and black floor tiles complemented the wooden units. There was so much space to work in. The dining area easily seated six and I could imagine you’d spend a lot of time socialising in there.

What was your favourite feature of the house? I was really impressed by how light it was and the skylights are a nice touch. As you enter there’s a retro Dr Evil style chair which was cool and I’ve never seen anything like the doggy wallpaper in the top floor bedroom! I think that was my favourite thing in the house.

Take us upstairs... The show home has two double bedrooms, each with en-suite, and another two bedrooms on the top floor, together with a master bathroom. There are four toilets in total, to give you an idea of the space in the homes.

Tell us about the bedrooms... There’s an impressive finish to all of the bedrooms, each of which are light and airy. The room I stayed in had a really bold feature wall, offset by some mirrored furnishings, and there’s plenty of space in the fitted wardrobes. On the top floor you’re given a feel of how the bedrooms could be decorated with children in mind, as the homes would be an obvious choice for families.

espite approaching her 50th year, actress Imogen Stubbs manages to maintain an adolescent charm which could easily present her with roles as a happy-go-lucky twentysomething. Fortunately for Liverpool theatre fans she will soon appear at the Playhouse as troubled southern belle Amanda Wingfield in the forthcoming production of the Tennessee Williams classic ‘The Glass Menagerie’. She talked to Jonathan Kearney about the types of roles she covets and how she is looking forward to experiencing the city’s nightlife.

This is the second Tennessee Williams play you’ve performed. What draws you to his work? His plays are always very challenging and the language he uses is so poetic. They’re real character parts. Are you enjoying taking on the role of Amanda Wingfield? Yes, the play as a whole is going really well. We’re learning from each performance. It takes a while to get to grips with the character and last night’s 42 Your Move

performance was the first time I felt it was really funny. I hadn’t really seen it as a funny play until then but you forget that it can be really quite witty. As I look much younger than I am there’s an audible gasp from the audience when it’s established I’m playing the mother of one of the characters, which is crazy because I’m actually six years older than Amanda. I’ve had similar problems before. It’s just a case of convincing the audience.

Are you excited by the prospect of performing in Liverpool? Yes I am. I’ve never performed in Liverpool before but I really believe in regional theatre. I think the play will have really settled in by the time we come to Liverpool. I’ve got a good friend there and I’d like to bring the family up. It would just be nice to see the city. Which types of roles would you like to try your hand at in the future? I’d quite like to play villains

or just people who are generally unacceptable. I haven’t really played that type of character yet and I haven’t played character roles very much. Would you like to keep acting into your later years? No, I’d like to travel the world. It’s not nice having the camera pointed at you. Ageing is hard in high definition. What are some of your favourite destinations? I like adventure-lite because I hate mosquitoes! I’ve been to

Africa and it wasn’t for me. I love Chile and Thailand and riding in the mountains and I also love Alaska. I love elsewhere basically. What are your other passions away from work? I like dancing, so perhaps I’ll try some of the Liverpool nightlife while I’m there! I like writing stories and I’ve got various things in the pipeline. Of the actors you’ve worked with, who have you really admired? Lots really. I loved Paul

Scofield, Vanessa Redgrave, Ian McKellen, Kate Winslet, Emma Thompson. I’ve been very lucky. Do you have any new onscreen projects in the pipeline? Not really. I’ve just been asked to do a film but I’m not very comfortable without the rehearsal process you have in the theatre. I do like comedy however and I’d love to be in something like ‘In the Loop’ or ‘Green Wing’. That kind of batty, eccentric comedy really appeals.

And finally, what’s the best piece of advice you’ve ever been given? Be brave enough to make a fool of yourself. It’s important to keep getting back on that horse. Jamie’s Italian for Liverpool One Celebrity chef Jamie Oliver is bringing his first north-west Jamie’s Italian restaurant to Liverpool with Grosvenor. Oyé lineup announced

The annual celebration of African music and culture in Sefton Park, is set to take part on 19 and 20 June this year, with dance workshops, drumming and percussion workshops, and holistic therapies. Chris tucks into his

grilled Old English sausages with mash and sweet onion gravy with relish. For dessert, Portico offers a vast selection from hot chocolate fudge cake to mango and passion fruit mess. Chris is currently taking on accepting properties across north and south Liverpool, St Helens and Widnes, for sale or let. Over cappuccino, Chris and I discuss the underlying approach at Modo Homes, where passion, integrity, and hard work are fastheld principles: “I don’t believe there’s a magical formula to being successful. You just have to work to the best of your ability.”
